CALL TO ORDER

Chairman Mark M. Finkle called the meeting to order at 10:00 A.M.

MOTION TO ADOPT OR REVISE THE MEETING AGENDA

Chairman Finkle asked for a motion to adopt the agenda. Mr. DeWitt made a motion to adopt the agenda. Mr. Rosenthal seconded. The Board approved the motion by unanimous vote.

PUBLIC COMMENT

Chairman Finkle opened the meeting to public comment. Three individuals addressed the Board regarding conditions imposed by a December 2015 permit issued by the APA approving a subdivision application. The speakers, including the applicant, his attorney, and the purchaser of one of the subdivided lots, sought relief from these conditions and clarity regarding HRBBRD’s position on any access permits associated with the subdivided lots. The owner of an eligible property questioned the equity of being placed on a waiting list for an access permit, noting that she believes the Regulating District holds the fee submitted with her access permit application. A pair of permit holders alerted the Board to loud and disquieting behavior and spill-over from an adjacent DEC/municipal access permit area, and thanked staff for working with them to address the issues.

APPROVAL OF THE JULY 7, 2020 REGULAR BOARD MEETING MINUTES

Chairman Finkle asked for a motion to adopt the July 7, 2020 regular board meeting Minutes. Mr. Rosenthal advanced the motion to approve the regular and special meeting minutes. Mr. Bird seconded and the Board approved the motion by unanimous vote.

REPORT OF THE EXECUTIVE DIRECTOR Mr. Callaghan presented his report to the Board. Mr. Callaghan noted that the Regulating District remains in Phase 4 of the COVID-19 reopening plan. He commended staff for their professionalism and dedication. Mr. Callaghan indicated Beth Moeller of Interactive Media Consulting, LLC will roll-out to the Board a beta version of the online permit system in the next several weeks and will then be available at the October meeting to outline the planned online permit system’s transaction capabilities. CONTRACTS/ACTIONS RESOLUTION APPROVING REVISED ACCESS PERMIT FEE SCHEDULE FOR GREAT SACANDAGA LAKE EFFECTIVE JANUARY 1, 2021 Mr. Callaghan presented a resolution revising the schedule of access permit fees authorized by the Rules and Regulations Governing Use by Permit Holders of State-Owned Property at Great Sacandaga Lake (6 NYCRR Part 606). He reminded the Board that the “Access Permit Fee Review Working Group”, comprised of existing stakeholder organizations around Great Sacandaga Lake including the Sacandaga Protection Committee, the Great Sacandaga Lake Association, the Town of Day Property Owner’s Association, Edinburgh Marina, Board members and staff, recommended the fee changes which were presented to the Board at its July 7, 2020 regular meeting. Mr. Callaghan further explained that, pursuant to 6 NYCRR §606.68, staff published notice in each officially designated newspaper, once a week for three consecutive weeks, and in addition thereto reached out to the community through the HRBRRD website, its newsletter and through social media. He noted that the requisite thirty day waiting period from the date of presentation of the proposed revised fee schedule has expired and that, as of this meeting, staff have yet to receive any negative comment on the proposal.

Chairman Finkle thanked Mr. Callaghan for the presentation and opened the floor for public comment upon the proposal. A representative from the Sacandaga Protection Committee, spoke in favor of the proposed fee adjustment.

Noting the positive feedback received, Mr. Callaghan recommended that the Board adopt the resolution setting the access permit fee schedule; effective January 1, 2021. Chairman Finkle asked for a motion to adopt the Resolution setting the access permit fee schedule effective January 1, 2021. Mr. DeWitt so moved. Mr. Rosenthal seconded and the Board approved the motion adopting the resolution by unanimous vote. STAFF REPORTS

Mr. Leslie presented his report. He noted that at the request of the Joint Commission on Public Ethics (JCOPE) counsel reviewed each of the Financial Disclosure Statements filed by staff.

Mr. Leslie noted that he addressed issues pertaining to the conduct of the September meeting on-line and that the October meeting will also, likely, be conducted online.

Ms. Ruzycky presented her report to the Board. Ms. Ruzycky noted her involvement

administering the HRBRRD’s COVID-19 re-opening plan. She also highlighted her attendance at the regional MWBE conference and her participation in the quarterly BRAO IC compliance audit.

Mr. Maniccia presented his report to the Board. Therein he noted that at the close of

fiscal August 31, 2020, the general fund balances for the HRA and BRA were approximately $4,606,042 and $1,982,189 respectively. He noted that District’s transactional processing and reporting are current. Mr. Maniccia explained that as part of the District’s implementation of Statement No. 75 (Accounting and Financial Reporting for Postemployment Benefits Other than Pensions) issued by the Governmental Accounting Standards Board in June 2015, the District was required to obtain an actuarial valuation of the postemployment benefits it offers to its employees, retirees and dependents. The District’s Total OPEB Liability as of June 30, 2020 is expected to rise to $15,498,316, an increase of $4,028,590 from what it reported in its Fiscal Year 2018-19 audited financial statements.

Mr. Foltan presented the Chief Engineer’s report to the Board. Mr. Foltan noted that the August average daily release from the Sacandaga Reservoir (Great Sacandaga Lake) was approximately 1,570 cubic feet per second (cfs). Precipitation during the month of August was above normal across the Great Sacandaga Lake watershed and below average in the Indian Lake watershed. The monthly inflow to Great Sacandaga Lake and Indian Lake reservoir was approximately 82% and 44% of historic average, respectively. Monthly release of water from Great Sacandaga Lake and Indian Lake measured 83% and 60% of historic average, respectively.

The August average daily release from Stillwater Reservoir was approximately 370 cfs. Monthly total precipitation measured 52%, 69%, and 85% of historic average at Stillwater, Old Forge, and Sixth Lake, respectively, as of August 20th. Precipitation in the month of August was below average at Stillwater, Old Forge and Sixth Lake. The monthly inflow to Stillwater Reservoir was approximately 20% of historic average. The inflow to Sixth Lake and Old Forge Reservoir totaled 0.01 and 0.07 billion cubic feet, respectively, in June. Release of water from Stillwater Reservoir averaged 85% of historic discharge.

Mr. Hodgson presented the Administrator’s report. Mr. Hodgson noted that repairs to Gate 2 at Sixth Lake have been completed, and a new seal installed on Gate 1, commending staff for completing these tasks in-house. Mr. Hodgson also noted that staff has been deployed to Indian Lake to address a septic tank issue at the residence. Finally, he said that he had participated in the tour of HRA facilities with staff from the Division of Budget and State Emergency Management, and that he met with representatives from Mayfield regarding a path around Mayfield Lake. Since the September Board Meeting, the Regulating District transmitted five (5) Weekly Flag Report updates

to the Executive Chamber and participated in one (1) monthly call.

As of July 13, we entered Phase 4 of our reopening plan, continuing our return to “normal” operations, with

some employees partially telecommuting to reduce same-day density, and/or working alternate schedules totaling 37.5

hours per week or 75 hours per pay period. Again, I believe our team has responded to the COVID-19 challenge at

every turn with professionalism and dedication and I commend our colleagues for these collective efforts.

The team has been working to prepare a solicitation for proposals to assess the value of water use by

Brookfield Renewable Power/ Erie Boulevard Hydropower (Brookfield) at the E. J. west Facility. An independent,

third-party valuation of the water made possible by HRBRRD’s 56 feet of head is a necessary component to a new or

amended agreement with Brookfield to replace the agreement which expires on June 30, 2021, which must be

approved by the New York State Comptroller and the Attorney General, following approval by the Board.

We attended the Black River Watershed Conference on September 19, which was held virtually.

Presentations at this year’s conference included 10 Years of Progress in the Black River Watershed, Emerald Ash

Borer in Jefferson County: Assessment of County Roads, Lewis County Fairgrounds Green Infrastructure Project,

and Hamilton County Lakes: A 25 Year Perspective, Japanese Knotweed, Hydroseeding in Herkimer County, An Early

History of the Black River, and Geology of the Black River Watershed.

On September 24, we participated in a virtual briefing held by the New York State Division of Homeland

Security and Emergency Services (DHSES) on federal funding available through FEMA. The FY 2020 Building

Resilient Infrastructure and Communities (BRIC) and Flood Mitigation Assistance (FMA) funding opportunities were

recently announced. DHSES is the New York State agency tasked with coordination applications from New York

State. Following this briefing, and with support and assistance of the Chief Engineer and CFO, we submitted a Letter

of Intent (LOI) to DHSES for FMA funding to support remediation and service life extension of the Conklingville

Dam.

On October 1, we attended a virtual biannual meeting of the New York State Invasive Species Council.

Following reports of increased vegetation in the GSL, I had consulted with colleagues at NYSDEC about efforts to

combat aquatic invasive species and the activities of the Council. Participation in the Council meeting is a first step

to becoming more aware of and immersed in the State’s efforts to combat invasive species and better understand what

tools might be available to communities and other stakeholder organizations around reservoirs in HRBRRD’s

jurisdiction.

We hosted a media event with the Great Sacandaga Lake Advisory Council (GSLAC) and other municipal

partners at the Sacandaga Field Office on October 1 to unveil 15 new historic markers which will be placed around

GSL to highlight history of particular sites, features or communities. The markers are being funded by the GSLAC

with installation being handled by the host municipalities and HRBRRD (5 markers will be placed on land within the

HRBRRD’s jurisdiction). The project was covered in the Saratogian and the Daily Gazette.

Finally, we continue to make excellent progress with our consultant Interactive Media Consulting, LLC

(IMC) on our online permit transaction capability, which will be up and running for the 2021 season. Board Members

De Witt and Rosenthal have both had the opportunity to take a first-hand look at the system’s capabilities and

functionality. We look forward to finalizing this system with IMC in the coming weeks, which will represent a major

customer service improvement for GSL permittees.

RESOLUTION AUTHORIZING THE

IMPOSITION OF ADMINISTRATIVE PENALTIES

WHEREAS, the Board of the Hudson River – Black River Regulating District approved

a revised permit fee schedule for fees authorized by the Rules and Regulations Governing Use by

Permit Holders of State-Owned Property at Great Sacandaga Lake (6 NYCRR Part 606) at its

September 9, 2020 meeting; and

WHEREAS, Environmental Conservation Law §15-2133(3) makes it unlawful for

anyone to interfere in any way with the operation of, or injure, a regulating district reservoir; and

WHEREAS, the Regulating District Board has determined and promulgated within the

Rules and Regulations Governing Use by Permit Holders of State-Owned Property at Great

Sacandaga Lake at 6 NYCRR §606.105(a) all persons will be held responsible for compliance

with the foregoing rules and regulations, and any person causing or responsible for any trespass

upon, or injury or damage to, lands acquired in the name of the people of the State of New York

for the uses and purposes of the reservoir, will be held liable in respect thereto for penalties,

damages and administrative fees as established by the board; and

WHEREAS, the Regulating District Board has determined and promulgated within the

Rules and Regulations Governing Use by Permit Holders of State-Owned Property at Great

Sacandaga Lake at 6 NYCRR §606.105(b) that any person violating any of the foregoing rules

and regulations shall, in addition to the other prescribed liabilities and penalties, be deemed to

have interfered with the operation of, or caused injury to, a regulating reservoir, and be subject to

the provisions of subdivision 3, section 15-2133, article 15 of the Environmental Conservation

Law; and

WHEREAS, Environmental Conservation Law §15-71-1123(2) provides that any person

violating the provisions of subdivision 3 of section 15-2133 shall be guilty of a violation

punishable by a fine of not more than one thousand dollars, and in addition thereto, shall be

liable for a civil penalty of not more than fifteen hundred dollars; and

NOW THEREFORE BE IT RESOLVED, that the Area Administrator and the

Executive Director, and/or their designee, are authorized to compute and assess penalties,

damages, consistent with the fee schedule adopted by the Board in Resolution 20-35-09 at its

September 9, 2020 meeting effective January 1, 2021.

Acting as Board Secretary, Counsel addressed issues pertaining to the conduct of the October 14, 2020 Board Meeting; including preparation of resolutions and overseeing preparation of agendas, the board packets, meeting space, etc. In light of social distancing restrictions wrought by the Coronavirus (COVID-19) outbreak, Counsel worked with the Executive Director and staff to anticipate issues which could arise as the Board holds the October meeting and solicits comments upon the fee increase proposal in an on-line environment. Counsel worked with the Executive Director to prepare a resolution through which the Board would authorize the imposition of administrative penalties for non-compliance with the rules and regulations governing the use of state-owned lands at Great Sacandaga Lake. Counsel worked with the Executive Director to address end of term issues regarding the Reservoir Operating Agreements at Conklingville and Stillwater. Counsel participated in the effort to craft a request seeking proposals to value the Conklingville Dam’s 56’ of head utilized to generate power. On behalf of the records access officer, counsel/staff addressed one (1) FOIL request(s) during the reporting period. There were no appeals. Counsel revisited a previous FOIL request upon discovery of additional items responsive to that request. The Committee on Open Government supplied its opinion with regard to the disclosure of names and addresses of access permit holders. Counsel participated in discussions with staff and several access permit holders regarding various access permit system issues; including encroachments, access, association membership, boundary disputes, etc.

Maniccia, CFO Re: CFO Report to the Board Date: Prepared October 1, 2020 for the October 14, 2020 Meeting District Fiscal Outlook Highlights Fiscal Summary For the month ending September 30, 2020, the general fund balances for the HRA and BRA were $2,604,288 and $2,491,373 respectively. When combined (in the amount of $5,095,661), this is $195,432 or 3.8% less than the same period last year. District expenses for the first three months of the fiscal year are $16,200 less than the same period of the 2019-20 Fiscal Year. Overall, the District is running a deficit of $466,200 as of September 30, 2020. This amount is $281,400 larger than the Jul-Sep 2019 period, largely because it has not collected the same amount in Assessment revenue as it did during this period last year. Timing issues are not unusual early in a fiscal year, and we have no reason to believe that the District will not collect the entire amount of Assessment and other revenue it has budgeted due to the economic consequences of the COVID-19 pandemic. District transactional processing and reporting for the months of September were completed in an accurate and timely fashion. Reporting Monthly financial forecasts and cash flow reports are attached for the Board’s review. Status of Fiscal 2020-21 county/state/federal assessments are:

• Received $737,618 to date in the BRA. • Received $1,505,393 to date in the HRA.

Administration/State Reporting/Sourcing The District is current in its reporting to the Authorities Budget Office (ABO) and other state entities. State and local authorities have been granted filing extensions via Executive Orders because of the complications the pandemic has presented. The District has filed all but two of the reports it is required to file and expects to file them by the time the Board meets on October 14. Current Period Significant Disbursements Significant disbursements for the September period include: School taxes (totaling $1,914,520), Payroll (for September 2, 16 and 30, totaling $191,955) and Health Insurance (for October, totaling $77,966). Other The audit for Fiscal Year 2019-20 has been completed. As stated last month, the most notable element is the District’s implementation of Governmental Accounting Standards Board Statement No. 75 (Accounting and Financial Reporting for Postemployment Benefits Other than Pensions). The District’s Total OPEB Liability as of June 30, 2020 has risen to $15,498,316, an increase of $4,028,590 from what it reported in its Fiscal Year 2019-20 audited financial statements. Absent a beneficial change in federal law enacted in December 2019, that liability would have risen to 18,993,954. The District’s Total Net Assets as of June 30, 2020 are a negative $7.6 million. The District’s independent auditor, Galleros Robinson, will discuss the results of the audit with the Audit Committee at the November 10 meeting of the Board. The balance of the month was devoted to other financial, procurement and internal control activities.

Great Sacandaga Lake

The September average daily release from the Sacandaga Reservoir (Great Sacandaga Lake) was approximately 1,540 cubic feet per second (cfs). The Upper Hudson / Sacandaga River Offer of Settlement target elevation for September 30 is 760.25 feet (ft). HUDSON RIVER AREA - SEPTEMBER SUMMARY- continued Operation Overview Precipitation during the month of September was below average across the Great Sacandaga Lake watershed and below average in Indian Lake watershed. The monthly inflow to Great Sacandaga Lake and Indian Lake reservoir was approximately 16% and 19% of historic average, respectively. Monthly release of water from Great Sacandaga Lake and Indian Lake measured 85% and 58% of historic average, respectively. Great Sacandaga Lake Operation Great Sacandaga Lake operation summary report for the period September 1, 2020 through September 27, 202 is attached. This report includes projected and forecast values for dates after September 27, 2020. Hudson River Area Staff Activities Staff completed routine maintenance and operations activities during the month. A summary of District staff activities and work projects at the dam facilities is attached in the Administrator’s Report.

BLACK RIVER AREA - SEPTEMBER SUMMARY - continued Operation Overview Precipitation in the month of September was below average at Stillwater, Old Forge and Sixth Lake. The monthly inflow to Stillwater Reservoir was approximately 28% of historic average. The inflow to Sixth Lake and Old Forge Reservoir totaled 0.01 and 0.03 billion cubic feet, respectively, in September. Release of water from Stillwater Reservoir averaged 75% of historic discharge. Black River Area Staff Activities A summary of District staff activities and work projects at the dam facilities is attached in the Administrator’s Report.

• Attended the September board meeting at the SFO • Attended Sr. Staff meetings • Assisted BRA staff with work on staff gauge at the Stillwater Dam • Attended a press conference at the SFO in regard’s to New Historical sign being

placed around the GSL • Meet with neighboring permit holder at the Broadalbin Beach in regards to an

encroachment issue. • Completed the new septic system at the Indian Lake Dam house

Staff Reports

• Ordered supplies as necessary • Expenditure Requests and vouchers prepared • New permits, Renewals & Permit changes processed daily • Completed daily cleaning of SFO • Participated in weekly meetings regarding COVID-19 updates • Participated in meetings regarding updating the permit system for online use • Ordered all necessary supplies for Renewals • Began collecting Winter Uniform requests • Review & Processed 87 work permit applications • Completed Site Visits/Met with Permit holders • Work permit inspections • Took Daily Weather Reports • Assisted with Phones • Assisted maintenance with various projects • Assisted with reorganizing and office cleanup

Conklingville Dam:

• Read & recorded Hudson, Stewarts Reservoir & control house gages daily • Read & recorded precipitation, temperature gages daily • Performed visual & physical inspection of earthen dam, spillway & surrounding

area daily • Performed weekly check/maintenance of company truck (fluids, lights, tires, wash

etc.) • Read & recorded piezometer, weir & spillway readings daily • Routine cleanup & housekeeping of garage, control house & grounds • Tested generator • Tested all Dow valves and completed required maintenance • Washed and detailed truck as needed • Continued Pest control on Dam • Equipment/Building maintenance & repairs • Continued clearing trees and limbs from all areas • Checked on work permits • Worked on ground repair near Weir Rd • Assisted Field crews with tree removal and maintenance projects • Continued making repairs to downstream access road • Continued seasonal mowing • Continued installation work on camera in the valve gallery • Inspected log boom weekly • Painted and winterized tri hull boat • Started cleaning up debris on upstream face
