Consideration of Approval of Amendment to the 2010-2011 Budget for Restricted Revenue and Expenses Relating to Federal and State Grants

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve an amendment to the 2010-2011 budget for restricted revenue and expenses related to grants. BACKGROUND Federal, state, and local grant activity is ongoing as amendments to currently active grants are processed and new grants are awarded. In order to fund the objectives of the grants, grant operating budgets must be established in a timely manner. This request for a budget amendment reflects the additions to restricted revenues and restricted expenses as a result of amendments and new awards received during the month of September, 2010. IMPACT OF THIS ACTION Approval of the budget amendment will allow the College’s staff to implement the programs in accordance with the requirements of the additionally funded award amounts. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) Restricted revenues and restricted expenses will each be increased by $553,270, so the net impact on the College budget is zero. MONITORING AND REPORTING TIMELINE The Office of Grants Management provides continuous monitoring of grant operations, which are included in the annual financial report to the Board of Trustees. October 4, 2010 Board Book – Grant Amendments Detail List Department of Health and Human Services/Texas Education Agency/Children’s Learning Institute/ University of Texas Health Science Center - Texas School Ready Grant Program (New Grant) The purpose of the grant is to implement a cohesive service model to dramatically improve early literacy, language, math and social development for preschool eligible children; to provide high quality early childhood education programs that coordinate Pre-kindergarten resources among public school districts, Head Start programs, and childcare providers; and to assist preschool children in achieving school readiness and successful transition into Kindergarten. The Children’s Learning Institute (CLI) at the University of Texas Health Science Center, Houston, is the technical assistance provider for these grants and will assist SJCD with the implementation of program components, as required. The Higher Education Coordinating Board - P-16 Calling Program (New Grant) The P-16 program was created to build a college-going and career-ready culture in Texas. The Southeast Texas P-16 Council is working on a program to help counselors to have better local and regional resources when they implement the new Achieve Texas Program. Achieve Texas calls on schools to make education and career plans for each student known as a Texas Achievement Plan (TAP). This part of the P-16 program is to fund student leaders to make a series of follow up phone calls to new students throughout their critical first year. The Higher Education Coordinating Board - Developmental Education Demonstration Project (DEDP) (Additional Funds) In order to meet TSI requirements, San Jacinto College District will provide accelerated completion of developmental courses through innovative instructional techniques, wrap-around student support services, and professional development of faculty and staff. The project’s main objectives are to enable students to connect to the institution while providing learning environments creating a meaningful educational experience and to increase their chances at successful matriculation through graduation. Texas Workforce Commission/Texas State Technical College Waco – Healthcare Training for Medical Professionals (New Grant) The Healthcare training for Medical Professional Grant teaches workers at partner/healthcare facilities to update healthcare worker skills, using state of the art equipment purchased from this grant award. Partners sign a memorandum of understanding to send workers to attend the training. They also agree to pay the minimum prevailing wage to the trained workers once skills have been updated.

Local Funds in tandem with the Louis Stokes Alliances for Minority Participation (LSAMP) Program – the RexTetrix Robot Camp The RexTetrix Robot Camp was held on Monday - July 26th at 8am. It took place at San Jacinto College Central Campus. A camp intern with a Robot Extravaganza T-Shirt met campers and chaperons. On Thursday, July 29th, campers hosted a demonstration with their robots. Counselors for the Robot Camp were College or University students working on a robotics internship this summer at San Jacinto College. Local funds were used to pay the expenses of the camp. San Jacinto College Foundation - Student Success Initiatives 2010-2011 (New Grant) San Jacinto College invites faculty and staff to submit proposals designed to support Student Success each year. Preference is given to proposals that directly engage students and focus upon maximizing the probability of academic success. These grants are pilot projects, which, if successful, will continue with express permission of the District or campus if funds are available.

Consideration of Approval to Amend Barnes & Noble Contract To Include a Textbook Rental Program

ADMINISTRATION RECOMMENDATION The Chancellor recommends that the Board of Trustees approve an amendment to the Barnes & Noble contract which will allow a textbook rental program to be offered at each of the three San Jacinto College bookstores. BACKGROUND With the increased cost of textbooks, students are seeking alternatives to traditional textbook purchases. Barnes & Noble (B&N) is responding to the needs of students by piloting a rental textbook program at other colleges and universities. The rental program affords students an opportunity to rent textbooks instead of purchasing them. Students have responded well to the rental program at pilot institutions. B&N is offering the College an opportunity to partner in a textbook rental program at all three campus bookstores. The rental program will enable students to rent books at a fraction of the purchase price. Because the rental textbooks will need to be reused for several semesters, B&N will choose the textbooks that will be offered through the rental program. Generally, textbooks for core academic classes will be considered. Additional factors to be considered will be volume of textbooks needed, consistency of adoption between campuses, length of adoption, and geographic demand. The current bookstore management contract with B&N began June 15, 2007 and the College is entering the fourth year of a ten year agreement. The rental program, if approved, will start with the Spring 2011 semester and would be subject to an annual review to be sure that the program continues to meet the needs of students, the College, and B&N. IMPACT OF THIS ACTION With the implementation of a rental program students will be able to rent textbooks at all three campus bookstores thus providing an opportunity to reduce textbook costs. The College will receive a commission rate of 8.5% on all textbook rentals. In the short term, the College expects no significant decrease in bookstore commissions. MONITORING AND REPORTING TIMELINE The Board will receive a periodic report on the success of the rental program in terms of student acceptance, volume of rental transactions, and the effect on bookstore revenue. Consideration of Approval of New Police General Order 600-01 Emergency Driving – 2nd Reading

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve the second reading of Police General Order 600-01 Emergency Driving in Non-Pursuit and Pursuit Situations. BACKGROUND Police Officers are commissioned by the State of Texas to uphold the laws of the State and the jurisdictions which employ them. The Police General Orders are statements of policy established by the College to guide officers in performing their duties within the philosophies adopted by the College. The first reading of General Order 600-01 occurred at the Board Meeting on September 13, 2010. No changes have occurred since that first reading. IMPACT OF THIS ACTION Police General Order 600-01 provides a clear concise statement of policy regarding the use of college-owned police vehicles for emergency driving. General Order 600-01 states that the College expects that officers will make every effort to respond to emergency calls quickly and safely and that officers will make every reasonable effort to apprehend fleeing suspects. It further states that a call response or pursuit will not be carried out to the extent that lives or property of innocent citizens, the violator or the officer will be put in unreasonable danger. General Order 600-01 defines emergency driving in two different situations (non-pursuit and pursuit) and prescribes the necessary conditions and approvals that must exist to allow an officer to consider operating his police vehicle in either emergency mode. The policy also prescribes the required training that the officer must have to operate a College-owned vehicle in an emergency mode. POLICY   

The San Jacinto College (“College”) police officers will make every reasonable effort to apprehend a fleeing suspect and to respond to emergency calls quickly and safely. The pursuit or call response should never be carried out to such an extent as to unreasonably endanger the lives or property of innocent citizens, the violator, or the officer. 

1. Definitions:  1. Emergency Driving in Non‐Pursuit Situations: The operation of an authorized emergency 

vehicle with emergency equipment in operation by a police officer in response to a life threatening or a violent crime in progress, incorporating due regard for the safety of others.  

2. Emergency Driving in Pursuit Situations: An active attempt by a law enforcement officer, operating an emergency vehicle and utilizing emergency equipment, to apprehend one or more occupants of another moving vehicle incorporating due regard for the safety of others; when the driver of a fleeing vehicle is aware of that attempt and is resisting apprehension by maintaining or increasing the speed of the vehicle; disobeying traffic laws; ignoring the officer;  and,  attempting to elude the officer.  

2. Training: 1. Officers are not authorized to engage in emergency driving under any circumstance 

unless they are current in receiving emergency driving training designated by the department. For purposes of this general order “training” means having successfully completed both a level 1 and a level 2 emergency driving training course sponsored by a recognized local law enforcement agency as determined by the Chief of Police. For purposes of this general order “current” means within the past 5 years. 

3. Emergency Driving — General:  1. Authorization:  

1. The operation of a police vehicle, when utilized as an authorized emergency vehicle, is governed by the Texas Transportation Code Chapter 546.  

2. Department vehicles are authorized to be operated as emergency vehicles in compliance with this policy in non‐pursuit and pursuit emergency situations.  

2. Emergency Mode:  1. Visual and audible equipment on police vehicles is governed by the Texas 

Transportation Code Chapters 546 and 547.  2. When operating a department vehicle as an authorized emergency vehicle, the 

officer will immediately activate emergency equipment.  3. Officers will immediately notify the dispatcher.  4. Officers will not operate a police vehicle in emergency status if it is occupied by 

any passenger (guards, cadets, civilian riders, etc) other than another police officer.

5. Police vehicles without emergency lights and sirens will not be operated as emergency vehicles.  

4. Non‐Pursuit Situations:  1. Emergency responses will be made only when the incident involves a life threatening 

situation or a violent crime in progress.  2. Emergency responses must be approved by a supervisor.  3. When deciding to initiate or continue driving under emergency conditions, officers will 

consider such factors as traffic volume, time of day, weather conditions, and potential hazard or liability to themselves and the public.  

4. Officers must seek sufficient information to justify the decision to drive under emergency situations.  

5. Officers responding to an officer needs assistance call must bear in mind that even though a rapid response is important, they must arrive at the scene safely in order to be of assistance.  

5. Pursuit Situations:  1. Prohibitions concerning vehicular pursuits:  

1. Pursuits will not be initiated unless probable cause exists for the belief that a felony offense has been committed and failure to apprehend a suspect immediately may result in loss of life or serious bodily injury to another. 

2. In no case will a crime against property alone be cause for the use of pursuit.  3. Pursuits will only be utilized to apprehend a suspected perpetrator of a felony 

crime which occurred on property owned, operated or controlled by the College.  

4. No pursuit will be initiated or continued on or off property owned, operated or controlled by the College by any officer unless a supervisor approves such pursuit.  

2. The following factors will be taken into consideration by the officer prior to initiating a pursuit:  

1. Nature of the offense.  2. Performance capabilities of the pursuit vehicle.  3. Road, traffic, and pedestrian conditions.  4. Environmental factors such as rain, fog, ice, snow, or darkness that would 

substantially increase the danger of pursuit.  5. Age of offender and/or whether the identity is known.  6. Officer's familiarity of area and their ability to accurately describe location and 

direction of travel.  3. Once the decision has been made to become engaged in a pursuit, the following actions 

will be taken:  1. The supervisor or shift commander will immediately be notified by the 

communication operator so they are aware of and authorize the pursuit.

2. The supervisor or shift commander will control the pursuit and have the authority to order the pursuit terminated at any time.  

3. One secondary unit, if available, will be approved by the supervisor or shift commander to respond.  

4. No other units will be involved in the pursuit unless authorized by the supervisor or shift commander.  

4. Officer initiating a pursuit will broadcast the fact as soon as possible and make every effort to broadcast the following information:  

1. Reason for the pursuit.  2. Location of the pursuit.  3. Direction of travel and rate of speed.  4. Description and license plate of the fleeing vehicle.  5. Description of the occupants of the vehicle.  6. Evasive actions being used, such as running without headlights, intentional 

collisions, driving on the wrong side of the roadway, etc.  5. Secondary unit will assume responsibility for constant and clear communication of:  

1. Pursuit location, direction of travel, and speed of pursuit.  2. Traffic violations committed by suspects.  3. Damage to property and/or vehicles.  4. Other actions perceived to have caused injury or damage.  5. Changes in weather, road, or traffic conditions.  6. If the pursuit is leaving College jurisdiction.  

6. Dispatcher responsibilities:  1. At the beginning of a pursuit, broadcast to inform officers that a pursuit is in 

progress.  2. The channel on which the pursuit originated will be designated as the primary 

channel for the pursuit. The primary unit, secondary unit, and control supervisor should have exclusive use of that frequency.  

3. As soon as possible, notify the supervisor or shift commander that a pursuit is in progress.  

4. Keep other law enforcement jurisdictions advised if the pursuit is likely to enter or cross into another jurisdiction.  

5. Upon confirmation that a pursuit has been terminated, broadcast to officers to cease all pursuit activity.  

7. Supervisor responsibilities:  1. It is the responsibility of the supervisor to make informed decisions approving or 

terminating a pursuit and to communicate the decision to the officers.  2. Supervisors should be within radio contact at all times and, once a pursuit is 

approved, continually assess the advisability of continuing the pursuit.

3. All pursuits require a written report from the officer and an administrative review by the Captain and his immediate supervisor. Each incident shall receive careful analysis and a determination as to whether or not correct procedures were used by all department personnel.  

4. The Captain(s) shall be responsible for submitting an annual analysis of all pursuits to the Chief of Police no later than September 15th of each year.  The purpose of this analysis is to determine if the pursuits were in compliance with departmental policy and if there are training needs or policy modifications that need to be considered.  

8. Officers will not use their vehicle as a ramming device, to box in or surround a suspect vehicle, to overtake or force a suspect vehicle off the roadway, or to create roadblocks.  

9. Officers will not discharge firearms at a fleeing vehicle or its occupants except in defense of life.  

10. The pursuit will be terminated when continuation of the pursuit constitutes an unreasonable amount of risk or when the officer is ordered to do so by a supervisor.  

11. When the suspect's identity has been established at a point where later apprehension can be accomplished, and there is no logical need for immediate apprehension, the pursuit will be terminated.  

12. All officers who are involved in a pursuit will complete an incident report detailing the facts of the pursuit.  

13. Officers should not feel compelled to continue an emergency response or pursuit when conditions escalate to a degree which places the safety of the officers or others in an unacceptable level of jeopardy.  

1. All officers involved in vehicular pursuits will be held accountable for the continuation of a pursuit when traffic hazards and other circumstances indicate, by danger level, that it should have been discontinued. Since the primary unit officer is usually concentrating on the safe operation of the police vehicle, the secondary unit officers should consider it a responsibility for advising the primary unit officer when they feel the pursuit is exceeding reasonable limits.  

14. Pursuits initiated by other law enforcement agencies.  1. When a pursuit begins within another agency’s jurisdiction and passes or ends 

within the College’s primary geographical jurisdiction, the originating agency will have arrest responsibility.

without use of the siren.  2. This mode of operation may be used when responding to urgent calls. Urgent 

calls are those type calls in which someone is actively engaged in criminal conduct or there is reason to believe the immediate response of a police officer will prevent the situation from worsening, or there is a reasonable possibility that the suspect can be apprehended.  

3. Examples of Code 2 calls include but are not limited to burglary in progress, assault in progress, or disorderly conduct involving violence in progress.  

4. When operating Code 2, officers will obey all traffic laws.  3. Code 3 — Emergency Operation:  

1. Operation of a police vehicle while the emergency equipment are activated and with supervisor authorization.  

2. This mode of operation may be used when responding to emergencies. These include situations in which death or injury has just occurred or in which someone is actively engaged in conduct that may result in death or injury.  

3. Examples of Code 3 calls include but are not limited to authorized pursuits, aggravated assault in progress, rape in progress, armed robbery in progress, kidnapping in progress, serious injury has occurred, and officer need assistance.  

4. Police vehicles will operate in accordance with Texas Transportation Code Chapters 546 and 547 described in paragraph B‐2 (Emergency Mode).

Consideration of Adoption of Ad Valorem Property Tax Rate ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve and adopt a 2010 tax rate of 17.6277 cents per $100 valuation of taxable property located within the San Jacinto Community College District. BACKGROUND The recommended 2010 tax rate of 17.6277 cents per $100 valuation is lower than the effective tax rate of 18.9349 cents. The State of Texas Truth-In-Taxation laws require that the College publish notices of tax increases and hold public hearings only in cases when the adopted rate exceeds the effective tax rate. Thus, the College was not required to comply with such requirements but did adhere to all other requirements of the Truth-In-Taxation laws. The total tax rate of 17.6277 cents is allocated as follows:

• 11.4293 cents for the purpose of maintenance and operation of the College (same as the rate adopted in 2009)

• 6.1984 cents for the purpose of paying interest and principal on the College’s outstanding general obligation bonds. The debt tax rate is calculated using current appraisal values to generate enough revenue to pay the required debt service payments.

The taxes that would be imposed on a residence homestead at the current year’s average appraised value of $107,473 (excluding special exemptions for persons 65 years of age or older or disabled) are estimated to be $180.64, a reduction from 2009 of $7.03. A taxpayer owning a homestead residence and claiming the over 65 or older or disabled exemption would incur no taxes ($0.00) to San Jacinto College on a residence appraised at the current year’s average appraised value. IMPACT OF THIS ACTION Approval of the property tax rate is required within 60 days of delivery of the certified tax rolls. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) Certified valuations (received on September 2, 2010) declined by approximately seven percent (7%) from the prior year values. The budget was prepared based on historical trends of valuation estimates compared to certified valuations. This year an estimating error occurred by Harris County Appraisal District which negatively impacted the valuation methodology. Based on the certified valuations and the proposed tax rate, the College anticipates a shortfall in the maintenance & operations property tax revenue budget of approximately $2,300,000.

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve notification to The Higher Education Coordinating Board (THECB) to update distance learning degree and certificate offerings by San Jacinto College. BACKGROUND Distance learning offerings at San Jacinto College have continued to grow in response to demand from students for these courses in online and hybrid delivery formats. As an outcome of this growth, it is necessary for San Jacinto College to provide an updated notification to THECB identifying those areas in which San Jacinto College offers 50 percent or more of the course work required for such degrees in a distance learning modality. IMPACT OF THIS ACTION This action complies with requirements of THECB. Furthermore, this action aligns with the College’s strategic goal 1, strategy 2 to become a recognized leader in the quality and availability of alternative delivery options by expanding the courses and programs available to students in online and hybrid delivery formats. BUDGET INFORMATION There is no budgetary impact to this action. Consideration of Approval for Chancellor to Negotiate and Execute a One Year Contract with Harris County for Bus Service to Central Campus

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees authorize the Chancellor to negotiate and execute a one year contract with Harris County for bus service to the Central campus at a cost not to exceed $130,000, such contract to be ratified by the Board at the November 1, 2010 regular board meeting. The execution of this contract is contingent on the participation and executed contracts between Harris County and the Cities of Pasadena and La Porte. BACKGROUND In January 2010, the transit arm of Harris County worked with multiple municipalities and the San Jacinto College District to leverage grant funds to start bus routes that served the Central Campus and surrounding communities including La Porte and Pasadena as well as portions of South Houston. That grant expires at the end of September 2010 although efforts to extend the grant through January 2011 are under way. Although the first nine months of operation were entirely grant funded, there are not sufficient funds to continue the service in 2011 without matching funds from participants. The City of La Porte, the City of Pasadena, and San Jacinto College have all agreed to fund the necessary matching funds to continue the service for another year. The original routes have been modified to provide better service to San Jacinto College (see attached map revision as of October 2010). In the pilot year, the Central campus made information available to students regarding bus routes and schedules. As a result, at the end of the spring 2010 semester, just five months after the bus service began; ridership was approximately 350 passengers per week with forty percent (40%) utilization or 140 riders to and from the Central campus. Ridership dropped during the summer months but resumed again in the fall 2010 semester. With the start of the fall 2010 semester, ridership surpassed 500 boardings per week for the entire route with 185 riders (37%) arriving or departing from the Central campus. This represents an increase of over thirty percent (32.14%) from May to August. The bus routes provide an important service to the area communities, but as one of the funders, the College is concerned about the return on investment and how to demonstrate that the investment is worthwhile. One way that this will be determined is based on new students riding the bus to take classes at the College. For example, the average contact hour reimbursement is $5.47 and tuition for in district students is $38.00/hour. For a three-hour course, this equates to $376.56 ($262.56 in average contact hour reimbursement plus $114.00 in tuition received, does not include fees). As a result, if it can be demonstrated that the bus service brings 345 new students per year taking one class then the service will break even. Campus personnel are designing ridership surveys to capture this information.

Consideration of Approval for Chancellor to Negotiate and Execute a One Year Contract with Harris County for Bus Service to Central Campus

It is important to note that the bus service is still in its first year. If the current growth patterns persist and match those of the service in Baytown, then the Central campus could see positive results. The bus service serving Lee College has been operating for over a year longer than the Pasadena-La Porte route and approximately fifty percent (50%) of all riders are Lee College students. IMPACT OF THIS ACTION By partnering with Harris County, Pasadena, and La Porte, San Jacinto College is able to leverage federal transportation grant funds and extend bus service to key population clusters in the Central campus service region. As such, Central campus personnel will work to document ridership in terms of both new students as well as an incentive for retention. Working with the Marketing Department, the College will reach out to potential students for whom attendance may have been limited by transportation. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) The maximum cost of $130,000 is budgeted in the Chancellor’s New Program budget for fiscal year 2010-2011. MONITORING AND REPORTING TIMELINE At the November 1, 2010 regular meeting of the Board of Trustees, the Chancellor will report to the Board the progress of negotiations and will, when complete, bring the contract for ratification by the Board. Consideration of Approval of Partnership Agreement with University of Houston - Clear Lake

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve a partnership agreement between the University of Houston – Clear Lake, Alvin Community College, College of the Mainland, Galveston College, Lee College, and the San Jacinto College District. BACKGROUND Since its inception in 1974, the University of Houston – Clear Lake (UHCL) has served as an upper-division educational institution. During the 82nd Legislative Session, UHCL, in conjunction with the University of Houston System office, intends to submit a proposal for downward expansion, enabling UHCL to offer lower-division (freshmen and sophomore) courses. In anticipation of this proposal, over the last year, the chief executive officers of the UHCL and the surrounding five community colleges (Alvin Community College, College of the Mainland, Galveston College, Lee College, and the San Jacinto College District) have met to understand the impact of this action on individual colleges and on the greater community service area. Additionally, during this same time, the community college representatives have had conversations with area State Legislators who have encouraged the parties to work together to develop a strong educational partnership that best serves the community and the State of Texas. While the five community colleges are concerned about the legislative approval of the downward expansion of UHCL, especially in light of the proposed State budget deficit, we worked diligently to reach an agreement that establishes a partnership to maximize educational opportunities for all students and utilize taxpayer resources in the most efficient and effective manner. IMPACT OF THIS ACTION The agreement is contingent upon legislative action to approve the downward expansion of UHCL; and if such legislative authority is obtained, then the partnership agreement will commence September 2011. The expiration will be at the conclusion of the 2015-2016 academic year. The agreement addresses specific collaboration efforts which include: increasing the college-going and college-graduation rates for our region at both the associate’s and bachelor’s levels, addressing areas of critical shortage in technical programs and workforce needs, developing joint degree programs, focusing on partnerships with area school districts and preschool to grade 16 initiatives, providing students the greatest mobility and focus on degree completion, and pursuing joint grant opportunities. Additionally, the agreement specifies stronger transfer and scholarship opportunities for community college students transferring to the UHCL and reactivates the Community College Advisory Council with the UHCL in order to address issues of common interest such as scholarships, articulation, reverse articulation, and honors programs.

Consideration of Approval of Partnership Agreement with University of Houston - Clear Lake

Finally, the agreement addresses specific areas for which UHCL will not provide services or offerings. Specific areas affecting San Jacinto College are that UHCL will not offer developmental education, will not offer dual credit outside of the UHCL campus, will not offer programs or courses leading to licensures or certification that require less than a bachelor’s degree, and will not offer lower-division courses at the UHCL- Pearland Campus. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) None at this time. MONITORING AND REPORTING TIMELINE The activities of the 82nd Legislative Session will be monitored with updates provided to the Board of Trustees. Partnership Agreement between 

Alvin Community College, College of the Mainland, Galveston College, Lee College, and the San Jacinto College District 

and University of Houston‐Clear Lake 

 This partnership agreement is entered into and is effective as of ________ 1, 2010 between Alvin Community College, College of the Mainland, Galveston College, Lee College, the San Jacinto College District, and the University of Houston‐Clear Lake.    The partnership agreement will address mutual considerations necessary to facilitate the proposed expansion of the University of Houston‐Clear Lake (UH‐ Clear Lake) into a four year university whereby UH‐Clear Lake will offer lower division courses. The community college participants in this agreement (Alvin Community College, College of the Mainland, Galveston College, Lee College, and San Jacinto College District) will be referenced as Area Community Colleges in this agreement.   The parties understand that legislative action is a necessary prerequisite to finalizing downward expansion and that UH‐Clear Lake plans to seek legislative authority for downward expansion in the 2011 session of the Texas Legislature.  If UH‐Clear Lake receives legislative authority for downward expansion in the 2011 session of the Texas Legislature, the provisions of this partnership agreement will commence in September 2011 and the expiration will be at the conclusion of the 2015‐2016 academic year.   The intent of the parties to this agreement is to establish a partnership that maximizes educational opportunities for all students and utilizes taxpayer resources in the most efficient and effective manner.  

Areas of Collaboration  The institutions will collaborate to:  1. Increase the college‐going and college‐graduation rates for our region at both the 

associate’s and bachelor’s levels.  2. Recruit students with an emphasis on the 2+2 enrollment model. 

 3. Address critical field shortages in math, science, and teacher education as well as in other 

areas identified for the region.  

4. Develop joint degree programs in high demand or emerging fields such as biotechnology.

5. Evaluate ways to implement 2+2 programs in allied health and nursing fields with the Area Community Colleges providing the lower division and associate degree courses.  

 6. Implement reverse transfer agreements for the individual Area Community Colleges. 

 7. Develop strategies to address the needs of area school districts for college credit 

opportunities for their students.  

8. Organize initiatives focused on strengthening P‐16 partnerships and collaborations including the consideration of a regional P‐16 Council.  

9. Provide reciprocal recruiting and advising opportunities for the Area Community Colleges and UH – Clear Lake on each others’ campuses in order to provide students the greatest mobility and focus on degree completion.   

10. Develop and pursue grants to meet the need for associate’s and bachelor’s degrees in high demand fields.  

11. Develop and pursue grants to address the recruitment and retention of under‐served student populations in the region.  

 University of Houston‐Clear Lake 

 The University of Houston‐Clear Lake will:  

1. Guarantee admission at the junior level for students with an associate’s degree earned at Area Community Colleges who meet minimum semester credit hour and grade point average requirements.  

2. Guarantee acceptance of up to 60 transfer credit hours for students who have earned associate’s degrees at Area Community Colleges and who have met minimum semester credit hour and grade point average requirements.  

 3. Expand the Unilink Program to provide for joint admission between Area Community 

Colleges and UH‐Clear Lake and encourage all students to participate in Unilink.   

4. Award scholarships to graduates of Honors Programs and to students graduating with Honors at Area Community Colleges who meet minimum course load and grade point average requirements.  

5. Maintain the current UH‐ Clear Lake automatic transfer scholarship program (currently students with 3.0 or higher GPA receive $500 per semester renewable for four long semesters and students with 2.75 to 2.99 GPA receive $400 for four long semesters;

both require registration of 9 or more hours), provide funding to support increases in the number of students from Area Community College students eligible for the program, and provide for increases in the scholarship amounts in appropriate levels to offset future tuition increases, assuming no reductions in formula funding provided by the State of Texas.  

6. Partner with Area Community Colleges to serve students in technical tracks who desire to pursue a bachelor of applied science degree.  

7. Reactivate the Community College Advisory Council with the University of Houston‐Clear Lake in order to address issues of common interest such as scholarships, articulation, reverse articulation, honors programs, etc.  

 The University of Houston‐Clear Lake will not:  

1. Offer programs or courses in the area of developmental education.  

2. Offer dual credit courses outside of the UH‐Clear Lake campus nor will UH – Clear Lake provide dual credit courses at any high schools within the taxing district or service area of the Area Community Colleges.  

 3. Offer programs or courses leading to licensures or certification that require less than a 

bachelor’s degree.  

4. Pursue a technical college or college of technology which would offer lower level technical courses.  

5. Offer lower‐level courses at the University of Houston‐Clear Lake Pearland Campus.  

6. Offer lower level courses at the Texas Department of Criminal Justice.   The parties noted below agree to the provisions of this partnership agreement which are detailed above. Consideration of Approval of Recommendation that Upcoming Board Vacancy Remain Vacant Until the May 2011 Regular Election

ADMINISTRATION RECOMMENDATION/REPORT The Board of Trustees recommends that the upcoming board vacancy created by the retirement of Wayne Slovacek remain vacant until the May 2011 regular election. BACKGROUND At the Board of Trustees’ meeting held on September 13, 2010, Wayne Slovacek expressed his intent to retire from the San Jacinto College Board effective December 13, 2010. Texas Education Code Section 130.082(d) requires the following in regards to board vacancies: “Any vacancy occurring on the board through death, resignation, or otherwise, shall be filled by a special election ordered by the board or by appointment by resolution or order of the board. A person appointed to fill a vacancy in a trustee district must be a resident of that trustee district. A person appointed to fill a vacancy in the representation of the district at large must be a resident of the district at large. A special election to fill a board vacancy is conducted in the same manner as the district's general election except as provided by the applicable provisions of the Election Code. The person appointed to fill the unexpired term shall serve until the next regular election of members to the board, at which time the position shall be filled by election for a term appropriately shortened to conform with what regularly would have been the length of the term for that position.” Furthermore, Section 11.060 of the Texas Education Code allows that if the board vacancy occurs less than 180 days prior to the next regular election than no special election is required. Rather the position may be filled with the next regular election. Due to the compressed amount of time between Trustee Slovacek’s retirement (December 13, 2010) and the next regular election (May 14, 2011), the Board of Trustees have determined that it prudent to allow the vacancy to be filled through the regular general election process. IMPACT OF THIS ACTION The Board of Trustees will accept Mr. Slovacek’s retirement with an effective date of December 13, 2010 at the December board meeting, and the Board will function with six members rather than seven until the new member is elected through the May 14, 2011 regular election. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) The May 14, 2011 regular election is included in the fiscal year 2010-2011 budget.

Consideration of Approval of Budget Transfers

ADMINISTRATION RECOMMENDATION/REPORT The Chancellor recommends that the Board of Trustees approve budget transfers for 2010-2011 which have been made in accordance with State accounting procedures. BACKGROUND Adoption of the budget by the Board of Trustees in August of each year serves as the authorization to expend funds for the next fiscal year. The budget is adopted by functional classification (or cost elements: Instruction, Academic Support, Student Services, Institutional Support, and Operation and Maintenance of Plant) as defined by the National Association of College and University Business Officers (NACUBO). Realizing that the budget is a viable document that reflects the evolving needs of the District in terms of meeting goals and objectives, occasional movement of budgeted funds between cost elements is desirable and warranted. The budget transfers under consideration represent previously authorized expenditures that are requested to be reclassified from one cost element to another cost element. IMPACT OF THIS ACTION Approval of the budget transfers will allow the College to more effectively utilize existing resources in fulfilling its instructional objectives.
