What's in a name?Investments are in place, the name is finalised and now your start-up is ready for business. Wait! Shouldn’t you be considering the possibility of trademark infringement? Chances are your product name might have been already trademarked by another entity. This happened in the famous Ok-Tata-Bye-Bye case where TATA objected to the name and won the case. In another incident a recently opened airline was objected by the trademark authority on the relative grounds of refusal because of same/similar marks which was already on the record of register for similar services.
