    The sangguniang barangay is the

    legislative body of the barangay which

    shall exercise legislative power(Section 48, LGC).

    ORDINANCE

    ORDINANCE DEFINED

    An ordinance is a law, a regulation of a general,

    permanent nature, and a rule established by

    authority. (Discanso vs. Gatmaitan, GR No. 12226, 31 October 1960).

    It is also defined as a legislative act passed by thelocal board or council in the exercise of its law-

    making authority. (Sec. 38, PD 231).

    An ordinance is not a public law of the state, but alocal law of the particular corporation, made for its

    internal practice and good government.(De Guzman vs. Subido, L-31683, 31 January 1983; 120 SCRA 448).

    Requisites for the Validity of an Ordinance

    In the case of Magtajas vs. Pryce Properties, GR No. 111097, 20July 1994, the Supreme Court laid down the requirements for the

    validity of an ordinance. They are as follows:

    It must not contravene the constitution and any

    statute;

    It must not be unfair and oppressive;

    It must not be partial or discriminatory;

    It must not prohibit, but may regulate trade;

    It must not be unreasonable; and It must be general in application and consistent

    with public policy.

    Kinds of Ordinances

    1. General Ordinances

    It is an ordinance enacted by a local legislative bodyin the exercise of its police power whose primary

    objective is the general welfare of the people byprescribing certain regulatory measures.

    This is an ordinance promulgated in the exercise ofpolice power of the lgu pursuant to Section 16 of theLocal Government Code. The main purpose of which

    is the general welfare of the people. The example of this type of ordinance is an

    ordinance relating to solid waste management, illegalgambling, and regulation in the operation ofrecreation centers.

    Kinds of Ordinances

    2. Appropriation Ordinances These are ordinances whose primary purpose is

    appropriation and authorization for the release of localfunds.

    The power to enact appropriation ordinance is spelled-out in Section 447 (a) of R.A. 7160.

    3. Tax Ordinances Tax ordinances are ordinances enacted to levy taxes,

    fees, charges and other impositions or any measure the

    purpose of which is to generate revenue. The power to enact tax ordinances is explicitly provided

    under Section 152 of R.A. 7160.

    The example of this is a tax ordinance imposing fees andcharges on billboards, signboards, neon signs, and

    outdoor advertisements.

    These are ordinances enacted for a

    special and/or specific purpose. The examples of this type of ordinances

    IV. Body of the OrdinanceExample:Section 1. Difinition of Terms. The following

    terms when used in this ordinance shallmean as follows:

    Garbage refers to any object or article not anymore fit forhuman or factory use or consumption found in publicplaces.

    Public Places refer to public plazas, streets, roads,thoroughfares, boulevard, public buildings, and any otherplaces not privately owned.

    Disposal means the act of throwing, placing, piling, orstoring garbage in public places.

    Section 2. Prohibited Acts. No person is allowedto dispose garbage in public places withinthe territorial jurisdiction of the barangay.

    V. Penalty Clause- The penalty clause is the provision which imposethe fines and/or penalties imposable in violation ofthe ordinance.

    - It is usually found in general and tax ordinances.

    Example:

    Section 3. Penalty. Any person violatingthis ordinance shall be fined as follows:

    First Offense : P 200.00;

    Second Offense : P500.00; and

    Third Offense : P 1,000.00.

    Any fine herein imposed shall not precludethe filing of appropriate action in court in

    violation of existing laws.

    VI. Repealing Clause

    - also known as severability or separability

    clause

    - It declares that if any part of the ordinance

    in which it appears is found to beunconstitutional, the rest of the ordinance

    shall not be affected.

    Penalties for Violations of Ordinances

    General Ordinances

    For the general ordinances, the sangguniangbarangay is authorized only to impose apenalty of fine in the amount not exceedingOne Thousand pesos (P 1, 000.00).

    It is worth stressing that a barangay is notempowered to impose a penalty of imprisonment.

    Tax Ordinances

    For tax ordinances, the sangguniang

    barangay is authorized to prescribe fines orother penalties but in no case shall suchfines be less than One Hundred pesos (P100.00) nor more than One Thousand pesos

    (P1,000.00) (Section 516, LGC).

    RESOLUTION DEFINED

    Resolution is a declaration of a council, or alegislative body, evidencing some purpose orintent to do some act, not the doing of the actitself. The intention to enter into some enterprise

    of public moment, something authorized by lawthat it may do. (Discanso vs. Gatmaitan, 109 Phil. 920.

    A Resolution is an expression of the sentiments; adeclaration of a will; of an opinion; a decision or

    position being rendered by the members of adeliberative body on certain issues and matters ofpublic interests and having no permanent valuebut only temporary in character.

    Distinctions between

    an Ordinance and a Resolution

    An ordinanceis a law. It is permanent in nature,which means, it continues to be effective unlessamended, repealed, or modified by subsequentordinance or law. In the enactment of ordinance,

    the sanggunian has to observe the three-reading-on-separate days rule.

    On the other hand, a resolutionis not a law. It ismerely an expression of sentiment, an opinion, a

    will, or position on a certain matter. It istemporary in nature in which, once its purpose isachieve, its effectivity ceases. In the passage ofa resolution, the sanggunian need not observethe three-reading-on-separate-day rule. (Beluso vs. Mun. of Panay,Capiz, GR No. 153974, 7-August 2006)

    SESSION

    SESSIONis a series of meetings conductedby a legislative body in the exercise of itslegislative power.

    TYPES OF SESSION

    1. Regular session

    In the case of local sanggunian,. a regularsession is one wherein the schedule of which isfixed and provided in the Internal Rules ofProcedures duly adopted by the sanggunian. It is the

    session in which the sanggunian is mandated bySection 52 (a) of RA 7160 to fix the day, time, andplace of the sanggunians regular session duringtheir first session following their election. The regularsession must be twice a month.

    TYPE OF SESSION2. Special Session

    In the case of local sanggunian, specialsession refers to the session conducted outsideof the date, time, and place of the regularsession fixed in the Internal Rules of Proceduresand may be called when public interest or

    urgency of a particular measure demands. When public interest so demands, special sessions called by the

    local chief executive or by a majority of the members of thesanggunian (Sectio n 52 (b), LGC).

    In the case of special sessions of the sanggunian, a written notice to

    the members shall be served personally at the member's usual placeof residence at least twenty-four (24) hours before the specialsession is held.

    Unless otherwise concurred in by two-thirds (2/3) vote of thesanggunian members present, there being a quorum, no othermatters may be considered at a special session except those statedin the notice. (Sectio n 52 (d), LGC).

    Presiding Officer

    The regular presiding officer of thesangguniang barangay is the punongbarangay.

    As provide in Section 49 (b) of the LGC, in theevent of the inability of the regular presiding officerto preside at a sanggunian session, the memberspresent and constituting a quorum shall elect from

    among themselves a temporary presiding officer.

    He is allowed to vote only to break a tie.(Section 49 (a), LGC).

    Secretary to the Sanggunian

    The barangay secretary is the secretary of thesanggunian. He shall take down the minutesduring session and keep a journal of proceedings.

    Q. In the absence of barangay secretary, can a

    presiding officer designate any member of thesangguniang barangay to act as secretary duringthe session?

    A. No. No elective local official shall be eligible for

    appointment or designation in any capacity to anypublic office or position during his tenure. (Sect ion94 (a), LGC).

    resolutions reported out by committees forsecond reading. The items are taken up in the

    order they appear in the calendar. Unassigned Business. Refers to the list of

    proposed legislative measures reported by thecommittee but not calendared for discussion asthe dates have yet to be determined by the

    Committee on Rules.

    RULE III

    OTHER DUTIES AND RESPONSIBILITIES OF INDIVIDUAL MEMBERS

    Section 1. Every member of this Sanggunian shall make a fulldisclosure of his financial and business interests as required of himunder Art.104, Rule XVII of the Rules and Regulations Implementingthe Local Government Code of 1991.

    Section 2. Every member shall attend all the session of thisSanggunian unless he is prevented from doing so by reason ofsickness or other unavoidable circumstances provided that, as ageneral rule, previous notice thereto shall be sent to the Sanggunianthru the Presiding Officer o r the Secretary.

    Section 3. As a general rule, every member is required to vote

    on every question or proposed measures being voted upon by theSanggunian. Abstentions may only be allowed if it can be shownthat the member concerned has a pecuniary interest, either directlyor indirectly, on the matter being acted upon by the body.

    Section 4. Every member shall observe proper deportment anddecorum during sessions.

    THE PRESIDING OFFICERSection 1. The Punong Barangay shall be the Presiding Officer of thisSanggunian and, as such, shall have the following rights and

    duties:

    To preside over the sessions of the Sanggunian.

    To exact from all the members present during thesessions proper deportment and decorum.

    To enforce the internal rules and procedures of theSanggunian.

    To maintain order during sessions and render a rulingon questions of order, subject to appeal by the memberconcerned to the body for final decisions.

    To sign all the legislative documents, papers, orchecks, requiring his signature.

    to act as Temporary Secretary except membersof the Sangguniang Barangay Member.

    A member who is abroad;

    A member who is on official leave of absence;

    A deceased member;

    A member who has resigned;

    A member who has been suspended;

    A member who was expelled; or removed by final judgment

    Step 6. The committee takes action by reportingout the measure. The committee action is eitherfavorable or unfavorable.

    If favorable, report is submitted to thecommittee on rules which calendars the measurefor second reading.

    If unfavorable, measure is laid on the table, theauthor or authors are given notice stating

    reasons for the action. To ensure that all measures are acted upon

    without delay, committees may be mandated bythe internal rules to prepare a report whetheraction on a measure is favorable or unfavorable.This will ensure no measure is left unacted andbuild the civil society groups trust in thesincerity and capacity of the sanggunian toaddress community issues and problems.

    Phase 3. Sanggunian Deliberations

    Step 7. The measure is read in its entirety onsecond reading during a session. Step 8. The committee that studied the

    measure sponsors it on the floor by explaining thenature of the measure and recommending its

    approval by the body. Step 9. The measure is subjected to debate and

    amendments. Step 10. The secretary prepares copies of the

    measure incorporating the amendments anddistributes these to the members at least threedays before its third and final reading.

    Step 11. The measure is voted upon onthird reading in the session.A quorum must be present before voting is

    taken.

    The number of those who voted for andagainst is recorded.

    The measure is deemed approved by thesanggunian. The secretary certifies themeasure correct and the presiding officersigns it.

    Step 13. An approved ordinance or resolutiongoes to a higher level sanggunian for review.

    An ordinance or resolution from acomponent city or municipality shall bereviewed by the provincial sanggunian threedays after its approval.

    An ordinance or resolution of a sangguniangbarangay shall be submitted for reviewwithin 10 days after its enactment.

    If no action is taken by a higher levelsanggunian within 30 days after submissionof an ordinance or resolution, it shall bedeemed valid.

    Step 14. The secretary shall order the posting of theordinance or resolution in a bulletin board at the entranceto the city or municipal hall or at the provincial capitol;and in at least two conspicuous places in the LGUconcerned not later than five days after its approval. The text of the ordinance or resolution shall be disseminated in

    Pilipino or English and in the Philippine dialect understood by themajority of the people.

    Unless otherwise stated in therein, the ordinance shall take effectten days from the date a copy of it is posted.

    Ordinances with penal provisions shall be posted for a minimum ofthree consecutive weeks, and published in a newspaper of generalcirculation within the territorial jurisdiction of the local governmentunit concerned except in the case of barangay ordinances. Unlessotherwise provided therein, the ordinance shall take effect on theday following its publication, or at the end of the period of posting,

    whichever occurs later.
