Brighton & Hove City Council Building Regulation Application Fees
With effect from April 1st 2015
Building Regulation Footnotes April 2015
1. The Building Notice fee shall be an amount equal to the aggregate of the Full plan fee and the inspection fee plus 20% where no professionally prepared drawings have been provided. All fees in connection with Building Notices must be made at the time of deposit.
2. A regularisation fee is the fee payable when an
application is made to the Local Authority for a Regularisation Certificate in respect of unauthorised building work, commenced on or after 11 November 1985 and is 125% of the total of the Full plans application fee and inspection fee. Such applications are exempt from VAT.
3. Disabled person means a person who is within any of
the descriptions to whom Section 29 of the National Assistance Act 1948(a) applies.
4. Please refer to Building Control for dwellings in excess
of 300m2 in floor area. 5. Detached garages and carports having an internal floor
area not exceeding 30m2 are ‘exempt buildings’ providing in the case of a garage it is sited not less than one metre from all boundaries or alternatively it is constructed substantially of non-combustible materials. Extensions comprising a carport must be open on at least two sides.
6. All work carried out based upon an estimate of less
than £5000 or for work where Building Notice is used must be accompanied by the total fees that apply at the time of deposit.
7. The total cost of any work where the fees are based upon an estimate accepted by the Local Authority, is such reasonable amount as would be charged by a person in business for carrying out the proposed work but does not include VAT and professional fees paid to an Architect, Quantity Surveyor or any other persons. Where the fee is based on total estimated cost of the work a reasonable estimate will be required, which must be deposited with the application.
In cases where the Local Authority considers an estimate to be unreasonable, or where no estimate or fee is supplied, the Local Authority is authorised to treat plans as if they had not been deposited.
8. Please note: cheques made payable to Brighton &
Hove City Council.
Our charges are based on what work is required to fulfil our responsibilities in relation to checking all relevant plans and particulars and undertaking site visits.

Fees and Charges Individual determination of charges An individual assessment of our charges will be necessary for larger and/or more complex schemes. This includes:-
Work consisting of the erection of more than 10 dwellings
Work consisting of the erection or conversion of a dwelling where the floor area exceeds 300m2
Work consisting of two or more dwellings where there is a repeat of house type designs – this may attract a reduction in our standard fee
Where there is no standard charge shown in out tables of fees If your building work requires an individual assessment of a charge you should email Building Control at: [email protected] providing details of the proposed work/development together with a request for the Building Regulations charge. We will aim to contact you within 2 working days, or alternatively telephone (01273) 292485. Fees are based on work being completed within 18 months of commencement of the work. If completion is more than 18 months from commencement there may be an additional charge for inspections undertaken beyond that time. All charges, other than Regularisations, are subject to VAT at the current rate. Where Standard Charges cannot be applied to the proposed work please contact Building Control on (01273) 292485.
