I have attached the estimated costs from both Entergy and LEG for the completion of the lights on the East side of theNorth Interchange. LEG's estimate has been reduced from the original estimate of $65,151.60 to $57,575.35 due to thefact Entergy is allowing us to install one 4" conduit and one 2" conduit versus two 4" conduits. That is a reduction of$7,576.25.Shawn Hollingshead with Entergy did say that there would be a slight increase on their estimate of $24,990.26 from backin March. This is due to an increase in the price of materials. He did say that they are experiencing computer issues andthat he would have an updated estimate ASAP. When he gets that to me, I will forward it to you.

Dear Sir,

Please see the attached quote for the underground conduit to be run from Hwy 367/38 intersection to the East side of the Bridge. Entergy will stop approximately 200ft from the existing LC2 service point. We will then set a .Meter Loop(Service Point) to run the 200ft to the existing LC2. Entergy has given us the go ahead to use 1-4" conduit and 1-2" conduit. If there is an overrun the unit pricing will be used.

If you choose to go with the Entergy' s plan of overhead, we will honor the price of the service point from the West Side.

This work will be performed in accordance with the applicable Supplemental Specifications, Special Provisions, and the applicable sections of the Standard Specifications, Edition of 2014.

RESOLUTION NO. __OF 2019

A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK~TREASURER TO EXECUTE ANY DOCUMENTS NECESSARY TO ENTER INTO A CONTRACT WITH NEEL-SCHAFFER, INC FOR THE PURPOSE OF ENGINEERING DESIGN SERVICES FOR THE CITY OF CABOT TRAFFIC; AND FOR OTHER PURPOSES

WHEREAS, on March 19, 2018 the City Council passed Resolution No. 6 of 2018, waiving the current procedures for selection of professional services, established by Ordinance No 55 of 2003, to allow for the request for qualifications for traffic signal engineering design services; and

WHEREAS, the City advertised for Statements of Qualifications for Traffic Signal Engineering Design Services, statements were received and disbursed to a selection group. The selection group individually evaluated each qualification and has determined Neel-Schaffer, Inc to be the most qualified engineer firm for the project; and

WHEREAS, the City and Neel-Schaffer, Inc have negotiated the costs and terms of Phase II of the Traffic Signal Engineering Design Services, which is explained in more detail in Exhibit “A” attached hereto and incorporated herein by this reference, and the City desires to move forward with implementation of Phase II in the amount of One Hundred Six Thousand, Six Hundred Eighty-Eight Dollars and 38/100 Cents ($106,688.38); subject to the approval of this governing body.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT:

SECTION 1: The Mayor and City Clerk~Treasurer are hereby authorized to execute any

and all documents necessary to enter into a Contract with Neel-Schaffer, Inc, for Traffic Signal

Engineering Design Services.

SECTION 2: The agreed upon cost for Traffic Signal Engineering Design Services is in

the amount One Hundred Six Thousand, Six Hundred Eighty-Eight Dollars and 38/100 Cents

($106,688.38) and is hereby approved.

SECTION 3: This resolution shall be in full force and effect from and after its passage.

ATTACHMENT 1

TECHNICAL DESCRIPTION OF BASIC PROFESSIONAL SERVICES

PHASE 2 - SYSTEM SOFTWARE AND INTERSECTION DESIGN, CONTRACT DOCUMENTS AND BID/A WARD

PROJECT MANAGEMENT AND COORDINATION

The project will be managed following all applicable City, ArDOT and FHW A methods and procedures, as well as following all necessmy Local Programs requirements by ArDOT. At the beginning of the project and with the onset of each task, the Engineer will hold a kick-off meeting with the City and ArDOT to formulate a clear understanding of the project plans requirements, including discussion of submittals, advertisement and procurement. This meeting will include discussion of the project scope, schedule, communication protocol, and team organization to move the design and Signal System Synchronization vendor phases forward on a timely basis.

Project progress meetings for this task will routinely be conducted by teleconference (or on site) to provide detailed updates on the project status. These meetings will occur as needed, but no less often than monthly. Further reference to these meetings can be found in the specific task descriptions below. The Engineer will prepare agendas for and schedule all meetings with concurrence of the City's Project Manager and will distribute meeting minutes afterward.

Monthly status repo1ts will be prepared by the Engineer that cover the project progress from one report to the next and will indicate the work completed during the past month. These monthly repmts will most often accompany the monthly progress billing.

ENVIRONMENTAL DOCUMENTS

The Engineer will prepare the necessmy environmental documents to be submitted to ArDOT /FHW A. Typically, this type project with minimal constrnction and no environmental impact as well as no right of way issues would be documented as a Categorical Exclusion Type project. The Engineer will coordinate the matter with ArDOT and Metroplan.

SIGNAL SYSTEM SYNCHRONIZATION SOFTWARE, HARDWARE AND NETWORK SERVER

The signal software would be procured either by a 'best value' type procurement, or through sole source procurement.

Initially the Engineer will meet with the City and ARDOT to determine if a sole source procedure would be acceptable for this project and what would be required to meet FHW A guidelines for sole source procurement process. If this method is possible, then equipment specifications and other software requirements would be developed and submitted to the sole source vendor for costing and delive1y and negotiations with the City. If the procurement method is to be a 'best value' type of procurement, the software would be selected based on technical evaluation through a Request for Proposal (RFP) fonnat on how well the software vendor meets and answers the requirements stated in the RFP and the needs statements as per the approved System Engineering Analysis Report.

The RFP would consist of equipment specifications and other criteria for an off-the-shelf type software for city-wide master signal synchronization purpose as well as the manner of communications with the intersections including antennas for broadband co1mnunications if necessary mounted on the radio tower at City Hall. After procurement selection, cost of the software would then be negotiated with the City and a contract would be executed. The contract would include software vendor services, including configuration, training, testing and suppo1i. The Engineer will work with the City in performing the RFP review and rankings but will not have a vote in the selection. The City will need to provide at least three (3) City employees to review and rank the submitted RFPs.

Additionally, any vendor requirements for support and integration of the system, including conditional and final acceptance testing requirements and also annual support. Any required training and documentation desired by the City will be part of the RFP requirements.

Engineer will meet with the City's IT department to dete1mine how to incorporate the signal system master software/server on the existing city computer system via a network server. Vendors may also want to meet with the IT department and view the City's computer network setup. Any requirement for coordination with the City's IT department for installation of the network server and software will be included in either the sole source or RFP type procurement method. Installation of the server and software will done in direct communication and oversite by the City's IT department. This will include any coordination necessary for providing intersection communications to the network server/master ..

INTERSECTION DESIGN - LOW BID PROCESS

DESIGN PLANS AND TECHNICAL SPECIFICATIONS The Engineer shall provide engineering design services for the preparation of the signal modifications including detection/communications plans and specifications. The design plans will be developed using the Local Agency Technical Standards of ArDOT, and per City requirements, and all other applicable standards as required. For this scope, it is intended that the Plans shall include nine (9) signalized intersection layouts at the following locations:

• 2nd St (Hwy 367) at Elm St, Main/Pine St, and Locust St(3)• Main St (Hwy 89) at Going Dr., Dakota St. and 10 th St. (3)• Pine St (Hwy 89) at Lincoln St, Campground Rd and Panther Trail (3)

Signal Intersection Improvements may include new controllers, MMU's, video detection, Flashing Yell ow arrow phasing, controller modifications, broadband and cellular communications to the master, antennas, PTZ cameras and video processors, and possibly batte1y power back-ups.

The Engineer shall submit 60%, 90% and Final plan sets per ArDOT minimum requirements. It is not expected that any more plans submittals than these will be required. While no new signals will be designed for this project, all applicable standards and guidance in this Chapter will be used for any new detection or devices required. The intersection plan layout sheets shall be derived from existing pdf and CAD drawings supplied by the ArDOT and/or the City from past ITS, signal or intersection improvement projects. Survey and geotechnical data gathering is not included in this scope. The intersection plan layout sheets shall show existing features and detection, along with new detection types and their location. Any other new devices or features required by the ASCT, such as communications, cabling, or other detection, shall be shown on the plans and detail sheets. Detail

sheets shall include all requirements for the chosen detection, including notes, manufacturer installation requirements and drawings. The Engineer shall work with the signal system synchronization vendor, awarded the software contract, in regard to any communications or detection specifications required by the manufacturer, for the bid document.

The plans will include these sheets: • Title• Index• General Notes• Summary of Quantities• Recap of Quantities• SystemMap• Each intersection to include a detail plan sheet and a sheet of charts, wiring and phasing

diagram and intersection notes.• Equipment detail installation sheets• Standard Traffic Control Sheets

BIDs AND AW ARDs.

Two separate bid packages will include all items in this Task of work, the RFP selected by technical selection committee and a Low Bid Signal modification plan set for nine intersections. The first bid package shall be for the signal system synchronization software procurement. The second bid package will be for a Signal Modification Contract that will utilize an experienced signal installation contractor that will utilize the plans for installation of the required devices. The City will be responsible for the cost to advertise the projects in statewide newspapers as legal notices. The Engineer will prepare documents for the two bid packages, which shall include: Assistance in selection of the Signal System Synchronization software/hardware vendor Bid documents using standard City Contract language, as required Standard City Contract to be used to award the contract to the approved software vendor and approved low bidder. Assist the City in advertising and bidding both bid documents Attend any pre-bid meetings and be available for questions and clarifications prior to the bid opening The Engineer will assist the City in getting the contracts to the Vendor/Contractor for execution and submittal back to the City for City Board approvals and in coordinating the effort with ArDOT for authorization by ArDOT in acceptance of the bids and in obtaining notices to proceed.

ITEMS/SERVICES TO BE PROVIDED BY THE CITY: Any Corridor CAD or PDF drawings from previous ITS/fiber optic installations, maps, aerial photographs and as-built plans of the ASCT area in CAD or other format, as may be available within the normal resources of the City; Names, addresses, and telephone numbers of points of contact for all stakeholders, utilities and plan reviewers, which may prove useful Utility coordination assistance Existing Systems information and coordination Plans and specification review

negotiated with the City and a contract would be executed. The contract would include software vendor services, including configuration, training, testing and support.

After software selection, the procurement and installation of signal equipment, vehicle detection, and network equipment would be procured via low-bid based on design plans and technical specifications for the equipment (with any sole source equipment requiring further justification per 23 CFR). It is expected that the system software selection may drive technical specifications for the signal and network equipment, as required, to be compatible with the system software, so it will be important to involve the system software vendor as quickly as possible through the low bid construction design and specifications.

Under this Task Order Engineer will design to a Constmction Cost Limit, subject to the terms of Paragraph 5.02 of the Agreement and of Exhibit F to the Agreement. Exhibit F is expressly incorporated by reference. The Constmction and CE&I Cost Limit is $500,000. The bidding or negotiating contingency of 5 percent is to be figured into this Constmction Cost Limit. This Constmction limit if for the purposes of establishing the base bid and the Constmction Limits may be exceeded by the City if the City chooses to do so.

Bid documents will be developed to provide for add alternates for some of the intersection items which will allow the City to consider additional items beyond the base bid.

ORDINANCE NO. 2019

AN ORDINANCE TO ESTABLISH STANDARDS AND SPECIFICATIONS TO ADMINISTER AND REGULATE THE

RIGHT-OF-WAY IN THE PUBLIC INTEREST, AND TO PROVIDE FOR THE ISSUANCE AND REGULATION OF RIGHT-OF-WAY PERMITS

WHEREAS, the· City of Cabot ("City"), the City has the authority under Arkansas State Law to take appropriate actions to safeguard its streets, property and Rights-of-Way; and,

WHEREAS, The City is vitally concerned with the use, construction within, and occupancy of all Rights of Way in the City as such Rights of Way are a valuable and limited resource which must be utilized to promote the public health, safety, welfare, economic development of the City and to protect public work infrastructure; and,

WHEREAS, a uniform process needs to be in place which assures companies shall comply with all applicable local laws and regulations, including municipal ordinances and regulations, regarding the placement and maintenance of facilities in the public rights of way that are reasonable, nondiscriminatory, and applicable to all users of the Rights of Way within or belonging to the City; and,

WHEREAS, the City desires to establish reasonable nondiscriminatory regulations for the installation construction, maintenance, renewal, removal and relocations of Utility Facilities.

NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED by the Mayor and Council of the City of Cabot, Arkansas as follows:

Section 1. Purpose, Authority, Scope, and Definitions.

(a) Purpose. This ordinance prescribes the minimum requirements for theaccommodation of public and private utilities within the Right-of-Way within the municipal boundaries of Cabot, Arkansas.

(b) Authority. Under Arkansas Statue 14-200-101 the City of Cabot has theauthority to determine the terms and conditions upon which a Public Utility may be permitted to occupy the streets, highways, or other public places with the municipality.

(c) Scope. The provisions of this Ordinance shall apply to all Utilities andFacilities occupying the Rights of Way as provided herein.

( d) Definitions.

1. "City" means the City of Cabot, Arkansas;

2. "Codified Ordinances" means the Codified Ordinances of the City ofCabot, Arkansas;

3. "Construct" means but shall not be limited to, dig, bore, tunnel, trench,excavate, obstruct, install or remove signs, or Facilities, other than landscaping or ornamental plantings, in, on, above, within, over, below, under, or through any part of the Rights of Way. Construct shall also include the act of opening and/or cutting into the surface of any paved or improved surface that is any part of the Right of Way;

4. "Construction means" but shall not be limited to, the act or process ofdigging, boring, tunneling, trenching, excavating, obstructing, installing or removing signs or Facilities, other than landscaping or ornamental plantings, in, on, above, within, over, below, under, or through any part of the Rights of Way. Construction shall also include the act of opening, boring and/or cutting into the surface of any part of the Right of Way;

5. "Director" means the Director of Municipal Services of the City ofCabot, Arkansas, or his or her designee;

6. "Emergency" means a condition that poses a clear and immediatedanger to life, health, or safety of a person, or of significant damage or loss of real or personal property;

7. "Facility" or Facilities means any tangible thing, including but notlimited to pipes, mains, conduits, cables, wires, poles, towers, traffic and other signals, and other equipment, appurtenances, appliances and future technology of any Utility in, on, along, over, or under any part of the Rights of Way within the City;

8. "Facilities Representative(s)" means the specifically identifiedagent(s)/employee(s) of a Utility who are authorized to direct field activities of that Utility and serve as official notice agent(s) for Facilities related information. Utility shall be required to make sure at least one (1) of its Facilities Representatives available at all times to receive notice of, and immediately direct response to, Facilities related emergencies or situations;

9. "FCC" means the Federal Communications Commission or anysuccessor thereto;

10. "Permit" means an authorization which grants permission to conductspecific regulated activities on, in, over, under or within any right-of-way, and which may be subject to conditions specified in a written agreement with the City or in a related provision of this Code of Ordinances;

11. "Right(s) of Way" means the surface and space in, on, above, within,over, below, under or through any real property in which the City has an interest in law or equity, whether held in fee, or other estate or interest, or as a trustee for the public, including, but not limited to any public street, boulevard, road, highway, freeway, lane, alley, court, sidewalk, parkway, or any other place, area, or real property owned by or under the legal or equitable control of the City, now or hereafter, that consistent with the purposes for which it was dedicated, may be used for the purposes of constructing, operating, repairing or replacing Facilities;

12. "Service(s)" means the offering of any service by a Utility for a fee directly to the public, or to such classes of users as to be effectively available directly to the public, or alternatively, the provision of any service by a Utility between two or more points for a proprietary purpose to a class of users other than the general public;

13. "Service Agreement" means a valid license agreement, serviceagreement, franchise agreement, or operating agreement issued by the City or state pursuant to Law and accepted by a Utility or entered into by and between the City and a Utility, which allows such Utility to operate or provide service within the geographic limits of the City;

14. "Street or Streets" means the surface of, as well as the spaces aboveand below, any and all the streets, alleys, avenues, roads, bridges, tunnels and public places of the City within the corporate limits of the City, as the same now exist or may be hereafter extended or altered, and any location thereon, thereover or thereunder, and any portion thereof;

15. "Transfer" means the disposal by the Utility, directly or indirectly, by gift, assignment, sale, merger, consolidation, or otherwise, of more than fifty percent (50%) at one time of the ownership or controlling interest in the Facilities, or of more than fifty percent (50%) cumulatively over the term of a written approval of Registration of such interests to a corporation, partnership, limited partnership, trust, or association, or person or group of persons acting in concert;

16. "Unused Facilities" means Facilities located in the Rights of Way which have remained unused for twelve (12) months and for which the Utility is unable to provide the City with a plan detailing the procedure by which the Utility intends to begin actively using such Facilities within the next twelve (12) months, or that it has a potential purchaser or user of the Facilities who will be actively using the Facilities within the next twelve (12) months, or, that the availability of such Facilities is required by the Utility to adequately and efficiently operate its Facilities;

17. "Utility or Utilities" means All privately, publicly, or cooperativelyowned systems for producing, transmitting, or distributing communication, data, information, telecommunication, cable television, video services, power, electricity, light, heat, gas, oil, crude products, water/sewer, steam, fire and police signals, traffic

control devices, and street lighting systems, and housing or conduit for any of the foregoing, which directly or indirectly serve the public or any part thereof. The term "utility" may also be used to refer to the owner, operator, Utility, service, contractor or subcontractor, or any agent thereof, of any above-described utility or utility facility.

Section 2. Construction Permits Required.

(a) Permit Required. It shall be unlawful for any Utility to excavate or to construct, install, maintain, renew, remove or relocate Facilities in, on, along, over or under the public roads of the City without a Utility permit from the department of Planning and Environmental Services in accordance with the terms of this Ordinance.

(b) Permit Procedure. Utility Permits shall be obtained from the Director ofMunicipal Services ( or such other person as the Mayor may designate) upon application made on forms prescribed by the department of Planning and Environmental Services. The written application shall include the following:

1. The name and address of the Utility;

2. The nature, extent, and location of any work proposed to be done, alongwith satisfactory plans as attachments showing in detail the location of theproposed Facility or operations as described in the Permit application. Theplans shall show the size or capacity of Facilities to be installed; theirrelationship to Street features such as right-of-way lines, pavement edge,structures, etc., horizontal and vertical clearance to critical elements of theroadway and any other information necessary to evaluate the impact on theStreet and its operation;

3. The name and address of the person or firm who is to do such work;

4 The name, street address, email address if applicable and telephone and facsimile numbers of one (1) or more Facilities Representative(s).

5. The projected dates for the work to be started and finished;

6. An indemnity bond or other acceptable security in an amount to be set by the City to pay any damages to any part of the City road system or other Cityproperty or to any city employee or member of the public caused by activityor work of the Utility performed under authority of the permit issued;

7 A copy, ifrequested, of the Registrant's certificate of authority (or other acceptable evidence of authority to operate) from the Arkansas Public Service Commission and/or the FCC and any other similar approvals, permits, or agreements; and

8 A copy, if requested, of the service agreement, if applicable or other legal instrument that authorizes the Utility to use or occupy the Right of Way for the purpose described in the application.

(c) Permit Fees. Fees shall be determined by the Director of MunicipalServices, subject to the approval by resolution of the City Council. A fee schedule shall be available at the offices of the Director and the City Clerk and open for public inspection.

( d) Issuance of Permit. If the Director determines the Applicant has satisfiedthe following requirements, the Director may issue a permit.

1. Whether issuing of the approval will be consistent with this Ordinance; and

2. Whether Applicant has submitted a complete Application and has securedall certificates and other authorizations required by law, if applicable, inorder to construct Facilities in the manner proposed by the Applicant; and

3. The impact on safety, visual quality of the streets, traffic flow, and otherusers of the right of way and the difficulty and length of time of the Project,construction or maintenance.

( e) Emergency Situations.

1. Each Utility shall, as soon as reasonably practicable, notify the Director ofany event regarding its Facilities which it considers to be an Emergency.The Utility may proceed to take whatever actions are necessary in order torespond to the Emergency. A Utility who engages in an emergencyexcavation shall take all reasonable precautions to avoid or minimizedamage to any existing facilities.

2. In the event that the City becomes aware of an Emergency regarding UtilityFacilities, the City may attempt to contact the affected Utility or FacilitiesRepresentative. The City may take whatever action it deems necessary inorder to respond to the Emergency, including cut or move any of the wires,cables, amplifiers, appliances, or other parts of the Facilities. The City shallnot incur any liability to the Utility, for such emergency actions, and the costof such shall be paid by each Utility affected by the Emergency

(f) Effective Period of Permit.

1. Each permit shall have a set commencement and expiration date based oninformation provided in the applicant's permit application.

2. The Permit shall remain in place Construction is completed or until itsexpiration date unless the Utility is in default. The Director may give writtennotice of default to a Utility if it is determined that a Utility has

a. Violated any provision or requirement of the issuance or acceptance of aPermit application or any law of the City, state, or federal government;

b. Attempted to evade any provision or requirement of this Ordinance;

c. Practiced any fraud or deceit upon the City; or

d. Made a material misrepresentation or omission of fact in its Permitapplication.

(g) Cancellation for Cause. If a Utility fails to cure a default within twenty(20) Working Days after such notice is provided to the Utility by the City, then such defaultshall be a material breach and City may exercise any remedies or rights it has at law or inequity to terminate the Permit. If the Director decides there is cause or reason to terminate,the following procedure shall be followed:

1. City shall serve a Utility with a written notice of the reason or cause forproposed termination and shall allow a Utility a minimum of fifteen ( 15) calendar days to cure its breach.

2. If the Utility fails to cure within fifteen (15) calendar days, the City maydeclare the Permit terminated.

(h) Expiration of Permit. If work is not begun within six (6) months of thedate of issuance, the permit will automatically expire.

Section 3. Required Minimum Standards.

(a) Utility Accommodation Manual Adopted. The 2010 UtilityAccommodation Policy manual, including all references contained therein to codes, rules, regulations, schedules, forms and appendix items, promulgated by the Arkansas State Highway and Transportation Department, as may be amended from time to time is hereby adopted by reference and incorporated in the article as if fully set forth herein, subject to the amendments and modification contained in this Ordinance. A copy of the manual shall be maintained at the offices of the Director or his designee and open for public inspection. Any conflicts between the provisions of this ordinance and the manual shall be resolved in favor of the manual. References to State personnel, agencies, and fees shall be interpreted, where required, as meaning the City of Cabot municipal equivalents.

(b) Protection of Traffic and Roadway. Unless specifically in the Permit, no Utility may occupy the City Rights of Way unless sufficient space is available so that the

free flow and safety of traffic and other capacity considerations are not unduly impaired and the installation does not prevent the Department from reasonably maintaining the streets, structures, traffic control devices and other appurtenant facilities, and further provided that maintenance and operations of the Facilities do not jeopardize the traffic, street structure, other users of the right of way or the right of way itself.

( c) Grading: If the grades or lines of any street within the City Right of Way are changed at any time by the City during the term of the permit and this change involves an area in which the Utility's Facilities are located, then the Utility shall, at its own cost and expense and upon the request of the City upon reasonable notice, protect or promptly alter or relocate the Facilities, or any part thereof, so as to conform with such new grades or lines. In the event the Utility refuses or neglects to so protect, alter, or relocate all or part of the Facilities, the City shall have the right to break through, remove, alter, or relocated all or any part of the Facilities without any liability to the Utility and the Utility shall pay to the City the costs incurred in connection with such breaking through, removal, alteration, or relocation.

( d) Installation of Poles and Other Wireholding Structures and Relocation.Unless otherwise provided in a valid service agreement, no placement of any pole or wireholding structure of the Utility is to be considered a vested interest in the Right of Way, and such poles or structures are to be removed, relocated underground, or modified by the Utility at its own expense whenever the City determines that the public convenience would be enhanced thereby. The Facilities shall be so located and installed as to cause minimum interference with the rights and convenience of property owners.

(e) Notice of Intent to Excavate or Demolish. As provided in Arkansas Statue14-271-112 and other applicable state law currently in place or as amended, no Utility shall commence, perform, or engage in blasting or in excavating with mechanized excavating facilities unless and until the Utility planning the blasting or excavating has given 48 hours' notice by submitting a locate request to the One Call Center, beginning the next Working Day after such notice is provided, excluding hours during days other than Working Days.

Section 4. Restoration of Property.

(a) Each Utility shall be responsible for the cost of repairing any Facilities inthe Rights of Way and adjoining property or other Facilities which it or its Facilities damage.

(b) A Utility shall be liable, at its own cost and expense, to replace, restore or repair, any Street, Facilities or property or structure thereon, thereunder, thereover or adjacent thereto that may become disturbed or damaged as a result of the Construction or installation, operation, upgrade, repair or removal of Facilities to a condition as good as or better than its condition before the work performed by the Utility that caused such disturbance or damage. If the Utility does not commence such replacement or repair after twenty (20) Working Days following written notice from the City, the City or the owner of

the affected structure or property may make such replacement or repair and the Utility shall pay the reasonable and actual cost of the same.

Section 5. Inspection.

(a) The Utility shall make the Construction site available to the Director and toall others as authorized by Law for inspection at all reasonable times during the execution and upon completion of the Construction.

(b) At any time, including the time of inspection, the Director may order theimmediate cessation of any work which poses a serious threat to the health, safety, or welfare of the public, violates any law, or which violates the terms and conditions of the Permit and/or this Ordinance or issue an order to correct work which does not conform to the Permit and/or applicable standards, conditions or codes.

( c) When the Construction under any Permit is completed, the Utility shallnotify the department of Planning and Environmental Services.

Section 6. Other Approvals, Permits and Agreements.

(a) Additional Permits Required. The Utility shall obtain all construction,building or other permits or approvals as according to City ordinance, state or federal law. In addition, a Permittee shall comply with all requirements of laws, shall complete work in a way as to not cause any unnecessary or unauthorized obstructions of sidewalks, streets, waterways or railways, and is responsible for all work done in the Rights of Way regardless of who performs the work. No Rights of Way obstruction or excavation may be performed when seasonally prohibited or when conditions are unreasonable for such work, except in the case of an Emergency as outlined in Section 2 ( e ).

Section 7. Penalties.

(a) Every Utility convicted of a violation of any provision of this Ordinanceshall be punished by a fine not exceeding one thousand dollars ($1,000.00) per violation. Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief and revocation of licenses or permits.

Section 8. Aesthetic Standards

(a) Authority and Scope. Under Arkansas Statue 14-200-101 the City of Cabothas the authority to determine the terms and conditions upon which a Public Utility may be permitted to occupy the streets, highways, or other public places with the municipality. Further, 47 U.S.C. § 253(c) provides that the City has authority to manage its rights of way.

(b) The City finds it is in the best interest of the City and its residents andbusinesses to establish aesthetic requirements and other specifications and reasonable conditions regarding placement of facilities in the rights of way. These requirements, specifications and conditions are adopted in order to protect the public health, safety and welfare of the residents and businesses of the City and to reasonably manage and protect the rights of way and its uses in the City.

(c) The objective of this Section is to ensure use of the rights of way: (i) is consistent with the design, appearance and other features of nearby land uses; (ii) protects the integrity of historic, cultural and scenic resources; and (iii) does not harm residents' quality oflife.

( d) This Section applies to all requests to locate facilities in the Rights of Way and ongoing use of the Rights of Way for such facilities. This Section is established pursuant to City Charter and applicable law. This Section is administered by the Planning and Environmental Services Department.

( e) Placement or modification of facilities in the Right of Way shall complywith this Section at the time the permit for installation or modification is approved and as amended from time to time. Permittees are required to comply with City Code and applicable law and regulations.

(f) Definitions. Unless otherwise defined in Section 1 d, terms used in thisSection are as defined in Arkansas Code, Title 23, Chapter 17, Subchapter 5 ( the "Small Wireless Facility Deployment Act"). Definitions in this Section include references and citations to applicable federal and state laws. In the event that any referenced section is amended, the definition in the referenced section, as amended, shall control.

(g) Facilities Standards.

1. To the extent Teclmically Feasible, Facilities must be compatiblemshould be painted to match as closely as possible the size, mass, and color te-of similar - - - - - - - - f a c i l i t i e s in the same zoning area, with a goal of minimizing the - - - - - - - - p h y s i c a l and visual impact on the area-;

3. To the extent Technically Feasible, Facilities mB-St-should be locatedin alignment with existing trees and/or - - f a c i l i t i e s .

4. Facilities must maintain the integrity and character of theneighborhoods and conidors in vv7hich the facilities are located.

(h) Undergrounding. Facilities shall be installed underground in Il'lSERTA.REA./ ZONE/ DISTRICT] in accordance with the Unified Development Code, so long as placement underground will not materially impact the provision of service. Any individual requesting to locate facilities above ground in [INSERT AREl .. /ZONE / DISTRICT] has the burden to demonstrate by clear and convincing evidence that undergrounding will effectively prohibit the provision o f the service in question.

(i) Historie Distriet. Facilities installed in the historic district of the City shallconform to the provisions o f the [insert name for plan or other document

(k) Installation and Modification Standards. Installation of new facilities in,on, along, over, or under the rights of way or modification of existing facilities in, on, along, over, or under the Rights of Way shall:

Ensure that use of the Rights of Way does not inconvenience the public, interfere with the primary uses o f the Rights o f 'Nay, or

hinder the ability of the City or other government entities to improve, modify, relocate, abandon, or vacate the Right of Way or any portion thereof, or to cause the improvement, modification, relocation, vacation, or abandonment of facilities in the Right of Way, as permi ted by applicable laws.

(m) Plans for Use. No facilities shall be placed in, on, along, over, or under thepublic rights o f \Vay unless: (i) there are immediate plans to use the proposed facility; or (ii) there is a contract vv'ith another party that has immediate plans to 1-1se the proposed facility.

(1) Contact Information. Every facility placed in the rights of way shall at alltimes display signage that accurately identifies the facility owner and provides the facility owner's unique site number, and also provides a local or toll-free telephone number to contact the facility owner's operations center.

Section 9. Other Provisions.

(a) Severability. If any section, subsection, sentence, clause, phrase, or portionof this Ordinance is for any reason held invalid or unconstitutional by any court or administrative agency of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.

(b) Reservation of Regulatory and Police Powers. The City by issuing aPermit under this Ordinance, does not surrender or to any extent lose, waive, impair, or lessen the lawful powers and rights, which it has now or may be hereafter vested in the City under the Constitution and Laws of the United States, State of Arkansas and the City Charter, and under the provisions of the City's Codified Ordinances to regulate the use of the Rights of Way. The Utility by applying for and being issued a written Permit, is deemed to acknowledge that all lawful powers and rights, regulatory power, or police power, or otherwise as are or the same may be from time to time vested in or reserved to the City, shall be in full force and effect and subject to the exercise thereof by the City at any time. A Utility is deemed to acknowledge that its interests are subject to the regulatory and police powers of the City to adopt and enforce general ordinances necessary to the safety and welfare of the public and is deemed to agree to comply with all applicable general laws enacted by the City pursuant to such powers. In particular, all Utilities shall comply with City zoning and other land use requirements pertaining to the placement and specifications of Facilities to the extent that they apply under state law.

(c) Compliance. No Person shall be relieved of its obligation to comply withany of the provisions of this Ordinance by reason of any failure of City to enforce compliance.

( d) Appeal of Administrative Decisions. All appeals provided for by thisOrdinance and any notification to the City required by this Ordinance shall be in writing and sent via certified mail to the Director as specified in this Ordinance.

( e) Ordinance Headings. Ordinance headings are for convenience only andshall not be used to interpret any portion of this Ordinance

(f) Repealer. Except as provided otherwise herein, all ordinances or parts ofordinances in conflict with this ordinance are hereby repealed.

(g) Effective Date. This ordinance shall become effective immediately uponits adoption by the Mayor and Council of the City of Cabot.

RESOLUTION NO. __ OF 2019

A RESOLUTION APPOINTING ADAM NOBLES TO THE CABOT PARKS AND RECREATION COMMISSION; AND FOR OTHER PURPOSES

WHEREAS, Mike Nash’s term on the Parks and Recreation Commission expired September 16, 2019; and

WHEREAS, Adam Nobles is a capable and qualified citizen of the City of Cabot who desires appointment to the Cabot Parks and Recreation Commission; and

WHEREAS, Mayor Kincade hereby recommends the appointment of Adam Nobles to fill Position 6 , subject to the approval of this governing body.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT:

SECTION 1: Adam Nobles is hereby appointed to Position 6 of the Cabot Parks and

Recreation Commission; said term is set to expire on September 16, 2024.

SECTION 2: This resolution shall be in full force and effect from and after the date of

its passage.

ORDINANCE NO. __ OF 2019

AN ORDINANCE TO APPOINT DR. MATT MOUDY TO THE CABOT PLANNING COMMISSION; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, due to the resignation of, Jason Weatherly, the Cabot Planning Commission currently has a vacant position; and

WHEREAS, Dr. Matt Moudy is a capable and qualified citizen of the City of Cabot that desires to be appointed to the Cabot Planning Commission; and

WHEREAS, Mayor Kincade hereby recommends the appointment of Dr. Matt Moudy to the Cabot Planning Commission, subject to the approval of this governing body.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT:

SECTION 1: Dr. Matt Moudy is hereby appointed to the Cabot Planning Commission.

SECTION 2: Dr. Matt Moudy shall fill the vacant position on the Cabot Planning

Commission; the unexpired term is set to expire on July 9, 2021.

SECTION 3: EMERGENCY. The proper operation and appropriate planning of the

Planning Commission is of great importance to the health and welfare of the city of Cabot and its

citizens. An emergency is therefore declared and this Ordinance being necessary for the preservation

of the public peace, health, safety, and welfare shall be in full force and effect from and after its

passage.
