SUBMITTED BY: EDITH FAYE REDDENDICKENSON COUNTY HISTORICAL SOCIETY PRESIDENT
The story of the murder of William Vanover by broth-ers Wilson and John Bryant proved to be an interestingone. Several sources stated that Wilson Bryant was thefirst man to be convicted of a capital offense and Bryantwas sentenced to hang for his crime. Wilson Bryant’sstory should have ended at that point. However, further, research revealed that there was more to his story.
The details concerning the murder were presented inour last article. This week, we conclude with the rest ofWilson Bryant’s story beginning with the article that Ifound which intrigued me and started my research intowhat was supposed to have been the first hanging inDickenson County.
***
On Saturday, July 11, 1903, The Evening Bulletin,Maysville, Kentucky, published the following: “DiedProtesting Innocence”
“In the presence of many mountaineers Wilson Bryant, aged 28, was hanged at Clintwood, in Dickenson County,Virginia, just over the Kentucky line, at 1:45 Friday, forthe murder of William Vanover, aged 60 years, hiscousin, on Georges’s Fork, in October, 1902. Bryantprotested his innocence.”
Having been told that no hanging had ever taken placein Dickenson County, I continued my research. I foundthe following: To try to find an accurate, official conclu-sion to the Wilson Bryant story, I found the Journal of theSenate of the Commonwealth of Virginia, which wasdated January 13, 1904. According to that source, on July7, 1907, Virginia Governor Andrew Jackson Montaguecommuted Wilson Bryant’s sentence from hanging to 18years in the penitentiary. Governor Montague served asthe 44th governor of Virginia from 1902-1906.
The text of the governor’s commutation contained inthis book gave an official account and the governor’sopinion as to why he made the commutation. It read:“Wilson Bryant. Convicted in the county court ofDickenson County, November 1902, for murder firstdegree, and sentenced to be hanged July 10, 1903.Commuted July 7, 1903.
“Wilson Bryant was jointly indicted with his brotherJohn for the murder of William Vanover, a desperate andlawless character. Wilson was tried shortly after the com-mission of the crime and convicted of murder in the firstdegree; his brother John, however, first met a mistrial bya hung jury, and at this second trial received a verdict ofmurder in the second degree and was sentenced to impris-onment in the penitentiary for eighteen years.
“I {Governor Montague} have laboriously read thecopy of the record, together with many affidavits andcounter-affidavits. From the records the evidence, whilstsustaining a verdict of murder in the first degree, couldequally have sustained a verdict of murder in the seconddegree; indeed, in my opinion, the evidence more fullywarrants a verdict of murder in the second degree.
“It appears that Wilson Bryant did not lie in wait orseek the deceased, but that the latter sought him, appar-ently for a friendly interview. Only one witness, and shethe wife of a kinsman of the deceased, claims to have seenthe difficulty at quite a distance, and the bulk of her evi-dence is in no wise incompatible with that of the accused. Moreover, John Bryna{t}, who was convicted of murderin the second degree, confessedly did all of the shooting, while Wilson Bryant’s offence {sic} consisted wholly inaiding and abetting in the murder. “Upon these consider-ations, and others equally strong, I am moved by a pro-found sense of duty to save the life of this young man, whose sentence I commute to life imprisonment in thepenitentiary.
“It should be stated that a preponderance of the citi-zens of the county, together with prominent officials, have urged me by petition and letter to commute the deathsentence.”
Evidently, the newspaper article from The EveningBulletin, which reported the hanging of Wilson Bryanthad been written before the governor, commuted WilsonBryant’s sentence to life imprisonment. Even thoughthis particular article proved to be false, most articles innewspapers are accurate. A person should consider many
factors when using older articles for historical purposes. One main factor that should be considered is theage of the newspaper. One must remember that thetechnology of today did not exist in the early1900s. Current news was not as easily nor asquickly accessed as it is today. Another factor thatshould be considered is the opinion or politicalaffiliation of the person who wrote the article.Always try to document a newspaper article withmore than one source if possible.
The governor’s commutation should have beenthe end of Wilson Bryant’s story. Wilson Bryantshould have served eighteen years in the state pen-itentiary and then should have been released. However, the story did not end with that commu-tation.
According to the Lexington Gazette,Lexington, Virginia, dated Wednesday, May 6,1908:
“Wilson Bryant, of Dickenson County, servinga life sentence for murder in the penitentiary, onMonday night dyed his clothes with shoe polishand oil and made a break for liberty. He was seenon top of a high fence and ordered back. Hejumped for liberty and was shot to death by theguard. He was a desperate man and had previous-ly tried to escape.”
To prove that this newspaper account wasactually correct, I searched for further official doc-umentation and found a page from the AnnualReports of Officers, Board and Institutions of theCommonwealth of Virginia, which listed the fol-lowing: “Death List - October 1, 1907 toSeptember 30, 1908 - Wilson Bryant, white, April27, 1908. Shot in attempt to escape.”
Wilson Bryant did not become the first man tohang in Dickenson County nor did he serve out hiscommuted sentence of eighteen years in the peni-tentiary. The end of Wilson Bryant’s story camewhen Wilson Bryant died on April 27, 1908, whiletrying to escape from prison!
Newspaper articles stated that WilliamVanover’s body was returned to Kentucky for“burial” after his murder.
An earlier newspaper article from the ClinchValley News, Tazewell, Virginia, dated May 22,1903, {just before Wilson Bryant was scheduledto hang} stated that “Wilson Bryant has selectedhis burial place on Elkhorn Creek, in Pike Co.,Ky., underneath the shade of a spruce pine, and bythe side of his cousins, Garfield and George Potter, who were killed last summer” {1902}.
The story of the Potter cousins is one for a dif-ferent time!
