Newsletter 2018-40 October 5, 2018 CAWV LEADERS PART OF AGC 100 TH CENTENNIAL CELEBRATION AGC of America chapter leaders, including CAWV Senior Vice President Doug Meeks, Brewer & Company of West Virginia, and Vice President Mike Gianni, The James White Construction Company, met in Washington, D.C. September 30 to October 2 with their counterparts from around the country to learn best practices and to address AGC's top legislative issues. The annual AGC National Chapter Leadership Conference (NCLC) featured national speakers and breakout sessions on the industry's and the association's pressing issues, including federal initiatives for infrastructure investment, workforce development, membership development and environmental and regulatory issues. CAWV’s leadership also participated in AGC’s 100 th centennial celebration that included a gala attended by 1,300 members, past presidents and former chapter executives. “We learned that finding a qualified workforce is a problem for most every AGC chapter,” said SVP Meeks. “We heard from a number of states, particularly Georgia, South Dakota and Colorado, who are concentrating their efforts to promote construction careers to high school students. AGC is also making workforce development a top priority wit h their “Workforce 2.0” initiative. It was a great leadership conference with exciting and informative ideas about chapter advancement,” he said. “The AGC National and Chapter Leadership Conference and Centennial celebration was an informative experience that I believe will be beneficial for me in the future as a leader in the CAWV,” said Vice President Gianni. It was exciting to be a part of a national conference and interact with other contractors and AGC chapter leadership throughout the nation and get their views on issues that we in the construction industry experience together. The breakout sessions were well thought out and gave us a chance to choose to be part of a discussion with a smaller group concerning issues in the construction industry and chapter development,” he said. And on top of that, we were a part of history to be there to celebrate the Centennial of the AGC of America!” The two state construction leaders also attended sessions with their counterparts on developing successful membership marketing campaigns, financial oversight and cybersecurity best practices for chapters and how chapters can form effective coalitions to impact construction policy. AGC chapter leaders across the country learned about AGC of America’s efforts to make the “Tax Cuts and Jobs Act” permanent. The many provisions important to the construction industry from the Act are set to expire in 2025. Absent Congressional action, many construction firms will see their taxes increase.

CAWV WINS NATIONAL AWARD FOR HIGHWAY FUNDING CAMPAIGN The CAWV has won AGC of America’s 2018 Chapter Public Relations Award for its “Fix Our Road” campaign to increase funding for West Virginia’s highway construction and maintenance program. The award was presented to CAWV Senior Vice President Doug Meeks and Vice President Mike Gianni at AGC’s awards luncheon held in conjunction with AGC’s 100th Centennial celebration in Washington, D.C. September 30 to October 2. Each year, AGC recognizes excellent chapter public relations achievement during the calendar year. The CAWV submitted its initiatives to promote highway funding investment that resulted in Governor Jim Justice and the West Virginia Legislature passing a record-setting funding package in 2017. This is the seventh national award the CAWV has received. The association has been recognized for past efforts including the CAWV Hard at Work license plate campaign, the promotion of the Amendment 3 Clean Water Bond Amendment, the original development of the “Hard at Work” campaign to promote the construction industry, and the “Great West Virginia Trash Mash” campaign to rid the state of illegal trash dumps. WEST VIRGINIA SENATE ACQUITS JUSTICE WALKER West Virginia senators voted Tuesday to allow Supreme Court Justice Beth Walker to remain in office following a two-day impeachment trial. The vote was 32-1 with one senator absent. A two-thirds majority was required to remove Walker, whose 12-year term expires in 2028. Walker was accused of abusing her authority. The impeachment charge stated Walker and other justices failed to control office expenses and maintain policies over matters such as working lunches and the use of state vehicles and office computers at home. The vote came after two hours of deliberations and exactly five weeks before the general election, when half of the Senate seats are at stake. GOV. JUSTICE ANNOUNCES THAT $55.2 MILLION IN BONDS HAVE BEEN SOLD FOR STATE PARK IMPROVEMENTS Governor Justice announced this week that West Virginia sold $55.2 million in excess lottery revenue bonds, issued through the West Virginia Economic Development Authority (WVEDA), to fund $60 million in state park improvement projects to promote economic development and help grow tourism. Debt service on the bonds will be paid from revenues deposited in the Excess Lottery Revenue Fund which primarily include net profits of racetrack video lottery and limited video lottery machines. The bonds received strong ratings of “AAA” by S&P Global and “A1” by Moody’s Investor Services. This financing was a collaborative effort among State representatives from the Governor’s Office, the Division of Natural Resources, the WVEDA, the Department of Administration and the Lottery Commission. The bonds in the first 10 years were well received by the market and garnered investor orders in excess of the bonds being offered. Later year maturities, particularly 2031 to 2039, were priced at attractive credit spreads of 35 basis points over the MMD municipal index. These credit spreads represent the second most aggressive pricing levels in recent history of state-backed lottery bonds. TAKE SAFETY INSPECTIONS AND AUDITS SERIOUSLY One of the tools a company uses to keep updated on how their safety and health program is doing is to perform safety inspections and audits. Inspecting the work practices of employees and checking equipment to see that is still operating safely is just good common since. Auditing the safety and health program will normally result in finding weaknesses and create opportunities for improvement. Many times safety inspections and audits will uncover flaws in the safety process that need to be corrected immediately. One of the most fundamental failures companies make is to either ignore the flaws they find in the safety program or simply “put off “making the improvement until a more convenient time. First and foremost, the willingness to ignore a hazard that you have uncovered can get one or more of your employees injured. Putting off making a correction is never a good idea. One of the ways to keep safety improvements on track is to include a responsible employee in the safety inspection process. Don’t fear getting the workforce involved. It will develop more trust and a better safety program. Using the results of your safety inspection as a tool to find and fix safety flaws will not only go a long way toward preventing injury to employees but will also reduce the liability of the company in the event of claim or law suit. Make the documented safety inspection work for the employees and the company. Take the information generated as a result of safety inspections and make it work FOR you, not against you. Take safety inspections seriously. A safety inspection report can be a great tool to help a company grow and prosper, if it’s used to make improvements. Create greater trust among employees and provide the safest work environment possible. Take

(Reported in Millions) JOINT UTILITY COMMITTEE MEETS KEY ON INDUSTRY ISSUES The CAWV Joint Utility Committee met on October 4 to discuss several key industry issues. Chairman Mark Urso welcomed a large group of attendees to the meeting. Marie Prezioso, the Executive Director of the West Virginia Water Development Authority (WDA), reported that the WDA had closed 69 loans in the amount of $94 million, plus an additional $9.3 million in grants for Fiscal Year 2018. Prezioso also reported that the WDA has $40 million in projects that are currently under construction and her office is looking into several options to increase funding for FY 2019. Wayne Morgan, the Executive Director of the West Virginia Infrastructure and Jobs

Council (WVIJDC), reported there are 13 projects that now have binding funding commitments and they still have funds available as of now. He noted that the FY 2019 funding will be the same as FY 2018. Both Morgan and Prezioso noted that their agency’s number one priority will be to get as many projects funded as possible. The committee also received funding updates from several other funding agencies in attendance. Kathy Emery, West Virginia Department of Environmental Protection, informed committee members that the Clean Water State Revolving Fund has total binding commitments of $22 million with several of those coming to bid in the coming months. She also reported that the SRF funding for FY2019 will be $5 million more than the previous year’s funding level. Emery also gave the committee an update on the new construction storm water permits that are out for public comment. The comment period ends on October 19 and the permit can be found on the WVDEP website for review at the link below: https://dep.wv.gov/WWE/Programs/stormwater/csw/Pages/cswdocs.aspx#CSW%20docs Stephanie Hickerson, Assistant Unit Manager, Bureau for Public Health (WVBPH), reported there are several projects coming up that have dollars already committed. Hickerson noted that WVBPH has $34 million that will go to bid in 2019. She reported that funding has also remained stagnant at $8.5 million for next year. Harry Taylor P.E., U.S. Department of Agriculture (USDA), reported that the West Virginia office has $30,564,00 committed to projects for FY 2018 with an additional $9 million from the National USDA office. He noted that the West Virginia office is undergoing some restructuring and he will update the committee on the outcome of that at the next CAWV Joint Utility Committee meeting. Several other industry issues were discussed during the meeting including project completion delays, utility locating on West Virginia Division of Highways right-of-way, project payment delays and waste site permits. The next meeting of the Joint Utilities Committee will be on January 24 at the CAWV and committee members will receive notice of the meeting. WVDOH IN TRANSITION TO wvOASIS - ESTIMATE BLACKOUT PERIOD IN EFFECT

The WVDOH’s much anticipated change over to wvOasis for Construction Estimate Payments began October 1, impacting Estimate Payments in September and October. The DOH has paid everything up through the September 7 estimate cutoff date under the old / current system. These payments should have been received the week of September 24th. It was necessary for the DOH to skip the September 21 estimate as they transfer to the new system, thus paying for work performed during this outage period on the October 5 estimate. This estimate will likely be paid the week of October 15th.

PAVING INDUSTRY WRAPS UP ANNUAL MEETING AT CANAAN The Asphalt Pavement Association of West Virginia (APAWV) concluded its Annual Fall Meeting on Sunday with a prayer breakfast, featuring a message about flood recovery from Rev. Jack Lipphardt, WV United Methodist Church Disaster Recovery. Nearly 170 members and their families attended the meeting at Canaan Valley Resort in Davis, WV. Despite being one of the wettest years on record, attendees were treated to blue skies and warm weather for the weekend retreat that featured business sessions and family-oriented activities. The Friday business session featured remarks and a Q&A session with State Highway Engineer Aaron Gillispie and Deputy State Highway Engineer for Construction and Development Todd Rumbaugh. The day also featured a golf and sporting clays tournament and evening banquet featuring remarks by MetroNews Talkline Host, Hoppy Kercheval. Members got a look at the 2019 paving program from a presentation at the Saturday business session by Ryland Musick, director, WVDOH Programming Division.
