Our records show that a well construction/pump installation permit was issued for the subject well on June 18, 1992 (attached). Bya letter dated September 30, 1993, the Commission on Water Resource Management (Commission) administratively approved an extension of the start of consrruction date to March 18, 1994. Our September 30, 1993 letter notified you that the completion date was June 18, 1994.

Since we have not received a well completion report for the subject well, we assume that no work was done under this permit, which has expired. Be advised that a new application for a well construction permit must be made and approved by the Commission prior to any future well construction work.

In the event that the well was constructed under the permit, please submit the following items that are required under Standard Condition 5 within thirty (30) days from the date of this letter:

a. Well Completion Report (form enclosed). b. Elevation (referenced to mean sea level) survey by a Hawaii-licensed surveyor. c. As-built sectional drawing of the welL d. Plot plan and map showing the exact location of the well. e. Complete pumping test record; including time, pumping rate, drawdown, chloride

content, and water quality data.

Be advised that failure to comply with the terms of your permit may result in daily fines of up to $1000.

Our permit was approved in June of 1992, but we were unable to make the installation due to the following circumstances (during the 12 month period allotted) : First we had the (100) year flood which devastated our land in Holoaa Valley, washed out our driveways, ruined tools & equipment, etc., setting us back considerably; Then, not totally recovered from the flood, Iniki hit Sept. 11, 1992. This did again wreak even greater havoc on our structures, our land, and again on our tools & equipment. This catastrophe required all our attention, physically, emotionally & financially to re-build & to reconstruct our lives, causing us to forego our well installation and construc­tion planned during that period.

We would greatly appreciate your consideration in the extension of our WELL PERHIT due to circumstances described as we hope to pro­ceed in the next few months.

TO: Mr. Joseph H. Roger P.O. Box 548 Kilauea, HI 96754

In accordance with the Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled l'Water Use, Wells, and Stream Diversion Works", your application to construct, test, and install a pump in Moloaa-Roger Well (Well No. 1120-10) within Tax Map Key: 4-9-09:31 for domestic use, is approved subject to the following conditions:

1. The Commission on Water Resource Management staff (Commission stafO, P.O. Box 621, Honolulu, Hawaii 96809, shall be notified, in writing, before any work covered by this permit commences.

2. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct and pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a committment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

3. The permit shall be for construction, testing, and installation of up to a 1/2 hp capacity pump in the well, as determined by the pumping test results. The applicant shall submit to the Commission staff the test results and proposed permanent pump information, based on the test, for approval by the Chairperson. No permanent pump may be installed and no water used from the well without the Chairperson's approval.

4. The applicant shall provide and maintain an approved meter or other appropriate device or means for measuring and reporting total water usage on a monthly basis. .

5. The following shall be submitted to the Commission staff within 30 days after completion of the well:

a. Well Completion Report.

b. Elevation (referenced to mean sea level) survey by a Hawaii-licensed surveyor.

c. As-built sectional drawing of the well.

d. Plot plan and map showing the exact location of the well.

e. Complete pumping test record; including time, pumping rate, drawdown, chloride content, and water quality data.

6. The applicant shall comply with all applicable laws, rules, and ordinances.

7. The permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work shall be completed within two years of the date of issuance.

8. The applicant shall contact the State Historic Preservation Division (Telephone: 587-0006) before starting any work on the project. The applicant shall obtain a written statement from the State Historic Preservation Division indicating that their concerns have been addressed, and a copy of that statement shall be sent to the Commission before work is started on the project.

9. Water from the well shall not be used for drinking water unless properly tested and treated. The Department of Health recommends that at a minimum, the operator of the well routinely do chemical tests for nitrates, DBCP, ethylene dibromide (EDB), trichloropropane (TCP), and bacteriological test for coliform bacteria prior to any domestic of human consumption.

Makawao Stream Bridge, Maunawili

These projects are not expected to affect Hawaiian Home Lands, and we have no direct comment. We would like to raise some considerations, however.

1. The Moloaa well is another small private well, joining many others in this same area. Understanding private property prerogatives, the situation nonetheless raises the question whether the State has an interest in reducing the potential of aquifer contamination from a multiplicity of wells. Is there a vehicle for encouraging the cooperation of the several parties in a joint management system, or even a community system that can serve all parties?

2. The Makuu well (Paradise Park) is near Hawaiian Home Lands, where the Department will be making improvements for 177 agricultural lots covering 725 acres. DHHL

anticipates the need for 89 Kgd potable domestic water, and 1.45 Mgd in irrigation water at full development. Improvements are scheduled for 1996. This represents only partial development of Hawaiian Home Lands at Makuu (totalling 2000 acres).

Thank you for the opportunity to review and comment on the subject document. We have examined the application and have the following comments to offer:

1. The application indicates that the subject well will be for domestic use. If the well is to serve 25 or more individuals at least 60 days per year or will have a minimum of 15 service connections, the applicant will be required to comply with Hawaii Administrative Rules, Title 11, Chapter 20, Potable Water Systems.

2. Section 11-20-29 of Chapter 20 requires that a new source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.

3. The proposed well is situated above the Underground Injection Control (UIC) line. Land areas above the UIC line are considered to contain underground sources of drinking water. Thus, it is essential that the well be designed and constructed to prevent the possibility of groundwater contamination. For example, the well should have a concrete well pad and full grouting to prevent seepage or floodwaters from migrating down the well shaft.

4. The proposed well is located approximately 500 feet from the Department of Water's Moloaa Tunnel (state well no. 1120-01). It should be pointed out that in July 1983, this source was shut down by the Department of Water due to excessive levels of nitrates and dibromochloropropane (DBCP). In the event that Chapter 20 does not apply, we would highly recommend that at a minimum, the operator of the well routinely do chemical tests for nitrates, DBCP, ethylene dibromide (EDB), trichloropropane (TCP), and bacteriological test for coliform bacteria prior to any domestic or human consumption.

No historic sites are known to be present in the area planned for the pump, but a review of our files indicates that several burial sites, agricultural terraces and heiaus exist nearby. No archaeological surveys have taken place in the project area, so we are uncertain if significant historic sites are present in the project area.

Given this information, we recommend that an archaeological inventory survey be conducted to determine if significant historic sites are present. Alternatively, if the parcel has had its land surface extensively disturbed in the past, the applicant should submit a description of this disturbance.
