၁။ CITES ဆသညမာ အျပညျပညဆငရာကြနဗငးရငးတစခ၏ အမညက အတေကာကေခၚဆျခငး

ျဖစသည။ “ မးဆကပကသဥးလဆ ေတာ႐ငးတရစာၦနႏင သစပငပနးမနမား ႏငငတကာ ကနသြယမႈဆငရာ

ကြနဗငးရငး ” Convention on International Trade of Endangered Species of Wild Fauna and Flora

(CITES) ဟ ေခၚဆသည။

၂။ ကမာၻေပၚရ ဇ၀မးစမးကြမားတြငပါ၀ငသည ေတာ႐ငးတရစာၦနမားႏင သစပငပနးမနမားတ႔က

ကာကြယထနးသမးေရးအတြကရညရြယၿပး ဖြ႕စညးချခငးျဖစသည။ ၁၉၆၀ ျပညႏစ ၀နးကငခန႔တြင ကမာၻ႔

သပၸပညာရငမားအသငးအ၀နးမ အပငႏငေတာ႐ငးတရစာၦနမးစတမားျဖစသည သဘာ၀သယဇာတ

အရငးအျမစမားတ႔က ကမာၻအ၀နး အလြနအကၽြ ထတယသးစြျခငး၊ ကးသနးေရာငး၀ယျခငးမား ျပလပ

လာၾကသညက သတထားမလာခၾကသည။ တစခ႕ေသာမးစတတ႔မာ ကမာၻေျမျပငေပၚမ ကြယေပာက

သြားခၾကေၾကာငး၊ တစခ႕မးစတတ႔မာ မၾကာမအခနတြင ေပာကကြယသြားေတာမည အႏ ရာယႏင ႀကေတြ႕

ေနရေၾကာငးတ႔က ေဖာထတေတြ႕ရလာခၾကသည။

၃။ ၁၉၆၃ ခႏစတြင ကငးပေသာ IUCN –World Conservation Union သ႔မဟတ International

Union for Conservation of Nature and Natural Resources အဖြ႕ႀကး၏ အဖြ႕၀င ႏငငမားအစညးအေ၀းႏင

၁၉၇၂ ခႏစ ဇြနလအတြငး ဆြဒငႏငင၊ စေတာဟမးၿမ႕၌ ကငးပေသာ လသားပတ၀နးကငဆငရာ

ကလသမဂၢညလာခတ႔မ ဆးျဖတခကအရ ကမာၻေပၚရ ရားပါး၍ မးသဥးေပာကကြယမည ေတာ႐ငး

တရစၧာနႏငသစပငပနးမနမား၊ ယငးတ႔၏ အစတအပငးမားက တရားမ၀ငအလြနအကၽြထတယျခငး၊

ေရာငး၀ယျခငးမားက ႏငငတကာျပနာတစရပအေနျဖင ပးေပါငးထနးခပ ကာကြယႏငရနအတြက The

International Convention on Regulations of Export, Transit and Import of Rare or Threatened

Wildlife Species or their Skins and Trophies က ေရးဆြသတမတခၾကသည။

၄။ ၁၉၇၃ ခႏစ မတလ ၃ ရကေန႔တြင ႏငငတကာကြနဗငးရငးတစရပအေနျဖင စတငဖြ႕စညးချခငး

ျဖစသည။ ၁၉၇၅ ခႏစ ဇလငလ ၁ ရကေန႔တြင ၀ါရငတနဒစ၌ ကငးပသညအစညးအေ၀းတြင ႏငင(၈၀)ေကာမ

ကယစားလယမားတကေရာကကာ အဖြ႕အစညးအေနျဖင စတငအာဏာသကေရာကေၾကာငး ထတျပနေၾကညာ

ခသည။ ၀ါရငတနဒစၿမ႕တြင စတငဖြ႕စညးခမႈေၾကာင ၀ါရငတနကြနဗငးရငးဟ အစပထမတြင လသမားခၿပး

ေနာငတြင CITES ဟ ျပငဆငေျပာငးလသးစြခသည။ အဖြ႕၀ငႏငငေပါငး (၁၇၅)ႏငငအထရလာခၿပး ျဖစသည။

အဖြ႕၀ငႏငငမားအျပင အသငးအဖြ႕အစညးမား၊ သေတသနဌာနမား၊ အစးရမဟတေသာ အဖြ႕ အစညးမား၊

ပနးမနႏင ယငးတ႔၏ အစတအပငးမားအား တရားမ၀င အလြနအကၽြေရာငး၀ယေနမႈက ႏငငတကာျပနာ

တစရပအေနျဖင အဖြ႕၀ငႏငငမားမ ပးေပါငးထနးခပကာကြယရန။

၇။ ျမနမာႏငငအေနျဖင ၁၉၉၇ ခႏစ စကတငဘာလ ၁၁ ရကတြင CITES ကြနဗငးရငသ႔

အဖြ႕၀ငအျဖစ စတင၀ငေရာကခသည။ အဖြ႕၀ငႏငငမားအား ဖြ႕ၿဖးၿပးႏငငႏင ဖြ႕ၿဖးဆႏငငဟ၍ ခြျခားၿပး

ႏစစဥေၾကးထည၀ငရေလရသည။

၈။ CITES ကြနဗငးရငးအတြငးေရးမး႐းက ဆြစဇာလနႏငင၊ ဂနဗာၿမ႕၌ အေျခစက႐းဖြငလစထားရၿပး

ကြနဗငးရငးအဖြ႕၀ငႏငငအခငးခငးၾကားတြင CITES ဆငရာစညးမဥးစညးကမးမား လကနာေဆာငရြကေရး

အတြက ေစာငၾကပၾကည႐ႈျခငး၊ ဆကသြယညႏႈငးေဆာငရြကေပးျခငးမားက အတြငးေရးမး႐းမ တာ၀နယ

ေဆာငရြကေပးသည။ ႏငငအလက ေအာကပါအတငး ဆကသြယေရးတာ၀နခမားထားရသည-

(က) စမအပခပမႈဆငရာတာ၀နခ( CITES Management Authority)။ ကးသနးေရာငး၀ယမႈ

ဆငရာကစၥရပမား၊ ေမြးၿမျခငး၊ မးပြားျခငးဆငရာကစၥရပမားတြင လအပသလ စစစ

ႀကးၾကပျခငး၊ မတပတငျခငး၊ တငပ႔ျခငး၊ တငသြငးျခငးဆငရာ ခြငျပခကပါမစမား (CITES

Export/ Re-Export/ Import Permit/ Exhibition Permit ) မားက ထတေပးျခငးတ႔

ေဆာငရြကသည။ ထနးခပကာကြယထားသည ေနာကဆကတြစာရငး၀ငအပငႏင

ေတာရငးတရစာၦနမားတ႔၏ အဆငအတနးသတမတခကမားက ျပငဆငႏငရန အၾကျပ

ေပးျခငး၊ အတးအေလာျပလပျခငးတ႔အတြက တာ၀နယေဆာငရြကသည။

( ခ ) သပၸဆငရာတာ၀နခ( CITES Scientific Authority)။ ႏငငအတြငးႏင ျပညပႏငငမား

မမးစတမားဆငရာ ရားပါးမႈ၊ ကာကြယထနးသမးမႈအဆငအတနးမားက တကဆငစစေဆး

ေပးျခငး၊ ေနာကဆကတြစာရငး၀င Appendixes မားအျဖစ သတမတႏငေရး အပခပမႈ

ဆငရာတာ၀နခထသ႔ သပၸဆငရာအၾကေပးျခငး၊ အခကအလကမားျပစေပးျခငးတ႔က

တာ၀နယေဆာငရြကသည။

၉။ သဘာ၀အပငမား ႏင ေတာ႐ငးတရစာၦနမားတ႔၏ ႏငငတကာကးသနးေရာငး၀ယမႈဆငရာကစၥ

ရပမားႏငပတသက၍ CITES Secretariat ႏငေသာလညးေကာငး၊ အဖြ႕၀ငႏငငအခငးခငးႏငေသာလညး

ေကာငး၊ အျခားအစးရမဟတေသာအဖြ႕အစညးမားႏငေသာလညးေကာငး ဆကသြယေဆာငရြကျခငးက

ပတ၀နးကငထနးသမးေရးႏငသစေတာေရးရာ၀နႀကးဌာန၊ သစေတာဥးစးဌာနမ တာ၀နယေဆာငရြကေပး

သည။

၁၀။ ေတာ႐ငးတရစၧာနႏင သစပငပနးမနမားအား ေပါမားမႈ၊ ရားပါးမႈအေျခအေနက စဥဆကမျပတ

ေလလာစးစမးေဖာထတျခငး၊ သပၸသေတသနျပလပျခငးမားအရ ႏငငတကာကးသနးေရာငး၀ယျခငး၊ စးပြားေရး

အလ႔ငာေမြးျမျခငးမားက ထနးခပတားဆးရနအတြက အဖြ႕၀ငႏငငမားအေနျဖင လကနာေဆာငရြကရန

စညးမဥးဥပေဒမား ထတျပနသတမတခပါသည။ ကြနဗငးရငး၏ သတမတခကပါ မးစတမား ႏငငတကာ

ကးသနး ေရာငး၀ယျခငး၊ အလအလယျပလပျခငး၊ တငးျပညတစခႏငတစခ တငသြငး/တငပ႔ျခငးမား အတြက

ေအာကပါစညးကမးခကမားအတငး တစညတစညြတတညးလကနာရန အဖြ႕၀ငႏငငမားမ သေဘာတလကခ

ကငသးလကရသည။ အဆပါသတမတခကမားတြင ေတာ႐ငးတရစၧာနႏင သစပငပနးမနမား၊ ယငးတ႔၏

အစတအပငးမားႏင ပတသက၍ ေအာကပါအတငး ေနာကဆကတြစာရငးမား (CITES Appendixes)

အျဖစသတမတကာ အဆင(၃)မး သတမတထားသည။

(၁) အလြနရားပါးၿပး မးသဥးရနအႏရာယကေရာကေနေသာ မးစတမားအားလးက

(၁) မၾကာမကာလအတြငး မးသဥးေပာကကြယရနအလားအလာရသည မးစတမား

အားလးက သတမတသည၊

(၂) မးစတမား၏ သဘာ၀တြငရသညအေရအတြကႏင ရငသနမႈက ထခကျခငး

မရပါက သတမတစညးကမးမားအတငး ကးသနးေရာငး၀ယမႈက ခြငျပႏငသည၊

ထတျပနသတမတခက Convention Text ၏ ေနာကဆကတြစာရငးအျဖစ သတမတထားသည သဘာ၀

အပငမားႏင ေတာ႐ငးတရစာၦနမားတ႔၏ မးစတမားစာရငးက ျပငဆင၊ေျပာငးလသတမတျခငးက အဖြ႕၀င

ႏငငမားညလာခအစညးအေ၀း Conference of the Parties (CoP) တြငသာ တငျပ၍ သေဘာတညခကရယၿပး

ညလာခအစညးအေ၀း၏ ဆးျဖတခကျဖငသာ ေဆာငရြကႏငသည။

၁၂။ CITES ကြနဗငးရငးအဖြ႕၀ငႏငငမားအစညးအေ၀းက ၂ ႏစတစႀကမကငးပေလရသည။ ၁၉၇၅

ခႏစ ဇလငလ ၁ ရကေန႔တြင ႏငငေပါငး(၈၀)မ ကယစားလယမားျဖင စတငစညးေ၀းကငးပကာ CITES

အဖြ႕ႀကးက တညေထာငချခငးျဖစသည။ ၁၉၇၇ ခႏစမ စတငကာ (CoP 1) ပထမအႀကမညလာခအစညးအေ၀း

ျပလပကာ CITES Convention Text ႏငတကြ Appendixes မားက သတမတထတျပနခသည။ ၂၀၁၀ ခႏစ

မတလ၌ ကာတာႏငင၊ ဒဟာၿမ႕တြင (CoP 15) အစညးအေ၀းက ေနာကဆးကငးပထားခၿပးျဖစသည။ ၂၀၁၂

ခႏစ မတလတြင (CoP 16) အစညးအေ၀းက ထငးႏငင၊ ဘနေကာကၿမ႕၌ ကငးပသြားမညျဖစသည။

၁၃။ သစပငပနးမနႏင ေတာ႐ငးတရစာၦနမးစတမားႏင ယငးတ႔၏ အစတအပငးမား၊ ဆငပြား

ထတလပမႈပစၥညးမားအား ေရာငး၀ယေဖာကကားျခငး၊ အလအလယ ျပလပျခငး၊ ေရႊ႕ေျပာငးသယေဆာငျခငး

တ႔က ျပလပရာတြင အျပညျပညဆငရာသဘာတညခကအျဖစ ကနးလမး၊ ေရလမး၊ ေလယာဥလမးေၾကာငး

မားမ တစဆင တငသြငးျခငး၊ တငပ႔ျခငး၊ တစဆငျပနလညတငပ႔ျခငးမား( Import, Export, Re-Export)

အတြက အလြယတကထနးခပႏငရန စစေဆးခရန၊ တငျပရန ခြငျပခကမားက စပစအျဖစအသးျပထတေပး

ေလရသည။ ထသ႔ထတေပးသည ပစက အဆငဆင ေပးပ႔စစေဆးျခငးျပလပသည။ မညသည ခြငျပခကပစ

CITES Permit မားကျဖစေစ ေအာကပါအတငး ထတေပး၊ ျဖန႔ေ၀ေလရသည-

(က) မရငးခြငျပခကပါမစ ။ တငပ႔/တငသြငးသထသ႔ထတေပးရသည။

( ခ ) ပါမစမတမား။ CITES Secretariat ကြနဗငးရငး႐း၊ သကဆငရာႏငငအလက CITES MA

မားတ႔သ႔ ျဖန႔ေ၀ရသည။

CITES Secretariat ႏင CITES Management Authority တ႔အၾကား ဆကသြယေဆာငရြကမႈစနစ

၁၄။ CITES Permit ထတေပးျခငးအတြက ထတေပးသညႏငငမ စမအပခပမႈတာ၀နခ CITES MA

သည ထတေပးသည ခြငျပခကပါမစအေပၚ ေအာကပါအတငးတာ၀နခစစေဆးရနလအပသည-

(က) ျမနမာႏငငအတြက CITES Permit မားက ၁၉၉၄ ခႏစ ေတာ႐ငးတရစာၦနႏင

သဘာ၀အပငမား ကာကြယေရးႏင သဘာ၀နယေျမမားထနးသမးေရး ဥပေဒအရ

ျပညေထာငစ၀နႀကးခြငျပခကျဖင ညႊနၾကားေရးမးခပ၊ သစေတာဥးစးဌာနက ထတေပး

ပငခြငရသည။

( ခ ) ပါမစလကမတမနကနေၾကာငးႏင ထတေပးမႈအတြက မးစတမားႏငပတသက၍

သပၸဆငရာ ရငးလငးေဖာျပခက ေထာကခခကလအပသည။

( ဂ ) တငသြငး/တငပ႔မညႏငငဖကရ CITES Management Authority ထသ႔ မတကေပးပ႔၍

CITES Permit ထတေပးျခငးက အသေပးထားရမည။

(ဃ) မတ ၁ စအား CITES Secretariat, Geneva, Switzerland ရ ကြနဗငးရငး႐းသ႔

ေပးပ႔ရမည။

( င ) CITES Permit က အလကထေရာနစေကာပျဖငလညး ျဖန႔ေ၀ေပးပ႔ႏငသည။

၁၅။ ဥပေဒမားထတျပနထားရမႈ။ ျမနမာႏငငအေနျဖင ကြနဗငးရငးမ၀ငေရာကမကပင မမႏငငအတြငး

ေရးယခငကတညးက ထတျပနေၾကညာခသည ဥပေဒမားအေပၚ ေခတစနစႏငကကညေစေရးျပငဆငေရးဆြ

၂-၁-၄၊ (CITES Article Article IV®�nß~àâ{é�၃)

A Scientific Authority in each Party shall monitor both the export permits granted by that

State for specimens of species included in Appendix II and the actual exports of such

specimens. Whenever a Scientific Authority determines that the export of specimens of

any such species should be limited in order to maintain that species throughout its range

at a level consistent with its role in the ecosystems in which it occurs and well above the

level at which that species might become eligible for inclusion in Appendix I, the

Scientific Authority shall advise the appropriate Management Authority of suitable

measures to be taken to limit the grant of export permits for specimens of that species.

Instructions and explanations (These correspond to block numbers on the form)

1. Tick the square which corresponds to the type of document issued (export permit, re-export certificate, import permit or other). If the box "other" has been ticked, the type of document must be indicated. The original number is a unique number allocated to each document bythe Management Authority.

2. For export permits and re-export certificates, the date of expiry of the document may not be more than six months after the date of issuance (one year for import permits).

3. Complete name and address of the importer. 3a. The name of the country must be written in full. 4. Complete name and address of the exporter/re-exporter. The name of the country must be stated. The absence of the signature of the

applicant renders the permit or certificate invalid. 5. Special conditions may refer to national legislation or special conditions placed on the shipment by the issuing Management Authority. This

block can also be used to justify the omission of certain information. 5a. The following codes should be used: T for commercial, Z for zoos, G for botanical gardens, Q for circuses and travelling exhibitions, S for

scientific purposes, H for hunting trophies, P for personal, M for medical, E for education, N for reintroduction or introduction into the wild, and B for breeding in captivity or artificial propagation, L for law enforcement / judicial / forensic.

9. Describe, as precisely as possible, the specimens entering trade (live animals, skins, flanks, wallets, shoes, etc.). If a specimen is marked (tags, identifying marks, rings, etc.), whether or not this is required by a Resolution of the Conference of the Parties (specimens originatingin a ranching operation, specimens subject to quotas approved by the Conference of the Parties, specimens of Appendix-I species bred in captivity for commercial purposes, etc.), indicate the number and type of mark. The sex and age of the live animals should be recorded, ifpossible.

10. Enter the number of the Appendix of the Convention (I, II or III) in which the species is listed. annual reports. 11a. Indicate the total number of specimens exported in the current calendar year (1 January to 31 December) (including those covered by the

present permit) and the current annual quota for the species concerned (for example 500/1000). This should be done for the nationalquotas as well as for those determined by the Conference of the Parties.

12. The country of origin is the country in which the specimens were taken from the wild, bred in captivity or artificially propagated, except inthe case of plant specimens that cease to qualify for an exemption from the provisions of CITES. In such instances, the country of origin isdeemed to be the country in which the specimens ceased to qualify for the exemption. Indicate the number of the permit or certificate of the exporting country and the date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-exports;

12a. The country of last re-export is the country from which the specimens were re-exported before entering the country in which the present document is issued. Enter the number of the re-export certificate of the country of last re-export and its date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-export of specimens previously re-exported.

12b. The “No. of the operation” is the number of the registered captive-breeding or artificial propagation operation. The “date of acquisition” isdefined in Resolution Conf. 13.6 and is required only for pre-Convention specimens.

13. To be completed by the official who issues the permit. The name of the official must be written in full. The security stamp must be affixedin this block and must be cancelled by the signature of the issuing official and a stamp or seal. The seal, signature and security-stamp number should be clearly legible.

14. To be completed by the official who inspects the shipment at the time of export or re-export. Enter the quantities of specimens actually exported or re-exported. Strike out the unused blocks.

15. Enter the number of the bill of lading or air way-bill if the method of transport used requires the use of such a document. The document must be written in one of the three working languages of the Convention (English, Spanish or French) or must include a fulltranslation into one of these three languages. Exported and re-exported specimens should not appear on the same document unless it is clearlyindicated which specimens are being exported and which re-exported.
