The office of Congressman Adam Smith has been assisting with the EB-5 Regional Center application for the Artemis Hotel, which has been in processing delay at the USCIS for two years.

TEC Equipment closed on their purchase of the Seattle Mack Truck company site on Pacific Highway S. on April 15th and began the permitting process for building expansion.

Dr. Nha-Tran Dinh Tran of All Smiles Dental on Pacific Highway was welcomed to the

Pacific Ridge neighborhood.

Businesses have reported more activity with the Waterland Card since its second release in the new City Currents magazine. Restaurants are the main beneficiaries and have been appreciative of the increased business.

The DMPD conducted a quarterly meeting of local apartment complex managers, and offered an opportunity to make a presentation about the Waterland Card. The cards were well received as a means to market to new tenants, and a courtesy item to be distributed to existing tenants.

LEGAL

Civil Matters. To-date, the Legal Department has opened 103 files for civil matters; primarily advisory work to assist the City’s operating departments.

Legal staff finalized a draft Franchise Ordinance to construct, install, operate, maintain,

repair, or remove fiber optic cables within the public ways of the City of Des Moines with the Zayo Group LLC. It was submitted to the City Council for review on March 14, 2013. The Council passed the Ordinance to a second reading on the next available Consent Calendar. The Franchise Ordinance was enacted by the City Council on May 25, 2013.

Legal staff continues to work on drafting a Franchise Ordinance with Midway Sewer

District to construct, maintain, operate, replace, and repair its sewer system, in, across, over, along, under, through, and below the public rights-of-way of the City.

The City Attorney and Prosecuting Attorney attended the WSAMA Spring Training

Conference in Cle Elum in April. Some of the topics of discussion were: legislative updates from the 2013 Session; dealing with major and minor gifts; criminal case law updates; preparing for I-502; municipal and regional courts study; group homes; land use case law update; perspectives from the Public Employment Relations Commission Director; finance panel; marijuana and enforcement; and preparing law enforcement for trial.

Prosecuting Attorney

o Des Moines: The Prosecuting Attorney filed 642 infractions and citations, 132

Woodmont Photo Enforcement infractions, and 198 Midway Photo Enforcement infractions in April, 2013 for Des Moines and appeared at 355 criminal hearings. He represented the City at 38 hearings involving infractions that were being opposed by private counsel, 2 code enforcement hearings, and 5 animal control hearings. Staff also responded to 25 infraction discovery requests.

o Normandy Park: The Prosecuting Attorney filed 37 infractions and citations in

April, 2013 for Normandy Park, appeared at 75 criminal hearings, and represented the City at 3 hearings involving infractions that were being opposed by private counsel. Staff also responded to 1 infraction discovery request.

MARINA

ADMINISTRATION Capital Improvement Program The staff is currently working on several small projects.

Security Cameras at Redondo. The contractor began installing the equipment during the last week of April and the system is expected to be up and running by mid May.

Activity Float Canopy. Two bids were received for fabricating the canopy and the staff is working thru some modifications suggested by the fabrication shops. The staff expects to issue a notice to proceed with the fabrication early in May.

Storage Yard Improvements. Staff is waiting for better weather to begin clearing the lot.

6th Ave. Stairway Gates. When the Waterford Condos were built, the City required that the developers install a stairway from 6th Ave. to the Marina floor on the north side of the building. As part of the negotiations the City agreed to install gates on the stairway and lock them at night. Because of recent incidents of vandalism and the general increase in inappropriate behavior in the south parking lot, the condo association has demanded that the City honor the agreement and install the gates. The gates have been designed and the Condo Association has approved the plans. The staff is in the process of getting three bids for the project.

MAINTENANCE Other than the regular seasonal maintenance tasks the staff completed the repairs to the bulkhead under the approach to the Public Fishing Pier in the Marina and worked with a contractor to get the concrete walkway re-poured. The following series of pictures shows the stages of the project. The first picture shows the site excavated with some of the plywood and timber lining applied. The second picture shows the crew applying the geo-textile filter fabric that will prevent the fine fill material from washing out. The third picture shows the installation of the rebar that is necessary to support the concrete slab and the fourth picture shows the contractor pouring the new approach. The last two pictures show the finished project.

PARKS & RECREATION

Des Moines Beach Park Rehabilitation Projects Staff has been working with Washington State Legislators in the 33rd and 30th Districts asking for their support of the $750,000 Washington Heritage Capital Grant that is on a list proposed for 2013 Biennium Funding to complete Beach Park Dining Hall rehabilitation. The 33rd District Legislators are working hard to help with this funding request. A lobbying group made up of the 26 heritage grant applicants on the list is working together to support the $10 million needed to fund all 26 projects during the 2013 legislative session.

John D. Spellman Historic Preservation Award

On April 23rd the City was awarded the John D. Spellman Award for exemplary achievement in the restoration of the Des Moines Beach Park Auditorium. The Award was presented by the Honorable Dow Constantine, King County Executive, who represented the Association of King County Historical Organizations and King County Executive’s John D. Spellman Historical Preservation Annual Awards. The joint awards ceremony was held at the Museum of History and Industry in Seattle.

Sonju Community Garden Awarded Grant The Des Moines Sonju Community Garden was one of nine recipients awarded a grant in the amount of $6,264 as part of the “Grow Your Park” Grant Program, sponsored by the Darden Foundation and the National Recreation and Park Association (NRPA). Grant funds will be used to purchase a greenhouse to grow plants for Food Bank clients, purchase tools to maintain the historic orchard trees and to work on expanding the garden’s connection to the community by developing a gardening resource library to help teach local residents about growing their own fresh vegetables.

Des Moines Arts Commission City Public Works and Parks and Recreation staff are working with the Arts Commission on the Temporary Sculpture Project. For the first year, five sculptures were selected to be loaned from Artists and placed one of the concrete pedestals located in the Marina District. These sculptures will be installed in May 2013. City Council has authorized two additional pedestals to be located as part of the S. 216th Gateway project. These sculptures will be installed prior to the dedication of the new roadway. All contracts for the Summer Concert Series have been finalized. This year the Commission has partnered with Destination Des Moines to sell beer and wine in the Founders Lodge during the concerts. There will also be a food vendor in the Beach Park allowing patrons the opportunity to purchase food and beverages.

Before and After School Program The Before and After School Program had strong numbers with 160 children attending Des Moines, North Hill, Marvista, Parkside and Woodmont Elementary Schools. Midway Elementary School children attend the program at Des Moines Elementary School and are transported daily by staff. Emphasis is placed on homework, exercise, and healthy snacks. Teen Dance 162 Pacific Middle School students attended the “Dancing Doubles” themed dance at the Field House. Staff and DJ Joeii Getty’s did a great job creating a safe option for teen entertainment on a Friday night.

Spring Soccer To date 29 soccer teams have been formed and are participating in our Soccer League playing games in Des Moines and SeaTac.

Half Marathon - Cove to Clover April 28th was an exciting day for 130+ participants in the first Cove to Clover Half Marathon which started at the opening to the Des Moines Beach Park, proceeded up the hill and onto 6th south bound, and then wrapped around into the Marina and then north back to the entrance of the park. Participants then continued through the park to the Des Moines Creek Trail head and up the trail to SeaTac. It was a great opportunity for our city departments to work together on a great event. There were several dignitaries in attendance who assisted with the race. Mayor Dave Kaplan had the honor of starting both the ½ marathon walkers and racers. Mayor Pro Tem Matt Pina and his wife Michelle directed participants up the Des Moines Creek Trail, and Councilmember Melissa Musser directed participants as they headed out of the Marina.

Chairs were set up around the fireplace for guests to welcome the mayor and ask questions about activities, projects and other issues related to the City of Des Moines municipal government. Aviation History- the Flight Attendant Who Changed It All Our Aviation History series continued on April 16 with Mary Patricia Laffey Inman, a retired Northwest Airlines flight attendant, who presented a vivid account of the major role she played in not only the history of aviation, but the history of women’s equal pay for equal work and the women’s movement back in the 1960’s.

POLICE DEPARTMENT

Officer Scott Oak was hired as a lateral police officer on 4/16/13. Scott was previously employed with Black Diamond PD and comes to us with about 10 years of experience.

Background investigations are in progress on two record specialist applicants.

Patrol Teams continued their liquor theft deterrent program by parking a department

police decoy car outside of various businesses and continue walking through of the liquor area in local stores.

On April 25 & 26, Command Staff attended a two day conference at CJTC for Law

Enforcement Executives and the response to active shooters and mass casualty incidents.

CSO Seaberry, CSO Batterman and Chief Delgado attended the quarterly Rental Managers meeting at Newport Apartments. Guest Speakers were Sean Martin from the Rental Housing Association and Marion Yoshino from the City Economic Development program.

CSO Seaberry met with the HOA representatives of Mariner Condo’s and Waterford Condo’s. Both properties are located in the Marina area. Main concern of both properties was vandalism and property theft in the area. A safety audit was performed for both and follow up safety meeting are in the works for both properties.

CSO Batterman, MPO Young, Commanders Bohl and Sellers hosted 2 drug take back

locations in our City. We collected 356lbs of unused and/or unwanted prescription drugs. This program is sponsored by DEA and provides citizens the opportunity to turn in old and unused drugs for destruction.

CAPITAL & FACILITY PROJECTS

Here is a summary of the activity in support of this year’s facilities and CIP projects in Transportation, Surface Water Management and Municipal Capital Improvements: Transportation CIP Transportation Gateway Project: S. 216th Segment 2 (18th Avenue S. to 24th Avenue S.): Expect delays and some lane closures

as the contractor makes utility crossings. Much of the work will progress on the north side of the roadway and traffic will be shifted as work progresses. The Contractor has until early spring 2014 to complete the project, but is attempting to wrap it up by this December.

24th Avenue S (S 208th St to S. 216th St.): Staff coordinated street intersection improvements

with the City of SeaTac in preparation for going out to bid. Staff also addressed PSE High Voltage relocation; drafted an interlocal agreement with Highline Water District (HWD) for waterline replacement; addressed local property owner concerns; solicited two remaining construction/access easements from property owners; coordinated with the Public Works Trust Fund on a potential capital construction funding resource and applied for a DOE NPDES permit. Segment 1A – staff worked with the City’s Legal Department and Bartell’s Drug owner on a quit claim deed to resolve an incorrect 1996 legal description.

Citywide Arterial Safety Improvements: The City has been awarded $250,000 from WSDOT

through Highways and Local Programs for arterial safety enhancements such as updated crosswalk markings, stop bars, and arrows, along with new street name signs for the arterials within Des Moines. Staff completed the design in April and submitted a request to WSDOT for authorization of construction funds. Staff is anticipating beginning construction in May or early June.

North Hill/Aviation School Zone Flashers: Staff submitted a grant request for $15,000 to

install 4 solar school zone flashing beacons for 8th Ave South and South 200th Street. Notification of the grant is expected in mid-June.

Surface Water Management Des Moines Memorial Drive 212th-213th Pipe Project: The project is being designed in-

house. Project schedule is to bid the project in early June. Construction is scheduled for this summer.

216th Place Pipe Project: The project is being designed in-house and is scheduled to be bid and constructed with the Des Moines Memorial Drive 212th-213th Pipe project.

Lower Massey Creek Channel Modification Project: A Task Order Assignment for the design and permitting has been approved by Council and the consultant given the notice to proceed. Construction is scheduled for 2014 depending on obtaining the necessary permits.

Barnes Creek/Kent-Des Moines Road Culvert Replacement Project: Staff met with Tetra Tech to begin scoping the design work. However, the cost for the preliminary and design

work is substantially higher than expected. The project has been placed on hold pending direction at the next available Environment Committee meeting.

Municipal Capital Improvements SR 509 Right-of-Way (ROW)/Barnes Creek Trail: The Appraisal of the property has been

sent to WSDOT. Staff received a response letter from WSDOT in December, and a meeting was held in early January to discuss the issues. A follow-up on site meeting was held in February. WSDOT has informed staff that they feel a new appraisal will be required. Staff will continue to work with WSDOT staff in an effort to reach resolution. Once an agreement on fair market value for the property is reached, staff can finalize the acquisition process. Design of the trail improvements is scheduled for 2013. ___________________________________________________________________________

Some building project highlights include:

Healthpoint, 36,000 SF Medical Arts Building, 26401 Pacific Highway S: The exterior cladding is nearing completion. The grounds are beginning to transform. Electrical, mechanical and plumbing systems work continues. The contractor for the building “shell” should be complete around July 1, and then the interior TI’s (tenant improvement) will take place. The Building Division will process those permits as they come in. The contractor has not been named.

SeaMar Medical Office Building (MOB) & Family Housing Project, 24215 Pacific Highway S: This large scale multi-building project was submitted for plan review on January 11, 2013. The Medical Office Building will be a 16,340 square foot steel and concrete building. The Family Housing building will be a 43,064 square foot wood framed structure. The plans and permit are nearing completion. The first contractor bids did not come back favorable due to the improving construction climate. The project is back out to bid.

Des Moines Veterinary Hospital, 21935 Pacific Highway S: This remodel and expansion project is now complete.

Highline College, Building 21: This $0.5 million project includes an exterior entrance to this building. This project is complying with ADA requirements and upgrades for this classroom building and is nearing completion.

Highline College, Building 4: This $3.2 million project on the Performing Arts Center building began the first week in January. Demolition, asbestos and lead based paint removal is complete. Crews are framing interior wall areas involved with this substantial remodel. This remodel involves renovations of spaces and interior partitions, a new roofing system, exterior windows and doors, a new entrance canopy, and upgrades to the HVAC, plumbing, electrical, and telecom systems. Veterans NW Construction is the contractor and the project is currently on schedule.

Artemis Hotel: This seven story hotel, located at 22406 Pac Highway was submitted for plan review on February 11th and is currently under review. Planning, Building and Public Works have been meeting with the Architect and Structural Engineer of record regarding revisions to the design.

Fire Alarm Upgrade for Multi-Unit Residential Buildings (R-2’s): We have had great success working with owners and condominium associations in an effort to avoid issuing citations. Current status of the 22 occupancies:

o 18 complexes have completed installation o 1 complex has submitted for a fire protection permit with the City. o 2 complexes currently have their fire alarm system installation underway. o The SeaTac Valu Inn property remains out of compliance and has received

multiple citations from the City. With the exception of the SeaTac Value Inn, substantial progress was made in April.

CODE ENFORCEMENT

Code Enforcement had 37 new cases opened and 30 cases closed during April. Thus far in 2013, 149 cases have been opened, 141 closed, and 113 are currently open. There were 0.5 volunteer administrative hours for Code Enforcement in April. Code Enforcement continues involvement in a King/Pierce County Hoarding Task Force. Currently working on database for resources to help residents and their families bring their properties into compliance.

Short Subdivisions Pending Review/Approval Atkinson 2 Lot Short Plat, 8XX S 280th Street, 1/17/06: Preliminary approval with

conditions was granted 10/4/10. Applicant submitted for civil plan review on 7/20/11. Review comments sent to applicant 8/9/11, 10/4/12 & 4/26/13.

Axcent Servicing 9 Lot Short Plat, 1615 S 260th Street, 11/20/07: Preliminary plat approval was issued 4/21/10. Applicant intends to pick up necessary permits later this spring and start construction/site work in June. Pre-construction meeting held 5/3/13. Applicant will post bond and pick up civil plans, grading permit and ROW permit.

Wagner 2 Lot Short Plat, 25639 Marine View Drive S, 10/24/07: Preliminary plat re-submittal routed for review 6/19/12. Preliminary approval issued 8/9/12. Engineering Plan Review routed 2/5/13. Civil plans approved 4/4/13 and are waiting for posting of bond.

Land Division Requests with Approvals, Pending Construction Landmarque 67 Lot Plat, 262xx Pacific Highway S 4/03/06: Plat improvements are 90%

complete and permit approvals for new home construction is at 27 units. There are three items that staff is tracking for full plat completion: final lift of asphalt, new wetland monitoring, and installation of improvements for the public park. Applicant is working with Staff on final park plan improvements which will be required to be installed soon.

Pacific Heights PUD, 77 lot PUD, 15xx S 279th Place, 6/1/11: On 1/07/13 civil plans were conditionally approved by City staff. Grading and ROW permit issuance are pending Army Corps of Engineer approval to fill certain wetland areas.

Commercial Scale Projects Pending Review/Approval JC Marble, 25447 Pacific Highway: This project involves construction of a 9,940 square

foot warehouse building addition to an existing retail space. Initial submittal attempts were unsuccessful due to deficiencies in plans and application materials. On 3/29/2013 staff met with a contractor who will be taking over the permitting and construction. The contractor is in the process of obtaining designs and revisions to the building from the architect which will then be submitted to the city.

SeaMar Mixed Use Development, 24215 Pacific Highway: This proposed 12,000 medical office building and separate 43 unit apartment structure has completed Design Review. Artemis Hotel, 234 Room Hotel, S 224th St. and Pacific Highway Building permit application filed on 2/11/2013. Plans filed were subject to foundation and structural system changes. An initial comment letter was provided to the applicant on 3/08/2013. City staff has been in contact with the project architect and final revisions to the initial plan set are being prepared.

Im, 6/25/10: On 6/22/12, the applicant filed the Shoreline Variance, SEPA, and Grading

Permit applications for the unpermitted retaining wall and the proposed additions to an existing house. These applications were deemed complete on 7/20/12. Staff completed its review of the project and provided comments back to the applicant on 9/13/12. On 2/12/2013, the applicant filed resubmitted materials in response to previous City comments. Staff reviewed the SEPA documents for the proposal and issued a DNS decision on 3/27/2013. The appeal period concluded on 4/21/2013 and an appeal was filed on behalf of a neighboring property owner. Planning staff and the City Attorney held a conference call with counsel representing the neighboring property owner. Counsel indicated that his client is aware of the revisions in the resubmitted application and are not in agreement with the applicant’s assertion of code compliance.

City Services, Project Management and Coordination Marina Master Plan-Lot Aggregation/Reorientation: The existing platting patterns of both

terrestrial and marine properties under City ownership are confusing for existing operations and not conducive for future marina development. A re-plat of these properties is needed to clarify ownership patterns and identify properties that are encumbered or otherwise restricted, but used for Marina purposes. Staff is currently waiting for the surveyor to incorporate properties located north and south of the marina parking into the short plat.

Text Change—Sign Code modifications for City Readerboards: This is a City sponsored code change that would facilitate the installation of electronic readerboard devices that would then be used to communicate civic events and activities by Parks personnel, or messages regarding road closures/detours, or announcements from Police or from Emergency Operations Center command.

Text Change—Street Standards modifications for Short Plats: This is a City sponsored change in response to Council’s request that staff review and address situations in which existing street improvements may be considered too onerous for smaller developments. Planning and Engineering staff have researched how other cities respond to similar situations. Draft changes have been discussed at the Council committee level on 4/4/13 and at a Council meeting on 4/11/13. Based upon those discussions, revised draft language was presented for discussion at a 5/9/13 PS&T committee meeting.

Federal Way School District, SEPA Mitigation Coordination: The City is currently accepting building permits for the 67 lot Landmarque housing development. As part of the SEPA review process, the City SEPA Official agreed to collect mitigation in-lieu-of impact fees in response to District concerns. Staff has been collecting and retaining fees for this development, but there is no formalized mechanism to allow our Finance Department to remit the fees to the District. Staff is working with the District and our Legal Department to develop and MOU that would address this issue.

Solid Waste/Recycling: o A King County Household Hazardous Wastemobile event was held at the Des Moines

Marina from 4/26-28/13. o City staff attended the Metropolitan Solid Waste Management Advisory Committee

meeting on 4/12/13. Agenda items included updates on the ILA process and transfer station upgrades and siting.

PLANNING DIVISION Sound Transit Coordination and Planning Attended Sound Transit’s Interagency Working Group meeting. Sound Transit provided an

overview of their Level 2 evaluation results and discussed alternatives to moving forward for detailed analysis in the environmental impact statement.

Pacific Highway S Corridor Planning Growing Transit Communities Technical Advisory Committee – provided feedback on the

station area typologies and draft Corridor Action Strategies that detail the actions and tools needed to make it easier to develop jobs and housing in areas associated with transit investments along the South Corridor. Growing Transit Communities is designed to help make the most of the voter approved $15 billion investment in regional rapid transit.

Continued coordination with City staff, Consultant (Grant Fredricks) and the Council Finance and Economic Development committee on potential amendments to the Pacific Ridge zoning in an effort to support redevelopment goals for the neighborhood and increase revenue opportunities for the City.

SURFACE WATER MANAGEMENT (SWM) DIVISION Illicit Discharge Detection and Elimination (IDDE) Residents are directed to call 206.870.6869 to report discharges or spills. Residents may also call the after-hours hotline at 206.550.5612 or the Police non-emergency number at 206.878.3301 during times that City Hall is closed. NPDES Permit Activity The new Western Washington Phase II Municipal Stormwater Permit became effective on 9/1/12. This permit is a one-year reissuance of the previous five-year permit. The next five-year permit was also published on 9/1/12 and will become effective on 8/1/13. The 2013 permit contains significant changes including increases in monitoring, inspection, and maintenance requirements; and the addition of low impact development requirements. Staff submitted the 2012 annual report and associated documents on 3/28/13. The updated Surface Water Management Program and annual report have been posted on the City’s website. Inspections of drainage control structures/facilities associated with, or located on private property are approximately 96% complete, with letters being issued to owners of control structures in need maintenance or repair.

Car Wash Kit Usage Car Wash Kits are available for organizations wanting to conduct fundraiser activities. The Car Wash Kit helps to prevent pollutants such as petroleum products, pesticides and animal waste, from being discharged into the Puget Sound. Organizations wishing to acquire a car wash kit should contact Ken Thomas at 206.870.6585. Rate Equity Study Financial Consulting Solutions (FCS) Group has been contracted to perform a comprehensive stormwater rate structure study. The purpose of the study is to recalibrate the City’s stormwater rate structure to ensure that the rates are equitable across all rate classifications while keeping the overall rate revenue neutral. Any changes from the study would not be effective until 2014, allowing time for the study, public hearings and changes to be made in the County billing system. FCS prepared five issue papers for discussion at the February Environment Committee meeting. A second meeting was held April 11 for finalizing the issue papers. FCS is also in the process of evaluating the City’s billing system and impervious area calculations. Staff is in the process of measuring the impervious areas for all single family residences city-wide. The study is currently scheduled for discussion at the May 23rd Council meeting. Pipe Program Tracking Beginning last year, staff began tracking participation in the Pipe Program. This program was established nearly 20 years ago and has been a very successful and popular way to fill and pipe many of the City’s nuisance road side ditches. Because the pipe work benefits both the City and property owners, each pipe project involves a contract between the City and property owner whereby the property owner pays for the material costs and the City provides the labor and equipment to perform the project. On average each year, nearly a dozen projects are done installing more than 1,000 feet of storm pipe. Following the issuance of the City Currents, which included an article about the Pipe Program, eight requests for the program have been received. Staff is now reviewing the requests. If all of the current requests are granted and completed, the work load for this year would likely exceed 1,000 feet of pipe. Two pipe program projects were completed during the month of April comprised of 135 feet of pipe. Year-to-date, 135 feet of pipe and 0 catch basins have been installed. It is anticipated that at least three more projects will be completed next month.

Division Administration and Management Budget:

o Transportation Benefit District Collections for April 2013 were $37,818. As a comparison, the April 2012 collections came in at $37,303.

Traffic Engineering and Operations Street Lighting: Staff is working on a potential energy and annual cost savings proposal

which would involve conversion of existing neighborhood High Pressure Sodium (HPS) street lights to LED lights. Staff brought a proposal forward to full council on April 4th and was given direction to proceed with a 3-year change out program of roughly 1,021- 100 watt lights.

Traffic Calming: Staff received a petition from several residents in the North Hill area requesting removal of the existing traffic circles. Staff responded that they would attempt to look at this request in October. In the meantime, staff has also heard from at least one resident in favor of keeping the traffic circles and a petition of that nature may be forthcoming. Staff briefed the PS&T Committee on March 7th as to the findings and recommendations of our investigation. There were some follow-up questions for staff and direction to report back to the Committee in April. Staff prepared a follow-up memo in April which provided some alternatives and costs.
