A. MAYOR’S REPORT.

The City Council will be holding a Special meeting next Monday night, February 13 at 6PM. The purpose of the meeting is for City Council action on a proposed Request for Proposals for O&M of the Wastewater Treatment Plant.

Mayor Thornton thanked the Public Works staff for the great job they did keeping the roads clean.

B. ATTORNEY’S REPORT

Reported on the February 8, 2017 Growth Management Hearings Board hearing. Due date for a decision is March 23rd.

POLICE CHIEF, MARC DENNEY. Chief Denney reported that the 2016 Annual report is finished and available to the public. Thanked the Public Works staff for the finishing the dog run. Presented letters from the middle school thanking the police department for the support. Reported on the Interim policing program and introduced Brian Bechtold to the council; Brian will be an Intern at the Police Department in conjunction with the Partners in Careers program.

PUBLIC WORKS, DIRECTOR SARVIS – Director Sarvis reported on the storm costs; commented briefly on the upcoming Special Meeting on February 13th; updated on the Water Trail Park. Council member Williams asked for an update on construction. The staff report is part of this record.

6. CITIZEN’S PUBLIC COMMENT.

Jane Poole, representing the Entrepreneurial Women Writers and Artist, reported on the upcoming “Arts & Culture Tour”. The tour is on Saturday, February 18, 2017; more information is available at http://www.janespoole.com/tour.html

Suzi Terrell 628 E. 18th Street – thanked Mayor and staff for assistance with the Historical Town Hall meeting that was held on February 6, 2017.

Director Sarvis introduced Paul Eisenhardt, of Eisenhardt Group. Mr. Eisenhardt presented a PowerPoint (a copy of which is part of this record) that outlined the procedures and timeline for issuing a Request for Proposals for the operations and maintenance of the City’s wastewater treatment plant.

Larry Lewton, 1109 W. C Ave asked about the cost comparison of outsourcing vs. keeping the O&M ‘inhouse’; he asked about the determination of purchasing new equipment; asked about regulatory compliance.

Re: Final 2016 Financial Report

Attached you will find the final 2016 ending balances and a comparison of budget to actual.

General Fund revenues

Overall revenues ended at 118% / $676,509 over budgeted amounts, primarily due to gambling revenues and building activity. Gambling revenues were $461,044 higher than budgeted.

General Fund expenditures – Total expenditures ended at $97,430 under budget.

Finance department – City attorney costs were $10,260 over budgeted; consulting costs were over due to the HR consultant brought on for city employee training. Capital & professional costs were higher than budgeted due to purchasing / installing new server in 2016 rather than 2017 and costs for purchasing and setting up council iPads.

Legislative department were lower than budgeted from not having the services of a lobbyist; some saving from reduction in city events budget.

Police department overtime was higher than budgeted by $24,000; benefits were a bit lower; police department fuel was about ½ of what was budgeted; Officer Education (degree program) was $7,395 under budget; intergovernmental costs (jail, CRESA, court charges for citations) were slightly under budget; capital over budget due to upgrade of vehicle computers.

Planning department – salary costs lower than budgeted (original budget included salary costs for PT building inspector) offset somewhat by cost of a contract building inspector; planner professional services a bit lower than budgeted; costs for the Comprehensive Plan / Capital Facilities / Transportation / Parks update were lower than budgeted.

Public Works department – under budget in professional services, street lighting (working off a CPU credit).

Impact Fee Fund – PIF/TIF revenue ended up $84,321 over the budgeted $44,170.

Capital Projects Fund – R.E.E.T revenues were 172% of budgeted. The roundabout project was budgeted for 2016 but is now in the 2017 budget. The Department of Commerce grant (school grant) is 73% complete.

Sewer Fund (Operations) – Charges for services (revenue) is a bit higher than budgeted due to the collection of several (large) delinquent accounts (and the associated late fees). Net salary costs were below budget due to a vacant position for most of the year but offset by the payout of accrued vacation to the WWTP supervisor who resigned in November.

Professional services: Based on prior year legal costs, the City budgeted $110,000 for professional services; in 2016 the City incurred $190,274 in costs, were reimbursed $126,335 with still more to be billed for reimbursement. Approximately $28,000 was for sewer-related professional services.

Sewer Equipment Fund – with the exception of retainage, the cost for the sewer line on Pacific Hwy are complete.

Sewer Debt Fund – SDC revenue was 200% of budgeted; interest revenue was lower than projected due to mid-year budget amendment to pay off $5M of PWTF debt (interest projections were based on a higher fund balance).

Background  

The City Council will convene a public hearing on February 22, 2017. The proposed ordinance repeals La Center Municipal Code 18.275, Sign Code, and replaces it with new Chapter 8.60, Sign Code. 

On July 26, 2016 the City Council adopted a six month Moratorium on processing and issuing sign permits in the Industrial, Commercial‐2 and MX zones. The Council allowed the Moratorium to expire on January 26, 2017. The Council directed the Planning Commission to: (a) Draft code revisions, (b) Conduct a public hearing, and (c) Forward final recommendation to Council. 

During the end of the Moratorium period the Planning Commission: 

Conducted work session on September 13th, October 4th, and October 25th   Held regular meetings on October 11th and November 15th   Advertised and conducted a Public Hearing on December 13th  Coordinate SEPA and Department of Commerce 60‐day review  Revised the Draft code based on review and comments from the City Attorney   Made minor edits to final code & forwarded it to the Council for review and action 

 An overview of key content issues is attached.  The Planning Commission recommends the Council adopt Chapter 8.60 and direct the Commission to make minor adjustment to the code and return it to Council within 6 months from this date. Members of the Commission and staff will present an overview of the code changes and remaining issues to the Council on February 22nd.   

Budget  

There is no budget impact to the City repealing LCMC 18.275 and creating LCMC 8.60. 

Recommendation/Motion 

Mayor, I Move the Council adopt Ordinance 2017‐03 repealing LCMC 18.275 and adopting LCMC 8.60, Sign Code. I 

further move that the City Council direct the Planning Commission to make adjustments to LCMC 8.60 consistent 

with the discussion tonight and to return revisions to Chapter 8.60 within 6 months from this date.

ORDINANCE NO. 2017-03

An Ordinance Repealing in its Entirety Title 18 (Development Code), Chapter 275 (Sign Regulations) of the LaCenter Municipal Code and Adopting a New Sign

Code as Title 8 (Health and Safety), Chapter 60 (Sign Regulations)

The La Center City Council adopts the following findings:

WHEREAS, the City of La Center currently regulates the placement of signs in La Center Municipal Code (LCMC) Chapter 18.275 (the “Sign Code”), and LCMC 18.275.040 requires an application and permit approval for the erection, placement or alteration of all signs anywhere in the City; and WHEREAS, in June 2015, the United States Supreme Court issued its opinion in Reed v. Town of Gilbert, which significantly narrowed the definition and applicability of temporary sign regulations and clarified the meaning of “content neutrality” in the area of sign regulations, which warranted a comprehensive review and revision of the City’s Sign Code; and WHEREAS, the Planning Commission held public workshops to consider Sign Code revisions on September 13, October 4 and October 25, 2016 and a public hearing to the matter on November 16, 2016, at the end of which the planning commission adopted a recommended revision, attached hereto as Exhibit A, and incorporated herein by this reference; and WHEREAS, the City Council held a duly noticed public hearing on February 22, 2017 to consider and take public testimony on the planning commission’s recommended revision to the Sign Code, and at the conclusion of the hearing the City Council voted to repeal the existing Sign Code and adopt the recommended revision. NOW THEREFORE, the City Council for the City of La Center ordains as follows: Section 1. Incorporation of Recitals: The foregoing recitals are adopted and incorporated

herein by this reference and made a part hereof as findings in support of the revised sign code hereby adopted.

Section 2. Repeal. Title 18 (Development Code), Chapter 275 (Sign Regulations) of the

LaCenter Municipal Code is hereby repealed in its entirety. Section 3. Adoption. A new Sign Code, attached as Exhibit A and incorporated herein by this

reference, is hereby adopted and shall be codified as Title 8 (Health and Safety), Chapter 60 (Sign Regulations) of the LaCenter Municipal Code.

Adopted this 22nd day of February 2017. This Ordinance shall be effective on the 31st day following adoption.

8.60.010 Intent, Purpose and Interpretation. (1)  Intent. Signs have a strong visual impact on the character and quality of the community.  As a prominent part of the scenery, they attract or repel the viewing public, affect the safety of vehicular traffic, and their suitability or appropriateness helps to set the tone for the neighborhood.  The City relies upon its scenery and physical beauty to attract commerce and these aesthetics will directly benefit economic value.  It is the intent of the City, through this Chapter, to protect and enhance the City’s historic and residential character and its economic base through the provision of appropriate and aesthetic signage.  In addition, it is the intent of the City to promote the size, type and location of signs that will minimize their distracting effect on drivers and thereby improve traffic safety. (2)  Purpose. This chapter regulates the erection, placement, maintenance and display of signs to protect and enhance public health, safety and welfare. More specifically, this chapter is designed to accomplish the following: 

(a)  Assure the effectiveness of traffic signs and other signs erected for public safety by limiting the number and extent of visible distractions and obstructions created that affect motorists, bicycle riders and pedestrians. (b)  To maintain clear and uncluttered rights‐of‐way so as to ensure the effectiveness of traffic safety signs, and minimize distractions to motorists, prevent signs from creating a hazard or nuisance by obstructing clear vision or distracting motorists by their dominating size or appearance and maintain clear passage on public sidewalks. This includes protecting the public right‐of‐way for the safe and efficient passage of motorists, bicycle riders and pedestrians.

(c)  Recognize free speech rights by regulating signs in a content‐neutral manner. (d)  Protect the right of speech for all signs by regulating the placement of signs in relationship to each other so that signs do not interfere with the rights of other signs to be seen and understood.  (e)  Maintain and enhance the scenic and visually aesthetic qualities of the city by limiting the size and number of signs, reducing visual clutter and the dominance of signs through reasonable time, place and manner regulations. (f)  Allow those signs that are compatible with the character and uses allowed in the zoning district in which they are located. (g)  Provide reasonable opportunities for signs through reasonable time, place and manner regulations. (h)  Address emerging trends in digital and electronic sign technologies and provide regulations that facilitate use of such technologies.   (i)  Protect neighborhoods, surrounding development and the night sky from the nuisance factors associated with glare, movement and animation of digital and electronic signs. 

(3)  Interpretation. Chapter 8.60 LCMC is not intended to, and shall not be interpreted to restrict speech on the basis of its content, viewpoint, or message.  Any classification of signs in this Chapter which purports to permit speech by reason of the type of sign, identity of the sign user or otherwise, shall be interpreted to allow commercial or non‐commercial speech on the sign.  No part of this Chapter shall be construed to favor commercial speech over non‐commercial speech.  To the extent that any provision of this Chapter is ambiguous, the term shall be interpreted not to regulate speech on the basis of the content of the message.    8.60.020 Applicability. (1) Exemptions. All signs are subject to this chapter except for the following: 

(a)  Signs not visible from a public right‐of‐way; provided, that any such signs are erected and maintained in accordance with this Chapter. (b)  Government signs: Signs erected by federal, state, county or city governing bodies. (c)  Signs inside a building, except for strobe lights, flashing or similar lights visible from a public right‐of‐way or another private property or audible from a public right‐of‐way or another private property.  (d)  Signs carved into or part of materials that are an integral part of a building. (e)  Customary holiday decorations. (f)  Murals. Murals are an exterior wall painted with artwork or some expressive content or message with no frame or other associated structure. (g)  Flags less than 100 square feet in area.  (h)  Signs attached to or carried by a person. (i)  Signs required by law or legal action, including signs warning of hazardous or dangerous conditions on a property and land use application and hearing notices. 

(2) Prohibited signs. The following types of signs are prohibited: (a) Signs which are public or private nuisances.  (b) Signs which do not comply with LCMC 8.60.050, General requirements. (c) Billboards. {NOTE: The Commission unintentionally left an inconsistency in the code: Billboards are defined as signs >200 sq. ft. and prohibited, but freeway signs are can be as large as 300 sq. ft. and are allowed.

(d) Attached to, painted on or carved into a tree, a utility pole or a traffic pole. (e) Search lights and rotating lights. (f) Inflatable signs. (g) Have expired, been discontinued or abandoned or have become dilapidated or are a threat to public safety. (h) Abandoned, discontinued or no longer in good repair. (i) Located on vehicles or trailers parked on public‐right‐of‐ways which display containing a message larger than two square feet. 

 8.60.030 Temporary signs. Temporary signs are allowed in all zones, on private property and in the public right‐of‐way, subject to the additional requirements of this section. The city does not require a permit for a sign that meets the definitional requirements of a temporary sign. (1)  Temporary signs shall not be: 

(a)  Internally or externally lit,  (b)  Contain a display area larger than four square feet or have any part of the sign higher than three feet above ground level,  (c)  Located on a sidewalk, in the vehicle travel portion of the right‐of‐way, or traffic round‐abouts, 

or (d)  Have no more than two readable faces.    

(2)  No signs, other than governmental signs, are allowed on a permanent basis in the public right‐of‐way. (3)  Temporary signs within the public right‐of‐way. 

(a)  Within a designated public right‐of‐way, the city Public Works Department, may remove unexpired signs during departmental operations such as mowing or mosquito abatement, replacing them when these operations are completed. 

(b)  Parties placing signs within the public right‐of‐way shall contact the Public Works Department prior to placement of the sign to obtain a city‐approved marking which will identify the person responsible for the sign and the expiration date of the sign. 

(c)  The city‐approved marking shall be valid for ninety calendar days from date of initial display and is renewable for an additional ninety days.   

(d)  The Public Works Department may contact the responsible person to advise them that temporary signs have expired or become damaged, dilapidated or discontinued. The party responsible for the sign shall have fourteen days to remove or repair the sign after which time the city may remove the temporary sign. Public Works crews may remove and discard expired, damaged, dilapidated, discontinued signs or signs without a city approved marking. 

(e)  The City reserves the right to exclude all signs, including temporary signs from segments of the public right of way where the City has determined that the presence of signs will cause or exacerbate traffic or other public safety hazard.  8.60.040 Sign permits. (1) A permit issued under this chapter is not a land use decision and is not subject to review under RCW 36.70.B and  appeal of a decision rendered under this chapter is not subject to review under the Land Use Petition Act, RCW 36.70.C.

(2) Any sign for which a permit is required by this chapter shall comply with this section. Signs excluded in LCMC 8.60.020(1) (a) through (i), Exemptions, are not regulated under this chapter and therefore do not require a permit.  All other signs are either prohibited or require a permit.  

(a)  Process. Sign permits under this chapter shall be processed as administrative review and decisions by the Public Works Department.    (b) Decision. Within 21 calendar days after the date an application is submitted, the Department shall issue a decision that approves, approves with conditions, or denies the application. An applicant may agree in writing to extend that time and may provide additional information within that time at the request of the city. The decision shall include a brief summary of the relevant facts and applicable standards for the application and of how the application complies with those standards based on the facts and evidence, including any conditions of approval. (c) Notice of the Decision. Within seven calendar days after issuing a decision the Department shall mail a copy of the decision to the applicant and applicant’s representative(s). (d) Appeal and Post‐Decision Review. The applicant may appeal the decision to the La Center City Council 

(3) Application. Application for a sign permit shall be accompanied by the required fee and shall be made in writing upon forms provided by the city.  

(a) The application shall include a complete and detailed description of the sign and supporting structure, a scale drawing of the sign and support structure, the proposed location, name and mailing address of the persons responsible for the sign including, but not, limited to the sign owner  and property owner, plus any plans and information necessary to establish that the proposed sign complies with all applicable requirements of this chapter and applicable building, structural and life safety codes.  (b) The Department may impose additional or waive certain submission requirements depending upon the sign type, location or other circumstance.  (c) Any misrepresentation or falsification of information supplied in the application may, at the option of the city, result in the invalidation of the permit. (d) The Department may require additional review such building, foundation or electrical permits depending on the nature of the sign proposed. 

(4) Approval Criteria. The Department shall approve a sign permit where the applicant demonstrates compliance with all of the following approval criteria: 

(a) The proposed sign is not one prohibited under LCMC 8.060.020(2)(a) through (i), Prohibited Signs, and (b) The proposed sign complies with all applicable dimensional, durational, locational and other requirements of this chapter. 

(5)  Exemptions to the Permit Requirement. The following signs may be erected and maintained without a permit in any zoning district, provided they are not prohibited signs, they satisfy all generally applicable regulations and meet the following requirements: 

(a)  Temporary signs do not require a permit so long as they meet the definitional requirements of a temporary sign.  (b)  A single unlit permanent sign per private property where no one display surface area exceeds four square feet. 

(5) Permit must be exercised within 90 days of issuance. Permits issued under this chapter shall be void if the sign so permitted is not erected in compliance with the requirements of the permit and this

chapter within 90 days following the date the permit is issued. The Public Works Director may grant a request, made in writing, to extend to period for one additional 90‐day period. (6) Permit Duration and Automatic Expiration. A sign permit is valid until the sign is abandoned or discontinued, or relocated. A sign permit is valid until the sign is altered by more than 10% of the applicable numeric value, such as height or area, or if the illumination or animation of the sign changes. Any sign permit that the Department determines has become invalid under the provisions of this section shall be removed within 90 days of that determination, including the support structure, or a new permit obtained.   8.60.050 General requirements applicable to all signs. (1)  General Requirements. The following requirements apply to all signs allowed in the city: 

(a) Any permanent sign, except for a government sign, that is erected or maintained on city property (public right‐of‐way, city hall, police department, public works properties, and all city parks) requires city approval. A temporary sign may be erected and maintained within the public right‐of‐way, so long as it complies with the requirements for temporary signs in this chapter. (b)  Building and Specialty Code Compliance. All signs, whether regulated by this chapter or not, shall meet all applicable construction and operation standards of the International Building Code adopted by the city of La Center. Where these codes conflict with the requirements of this chapter, the more stringent or restrictive shall control. (c)  No sign shall be insecurely erected, or constructed so as to constitute a safety hazard, fire hazard or a nuisance. (d)  Sign Obstructing View, Passage or Safety. No sign shall: 

(i)  be located so as to physically obstruct any door, window, or exit from a building; (ii)  be located so as to obstruct or interfere with intersection sight distance for vehicles exiting a driveway or street; (iii) obstruct or interfere in any way with the public’s ability to clearly view government signs; (iv) by reason of their size, location, movement, content, coloring, or manner of illumination, may be confused with a government sign. (v)  interfere in any way with traffic, visibility or passage within the public right‐of‐way, including vehicle travel lanes, sidewalks and bike lanes; (vi) obstruct free ingress to, or egress from, any door, window, fire escape, alley, driveway, fire lane, access from the sidewalk to transit stop areas, designated disabled parking spaces, disabled access ramps or building exits. 

(e)  Removal. All prohibited signs and signs that do not have a valid sign permit when one is required under this chapter are unlawful, a violation of this chapter and shall be removed. Failure to do so shall subject the sign and property owner to civil enforcement pursuant to LCMC 2.15, Code Enforcement. (f)  Lighting. Signs, excluding temporary signs, may be lit, either from within the sign structure or by external lights shining on the sign face. Except in residential zones, lights shall be aimed downward. In no case shall sign lights shine directly onto an adjacent property, buildings or the public right‐of‐way or to cast glare into the eyes of pedestrians or motorists in the public right‐of‐way. Flashing, strobes and rotating lights are prohibited in all situations. Sign lights shall not substitute for security or safety lighting that may otherwise be required.

(g)  Property Owner Consent. No sign shall be erected on property or a structure (e.g., a building or utility pole) owned by someone other than the person responsible for the sign without the express consent of the property’s owner. If the City cannot verify owner consent, the sign will be deemed unlawful and subject to removal.   

(2)  Modifications to Existing Signs. Any sign that is structurally altered, relocated or replaced shall be brought into compliance with all applicable substantive requirements of this Chapter, including the requirement to obtain a permit. This requirement shall apply to signs that have been structurally altered.  Any modification to a sign for which a permit has been issued shall be processed as an administrative review in the same manner as for a new sign. This requirement to obtain a new permit for sign modifications does not apply to copy or panel changes where the physical size, shape, height, or support structure is not changed by more than 10% of the applicable numeric standard.  (3)  Variances. After receiving a written request from the sign owner, the city may grant a variance to one or more numeric or dimensional requirements of this chapter, except that none of the prohibited signs in LCMC 8.60.020(2)(a) through (i), Prohibited Signs, may be allowed through a variance procedure. 

(a)  Variance criteria. The following criteria apply to sign variances: (i)  Exceptional, extraordinary or unusual circumstances that are not self‐imposed that do not apply to other properties in the same area or zone are present. Such circumstances may be the result of an unusual location or orientation of the applicant’s building, topography, vegetation or other circumstance over which the applicant has no control. (ii)  The variance is necessary for the preservation of a right of the applicant that is substantially the same as rights possessed by the owners of other property in the area or zone. (iii) The granting of a variance will not be materially detrimental to, or conflict with, the purposes of this chapter, or be injurious to the use and enjoyment of other property in the area or vicinity, or the public way, in which the property is located. (iv) The variance requested is the minimum exception to the established requirements that is necessary to alleviate the claimed grounds for variance. (v) The requested variance does not exceed 40% of the underlying numeric performance standard. 

(b)  Conditions for Granting a Variance. The city may impose certain changes as conditions to granting a variance. These may involve sign design, area, height, location, and compliance with the downtown design guidelines or similar conditions. (c)  Variance Fee. The applicant shall pay a fee in accordance with the fee schedule established and amended from time to time by the city council and on file with the city clerk. (d)  Procedure. Any variance sought to the requirements of the sign code shall be processed as an administrative decision with public notice and an opportunity to be heard and in conjunction with the underlying sign permit application.  

(i) Notice of Application. Within 14 calendar days after the date an application for a sign permit variance, the Department shall invite the public to comment on the variance request. The Department shall:  

(A) Mail a written notice of the application to property owners within 300 feet of the subject sign site, and  (B) Post a notice of the variance request on the subject property which is visible to the public.

(ii) Comment Period. The notice shall provide for a 14‐day public comment period from the date of mailing the notice.  (iii) Comments. The Department shall mail to the applicant a copy of comments timely received in response to the notice together with a statement that the applicant may respond to the comments within 14 calendar days from the date the comments are mailed. (iv) Decision. 

(A) Within 14 calendar days after the date an application for variance is received  the Department  shall issue a decision that approves, approves with conditions, or denies the application; provided, an applicant may agree in writing to extend that time and may provide additional information within that time at the request of the city. (B) The decision shall include a brief summary of the relevant facts and applicable standards for the application and a summary of how the application complies with those standards based on the facts and evidence, including any conditions of approval. 

(4) Notice of Decision. Within seven calendar days after issuing a decision, the Department shall mail notice of the decision to the parties of interest including, but not limited to, the applicant and any person or party commenting on the variance request. (5) Appeal. A decision on the permit itself will be heard by the City Hearing Examiner consistent with established City procedures for public hearings.   (6) Permit duration. Once granted, and the sign is installed, a sign variance shall be valid so long as the sign is not abandoned, altered, relocated or obsolete.  8.60.060 Signs in residential zones. (1)  Signs Allowed without a Permit.  

(a)  Any sign for which a permit is required by this chapter shall comply with this section. Signs excluded in LCMC 8.60.020(1)(a) through (i), Exemptions, are not regulated under this chapter and therefore do not require a permit.  All other signs are either prohibited or require a permit. (b)  Portable signs may be displayed within the public right‐of‐way in the residential zone between the hours of 6:00 a.m. to 6:00 p.m. subject to the following limitations: 

(i)  The sign is on a sidewalk, within six inches of the curb and entirely outside the driving and on‐street parking portion of the right‐of‐way; (ii)  The sign area does not exceed 2.5 feet wide by 2.5 feet high and is no taller than four feet above average grade; (iii) The sign does not obstruct a continuous through pedestrian zone of at least three feet in width; and (iv) The sign does not obstruct pedestrian or wheelchair access along the sidewalk, from the sidewalk to transit stop areas, designated disabled parking spaces, disabled access ramps or building exits. 

(2)  Signs Allowed with a Permit. The following signs are allowed in the city’s residential zones so long as a permit is first obtained: 

(a)  Monument signs.  (i)  A monument‐style sign may be placed at the entrance to a subdivision; provided, that it is not larger than thirty‐two square feet in area and is located on a separate non‐developable tract owned and maintained by a homeowner’s association.

(ii)  A monument sign may be placed at the entrance to an apartment complex provided it is not larger than thirty‐two square feet in area. 

(B)  Other signs. A single sign is permitted on one residential lot provided the sign is not larger than six square feet in area. 

(3)  Prohibited Signs. Unless specifically allowed by the preceding subsections, illuminated or signs that are lighted from within or by an external light, excluding addresses or wall plaques less than two square feet, are prohibited in the city’s residential zones:  8.60.070 Signs in the C‐1 and C‐3 zones. This section governs signs in the city’s C‐1/C‐3 (downtown commercial/cardroom overlay) zones.  (1)  All signs in the C‐1 and C‐3 districts shall: 

(a)  Use materials compatible with the facade materials. (b)  Avoid highly reflective materials and surfacing, limit the use of plastic, and employ painted wood or metal where reasonably feasible.    (c)  Apply letter or painted signs to the building face where reasonable feasible. (d)  Use fonts which complement the period of the building’s architecture. (e)  Avoid use of reader boards consistent with this Chapter.  (f)  Avoid corporate design standards which cannot be used as a justification for granting a variance to this Chapter. (g)  Be externally illuminated by downward facing light sources.  (h)  Mounted so that the sign does not obscure significant architectural details. (i)  Comply with the La Center Downtown Design Plan and Guidelines. 

(2)  Signs Allowed without a Permit. Signs excluded in LCMC 8.60.020(1)(a) through (i), Exemptions, are not regulated under this chapter and therefore do not require a permit.  Incidental signs are allowed without a permit so long as the definitional requirements of an incidental sign are met. All other signs are either prohibited or require a permit.  (3) Signs Allowed with a Permit. The following signs are allowed in the city’s C‐1 and C‐3 zones so long as a permit is first obtained: 

(a)  Wall Signs. One wall sign is allowed per business on each property, with a maximum area of twenty‐four square feet per wall sign. The collective area of all wall signs on any facade of a multi‐tenant building shall not exceed fifteen percent of the facade’s area. (b)  Portable Signs. One portable sign may be displayed in the public right‐of‐way per business during business hours, subject to the following limitations: 

(i)  The sign is entirely outside the driving and on‐street parking portion of the right‐of‐way. (ii)  The sign is no larger than seven square feet in size. The sign face is no wider than two feet and no taller than forty two inches feet. (iii) The sign is within six inches of the curb. (iv) The sign does not obstruct a continuous through pedestrian zone of at least three feet in width. (v)  The sign does not obstruct pedestrian or wheelchair access from the sidewalk to transit stop areas, designated disabled parking spaces, disabled access ramps or building exits. 

(c)  Electronic Reader Board Signs. One LED electronic reader board sign is allowed per property, so long as the sign message area is no larger than twenty square feet, and no part of the sign or

support structure is higher than xx feet (Note: The commission was divided on this question.) above grade. Video display reader boards are prohibited. (d)  Street Banners. Street banners may be erected in or over the public right‐of‐way subject to first obtaining a city sign permit and compliance with all conditions attached to that permit. All other banners shall be regulated as signs under this chapter. (e)  Window Displays. Artwork and text affixed to windows shall not exceed sixty percent of the window area. (f)  Monument signs. The sign area of a monument sign shall not exceed forty square feet and the highest point of the monument sign shall be no higher than 5 feet above average finished grade. (g)  Projecting signs.  

(i)  No sign shall project out from a building facade more than six feet from the wall of the building. (ii)  Any projecting signs shall be no closer than 8 feet above the sidewalk finished grade. (iii) The maximum sign area of a projecting sign shall not exceed five square feet. 

(h)  Feather sign. No more than three feather signs are allowed along the frontage of each legal lot. 

 8.60.080 Signs in the C‐2 (community commercial) zones. (1) All signs shall satisfy the requirements of LCMC 8.60.050, General requirements, unless 

otherwise allowed in this section. (2) Signs Allowed without a Permit. Signs excluded in LCMC 8.60.020(1)(a) through (i), 

Exemptions, are not regulated under this chapter and therefore do not require a permit.  Incidental signs are allowed without a permit so long as the definitional requirements of an incidental sign are met. All other signs are either prohibited or require a permit. 

(3) Total sign coverage may not exceed one square foot per one linear foot of building frontage, per abutting street frontage, with an allowable minimum of thirty‐six (36) square feet per business. This sign area may be distributed among any number of the following signs:  (a)  Wall sign. Maximum sign face area for an individual wall sign shall not exceed thirty‐six square feet. (b)  Monument Sign. One monument sign is allowed on each commercial lot and may not exceed twenty feet in height above finished grade. The sign area of the monument sign is limited to 1 square foot per lineal foot of public street frontage of a commercial complex. No more than two such signs are allowed in a commercial complex. (c)  Projecting Sign.  

(i)  In the Pedestrian Zone the sign area of a projecting sign shall not be larger than five square feet.  The lowest portion of a projecting sign shall be no less than eight feet from ground level, project no more than six feet from the building face, and shall not extend six inches above the roof line. One projecting sign for each building entrance used as a customer entrance is allowed. The eight‐foot height restriction does not apply to signs extending over private property. (ii)  In areas outside of the Pedestrian Zone the sign area of a projecting sign shall not exceed thirty‐six square feet. The lowest portion of a projecting sign shall be no less than eight feet from ground level, project no more than six feet from the building face, and shall

(d)  Portable Signs. Portable signs shall not exceed seven square feet, forty‐two inches in height, and twenty‐four inches in width per each sign side. Sign may be in place during hours of operation only. One portable sign is allowed per licensed business. 

(3) Business Complex Sign. A business complex sign shall not exceed one‐hundred and eighty square feet in area and the highest point of the sign shall not be taller than twenty above finished grade. Any freestanding sign in a commercial complex shall be a business complex sign. One business complex freestanding sign may be installed on any one abutting street frontage; a second sign is allowed if the site has two street frontages.  

(4) Directional Signs. Directional signs may not exceed six square feet per sign side and a maximum height of forty‐two inches. One directional sign allowed per abutting street frontage entrance or exit.  

(5) Freeway signs. A freeway sign is visible from the freeway and is located within three hundred feet of the I‐5 right‐of‐way. One freeway sign is allowed, per legal lot. Freeway signs shall not exceed three hundred square feet in sign area and forty feet in height. The city shall allow a freestanding freeway sign if the applicant demonstrates that it is not feasible to place the sign on the wall of a building within 300 feet of the I‐5 right‐of‐way  still be visible to freeway motorists. 

(6) Feather sign. No more than three feather signs are allowed along the frontage of each legal lot.  8.60.090 Signs in the LI/EC (light industrial/employment campus) zones.  (1) All signs shall satisfy the requirements of LCMC 8.60.050, General requirements, unless otherwise allowed in this section. (2)  Signs Allowed without a Permit. Signs excluded in LCMC 8.60.020(1)(a) through (i), Exemptions, are not regulated under this chapter and therefore do not require a permit.  Incidental signs are allowed without a permit so long as the definitional requirements of an incidental sign are met. All other signs are either prohibited or require a permit. (3)  On‐Premise Freestanding Signs. 

(a)  Allowable area: one square foot per lineal foot of street frontage, up to a maximum of two hundred square feet, provided that each business frontage shall be guaranteed a minimum of thirty‐six square feet. (b)  Number of signs: one per street frontage. A second sign may be placed, with the maximum sign area distributed between two signs, along the street frontage, provided that a distance of two hundred feet between signs is maintained. (c)  Height of sign: maximum thirty feet. 

 (4) On‐Premise Wall Signs. (A)  Allowable area: one square foot per linear foot of building frontage (if a freestanding sign is also placed), per abutting street frontage, as measured horizontally along a side building elevation, up to a maximum of two hundred square feet per sign; provided that each building is

guaranteed a minimum of a thirty‐six‐square foot sign. The maximum sign area may be distributed among any number of signs. (B)  Allowable area if no freestanding sign is placed: one and one‐half square feet per lineal foot of building frontage, per abutting street frontage, as measured horizontally along a side building elevation, up to a maximum of three hundred square feet per sign, with a guaranteed minimum of fifty‐four square feet of sign area per building. (C)  Projecting signs are prohibited in these districts. 

(5)  Business Complex Signs exclusive of I‐5 Signage Allowance. A business complex sign may be placed, either monument style or freestanding, at the main entrance of each industrial or business complex, based on the following specifics: (a)  Allowable area: one square foot per lineal foot of street frontage of the premises, up to a maximum of two hundred square feet for each sign; provided that every business complex shall be guaranteed a minimum of sixty‐four square feet of signage. (b)  Number of signs: one per complex entrance as allowed by site plan approval. A second complex sign may be placed at a second entrance, if desired. (c)  Height of sign: a maximum of thirty feet. (d)  Space shall be made available for businesses to be listed on the business complex sign directory, if desired by the business. 

(6)  Directional Signs. Directional signs may not exceed six square feet per sign side and a maximum height of forty‐two inches. One directional sign is allowed per abutting street frontage entrance or exit.  (7)  Freeway signs. A freeway sign is visible from the freeway and is located within one‐hundred and fifty feet of the I‐5 right‐of‐way. One freeway sign is allowed, per legal lot. Freeway signs shall not exceed three hundred square feet in sign area and thirty feet in height. The city shall allow a freestanding freeway sign if the applicant demonstrates that it is not feasible to place the sign on the wall of a building still be visible to freeway motorists.  (8)  Feather sign. No more than three feather signs are allowed along the frontage of each legal lot.

(b)  Monument Sign.  The sign area of a monument sign shall not exceed forty square feet and the highest point of the monument sign shall be no higher than 5 feet above average finished grade. (c)  Projecting signs.  

(i)  No sign shall project out from a building facade more than six feet from the wall of the building. (ii)  Any projecting signs shall be no closer than 8 feet above the sidewalk finished grade. The eight‐foot height restriction does not apply to signs extending over private property. (iii) The maximum sign area of a projecting sign shall not exceed five square feet. 

(d)  Business Complex Sign. A business complex sign shall not exceed fifty square feet in sign area and twelve feet in height above finished grade. One business complex grouping of signs may be installed on any one abutting street frontage; a second sign is allowed if the site has two street frontages. (e)  Portable Signs. Portable signs shall not exceed seven square feet, forty‐two inches in height, and twenty‐four inches in width per each sign side. Sign may be in place during hours of operation only. One portable sign is allowed per licensed business. Signs shall meet all of the following standards: 

(i)  Signs may be placed in the right‐of‐way provided that the sign placement maintains a five‐foot‐wide clear zone for pedestrian movement along the full frontage of the parcel and does not create any sight obstruction per Section 2.15 of the city engineering standards. (ii)  Signs shall be constructed of finished materials to create a professional appearance. 

(f)  Directional Signs. Directional signs may not exceed six square feet per sign side and a maximum height of forty‐two inches. One directional sign allowed per abutting street frontage entrance or exit. (g)  Feather sign. No more than three feather signs are allowed along the frontage of each lot of record.

 8.60.110 Signs in the RP (Residential Professional) zones. (1)  All signs shall satisfy the requirements of LCMC 8.60.050, General requirements, unless otherwise allowed in this section. (2)  Residential uses are subject to compliance with LCMC 8.60.060, Signs in residential zones. (3)  Office or retail uses permitted in the RP zone are subject to compliance with LCMC 8.60.070, Signs in the C‐1 and C‐3 zones.  (4)  Feather sign. No more than three feather signs are allowed along the frontage of each lot of record.  8.60.120 Signs in the UP (Urban public) zones. (1)  All signs shall satisfy the requirements of LCMC 8.60.050, General requirements, unless otherwise allowed in this section. (2)  Total sign coverage may not exceed one square foot per one lineal foot of building frontage, per abutting street frontage, with an allowable minimum of thirty‐six square feet and a maximum of one hundred twenty square feet per public entity. The maximum sign area may be distributed

among any number of signs. Signs advertising products sold and/or produced, or services rendered on the premises, are permitted as follows: 

(a)  Wall Sign. Maximum sign face area for an individual wall sign shall not exceed one hundred twenty square feet. (b)  Freestanding Sign. One freestanding sign is allowed per building sites not to exceed twenty feet in height and one hundred twenty square feet in area and no more than two such signs per building site complex. Any freestanding sign in a building site complex shall be a complex sign. (c)  Projecting Sign. A projecting sign shall not exceed ten square feet in sign area. The lowest portion of a projecting sign shall be no less than eight feet from ground level, project no more than six feet from the building face, and shall not extend six inches above the roof line. One projecting sign for each building entrance used as a customer entrance is allowed. (d)  Business Complex Sign. A business complex sign shall not exceed one hundred twenty square feet in area and eight feet in height. Any freestanding sign in a building site complex shall be a complex sign. One group complex sign may be installed on any one street frontage. (e)  Portable Signs. Portable signs are prohibited in the public districts. (f)  Directional Signs. Directional signs may not exceed six square feet per sign side and a maximum height of forty‐two inches. One directional sign allowed per street frontage entrance or exit. (g)  Electronic message center signs, owned and operated by a public agency, may not exceed twenty square feet in sign area. Private electronic message center signs are not allowed in public districts

 8.60.130 Implementation of this sign code. All signs lawfully established and existing on the date the ordinance codified in this chapter is adopted shall be allowed to continue in their then‐existing condition provided they are maintained in a good state of repair, are safe, and do not change or expand. Any change to such a preexisting sign, including a change to the text or expressive content, shall require the sign to comply with all applicable requirements of this chapter. Any such preexisting sign that is subsequently damaged or destroyed by fire, storm, theft, vehicle collision or some similar cause not intended by the owner may be repaired or replaced as it existed prior to the damage or destruction so long as the replacement is completed within one year of when the damage or destruction occurred. [Ord. 2014‐01 § 2 (Exh. 1), 2014.]  8.60.140 Conflict and severability. In the event any provision of this chapter is found to be in conflict with any zoning, building, fire safety, health or other code provision of the city, the provision that establishes the higher, stricter or more specific standard shall prevail. A finding by a court of competent jurisdiction that any portion of this chapter is invalid shall not invalidate the remaining portions. A permit issued pursuant to this chapter does not grant any authority to violate any other law or regulation that may apply. [Ord. 2014‐01 § 2 (Exh. 1), 2014.]  8.60.150 Enforcement, violation and penalty.

The city may, without notice, remove any prohibited sign, including signs for which a permit is required but do not have one and signs which are abandoned or obsolete. In addition to any other provisions of the LCMC, it is unlawful for any person or entity to erect, maintain or display a sign in violation of this chapter or to have such a sign on their property. All violations of this chapter are deemed to be a nuisance and subject to civil enforcement under LCMC 2.15, Code Enforcement. Signs found to be erected, maintained or displayed in violation of this chapter may be removed by the city and the property and sign owner may be subject to enforcement and possible fines and other penalties. [Ord. 2014‐01 § 2 (Exh. 1), 2014.]   8.60.160 Definitions.  The following definitions shall control the interpretation of this chapter: 

A   “Abandoned sign” means a sign, the face of which has been intentionally or unintentionally removed or is broken and is not refaced within 180 days thereafter.  Abandoned signs shall also include signs with rusted, faded, peeled, cracked or otherwise deteriorated materials or finishes that have not been repaired within 90 days after the City provides notice of the sign’s deteriorated condition under the City’s enforcement chapter 18.50, Enforcement and Penalties.    “Alter” including “alteration” or “altered sign” means change the copy, color, size, shape, illumination, position, location, construction or supporting structure of a sign, not including ordinary maintenance.  

B   “Banner” means a sign made of cloth, canvas, plastic film or some similarly flexible material without a rigid frame or surface. Banners include signs over the street or on poles along the right‐of‐way.   “Billboard” means any sign with a display surface of 200 square feet or more and is distinguished from Freeway signs.   “Business complex sign” means a sign, which is designed to identify a business complex where no single business identification and/or advertisement occupies more than fifty percent of the sign area. 

C   “Copy” means the text, letters, numbers, symbols and any other sort of graphical expressive content. 

D   “Department” means La Center Department of Public Works.   “Directional sign” is any sign within or adjacent to a right‐of‐way used primarily to give information about wayfinding of locations or destination.   “Director” means the Public Works Director or assignee.   “Discontinued” means to cease doing or providing (something), intentionally or unintentionally.    “Display surface area” means the total area of a sign including all sides that are available for displaying advertising or an informational message. 

E   “Electronic Reader board” is a visual display board that conveys information electronically about a wide variety of subjects, including advertising for products or services, travel, news or event information.

  “Erect” or “erected” means to construct, build, assemble, alter, or otherwise place a sign at the location where it is to be used 

F “Feather sign” means a vertical portable sign that contains a harpoon‐style pole or staff driven into 

the ground for support or supported by means of an individual stand. “Flag” means a flat piece of pliable material  with distinctive colors, patterns or symbols, having one 

end of the cloth attached to a vertical staff (directly or by rope and pulley mechanism) and all other ends free‐flowing under natural movement of wind. 

“Freestanding sign” means a sign and its support pole or base standing directly on the ground that is independent from any building or other structure 

 “Freeway sign” mean a sign visible from I‐5 and located within three hundred feet of the I‐5 right‐of way and in the "C‐2" zone is no taller than forty feet from finished grade and in the "LI/EC" zone is not taller than thirty feet from finished grade.    

“Frontage” means the boundary between a single parcel and the public right‐of‐way. For purposes of this sign code, where a property abuts only one right‐of‐way, it has only one “frontage.” Where a property is a corner lot or otherwise abuts more than one right‐of‐way, it has two or more frontages. 

G   “Government sign” means: signs installed, erected, maintained or required by the city, county, or a federal or state governmental agency.   

H   “Height” of sign means the overall height of the sign above grade directly below or at the base of the sign.   

I   “Incidental sign” means a small wall‐ or window‐mounted sign (two square feet or smaller).    “Inflatable sign” means any object enlarged or inflated which floats, is tethered in the air, is activated by air or moving gas, or is located on the ground or on a building with or without copy or other graphic.

“Monument Sign” means a freestanding sign that is not supported by poles or columns and the base of the sign is in contact with the ground and the base is the full width of the sign face.

“Permanent sign” means a sign constructed of weather resistant material and intended for permanent use and that does not otherwise meet the definition of “temporary sign.”  Wall mounted sign holders designed for insertion of signs and posters shall be considered permanent signage and subject to all standards of this chapter.

“Portable sign” means a free‐standing sign that is readily moveable and not permanently affixed to the ground, including A‐frame or sandwich board signs, pole signs mounted on weighted bases, and similar signs that are used on more than a temporary basis.    “Projecting sign” a sign attached to a building with the face not parallel to the vertical surface of the building.  Projecting signs include signs projecting directly from walls, or signs hanging from porch ceilings or other support structures.   “Public Agency” means: (a) Any state board, commission, committee, department, educational institution, or other state agency which is created by or pursuant to statute, other than courts and the legislature; (b) Any county, city, school district, special purpose district, or other municipal corporation or political subdivision of the state of Washington; or (c) Any sub agency of a public agency which is created by or pursuant to statute, ordinance, or other legislative act, including but not limited to planning commissions, library or park boards, commissions, and agencies;

R   “Responsible person” or “person responsible for a sign” is the person or party responsible for the content and/or erection and distribution of a sign whose contact information is identified on the sign.  

S   “Sign” letters, figures, symbols, trademarks, or logos, with or without illumination, intended to identify any place, subject, person, firm, business, product, article, merchandise or point of sale.  A sign also includes balloons attached to sign structures, products, streamers, spinners, pennants, flags, inflatables or similar devices intended to attract attention to a site or business, as well as architectural or structural forms, illuminated panels, spandrels, awnings and other structural or architectural features not common to classic vernacular or non‐corporate regional architecture and that are intended to convey a brand, message or otherwise advertise a location or product, whether or not such features include text or graphics and whether or not they serve other practical purposes such as lighting, covering or enclosure of persons or products.  A sign includes any device which streams, televises or otherwise conveys electronic visual messages, pictures, videos or images, with or without sound or odors.     “Sign area” means the area of the largest rectangular portion of a face of a building to which a sign is affixed or proposed to be affixed, which can be included within parallel, vertical and horizontal lines uninterrupted by significant architectural features of the building.    “Sign face” means the total of display surface area visible from one side of a sign. 

T “Temporary sign” (which may include special event sign)” means any sign that is used temporarily and is not permanently mounted, painted or otherwise affixed, excluding portable signs as defined by this Chapter, including any poster, banner, placard, stake sign or sign not placed in the ground with concrete or other means to provide permanent support, stability and rot prevention. Temporary signs may only be made of non‐durable materials including, but not limited to, paper, corrugated board, flexible, bendable or foldable plastics, foam core board, vinyl canvas or vinyl mesh products of less than 20 oz. fabric, vinyl canvas and vinyl mesh products without polymeric plasticizers and signs painted or drawn with water soluble paints or chalks.  Signs made of any other materials shall be considered permanent and are subject to the permanent sign regulations of this Chapter.

Background  

The City Council will convene a public hearing on February 22, 2017. The proposed ordinance amends the City’s zoning map for the Naray property from Low Density Residential to Residential Professional. The proposal does not require an amendment to the city’s Comprehensive Plan.  

Tibor and Elyse Naray, 4973 Deeboyar Ave, Lakewood, CA, owners of a 10,004 S.F. lot located at the Northeast corner of the intersection of West “E” Ave and 4th St; APN: 63620000, petitioned the city to change their zoning from Low Density Residential (LDR 7.5) to Residential Professional (RP).   

The La Center Planning Commission conducted a public hearing beginning at on the proposed zoned change on December  13,  2016.  The  Commission  concluded  that  the  applicant  sustained  the  burden  of  proof  and  the application complies with the applicable provisions of the La Center Municipal Code and Comprehensive Plan and recommends  APPROVAL  of  the  proposed  zone  change  at  this  location.  The  Planning  Commission’s recommendation is attached.

Mr. Mayor, I Move the Council adopt Ordinance 2017‐04 amending the La Center zoning map for the purpose of re‐

zoning Parcel 63620000 from LDR 7.5 to RP and further direct the city staff and consultant to communicate the 

zone change information to Clark County and, thereafter, revise the city’s official zoning map.

ORDINANCE NO. 2017-04

An Ordinance Approving a Zone Change for a 10,004 sf lot from Low Density Residential (LDR 7.5) to Residential Professional (RP); and amending the

LaCenter Zoning Map to Reflect this Change. (Naray, parcel no. 63620-000, City File No. 2016-019-ZONE).

The LaCenter City Council adopts the following findings:

WHEREAS, the City of La Center exercises exclusive land use planning and permitting authority over all real property located within its corporate boundaries pursuant to the Washington Growth Management Act (GMA), as codified in Title 18 (Development Code) of the LaCenter Municipal Code (LCMC), and has zoned all lands within its boundaries pursuant to this authority; and WHEREAS, Tibor and Elyse Naray, owners of a 10,004 sf lot located at the northeast corner of the intersection of West East Avenue and 4th Street (Parcel No. 63620-000) in LaCenter, applied for a zone change of their property from Low Density Residential (LDR 7.5) to Residential Professional (RP); and WHEREAS, the Planning Commission conducted a public hearing on the proposed zoned change on December 13, 2016, accepted all manner of public testimony and written comment, and at the conclusion of the hearing unanimously recommended approval of the request, consistent with the proposal, based upon the findings of fact and conclusions of law attached hereto as Exhibit A, and incorporated herein by this reference; and WHEREAS, the City Council held a duly noticed public hearing on February 22, 2017 to consider and take public testimony on the planning commission’s recommendation on this zone change proposal, and at the conclusion of the hearing the City Council voted to approve the request, based upon the Planning Commission’s recommendation, findings and conclusion. NOW THEREFORE, the City Council for the City of La Center ordains that the zone change proposal for a 10,004 sf lot owned by Tibor and Elyse Naray (Parcel No. 63620-000, City File No. 2016-019-ZONE) from Low Density Residential (LDR 7.5) to Residential Professional (RP) is hereby approved, based upon the record of this matter compiled by the Planning Commission. IT IS FURTHER ORDAINED that the LaCenter Zoning Map shall be amended to reflect this zone change. In support of this decision, the Council adopts as its own and incorporates herein the findings of fact and conclusions of law attached as Exhibit A. Adopted this 22nd day of February 2017. This Ordinance shall be effective on the 31st day following adoption.
