Common Law Admission Test (CLAT)

IntroductionIntroductionIntroductionIntroductionIntroductionThe greatest contribution of National Law Schools has been to transform legaleducation into a professional education in its real sense of the term and to make itattractive to Indian intelligentsia. The success of National Law School of IndiaUniversity, Bangalore, has inspired many States to set up similar institutions intheir respective territories and at present, there are eleven Law Schools in differentparts of the country. These institutions are national in the sense that substantialnumber of seats in all these institutions are filled up by students from all over Indiaand the academic staff are also recruited on all India basis. All of them conductadmission tests in different centres spread all over the country and thousands ofstudents after their ten plus two examinations take these admission tests.

As the things stand now, each Law School conducts its own admission test andadmits students as per its regulations. As a result, students aspiring for good legaleducation have to write a number of admission tests; and this multiplicity ofadmission tests has been causing tremendous hardship both physically and financiallyto the candidates taking these tests. This issue was raised from time to time byseveral people, but it drew national attention as a result of a Writ Petition filed byMr. Varun Bhagat against the Union of India and various National Law Schools inthe Supreme Court of India in 2006. In the course of hearing, the HonourableChief Justice of India directed the Union of India to consult the National LawSchools with a view to evolving a scheme for common admission test. It may benoted that the Bar Council of India strongly supported this move towards commonadmission test.

Since all National Law Schools owe their existence to their respective StateLegislation, there is no central agency to coordinate their activities. Therefore, amove such as common admission test requires the consensus of all National LawSchools participating in such a process. To facilitate such a consensus, the Ministryof Human Resources Development, the Government of India and the UniversityGrants Commission of India convened the meeting of the Vice-Chancellors of sevenNational Law Schools namely NLSIU, NALSAR, NLIU, NUJS, NLU, HNLU and GNLU.The Chairman, Bar Council of India actively participated at these meetings. It maybe noted that these seven Law Schools have been functioning for quite some timeunlike other newly-established National Law Schools. After a couple of such meetings,these seven National Law Schools signed a Memorandum of Understanding (MoU)on 23rd November, 2007 committing themselves to hold the common admission test.It is quite in order to acknowledge the significant role played by Mr. Sunil Kumar,

Joint Secretary, Ministry of Human Resources Development and Prof. Mool ChandSharma, Vice-Chairman, University Grants Commission in this entire exercise.

According to this MoU, the Common Law Admission Test would be conductedhereafter every year by each of National Law Schools on rotation as per thecriterion of seniority. The NLSIU, Bangalore, the oldest of the National Law Schoolswill set the process in motion by undertaking to conduct the admission test for theacademic year 2008-09.

It is expected that other National Law Schools (i.e., the Law Schools establishedby State enactments) would join these seven Law Schools in due course.

It has been our experience that larger the catchment area, better will be thequality of students; and it would be better for the institutions and the society. Thisshould be the first step to improve the quality of our educational institutions, sothat they may measure upto the international standards. This is imperative, if wehave to successfully meet the challenges of globalization.

National Law SchoolsIt is somewhat paradoxical that the legal education had not received the adequateattention from our policy makers in the early years of our Independence despitethe fact that most of them were eminent lawyers. Naturally there was heavyemphasis on technical education in view of the need for industrializing our economy.But the important role assigned to law and the judiciary in our system of constitutionalgovernance required sound legal education as well. The relative negligence of legaleducation took a heavy toll on the system; and the concept of national law schoolwas a response to meet the challenges posed by the deteriorating standards.

The Bar Council of India, representing the organized legal profession at all Indialevel, took initiative in establishing the first National Law School of the country.This bold experiment required statutorily-guaranteed autonomy from theconventional university system. Hence there was a need for the establishmentof a full-fledged law university. The Government of Karnataka, under thevisionary leadership of the then Chief Minister, Sri. Ramakrishna Hegde,responded to the request of Bar Council of India by passing the National LawSchool of India Act, 1986. The State Government also provided the land and thesubstantial financial assistance in the initial stages. The Law School becamefunctional in 1988. From the very beginning, it admitted students on the basisof all India admission test.

The decade of nineties was the era of globalization and it opened up vastopportunities for young law graduates. As a result, the products of National LawSchool have been very much in demand everywhere. This phenomenon inspiredother State Governments to set up similar law schools in their own States. As aresult, a number of National Law Schools have come up in different parts of thecountry. Statutory basis provided by the State Legislature concerned and intake onall India basis are the common characteristics of all these Law Schools. Of course,all of these Law Schools had close links with the higher judiciary. Invariably, eitherthe Chief Justice of India or the Chief Justice of the respective High Court happensto be the Chancellor of these Law Schools.

Broadly speaking, the objectives of all these National Law Schools may besummarized as follows:

to achieve excellence in legal education and in this process, benchmarkthemselves against the international standards.

to impart comprehensive legal education relevant to the requirementsof our country.

to advance knowledge by promoting inter-disciplinary research in allbranches of law.

to inculcate noble professional and ethical values so as to realize theobjectives enshrined in our Constitution.

In keeping with the present trend, all National Law Schools are expected to beself-financing, and therefore, they charge relatively higher tuition fees. But it hasbeen the common objective of all of them that no student is compelled todiscontinue the study on account of financial constraints. Hence, all of themprovide liberal means cum merit scholarships.

All National Law Schools are residential and the students are expected to be in thecampus so that the teaching and learning would be a continuous process.

With these words of introduction, the Common Law Admission Committee welcomesthe young students from all over India and abroad to come and study in NationalLaw Schools. In order to facilitate the selection, brief sketches of the academicprogrammes offered by each of the Law Schools are provided herewith. Itbecame functional in 1988. It is the only Law School sponsored by the Bar Councilof India with a view to raising the standard of legal education in India. Leadinglawyers, judges and academicians have been associating with the Law School fromthe very beginning and in this way, the NLSIU represents the unique partnershipamong the Bar, the Bench and the Academia.

NLSIU, Bangalore offers five year B.A., LL.B.(Hons.) programme whereunder foursocial science subjects, namely, History, Economics, Political Science and Sociologyare integrated with legal studies. The social science subjects are taught in thefirst two years along with law subjects. All the subjects are compulsory in the firstfour years; and in the fifth year, optional seminar courses are offered along with afew compulsory courses.

The NLSIU follows a trimester system whereunder the academic year is dividedinto three parts and four subjects are taught in each trimester. As a result, astudent would have studied sixty subjects when he/she completes the five yearterm. The wide spread of subjects helps a student to acquire extensive and intensiveknowledge of the legal system.

The optional seminar courses offered in the fifth year provide opportunities tospecialize in certain areas. For example, a student who wishes to pursue career incorporate law may choose seminar courses on accountancy, securities, mergers andacquisitions, etc. The NLSIU encourages the involvement of outside expertise inoffering optional seminar courses. In the recent times, the seminar courses havebeen offered in subjects such as International Taxation, Accountancy and FinancialManagement, Information Technology Law, Telecommunication Law, EuropeanCommunity Law, Competition Law, Anti-Dumping Law, Negotiation Skills, Law ofElections, Refugee & Humanitarians Laws, Affirmative Action, Women and theLaw, Displaced and the Law etc.

Another significant method of involving scholars from outside is by way of onecredit courses. These courses comprise of nearly eighteen lecture hours normally

spread over a week. The school invites experts, national and international, tocome and stay within the campus for a week to deliver these lectures. Any interestedstudent can sign up for these courses provided he/she possesses some basicunderstanding of the subject. Some of the one credit courses offered in recenttimes are: Shipping Laws, Law and Literature, South African Constitutional Law,the U.S. Patent Laws, Genetic Resources Policy etc.

The NLSIU is a fully residential University with a number of halls of residence formen and women. Men and women have separate mess facilities. Shri. NarayanaRao Melgiri National Law Library, well-equipped with books, journals and electronicdata bases is the heart of the campus both in literal and metaphorical sense of theterm. The academic block, hostels and the Library are provided with wirelessconnectivity so that the students may access internet facilities through their laptops.

Having realized the importance of computers in education, the NLSIU expectsevery student to prossess a laptop. Those who cannot make down payments to buylaptops may go for bank-loans and the Law School stands guarantee for therepayment of such loans.

The NLSIU is proud of its vibrant student community which has excelled in curricular,co-curricular and extra-curricular activities. The Law School has a well-equippedmoot-court hall named after Honourable Justice Hidayatullah. The students havedone very well in national and international moot court competitions. The mootand debating competitions hosted by NLSIU have attracted participants from allover India and from neighbouring countries such as Pakistan, Bangladesh, Nepal,Malaysia, etc. The Law School students have in the recent times organized sportsand theatre festivals and national and international teams have participated inthose events.

There is a rigorous internship programme which every student of NLSIU has toundergo as part of the curriculum and it starts from III year onwards. During theseinternships, a student has to compulsorily work with lawyers doing trial work andappellate work. The students who do very well can expect to work as law clerkswith the Judges of the Supreme Court and High Courts.

The NLSIU has well-developed research centres in areas such as Juvenile Justice,Intellectual Property Rights and Environmental Law. The interested students canassociate themselves with these centres.

The Law School also has a well-equipped International Training Centre whereinseminars and workshops are conducted on a regular basis.

The admission shall be based exclusively on the performance in the Common LawAdmission Test (CLAT). However, to qualify for admission the candidate

(a) must have passed the Higher Secondary School Examination (10+2) oran examination equivalent thereof, securing in aggregate not less than50% in all the core subjects and English put together.

(b) must not have completed 20 years of age as on 1st July, 2008.

In the case of candidates belonging to SC/ST the age limit will be 22 years as on 1st

July 2008.

All those who have appeared in the qualifying examinations are entitled to writethe Admission Test. But any candidate securing less than 50% in the qualifyingexamination will be denied admission notwithstanding his/her rank in the AdmissionTest.

The intake capacity of B.A., LL.B.(Hons.) degree programme shall be 80 withfollowing breakup:

(a) General Category : 55

(b) Scheduled Caste : 12 (i.e. 15%)

(c) Scheduled Tribe : 6 (i.e. 7.5%)

(d) Persons With Disability (PWD) : 2 (i.e. 3%)

(e) Foreign Nationals : 5

The foreign students will be admitted directly on the basis of their performance inthe qualifying examination, overall academic record and command over Englishlanguage. The preference is given to candidates from SAARC region. The foreignstudents must apply directly in the CLAT application form with supporting documentsto the Registrar, NLSIU, Nagarbhavi, Bangalore-560242, on or before 10th April,2008.

The annual intake is approximately twenty five studentsin each specialization. This intake is subject to reservations in favour of ScheduledCastes, Scheduled Tribes and Persons With Disability.

There is no separate quota for foreign students. Interested foreign studentsmay apply directly in the CLAT application form with supporting documents tothe Registrar, NLSIU, Nagarbhavi, Bangalore-560242, on or before 10th April,2008.

The LL.M. programme is based on the semester system. In the first semester, allthe students study four compulsory subjects:

2. Indian Constitutional Law: The New Challenges

3. Judicial Process

4. Research Methodology

In the second and third semesters, the students pursue optional seminar coursesdepending upon their specializations. In recent years, Tax Law, Intellectual PropertyRights, the WTO, Environmental Law, Corporate Governance, CommercialArbitration, etc have been offered as optional seminar courses for Business Law.International Humanitarian and Refugee Law, Minorities Laws, International HumanRights etc, have been offered as optional seminar courses for Human Rights Law.In all these subjects, national and international dimensions are properly highlighted.The fourth semester is devoted for writing the dissertation.

The NALSAR University of Law was established under the Andhra Pradesh Act 34 of1998. It is a fully residential university equipped with state of the art facilities. Itis the second National Law University established after NLSIU, Bangalore.

The NALSAR offers a five year integrated B.A.,LL.B.(Hons.) programme. English,History, Economics, Political Science and Sociology are taught as social sciencecomponents of legal studies. In the final year, two seminar courses are offered.The students can choose courses from such diverse areas as Public Laws and PolicyChoice, Family Laws, Business Laws, International Laws etc.

With a view to developing professional skills, NALSAR imparts instruction in simulatedsettings such as moot courts and drama. Its curriculum is based on UGC CurriculumDevelopment Committee Report. Clinical education is an integral component ofthe course curriculum.

In NALSAR, the instruction is given through lectures, seminars, group and individualtutorials. Collaborative teaching is encouraged to maximize on available expertiseand to promote inter-disciplinary understanding. The NALSAR, as far as possible,encourages individuated, one-to-one interaction. Each student has a faculty advisor,who acts as a counselor for curricular, co-curricular and extra-curricular activities.

As a residential university, the NALSAR has adequate accommodation for all itsstudents. Altogether, there are eight halls of residence with a common dining hall-cum-kitchen. There is a separate library building with large number of books,journals and electronic data bases. The entire campus is Wi-fi enabled. The Universityhas an excellent moot court hall and state of the art video conferencing facility.This video conferencing facility can bring the lectures from anywhere in the worldalive to the audience in NALSAR and this will go a long way in augmenting thefaculty resources of NALSAR. In addition, the NALSAR has excellent conferencehalls wherein the seminars and workshops are regularly held.

The NALSAR has a rigorous research programme. N.C. Banerjee Centre for IPRstudies and S.P. Chatterjee Centre for Environmental Studies have facilitated the

research in respective areas both by the faculty and students. The University haspublished a number of text books, research studies and monographs over a periodof time.

M.K. Nambyar SAARC Law Centre for Advanced Legal Studies is the most recentaddition to the research facilities. This Centre seeks to promote ComparativeSouth Asian Constitutional Studies.

The candidate seeking admission

must have passed 10+2 or its equivalent examination securing 50% ofmarks in the aggregate and those who are taking this examination in2008 are also entitled to apply;

must be less than 20 years of age as on 1st July, 2008 (22 years in caseof SC/ST candidates and 25 years in case of persons with disability)

The number of students to be admitted through admission test is Seventy withthe following reservations:

Scheduled Caste 15%

Scheduled Tribe 7.5%

Women* 30% (Horizontal)

Persons with Disability 3%

* Since women candidates admitted comes to about 50% on their own merit thisreservation does not affect the seats in the general category.

In addition, 10 seats are allotted to Foreign Nationals. Candidates possessing thecitizenship of a country other than India will only be considered under this category.

It has been granted permanent affiliationof the Bar Council of India. The Hon’ble Chief Justice of India is the Chancellor ofNUJS and is also the Chairman of its highest governing body, the General Council.

NUJS strives to pursue holistic legal education in order to prepare its graduates forthe diverse worlds of litigation, corporate legal practices, academia and legalresearch. Due emphasis is given to clinical legal education in order to equip thestudents with knowledge, skill and values to promote the ends of justice throughthe instrument of law.

NUJS offers five-year integrated B.A. / B.Sc. LL.B (Hons.) and two-year LL.Mprogrammes besides M.Phil, Ph.D and LL.D programmes in law. It follows semestersystem and its students are exposed to a carefully articulated blend of law andsocial science courses. It adopts Socratic Method of teaching of well-structuredand regularly updated curricula with a host of optional courses to cater to theneeds of appropriate specialization. In addition to writing end-semesterexaminations, each student has to compulsorily prepare project papers on selecttopics pertaining to each subject of study. A very rigorous system of evaluation isin place. Grading is done on an eight-point scale.

NUJS has an excellent faculty, a good balance of the experienced and the young.They work with the self-belief that NUJS is poised to become the premier lawschool in this part of the globe and their pupil are among the best in the world oflegal education. It has everythinga modern university ought to have - a host of class rooms, seminar halls, conferencerooms, a well-stocked air-conditioned library open from 8 A.M. through 10 P.M.with services of internet, printing and photocopying. Physical infrastructure ofNUJS also includes on campus Bank, a canteen, state-of-the-art kitchens at thehostels, health care and sports and recreational facilities. Students of NUJS haveadapted themselves to computer aided education in a big way and LAN service isextended to most of the rooms in the hostels. Construction of a modern auditoriumand complete networking of the entire campus is now underway.

Students of NUJS are a promising lot and are carefully nurtured for all roundexcellence. They have enviable track-records in the field of mooting and debating,have regular publications in peer-reviewed journals of international repute and areknown for their outreach community services and legal aid activities. They havethe unique distinction of publishing regularly two journals, one quarterly and otherannual, featuring contemporary legal thought. It is no wonder that each one of allthree passed-out batches has been satisfactorily placed in the profession and isable to make a mark in her/his respective vocation.

Despite being able to achieve a high level of academic ambience, the NUJS hasmaintained a relatively modest fee structure. It further seeks to ensure that nostudent is forced to discontinue studies on account of financial constraints. Withgenerous donations of individuals and institutions, the University has built upScholarship Fund, proceeds of which are disbursed to students every year on needbasis. The alumni of the NUJS have also instituted a scholarship from this year.Arrangements are in place for students of NUJS to secure educational loans fromany Bank of their choice on mutually agreeable terms. The Indian Bank hasannounced special package for the NUJS students to facilitate speedy sanction ofloan at softer rate of interest without any collateral.

NUJS perceives legal education as an efficient instrument of improved social ordercontributing to national development. The new campus of HNLU is located at Village Uperwara off National Highwayconnecting Raipur and Vishakhapatnam and is about 22 kms. from the city campus.The new campus is constructed with huge investment of about 50.00 Croressprawling over 65 acres of land abutting a beautiful lake. It consists of the academicand administration block, halls of residence for men/women, halls of residence forgirls, separate Dining Halls attached to the hostels, Faculty Quarters, Guest House,Gymnasium, Sports Complex and a proposed training centre. The academic blockalso houses the State-of-the-art Moot Court Halls carefully designed to match thestandards of the Hon’ble Supreme Court of India and the High Courts. HNLU is theonly National Law University in India having a hi-tech Language Lab to equipstudents with writing skills and communication skills required for a promisingcareer in law. The Language Lab is having computers fully loaded with interactivelanguage learning programs. The entire campus is Wi-Fi enabled. All classroomsare air-conditioned with Hi-Tech gadgets having DLP projectors, interactive boardsetc. The campus also consists of the State-of-the-art Conference Hall, which canaccommodate about 450 persons. The academic block also has an aestheticallydesigned amphitheatre to cater to the needs of the students. The Honours course of the University is its distinguishing feature from otherNational Law Schools of the country as it offers the student to specialize in twosubject areas of his/her choice. The Honours course differentiates itself from theHonours paper system, wherein a student opting for a stream, is enriched withintensive knowledge through three exhaustive papers. The teaching in honourspaper is highly interactive due to choice-based study of the subject. The course isdesigned with a near resemblance to a postgraduate course in a particular subject.Coupled with the compulsory papers as prescribed by the University, the Honourscourse provides a comprehensive five-paper study in the chosen subject, oncompletion of the exercise.

Gujarat National Law University (GNLU), Gandhinagar was established under GujaratNational Law University Act, 2003 enacted by Gujarat State Legislature; and itwas formally inaugurated on 17th July 2004. It offers five year integrated degreecourses leading to the award of following degrees:

The GNLU follows a semester system with six subjects in each semester. Thelaboratory facilities are provided for students pursuing B.Sc., LL.B.(Hons.)programme. It is fully a residential university. At present, it operates from temporarypremises and the new campus is under construction.

The GNLU is proud of its student community and the students have demonstratedtheir capabilities in various national and international competitions and academicpublications.

The admission shall be based exclusively on the performance in the Common LawAdmission Test. However, to qualify for admission, the candidate

(a) must have passed the Higher Secondary School Examination (10+2) oran examination equivalent thereof, securing in aggregate not less than50% in all the core subjects and English put together.

(b) must not have completed 20 years of age as on 1st July 2008.

In the case of candidates belonging to SC/ST category, the age limit will be 22years as on 1st July 2008.
