‘Surprised’ by collapse>> Inquiry chair to note mall developer as an ‘uncooperative witness’
THEill-fatedTongaatmalldevel-oper said he was “surprised”when the mall collapsed.
But Ravi Jagadasan — owner ofRectangle Property Investments andson of controversial Durban busi-nessmanJaySingh—wasvisiblyun-settled as the commission of inquiryinto themall’s collapsegrilledhim forseveral hours.
The commission’s chairpersonPhumudzo Maphaha said: “On myreport Iwillwrite thathe [Jagadasan]was not a co-operative witness.”
The twohadabruising encounter, with Jagadasan on several occasions
saying thateitherhis father,Singh, orhis legal representative, advocateSaleemKhan, would answerMapha-ha’s questions.
On one occasion Maphaha de-clined Jagadasan’s request to be al-lowed a few moments to consult hislegal team.
But bizarrely it did emerge Jaga-dasan was surprised to find his mallin the news when it collapsed.
Jagadasan said the order hadbeen given to stopwork at the site af-ter theeThekwiniMetroMunicipalityobtained a court order halting allbuilding at the site.
“Didn’t it comeas a surprisewhenthe mall was in the news?” saidMaphaha.
“It was. They were supposed tohave stopped work,” he replied.
Jagadasan is the sole member ofRectangle Property Investments CC,of which his father is the chief execu-tive.
The close corporation was the de-veloper of the R220 million mall thatwas being constructed by Gralio Pre-cast (Pty) Ltd, which is also run bySingh.
Jagadasan is also a director of thecompany.
Hesaidhebelievedthat Graliowascompetent to build the mall, but hewas unable to tell Maphaha whatqualifications the Gralio staff had.
Maphaha said that all he could seewas that the engineers and the per-sonnelofothercompaniescontractedby Gralio appeared not to have any
formal qualifications.A large portion of the mall col-
lapsed on 19 November, killing twoand injuring 29 last year as scaffold-ing and formwork was removed.
“You can shift your responsibility, but we will have to test if the liabilitylies with you,” Maphaha warned.
Jagadasan said he believed thatright up until the August before the
mall collapsed all plans had been ap-proved by the eThekwini Metro Mu-nicipality.
Hesaid thathewasnot involved intheday-to-day runningoftheRectan-gleProperty Investmentsand thathisfathertookalldecisionsregardingthemall.
The inquiry resumeson4Septem-ber.
Ravi Jagadasan, developer ofthe illfated Tongaat mallwas described as an “uncooperative” witness.

BEFORE I became a journalist, Imade a living as a private tutor.I started with a terrible hourly
fee as I did not know howmuch tutorsusually charged.
As I got wiser I increased my feeand started to make a somewhat re-spectable living; enough tobreakevenwith the taxi fare I paid for every day.
I was not a teacher, have neverbeen, and I respect teachers and thework they do. I did, however, findmy-self rectifying a lot of their mistakeswhenIwastutoringstudentsinmathe-matics and the physical sciences. Myfirst judgment was that the studentswho denied being taught a basic con-cept in either subject were being lazy,as is almost always the case.
But then I started getting calls fromparents who had very bright childrenfrom prestigious schools in the Rich-ardsBayandEmpangeni areas.Thesechildrenweregettingdistinctionsinalltheir other subjects except eithermathematics or the physical sciences.I found that a lot of the basics lacked, notbecausethestudentswere lazy, butbecause their teachers had failed toteach them the basics.
Whether this failure was caused bya lack of knowledge or time, I cannotspeculate. Academics from the Uni-versity of KZN and Durban Universityof Technology are being quoted in
many an internet conversation re-garding the competency of matricmathematics teachers.
This is after a reportwaspublishedinTheMercuryonMonday21July, re-garding a study published in the ‘Per-spectives in Education’ journal. Ac-cording to the report, a sample of 253KZN teachers averaged a mark 57%when writing a past Mathematics ex-ampaper, typical of what thestudentsthey teach, have to write.
The paper was separated into fourlevels (levels one to four) which in-creased in difficulty.
The fourth and final level involvesproblemsolving,whichwasmostchal-lenging. At this level, the sample ofteachers tested averaged a mark of26%, which is even lower than the ri-diculous30%passneeded.Having en-counteredthesekindsofquestionsalotmyself, I agree that theyarequite chal-lenging.
These researchers question the
teachers are from previously disad-vantaged schools and backgrounds.I would speculate that the difficulty ofthe problem solving questions in thefourth levelmaybelinked to their pro-ficiency intheEnglish language. Whatwe need to understand is that this isjust one study thathasdetecteda long-suspected problem.
The study’s authors do not specu-late what exactly is causing the prob-lem, only that it exists and that it isscary howwe expect these teachers tohelp pupils grasp the mathematicsthey teach. This study unfortunatelycastsabad lightonsome teacherswhoactually understand the subject andare able to convey it.
It is not all bad. I have encounteredseveral teachers who have helpedmegrasp challenging concepts in mathe-matics.
This story will unfortunately re-main another talking point which willlead to debates in weeks to come.
Catching the matric mathematics bandwagon
quality of the material theteachers are delivering tolearners if they clearly fail tounderstand it themselves. Ihave to agree with them butalso take caution in knowingthat not all is cut and dry andthat I am not an educationexpert. Clearly there is some-thing wrong, but as to thecause of it and the solutionthat needs correct it, I havefound that we are all experts.
In thedigitalversionofTheMercury article, I found a listof comments longer than thestory itself. This is often thecase with stories that are thetopicsofmanyadrunkencon-versationorwhenastorysup-portspeople’scynicismonthegovernment’s failure.
The (anonymous) com-ments are full of “not surpris-ing”,“dismal”, “blind leadingthe blind” and others ques-tioning whether all teachersare qualified to teach anysubject. The report does notmention how many of these

Make your voice heard atFriday’s Silent Protest
ON Friday, 1 August at the start ofWomen’s Month, thousands of volunteers will participate in the eighth annual Silent Protest.
The protest, organised for the firsttime in Durban by the AIDS HealthcareFoundation (AHF), in associationwith St Michael’s Lutheran Church, aims to highlight rape survivors’ rightto Post Exposure Prophylaxis (PEP) inorder to prevent HIV seroconversion.
The demand for greater access toPEP is in line with AHF’s 20x20 Campaign.
Central to the protest is the publicact of showing solidarity with rapesurvivors who are often silenced bysexual violence.
The Silent Protest will also takeplace in Grahamstown and Johannesburg. To join the Durban march, community members must meet at StMichael Lutheran Church, 43 MilneStreet in the Durban CBD at 6am.
The event is anticipated to endat 5pm.
Government crime statistics revealthat 66 000 sexual assaults were reported in South Africa last year.
Of these, only 6.5% are successfully prosecuted and less than half of1% of perpetrators will serve any jailtime.
All studies agree that the vast majority of rape victims never report thecrime to the police and there are manystatistics available focusing on the ratio of reporting to nonreporting ofrape survivors: the most conservativeestimate comes from Rape Crisis (1 in4) and the most shocking comes fromthe SAPS (1 in 25).
These statistics translate to anywhere from 260 000 to over 1.5 millionrapes annually.
The statistics demonstrate the culture of impunity in South Africa, whererape is commonplace because there isan understanding that no punishmentwill result.
When rape is reported, the rate ofconviction is low; court cases last onaverage three years and intimidationand victimisation are common.
Thenationalproteston1Augustaffirms public solidarity with the mil-lions silenced by rape and sexualviolence.
PHOTO: SUPPLIEDFor the past eight years, activists have staged the Silent Protest inorder to draw public attention to rape, educate the public about theirright to PEP after rape and to demand better services for survivors.

Fish deaths raise concern>> Results from water quality data are still outstandingDEBI BLAKE
A RECENT discovery of morethan70deadfishintheUmdlotilagoon has raised concern
among residents as to the quality ofthe water.
Watersampleshavebeencollectedfor analysis but the cause of the fishdeaths are yet to be confirmed.
One of those who saw the deadfish last monthwas Riaan van Jaars-veldt on his daily walk along thebeach and the Umdloti lagoon.
“I spotted a few dead fish in theshallows of the river and on closerinspection noticed they were all onespeciesof fish.Afterseeingmore, fur-ther along, I decided to have a goodlook and count how many I couldfind,” Van Jaarsveldt told Fever.
“I counted 74. The majority ofthem were fairly ‘fresh’ as only theeyes and the soft spot of the flesh be-low the gills were eaten, probably bycrabs. None of the gulls seemed to beinterested in them.
“About aweek later I cameacrosstwo cleaning ladies clearing thebeach trash.
“Eachwascarryingafishofsimilardescription and in the same state asthe ones I had seen previously.“Inoticed that the fishwere scrubbedand I told the women not to eat them
as they may be contaminated. Theyleft with the fish regardless.”
Van Jaarsveldt said that he hassince steered clear of the rivermouthitself as his dog usually swims in it.Other residents have also observedthe dead fish.
“BothmyhusbandandIhaveseenthe dead fish and general litter pollu-tion,” Caroline Helfer said.
“The fish were a new thing for usbut I’mnotawareof it beinga regularoccurrence.”
Environmental consultant and
Umdloti resident, Renee Royal, saidthat she had also seen about sevendead fish “aswell as a lot ofmoss-likealgae on the bottom” on her walks tothe estuary.
Terry Rens of Umdloti’s UIP saidthat pollution in the river and lagoon
is sometimes experienced duringheavy rainswhendebris and effluentfrom the sewage from communitiesand farmsupriverarewasheddown-stream.
“OneofthefunctionsofTheUmdlo-ti River Catchment Forum is to liaisewith theDepartment ofWaterAffairsand other interested parties regard-ingpollution intheriverandestuary,”Rens said.
Since the discovery of the deadfish, an expert from the DepartmentofWaterAffairshasvisitedthelagoonto take water samples.
Waterqualitydataforthesamples- that were taken by the DepartmentofWaterAffairs-hasbeenreceivedbyHassina Aboobaker, environmentalofficer:specialisedproduction, waterquality management, for the depart-ment.
“We are currently evaluating thedata (also received from eThekwiniMunicipality) and will ask eZemveloandDEA for their input aswell. Oncea formal report is completed furtherfeedbackwillbeprovided,”Aboobak-er said.
Councillor Geoff Pullan said heis“particularly interested” inreadingthe report, “aswehave twoPilot BlueFlag beaches in Umdloti.
