Section6133.Specialprovisionsandexemptionswithincertainmixedusedevelopments.1
(a)
Theprovisionsofthissectionareintendedtosetforthcertainexceptionsandprovisionsapplicable2
onlytolicenseeswhoseestablishmentsarelocatedwithincertainlargemixedusedevelopment3
districts,ashereinafterdefined,holdinglicensestosellalcoholicbeveragesforconsumptiononthe4
premises.Exceptasspecificallysetforthinthissection,allsuchlicenseesremainsubjecttoallother5
provisions
of
the
countys
alcoholic
beverage
ordinance.6
(b) Forthepurposesofthissectiononly,amixedusedevelopmentdistrictisdefinedasadevelopment7
thatiszonedRRCwithapubliceventvenuewithpermanentseatinginexcessof20,000seats(and8
toincludeattendantparkingfacilities)andmayincludeamixtureofretail,restaurants,9
entertainment,officespace,and hotelunits.10
(c) Thecountyminimumdistancerequirementsforonpremisesconsumptionestablishmentsina11
mixedusedistrictarewaived.Allstateminimumdistancerequirementstopropertiesoutsideofthe12
boundariesofsuchcertainmixedusedevelopmentdistrictsshallremainineffect.13
(d)
Outsideconsumptionofalcoholicbeveragespermittedasfollows:14
(1)
Theareasdesignatedfortheoutsideconsumptionofalcoholicbeveragesshallbedepictedona15
plan,presentedbytheapplicant,thatshallbeapprovedbyboththemixedusedevelopment16
districtmanagementandtheboardofcommissionersandincludelocationswherefreestanding17
vendors(as
distinguished
from
alicensed
premises)
may
sell
alcoholic
beverages
within
the
18
designatedarea.Areasdesignatedfortheoutsideconsumptionofalcoholicbeveragesmust19
includemethodsforverifyingidentification,determiningeligibilityforadultstopurchaseand20
consumealcoholicbeverages,andensuringminorswillnotbeservedalcoholbeverages.21
(2)
Drinkingfrom glassbottleorotherglasscontainerprohibited.Itshallbeunlawfulforanyperson22
todrinkorattempttoconsumeanyalcoholicbeveragefromaglassbottleorotherglass23
container,ortopossessinanopenbottleorglassanyalcoholicbeverageintheareadesignated24
foroutsideconsumptionofalcoholicbeverages.25
(3) Purchasefromlicensedpremiseswithinmixedusedevelopmentdistricts.Alcoholicbeverages26
consumed,withintheareadesignatedforoutsideconsumption,pursuanttotheseprovisions27
mustbepurchasedfromalicensedpremiseorapprovedfreestandingvendorwithinthemixed28
usedevelopment
district.

(4) Consumptionlimitedtolawfulhoursofoperation.Noalcoholicbeveragepurchasedpursuantto30
thisprovisionshallbeconsumedexceptwithintheauthorizedhoursofsale.31
(5) Twodrinkonstreetlimit.Anyestablishmentorfreestandingvendorlicensedtosellalcoholic32
beveragesbythedrinkforconsumptionisauthorizedtodispensealcoholicbeverage(s)ina33
paperorplasticcup,orothercontainerotherthanaglassbottleorotherglasscontainer,for34
consumptioninthedesignatedareaasdepictedintheapprovedplanasdescribedin635
133(d)(1).However,noestablishmentshalldispensetoanypersonmorethantwosuch36
alcoholicbeveragesatatime.Noalcoholicbeveragecontainershallbemorethantwentyfour37
(24)fluidouncesinsize.Noindividualshallhavemorethantwoopencontainersofalcoholic38
beveragesintheirpossession.39

Section6133containsspecificregulationspertainingtothesaleandconsumptionofalcoholic40

(1) MixedusedevelopmentdistrictmeansadevelopmentthatiszonedRRCandmayincludea12
mixtureofretail,restaurants,entertainment,officespace,hotelunits,andapubliceventvenue13
withpermanentseatinginexcessof20,000seats(andtoincludeattendantparkingfacilities).14
(2)
Universitymeansaneducationalinstitutiondesignedforinstruction,examination,orboth,of15
studentsinmanybranchesofadvancedlearning,andauthorizedtoconfervariousdegrees.16
(c) Tailgatingispermittedasfollows:17
(1)
Theareas
designated
for
tailgating
shall
be
depicted
on
aplan,
presented
by
the
applicant,
that

shallbeapprovedbyboththemixedusedevelopmentdistrictmanagementortheuniversity19
andtheboardofcommissioners.20
(2)
Tailgatingareaplansshallinclude:21
a.
Area(s)wheretheoutsideconsumptionofalcoholicbeverageshallbeallowed;22
b. Locationsofpermanentortemporarypublicrestroomfacilities;23
c. Locationsofareasdesignatedforoutdoorcooking;24
d. Locationsoftrashreceptaclesandrecyclingcontainers;and25
e. Prohibitiononlittering.26
(d) Prohibitionofthesaleofalcoholicbeverages,foodproductsorotheritemsrelatedtotheevent27
activities.Theoutsideconsumptionofalcoholicbeveragesshallbeallowedwhentheyare28
transportedto
the
designated
areas
for
personal
consumption.
No
beverage,
alcoholic
or
otherwise,
29
orfoodproductshallbesoldorpurchasedwithinthearea(s)designatedfortailgating;30
(e) Drinkingfrom glassbottleorotherglasscontainerprohibited.Itshallbeunlawfulforanypersonto31
drinkorattempttodrinkanyalcoholicbeveragefromaglassbottleorotherglasscontainer,orto32
possessinanopenbottleorglassanyalcoholicbeverageintheareadesignatedforoutside33

Procedure
for
fee,
suspension
and

(a) Itisdeterminedthatthefollowingareviolations:7
(1) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or8
convictedofsellingalcoholicbeveragestoanunderagepersonorpersonsoronSundaywithout9
necessarySundaysaleslicense;10
(2) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or11
convictedofsellingalcoholicbeveragestoanintoxicatedpersonpursuanttoO.C.G.A.332212
duringthecurrentlicenseyear;or13
(3) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or14
convictedofsellingalcoholicbeveragestoanintoxicatedpersonpursuanttoO.C.G.A.332215
duringtheprevious24months.16
(b) ThepolicedepartmentshallnotifythebusinesslicensedivisionmanagerifanyviolationofSection17
6147(a)
occurs.

(c) FeesforfirstoffenseofanyviolationinSection6147(a)19
(1) Thebusinesslicensemanagershallcollectafeeof$750.00fromthelicenseeinlieuofplacing20
thematterforhearingbythelicensereviewboardforanyfirstoffenceoftheviolationssetforth21
inSection6147(a),unlesslicenseehasanycriminalhistorywithinthepastfive(5)years.The22
licenseeshallhaveten(10)daysfromthedateofnotificationbythebusinesslicensemanager23
topaythefee.Failuretopaythefeewithintherequiredtimeframewillresultsinanautomatic24
three(3)daysuspensionoftheirlicense.25
(2) ThelicenseholderthathasbeenchargedwithaviolationofSection6147(a)mayappealthefee26
andrequestahearingbythelicensereviewboardasfurtherdefinedinthesection.27
(d) Noalcoholicbeveragelicensewhichhasbeenissuedorwhichmayhereafterbeissuedshallbe28
suspendedor
revoked
except
for
due
cause
as
defined
in
this
section
Section,
after
ahearing
and
upon
29
writtennoticetotheholderofsuchlicenseofthetime,placeandpurposeofsuchhearinganda30
statementofthechargeorchargesuponwhichsuchhearingshallbeheld.31
(1) Oncethebusinesslicensemanagerbecomesawareofanyreasonforapossiblesuspensionor32
revocation,he/sheshallplacethematterforhearingbythelicensereviewboard. Aminimum33
ofthreedays'noticeofthehearingdateshallbeprovidedtothelicensee.34
(2) Duecauseforthesuspensionorrevocationofsuchlicenseshallconsistofoneormoreofthe35
following:36
a. Theviolationofanylawsorordinancesregulatingsuchbusinessorfortheviolationofany37
stateorfederallaw;38
b. Anychangeintheareawheresuchbusinessislocated,whichchangeisdeemedbythe39
boardofcommissionerstocausesuchbusinessinsuchareatobeundesirable;40
c. Anyreasonwhichwouldauthorizetheboardofcommissionerstorefusetheissuanceofa41
license;42
d. Anyviolationofthischapter;or43
e. AsecondoffenseofanyviolationofSection6147(a).44
(3)Duecausehearing.Thelicensereviewboardatsuchhearingshallhearevidenceofthe45
circumstancesofthepossibleduecauseandaftersaidhearingmayrecommendthatthelicense46
tosellalcoholicbeveragesbesuspendedforamaximumof12monthsorrevoked.Thelicense47
reviewboard,andtheboardofcommissioners,ifapplicable,mayconsidermitigatingand48

aggravatingcircumstancesinconsideringsanctions,includingbutnotlimitedto,attendanceofa1
responsiblealcoholsalesandservice(RASS)workshop,implementationandcomponentsof2
writtenpolicies,thatemployeeshaveordonothavealcoholicbeverageworkpermits,3
implementationandresultsofmysteryshopperprogram,implementationandcomponentsofa4
trainingprogram,numberofviolationsofbusiness,numberofviolationsoflicensee,numberof5
stores,
length
of
time
in
business,
compliance
check
was
due
to
a
complaint,
identification
was6
notchecked,andanyotherfactsdeemedrelativebythefactfinder.7
(4) AffirmationbyBoardofCommissioners.Ifthelicensereviewboardrecommendssuspensionor8
revocationandtheownerofthealcoholicbeveragelicense,thelicenseeorbothshouldfailto9
appealsuchsuspensionorrevocationrecommendation,thenthesuspensionorrevocationshall10
becomeeffectiveuponaffirmationbytheboardofcommissionersofsuchsuspensionor11
revocationrecommendationandtheownerofthealcoholicbeveragelicenseandthelicensee12
shallbedeemedtohaveacquiescedtosuchsuspensionorrevocation.Theboardof13
commissionersshall,within60daysofthelicensereviewboardaction,reviewasummaryofthe14
hearingbeforethelicensereviewboardwhereinthealcoholicbeveragelicensewasconsidered15
forsuspensionorrevocation(thesummaryshallbepreparedbythebusinesslicensedivision16
manager)andtheboardofcommissionersaftersuchreviewmayplacethematterdownfora17
hearingor
affirm
or
alter
the
decision
of
the
license
review
board.
Should
the
board
of
18
commissionersplacethematterdownforhearing,theboardofcommissionerssuspend,fora19
maximumoftwelve(12)months,orrevokethealcoholicbeveragelicense.20
(5) Appeal.21
a. Intheeventthelicensereviewboardrecommendsthatthealcoholicbeveragelicensebe22
suspendedorrevoked,theownerofthealcoholicbeveragelicense,thelicenseeorboth23
mayfileanappealwiththebusinesslicensedivisionmanagerofsuchrecommendation24
withintendaystotheboardofcommissioners.Theboardofcommissionersshallconducta25
denovoreviewandanyadditionalevidencemaybepresentedattheappealhearing.26
b. Ifahearingoccurredbeforetheboardofcommissioners,suchdecisionisfinalunlessappeal27
ismadetothesuperiorcourtofthecounty. Anyaggrievedpartymayappealadecisionof28
theboard
of
commissioners
by
filing
apetition
for
writ
of
certiorari
to
the
superior
court
29
within30daysofthedecisionoftheboardofcommissioners.30
(e) Inallhearingsheldpursuanttothissection,theproceedingsshallbeasinformalascompatiblewith31
justice,thehearingshallbeexpeditedandnormallyshallnotexceed30minutesinlength,andthe32
followingproceduresshallprevail:33
(1) Thechargesandspecificationsagainstthelicenseeandtheresponseasfiledbythelicensee34
shallberead.35
(2) Thecountyrepresentativeshallpresentevidence,andthenthelicenseeshallpresenthis36
evidence,withopportunityforeachpartytopresentrebuttalevidence,examinationandcross37
examinationofwitnesses,andinterrogationbytheboardofcommissioners.Noevidenceshall38
bepresentedwhichisnotrelevanttothecharges.39
(f) Intheeventalicensetosellalcoholicbeveragesissuspendedasignissuedbythebusinesslicense40
officeshallbeplacedateachentrancetothefacilitywhereinalcoholicbeveragesweresoldwiththe41
signproviding,"THELICENSETOSELLALCOHOLICBEVERAGESISSUEDTOTHEOWNERANDLICENSEE42
OFTHISBUSINESSHASBEENSUSPENDEDFROM____________TO____________ASARESULTOF43

(a) Forwhomrequired.ItistheresponsibilityofthelicenseeanddesigneeasstatedinSection692(g)37

shall
be

andinvestigated
by
the
17 policedepartment,andsuchinvestigationshallinclude,amongotherthings,aninvestigationofthe18
criminalrecord,ifany,oftheapplicant.Noworkpermitshallbeissuedbythepolicedepartmentif19
theapplicanthasviolatedanyoftheprovisionsofSection6206hereof.Anyapplicantwhoisdenied20
analcoholicbeverageworkpermitshallhavetherighttoappealsuchdecisiontothelicensereview21
board.Appealstothelicensereviewboardregardingthedenialofanalcoholicbeveragework22
permitmustbefiledwiththebusinesslicensedivisionwithin30daysofthedenial.Afterahearing,23
thelicensereviewboardmayapproveordenytheworkpermit.Thedecisionshallbefinalunless24
appealedinaccordancewith6207(i).Inaddition,afterthehearing,thelicensereviewboardmay25
approveorrecommendtotheboardofcommissionersapprovalofaworkpermittoanemployee26

license foraccessoryspecialeventparkingaddressesprivatepropertyuseforparkinginareasthatwere10
notoriginallydesignedorlicensedforspecialeventparking,trafficproblemscreatedbypaymentfor11
parking,motorizedandnonmotorizedvehicleandpedestriantrafficmanagement,emergencyvehicle12
andpublicsafetyaccess,and/orlittercreatedbyalotoperatorsfailuretoproperlyadministerthelot13
andadjacentareaafterthespecialevent.Theseprovisionsareintendedtopromotethesafetyofarea14
visitors,residents,andbusinesses,andtoprovideasystematicapproachtoparkingandtraffic15

406.3.
Applicability
and
requirements.

(a) Anaccessoryspecialeventparkinglicensewillbeissuedonlytopropertywithanactive19
nonresidentialuseastheprimaryuseoftheproperty.Anaccessory specialeventparkinglicense20
willnotbeissuedifprimaryaccesstotheaccessoryspecialeventparkingareaisfrompublicright21
ofwaywithinthelimitedaccesszone.22
(b) Thelimitedaccesszone(s)shallbewithin1/2mile(2,640feet)fromthespecialevent.23
(c) Nopersonshallprovidespecialeventparkingforafee,includingwithinthefourhourperiodbefore24
thescheduledstarttimeofthespecialevent,andthetwohourperiodafterthecompletionofthe25
specialevent,withoutanaccessoryspecialeventparkinglicense.26
(d) Governmentalentitiesandparkingthatsatisfieszoningrequirementsformajortouristattractions27
arenotrequiredtoobtainanadditionalaccessoryspecialeventparkinglicense.28
(e)
Allapplicants
for
an
accessory
special
event
parking
license
shall
submit
an
application
to
the

BusinessLicenseDivisionoftheCommunityDevelopmentAgencyatleastthirty(30)dayspriorto30
thespecialevent.Onlycompletedapplicationswillbeconsidered.Theapplicationmustcontainthe31
following:32
(1)
Theapplicantsname,address,phonenumber,emailaddress,andproofofidentity;33
(2) Adescriptionoftheprimaryuseoftheproperty,copiesofvalidoccupationaltaxcertificatesfor34
allbusinesseslocatedontheproperty,andanaffidavitthattheprimaryuse,assetforthinthe35
certificateofoccupancyandoccupationaltaxcertificatesfortheproperty,isanactiveuseatthe36
property;37
(3)
Thenameofthepropertyowner,address,phonenumber,email,andevidenceofpaymentof38
propertytaxes;39
(4)
Written,notarizedstatementofconsentfrompropertyownerforuseofthepropertyfor40
accessoryeventparkingiftheapplicantisnottheowner;41
(5)
Thename,address,phonenumber,email,andproofofidentityofthepersonresponsiblefor42
theoperationofthespecialeventparkingarea,ifnottheownerortheapplicant.43
(6) AparkingplanincompliancewiththeCobbCountyCodeandDevelopmentStandards44
indicatingtheaddressandnameoftheprimaryuseontheproperty,asshownonthesignage45
fortheprimaryuse,boundariesoftheparkingarea,preservationofparkingfortheprimaryuse,46
ingressandegresslocations,theparkinglayout(nostackingispermitted,parkingmustbein47

Onthedayofaspecialevent,atemporarysandwichboardsignmustbedisplayedintheaccessory15
specialeventparkingareaneareachentrancetotheparkingareainthelocation(s)shownonthe16
parkingsiteplan.Thesigncopyareamustbeatleast18incheshighand24incheswide(butno17
largerthan
24
inches
by

inches)
with
amaximum
height
from
grade
to
the
top
of
the
sign
of
four

feet,includingaparkingsymbol,atleast10inchesinheightdesignatedbythecounty,andinclude19
thefollowingwordingwiththeblanksfilledinappropriately:SpecialEventParkingLot,License#20
___,ParkingFee$___,Operatorphone#__________.Theparkingfeemustbeinafontthatisat21
least6inchesinheight.Whenthelotisfull,thesignmustbeturnedaroundtodisplaywording22
visiblefromthestreetthattheparkinglotisfull.Thesignisatrafficmanagementdeviceanda23
displayoflicense,sonootherwordingispermittedonthefrontofthesign.Thesignmustbeofa24
durablematerial,suchasplastic,metal,wood,orlikematerial,andmustbeprofessionally25
fabricatedandmaintainedingoodrepair.Asignpermitisnotrequiredforthissign,whichmaybe26
displayedfourhourspriortotheeventandremovedtwohoursaftercompletionofthespecial27
event.Theparkingsymbol,thewording,andthefeemustbevisiblefromtheadjacentstreet.The28
parkingfee
must
remain
the
same
throughout
the
day
of
the
special
event
unless
decreased,
and

theamountchargedforparkingmustnotexceedtheamountstatedonthesign.Thesignmustbe30
visibleonthespecialeventparkingareafromthetimecarsareadmittedforthespecialevent31
parkinguntilthepropertyhasbeencleanedoflitterattheendofthespecialevent.32

Theaccessoryspecialeventparkinglicenseandparkingplanmustbeavailableforimmediateonsite33
inspectionbycountystafforpublicsafetyofficials.34
(k) Theaccessoryspecialeventparkingareamustbepaved,striped,andlitincompliancewith35
standardsprescribedbycountyordinancesforparkingareas.Vehiclesmustbeparkedonapproved36
surfacesandincompliancewiththeparkingplan.37
(l)
Theaccessoryspecialeventparkingareamustbestaffedbyatleasttwoattendantswhomustbe38
presentontheaccessoryspecialeventparkingareafromthetimetheoperatorstartsaccepting39
paymentonthelotforparkinguntilthelotisfullorthestartofthespecialevent,whicheveroccurs40
first.Aminimumofoneattendantmustremainonthelotuntilonehouraftertheendofthespecial41
event.Theoperatormustprovidecleanupserviceonparkways,parkingspaces,andsidewalksto42
removelitter,trash,junk,orotherdebrisfoundthroughouttheaccessoryspecialeventparking43
area.Theattendantsmustbeeasilyidentifiablebyuniformclothingindicatingthattheyare44
employedtoprovideaccessoryspecialeventparking.Cleanupserviceshallbecompletedtwohours45

for

(a) ReviewbyAdministrator12
(1) Anyapplicantwhoisdeniedanaccessoryspecialeventparkinglicense,orpersonwhose13
licenseisrevoked(anappellant)may,withinten(10)daysoftheserviceofnoticeofsuch14
determination,fileawrittenappealfromsuchdeterminationwiththeCommunity15
DevelopmentAgencyDirector.16
(2) TheCommunityDevelopmentAgencyDirectorshallhaveten(10)daysfromthedateon17
whichthe
appeal
was
received
in
which
to
provide
appellant
awritten
notice
that
the
18
decisionwasaffirmed,modified,orreversed.Thenoticetotheappellantshallbedeemed19
servedupontheappellantwhenitispersonallydeliveredorwhenitissentbyregularmail20
andcertifiedmailbytheUnitedStatesPostalService,tothenameandaddresssetforon21
theapplicationforpermit.22
(3) AdecisionbytheCommunityDevelopmentAgencyDirectoradversetotheapplicantcanbe23

Panhandlingmeans
the
act
of
obtaining
money,
food
or
other
items
by
approaching
and

beggingfromastranger.29
Roadsincludespublicarterialandcollectorroadsorstreets,shoulders,roadbeds,medians, and30
allotherwaysopentotravelbyoperatorsofmotorizedvehiclesorareasofpedestrianactivitywithin31
the unincorporatedcounty.Thedefinitionexcludesprivateroadsandroadsthatarenotopentomotor32
vehicletravel.ArterialandcollectorroadsareidentifiedontheOfficialThoroughfaremapofthecounty.33

Sec.8662. Findingsanddeterminations.35
(a) Theboardofcountycommissionersherebyfindsanddeterminesthatphysicalinteractionbetween36
pedestriansandmotorvehiclesthataretemporarilystoppedfortrafficcontroldevices,onarterial37
andcollectorroadsinthesamespaceatthesametimeisinherentlydangerous,andthatthe38
combinationofthehighvolumeofmotorizedvehiclesandcongestedroadsinthecountywith39
personswhoaresittingorstandingnexttoorinthetravellanes,sittingorstandingonroad40
medians,orsittingorstandingincloseproximitytotheedgeofthetraveledroadwayinsituations41
wheresuchpersonsareengaginginanykindofphysicalexchangeofobjectswithoperatorsand42
passengersofmotorvehicles,includingbutnotlimitedto:distribution,solicitationforcharitableor43
commercialpurposes,orindividualpanhandlingthatisdirectedatmotorvehicleoccupantsonthose44
roadsishazardoustopublicsafety,bothforoccupantsofmotorizedvehicleslocatedonpublicroads45
andforpersonsengaginginsuchadvertising,distribution,solicitationandpanhandling.46

(b) Thelanguageofthisarticleisintendedtoprohibittheactivitiesdescribedaboveonlywhentheyare12
directedbypedestrianstowardoccupantsofmotorvehiclesthatareonthetraveledportionof13
publicarterialorcollectorroadsthatareopentotraffic.Theterm"traveledportion"includestravel14
lanes,turnlanes,andotherportionsoftheroadthataregenerallyusedformotorvehicletravel.15
Thisarticleisnotintendedtoprohibitactivitiessuchasadvertising,distributionofgoodsor16
materials,orbusinessorcharitablesolicitationthatisdirectedtowardpedestriansonsidewalks.17

Theprovisionsofthisarticleshallembraceallpublicarterialorcollectorroadsandstreetswhensuch20
roadsorstreetsareopentomotorvehicletraffic,withinthelegalboundariesoftheunincorporated21
county,includingstateroads,interstaterampsandcountyroads.22

(a) Nopersonorentityshallengageinthecollection,transportationordisposalofanysolidwasteor16

11:00p.m.and7:00a.m.excepttoperformemergencyworkrequiredtosafeguardtheimmediate18
health,safetyandwelfareofthepublic.19
(b)
Everynoisecomplaintreceivedandrecordedbythesolidwastedivision,thecountypolice20
department,orthecodeenforcementdivisionofthecommunitydevelopmentagencyataspecific21
locationshallconstituteaviolationofthisprovisionandshallresultintheissuanceofareporttothe22
countypolicedepartment,thecodeenforcementdivisionofcommunitydevelopmentagencyorthe23
divisionmanagerofthesolidwastedivisionorhis/herdesigneesoremployeesforfullenforcement24
ofthischapter.25
(c) Atsuchtimeasanysecondnoisecomplainthasbeenreceivedorrecordedbythesolidwaste26
division,thecountypolicedepartment,orthecodeenforcementdivisionofthecommunity27
developmentagencyina45dayperiodataspecificlocationinthecountyanduponinquiryand28
investigationthe
solid
waste
division,
the
county
police
department,
or
the
code
enforcement

divisionofthecommunitydevelopmentagencyisabletoverifyandsubstantiatethefactualbasis30
forsuchcomplaint,thesolidwastepermitholdershallbesubjecttothepenaltiesdetailedinSection31
