b) Pound Keeper Agreement – New Contract with Georgian Triangle Humane Society

Recommendation: That the Community Services Committee recommends to Council that the Mayor and Clerk be authorized to execute the attached 5-year agreement for Pound Keeper Services with the Georgian Triangle Humane Society.

c) Animal Control Services Delivery

Recommendation: That the Community Services Committee recommends to Council that it authorize the Mayor and Clerk to enter into an Animal Control Services Contract with Redneck Wildlife Animal Control for a five year period; and

Further that the Municipal Law Enforcement and Licensing Department be authorized to perform the dispatch service for Redneck Wildlife Animal Control for evenings, weekends and holidays as outlined in this report.

d) Watercourse Protection By-Law

Recommendation: That the Community Services Committee recommends to Council that it approve a new Watercourse Protection By-law for the municipality.

1) OPENING OF MEETING: RESOLUTION #20-15 Moved by: Mike Gennings. Seconded by: Denise Sefranka-Hoskin. Be it resolved this meeting of the Wasaga Beach Public Library Board open

at 5:05 p.m. CARRIED

1.1 DECLARATION OF PECUNIARY CONFLICT OF INTEREST: None.

1.2 APPROVAL OF MINUTES:

RESOLUTION #21-15 Moved by: Rorry Cruikshank. Seconded by: Mike Gennings. Be it resolved that the minutes of the May 11th, 2015 meeting be adopted as circulated.

1.3 ACTION ITEMS ARISING FROM THE MINUTES: 4.1 -The cleaning contract has been signed and is retroactive to April 1, 2015. 5.1 - The board/staff BBQ is to follow the Board meeting. 5.2 -There are more board members than council members attending the July 7th

Celeb Day Event. 5.3 - Jackie Beaudin presented the information to the Community Services Committee, it was well received.

2) FINANCIAL REPORT: 2.1 APPROVAL OF PAYMENT OF ACCOUNTS:

RESOLUTION #22-15 Moved by: Rosanna Vryvogel. Seconded by: Lorraine Gruzuk. Be it resolved that the Wasaga Beach Public Library Board approve the Cheque, PAP and ETF Register as presented.

CARRIED

Deborah Grant asked how Survey Monkey is used and Jackie Beaudin explained this was used for different purposes such as ILLO requests.

One of the public computers and a staff computer have been replaced. The library is looking into a backup system, currently Simcoe County does

not provide this. Staff use USB devices to back up files at the moment.

2.2 STATEMENT OF OPERATIONS Deborah Grant inquired how temporary memberships work. Jackie

Beaudin explained they are used more in summer when visitors arrive. Jackie Beaudin outlined the changes to staff wages beginning in July. One

current part time position will become full time. Rosanna Vryvogel inquired about the library search computer which is out

of commission. Jackie Beaudin explained a iPad search computer has arrived and will be installed once the stand arrives.

2.3 BUSINESS ARISING FINANCIAL REPORT

3) REPORT FROM: 3.1 Board Chair

Deborah Grant attended the Richard B. Wright event. He was very entertaining and personable. We are lucky to be able to welcome such a prestigious writer to the library.

The next Appetizing Author event is in August and will feature Giles Blunt. 3.2 CEO

The library is partnering with the Palaver International Literary Festival on August 8th and 9th. To promote this event the library will be hosting a Caribbean Day on Friday, July 31st .

The library has also partnered with the Community Policing Committee to promote a new publication about safety geared to seniors.

A grant of $2,500 was received from the Ontario Library Capacity Fund to purchase new computers.

A student has been hired with the Canada Summer Jobs Grant to develop and carry out summer programs and activities.

The Library Ladies were on 97.7 The BEACH FM in May to promote the Friends of the Library information evening and upcoming programs, activities and events.

The 2014 Year In Review was presented to the Community Services Committee, as well as an invitation to Celeb day at the Library.

The Friends of the Library information evening is on June 23rd at 7 pm, invitations and an information package have been sent out to key community members.

The final draft of the Strategic Plan was presented to the committee; this will be brought forward to the board for discussion and approval.

There are a number of building maintenance issues which are being prioritized and will be resolved as required.

Library staff participated in a Customer Service Training Day organized by the Town to ensure a consistent level of customer service throughout the municipality.

Library staff also participated in Simcoe County Local Immigration training through the Library Hub Pilot Project, to help staff provide assistance to newcomers to the community.

New job descriptions have been submitted for several positions at the library. These will better reflect the areas of responsibility for these positions as they have undergone a number of changes since the original

job descriptions were done in 2006. There are no changes to status or rate of pay proposed.

A pre-audit is being done by staff from SOLS to move forward towards accreditation of the library.

4) FOLLOW-UP BUSINESS: 4.1 Strategic Plan (distributed)

Jackie Beaudin outlined the 2 main parts of the Strategic Plan, the executive summary which is meant for the public and the SP document which is for the board to use.

Staff driven goals vs board driven goals were discussed. Deborah Grant commented on the quality and ease of use of the revised SP. The board agreed to review the revised SP and vote on the document at the

August board meeting.

ACTION: Jackie Beaudin will contact members of the Strategic Plan Committee via email to set up a meeting.

Jody Mayhew brought up the need for supporting documents to show progress. Denise Sefranka-Hoskin suggested a footnote in the CEO report to show steps

as they move forward.

ACTION: Jackie Beaudin will put together a method of tracking that will address these needs.

4.2 Celeb Day @ the Library All board members have contacted someone on council to join staff on Tuesday,

July 7th to experience the library from behind the circulation desk. 4.3 Friends of the Library Information Night

The date for this information session is Tuesday, June 23rd. An executive of 5 core members must be formed. Not all volunteers are Friends but they have the option of joining this group. A second date may be scheduled to provide information to those not able to

attend.

5). NEW BUSINESS 5.1 FedDev Grant

Jackie Beaudin passed out the forms for the board to complete over the summer. Jackie Beaudin introduced Leadership By Design an online training opportunity

for board members. 5.3 July Book Sale

In the past one of the book clubs has taken on the book sale. Deborah Grant wondered if the book club would want to continue. Jackie Beaudin mentioned an alternative may be to set up a table by the library

entrance and have staff monitor the book sale. The sale could be held for an extended period of time and would not require a lot of staff time.

Deborah Grant recommended this option.

Fire Department

Fire Department Activity Report attached for review, verbal report of notable occurrences will be provided.

Fire Prevention, Public Education, Public Relations

OFMEM (Office of the Fire Marshal and Emergency Management) reporting 74 fire fatalities in the province of Ontario from January 1st to September 2nd, 2015.

Fire Chief McWilliam and Deputy Chief Higgins are scheduled to attend the Simcoe County Fire Chiefs Administration Group meeting on September 15, 2015.

Preparation for Fire Prevention Week has begun and will be observed from Sunday, October 4th

through to Saturday, October 10th 2015. The theme for this year’s event is: “Hear the Beep where you Sleep”

Occupational Health and Safety

Fire Chief McWilliam is scheduled to attend an Occupational Health & Safety Workshop on September 8-9, 2015. The Joint Health and Safety Committee meeting is scheduled for October 29, 2015.

Emergency Planning

The updated Emergency Response Plan is still being reviewed with plans to bring it forward in October for Council approval.

SUBJECT: Municipal Law Enforcement Activities for August 2015

RECOMMENDATION

THAT the Community Services Committee recommends to Council that the Municipal Law Enforcement Department’s August 2015 monthly activity report be received, for information.

BACKGROUND

The following report provides Committee with information on the activities of the Municipal Enforcement Department for the month of August 2015.

DISCUSSION

1. Municipal Law Enforcement (Regulatory By-Law Enforcement):

During the month of August 2015 a total of 344 Calls-For-Service (C.F.S.) or proactive enforcement files were handled by the Department (versus 233- 2014 and 231-2013 and 591-2012). Officers also continue to clear outstanding files and prosecutions from previous occurrences.

All of these calls and files required an investigation, action or inspection as a result of the complaint being filed or the proactive measures being taken. The type of complaints ranged from Property Standards, parking, noise, animal control, business licensing (property standards inspection), and highway obstruction. Attached is an itemized report off all complaints received this past month, now sorted by occurrence type, including date of complaint and action taken during the investigation.

The Department continues to focus efforts on complete the compliance “list” for Sewer & Water connections that have been task to the department to enforce connection to Municipal Services. Forty-five “Director’s Orders” were issued, with various compliance dates and were accompanied by direct phone contact (where possible). We have compliance achieved on 26 files (58%) where they have either completed hook-ups or removed the structures. The remaining files include 2 with open Building Permits (nearly hooked-up), 4 Extensions, 3 Holds (other issues), 6 Court and 4 (9%) files still being actioned. The Department was recently given 6 additional files for investigation.

2. Property Standards Report:

During the month of August 2015, the Municipal Law Enforcement and Licensing Department did investigate 119 Property Standards Complaints (versus 66-2014, 72-2013, 213-2012).

The term “Property Standards”, for the purposes of this section, will include investigations and actions initiated under the following by-laws:

1. The “Property Standards” By-law (#99-75) 2. The “Clean Yards” By-law (#2009-50) 3. The “Highway Obstruct” By-law (#93-34) 4. The “Littering” By-law (#82-13)

The combined objectives of these by-laws are to ensure the community’s character and appearance can be maintained in a reasonable state of good order. The overall effect is to maintain property in a condition that neither visually offends, nor creates real or perceived health or nuisance hazards.

Since 2010, the Department has been increasing its compliance activities towards “Property Standards” with a more proactive (versus reactive) approach being taken. This has largely been driven by a conscious shift in residents “beautification” and “greener environment” values being expressed directly to the department and members of Council.

Municipal Law Enforcement (Parking Enforcement):

During the month of August 2015, the Municipal Law Enforcement Department issued 401 parking infraction “notices of violations” of the Town of Wasaga Beach Parking Control By-Law No. 2005-17 (Versus 607-2014 and 845-2013, 407-2012).

2015 Court Report Summary

One of the functions of the Municipal Law Enforcement and Licensing Department is to investigate possible violations of both municipal and provincial laws (ie. Municipal By-laws, Building Code/Property Standards, Planning Act/Zoning) and then to obtain compliance when and where required. In some situations, the circumstances require that offenders are summoned to Provincial Court to obtain compliance or to be held accountable after the fact.

The purposes of requiring a court appearance can be many - it may be to obtain a fine or to seek additional remedies including restitution or corrective Orders. Additionally, the court may be requested to issue an Order to prohibit repetition or continuance of an offence. The goal of sentencing is to provide a fair and balanced response to inappropriate behaviour that will serve as a deterrent to a specific offender (referred to as “Specific” deterrence).

It may also be intended to send a message to the greater population who might choose to commit a similar violation as to what they might expect if they behave similarly (referred to as a “General” deterrent sentence). The latter form of sentencing is usually imposed to address a “problem” issue in the community.

On August 18th, 2015, the Department attended Provincial Court where 8 matters were set for a trial concerning By-law infractions, including 6 Sewer & Water files and 2 Obstruction (interfere with Officer) files; all matters were remanded to October and December Court Dates. The next court appearance is October 6, 2015 in Wasaga Beach and results will be including in the November Staff Report.

5. Notes: DEMOLITION: Update The department has over-seen the issuance of an RFP and subsequent contract letting for the demolition of 28 Main Street (Red Barn-like structure). The demolition was completed in June and required very labour intensive deconstruction practices. Contractors have now completed the restoration of the external wall on the north side of 28 Main Street.

The paving has been delayed until a soak-away pit for excess surface run-off can be designed and installed at the former 28 Main street foundation area. This is required to protect the remaining building at 32 Main, from any possible structural failures resulting from uncontrolled surface draining in the general area. We have now received design drawings from Burnside Engineering and are awaiting a 3rd quote, as per our purchasing policy, before letting out the contract. Work will be completed in early fall in an estimated 3-5 day window to minimize disruptions.

RESIDENT PARKING PASSES: Update At the July 28, 2015 meeting, Council approved a recommendation of the Community Services Committee to allow the Residential Parking Passes to be permitted in the Municipal Picnic Area. Since the passing of this recommendation, the sales of these passes has exceeded 1,000 (presently 1035) permits, a record number since their implementation in 2006.

TAXI CAB MORATRIUM: Update The Municipal Enforcement & Licensing Department has commenced the review of the current Taxi Cab Industry, as well as the associated Limousine and Shuttle-type Service sectors. The focus of the review is to examine the existing service delivery model and then to explore areas to improve services, both in is’ present form and also examine alternative service delivery options.

The Town has now met with the current Taxi and Limo business owners for preliminary discussions on status of the existing industry, it’s effectiveness at meeting customer service demands (from the business owners perspective), the products options currently being offered (including equipment and accessibility status) and areas of concern, limiting factors and future service enhancement options.

The Department will be initiating a public consultation process within 30 days, to gather information, comments and recommendations from both the public and business/institutional sectors. A questionnaire is currently being developed, for distribution at the upcoming meeting as well as being made available through other means that are still being reviewed (ie. Online, tax/water bill insertion, direct mailer, at local businesses?). A preliminary report to Committee is targeted for the November 12, 2015 meeting to report back on findings.

ACCESSIBLE CAB: Update. At the August 25, 2015 Council meeting, the CSC Staff Report concerning Accessible Taxi Cab Licensing, was referred back to staff for further review and recommendations. This issue will now be incorporated in the overall Taxi Cab/ Limo review process and will be included in the November 12, 2015 Staff Report to Committee.

Future Activities:

Continue to enforce sign by-law along highways. Work on Discharge of Firearms By-law for October Committee meeting. Maintaining efforts to monitor and clean-up areas with Graffiti. Departmental operations review to ensure Municipal Law Enforcement and Licensing operates

efficiently and effectively.

SUBJECT: Pound Keeper Agreement – New Contract with Georgian Triangle Humane Society

RECOMMENDATION

THAT the Community Services Committee recommends to Council that the Mayor and Clerk be authorized to execute the attached 5-year agreement for Pound Keeper Services with the Georgian Triangle Humane Society.

BACKGROUND

The Town of Wasaga Beach entered into a Pound Services Provider agreement with the Georgian Triangle Humane Society in December 2011 for a period of 4 years to provide for the care and refuge of impounded municipal dogs. That agreement is set to expire on December 15, 2015.

Prior to utilizing the services of the Georgian Triangle Humane Society, the municipality, along with 3 other municipalities, had a longstanding arrangement with Abernant Vet Services, a Stayner area vet. In 2011, all municipalities were given notice that these services were no longer available and each municipality sought a new pound services provider that best suited each municipality’s needs. Each municipality then found their own services provider separately and a “Shared service” location was no longer available.

The Georgian Triangle Humane Society was successful in, the RFP process, by a significant margin (53% lower) over another Clearview bidder (See Dec. 2011 Report attached).

Over the course of the present agreement, the Georgian Triangle Humane Society has met, and often exceeded the requirements of the contract, providing an excellent level of care, record keeping as well as punctual and accurate financial accountability/and remittance.

DISCUSSION

The Senior Municipal Law Enforcement Officer entered into discussions about renewing the agreement in June 2015 with the Georgian Triangle Humane Society executives. As part of the review staff reviewed the previous 4-year performance under the existing Pound Services agreement.

The attached proposed new agreement has 4 changes from the original apart from an updated fee schedule, as follows:

1) At item #26, the invoicing remittance (transaction details) be changed from monthly to quarterly,

2) A paragraph (originally #40) is deleted which pertained to veterinarian services handling during the 4-7th day hold period before the Georgian Triangle Humane Society obtained “ownership on 8th day”. This has been replaced with “ownership of an impounded dog shall pass to the Georgian Triangle Humane Society on the 4th Full Day of impoundment unless the municipality advises they are not wanting ownership transferral until notified. Where such notification is given, the municipality will pay the nightly fee agreed to from time to time, until the dog is transferred or the dog is returned to owner, where such owner is liable for additional fees billed to the Town, in addition to standard fees required”.

3) Paragraph 60- Notice period is changed from 120 days to 180 days. 4) Item 1, change from 4-year term to five (5) year term.

It is recommended that the previous 2% annual increment in Annual Remuneration be continued with the proposed new agreement. This would mean the proposed annual amount (including HST) is as follows:

BETWEEN: The Corporation of the Town of Wasaga Beach (hereinafter referred to as the “Town”) of the first part

- AND - Georgian Triangle Humane Society (hereinafter referred to as the “Pound Keeper”) of the second part

WHEREAS the Town, under the authority of its Animal Control By-Law regulates the ownership, keeping and control of dogs, and further Provincial legislation governs the establishment and operations of “Pounds” that holds animals;

AND WHEREAS the Georgian Triangle Humane Society is a volunteer organization whose primary purpose is to provide care and find homes for lost, abandoned, surrendered and stray domestic animals in the Georgian Triangle;

AND WHEREAS the Town wishes to enter into an Agreement with the Georgian Triangle Human Society for the supply of Pound Services on an annual-unlimited services contract basis, for dogs impounded in the Town of Wasaga Beach;

NOW THEREFORE, as witnessed, the Town of Wasaga Beach and the Georgian Triangle Humane Society hereby agrees upon as follows:

THE TOWN AGREES THAT IT:

1. Hereby appoints Georgian Triangle Humane Society as Pound Keeper for the Town effective December 16th, 2015, for a five (5) Year Term.

2. Hereby designates the physical lands and premises of the Pound Keeper, currently situated at 549 Tenth Line, Collingwood, Ontario L9Y 0W1, as the “Town Pound” as defined in the Town’s Animal Control By-Law which may be amended or replaced from time to time.

3. Hereby appoints the Pound Keeper as authorized agent to act on behalf of the Town, to achieve the effective and efficient delivery of services as set out in this agreement and, with any subsequent direction received from the Town from time to time; such duties include, but not limited to, the following functions:

a) Hold, care for and release as permitted, all impounded dogs, and b) The collection of appropriate licensing and other fee(s) or monies, and c) The issuance of serial numbered tag(s), and d) The collection of licensing and impoundment information, and e) The authority to demand evidence that a dog has been inoculated with an anti-rabies

vaccine.

4. Shall pay the Pound Keeper, remuneration for services, as tendered, that are set out in “Schedule A - Annual Pound Keeper Remuneration”, as attached. These fees may be adjusted from time to time at the approval of Council.

5. Shall pay the Pound Keeper, remuneration for Ancillary Services, required for the effective and efficient operation of the Town Pound by the Pound Keeper, as established from time to time and are set out in “Schedule B – Ancillary Services Approved Fees” and attached hereto. Such remuneration shall be paid upon receipt of statement(s) (and supporting receipts where applicable) to be received no later than three (3) months from when the service was provided except, yearly finalizations shall not be received later than January 21st annually, for all outstanding Ancillary Services of the preceding calendar year.

6. Shall provide the Pound Keeper annually (and as otherwise required), a supply of current serial numbered dog tags and a revised annual schedule of fees, forms and instructions; to facilitate the issuance of dog licenses for impounded animals, non-impounded animals and dogs adopted by Wasaga Beach residents.

7. Shall provide the Pound Keeper a “bound” impound log book, as required to be replaced from time to time, for the purpose of the Pound Keeper maintaining a record of all dogs impounded and how they were disposed of.

8. Shall provide the Pound Keeper with such forms and instruction, that may be amended from time to time, to be completed by the Pound Keeper or

9. Shall provide the Pound Keeper with contact information of the Municipal Law Enforcement Office (both regular and off-hours) as well as for the Towns Animal Control Officer, to facilitate communications between parties, for the efficient and effective operation of the Town Pound and associated issues.

10. Shall counsel and instruct the Town’s designated independent Animal Control Officer (A.C.O.) and Municipal Law Enforcement Officer (M.L.E.O.) directions and instructions received from time to time from the Pound Keeper in regards to the necessary protocols required of the A.C.O. and M.L.E.O’s to enter and impound a dog at the Pound Keepers facility. Also to, immediately attempt to resolve any operational (or otherwise issued) regarding access and impoundment, to ensure the continued effective and efficient operation of the Town Pound.

11. To assist, if requested, the Pound Keeper to facilitate adoptions/sale of formerly impounded animals by providing a link from the Town’s website.

12. To facilitate mediation of any conflicts between the Pound Keeper and owners or former owners of dogs impounded by the Town.

13. Shall authorize the Pound Keeper to provide essential emergency veterinary care or euthanization by a licensed Veterinarian in accordance with “Schedule C- Emergency Veterinary Care- Upset Limits”, attached hereto. These authorized expenditures shall be added to the redemption fees at the time of release of the impounded dog and where the dog is not redeemed by the owner/agent, the Pound Keeper shall be permitted to invoice

the Town as it were an Ancillary fee. The Pound Keeper, at the time of invoice, shall attach proof of services from a licensed Veterinarian.

14. Shall permit the Pound Keeper to provide essential and necessary health maintenance and disease control procedures as may reasonably be necessary from time to time, as set out in “Schedule D- Necessary Health/Disease Control Procedures”, attached hereto, and to authorize the Pound Keeper to collect and retain said costs from the owner/agent of the dog. The Town shall NOT reimburse the Pound Keeper for such costs, unless specifically authorized in advance by the Town. Where such costs have been pre-authorized, the Pound Keeper shall be permitted to invoice the Town as it were an Ancillary Fee. The Pound Keeper, at the time of invoice, shall attach the written pre-authorization to the invoice.

15. Shall direct the Pound Keeper to collect on behalf of the Town, such fees, deposits or other monies, as is determined by the Town; from the owners/agents of dogs being redeemed from the Town Pound and to remit such monies to the Town, as directed.

16. Shall authorize the Pound Keeper to collect and retain such fees as are permitted by the agreement, prior to the return of the impounded dog to its owner/agent. These fees being set out in “Schedule D- Necessary Health/Disease Control Procedures”, and attached hereto.

17. Shall transfer ownership of an unclaimed dog that was impounded under the authority of the Corporation’s current Animal Control By-law, on the day set out in “Schedule E – Assumption of Ownership of Impounded Dogs”, and attached hereto.

18. Town Clerk will provide the Pound Keeper with information and instructions, and Policy, to ensure that the Town Pound is operational in accordance with Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) rules and regulations.

THAT THE POUND KEEPER AGREES THAT:

Pound Keeper/Operate Town Pound; the Pound Keeper shall:

19. Fulfill duties as Pound Keeper in accordance with this agreement and the Corporation’s Animal Control By-law and with any additional instructions that may be communicated from time to time by the Town.

20. Operate the Town Pound in accordance with all Federal, Provincial Statutes and Municipal by-laws including Town of Wasaga Beach Animal Control By-Law (copy provided) and the Animal for Research Act, R.S.O. 1990, as amended, and associated regulations (copy provided).

Agent; the Pound Keeper shall:

21. Act as Agent for the Corporation by: a. Collecting and remitting to the Town all Licensing fees, deposits, or other monies

collected in relation to the Pound Keeper and dog licence issuer activities.

b. Collecting and remitting to the Town within 24hrs all necessary information for dog licenses issued and record associated tags issued (Form P2 or P3).

c. Collect and remit to the Town as soon as possible all other forms. d. Forward copy of properly completed Impoundment and Disposition Record Form

(Form P1) (and Licence “issued” Form (P2 or P3) when required) immediately, as each of these steps is completed.

i. The initial impoundment of dog by the Animal Control Officer. ii. The redemption of a dog by its owner. iii. The transfer of ownership of dog. iv. Other change in status (death, seizure) where dog leaves Pound Keepers

possession. e. Require proof of licensing and current rabies vaccination from someone attempting

to redeem the dog, and where proof is not given; requiring the owner/agent to purchase a license and pay prescribed fees (including Rabies Deposit) as set out by the Town, and providing a copy of said form to the person redeeming the dog.

f. Ensure the identity of any person redeeming the dog by viewing and recording valid photo identification (name and address on photo ID or Driver’s Licence number must be recorded).

Accept Dogs; the Pound Keeper shall:

22. Accept and provide care maintenance and administrative services for all impounded dogs except where the Town has been advised of a dog whose temperament, conduct, health condition or other situation, makes the animal an unacceptable risk to be impounded by the Town Pound. The Pound Keeper will work with the Town to achieve the objectives of the Animal Control By-Law in such situations to the mutual agreement of both parties.

Confidentiality; the Pound Keeper shall:

23. Maintain confidentiality and secure control of all information collecting in relation to duties as Pound Keeper and Dog Tag Issuers.

24. Refer all Pound Keeper/Licence Issuer/Dog Pound Inquires to the Senior Municipal Law Enforcement Officer of the Town.

25. Report all breaches of confidentiality immediately to Clerk or Senior Municipal Law Enforcement Officer of the Town, and where appropriate the Ontario Provincial Police (O.P.P.); such notification shall be both by phone/fax and followed up in writing.

Invoicing; the Pound Keeper shall:

26. Submit contract invoice quarterly, for amount specified in Schedule “A” attached.

27. Submit invoice for approved Ancillary Services at least quarterly except that the final invoice for a calendar year shall be submitted no later than January 21st of the following year.

Forms – Fully Completed; the Pound Keeper shall:

28. Issue dog licenses and collect and remit forms and fees collected as per this agreement, ensuring that all forms are complete and legible on their face and that the correct fee is collected and remitted.

29. Complete fully and legibly all other forms required by the Town, and they are maintained in an organized manner and secure location. Copies of forms will be forwarded to the Town pursuant to this agreement and any subsequent instructions of the Town.

Pound – Log Book; the Pound Keeper shall:

30. Ensure that the Pound log book is being fully completed by both the Animal Control Officer and the Pound Keeper and that a full record of all Town dogs impounded and how they were disposed of, is immediately available for inspection by a Pound inspector or the Town.

Animal Control Officer – Incomplete Forms/Disputes; the Pound Keeper shall:

31. Notify the Animal Control Officer and/or the Town when information about an impounded animal is incomplete, unclear or requires further follow-up. All disputes or disagreements or other situations that arise between the Pound Keeper and the Town or Agents (Animal Control Officer/Municipal Law Enforcement Officers) shall be immediately brought to the attention of the Senior Municipal Law Enforcement Officer.

Access/Instructions For Town; the Pound Keeper shall:

32. Provide 24hr/365 day access to the Town Pound including any keys, access code or other requirements for entry to the Town and its Animal Control Officer.

33. Provide instructions and guidance to Animal Control Officer at any reasonable time, to ensure the safe and secure impoundment of dogs at the Pound Keeper facilities.

Hazards- Notification; the Pound Keeper shall:

34. Immediately provide the Animal Control Officer and Town instructions and guidance in any hazardous, defective or other situation regarding the Pound Keeper facilities that could result in serious harm or injury of persons or animals, including the inadvertent release of an impounded animal.

Adoption Assistance; the Pound Keeper shall:

35. Advise the Town if they wish to advertise for the sale/adoption of previously impounded animals through a link on the Town`s website.

Notification – Anger/Threats; the Pound Keeper shall:

36. Advise the Town, and police where necessary, of any situations of anger, hostility, or threats or similar actions at the Pound Keepers Facility that are in relation to the Town, impoundment activities or an animal being held.

Humane Treatment; the Pound Keeper shall:

37. Provide humane and ethical treatment of all dogs impounded pursuant to this agreement and report to the Town, and other agencies as required, any instances of inhumane treatment or cruelty brought to the Pound Keepers attention concerning any impounded animal.

Emergency Medical Treatment; the Pound Keeper shall:

38. Seek emergency veterinary care and treatment for any dog impounded pursuant to this agreement, where such actions are reasonably needed to relieve undue suffering or sustain life where practical to the circumstances. Such actions shall be pre-authorized subject to recoverable fee as set out in “Schedule C – Emergency Veterinary Care- Upset Limit”, and where veterinary care is expected to exceed the pre-authorized limit; specific written approval may be obtained from the Senior Municipal Law Enforcement Officer of the Town. Where such approval has been authorized, the approved cost may be invoiced as an Ancillary fee along with required documentation.

Essential Health Maintenance/Disease Control; the Pound Keeper shall:

39. Take measures to provide essential and necessary health maintenance and disease control where, in the opinion of the Pound Keeper, it will prevent the contamination of facilities or adversely affect the health of other animals at the facility. Such reasonable and customary costs will be recoverable, at the Pound Keepers discretion, from the owner of the impounded dog or from the new adoptive owners. Such costs are not recoverable from the Town unless specifically authorized in writing in a case-by-case approval. Where such a situation exists; the approval (in writing) may be submitted with the appropriate invoice, as an Ancillary cost.

40. Ownership of an impounded dog shall pass to the Georgian Triangle Humane Society on the 4th Full Day of impoundment unless the municipality advises they do not want ownership transferral until notified. Where such notification is given, the municipality will pay the nightly fee agreed to from time to time, until the dog is transferred or the dog is returned to owner, where such owner is liable for additional fees billed to the Town, in addition to standard fees required.

Enhanced Care Level; the Pound Keeper may:

41. Provide any additional care, at the Pound Keepers expense, that enhances the quality of life if any impounded dog but such expenses are not recoverable from the owners of impounded dogs or the Town.

Transfer of Ownership; the Pound Keeper shall:

42. Accept all impounded dogs to the ownership and responsibility of the Pound Keeper on the day set out in the attached “Schedule E – Assumption of Ownership of Impounded Dogs” of this agreement, unless otherwise agreed to by the Town. Method for calculating the “day” is set out in said Schedule and shall be used to calculate such time.

Unsuitable/Aggressive Dogs; the Pound Keeper may:

43. At any time before the ownership has transferred to the Pound Keeper, notify the Town where a dog is found to be unsuitable for adoption or has become aggressive, to discuss available options for addressing the particular circumstances. The Town will remove within in a reasonable time any such animals, where notified by the Pound Keeper, that the animal is a health and safety risk to the Pound Keeper staff or others.

Duty to Train/Educate; the Pound Keeper shall:

44. Provide training and supervision to all staff/volunteers that are assisting in the operation of the Town Pound. This shall include familiarizing staff/volunteers with the impoundment and release requirements of the Town`s dogs, including the assessment of fees/charges and completion and submission of required forms.

Errors/Escapes; the Pound Keeper shall

45. Immediately notify the Town of any animals that escape, or are improperly released without the terms of this agreement being fulfilled and shall assist the Town in correcting the errors or recovering the animal where possible.

Liability Insurance

46. The Pound Keeper shall:

a) Keep any and all buildings, equipment and vehicles insured for fire and shall keep themselves and the Town properly insured with respect to public liability and property damage, including claims in respect to injury or loss and/or death incurred by negligence of any animals while in their care, to the amount of two million dollars ($2M).

b) Ensure each policy or policies of insurance shall provide cross-liability coverage protecting the Town in respect of claims by the Licensee as if the Town were separately insured; a waiver of subrogation in favour of the Town and those for whom in law it is responsible, and shall also contain an undertaking by the insurer that no material change adverse to the Town or the Licensee will be made and the policy will not lapse or be cancelled or not renewed except after not less than thirty (30) days; prior written notice to the Town, and the Town will require the Licensee to supply a certificate of insurance thereof from time to time, to the satisfaction of the Town. The Licensee will provide a renewal certificate to the Town prior to the expiration date of the policy without demand or request by the Town.

47. The Pound Keeper will name the insurer, the policy number and identify the Corporation of the Town of Wasaga Beach as an additional insured.

Workplace – Safety; the Pound Keeper shall:

48. Comply with current Workplace Safety and Insurance Board (WSIB) legislation.

Health and Safety; the Pound Keeper shall:

49. Provide to the Municipality a Corporate Health and Safety Policy Statement that complies with Sections 8 and 25 of the Ontario Occupational Health and Safety Act, R.S.O. 1990.

50. Demonstrate the establishment and maintenance of a health and safety program with objectives and standards in compliance with legislation and municipal policy.

51. Ensure that workers in their employ are aware of hazardous conditions and substances in the workplace and are wearing the required protective equipment and have received the required training associated with the identifiable hazards.

52. Make themselves aware and have an understanding of the Town of Wasaga Beach Health and Safety Policy.

Accessible Customer Service

53. The Pound Keeper agrees to be in compliance with Ontario Regulation 429/07, (Accessibility Standards for Customer Service) made pursuant to the Accessibility for Ontarians with Disabilities Act, 2005.

GENERAL CONDITIONS

54. The Clerk or Senior Municipal Law Enforcement Officer, may authorize, on a case by case basis, the expenditure of additional costs related to an impounded animal, that are not otherwise covered by this agreement. Such costs may be subject to recovery from the owner during the recovery period or otherwise, when authorized, may be submitted by the Pound Keeper as an Ancillary fee, with required documentation attached.

Payment

55. Payment for work will be made within thirty (30) days of the date of acceptance of the completed work outlined in a detailed invoice, unless agreed upon otherwise.

Assignment/Subcontract

56. The Pound Keeper shall not assign or subcontract without prior written consent of the Town of Wasaga Beach.

57. No permitted assignment or subcontract shall relieve the Pound Keeper from its obligations arising from this agreement or impose any liability upon the Town to any assignee or subcontractor. The Pound Keeper shall at all times be held fully responsible for the acts

and omission of the assignee’s or subcontractor’s directors, officers, employees, independent contractors, subcontractors, shareholders, agencies, partners and volunteers.

Risk of Loss

58. All risk of loss or damage to any property or supplies provided by or used by the Pound Keeper or provided by any third parties in connection with this agreement shall remain with and be upon the Pound Keeper.

Termination- Deemed Detrimental

59. In addition to all of the Town’s other remedies, where the conduct of the Pound Keeper in carrying out the provisions of the agreement, is deemed solely by the Town to be detrimental to the interests or objectives of the Municipality, the Town may, in its sole and absolute discretion and without incurring any liability, rescind the selection of the Pound Keeper. The successful Pound Keeper will not be reimbursed for any profits which may have been anticipated, but which have not been earned up to the date of termination.

Termination – General

60. Notwithstanding, the Town`s right under Section 60 above, either party may terminate this agreement upon giving at least 180 days’ notice of intention to terminate this agreement and such notice shall be in writing.

Indemnification

61. The Pound Keeper shall indemnify and save harmless the Corporation and the Town’s Councillors, employees, trustees and officers, independent contractors, subcontractors, agents, volunteers, successors, and assigns, of any and all losses, costs, damages including but not limited to, incidental, indirect. Special and consequential damages or any loss of use, revenue or profit by any person, organization or entity, however caused, arising or to arise by reason of executing this agreement.

RECOMMENDATION

THAT the General Government Committee recommend to Council that the Town enter into a four-year contract with the Georgian Triangle Humane Society for the supply of Pound Services for dogs impounded in the Town of Wasaga Beach.

BACKGROUND

The Town of Wasaga Beach, under the authority of its’ Animal Control By-Law #2002-63 (as amended), and Provincial legislation, regulates the ownership, keeping and control of dogs. Provincial legislation governs the establishment and operations of “Pounds” that hold animals.

Wasaga Beach has, through a long-standing services contract, established and maintained a Municipal Dog Pound with Abernant Veterinary Services located on Highway #26 in Clearview Township, to hold and care for dogs picked up running loose within the municipality. Three other Municipalities: Essa Township, Clearview Township and Springwater Township also utilize this facility.

In September 2011, Abernant Veterinary Services came under new ownership and shortly afterwards all four municipalities, including the Town of Wasaga Beach, were placed on notice that they will no longer be providing service as of December 15, 2011.

Following this notification, representatives of the affected municipalities met to discuss options and find possible solutions. All agreed a similar shared-service facility would be ideal but likely hard to find. Each municipality decided to issue its own RFP/Q (Request For Proposal/Quote) which contained an “information sharing” clause that allowed the respective bidders information, including offers of proposed service levels, to be freely shared with the other municipalities so that they could establish one or more service locations.

In October, the Town of Wasaga Beach issued a three-part RFP for the supply of: Part I- Dog Pound Services Part II- Animal Control Services- Only Part III- Pound & Animal Control Services- Combined

While our current Animal Control Services Contract (Part II) is due to expire in April 2012, it was thought to be expedient to solicit the level of interest and potential costs at this time. The immediate goal of this exercise is to re-establish new Municipal pound.

The third (Part III) service option provided the opportunity for someone to propose a “one-step” “capture & impoundment” business model that currently exists in some other municipalities.

DISCUSSION

At the close of this RFP (Nov 18th/11), two (2) bids were received under Part I (Pound Services- Only) and zero (0) bids were received under Part III (Animal Control & Pound Services- Combined). There were also two (2) bids received under Part II (Animal Control Services- Only) but will not be included in this report as the present goal is to re-establish a new “Pound” facility immediately.

Bids for the Pound-Only (Part I) were received from the following prospective service providers:

Bidders were given the option to bid on a “per/dog, per/day fee-for-services basis and/or an “Annual” Unlimited Events” service. Further, the Municipality will pay up to 7 days holding, after which the ownership transfers to the Service Provider.

Based upon a review of all parameters examined, the Georgian Triangle Humane Society proposal provides the best value and service at the most economical rate presently available.

RECOMMENDATION

THAT the Community Services Committee recommends to Council that it authorize the Mayor and Clerk to enter into an Animal Control Services Contract with Redneck Wildlife Animal Control for a five year period; and further;

THAT the Municipal Law Enforcement and Licensing Department be authorized to perform the dispatch service for Redneck Wildlife Animal Control for evenings, weekends and holidays as outlined in this report.

BACKGROUND

The Municipal Law Enforcement and Licensing Department is currently seeking to re-establish the municipality’s Animal Control Services since the unexpected loss, in December 2014, of the Officer who had been providing these services for many years. Fulltime staff stepped in and took over providing Animal Control Services as needed, on an on-call/call-out basis. Later in March 2015, Council approved the hiring of Redneck Wildlife Control to provide interim Animal Control Services until a full review and report on options could be brought forward.

On February 12, 2015 the Community Services Committee received a Staff Report from the Senior Municipal Law Enforcement Officer, and directed an R.F.P. for Animal Control Services be prepared and be brought back to Committee for approval.

On March 19, 2015 the Community Services Committee approved the R.F.P. for Animal Control Services, and further approved a request from the Senior Municipal Law Enforcement Officer to hire an interim animal control services provider. This independent contractor would provide emergency services of dog impoundment and dead animal pick-up/disposal, on an “as-needed” basis, until a new service model is decided upon and is in place.

Mr. Eric Bronee o/a Redneck Wildlife Control was subsequently appointed an interim Animal Control Officer; his company has continued to provide services to the municipality since this appointment.

The R.F.P. process produced only two (2) responses from interested parties; one bidder (Mr. Dwight Pilkey) submitted a bid under PART I only- BASIC/FULL SERVICES SECTIONS, and the other bidder (Eric Bronee of Redneck Wildlife Control) submitted various bids under PART II only – DOG IMPOUNDMENT/DEAD ANIMAL PICK-UP SERVICES SECTION.

Mr. Pilkey’s bid under PART I was for the “Full Service” Option only ($48,000); this required prerequisite knowledge and skill sets in law enforcement to act independently as an enforcement officer. This bidder was tested in knowledge and skill, as per R.F.P. conditions, and found to be deficient in several required core areas, effectively negating this bid. This means that currently, only 1 bidder, Redneck Wildlife Control, remains within the terms of the R.F.P. This bid was for a fee-for-service basis only, either individual occurrence based or monthly rates.

The Municipality has now directly overseen the Animal Control Services program for the last eight (8) months, including a 5 month “Review” period. The program consisted of the use of the interim Animal Control Officer, who simply responded to callouts for dog impoundment or dead animal pickups, dispatched by the municipality.

During the “review” period the municipality screened all animal control calls, including calls received during day-time business hours, as well as evening and weekend calls. Municipal Staff then managed the required responses to minimize the timing and frequency of “call-outs” to the interim Animal Services provider and to screen out animal attack reports, police/other agency assistance calls as well as “non-respondable” inquiries or Animal Control by-law related inquiries (Licensing, Poop n Scoop, noise, etc.)

This pre-screening/dispatch system proved to be very effective at reducing the number of dogs needing to be impounded, responding quickly to retrieve dead animals and better managing and responding to Animal Control by-law complaints, especially dog bite investigations and nuisance barking calls.

During the 22 week review period, the interim Animal Control Officer responded to 41 calls for service (1.9 calls/week), impounding 10 dogs, and picking up 41 deceased animals, including 4 deer. Additionally, the Municipal Law Enforcement and Licensing Department maintained an officer on-call ($225/week cost) to respond to Public complaints that are animal control related, on evenings and weekends. Approximately 8 calls per week were received by the on-call services which handled, in addition to the 41 Animal Control Officer call-outs, 9 dog bite incidents, 16 lost (no pick-up) or found dogs, 15 dog barking, 10 running-at-large, 5 alternate support services (MNR, OPP), 35 nuisance wildlife/domestic animals as well as 40 non-respondable calls (cat in tree, saw bear tracks, etc.)

DISCUSSION

Animal Numbers

Dog Impoundment Service- Numbers Previous data analysis for the Pound Contract has predicted a solid 4-year average of 56 dogs/year impounded. While numbers fluctuate seasonally, the 4-year review provides a reasonable base line.

Dead Animal Pick-Up Service- Numbers The 5-month review period and additional 3 month in-house (January-March) experience has provided essential data, never before recorded, concerning dead animal pick-up volumes. This provides a reasonable base-line to project anticipated workloads (as associated costs).

Financial Projections

Dog Impoundment Service- Projected Cost During the review period, the Town paid a negotiated rate of $125/dog to impound dogs. This rate reflected a long-standing rate paid to our previous Animal Control Officer, while performing services in the municipality of Springwater. Also, Redneck Wildlife Services is currently supplying this same service to the Municipality of Springwater at a rate of $125/dog call-out,

ANNUAL IMPOUNDMENT COST ESTIMATE: $125 x 56 DOGS = $7,000

Dead-Animal Pick-Up- Projected Cost During the review period, the Town paid Redneck Wildlife Control various negotiated rates (deer, squirrel, skunk), including a single fee for up to 3 small animals on the same “run”. The average pick-up and disposal cost was $80.00 per trip.

ANNUAL DEAD ANIMAL PICK-UP COST ESTIMATE: $80 x 100/YR = $8,000

Municipal On-Call Services- Projected Costs During the review period, Town Staff acted in an on-call capacity during weeknight/weekend/Stat Holiday hours to handle all Animal Control complaints, dog bites, found animals and to dispatch for pick-ups. They were paid a similar rate that was established in the present CUPE contract; this equated to $225 for entire week/weekend coverage; they average 8 calls/week. It is recommended that the service be continued but the rate reduced to $175/week plus a $50/day premium for Stat Holidays.

OPTION 1 Canvas Redneck Wildlife Control to ascertain if they will accept the projected lower amount for services, and if so, prepare a contract for execution that reflects that acceptance and bring forward to Council.

Note: The discussion has occurred and the owner is prepared to accept the lower amount for services. His preference is to respond to dispatched calls rather than deal with the public directly.

OPTION 2 That the Community Services Committee, where no agreement is reached under Option 1, direct that a new R.F.P. be released to again seek qualified bids and report back to Council.

OPTION 3 That the Community Services Committee direct that the Senior Municipal Law Enforcement Officer bring back a new report concerning bringing the Animal Control Services in-house, and provide a full analysis.

Given the owner of Redneck Wildlife Control is prepared to accept the lower estimated cost, it is recommended that Committee recommend to Council that the contract for the provision of animal control services be awarded to him.

It is further recommended that staff in the By-law Department be authorized to continue to perform dispatch services for animal control services based on the current service level.

The combination of these two aspects provides a high level of service to the public at a reduced cost to the taxpayer compared to the arrangement with the previous long standing animal control officer.

RECOMMENDATION

The Community Services Committee recommends to Council that it approve a new Watercourse Protection By-law for the municipality.

BACKGROUND

In recent years, the municipality has received numerous complaints about activities that may negatively affect watercourses including the Nottawasaga River and Beachfront Areas.

These activities have included the intentional dumping of leaves and yard waste into the river that, among other things, adds to the black muck and detritus that washes up upon the main beaches. Pools and spas containing chemicals have also been witnessed being emptied directly into the watercourse. Additionally, other occurrences have been reported of garbage and waste materials that have been accidentally or intentionally dumped into the river.

The municipality is also seeing an increased frequency of complaints of deteriorating breakwalls and associated bank deterioration and entry into the river of a wide range of debris.

These complaints eventually caught the attention of the River Resources Committee at the October 28, 2013 meeting, where a presentation from Jason Ruttan was heard. The Committee discussed the feasibility of creating a public education program and also exploring the possibility of establishing a regulatory by-law.

The Public Works Department then created an information brochure entitled “Dumping into the Nottawasaga River and Other Watercourses”, which was distributed in the early 2014 Municipal Water Bills (see attached).

The Municipal Law Enforcement and Licensing Department was then asked to explore the possibility of creating a regulatory by-law to address the issue of “dumping” into the River. The department then sought out a legal opinion as to the Municipal Jurisdiction to regulate such matters over the provincially owned watercourses within the Town of Wasaga Beach.

DISCUSSION

The Town and its inhabitants recognize and understand the importance of the “water” to Wasaga Beach. It is the central focus of our recreational tourist activities and vital to the economic engine of the community. It also provides a desirable residential location with significant property values, and associated property tax revenue. Additionally, it is a living ecosystem with unique environmental benefits to visitors and residents alike; it is worth protecting.

The importance of these benefits to the Municipality enables the Town, through the strength of the new Municipal Act, to exercise jurisdiction over the River (and other watercourses) to protect and enhance the social, economic and environmental wellbeing of the community.

The Supreme Court has now affirmed these new “municipal powers” to ensure municipal governments can “achieve the legitimate interests of the municipality and its inhabitants”. These powers can co-exist with other Provincial or Federal regulation, but only to the extent they achieve the same purpose and do not frustrate the purpose of the respective federal or provincial legislation.

This proposed Watercourse By-law will enable the municipality to deal with both the “dumping” issues as well as the maintenance and care of the current shoreline structures, both areas we presently have been unable to address adequately.

It also provides the ability of the Municipality to issue orders to cleanup, repair or remove offending materials. This also allows the municipality to effect repairs where the others refuse, and the costs can be added to the tax rolls.

Upon approval of this by-law, the Municipal Law Enforcement and Licensing Department intends to seek approval from the Senior Justice, to enable a “ticket” be issued for “dumping” offences and for “failure to comply with an Order”. A set-fine will be sought of $300 dollars for dumping and $500 dollars for failure to comply with an Order. These will allow for immediate penalty action (issuing a Ticket) without first appearing in court. These fines will serve as an immediate deterrent to raking or blowing your leaves in the river. Such fines would first need approval of Senior Justice of the Province of Ontario.

A BY-LAW TO PROVIDE FOR THE PROTECTION AND CONSERVATION OF THE WATERCOURSES WITHIN THE MUNICIPALITY

WHEREAS Section 8 of the Municipal Act, 2001, as amended provides that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality’s ability to respond to municipal issues;

AND WHEREAS Section 9 of the Municipal Act, 2001, as amended, grants municipalities the capacity, rights, power and privileges of a natural person for the purpose of exercising its authority under the Act;

AND WHEREAS under Section 11 of the Municipal Act, 2001, as amended, a lower tier municipality may pass by-laws respecting matters within the sphere of jurisdiction set out therein, including matters related the Economic, social and environmental well-being of the municipality;

AND WHEREAS it is recognized that the Nottawasaga River and other watercourses are key to the economic, social and environmental well-being of this municipality;

AND WHEREAS it is deemed expedient to protect all watercourses within the municipality, including the Nottawasaga River and all watercourses that flow into it or otherwise terminate into the Nottawasaga Bay in areas affronting the municipality;

NOW THEREFORE, the Council of the Corporation of the Town of Wasaga Beach HEREBY ENACTS as follows:

1. Short Title

This by-law shall be known as the “Watercourse Protection By-law”.

2. Definitions

2.1 DEBRIS shall mean all waste material such as discarded and demolished building material, trees and shrubs or parts thereof, leaves, grass cuttings, yard and garden waste, and any other like or similar waste material;

2.2 DELETERIOUS SUBSTANCE shall mean

(a) any substance that, if added to any water, would degrade or alter or form part of a process of degradation or alteration of the quality of that water so

that it is rendered or is likely to be rendered deleterious to fish or fish habitat or to the use by man of fish that frequent that water, or

(b) any water that contains a substance in such quantity or concentration, or that has been so treated, processed or changed, by heat or other means, from a natural state that it would, if added to any other water, degrade or alter or form part of a process of degradation or alteration of the quality of that water so that it is rendered or is likely to be rendered deleterious to fish or fish habitat or to the use by man of fish that frequent that water,

and without limiting the generality of the foregoing includes

(c) any substance or class of substances prescribed pursuant to paragraph (2)(a),

(d) any water that contains any substance or class of substances in a quantity or concentration that is equal to or in excess of a quantity or concentration prescribed in respect of that substance or class of substances pursuant to paragraph (2)(b), and

(e) any water that has been subjected to a treatment, process or change prescribed pursuant to paragraph (2)(c);

2.3 DEPOSIT shall mean the act of, or the permitting thereof, any discharging, spraying, releasing, raking, blowing, spilling, leaking, seeping, pouring, fouling, emitting, emptying, throwing, dumping, placing or any by another other action or inaction that, directly or indirectly, results in any foreign materials entering a watercourse or watercourse system or being situated where it will likely enter a watercourse or watercourse system;

2.4 FOREIGN MATERIAL shall mean any liquid, solid or gaseous “thing” that did not immediately originate from within the watercourse or the bed of the watercourse, including, but not limited to, garbage, refuse, debris, domestic or industrial waste, a deleterious substance or anything that is prohibited entirely or in specific quantities, by any other by-law or statute or Regulation of the Province of Ontario or by the Parliament of Canada;

2.5 GARBAGE shall mean all vegetable and animal matter subject to decay, whether it be household, commercial or industrial waste and shall include the wrappings in which the same is placed;

2.6 OFFICER shall mean all Municipal Law Enforcement Officers or Police Officers;

2.7 ORDER shall mean an Order issued under a By-law of the Municipality pursuant to section 444 and 445 of the Municipal Act 2001, S.O. 2001, c. 25; as amended;

2.8 OWNER shall have the same meaning as the “owner of Shoreline Materials”;

2.9 OWNER OF SHORELINE MATERIALS shall include the owner or tenant of:

(a) the real property upon which the Shoreline Materials are partially or fully situated upon or form a part thereof, and

(b) the real property which immediately affronts the shoreline materials, which may be partially or fully upon lands owned by other person(s) but are utilized, attached or historically formed as an extension of one or more adjoining real property(s) that provide access and proximity to the adjacent water body including docks and other structures that are under the control of said owners/tenants.

2.10 REFUSE shall mean all waste material such as, but not limited to, crockery, glass, bones, metal, rags, discarded wearing apparel, discarded furniture and appliances, and all such other kinds of discarded items which may be subject to decay;

2.11 REGULATED AREA shall be the area under jurisdiction of the Nottawasaga Valley Conservation Authority regulations;

2.12 SHORELINE shall mean the area(s) of lands which are adjacent to, touching from time to time, or covered by the waters of a watercourse, and includes lands “regulated” by the Nottawasaga Valley Conservation Authority to the extent necessary to accomplish the purpose of the by-law;

2.13 SHORELINE MATERIALS shall mean any soils, or components thereof, rocks, wood or wood works, cement works, metal works, docks, breakwalls, wave walls, retaining walls or any other natural or artificial or foreign materials that are situated to affront a watercourse or is in direct contact with the watercourse wholly or from time to time;

2.14 WATERCOURSE means a creek, pond, lake, river, stream, or brook, whether usually containing water or not and any spring or wetland that is integral to a watercourse;

2.15 WATERCOURSE SYSTEM means Watercourses and waterworks, ditches, drains or sewers, drainage works, mains, pipes, culverts, catch

basins. Leads, and curbs and gutters, located in the District on private or public property, by which surface or ground water is conveyed to receiving waters; excludes stormwater control basins (but not their discharge outlets or channels);

2.16 WETLAND means land, with or without visible banks, which is inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal conditions supports, a prevalence of vegetation typically adapted for life in saturated soil conditions, including swamps, marshes, bogs and similar areas, also includes all land within 7.5 metres of any land meeting that description, measured horizontally.

3. General Prohibitions

3.1 Except where otherwise explicitly authorized by law, no person shall deposit or permit the deposit of any foreign materials into any watercourse or watercourse system that exits or flows within the municipality boundaries of the Town of Wasaga Beach.

3.2 Except where otherwise explicitly authorized by law, no person shall deposit or permit the deposit of any shoreline materials into any watercourse or watercourse system that exits or flows within the municipality boundaries of the Town of Wasaga Beach.

3.2.1 Section 3.2 above does not apply where the shoreline materials are fixed in-place and function for origin of purpose, without eroding, corroding or deteriorating into watercourse or creating a nuisance or potential hazard to watercourse users.

3.2.2 Section 3.2 above does not apply where approved construction or maintenance works are being undertaken and are being carried out in accordance with the conditions of that approval.

3.2.3 Section 3.2 above does not apply to the Province of Ontario Conservation Authority or any other Government Organization that has authority to work or alter the Shorelines or Shoreline Systems or any watercourse. or to maintenance or other works conducted by, or on behalf of, the Town of Wasaga Beach.

3.3 Except where otherwise explicitly authorized by law, no person shall store, hold or maintain accumulations of foreign materials in such a location or under such circumstances that would likely result in the eventual deposit of such materials into the watercourse or watercourse system, either through natural environmental factors (wind, rain, erosion, gravity, animals, etc.) or other human activities.

3.4 Except where otherwise explicitly authorized by law, no person shall store, hold or maintain accumulations of shoreline materials in such a location or under such circumstances that would likely result in the eventual deposit of such materials into the watercourse or watercourse system, either through natural environmental factors (wind, rain, erosion, gravity, animals, etc.) or other human activities.

3.5 For the purpose of interpretation of 3.1, 3.2, 3.3 or 3.4 above, it need not be proven that any “deposit” had occurred; only that on a reasonable balance of probability, that a deposit of some such materials has already occurred or would eventually occur.

4. Exceptions

Notwithstanding the sections above, nothing in this by-law is intended to prevent the lawful seasonal or temporary, uses of the watercourses by the operation of recreational watercraft or associated navigational aids, or the lawful placement and use of docks that does so without offending section 3.1 above.

5. Entry and Inspection

Officers shall have the right to enter and inspect property pursuant to the Municipal Act, 2001, sections 444 and 445, and set out in the Municipal By-law.

6. Obstruction

No person shall obstruct or attempt to obstruct any Officer or other person, who is exercising a power or performing a duty under this By-law or any other Town of Wasaga Beach By-law or the Municipal Act, 2001, S.O. 2001, c. 25, as amended or its predecessor.

7. Orders and Remedial Action

7.1 If an Officer is satisfied that a contravention of any By-law has occurred, the Officer may make an order requiring the person who contravened the By-law to discontinue the contravening activity, known as an Order to Discontinue Activity, requiring the person who contravened the By-law, or who caused or permitted the contravention, or the owner or occupier of the Land on which the contravention occurred, to discontinue the contravention. 7.1.1 An order under subsection 7.1 shall set out,

a) reasonable particulars of the contravention adequate to identify the contravention and the municipal address on which the contravention occurred;

b) the date by which there must be compliance with the order; and

c) the date on which the order expires.

7.2 If an Officer is satisfied that a contravention of any By-law has occurred, the Officer may make an order requiring the person who contravened the By-law to do work to correct the contravention, known as a Work Order.

7.2.1 An order under subsection 7.2 shall set out,

a) reasonable particulars of the contravention adequate to identify the contravention and the municipal address of the property on which the contravention occurred;

b) the work to be done and the date by which the work must be done; and

c) the date on which the order expires.

8. Offence

8.1 Any person who contravenes any of the provisions of this By-law including failure to comply with an Order, is guilty of an offence and upon conviction is liable to a maximum fine of $100,000.00.

8.2 Upon conviction, in addition to any other remedy and to any penalty imposed by this By-law, the court in which the conviction has been entered and any court of competent jurisdiction thereafter may make an order prohibiting the continuation or repetition of the offence by the person convicted.

9. Municipality Power to Remedy

Where a person fails to do a matter or thing as directed or required by an Officer or other person pursuant to this By-law or other Town of Wasaga Beach By-law or the Municipal Act, 2001, S.O. 2001, c. 25, as amended, the matter or thing may be done by the municipality at that person’s expense which associated costs may be added to the tax roll of the person to be collected in the same manner as property taxes.

10. Validity and Severability

Every provision of this By-law is declared to be severable from the remainder and if any provision of this By-law shall be declared invalid by a court of competent jurisdiction such declaration shall not affect the validity of the remainder.

11. Conflicts

11.1 This By-law shall apply in addition to the provisions of any other Town By-law and the Municipal Act, 2001, S.O. 2001 c. 25, as amended, provided that in the event of conflict, the provisions of any other Town By-law or the Municipal Act, 2001, S.O. 2001 c. 25, as amended, shall be paramount over this By-law, provided such provisions are not contrary to law.

11.2 Nothing in this By-law shall limit any other statutory or common law rights or powers of the municipality or any Officer to enter on Land.

12. Effective date

THAT this By-law shall come into force and take effect on the date of its final passing.

RECOMMENDATION

The Community Services Committee recommends to Council that it table the attached proposed new Noise By-law for review and discussion.

BACKGROUND

Presently, the Town is using a consolidated (2002) Noise By-law that amalgamated four (4) previous By-laws (#87-1, #89-58, #99-18 and #99-19) and has had an additional amendment concerning snow maintenance equipment noise exemptions (2008-103), in 2008.

The current by-law is poorly worded and extremely hard to enforce. It restricts noise 24 hrs/day which has created frustration and challenges for residents, local business owners and the Officers who must seek compliance with the by-law the way it is written. It has also been difficult for members of Council to explain how the by-law is enforced to those who have noise by-law complaints. As a result of all these factors, Committee requested that the by-law be reviewed and updated.

DISCUSSION

The Municipal Law Enforcement and Licensing Department has revamped the By-law to balance the expectation to be respectful of other people’s need for peaceful enjoyment of their property while acknowledging the “norms” of a summer tourist destination area. The expectations and experience at a tourist destination must meet the needs of vacationers and residents alike.

- 11PM – 7AM – RESIDENTIAL PROPERTIES

- 12PM – 7AM – COMMERCIAL TOURIST BUSINESSES, BARS/ RESTAURANTS (that serve alcohol and provide musical entertainment from time to time) that are located within 225 meters of R1 residential properties.

- 2AM – 7AM – COMMERCIAL BARS/RESTAURANTS (that serve alcohol and provide musical entertainment from time to time) that are located more than 225m from R1 residential properties.

THAT the Community Services Committee does hereby receive the Parks, Facilities and Recreation monthly activity report as information.

BACKGROUND:

The Senior Administrative Assistant was able to have the 2015/16 Fall & Winter Brochure ready ahead of schedule and it was sent out to all residents the week of August 17th. The brochure looks great and has all the updated information for events, programs and contacts for the many other recreational opportunities in Wasaga Beach. Darlene was once again able to secure advertising that will cover approximately 80% of the brochure costs.

The 8th annual Mayors Golf Challenge was held on Friday, August 28th, at the Marlwood Golf & Country Club. Despite the short preparation time we did have close to a full complement of golfer’s turnout to support the event and enjoy a beautiful summers day. Once again we’d like to thank 97.7 The Beach for being our co-sponsor and assisting in promoting the event and also all the businesses for their donations and hole sponsors.

Planning is presently underway for the dedication ceremony of Peacekeepers Park and Veterans Way, which is scheduled to take place on Saturday, October 17. Additional information will be sent out once the agenda and invitations are finalized.

Jazz and More in the Park has been receiving some fantastic reviews so far this summer. We have seen attendance range from 150 people to 350 people. Tuesday, September 1st, was the last performance for the 2015 performances and through the summer we have had over 1700 people attend the event. The Recreation Coordinator has also been circulating advertising pamphlets for Dinner and a Movie event at the last two shows and an announcement prior to the performance will also be made.

The Wacky Boat Regatta event has been postponed to September 13th, 2015 with a goal of achieving a minimum of 8 registrations. Prior to postponing the event to a later date, only one registration was processed and this was completed online. Promotion of this event so far has included a significant advertising campaign between 97.7 The Beach and the Wasaga Sun. Over 400 team registration packages have been printed and delivered to business in and surrounding Wasaga Beach. 40 sponsorship packages have been delivered in person and through the mail. 50 Posters were printed and distributed around Wasaga Beach. Extensive follow up phone calls have been placed and personal visits to businesses in Wasaga Beach with hand delivered sponsorship and team registration packages.

The Nancy Island Lions Club has also hand delivered over 30 team registration packages and have not submitted any teams as of today (September 1st, 2015). The dead line for team registration is this Friday, September 5th, 2015. Prior to registration closing Josh will be going around to business again with access to the online registration on Wednesday, September 2nd, 2015. All entertainment and event suppliers have been updated with current information regarding the date change and possibility of cancelation.

A needs assessment for the Wasaga Beach Adult Recreation League Project in partnership with the Wasaga Beach YMCA has been distributed electronically. So far we have gathered 111 responses that will allow the programmers an opportunity to identify some significant trends regarding the needs of the community in terms of adult recreation. The needs assessment thus far gives reason to believe that this project is on the right track and that adults in Wasaga Beach are indeed seeking more opportunities to participate in organized recreation sports.

The YMCA and the Recreation Program Department have almost finalized an agreement to offer cooperative programming specifically for the upcoming Fall/Winter adult volley ball league.

The Recreation Coordinator will be scheduling committee meetings for Snowman Mania beginning in September. Recruitment of new committee members has also begun and phone calls to schedule entertainment have been placed. Sponsorship discussions with local media such as 97.7 The Beach and the Wasaga Sun have taken place and the two advertising companies have started to put together package proposals.

A proposal has been put together which outlines the costs associated with upgrading the Book King Registration System (our current software service provider) for Parks, Facilities and Recreation. These upgrades would also benefit events such as the Wacky Boat Regatta, Mayor’s Golf Challenge, Geocaching, Self Defense Seminar and Snowman Mania through offering online registration. Moving forward with enhancing our number of modules we deliver from Book King in the opinion of the Recreation Coordinator is the best fit for the Town of Wasaga Beach at this time. Some of the benefits to staying with Book King are that we already have a relationship with the customer support team, we would not need to completely retrain our staff, and the cost of their software is very reasonable in comparison to other registration software service providers. The information includes hardware upgrades at the service end of the registration system which include a touch screen monitor, cash drawer and recite printer. Making these upgrades will allow for a more seamless flow of registration, payment, administration and developing reports. Revising this process to building client accounts and take registrations on the computer as the customer is at the desk with a receipt printed automatically upon registration will ultimately make registering a more customer friendly experience and allow front end staff to eliminate the timely task of building class lists and reports. This process will also allow us to track registration trends and see when our strongest registration periods are taking place. In turn, we can promote registration time periods more effectively to drive participation in the programs and events we offer. Additional training on the new modules will be offered and a request has been made to allow recreation programmers to sit through training on the Program Registration modules in order to use more effectively.

The Recreation Programmer has also been working on a number of other initiatives to enhance the Sports Park facility uses including a summer multi-sports camp, football, possibly providing volley ball courts at the site.

About three weeks ago we added Pickle Ball lines to the Town Hall Tennis Court. With the court surfacing being a dark blue colour, and the tennis lines painted white, we decided to paint the pickle ball lines a lighter shade of blue, as recommended by multi-court contractors.

To date we have received concerns from two tennis players in regards to confusion by the extra set of lines but no complaints from the pickleball players that are utilizing the same court. We’ll continue to monitor it to see if there’s a large backlash from either group but we believe that once they get used to the extra set of lines that they’ll be more comfortable with them. Four sets of Pickle Ball lines were also added to the double concrete tennis courts at the Oakview Woods facility in order to accommodate the clubs activities next year when we re-construct the court a Wasaga sands. Once that construction is complete we’ll adjust the lines and to accommodate two courts so that they can use the tennis nets, similar to the town hall court.

The parks staff has started aerating; seeding and top dressing a number of feature/high profile areas and then, once the sports field activities slow down, will be applying the same program to a number of those facilities. In all we have about fifteen areas that will be addressed.

The five parks maintenance summer students will be finished on September 4th and returning to school. Overall we were pleased with the complement of staff and the duties they were able to perform while they were with us for the four month period.

Along with their regular duties of maintaining sports fields, trails, parks and open space areas, cemetery etc., the Parks areas of the department has been busy providing set-up and tear down for a number of special events over the past few months. We still have a few weekend ball and soccer tournaments scheduled for the Sports Park along with some event set-ups and two tree planting events

The Youth Coordinator put out an RFQ for the provision of DJ services for the 2015/16Youth Dances with four DJ’s submitting quotes. We have chosen to hire DJ Chuckie B of DJ Nation Canada as scored the highest on the criteria laid out in the RFQ. He will be providing music videos for all of the dances, as well as lighting effects, swag giveaways, and a photo booth.

The Youth Centre has met with Stormie Choi, Acting Beach Stewardship Coordinator for Ontario Parks, and partnered with them for the youth to volunteer at the Beach helping with beach clean-up. Shelley has been busy finalizing details for this year’s school programs and has sent the school marketing materials to the School Boards for approval.

The Youth Centre Garage has been re-painted and organized, the grand opening will be Saturday, September 5th 4pm-7pm, the community is invited to see what the refreshed space has to offer and partake in a short yoga class
