1. IntroductionWelcome to the new CPD Guidelines & Regulations 2020 for those who hold the designation PTP (Pension Trust-ee Practitioner). The PTP designation is awarded to members who have successfully completed the Professional Certificate in DC Pension Scheme Trusteeship. These guidelines are valid for the CPD year 2020.

Every individual who holds the PTP designation is obliged to:a) maintain membership of LIAb) fully participate in the PTP CPD scheme and comply with all of their requirements.

Any breach of either one or both of these conditions will result in the loss of your designation. This process is essential in maintaining the credibility and standing of the designation, and of those who continue to hold them.

2. TermsThroughout this document the following terms are used:

Professional Certificate in DC Pension Scheme TrusteeshipThis term refers to the professional qualification that must be achieved in order to apply for the PTP designation.

Pension Trustee Practitioner (PTP)This term is used to refer to those who have been awarded the PTP designation by LIA.

AdministratorsThis term refers to those responsible for carrying out the administration of the CPD scheme i.e. the CPD adminis-tration staff of LIA.

3.Continuing Professional Development Definition & Purpose There have been many definitions of CPD by various individuals and bodies over the years. The Professional Associations Research Network in the UK carried out an extensive research project into CPD and in the process devised the following comprehensive definition:

“CPD is any process or activity of a planned nature, that provides added value to the capability of the professional through the increase in knowledge skills and personal qualities necessary for the execution of professional and technical duties, often termed competence. It is a life-long tool that benefits the professional, client, employer, professional association and society as a whole and is particularly relevant during periods of rapid technological and occupational change.”

The purpose of the PTP CPD schemes is to keep the qualifications current and to ensure that the holders of the PTP designation are meeting the highest level of governance, compliance and competence for those acting or wanting to act as a trustee of a defined contribution occupational pension scheme or Trust RAC, as well as a Pensioner Trustee.

4. Benefits of CPDThere can be no doubt that the principal beneficiary of CPD participation is you. Your involvement should ulti-mately help you both personally and in your career.CPD should help you to:

• update your skills and knowledge on existing and new areas of business• build client trust and confidence• expand and hone your skills• build self-confidence and conviction• gain a broader view• raise your personal profile through networking and make you more ‘marketable’ to your existing and/or future employers.

Your ClientsYour participation in the CPD scheme also benefits your clients, who will be reassured that you are a qualified, well-informed person maintaining your knowledge and skills by keeping in touch with ongoing developments in your business.

Your EmployerYour employer or company benefits from your participation, as you are likely to be more efficient and productive, which gives them a competitive edge.

The PTP DesignationThe fact that all those who hold the PTP designation participate in a common CPD scheme gives added value and credibility to the designations. This has a positive effect on client and employer confidence, which in turn has a positive effect on you.

The Financial IndustryThe PTP designation which is backed up by mandatory CPD scheme is a recognised stamp of quality for those who hold it.

5. Annual CPD RequirementsEvery PTP designation holder is obliged to complete the same amount of CPD, irrespective of the area of busi-ness or the industry in which they are employed.

The annual requirement for PTP members who are Lay Trustees with no existing LIA designation is 6 hours in areas relevant to your PTP Designation, i.e. Trusteeship, Savings/Investments & Pensions. In this regard, at least 1 hour must be in each of these categories with the remaining 3 hours across any of these 3 categories.

The annual requirement for current LIA members with an existing designation/CPD requirement each year will remain unchanged at 15 hours but PTP holders need to acquire 6 hours (of the annual 15 requirement) relevant to your PTP designation. In this regard, at least 1 hour must be in the each of the categories Trusteeship, Pensions & Investments with the remaining 3 hours across any of these 3 categories.

The CPD scheme for PTPs is essentially self-certifying and there will be no compulsory testing by LIA. A percent-age of members will be selected for audit of their CPD hours each year (see section 21 Audit).

6. Important Notes on Claiming CPD HoursPlease note that while PTPs are entitled to attend all seminars and complete any module on the MyCPD website, members need to ensure that events they attend or MyCPD modules they complete are relevant to the designa-tion(s) they hold.

Should LIA become aware of a member counting CPD hours for a presentation/seminar or MyCPD module which is not relevant to their designation, those hours will be removed from the member’s record which could lead to a shortfall in CPD requirements and ultimately the removal of the member’s designation/accreditation. 7. CPD Hours awarded to MCC and Advice-related Exams

i) If someone with an existing designation/CPD requirement sits any LIA exam (deemed relevant to the provi-sion of retail financial advice to consumers) during the year, the exam will earn them 8 hours CPD which will be offset against their overall requirement. These 8 hours will be offset against their overall total only and will not count against any product categories/competencies,

ii) If someone with an existing designation/CPD requirement sits any non-LIA exam during the year, the exam content will be assessed by the CPD Administrators and may be approved for CPD hours depending on wheth-er or not it is deemed relevant to providing retail financial advice to consumers. If approved for CPD the exam will earn the member up to 8 hours CPD which will be offset against their overall requirement.

8. Surplus HoursAny surplus accumulated in one year may NOT be carried into the following year(s).

9. CPD YearThe CPD year runs from 1st January – 31st December each year, i.e. hours must be completed in the calen-dar year. While the closing date for making an annual return each year is 31st January (see section 20 Annual Returns), CPD hours must be completed by 31st December. Hours completed in January count for that CPD year and cannot be counted for the previous CPD year e.g. hours completed in January 2020 will count for the 2020 CPD year and not 2019.

10. Minimum & Maximum Duration - CPD HoursAll CPD hours must be accredited by LIA as appropriate (see section 28 Accreditation of Events for CPD Hours).

The minimum unit of time recognised and accredited for CPD purposes is a half hour.

The maximum number of hours that will be accredited for any single event/activity/topic is 4 hours.

The maximum number of hours that will be accredited for any single tested online course/module is 2 hours.

The maximum number of hours that will be accredited for any single examination module is 8 hours (must be a minimum of 3 ECTS credits on a programme leading to a qualification at level 6 or above on the National Frame-work of Qualifications and CPD credit is awarded in the year the examination is passed).

Time spent actively involved in a CPD activity will count and can include question and answer time, case studies and tests/exams etc. Time spent travelling to an event, registration time, coffee/lunch breaks, social time etc. will not count.

11. Pro Rata Adjustment of CPD HoursIn certain circumstances (see (i) and (ii) below) a pro rata adjustment (reduction) in required CPD hours may be granted, provided the PTP is not undertaking certain specified functions in Ireland i.e. provided that the member is not working for the relevant period of time. In order to be granted an adjustment, a Pro Rata Adjustment Form (available in Appendix B) must be completed and returned to LIA. PTPs who have been granted a pro rata adjust-ment in hours for part of a year must still make an annual return of hours completed for the remainder of that year by 31st January (of the following year). LIA will not be held responsible for returns not received due to out of date or incorrect correspondence details held on our records.

I. Statutory Maternity/Parental/Carer’s Leave

There will be a pro rata adjustment in CPD requirements for those taking statutory maternity leave (current maximum 42 weeks i.e. 26 weeks paid and up to 16 weeks unpaid leave), statutory adoption leave (current maximum 40 weeks i.e. up to 24 weeks paid and up to 16 weeks unpaid leave), statutory block parental leave or statutory carer’s leave. The adjustment will be given for paid and unpaid statutory leave only i.e. does not include holidays, additional unpaid leave or career break.PTPs should contact LIA’s CPD Department in advance of taking such leave to apply for a temporary exemp-tion from CPD activity for the duration of the leave. A PTP member out of work on statutory leave for more than 12 months may be required to complete ‘catch- up’ hours on their return to work.

II. IllnessBrief periods of absence due to illness etc. will not entitle a PTP to any adjustment in CPD requirements.

However, those out of work due to long-term illness (two months or more) may apply for a pro rata reduction in requirements subject to medical certification of the illness. A PTP member out of work on long-term illness for more than 12 months may be required to complete ‘catch-up’ hours on their return to work.

III. Circumstances where a Pro Rata Adjustment of Hours will NOT Apply A pro rata adjustment of hours will not apply in the following circumstances:

a) Part-time work/job sharing

b) Holidays - including where taken immediately following maternity/parental/carer’s leave.

c) Retirement - where the member still wishes to retain the PTP designation.

d) Redundancy/Unemployment - where the member still wishes to retain the PTP designation for use at any point in the future.

e) Career Break - PTPs who choose to take a career break (or sabbatical leave) will not receive any adjust-ment in CPD requirements and will be required to participate fully in the CPD scheme.

12. Newly Qualified Members – Applying for your PTP DesignationNewly qualified PTP students (those student members with no existing LIA designation(s)) will be invited by LIA to apply for their LIA membership and PTP designation when ratified results are issued by the relevant Examination Board.

13. Newly Qualified Members - Commencement of CPDA member who qualifies from examinations will be required to commence CPD as soon as they’ve been awarded with their relevant designation(s). CPD requirements will be adjusted on a pro-rata basis for members as follows• Qualified following examination boards between January – July each year: 3 hours to be completed by the

31st December of that year.

• Qualified following examination boards between August – December each year: 0 hours to be completed by the 31st December of that year. Full annual requirement of 6 hours will apply the following year.

14. Late Applications for the PTP DesignationPersons who do not apply for their PTP designation within two years from the 1st January following qualification and who wish to apply at a later date will be required to successfully complete the DC Pension Scheme Trustee Practices module and examination once again, hence they will then be eligible to apply for the PTP designation again.

15. Commencement of CPD for late applicationsCPD starts to accumulate from the date the designation(s) is/are taken up for the first time and the same first-year requirement applies as for those applied immediately upon eligibility.

16. Awarding of Second or Subsequent Professional Designation Once a member has received their first designation, all subsequent designations will be automatically awarded to them by LIA. Such members will earn a new competency and will be required to meet the one-hour relevancy requirement in that competency from the following year.

17. LIA PTP members who also hold other LIA DesignationsPTPs who hold other LIA designations will not be required to make separate annual returns. However, they must ensure that they complete the annual PTP 6 hours CPD requirement as part of their overall annual 15 hours’ requirement - as outlined in Section 5 above, “Annual CPD Requirements”.

In many cases the CPD hours completed for the PTP designation may also count for other categories (please note that the reverse is not always the case). Individuals should check with LIA’s CPD administration staff in the event of any queries on qualifying hours.

18. Lay PTPs - not holding other LIA designationsLay PTPs who wish to retain their PTP designation for current or future use are required to comply with the annu-al CPD requirements and retain their annual LIA membership.

19. Keeping Records & Supporting DocumentationEach PTP member is responsible for keeping his/her own records in relation to CPD undertaken. LIA provides an online CPD Record for members to track and record their CPD hours. Members are encouraged to use this online tool to manage their CPD throughout the year and subsequently make their annual return at the end of each year.

PTPs are also required to keep supporting documentation as evidence of attendance at events or completion of a Non-LIA course e.g. attendance sheets, certificates of attendance, certificates of completion, computer printout/record of completion, written confirmation from employer etc.

It is essential to keep personal records and supporting documentation, as members will be required to present original versions should they be the subject of an audit (spot check) at any stage (see section 21 Audit).

Such records and documentation should be retained for a minimum of 6 years. 20. Annual ReturnsEvery PTP is obliged to make an annual return online by 31st January every year declaring:

• The number of CPD hours completed during the previous calendar year• That the hours completed conform to the requirements set by LIA (see section 25 LIA’s Criteria in Relation to

Awarding CPD Credit).• Anyone who has not made an Annual Return will be considered not to have complied with the CPD require-

ments and will be subject to the procedure outlined below under section 22 Failure to Comply.

21. AuditThe CPD administration staff will audit a random sample of members each year in order to verify that the infor-mation received is correct. Should a member be the subject of an audit, they will be required to present original versions of their own personal records and supporting documentation confirming attendance/completion for each CPD event they include in their return.

Details of the records will then be verified, as seen fit by the administrators (including, if deemed necessary, con-tacting any of the organisations/people listed in the records). Audits are predominantly random and so a member may be the subject of an audit on any number of occasions (successive or intermittent) and must comply by furnishing the administrators with appropriate records/proof of CPD completed during the previous calendar year.

22. Failure to ComplyA PTP who has had their designation removed due to failure to comply with the CPD regulations is advised to ap-ply to reinstate their designation as a matter of urgency. Such a person should state their case in writing to their Administrator. Requests to reinstate the PTP designation are considered on a case-by-case basis.

23. Reinstatement of the PTP DesignationIn order to reinstate the PTP designation LIA’s reinstatement rules apply, as follows:

(i) 4 years or less out of the scheme:• Completion of any shortfall* in CPD requirements (in addition to the requirements for the year of reinstate-ment), and

• Payment of backdated designation and / or membership fees, where relevant

OR

• Successfully complete the DC Pension Scheme Trustee Practices module. No reinstatement fee or backdat-ed designation and / or membership fees apply in this case.

*A person with a shortfall in CPD requirements may apply to be included in the CPD scheme as a ‘suspended’ member in order to complete the CPD shortfall but will not have the PTP designation reinstated at this time. Annual fees are payable while a suspended member of the scheme. A suspended member will only be restored once he or she is again in compliance with the CPD requirements (i.e. is reinstated as a full member of the CPD scheme and has the PTP designation reinstated). A person will be given credit for any relevant CPD completed in the period prior to reinstatement which has been verified by LIA. A shortfall warning will be applied on reinstatement i.e. if the member fails to complete the CPD requirements in any of the five years following the most recent failure to comply, their designation(s) will be removed.

(ii) 5 or more years out of the scheme:Completion of the DC Pension Scheme Trustee Practices module. No reinstatement fee or backdated designa-tion and / or membership fees apply in this case.

24. Suspended MembersSuspended members will have two years to complete their catch-up hours. The two- year deadline will be set from 1st January the following year and must be completed on or before 31st December of the year thereafter. For example, anyone who enters suspension in 2020 will have until 31st December 2021 to complete all catch-up hours (irrespective of when in 2020 they entered suspension).

Suspended members should advise in writing when they have completed the outstanding hours in order to be considered for reinstatement of their PTP designation.

25. LIA’s Criteria in Relation to Awarding CPD CreditLIA has adopted the following definition of CPD:

The content of CPD hours must be directly relevant to the subject matters covered in the Professional Certificate in DC Pension Scheme Trusteeship modules.

The key activities in the context of the PTP designation is “to empower these individuals to gain and demonstrate the necessary knowledge, competence and skills to manage their scheme in accordance with the scheme rules, general trust law, and relevant provisions of the Pensions Act and associated regulations”.

This view is reinforced by the overriding objective of the CPD requirement, which is to keep qualifications up to date and ensure that those who qualified in the past are as knowledgeable as those qualifying today.

LIA accredits all events for CPD hours in respect of the PTP designation. All courses/seminars/online training must meet the following LIA criteria in order to count towards formal CPD:

• The material or content must be directly relevant to the DC Pension Scheme Trustee Principles/Practices modules.• Course Presenters must have qualifications and/or knowledge and experience appropriate to the subject(s) being presented.• The presentation must be conducted in an appropriate location (i.e. proper conference/business/in-house facility).

• The presentation/course must be at least a half hour in duration.• If electronically delivered, the event/activity must meet the criteria described in section 26 Award of CPD Hours for Electronically Delivered Events and Activities below.

26. Award of CPD Hours for Electronically Delivered Events and ActivitiesIn considering whether or not to grant CPD hours to e-learning courses and other electronically delivered events and activities, the relevance of their content is evaluated in the same way as other activities and events. In order to assess the level of active involvement required of its participants, LIA also examines carefully the learning ap-proach and structure of electronically delivered events and activities. In this regard, to be awarded CPD hours:Each e-learning course or module must:

• Be generally well-designed (e.g. divided into individual lessons or units of reasonable length, require little or no scrolling within pages, be easy to read and navigate).

• Be highly interactive, requiring regular interaction between the course and the learner (through frequent exercises, questions, links to websites or feedback etc.).

• Incorporate a reasonable diversity of delivery approaches and/or media (e.g. appropriate combinations of text/slides, animation, pop-up pages, audio or video, attachments etc.).

• Ensure that the module is designed so that individuals cannot bypass the learning material and go straight to the test.

• Ensure that individuals spend a comparable amount of time completing a module as the accreditation award-ed for the module i.e. if a module is accredited for 2 hours, then the module should take an individual 2 hours to complete, inclusive of the test.

• Include computer-based testing to provide evidence that a learner has assimilated the knowledge and skills contained in the course (the question bank should contain a greater number of questions than the test in the event that a person fails the test to ensure that a predominantly different set of questions is presented in a resit test). Please see the following matrix as a guide:

A minimum pass rate of 65% or over is recommended.

• Be capable of providing appropriate confirmation that the learner has successfully completed the test.

• Include a minimum of a half hour and a maximum of two hours relevant learning (including tests).

Events delivered using Web Casting and Web/Tele-Conferencing and similar technologies must:• Be transmitted ‘live’ (to allow for interaction between learner and presenter). Presentations which are not viewed/attended ‘live’ will not be accredited for CPD hours. • Be generally well-designed and create a productive learning experience (e.g. participants at remote locations must be able to hear and/or see the presenters, while simultaneously viewing the presenters’ materials [e.g. slides or simulations]).

• Provide opportunities for all participants to put questions to and engage in discussions with presenters

(events where interaction is limited to submission of written questions are normally not awarded CPD hours).

• Provide a means for course organisers to verify those participating at each venue (to include verification that the participant attended for the full duration e.g. log-in and log-out confirmation).

• Include provision of electronic or hardcopy confirmation of attendance for the full duration to participants.

• Include a minimum of a half hour of relevant learning.

27. Definition of CPDSection 1.7.2 of the Minimum Competency Code defines CPD as follows:

“The content of the CPD hours must be directly relevant to the functions of the qualified person or grandfathered person and the CPD material for qualified persons or grandfathered persons must therefore be related to the competencies set out in Appendix 3 of this Code.”

All CPD hours for a product category must, therefore, be related to the competencies set out in Appendix 3 of the Minimum Competency Code for that product category. The requirement that the content of the CPD hours must be directly relevant to the functions (as defined in Section 1.2 of the Minimum Competency Code) of the qualified person in relation to a product category does not restrict CPD hours to only some of the competencies set out in Appendix 3 of the Minimum Competency Code for that product category, since all the competencies set out in Ap-pendix 3 of the Minimum Competency Code for a product category are directly relevant to the functions defined in Section 1.2 of the Minimum Competency Code in relation to that product category.

For holders of a specific APA designation, the Minimum Competency Code effectively requires that all CPD hours must be related to the competencies set out in Appendix 3 of the Minimum Competency Code for the category (or categories) of retail financial product in respect of which that APA designation is recognised.

28. Accreditation of Events for CPD HoursAll CPD hours must be accredited by the CPD Administration staff of LIA. Thus, event providers (companies/bodies)/members applying for CPD hours for events should complete the CPD Accreditation Request Form (see Appendix A) and return it to the Administrators.

In the case of companies organising relevant in-company events/training for their own staff, it is recommended that one contact person in each company submits to the relevant Administrator all requests for accreditation on behalf of their staff. Thus, members should check with their training department/intranet site for further informa-tion on their company accreditation procedures prior to submitting any application.

Members are required to attend for the full duration of an event in order to claim the CPD hours approved for that event. Where a member has not attended for the full duration he/she is required to submit a new application for reduced hours. Evidence of attendance is required in the event of a CPD audit e.g. sign in/out log.

Companies/bodies organising events for CPD purposes and applying for hours must submit a new application for reduced hours where members do not attend for the full duration.

It is the responsibility of event providers to clearly advise attendees (in advance of the event) the accreditation number(s) allocated to the event by LIA, as well as the number of CPD hours applicable and the categories of CPD the hours awarded relate to. This should also be announced/indicated to attendees at the beginning and end of the event.

Events run by LIA, as well as online MyCPD modules, will be accredited for CPD hours by category, given ac-creditation numbers and automatically recorded in the PTPs online CPD Record.

All CPD events, courses and training etc. are accredited for one CPD year only and must be re- accredited in each CPD year by application to the relevant CPD Administrator.

29. Examples of CPDSome general examples of organisations who regularly hold events that meet the definition of CPD are listed below. Anyone holding a CPD event is required to seek CPD accreditation from LIA (see Section 28 Accreditation of Events for CPD hours).

• Pensions Authority Annual Online Training• IAPF Seminars• APTI Seminars• IIPM Seminars• Pensions Authority Seminars• Pensioner Trustee Company Seminars• LIA online CPD modules (www.mycpd.ie)• LIA Regional Seminars

CPD needs to be widely spread to ensure that the holders of recognised qualifications maintain and enhance their knowledge across a range of topics. Members should ensure that they do not include events in their annual return that covers the identical material.

The content of CPD hours must be related to the competencies/knowledge requirements in respect of which the PTP designation is recognised.

30. CPD Annual Update DocumentLIA publishes an Annual Update of changes relevant to Financial Advice. Currently, full reading and assimila-tion of the contents of this document counts for up to four hours CPD annually. The manual is made available to download via LIA’s website usually in August of each year.

31. Excluded ActivitiesThe following are examples of activities not considered to be formal activities, in that they do not meet LIA’s crite-ria, and are therefore excluded from counting towards CPD:

• Study or exam preparation. CPD hours are awarded on successful completion of relevant examinations in the year the examination is passed.• Normal working activities.• General software/application training (e.g. Microsoft Excel, Access etc.).• Internet training.• Sales techniques training.• General communications training (e.g. reading and research).• DVDs, TV programmes.• Online training that is not tested.• ‘Soft-skills’/general training (such as programmes or courses on telephone techniques, customer care, time management, negotiation skills, leadership/supervisory skills, writing/communication skills etc.).• Product launches or other primarily social occasions (formal product training sessions may earn credit).• Motivational seminars.

32. CPD schemeLIA offers its members a comprehensive and cost effective CPD scheme to help them meet their annual CPD requirements. The content of CPD hours must be related to the knowledge requirements in respect of which the PTP designation is recognised. The programme includes:

The MyCPD portal offers all PTPs a programme of online courses covering a wide range of topics. There are currently up to 28 modules available online, each counting for 2 CPD hours. However, it is important that you choose modules relevant to your designation(s)/accreditation(s).There is no extra cost involved (included in annual LIA membership fee). As courses are updated on an an-nual basis, courses completed in previous CPD years can be re-taken to count for CPD hours in a new CPD year provided 6 months have passed since the course was last completed. Members can access the website using their membership number and password.

ii. LIA CPD SeminarsSeminars are organised by LIA in a number of regions throughout the year. Members are issued with their Seminars & Events booklet and booking forms each January. There are up to 85 hours of face- to-face CPD seminars across our eight regions each year. The Seminar & Events booklet specifies the CPD category rele-vant to each event

iii. Accreditation of In-company and Other Events for CPD HoursAs described earlier in section 28 Accreditation of Events for CPD Hours, LIA accredits relevant in- company training and other relevant events for CPD hours. Anyone wanting to have an event accredited for CPD should complete and return the CPD Accreditation Request Form (see Appendix A) to LIA.

iv. LIA CoursesMany of LIA’s courses are accredited for CPD hours, upon success in a module. Many external courses may also be accredited for CPD. The content of CPD hours must be relevant to the knowledge requirements in respect of which the PTP designation is recognised.

33. Costs

There is currently no additional cost to members for participation in the CPD scheme. However, members should note that individual events, seminars, meetings, special publications etc. do occasionally involve a charge pay-able by the member pays to the association/body running the event or publishing the material.

34. Change of Personal Details

Individuals are required to advise LIA of any changes to their mailing address, email address, contact phone number, company details etc.
