Amazon To Build In Tracy

Amazon.comhas announced that itwillbuildadistributioncenterinTracy.CityManagerRodButler andMayorLuisMolinasaidtheyknewtheonlineretailgiantwaslookingforathirdCal-ifornia site.Amazon recently openeda distribution center in the SouthernCaliforniacityofSanBernardino,anda1million-square-footcenterisunderconstructioninPatterson.

$5.4 Million Lakeport Housing Project Saved

TheLakeportCityCouncilhasvot-edtosupportaproposedaffordablesenior housing complex during aspecialmeetinglastweek.

“When redevelopment went away,I figuredwe’d lose thewhole proj-ect,” Mayor Stacey Mattina said.“Sowhen theywerestill interestedinfinishing it, I thought itwassuchanexcellentthingforus.”

Constructioncostsareestimatedatalmost$5.4million.LEEDPlatinumstatus is a requirement of federalfundingtheprojectreceived.

Cost Of MTC Building Work Goes Up To $218 Million

ThecostoftheMetropolitanTrans-portation Commission’s plan totransform the old tank factory andpostalfacilityat390MainSt.intoasuitableplaceforregionalagencies

tocohabithasincreased,accordingto Steve Heminger, the commis-sion’sexecutivedirector.

The estimated cost now stands at$218 million, which is $38 millionhigher than the original estimatefromJuly2011but$51millionmorethan themost recentestimate,ad-opted in November 2011. (Theprojectedcost fellafter theagencyboughtthebuildingatalowerprice.)

The massive 1942 building, whichthe MTC bought last year for $93million,willbeguttedandrehabbedto house the commission, theBayAreaAir QualityManagement Dis-trictand,mostlikely,theAssociationofBayAreaGovernments.

Last week, Heminger told the BayArea Headquarters Authority, agroup of commissioners oversee-ingthecreationofthenewregionalgovernment headquarters, that themainreasons for thecost increaseinclude:

•A$10millionincreaseintheesti-mateforseismicretrofitting.

•Theinclusioninthebudgetofthe$15 million cost of buying and in-stallingtechnology,fixturesandfur-nishings for the government agen-cies inhabiting the building. Thosecosts aren’t usually included inconstruction budgets, and weren’tpreviously,Hemingersaid.Buttheywereaddedinanefforttolookatthefullcostoftheproject.

•An$11millionincreaseinthecostof improvements for the five floorsof the building to be inhabited bygovernmentagencies.

Fresno Park Bids Rejected

TheFresnoCityCouncilhasrejectedallfourbidsforbuildingthe$7.2mil-lion park because they came in farhigher than expected, ranging from$8.3million to $9.25million. Itwasestimatedthatbidswouldbearound$6.4million.

CityofficialsnowwillworkwithBrous-sard and Associates Inc., which diddesign and engineering services, toseewhethersomeoftheproposalcanbeeliminatedorscaledbackenoughtogettheparkunderitsbudget.

The challenge for the city will bekeeping elements that make thepark “universally accessible.” Theparkproposalhasa“numberoffea-tures” that are expensive but arewhatmakeituniversallyaccessible.

More ExpansionPlanned For Apple

Apple is planting its flag in SantaClarainabigwayasthetechnologygiant continues its shopping spreefornewoffices,agreeingtooccupyasitewhereApplecouldlocate1,200ormoreworkers.

Cupertino-basedApplehasstruckadeal with developer PeeryArrillagafor a custom-tailored two-buildingcampus that is under constructionon thenorthsideofStevensCreekBoulevardinSantaClaraashortdis-tancefromtheCupertinocitylimits.

Appledeclinedtodiscussthedevel-opmentand leasingdeal.However,multiple sources with direct knowl-edge of the transaction told thisnewspaper that Apple has leasednearly 296,000 square feet fromPeeryArrillagainadealthatinclud-eddemolitionofexistingbuildings.

Thetwonewstructureswillbothbesix-story office buildings, said RuthShikada, Santa Clara’s economicdevelopmentofficer.

Housing Market Continues Strong Recovery

U.S. builders started constructionlastmonthon themosthomesandapartments since July 2008, moreevidence that the housing recov-ery is gainingmomentum. Housingstartsare87percentabovethean-nual rate of 478,000 inApril 2009,therecessionlow.

The Commerce Department saidlastweekthatbuildersbrokegroundon homes in October at a season-allyadjustedannualrateof894,000.That’sa3.6percentgainfromSep-tember.

Single-family home constructiondipped0.2percenttoanannualrateof 594,000, down from a four-yearhigh in the previous month. Apart-ment construction, which is morevolatilefrommonthtomonth,rose10percenttoanannualrateof285,000.

Applications for building permits, asign of future construction, fell 2.7percent to 866,000, after jumping12 percent inSeptember to a four-year high. Still, permit applicationstobuildsingle-familyhomesrosetotheirhighestlevelsinceJuly2008.

“The overwhelming trend here is ahousingmarketthathasclearlyshift-ed intorecoverymode,”RobertKa-vcic, an economist at BMOCapitalMarkets,saidinanotetoclients.

Builder confidence rose to its high-estlevelinsixandahalfyears,ac-cording toasurveyby theNationalAssociationofHomeBuilders/WellsFargo. Their index of builder senti-

mentroseto46thismonth,upfrom41 in October. It was the highestreadingsinceMay2006,justbeforethehousingbubbleburst.

Yuba City Work Now Bidding

Bids for theWesternParkwayproj-ect inYubaCityareexpectedtobeopenedinJanuaryafterCityCouncilapproval of plans for the $2millionproject toease trafficcongestionatthe George Washington Boulevardintersection.

Thework includesextendingWest-ern Parkway from Libby Lane toHighway20.Development innorth-western Yuba City between Town-ship andRoyoRanchero roads ini-tiatedtheproject.CouncilmembersinJune2011approvedtheenviron-mental review for the project aftertaking out a traffic barrier on RoyoRancheroRoad.

Development in West Sacramento

Site work has started on an apart-mentcomplexnearRaleyFieldthatwillfeature,amongotheramenities,aplacetowashyourdogandrepairyourbike.

TheWolffCompanyLLCofScotts-dale,Ariz., isbuildingTowerBridgeCommons in two phases, with thefirst part under construction in aparkinglotformerlyusedbytheSac-ramento River Cats baseball team.Soil compaction has started, andthebuildingwillstarttakingshapeinthree or fourmonths, DevelopmentDirectorDanNethercottsaid.

The first phase will consist of 270units.Ifbothphasesareconstructed,thecomplexwillconsistof378apart-mentsin12three-storybuildingsar-rayedoveraboutsevenacres.Tow-

$324 Million Highway 101 Work To Begin In December

Construction isslated tobeginnextmonthona long-awaitednewinter-change along a notorious stretchofHighway101near theRedBarnon the northern edges ofMontereyCounty,evenas thefirstmajorpartof a larger upgrade project for thecriticalentrywayisslatedtoopen.

It is consideredakeyelementofa$324millionefforttoimprovesafetyand traffic flow along the highwayfrom Salinas to the northern coun-ty line over the past several years,rangingfromthealreadycompletedAirport Boulevard upgrade to thePrunedaleImprovementProject.

SharonGavin,spokeswomanfortheTransportationAgencyforMontereyCounty,saidworkonthe$90.6mil-lion project aimed at consolidatingthree intersections into one inter-changewillbegininDecember,afterCaltrans awarded the project con-tractlastmonthtoGraniteConstruc-tion andMCMConstruction, a jointventurefromWatsonville.

The project includes building an

overpass just north of San JuanRoad while eliminating cross-trafficaccessatSanJuan,DunbartonandColeroadstoimprovesafetyandre-ducecongestionalongapartofthehighwayknownfordeadlyaccidentsandtrafficbackups.Itisexpectedtobefinishedbylate2015.

Construction Work At UC Merced Approved

The UC Board of Regents financecommittee has approved roughly$45million tohelpbuildnewclass-roomsandlabsfortheUniversityofCaliforniaatMerced’sever-expand-ingstudentpopulation.Theprojectsontheplanareapriority listfortheUCsystem, saidPeterKing, publicaffairs director for the UC system.“It’shigh in thepriority list,”hesaidoftheUCMercedbuilding.

Themoney,partof thecommittee’s2013-14budgetforsystemwidecap-ital improvements, were approved

during the UC Regents’ regularlyscheduledmeetingatUCSanFran-cisco’sMissionBaycampus.

The plan calls for a $788.5million thatwould allow 39 major capital projectsthroughout theUCsystemtomove for-ward,ifapprovedbythestateLegislature.Among those projects is UC Merced’sproposed$49millionclassroomandaca-demicofficebuilding.Itwouldincreaseon-campusclassroomspaceby50percent.

Construction for the approximately77,000squarefoot,four-storybuild-ingcouldbeginshortlyafterfundingisauthorizedandit’sexpectedtobecompletedin2015.

OngoingconstructionprojectsatUCMercedincludetheScienceandEn-gineeringBuilding2,expectedtobecompletedin2014;theStudentSer-vicesBuilding,expectedtobecom-pletedin2013,andthefourthphaseofon-campushousing,expected tobecompletedin2013.

Construction business owners undoubt-edly have restless nights over business risks associated with operations, not to mention other concerns. But what these individuals often overlook are the unin-sured or underinsured risks, such as pro-fessional and vicarious liabilities.

It’s important to evaluate your profes-sional exposure, the insurability of such exposure and any potential contractual problems of risk transfer or A&E contrac-tual limitation of liability. Additionally, you should weigh these elements against project profitability and the impact on a design loss resulting in a project delay or, worse yet, a rectification of the work.

Lawsuit Challenges Legality OfLease Leaseback Contracting By Fresno USD

Objections to taking the time to evaluate professional liability and protective mitigation strategies are plentiful: “It’s too costly,” “We do not have the exposure,” “We are contractually protected,” “Our A&E firm is responsible and insured,” and the list goes on. The fact, however, is that construction firms may be exposed to such risk in many ways. Examples include simple cases such as the tipping of a tower crane designed by the firm or something as extreme as the discovery of sinking bridge piers on a $400 million toll road project. If you are a mechanical contractor or if there are mechanical elements in one of your projects’ larger packages, claim possibili-ties are even more prevalent.

Changes in the insurance environment The professional protective insurance environment for contractors has changed vastly with the influx of new insurance capital and heightened competition in the insurance industry. Three years ago, only one insurance agency offered construc-tion firms this type of coverage. To date, nearly half a dozen insurers have entered the professional protective marketplace, expanding coverage options while creat-ing a competitive environment with af-fordable premiums.

protective environmental coverage. Such coverage extensions protect against liabili-ties related to design errors that result in environmental loss or claims. These types of liabilities are important, but they often remain uninsured against.

Additionally, your subcontractors will lack relevant coverage on occasion, and regardless of contractual indemnity pro-visions contained in your contract, you remain responsible to the project owner to complete the project on time. In these cases, protective environmental insur-ance can offer “first-party” coverage for mitigation of loss and rectification.

It is important to note that professional practice liability policies for designers are claims-made, and as long as the de-sign professional has maintained con-tinuous coverage, the policy covers all professional exposures from the design firm’s inception. Consider the design professional that has been in business

for decades and maintains $2 million of professional liability. That $2 million of professional liability extends to all of the design professional’s projects—current and historical. Construction business owners undoubt-edly have restless nights over business risks associated with operations, not to mention other concerns. But what these individuals often overlook are the unin-sured or underinsured risks, such as pro-fessional and vicarious liabilities.

It’s important to evaluate your profes-sional exposure, the insurability of such exposure and any potential contractual problems of risk transfer or A&E contrac-tual limitation of liability. Additionally, you should weigh these elements against project profitability and the impact on a design loss resulting in a project delay or, worse yet, a rectification of the work.

Objections to taking the time to evaluate professional liability and protective mit-igation strategies are plentiful: “It’s too costly,” “We do not have the exposure,” “We are contractually protected,” “Our A&E firm is responsible and insured,” and the list goes on. The fact, however, is that construction firms may be exposed to such risk in many ways. Examples include simple cases such as the tipping of a tower crane designed by the firm or something as extreme as the discovery of sinking bridge piers on a $400 million toll road project. If you are a mechani-cal contractor or if there are mechanical elements in one of your projects’ larger packages, claim possibilities are even more prevalent.

Changes in the insurance environment The professional protective insurance environment for contractors has changed vastly with the influx of new insurance capital and heightened competition in the insurance industry. Three years ago, only

one insurance agency offered construc-tion firms this type of coverage. To date, nearly half a dozen insurers have entered the professional protective marketplace, expanding coverage options while creat-ing a competitive environment with af-fordable premiums.

Most owners understand professional liability, but contractors professional li-ability is far more comprehensive, as it includes protective environmental cov-erage. Such coverage extensions protect against liabilities related to design er-rors that result in environmental loss or claims. These types of liabilities are im-portant, but they often remain uninsured against.

Additionally, your subcontractors will lack relevant coverage on occasion, and regardless of contractual indemnity pro-visions contained in your contract, you remain responsible to the project owner to complete the project on time. In these cases, protective environmental insur-ance can offer “first-party” coverage for mitigation of loss and rectification.

It is important to note that professional practice liability policies for designers are claims-made, and as long as the de-sign professional has maintained con-tinuous coverage, the policy covers all professional exposures from the design firm’s inception.
