7Plenaries, Breakouts, Forums & Workshops

Friday, February 13CLE Plenary Session: SCOTUS Future Selfie: How Recent and Upcoming Supreme Court Decisions Will Impact Corporate America and Corporate Litigation

8:15 am – 9:30 am

More and more, the Supreme Court is deciding critical issues of profound impact to businesses. This knowledgeable panel will analyze these issues and forecast how the business world will be affected by recent and upcoming Supreme Court rulings. This program is a must for all in-house and outside counsel who care about how businesses will navigate tomorrow’s legal problems.

Moderator: Eric Murphy / Program Chair: Don DavisSpeakers: Andrean Horton, Nash Long, Tracey Salmon-Smith

CLE Breakout Session:Effective Corporate Investigations: Discovering the Whole Truth

9:40 am – 10:40 am

It’s one thing to do a corporate investigation and another to do it right. These experienced investigators will show what outside and in-house counsel, governmental agencies, and others will need to do to conduct an effective investigation, including how best to navigate issues such as data collection and preservation, interviews, privilege preservation, corporate sentencing guidelines, governance practices, and pitfalls to be avoided.

Moderator: Lucinda A. LowSpeakers: Hon. Vernon Broderick, Yvette Ostolaza, Arnold Perez, Hon. Stanley Sporkin (Ret.)

CLE Breakout Session:Humanizing the Corporation Before the Jury: Ways to Level the Playing Field

9:40 am – 10:40 am

Face the reality—in courtrooms and the court of public opinion, the deck is typically stacked against corporations in disputes with non-corporate parties. These experts will teach specific strategies and techniques for overcoming ingrained bias against corporations and enabling jurors to see corporate parties as responsible, caring, honest, and even deserving of empathy.

Moderator: Diane P. SullivanSpeakers: Robert Alexander, Douglas Green, Paul Robinson

CLE Breakout Session:What to Do When You Think the Judge Hates Your Tactics, Your Style, Your Case, Your Client, and Every Word You've Ever Said

9:40 am – 10:40 am

Did you ever draw a hostile judge for whom you can do no right, one who inexplicably rules against you at every turn and sets your case on a path to sure defeat? Learn how to turn that judge around and give yourself a good chance to snatch victory from the jaws of defeat.

Moderator: Lance J. Ream / Program Chair: Arvin MaskinSpeakers: Louis Burke, Paige Montgomery, Hon. Lourdes Simon

CLE Plenary Session: Blurred Lines: When Zealousness and Nastiness Cross into Bad Ethics, Bad Business, and Bad Advocacy (Ethics)

10:50 am – 12:05 pm

There is a line between zealously representing your client and being mean and disrespectful to your peers and the court. This panel of federal and state jurists and outside counsel will explore how lawyers can enhance their reputations, their business prospects, and their litigation skills by dialing down offensiveness in dealings with opposing counsel, in depositions, in court papers, and in the courtroom.

Moderator: Amy M. StewartSpeakers: Charles "Chip" Babcock, Hon. Angel Kelley Brown, Hon. Eric V. Moyé, Hon. Analisa Torres

CLE Breakout Session: Are "Reasonably Certain" Damages Ever Certain?

1:45 pm – 2:45 pm

Special damages aside, proof of damages is either an art or an inexact science, and therefore can be particularly vulnerable under the “reasonable certainty” standard. To avoid having your case crumble under this vague standard, these lawyers and experts will show you how to develop not simply a defensible damages case but one that should withstand a blistering cross-examination or Daubert assault.

Moderator: Bernie WoolfleySpeakers: Ben Bradshaw, Sona De, Sumon Mazumdar, Caroline Reynolds

CLE Breakout Session: Ethical, Privilege, and Practical Issues in Cloud Computing, Privacy, and Corporate Data Protection (Ethics)

1:45 pm – 2:45 pm

Corporations and law firms are increasingly storing data in the cloud (remote third-party servers). If you or your client is dependent on the cloud, you should hear what these panelists have to say on the ethical, privilege, and privacy ramifications of such practices, including on the attorney-client privilege, the work-product doctrine, and the practical steps to protect confidentiality and maintain privacy.

Moderators: Francis J. BurkeSpeakers: Todd Champeau, Katherine M. Layman, Stephen Ramey, Prof. Veronica Root

CLE Breakout Session: Reexamining the Roles of In-House & Outside Counsel Before and During Trial

1:45 pm – 2:45 pm

If in-house counsel relies on outside counsel to carry all the water from complaint to trial, both are losing out on the powerful synergies of an effective in-house/outside counsel litigation team. This panel of experienced trial attorneys and in-house counsel will discuss best ways to share the litigation load, leverage the complimentary expertise of each, and achieve optimal litigation outcomes.

Moderator: Jennifer GraySpeakers: Elizabeth J. Asali, Michael B. Bernacchi, David A. Coulson, Rik Tozzi, Denise Zamore

FOR IN-HOUSE COUNSEL ONLY: Peer-to-Peer Open Forum DiscussionNon-CLE

If business development is a challenge, you can learn how to overcome those challenges and become a better and more effective lawyer at the same time.

Leader: Michael O'Horo

9:10 am – 10:10 am

Roll up your sleeves in this workshop to discuss how to address difficult issues at trial and make tough choices, evaluate risky alternatives with potential tactical and ethical implications (and complications), and deal with the unexpected, including considering how the bench or jury will react.

Moderator: Sandra B. Wick MulvanySpeakers: P. John Brady, Hon. Abbe Fletman, Beatrice O'Donnell, Heather Stern

CLE Workshop: Relationship Management: Litigation Budgets That Work

9:10 am – 10:40 am

Litigation budgets can strain attorney-client relationships because the project scope is often inherently unknowable, optimism produces budgets likely to be exceeded, and realism produces budgets likely to be shockingly high. This workshop will unlock the secrets of clarifying expectations, objectives, stakeholders, and risk factors at the outset so that you can develop a meaningful litigation budget, making for more effective case management and better relationships between in-house counsel, outside counsel, and company stakeholders.

Leaders: Susan Raridon Lambreth, Robert F. Ware

CLE Plenary Session:Innovative Solutions to Resolving Complex Business Disputes (Ethics)

10:50 am – 12:05 pm

Options for resolving business disputes proliferate, having moved from old standbys like arbitration and mediation to online dispute resolution, specialized business courts, and, in some jurisdictions, private, court-run ADR. This panel of judges, arbitrators, and litigators will address the efficacy and constitutionality of these different approaches, the adaptability of particular programs for different disputes, and best ways to maximize their effectiveness. Moderator: Merrick L. “Rick” GrossSpeakers: Hon. Beatrice Avgherino Butchko, Melanie Emmons Damian, Hon. Joseph Farina (Ret.), Tiffani Lee, Hon. John S. Olson
