has fallen into disrepair causing a temporary interruption of indispensable services at the

15.03.90 Temporary Use and Occupancy Permits
A. Temporary Use and Structure Permit Application
1. Unless specifically exempt below, any person, firm 9r corporation desiring to conduct a
temporary use or operate a temporary structure within the city shall first obtain a
temporary ug prr.it. Such perion, firm or corporation shall file a written application
with the planning Department on a form provided by the City, together with an
application fees is required by the City. For any event, not conducted by the owner of the
p?op"rtn where the timporary use or placement of a temporary structure is to occur' a
letter from the property owner granting permission to conduct the event shall be
provided. A permii is not required for temporary uses to be conducted on City property,
provided ,u.h ur" has been approved by the appropriate City official and provided the
temporary zse complies with all provisions of this ordinance.
2. The planning Department shall gtant temporary use permits for those uses and structures
listed below so long as it is deteinined tliat the proposed use, including the erection of
any temporary builiing or structure, including tents and placement of vehicles, complies
with the requirement, of thir section and ordinance. Unless expressly provided in this

i"iporaryuse shall comply with the bulk, setback, parking and public

accommodation requirements for such use applicable in the district which the temporary
use is located. Temporary zses shall be consistent with the permitted uses in the zoning
district in which they are located and comply with all local regulations including fire code
and building code regulations. The Planning Department, Building Department or Fire
Departmenimay impose other conditions, as part of the temporary use permit approval;
u, ir.."rrury to achieve the purposes of this ordinance and to protect the public health,
safety, comfort, convenienci and general welfare. No temporary use shall be permitted in
any district if it would have a significant negative impact on any adjacent property or on
the areas as a whole.
Temporary uses and smtctures not specifically listed herein shall require review and
approval by the Planning Department which shall identify the proposed use with a similar
or comparable activity as a use tisted in this section. If the applicant for a temporary use
is denied such permit because the Planning Department determines that there is no
similar or comparable use, then the applicant may request review and approval by theplanning Commission. The process for approval shall be the same as for a site plan
review and approval.
General Provisions
1. Only those temporary ases identified herein and in Article 3.0 and atemporary use as
determined by ihe Planning Department shall be allowed in the City. Temporary
structures,intluding tents, vendor carts and kiosks, portable buildings, trailers, over-the-
road trailers, freighicontainers, recreational vehicles and mobile homes or similar
vehicles, other th-an mobile food vendors operating as a Food Truck, used in conjunction
with the temporary zses listed herein are permitted as identified below, otherwise they
are prohibited.Every tempordry use shall comply with the following standards:

site threat to public health, iafety, comfort, convenience and to the general welfare.

restrictions and conditions as the Fire, Police and Building/Codes Departments may
require. If required by the City, the operator of the temporary use shall employ

expe.t"d to be generated by such use would have an undue detrimental impact on
surrounding streets and uses'
5. No temporary use shall be permitted on any site without adequate all-weather' dust-free,

operating for lesi than seven consecutive days. No temporary zse shall be authorized that
would silnificanUy reduce the minimum amount of parking spaces required for any use
or activity establiJhed as a pennanent uses located on the property in question. Adequate
drive aisles and hre lanes sirall be provided. The Planning Department shall determine the
total number of parking spaces that is reasonably required in connection with a proposed
temporary r* oithe b-asis of the particular use, its intensity and the availability of other
public or contracted parking faciliiies in the area necessary to accommodate the
temporary use-

No temporary zses shall be permitted if such use would conflict with another previously
authorized temporary use thatwould operate at the same time.
Signs shall be permitted only in accordance with Section L3.07. (Sign regulations).
Reserved.The operation of all temporary ases shall be subject to the noise ordinance (Chapter 10,
Articfi IV, Gallatin Code of Ordinances) and the performance standards of Article 13,
Section 13.02.All temporary uses and structures shall comply with all applicable local, county and state
environmental, solid waste disposal and sanitary waste disposal regulations. Any required
Health Department certificates shall be plainly displayed in public sight.
Temporary zses authorized within the public right-of-way, parks or other public property
shali first secure approval of the appropriate City representative. All such uses shall be
coordinated with the appropriate city, county and state officials.
Trash generated bV the teiporary use shall be collected from the site where permiffed
and removed daily.No temporary use permll is required for private events not open to the public.
Any required permits and a business license shall be obtained per Chapter 11, Article V,
Gallatin Code of Ordinances.

A temporary use, temporary certificate of completion and temporary occupancy permit shall be
issued for nb -or" than six(6) consecutive months and/or no more than six (6) months in any
given year unless otherwise restricted herein. In no instance shall a temporary use, temporary
lertificate of completion or temporary occupancy permit be issued for a longer time period than
the surety required to secwe completion of all site improvements and off-site improvements.
C. Temporary Use Permit, Temporary Certificate of Completion and Temporary Occupancy
Permit - Partially completed Sites and Partially completed Buildings
Temporary use permit,temporary certificate of completion and temporary occupancy
p.rrnit. rnay be'issued for a site or portion of a building or structure in process of erection
or alteration, provided that such temporary use permit shall not be effective for a time
period in excess of six (6) months, and provided further that such portion of the building,
structure, or premises is in conformity with the provisions of this ordinance'
D. Temporary Use permit -Temporary/Seasonal Uses and Transient and Pedeshian Vendors
The provisions ofthis section are necessary to govem the operation ofcertain seasonal
and other temporary zses. Application for atemporary use permit shall be made with the
Planning Department. The application shall:
e contain information as to the nature of the proposed use,
e the anticipated period of operation,
r the number and location of parking spaces,
r sanitary facilities or authorized access to sanitary facilities if operated at the same
location for more than three (3) continuous hours, and
o authorization from the property owner to use the property for a temporary uses
activity/use.

An adequate form of surety which meets the provisions of Section 15.03.080
shall be posted prior to issuance of a permit to assure clean-up and repair of any
public facilities impacted or damaged by the operation of the temporary use
permitted activity or by patrons associated with such activity. The amount ofsurety shall be determined by the ZoningAdministrator; however, the amount ofsurety shall be no less than five thousand dollars ($5,OOO;. A surety is not
required for a transient or pedestrian vendor or mobile vendors including food
trucks/food trailers except that the permit administrator may require a surety for
food truck rallies.
No temporary use permil issued, herein und€r, shall be for a time period in excess of that
stipulated below for the individual activity indicated.
Circuses, Carnivals and Haunted Houses: May be permitted in the following districts:
Commercial Districts - CG and CS
Industrial Districts - IR and IG
Such permit may be issued for a period not to exceed fifteen (15) days. The time ofop"ruiion need not be fifteen (15) consecutive days; howevero the site must be vacated
within thirty (30) days after initiating operation. Such use shall only be permitted on
lots where adequate off-street parking can be provided and/or contracted within 1200
feet of the site of the permitted temporary use'

2 Transient Vendors, Mobile/Pedestrian Vendors Sales other than a Mobile Food Vendor
as described in 3. below, Christmas Tree/Pumpkin/Plant/Fireworksilvlerchandise Sales
and Donation Boxes may be permitted as a temporary use with a temporary use permit
in any Agriculture Residential, commercial or industrial district with the following
limitations:a. A permit may be issued for a maximum time period of thirfy (30) consecutive days
per zone lot.b. i.lo -or. than three such sales shall be permitted on any one lot, parcel or tract in
one calendar Year,c. A permit is limited to commercially or industrially zoned lots and public property
when authorized in writing by the public entity and comply with chapter 11, Article
VII and/or Article VIII, Gallatin Code of Ordinances'
d. Food produce sales is permitted on any property where the produce is grown in

Mobile Food Vendors: Permits for a mobile food vendor and a food truck rally and

Temporary Use Permit fee is required in addition to the fees for a mobile food vendor
or mobile food vendor vehicle.
Assembly Meetings: Assembly meetings may be permitted in any district' Such
temporaiy use peirnit may be issued for no more than a fifteen (15) days in non-

Temporary Construction Offices: In any district, a temporary use permit may be issued

8 Temporary Borrow Pits: In any district , a temporary use permit may be issued for the
operation of a temporary borrow pit from which soil may be removed to other locations
to be utilized as fill material. Such permit may only be issued with an approved site
utilization and reclamation plan in conjunction with a Land Disturbance Permit issued
by the Engineering Division as the basis for such action A Land Disturbance Surety
shall be rfruired per Section 15.03.080. The period of operation shall be as specified in
the approved plan. Such permit shall not be valid for more than one (1) year, but may
be renlwed for six (6) month extensions for particular use granted. Such use/activity
shall cease immediately upon expiration of the temporary use permit. This shall not be
construed to allow for the excavation of rock or quarrying'

Structures for Temporary Uses: A temporary use permit may be issued by the Zoning
Administrator and Building Official for placement of a structure for temporary uses ota commercially zoned lot for a maximum of six (6) months in a calendar year. The
structure and site shall meet the following criteria as determined by the Zoning
Administrator and Building Official :
a. Structure shall have public water service.
b. Structure shall have public electrical service.
c. structure shall be served by sanitary sewef or septic system.
d. Structure shall be securely anchored to the site with supports and anchors screened
from public view'e. Reserved.f. Upon removal of the temporary structure, all evidence of the temporary
use/structure shall be totally rernoved from the premises from which the activity is
conducted.
Model Homes and Subdivision/Builder Information and Sales Offices: In any
residential or mixed use district, a temporary use/structure permit may be issued by the
ZoningAdministrator and Building Oinciat to allow the use of a dwelling unit or club
houseL a model home and/or Subdivision and/or building information and sales office
anJ associated parking. This permit may be modified to reflect moving the model
home or information and salei offrce to a new location in the same subdivision or
parcet. Said use shall be discontinued when all homes in the subdivision or parcel,
!*."pt the model, have been sold. All regulations pertaining to signs as contained in
article 13.07 shall apply. Any parking lots or other parking areas, other than driveways

WHEREAS, The Tennessee General Assembly passed Public Chapter 972, Acts of 2018
which became effective on May 17,2018 and codified under Title 13, Chapter 7, Sections 601-
60g, Tennessee Code Annotated, andestablished a process for regulating "short-term rental units;"
and
WHEREAS' the City of Gallatin desires to ensure that the use and enjoyment of residential
and commercial properties by residents is not adversely affected by activities occurring on adjacent
or nearby properties; and
WHEREAS, the City prohibits buildings or structures which are incompatible with the
character of development or the permitted uses within specific zoningdistricts; and
W1IEREAS, the City intends to protect the character and maintain the stability of
residential, business and commercial areas within the city and to promote the orderly and beneficial
development of such areas; and
WHEREAS, the desire for property owners to use certain properties for income generating
activities is important to the enjoyment and use of their properties; and
WHEREAS, the city's growth and market demands have created markets for using
commercial and residential properties for income producing purposes; and
WHEREAS, the city continues to apply regulations that limit congestion in publicstreets
and protect the public health, safety, cottu.nGn"e and general welfare by providing for off-street
parking of motor vehicles; and
WHEREAS, the use of property authorized under the act of the General Assembly often
times results in the disruption of tn" injoyment and serene use of certain properties and it is
necessary to impose certain restrictions on the use of properties in the city used for short-term
r"nta. to proteci the health, safety and welfare of residents and visitors; and

WHEREAS, the Gallatin Municipal Planning Commission, pursuant to Section 15'07.040
of the Gallatin ZoningOrdinance has reviewed and recommended approval in GMPC Resolution
No.2021-106; and
WHEREAS, notice and public hearing before the Gallatin City Council has or will occur
before final passage pursuant to Section i5.07.060 of the Gallatin Zoning Ordinance and Tenn.
Code Ann. $ 13-7-203; and
WHEREAS, the Mayor and Council deem it necessary to amend the zoning ordinance for
the purposes of promoting the health, safety, morals, and general welfare of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN'TENNESSEE as follows
The Gallatin City Council hereby concum with the recommendations of the Gallatin
Municipal planning Commission and hereby approves amending the Gallatin Zorung
Ordinance to estabiish standards for the use of o'short-term rental units," as described
in Exhibit'A;' and
Based upon the recommendation of approval by the Gallatin Municipal Planning
Commission and after public notice and public hearing in compliance with Section
15.07.060 of the Gallatin zoningordinance and Tennessee code Ann. $ l3-7-203,the..short-term rental unit" requirements are hereby established as described in ExhibitoA;'and
The Gallatin City Council does hereby approve, authorize and direct the revision of the
Gallatin Zoning Ordinance in accordance with Section 15.07.080 of the Gallatin
ZoningOrdinance, which shall, upon the effective date of this ordinance, be amended
to reflect the amended text; and
All ordinances or parts of ordinances in conflict with the provisions of this ordinance
are hereby repealed to the extent ofsuch conflict; and
If any provision of this ordinance or the application thereof to any person or
circumsiance is held invalid, the invalidity shall not affect other provisions or
uppti.utions of this ordinance which can be given without the invalid provision or
uiifi.ution, and to this end the provisions of this ordinance are declared severable'

A. Established Short Term Rental Units:
Any short-term rental unit established prior to the adoption of this Ordinance on October 19,
20j1 consistent with Tenn. Code Ann.$ 13-7-601-606 and continuously operated as such use
without the sale or transfer of the property and resumption of the use by other(s) prior to
adoption of this ordinance and not having said use revoked for actions, as described in Tenn.
Code Ann. S 13-7-604, shall be permitted to continue to operate on the property unless one or
more actions described in Tenn. Code Ann. $ 13-7-603 or $ 13-7-604 results in the suspension or
prohibition of the use and operation of such property for use as a short-term rental unit'
B. Regishy of Short-Term Rental Units Required
Effective upon adoption of this ordinance, any owner or operator of a short-term rental unit(s)
shall register with the City the location and address of such rental unit(s) regardless of whether
the uniipre-existed the adoption of the ordinance as required by Chapter 8, Article V, Gallatin
Code of Ordinances. Registering of a pre-existing short-term rental unit(s) is not a basis for
denying one the right to otherwise lawfully operate such use'
C. Short Term Rental Unit(s) Operation Requirements
For properties described under subsection A. above, any owner or operator of a short term rental
unit(s) shall:
(l) Apply for a permit with the city and pay a business tax to operate such a unit as a short-' '
term rental unit(s) and be required to renew the permit and pay the business tax yearly as
required by chapter 8, Article V, Gallatin code of ordinances.
(2) prior to beginning operation, each short-term rental unit(s) first shall be inspected by the
fire marshal and ie-inspected each year upon renewal of the city business tax.
(3) Upon sale of the property, the owner/operator shall notiff the city of the sale of such
property and opeiation as a short-term rental unit(s) shall terminate.
(4) A iur.iuk". oilocal contact person, designated by the op_erator and authorized to make
decisions pertaining to the use, shall be available twenty-four (24) hours per day, seven
(7) days per week for the purposes of:o physically..rporrdittg, as necessary, within one (1) hour of notification of an
emergency or complaintiegarding the condition, operation, or the disruptive conduct
of occupants of the short-term rental unit, and
e Taking remedial action necessary to resolve any complaints.
o A designated contact person may be the owner, the lessee, or the owner's agent.
(5) The owner or operator of a sliort-term rental unit(s) established after adoption of this
Ordinance on October 19,2021shallprovide the following improvements necessary to
support the use and restrict the use as follows:
a. permit no more than two residents or guests per bedroom, but shall not exceed
twelve (12) persons. gactr bedroom shall consist of a minimum of 140 square feet and

contain a separate but attached closet space. The occupancy restrictions shall be posted
in a conspicuous place within the short-term rental unit.
b. Provide hard-surfaced or dust free gravel parking spaces at ratios required by
Article 11, Table I l-1. No parking shall be permitted on unimproved surfaces.
c. Provide proof of liability insurance to the City for the property being utilized as a
short-term rental unit.d. Short term rentals shall require rental of the units for no less than twenty-four (24)
continuous hours.

ORDINANCE AMENDING GALLATIN MUNICIPAL CODE CHAPTER 5, BUILDINGSAND BUILDING REGULATIONS, ARTICLE VII, PROPERTY MAINTBNANCB
STANDARDS
WHEREAS, it is deemed in the public interest to amend the City of Gallatin Municipal
Code in order to protect the public health, safety and welfare of its citizens; and
WHEREAS, it is in the public interest that the City of Gallatin Municipal Code be
amended regarding the identification and remedy of property maintenance code violations; and
WHERBAS, it is appropriate for the City of Gallatin to create a Property Maintenance
Board of Appeals in order to protect the property rights of its citizens; and
WHEREAS, the City of Gallatin has adopted the International Property Maintenance
Code ("lPMC"),2018 edition, pursuant to ordinance No.O1809-45; and
WHEREAS, the IPMC requires a Property Maintenance Board of Appeals be established
to hear decisions of the property maintenance code official.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN,
TENNESSEE, that the Gallatin Municipal Code, Chapter 5, Buildings and Building
Regulations. Article VII, Property Maintenance Standards, is amended as fbllows:
Sec.5-187. Property Mainten:rnce Board of Appeals
(1) Established. There is herebr establishecl a Property Maintenance Board of Appeals,
rel'erred to irr this article as "the board." to hear and decide appeals of the findings of
the property rnaintenance code oflcial or any duly ar-rthorized representative, to
deternrine whether the Itttcnrational Property Maintenance Code has been incorrectly
ir-rterpreted. to deternrine rvhether the provisions of the International Property

Maintenance Code apply, or to determine whether the requirements of the
International Property Maintenance Code are adequately satisfied by other lneans.
(2) Authority. The authority of the board is derived from and set forth in the currently
adopted edition of the International Property Maintenance Code.
(3) Membership. The membership of the board shall consist of not less than three
members and two alternates appointed by the Mayor and confirmed by the City Council. The
property maintenance code official or any duly authorized representative shall be an ex-officio
member but shall not vote on any matter before the board.
(4) Qualifications. The qualifications shall be as stipulated in the currently adopted
edition of the Intelnational Property Maintenance Code.
(5) Term. The members of the board shall be appointed to three (3) year terms, except
that the initial board members shall serve terms of two, three and four years, so that the terms
sliall be staggered and overlapping.
BE IT FURTHER ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, that
this Ordinance shall take effect upon passage, the public welfare requiring such.

WHEREAS, THE CITY OF GALLATIN PLANNING COMMISSION hAS
recommended acceptance by the City of Gallatin of the public improvements, excludingsidewalks, in the development hereinafter named The Drive-In, Phase One and Two;
WHEREAS, THE CITY OF GALLATTN ENGINEERING DIVISION heTebY
certifies that the public drainage infrastructure, rights-of-way, and public easements
described above have been satisfactorily completed and have been installed in accordance
with the approved plans and specifications and that there has been full compliance with the
City of Gallatin Subdivision Regulations;
WHEREAS, THE CITY OF GALLATIN PUBLIC UTILITIES DEPARTMENThereby certifies that the public utility improvements in the development described hereafter
have been satisfactorily completed and have been installed in accordance with the approved
plans and specifications and that there has been full compliance with the City of Gallatin
Subdivision Regulations and City of Gallatin Municipal Code.
NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN,TENNESSEE, pursuant to Chapter 3, Section 3-105, et seq. of the Subdivision
Regulations of Gallatin, Tennessee, that the public drainage infrastructure, rights-of way,
public easements, and public utility improvements, described in The Drive-In, Phase One
and Two, Plat Book 22,Page(s) 33 , Recorded October 19,2004 in the Register's Office
for Sumner County, are hereby accepted by the City of Gallatin, Tennessee. Such
acceptance specifically excludes the acceptance of any sidewalks.

WHEREAS, the City of Gallatin Municipal Planning Commission approved GMPC
Resolution No. 2021-141 at its regular meeting on August 23,2021 recommending to the Gallatin
City Council to name andlor rename the roadway identified in Exhibit A as follows: to name a new
segment of roadway identified as Section A as West Albert Gallatin Avenue; to rename the street
identified as Section B, which is currently named North Water Avenue, to West Albert Gallatin
Avenue; and to rename the street identified as Section C, which is currently named Albert Gallatin
Avenue, to East Albert Gallatin Avenue, all of which is consistent with Chapter 15, Article II, Division2, Sections 15-51 and 15-54, Gallatin Municipal Code of Ordinances, and
WHEREAS, THE CITY COUNCIL OF THE CITY OF GALLATIN has reviewed the
application materials and supporting documentation submitted by the applicant, the analysis, findings
und .""o--endations presented by City Staff and in the Planning Commission Recommendation and
the evidence and testimony presented during the meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITYOF GALLATIN as follows.
Section l. Findings -The city of Gallarin city council in its deliberations makes
the following findings pursuant to Chapter 15, Article II, Division 2,
Sections l5-51 and l5-54, Gallatin Municipal Code of Ordinances:
The proposed street name change has been reviewed by the Gallatin Municipal
elanning Commission, the Planning Department and the Sumner County E911 office.
The Gailatin Municipal Planning Commission recommended approval of the naming
and renaming of the roadway identified in Exhibit A as follows: to name a new segment
of roadway identified as Section A as West Albert Gallatin Avenue;to rename the street
identified as Section B, which is curuently named North Water Avenue, to West Albert
Gallatin Avenue; and to rename the street identified as Section C, which is currently
named Albert Gallatin Avenue, to East Albert Gallatin Avenue.
2 The proposed street name change will not adversely affect area property owners or
cause confusion to the traveling public.
Section 2. Action -
The Gallatin City Council hereby gives approval to name a new segment of roadway
identified in Exhibit A as follows: to name a new segment of roadway identified as
Section A as West Albert Gallatin Avenue; to rename the street identified as Section

Section 2. Action - The Gallatin Municipal Planning Commission hereby
recommends approval to the Gallatin City Council to name a new
segment of roadway identified in Exhibit A as Section A as West
Albert Gallatin Avenue, rename the street name identified as Section B
which is currently named North Water Avenue to West Albert Gallatin
Avenue, and rename a street identified as Section C which is currently

SUBJECT:Naming of the roadway on the Albert Gallatin/Track Extension project
SUMMARY:On July 27,2021the City Engineer presented options to the City Council in regards to naming the
new section of roadway currently being constructed as part of the Albert Gallatin/Hatten Track
Extension Project and potentially renaming the current North Water Avenue and Albert Gallatin
Avenue. City Council chose to present to the Planning Commission the option that named Section Aas West Albert Gallatin Avenue, Section B as North Water Avenue, and Section C as East AlbertGallatin Avenue.
Discussion of this naming/renaming at the Augu st 23, 2021 Planning Commission resulted in the
Planning Commissioners recommending that the City Council approve Section A as West Albert
Gallatin Avenueo Section B as West Albert Gallatin Avenue, and Section C as East Albert Gallatin
Avenue.
With respect to both governing bodies, you will find two draft Resolutions outlining both
recomendations. We are asking City Council to decide which of these draft Resolutions the City willmove forward with.
