This has reference to your proposal forwarded by Member Secretary, Maharashtra Coastal Zone Management Authority (MCZMA)vide letter No: CRZ- 2011jCR-60jTC-2 dated 21.02.2013 seeking prior CRZ Clearance for the above project under the Coastal Regulation Zone (CRZ)Notification, 2011. The proposal has been appraised as per prescribed procedure in the light of provisions under the Coastal Regulation Zone Notification, 2011 on the basis of the mandatory documents enclosed with the application viz., the Questionnaire, recommendation of State Coastal Zone Management Authority and the additional clarifications furnished in response to the observations of the Expert Appraisal Committee constituted by the competent authority in its meetings held on 13 th - 14thMay, 2013 and 19 th - 21 st May, 2014. 2. It is inter-alia, noted that the proposal is for setting up new 12 inch diameter Natural Gas Transmission pipeline from Kalyan to Bhivandi, passing through Bhivandi creek parallel to the existing' bridge Durgadipul in Kalyan, Thane, Maharashtra. The length of the pipeline is 1 km in CRZ area. Approx. 400 IIi creek crossing by HDD method with pipeline diameter 08", 8.2 mm thick. The creek crossing shall be executed by HDD method without disturbing the creek bed. The pipeline shall be laid at a dept more than 2.5m from the water bed. The pipeline will pass through CRZ area (CRZ-I(II) and CRZ-III). The cost of the project is Rs. 2.0 Crore. 3. The Maharashtra Coastal Zone Management Authority (MCZMA) has recommended the project vide letter No. CRZ-2011jCR-60jTC-2 dated 21.02.2013. 2. It is inter-alia, noted that the proposal is for setting up new 12 inchdiameter Natural Gas Transmission pipeline from Kalyan to Bhivandi, passingthrough Bhivandi creek parallel to the existing' bridge Durgadipul in Kalyan,Thane, Maharashtra. The length of the pipeline is 1 km in CRZ area. Approx. 400IIi creek crossing by HDD method with pipeline diameter 08", 8.2 mm thick. Thecreek crossing shall be executed by HDD method without disturbing the creekbed. The pipeline shall be laid at a dept more than 2.5m from the water bed. Thepipeline will pass through CRZ area (CRZ-I(II) and CRZ-III). The cost of theproject is Rs. 2.0 Crore.

3. The Maharashtra Coastal Zone Management Authority (MCZMA) hasrecommended the project vide letter No. CRZ-2011jCR-60jTC-2 dated21.02.2013. As per the MCZMA,the proposed area falls within CRZ area (CRZ-

4. The Expert Appraisal Committee, after due consideration of the relevantdocuments submitted by the project proponent and additional clarificationsfurnished in response to its observations, have recommended for the grant ofCRZ Clearance for the project. Accordingly, the Ministry hereby accordsnecessary CRZ Clearance for the above project as per the provisions of CoastalRegulation Zone Notification, 2011, subject to strict compliance of the terms andconditions as follows:

A. SPECIFIC CONDITIONS:

(i) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air and Water Act and a copy shall be submittedto the Ministry before start of any work at the site.

(ii) The pipeline shall not be laid in mangrove area and there shall be nodestruction of mangroves as committed.

(iii) All the recommendation of Risk Assessment and DisasterManagement Plan shall be complied with.

(iv) The depth of Horizontal Directional Drilling (HDD)pipeline shall bedecided based on the geotechnical investigation.

(v) All the conditions/recommendations stipulated by MaharashtraCoastal Zone Management Authority (MCZMA)vide letter No. CRZ-2011/CR-60/TC-2 dated 21.02.2013, shall be complied with.

(vi) There shall be no disposal of solid and liquid wastes in to the Coastalareas.

(vii) There shall be no ground water drawal within CRZ area.

(viii) Necessary signages shall be installed in both English and locallanguages wherever the pipeline is passing.

B. GENERAL CONDITIONS:

(i) Adequate provision for infrastructure facilities including watersupply, fuel and sanitation must be ensured for constructionworkers during the construction phase of the project to avoid anydamage to the environment.

(ii) Appropriate measures must be taken while undertaking diggingactivities to avoid any likely degradation of water quality.

(iii) Adequate precautions shall be taken during transportation of theconstruction material/pipes so that it does not affect theenvironment adversely.

(iv) The project proponent will set up separate environmentalmanagement cell for effective implementation of the stipulatedenvironmental safeguards under the supervision of a SeniorExecutive.

(v) Full support shall be extended to the officers of this Ministry/RegionalOfficeat BhopalbY

of the project for monitoring purposes by furnishing full details andaction plan including action taken reports in respect of mitigationmeasures and other environmental protection activities.

Ministry of Environment, Forests & Climate Change or any othercompetent authority may stipulate any additional conditions ormodify the existing ones, if necessary in the interest of environmentand the same shall be complied with.

(vii) The Ministry reserves the right to revoke this clearance if any of theconditions stipulated are not complied with the satisfaction of theMinistry.

(viii) In the event of a change in project profile or change m theimplementation agency, a fresh reference shall be made to theMinistry of Environment, Forests & Climate Change.

(ix) The project proponents shall inform the Regional Office as well as theMinistry, the date of financial closure and final approval of theproject by the concerned authorities and the date of start of landdevelopment work.

(x) A copy of the clearance letterPanchayaty local NGO, if any,representation has been madeproposal.

(xi) State Pollution Control Board shall display a copy of the clearanceletter at the Regional Office,District Industries Center and Collector'sOffice/Tehsildar's office for 30 days.

These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act 1974, the Air (Prevention andControl of Pollution) Act 1981, the Environment (Protection) Act, 1986, the PublicLiability (Insurance) Act, 1991 and EIA Notification 2006, including theamendments and rules made thereafter.

6. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil Aviation Department,Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall beobtained, as applicable by project proponents from the respective competentauthorities.

7. The project proponent shall advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded CRZ Clearance and copies ofclearance letters are available with the State Pollution Control Board and may alsobe seen on the website of the Ministry of Environment, Forests & Climate Changeat http://www.envfor.nic.in. The advertisement should be made within 10 daysfrom the date of receipt of the Clearance letter and a copy of the same should beforwarded to the Regional Officeof this Ministry at Bhopal.

8. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to ~is project. *-

•9. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section 16of the National Green Tribunal Act, 2010.

10. Status of compliance to the various stipulated environmental conditionsand environmental safeguards will be uploaded by the project proponent in itswebsite.

11. The project proponent shall also submit six monthly reports on the status ofcompliance of the stipulated Clearance conditions including results of monitoreddata (both in hard copies as well as bye-mail) to the respective Regional OfficeofMoEF&CC,the respective Zonal Officeof CPCB and the SPCB.

12. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of conditions and shall also be sentto the respective Regional Offices ofMoEF&CCbye-mail.
