Your Holiday With David Urquhart (Travel) LimitedThese conditions set out the terms of the contract, which you (the person(s) named on theconfirmation of booking) enter into by booking a holiday with us, David Urquhart (Travel) Limited, theterms of which become effective on you paying your deposit and us issuing a confirmation ofbooking to you. The contract does not start until the confirmation of booking is posted or handed toyou.

PaymentThe balance of your account must be paid to us, at the address stated on the confirmation ofbooking, at least Four weeks prior to the scheduled date of the start of your holiday otherwise yourbooking will be cancelled and your deposit will not be refunded. Payment is normally required in fullshould the scheduled date of the start of your holiday be within Four weeks of the date your bookingis received by us. Once made, you may change certain aspects of your booking (for example thenames of the passengers travelling) or subject to availability of arrangements departure dates, pickup points, room types on payment of an administration fee of up to £20 per person to cover ouradministration costs.

Cheques, Debit Cards and Credit Cards are all acceptable forms of payment unless booked withinTen days of the scheduled date of the start of your holiday when we reserve the right to requirepayment by debit or credit card or some other form of cleared funds. A 2% credit card fee will beapplied to all balances paid by credit card. There are no credit card fees on deposits/initial payment.There are no fees charged for any payments made by debit card.

Cancellation/Changes by youIn the event of you having to cancel your booking you should contact us immediately to avoidincurring any unnecessary charges. Any verbal cancellation of your booking must be followed up inwriting within 24 hours. Unfortunately our bookings are arranged with service providers many weeksin advance of the date of travel and as a result we require to impose cancellation charges. Thesecancellation charges may be recovered through travel insurance, subject to the terms of theinsurance company policy and we would therefore encourage you to obtain cancellation cover. OurCancellation charges are as follows:-

We accept your booking in good faith and you agree that there are no reasons which have not beendisclosed to us in writing before booking (e.g. severe infirmity or incapability) which may make itunwise for you or your party to embark on the tour. The safety and well being of all passengers onthe coach is the responsibility of the coach driver whose directions providing they are reasonablemust be respected by you. We are responsible for the acts and omissions of our staff and suppliersof services with whom we contract. We are not able to accept responsibility for unexpected orunforeseen circumstances beyond our control where we have taken all due care to avoid them.

Changes by usWe may require to cancel your holiday in certain unusual, unforeseen circumstances beyond ourcontrol or in the event that the number of people booked on a tour does not reach our minimum(normally 25). In the event of cancellation you are entitled and we will offer you either (a) a substitutepackage of equivalent or superior quality, if space permits or (b) a substitute package of a lowerquality, if space permits together with the difference in price between the price of the holiday youhave purchased and that of the substitute or (c) to repay you as soon as possible all the monies youhave paid us. In the event of cancellation we will notify you at the earliest opportunity and give you areasonable time to enable you to take a decision on which option you wish to follow. The newarrangement will, where possible, be confirmed to you in writing. If a tour is cancelled where thenumber of people booked on a tour does not reach our minimum, you will be notified at least 14days prior to the date of departure.

We sometimes make changes to journeys and excursions in response to adverse weatherconditions, road repairs, road congestion and other local factors. In these circumstances the driverwill exercise his discretion reasonably having all due consideration to the relevant factors and as aresult there may be changes to the planned journey. In the event that the principal destination ofyour holiday is no longer available for reasons beyond our control, the consequences of which couldnot have been avoided even if all due care had been exercised, then we will attempt to makealternative arrangements at no extra cost and will refund any difference in the cost between theoriginal arrangements and the alternative arrangements supplied. Where we are unable to agree tomake appropriate alternative arrangements, with both parties acting reasonably, we will either returnyou to the original departure point or to another mutually agreed place. Advertised pick up pointsand timings are only indicative and are not finalised until shortly before departure. A change to eitherthe pickup point, pick up time or number of pick up points is not considered to be a significantalteration to the terms of the contract.

The price of your holiday is guaranteed and will not be subject to any variations, either upwards ordownwards except for those resulting from variations in (a) transportation costs, including the costof fuel; or (b) dues, taxes or fees chargeable for services; or (c) the exchange rates applied to aparticular package. We will not vary the price within 30 days before the date of departure. In theevent of the alterations in price being less than 2% then no variation will be made.

Should the price change be such that it amounts to a major alteration of the terms of the contract, orthere is any other significant change to the contract, then you will be entitled to the three optionsnoted in paragraph one of the “Changes by us” section (above) and, where appropriate, seekcompensation.

ComplaintsAll complaints we receive are thoroughly investigated and customers are kept informed at eachstage of the investigation. Sometimes investigations can take time as we await response from ourservice providers. In order to bring matters to the attention of the service providers at the earliestpossible opportunity you should raise any matter that relates directly to the Hotel or Holiday Centrewith a Senior Manager or Owner as it arises so that matters can be dealt with there and then. Anycomplaint associated with transport should be intimated to the driver as soon as possible to give himthe opportunity to correct any deficiency. Should the matter remain unresolved after a reasonabletime has been allowed for action, you should report the matter to us without delay and confirm thesame in writing as soon as possible thereafter. We would consider 28 days to be a reasonable timeto confirm the complaint to us and in the event of the complaint not being intimated in time, thismay impede the future investigation and could affect your entitlement to compensation.

BehaviourIf you or any member of your party is considered likely to cause offence, danger, damage or distressto others we reserve the right at all times to cancel or terminate your holiday completely. If thissituation arises our responsibility under the contract will cease and we will be under no obligation tocover expenses incurred nor shall we consider any claims for compensation or refunds.

Smoking and the consumption of alcohol are not permitted on our coaches.

CompensationWhere you are entitled to receive compensation from us in terms of this Agreement or in terms ofthe Package Travel, Package Holidays and Package Tour Regulations 1992 the minimum level ofcompensation payable by us shall be either £10 where the cancellation (or significant change to thecontract) is made 14 to 28 days prior to departure or £15 where the cancellation (or significantchange to the contract) is made within 0 to 13 days of departure. Where the cancellation (orsignificant change to the contract) occurs prior to 28 days before departure, compensation may bepayable where there is a provable loss. If following upon the date of departure we are unable toprovide a significant proportion of the contracted services the level of Compensation payable by usshall be a minimum of £15.

Compensation is not payable (a) in the event of us cancelling a tour in the event that the number ofpeople on the tour does not reach the required minimum or (b) for unusual and unforeseeablecircumstances outwith our control, the consequences of which could not have been avoided even ifall due care had been exercised by us.

General ConditionsWhile at the time of going to print the details contained in this brochure are correct to the best of ourknowledge, we will where possible inform you of any inaccuracies or changes to the brochuredetails at the time of booking.

On holidays wholly based in the United Kingdom, Isle of Man, Channel Islands and the Republic ofIreland passports are not required, however, a full British Passport is required for all continentalbreaks and UK holidays featuring excursions to the continent. If you are not a holder of a full BritishPassport you should request further advice before booking any holiday involving travel outwith theUnited Kingdom

As a package holiday provider we are bound by the Package Travel, Package Holidays and PackageTour Regulations 1992. Regulation 20 of these Regulations requires us to protect all customer pre-payments and therefore all monies received by us prior to the date of the holiday will be deposited ina Secure Trustee Account controlled by Independent Trustees who are professional people acceptingthe obligation for controlling this Account in our customers’ interest. For tours outwith the UnitedKingdom the Trustees will have funds available to cover repatriation of clients to the United Kingdomshould we cease to trade for any reason.

These terms and conditions shall be governed by the law of Scotland.

TicketsYour ticket giving exact time and place of departure will be sent to you approximately one week prior todeparture. At the same time you will receive your luggage labels. To help your holiday planning,proposed pick up times are indicated in this brochure but please ensure you check the finaldetails as stated on your ticket.

Seat allocationWhen you book you will be advised in which areas of the coach space is available (see diagram). Fromthis information, you will be able to select the area from which your seat(s) will be allocated. Your exactseat number will be advised by your driver as you join the coach.There is a supplement to confirm booking of the front seats, subject to availability.

LuggagePlease ensure that your luggage is sturdy and waterproof - suitable for the normal handling andconditions on a coach tour. Approximately one week before departure, we will send you your luggagelabel. Please ensure that it is completed and prominently displayed on your luggage.

Personal BelongingsPlease, please, double check you have all your personal belongings gathered together before youvacate the hotel and before you leave the coach as returning items to customers is, at best, bothdifficult and expensive and, at worst, sadly some items are ‘lost forever’.

Smoking / Alcohol on boardSmoking and the consumption of alcohol is not permitted on coaches. There will be regular comfortstops when those wishing to smoke can do so.

Meals en-routeWhilst we do not include meals en-route, when appropriate we will make stops where snacks/mealscan be purchased.

Return JourneyExact time of arrival home can vary owing to weather, traffic conditions etc. If you are arranging forsomeone to collect you on return, we suggest you ask the driver at the last comfort stop on the wayback, and telephone ahead.

HotelsThe hotel gradings used in this brochure are taken from the respective organisations’ handbookavailable at the time of going to print. For hotels on the Continent, we use local ratings, which can varyfrom country to country. Generally meals on the Continent will reflect local cuisine. Continentalbreakfast is usually a croissant or roll and coffee, whilst buffet breakfast includes a selection of meatsand cheeses. Dinner at hotels on the Continent may include a set menu or limited choice.

EntertainmentWhilst we encourage hotels to provide some entertainment, the type and amount of entertainment is atthe discretion of the management, will vary from hotel to hotel and may be dependent on numbersstaying at the hotel.

Satisfaction CardsWhen we send your tickets we include a satisfaction card which we hope you will complete and returnto us at the end of your holiday. There is no postage charge for the sender. Whilst all cards are carefullyscrutinised and help us a great deal in maintaining and improving standards we do not sendacknowledgement of receipt of your card.

What to do if you have a problemIf you have any problem on tour your driver will do his/her best to help. Within the hotel theproprietor/manager/senior staff will do their best to handle requests or resolve problems. But pleaseremember that if you do not tell the proprietor/manager about the problem there is little he/she can do.Equally, if any problem is not resolved and the first time you contact us is after the holiday is over, thenit is too late for us to take action. (This does not negate your right under our booking conditions.)

HOLIDAY INSURANCEWe have arranged a Travel Insurance Policy through Towergate Chapman Stevens that isunderwritten by Optimum Underwriting Limited as underwriting agents for Groupama InsuranceCompany Limited (Towergate Chapman Stevens, Optimum Underwriting Limited & GroupamaInsurance Company Limited are authorised and regulated by the Financial Conduct Authority)thus providing first class security.

NOTE: THIS TRAVEL INSURANCE COVER IS ONLY VALID FOR HOLIDAYS BOOKED WITH DAVIDURQUHART TRAVEL.DEMANDS AND NEEDS. This insurance policy will suit the Demands and Needs of an individual, or group (whereapplicable) who are not travelling against Medical Advice, are travelling in countries included within the policy terms andwho wish to insure themselves against unforeseen events detailed in the cover section below, subject to the terms,conditions and maximum specified claim limits.

IMPORTANT. We will not provide you with advice about the suitability of this product for your individual needs but will behappy to provide you with factual information.

The Policy is optional for UK Holidays, but for European Holidays it is a condition of booking that all guests have TravelInsurance when travelling overseas. Should you wish to take advantage of our Travel Insurance please include theappropriate premium when booking your holiday. Your David Urquhart Travel invoice is proof of insurance and full detailsof the Policy Wording will be sent to you with your confirmation of booking. Premiums quoted include Insurance PremiumTax at the prevailing rate.

SUMMARY OF BENEFITS

Please note this Policy is only available to persons resident in the United Kingdom and for persons visiting the UnitedKingdom. For the latter cover will apply for travel in, from and return to the United Kingdom only, and repatriationwill be to the United Kingdom. For further details or clarification of the above please refer to your policy.

• MEDICAL HEALTH REQUIREMENTS. It is a condition of the David Urquhart Travel Insurance that at the time of taking outthis policy and between that time and your departure date, you are not travelling against Medical Advice or for the purposeof receiving medical treatment.

• INSURANCE POLICY. This contains full details of the cover provided plus the conditions and exclusions which apply to it.You must read the Insurance Policy carefully.

• CONDITIONS, EXCLUSIONS AND WARRANTIES. There are conditions and exclusions which apply to individual sectionsand general conditions, exclusions and warranties which apply to the whole Policy.

• FRAUDULENT CLAIMS. The making of fraudulent claims is a criminal offence.• HEALTH. Refer to Medical Health Requirements as shown above.• PREGNANCY. The Policy will not cover any claim arising from Pregnancy for travel within four (4) weeks of the estimated

date of delivery.• PERSONAL PROPERTY. If you are planning on taking items valued in excess of £200 such as photographic equipment,

jewellery and other valuables with you, then you should make sure that you have adequate personal possessions cover undera Home Contents Insurance. Personal Property claims are paid based on the value of the goods at the time of loss and not on a‘New for Old basis’ or replacement cost basis. A deduction will therefore be made for wear and tear and depreciation.

• DATE CHANGE EXCLUSION. Certain sections of your policy (refer to General Exclusions item 17) contain exclusions forlosses arising from failure of equipment to correctly recognise the calendar date, such as the change to the year 2000.

• POLICY LIMITS. Most sections of the Policy have limits on the amount the Insurer will pay under that section. Somesections also have inner limits e.g. for one item, or for valuables in total.

• POLICY EXCESS. Claims under most sections of the Policy will be subject to an excess. Where there is an excess, you willbe responsible for paying the first part of the claim.
