SUBJECT: Guidelines on the Implementation of the Proiect to Establish Baraneav Health Stations in Public Schools under the Ilealth Facilities Enhancement Program RATIONALE The Department of Health (DOH) continues to pursue "Kalusugan Pangkalahatan" through the improvement of access to quality health services by all Filipinos, especially by the disadvantaged groups. In 2A15, it was noted that there were only 17,9A4 barangay health stations (BHS) for the 42,029 barangays all over the country. Only 42Yo of barangays are served by a BHS which is the first point of contact of the community with the government health care system. The Department of Education (DepEd), on the other hand, has established 38,688 public elementary schools all over the country-that is, 92o/o of all barangays have public schools. The location of public schools indicate which areas could be most feasible for the construction of BHS where there had never been one before. With this information, the collaboration between DOH and DepEd to establish BHS in public elementary schools began. After diligent coordination with the DepEd and the Department of Interior and Local Government (DILG), a project to build on the gains of the education and health sectors was sealed by way of a Memorandum of Agreement (MOA) among the DOH, DepEd and DILG, dated lanuary 26,2016 (see Attachment I). The Project aims to establish health clinics in public school grounds, initially using Health Facilities Enhancement Program G{FEP) FY20l5 allocation and with the DepEd and DILG providing the local human resources and maintenance and operations requirements. OBJECTIVE The Objective of this Department Order is to provide guidance on the implementation of the project to establish BHSs in strategically selected public schools through the I{FEP. DEFINITION OF TERMS 1. TSeKaP - Acronym for Tamang Serbisyo para sa Kalusugan ng Pamilya, TSeKaP consists of essential services aimed at prevention, early detection of diseases and provision of first line treatment for common ailments. contract price, time frame and other terms and conditions advantageous to theclient.

Punch List - a list of all items on a construction project that are unfinished orincomplete, have not been done at all, require replacement or repair or requireadditional work to achieve an acceptable level of workmanship. Such a list isoften established as a result of periodic inspection at the job site duringconstruction and may be included in field reports. A11 items in a punch list must be

corrected by the contractor in order to confirm with contract documents andtimetable.

4. Inspectorate Team - a team of architects, engineers and/or other technical staffoffrcially authorized and organizedby the DOH Regional Director for the purposeof conducting on-site monitoring and inspection of projects 1o in order to ensurethat the Contractor complies with the plans, scope of works, technical and otherrelated contract documents.

GENERAL GUIDELINES1. The DOH shall be the lead agency in implementing the establishment of

PhilHealth TSeKaP-accredited BHS in public schools.

2. The DOH shall support the construction of BHS in barangays with public schoolsbut without BHS or other nearby primary health facility or hospital. DOH will aimto establish an average of 3,000 new BHS per year, until an adequate number anddistribution of BHS is reached.

3. The DOH together with other agencies and beneficiaries of the Project shall bejointly responsible for the establishment, operationalrzation, maintenance,

monitoring of project implementation and submission of progress reports to theOffice of the Secretary of Health through the F{FEP Management Office.

SPECIFIC GUIDELINES

A. The Engagement Process1. The DOH shall provide the guidelines to implement and manage the project

according to the provisions of the tripartite MOA

2. It shall be the responsibility of the DOH Regional Directors and DOHRegional Engineers to coordinate with the representatives of the DepEd andContractor for the construction and furnishing of the BHS in public schools.

3. To enable the effrcient implementation and compliance by the contractor ofthe technical plans, programs of works and specifications as prescribed in thecontract for the above project, all DOH engineers, coordinators and other dulyauthorized representatives of the DOH shall coordinate with the DILGcounterparts to secure the necessary building permits, regularly monitor and

make reports on the progress of implementation in each of the BHS projectsite$.

4. The DOH Regional Directors shall create inspectorate teams per province inorder to make preliminary inspections and submit a punch-list to the contractor inpreparation for the certification of completion, acceptance and final turnover of the

B. Monitoringo Inspection and Reporting-The DOH Regional Offices shallregularly monitor and report the status of implementation of each project undertheir charge that are related to the TSeKaP-accredited BHS in Public Schools.

l. DOH engineers and other representatives shall coordinate with the DepEdofficials in order to agree on the final school sites for the construction of theBHS. The DOH regional office shall submit a copy of the list of final schoolsites, per province and municipalitylcrty to the I{FEP-MO, copy furnished theDepEd and DILG regional offices.

2. The assigned DOH regional HFEP engineers shall oversee the construction ofBHS in coordination with DepEd Division Engineers.

3. On-site visit or inspection by regional DOH engineers and other projectmonitors shall be done for each Project during the contract implementationespecially at the start of physical works and whenever issues arise.

4. If exceptional variation order, such as structural reinforcements, need to beprovided/constructed beyond the contract cost, there should be prior approvalby the DOH Regional Director, upon the recommendation of both the DOHand DepEd engineers.

5. The DOH Regional Director shall submit progress reports every third week ofeach month based on on-site monitoring and on the contractors' report on theinfrastructure projects, to the FIFEP-MO. The ftr'EP-MO shall review thissubmission and make a monthly report of the same to the DOH Secretary.

Completion of Projects1. Once construction of each Health Station is at its final stage based on the

scope of work per contract, the Inspectorate Team shall submit a punch-list, ifnecessary, to the contractor in preparation for the final turnover ofthe project.Said punch-list will contain, among others, the remaining works, workdeficiencies for necessary corrections, and the specific duratron/trme to fullycomplete the project considering the approved remaining contract time andscope of work. This, however, shall not preclude the procuring entity's claimfor liquidated damages.

2. The Certificate of Completion shall be issued by the DOH Regional Directorconcerned upon: 1) the request of the Contractor, 2) the recommendation ofthe Inspectorate Team, and 3) the submission of the Final Inspection Reportstating that the project has been found to be satisfactorily completed inaccordance with the Plans, Program of Works and Specifications of theContract.

The standard formats for the Certificate of Completion, Completion InspectionReport and the Final Completion Inspection Report shown in Annexes "A","8" and "C" respectively, shall be adopted.

Procedure for Issuance of Certificate of Completion--a. Upon receipt of notice from the contrac.tor that the project is completed,

the DOH Regional Director shall instruct its Inspectorate Team to conductan inspection of the project and to submit its Completion InspectionReport within five (5) days, indicating any constructiondefects/deficiencies detected and the corresponding measures that

taken by the contractor to correct them. If no defectsldeficiencies aredetected, the report is considered as the Final Completion InspectionReport.

b. Based on the Inspection Report, the DOH Regional Director shall issue tothe contractor a Notice of Defects/Deficiencies and Required CorrectiveRepair Works, with the instructions for the contractor to commence therepair works within seven (7) days and to complete the works within three(3) days.

c. Upon receipt of advice from the contractor that the defects anddeficiencies indicated in the said Notice have been corrected, the RegionalDirector shall instruct the Inspectorate Team to conduet an inspection ofthe project and to submit its Completion Inspection Report within seven(7) days. If the report shows that the defects/deficiencies have beensatisfactorily corrected, the report is considered as the Final CompletionInspection Report. Otherwise, the process is repeated until the noteddefects/defi ciencies have been satisfactorily corrected.

d. Upon the receipt of the Final Completion Inspection Report from theInspectorate Team, the DOH Regional Director shall issue the Certificateof Completion of the project, certifying that the Project has beensatisfactorily completed as of the date indicated in the Final InspectionReport.

D. Certificate of Acceptance1. The Certificate of Acceptance shall be issued by the DOH Regional Director

after the one-year liability period and after all defects, deficiencies or punchlist shall have been corrected or replaced by the Contractor to the satisfactionof the DOH Regional Office thru the same Inspectorate Team as mentionedabove and upon submission of the Warranty Certificate by the Contractor.

2. The standard formats for the Certificate of Acceptance (Annex D), theAcceptance Inspection Report (Annex E) and the Final Inspection Report(Annex F) shall be adopted.

3. Procedure for Issuance of Certificate of Acceptancea. Upon receipt of notice from the contractor that the project is ready for

inspection after the one-year Defects Liability Period from the issuance ofthe Certificate of Completion, the Regional Director shall instruct itsInspectorate Team to conduct an inspection of the project and to submit itsInspection Report within five (5) days, indicating any constructiondefects/deficiencies detected and the corresponding measures that must betaken by the contractor to correct them. If no defects/deficiencies aredetected, the report is considered as the Final Acceptance InspectionReport.

b. Based on the Inspection Report, the Regional Director shall issue to thecontractor a Notice of DefectslDeficiencies (Annex G) detailing therequired corrective repair works, with the instructions for the contractor to

commence the repair works within seven (7) days and to complete theworks within three (3) days.

c. Upon receipt of advice from the contractor that the defects/deficiencies inthe said Notice have been corrected, the Regional Director shall instructthe Inspectorate Team to conduct an inspection of the project and tosubmit its Acceptance Inspection Report within seven (7) days. If thereport shows that the defects/deficiencies have been satisfactorilycorrected, the report is considered as the Final Acceptance InspecfionReport. Otherwise, the process is repeated until the noteddefects/defi ci enci e s have been sati sfactorily corrected.

d. Upon the receipt of the Final Acceptance Report, the Regional Directorshall recommend issuance of the Certiftcate of Acceptance.

e. If no defects/deficiencies are noted by the Inspectorate Team upon the firstinspection prior to the issuance of the Certificate of Acceptance, the Teamshall duly note this in the Final Acceptance Inspection Report withappropriate commendation of the contractor.

Progress PaymentAfter completion of minimum two hundred (200) units of the Health Station(HS), the contractor may submit a request for progress billing. The progressbilling should show the amounts which the contractor considers itself to beentitled, to cover (a) the cumulative value of the works it executed, based on theitems in the Bill of Quantities, and (b) adjustments made for approved variationorders executed.

The contractor shall submit for the technical review and recommendation ofDOH Regional Offrces the following documents required for each completed HS:

a.) Letter request by the contractor for paymentb.) Statement of Work Accomplishedc.) Inspection Report by the Agency's Authorized Engineerd.) Result of test analysis (if applicable)e.) Notarized Certification that the concreting of flooring is in accordance to

contract specifications/ scope of workf.) Statement of Time Elapsedg.) Contractor's affrdavit on payment of laborers andmaterialsh.) Pictures (before, during and after construction of items of works)i.) Certrfrcate of Completionj.) As-built plansk.) Warranty Securityl.) Photocopy of vouchers of all previous payments

Ftr'EP-MO shall prepare the Obligation Request required for the progresspayment, while the DOH Finance Service will evaluate the completeness of thedocuments required for payment and certify the amount to be paid to thecontractor as progress payment and prepare the following documents :

a. Disbursement Voucher (2 copies)b. BIR Disbursement Voucher (2 copies)

c. Letter to Land Bank for release of certified amount as progress billing tobe signed by the Authorized Signatory

The DOH Finance Service shall deduct the following from the certified grossamounts to be paid to the contractor as progress payment:

a) Cumulative value of the work previously certified and paid forb) Portion of the advance payment to be recouped for the month.c) Retention money in accordance with the condition of contract.d) Amount to cover third party liabilities.e) Amount to cover uncorrected discovered defects in the works.

Progress payments are subject to retention of ten percent (10%) referred to as the"retention money. " Such retention shall be based on the total amount due to thecontractor prior to any deduction and shall be retained from every progresspayment until fifty percent (5A%) of the value of works, as determined by theprocuring entity, are completed. Il after fifty percent (50%) completion, the workis satisfactorily done and on schedule, no additional retention shall be made;otherwise, the ten percent (L0%) retention shall be imposed.

The total "retention money" shall be due for release upon final acceptance of theworks. The contractor may, however, request the substitution of the retentionmoney for each progress billing with irrevocable standby letters of credit of froma commercial bank, bank guarantees or surety bonds callable on demand, ofamounts equivalent to the retention money substituted fori and acceptable toGovernment, provided that the project is on schedule and is satisfactorilyundertaken. Otherwise, the ten percent (10%) retention shall be made. Saidirrevocable standby letters of credit, bank guarantees andlor surety bonds, to beposted in favor of the Government shall be valid for a duration to be determinedby the concerned implementing office/agency or procuring entity and will answerfor the purpose for which the ten percent (10%) retention is intended, i.e., tocover uncorrected discovered defects and third party liabilities.

F. ROLES AND RESPONSIBILITIES1. The Department of Health is the lead agency for the Project.

a. DOH shall provide the funds for the procurement and payment of theschool-based clinics using the Health Facilities Enhancement Programline item under GAA;

b. The DOH Central Offrce Bids and Awards Committee shall undertake theprocurement of the necessary civil works regarding the Project;

c. The Health Facility Development Bureau shall provide the necessarytechnical assistance for the design, planning, irnplementation andmonitoring of the Project;.

d. DOH Regional Offrces shall create the mechanisms for effective projectmanagement and implementation at the regional level and providefeedback and reports to the Office of the Secretary through the F{FEPManagement Office;

e. The HFEP Management Office under the Office of the Secretary shallprovide guidance, oversight and coordinating functions between andamong the DOH offices and agencies concerned.

The Department of Education is the host agency for the Project.

a. The DepEd shall participate in the planning, coordination,implementation and monitoring of the construction and establishment ofthe school-based health stations or clinics;

b. The DepEd shall provide access to school grounds and ensure lot in thebest suitable location for the construction of the health stations or clinics.

c. The DepEd shall provide necessary support to ensure the participation ofconcerned DepEd departments in meetings and trainings in order toimplement the Project;

d. The DepEd shall participate in the feedback, monitoring, evaluation andreporting with regard the Project.

The Department of fnterior and Local Government is the coordinating agencythat will provide sustained support to the Project.

a. The DILG shall inform and coordinate with local qovernment units(LGUs) with regard the Project;

b. The DILG shall encourage and enable LGUs to ensure the availability ofbasic utilities for the school health station or clinic,

c. The DILG shall provide necessary support to ensure the participation ofits concerned departments, offices or units in meetings and trainings inorder to implement the Project,

d. The DILG shall facilitate inter-agency complementation between theDOH and DepEd and between the national agencies and the localgovernment officials.

G. EFFECTIVITY

This Order shall take effect immediatelv.
