Not uncommon people complain that prisoners have more rights that ordinary citizens but reality isfar from it. What really is happening that prisoners are more aware of their rights where ordinarycitizens generally haven’t got a clue of their rights..Many a citizen takes the view that Australia is the land of criminals, but again it is just thatcriminals generally know how to use the law to their advantage and to the citizens disadvantagewhereas ordinary citizens are not particularly interested to pursue as to know their rights..Just don’t yet hold that it only relates to ordinary citizens. I will give you an example:Most people will know that there is such a thing as client-solicitor confidentiality and so a lawyer or a client cannot be compelled to disclose confidential details.What most people are not aware of is that if the client-solicitor communication involved unlawfulconduct or matters associated with unlawful conduct then the client-solicitor confidentiality may notapply at all. After all we cannot have a lawyer planning a murder with his client and then claim
client-solicitor confidentiality!.More over, many lawyers and indeed law firm are not aware that they actually have given up their client-solicitor confidentiality.When I decided a certain Internet provider I was directed to check out their terms and conditionstated on their website in the meantime. I did so and discovered that this Internet provider on itswebsite stated that the customer agrees that the Internet provider could within certain legislative
provisions disclose to relevant Authorities information/details of all Internet communication of theclient. Moment, what is that disclosure to authorities? Now fancy not just lawyers but large lawfirm signing up on this without bothering to read the terms and conditions and so having given upeffectively client-solicitor confidentiality because any correspondence forwarded by email can be
passed on to the authorities, being it police or otherwise. Now, that just shows that not just ordinarycitizens but even large law firms are not even bothering to check what is legally applicable even sothey should..But lets even go further.As I am a person always liking to check the “fine print” I decided to check the legislation theInternet provider referred to that gave them the power to hand over such information to Authorities.OK, I discovered that no such legislation existed but still all those lawyers and law firms and not toforget the politicians who are using this Internet provider are happily authoring this when using thisInternet provider!.I did complain to this Internet provider and the response I received what that it is to upgrade itswebsite and remove the incorrect details.Well, they still continued to sign up new clients under the deceptive terms of the terms andconditions..Rest assure I withdrew my application and decided to go to another Internet provider but still ask yourself when you next time have communication with a politician/ lawyer or other personregarding very confidential details is this communication authorised to be given over to authoritiesor not? Unlikely will you ask your lawyer if his law firm is with an Internet provider who will handover confidential details to Authorities! So to say you are a gonner.
