New York City: June 2016 New York City passed the first legislation in the U.S. to ensure free menstrual products in the restrooms of all public schools, shelters and jails. School initiative has resulted in a reduction in absenteeism.

New York State: April 2018Schools in New York State are required to provide free menstrual products in restrooms for girls in grades 6 through 12.

State of Illinois: August 2017 The Learn with Dignity Act was passed - Public Act 100-0163. Starting January 1, 2018, Illinois school districts and charter schools will be required to provide feminine hygiene products (tampons and sanitary napkins) in bathrooms of school buildings for free.

California: October 2017 Assembly Bill 10 was signed, requiring public schools having classes from grades 6-12 where at least 40% of the students meet the federal poverty threshold to stock half of the school’s restrooms with free feminine hygiene products.

AN ACT concerning education, which may be referred to as

the Learn with Dignity Act.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF ILLINOIS,

REPRESENTED IN THE GENERAL ASSEMBLY:

Section 5. The School Code is amended by adding Sections

10-20.60 and 34-18.53 and by changing Section 27A-5 as follows:

(105 ILCS 5/10-20.60 new)

Sec. 10-20.60. Availability of feminine hygiene products.

(a) The General Assembly finds the following:

(1) Feminine hygiene products are a health care

necessity and not an item that can be foregone or

substituted easily.

(2) Access to feminine hygiene products is a serious

and ongoing need in this State.

(3) When students do not have access to affordable

feminine hygiene products, they may miss multiple days of

school every month.

(4) When students have access to quality feminine

hygiene products, they are able to continue with their

daily lives with minimal interruption.

(b) In this Section:

“Feminine hygiene products” means tampons and sanitary

napkins for use in connection with the menstrual cycle.tudents in grades 6

through 12.

Assembly Bill No. 10CHAPTER 687An act to add Section 35292.6 to the Education Code, relating to

feminine hygiene products.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 35292.6 is added to the Education Code, to read:

35292.6. (a) A public school maintaining any combination of classes from

grade 6 to grade 12, inclusive, that meets the 40-percent pupil poverty

threshold required to operate a schoolwide program pursuant to Section

6314(a)(1)(A) of Title 20 of the United States Code shall stock at least 50

percent of the school’s restrooms with feminine hygiene products at all times.

(b) A public school described in subdivision (a) shall not charge for any

menstrual products provided to pupils, including, but not limited to, feminine

hygiene products.(c) For purposes of this section, “feminine hygiene products” means tampons

and sanitary napkins for use in connection with the menstrual cycle.

SEC. 2. If the Commission on State Mandates determines that this act

contains costs mandated by the state, reimbursement to local agencies

and school districts for those costs shall be made pursuant to Part 7

(commencing with Section 17500) of Division 4 of Title 2 of the

Government Code.

How the Audit Can HelpSurvey results can offer savings in a number of ways. Buying the right number of right sized dispensers is just the beginning. Higher quality, longer lasting ADA-compliant dispensers and easier to service disposal bins will make happy the building services and janitorial teams who will be interfacing with the equipment long after the initial installation.

In short, solutions born out of a formal facility audit can improve compliance and help identify the proper equipment that will provide the best long-term value for a school system.

Choose the correct fitting liner bag to follow OSHA expectations.OSHA does not generally consider discarded feminine hygiene products, used to absorb menstrual flow, to fall within the definition of regulated waste.

However..OSHA expects these products to be discarded into waste containers which are lined in such a way as to prevent contact with the contents. Please note, however, that it is the employer’s responsibility to determine which job classifications or specific tasks and procedures involve occupational exposure.

We see menstrual care solutions to be as necessary as soap, toilet paper, and paper towels. We champion universal access because, let’s face it, this isn’t a topic people talk easily about.
