Background
Americans with Disabilities Act (ADA) Legislation ADA was signed into law Jan. 26, 1990, and became effective Jan. 26, 1992. ADA makes
discriminating against people with disabilities unlawful.
ADA comprises several sections of the United States Code compiled into five subject areas
referred to as titles:
• Employment (Title I).
• Public services (Title II).
• Public accommodations and services operated by private entities (Title Ill).
• Telecommunications (Title IV).
• Miscellaneous (Title V).
Title II has the broadest impact on the Kansas Department of Transportation (Kansas DOT),
as it specifically covers programs, services, or activities relating to areas of public
transportation and updating existing infrastructure. Title II requires the Kansas DOT to
develop a transition plan to bring facilities into compliance with ADA. This document
presents the transition plan the Kansas DOT has developed for pedestrian facilities within
the right of way. It does not discuss ADA compliance for buildings.
Title II of ADA
Title II places emphasis on the accessibility of infrastructure within the public right of way.
In order to achieve accessibility and consistency, public agencies are required to modify
their policies, practices, and procedures to avoid discrimination without altering the
fundamental nature of services, programs, or activities. Facilities required to be ADA
compliant include:
• Sidewalks,
• Crosswalks,
• Bus stops,
• Pedestrian signals,
• Trails and shared use paths
• Railroad crossings
• Pedestrian ramps, and
• Any other feature related to the safe movement of pedestrians.
Defining ADA Compliance

Features will be considered ADA compliant when they meet the criteria outlined in the
documents listed below.
• "U.S. Department of Justice's ADA Standards for Accessible Design" (2010).
• "Revised Draft Guidelines for Accessible Public Rights-of-Way'' (2005).
Agencies Affected
All state and local governments with more than 50 public employees are required to
prepare a self-evaluation of all roadways and pedestrian facilities within their jurisdiction
and develop a transition plan for all noncompliant facilities.
Because the number of city employees can fluctuate from year to year, the Kansas DOT
conducted a survey to determine the average population associated with 50 city
employees.
The survey determined, as a general rule, cities with more than 5,000 people had more than
50 city employees and should have their own transition plans.
Many of the pedestrian features located on Kansas DOT right of way are owned and
maintained by local governments. To avoid conflicts that may arise with local governments'
transition plans, the Kansas DOT has elected to defer to local governments' transition plans
in areas of joint jurisdiction rather than producing duplicate plans for those areas. The
Kansas DOT's transition plan will focus on areas without joint jurisdiction and cities with
populations of fewer than 5,000 people.
ADA Transition Plan
The purpose of the transition plan is to identify the steps the Kansas DOT will take to achieve
ADA compliance for pedestrian facilities. These steps are:
1. Identify physical obstacles limiting the accessibility of programs or activities to
individuals with disabilities.
2. Describe in detail the methods that will be used to make facilities accessible

3. Develop a Schedule for achieving compliance.

4. Identify the Kansas DOT's ADA coordinator who will be responsible for ADA
compliance.
5. Develop a grievance procedure to review complaints.
The first 4 steps are the minimum requirements for a transition plan as set forth by 28 CFR
35.150
The remaining steps are additional requirements for achieving ADA compliance as set forth by
Title II.
In addition to the above steps, the Kansas DOT will track and report on their progress
To ensure ongoing compliance with ADA requirements, the Kansas DOT will perform periodic
reviews of the plan and update as necessary.

ADA Coordinator
While Catherine Patrick, State Transportation Engineer is responsible for the implementation of
Kansas DOT’s Transition Plan, the ADA Coordinator is overseer of the project.

This person will coordinate and monitor progress; however, many throughout the Kansas DOT
will contribute to the overall ADA compliance process.

Review
The Kansas DOT is required to adopt and publish procedures for
resolving complaints arising under ADA’s Title II. The
procedures are intended to set up a system for resolving
complaints of disability discrimination in a prompt and fair
manner. The next section provides the process and the form used
to review complaints.

This Grievance Procedure is established to meet the requirements of the Americans with
Disabilities Act of 1990 ("ADA"). It may be used by anyone who wishes to file a complaint
alleging discrimination on the basis of disability in the provision of services, activities,
programs, or benefits by the Kansas Department of Transportation (KDOT).
The complaint should be in writing and contain information about the alleged discrimination
such as the name, address, and phone number of complainant and location, date, and
description of the problem. Alternative means of filing complaints will be made available for
persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his/her designee no later than 60
calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, Traci Ward, “ADA Coordinator”
or designee will meet with the complainant to discuss the complaint and the possible
resolutions. Within 15 calendar days of the meeting, ADA Coordinator or her designee will
respond in writing, and where appropriate, in a format accessible to the complainant.
The response will explain the position of the Kansas Department of Transportation and
offer options for resolution of the complaint.
All complaints received by the ADA Coordinator will be retained by the KDOT for at least
three years.

Grievance/Comment Form Public Accommodations
This form shall be used by anyone wishing to file a complaint alleging discrimination
on the basis of disability in the provision of services, activities, programs or benefits
by the Kansas Department of Transportation (KDOT). This form should be

2017 ADA Plan
KDOT evaluates these conditions and the need for sidewalk facilities at the time of
major rehabilitation (typically a re-deck) or replacement. Coordination between
KDOT Project Managers (Road Design and Area Engineer) as well as any
applicable local entities is done during the preliminary design phase of these
projects. If it is deemed that a sidewalk is needed at a particular location, the
facility will be designed to meet current ADA, as well as other requirements.
Finally, this is primarily a road design issue. Road design dictates the geometry
(based on ADA and other requirements) of sidewalk facilities and passes that
information to bridge to be incorporated into our design.

Building Inventory
2017 ADA Plan
The inventory of occupied buildings is on the following pages. Below is a
description of the columns.
Are public services available at this location? : A “Y” in the column indicates that
public services are provided in this building. Many of our buildings are work
crew buildings where employees report to work and then deploy out to the field, or
shop facilities where equipment is repaired. KDOT does not offer any public
services at these locations and are noted as an ‘N’ in this column.
Is building ADA compliant? : For those buildings where public services are
provided we have worked for several years to make them ADA compliant. If there
is a “Y” in the column it designates this building meets ADA requirements. If
there is a “Y**” in the column it designates that this building meets ADA
requirements for short term public service, where the duration of the visit would be
less than 30 minutes. The buildings are accessible, however due to the age and
layout of the building an ADA restroom is not available. An “N” in this column
indicates that the building does not meet all of the requirements of the ADA.
When are modifications scheduled? : This is the date by which the necessary
modifications are scheduled to be completed for those buildings where public
services are provided.
Scheduled FY (Fiscal Year) for Sub-Area Modifications: KDOT has a building
program underway that is modernizing our Sub-Area shops by increasing the size
of the equipment bays and bringing the office portion of the building up to ADA
standards. We have done a number of these and have funds to do 3 to 4 of these
buildings each year.

Safety Rest Areas
2017 ADA Plan
On the next page is the inventory of Safety Rest Areas located adjacent to the State
Highway System of Kansas that are the responsibility of the Kansas Department of
Transportation. The majority of these rest areas do meet the current ADA
requirements. The ones that are not only need minor corrections such as signage
and door opening requirements. KDOT plans to have these corrected by June 30,
2017. Funds for the needed modifications do not appear as a separate budget line
item, but come out of a budget for building repair and rehabilitation. One issue at
many of these locations that was not listed as a deficiency is the need for truncated
cones or some method of delineating sidewalk ramps leading into the parking lot.
At the time that these ramps need modification or reconstruction the appropriate
surface will be installed.

Sidewalks
2017 ADA Plan
On the next page is an inventory of the sidewalks located on KDOT right-of-way
that are the responsibility of the Kansas Department of Transportation. The
majority of the sidewalks on State R/W are inside city limits. We have agreements
with each city that delegates the responsibly to maintain the sidewalks to the city.
Many of the sidewalks shown in this report are located in or near unincorporated
cities on the State Highway system. Many are remnants of old sidewalks that do
not provide a path to a destination. KDOT will evaluate the need for these
sidewalks at the time of a major rehabilitation of the adjoining highway and will
bring up to standards if the sidewalk is deemed necessary. When KDOT receives a
complaint or a concern about any of these sidewalks related to whether they meet
the current ADA requirements, KDOT will investigate and respond accordingly.
