Cedar county boardTIPTON, IOWAOct. 6, 2020Cedar County Board of Supervisors met in regular session at 8:30 a.m. Oct. 6, 2020 with following members present: Smith, Bell, Kaufmann, and Chairperson Agne. Gaul absent. Members of public were also present. Board viewed correspondence from vari-ous agencies.Manure Management Annual Updates submitted by:Crock & Sons #64129 site located at 1520 Ocean Avenue, TiptonIt noted following Handwritten Disbursement issued on Oct. 2, 2020 to Cedar County Treasurer for Benefits, Inc. for an electronic deposit: #424973 for $138.00-self funded medical claims.Moved by Kaufmann seconded by Smith to approve agenda.Ayes: AllAbsent: GaulChairperson Agne addressed public for comment and there were none.Moved by Smith seconded by Bell to approve Board Minutes of Sept. 29, 2020.Ayes: AllAbsent: GaulMoved by Kaufmann seconded by Bell to approve Claim Disbursements #424838 - #424972 paid on Oct. 1, 2020.Ayes: AllAbsent: GaulBoard reported on Outreach/Committee Meetings they attended. Auditor Dauber met with Board to discuss annual Urban Renewal Report. Dauber presented beginning and ending fund balances and expenditures for FY19/20. General discussion held regarding con-tinuing to certify debt for this district. Dauber consulted with Attorney Robert Josten and he stated Urban Renewal Area is for 20 years and county can still collect receipts up to that time. Dauber informed Board first year county collected receipt in 2003 therefore, if Board wishes they can continue to certify debt and collect receipts until 2023. consensus of Board to wait for public comment on this topic. Dauber stated she will pres-ent debt certification to Board in month of November and at that time they can decide whether they will continue col-lecting receipts from this Urban Renewal Area. Moved by Smith seconded by Bell to approve FY19/20 Urban Renewal Report.Ayes: AllAbsent: GaulAuditor Dauber presented ordinance #61 to repeal Ordinance #36, referring to Cedar Valley Golf TIF District. Auditor Dauber reminded Board they had passed and approved a Resolution Rescinding Conditional Rezoning Agreement on August 4th due to sale of property. Dauber informed Board she consulted Attorney Robert Josten for guidance on procedure to repeal Ordinance #36. Engineer Fangmann involved in process also. Moved by Kaufmann seconded by Smith to approve and adopt Ordinance #61.Ayes: AllAbsent: GaulAuditor Dauber presented an amend-ed Federal Funds Procurement Policy to Board. Dauber explained original Procurement Policy that approved in August not accepted by Homeland Security due to Federal Code sections were not listed. Dauber worked with Assistant Attorney Blank on amendment. Blank wanted to reiterate that this amend-ment is only for Federal Funds and does not affect County Procurement Policy.Moved by Bell seconded by Kaufmann to approve amended Federal Funds Procurement Policy as presented.Ayes: AllAbsent: GaulAuditor Dauber presented Mandatory Disclosures of Violations of Federal Law Policy to be approved by Board.Moved by Bell seconded by Smith to approve Mandatory Disclosures of Violations of Federal Law Policy as pre-sented.Ayes: AllAbsent: GaulAuditor Dauber requested Board to reschedule November 3rd board meeting due to that being an election day. Dauber stated on election day office is extremely busy and she and her staff needs to be available to respond to issues in precincts on election day. General discussion held. It consensus of Board to table this topic and review agenda at a later date to decide if a meeting is needed.Auditor Dauber informed and presented to Board current financial status of county funds. Discussion held and will contin-ue in department head meeting. Board departed Board Room at 8:53 a.m. to attend department head meeting in large meeting room to socially distance. At 9:00 a.m. Department Head meeting held with following department heads present in large meeting room and pro-vided a departmental update. Recorder Bahnsen unable to attend but provided an update to Chairperson Agne. Bahnsen updated Board on passports and renew-als, notified Board that Recorder Office will be open on Saturday, Oct. 31st from 9:00 a.m. to 1:00 p.m. for all services, except recording documents. Bahnsen suggested public to call ahead for pass-port service. Bahnsen informed Board that proclamation extended for anoth-er month allowing citizens to obtain a replaced registration and or title due to DERECHO at no cost. Assessor Marx not present at meeting although provided an email update. Marx stated Assessor’s Office has been working on collecting storm damage information and answering calls regarding tax statements. Engineer Fangmann provided road updates. Attorney Renander informed Board that first jury trial will be held next month. Treasurer Delaney provided driver license statistics and informed Board that they will offer drive test and knowledge test on November 1st. Chairperson Agne inquired about tax sale. Delaney respond-ed that next tax sale will be in June 2021. Sheriff Wethington provided an update on various topics including evictions, virtual jail inspections, law enforcement cover-age to City of Mechanicsville and City of Clarence, visitation at jail, maintenance on sprinkler system and Sunbury matter is a civil issue. IT Director Cahoy has been working with Solutions on changes in process of IT and infrastructure security regarding emails. Public Health Director Walker informed Board currently there are 283 positive cases, 2 deaths, 3 hos-pitalizations and 184 recovered. Walker received new guidance today that respi-ratory droplets were a known way that COVID-19 spreads, but now they know it can sometimes be spread through air-borne transmission. Walker recommends wearing masks. Walker has hired two new employees so they are almost fully staffed. GIS Teut is working on database design and is keeping busy with editing data. Veteran Affairs Director Hamann reported Commissioner Wheeler is work-ing on a Facebook page for Veterans. Hamann informed Board she will have her office open on Oct. 31st for out-reach services. Hamann thanked Board for hiring a full-time IT Director. Tyler has assisted her several times and she appre-ciates having an IT in courthouse. Auditor Dauber provided statistics on voting, and

Mayor Roger Laughlin called the West Branch City Council meeting to order at 6:31 p.m. Roll call: Council members (via Zoom): Colton Miller, Tom Dean, and Nick Goodweiler. Attending in-person: Jodee Stoolman Jerry Sexton. City Staff: City Administrator Redmond Jones II and Deputy Clerk Leslie Brick.GUEST SPEAKER PRESENTATIONS None.PUBLIC COMMENT None.CONSENT AGENDANone.PUBLIC HEARING / NON-CONSENT AGENDAResolution 1940 – Approving an amendment to that certain Subdivider’s Agreement by and between the City of West Branch and KLM Investments, LLC for The Meadows, Part 4, West Branch / Move to action.Background: Requirements of Chapter 170.19 had not been met by the devel-oper for the October 5th City Council meeting. Because public improvements have not yet been completed, the City requires an Escrow for the remaining improvements in order to approve a final plat. The escrow amount is calculated by the developer’s engineer and then approved by the City Engineer. This information was received on October 9th and the meeting was scheduled at the request of the developer as they have lots pending sale before the next regular Council meeting. Because of rezoning changes and re-numbering of lots have occurred after the preliminary plat and Subdivider’s Agreement was approved in 2018, the City Attorney is required to make an amendment to the original agreement (Resolution 1742) to reflect those changes.Jones said due to the timing of the special meeting request and availability to obtain all the necessary informa-tion, the proposed amendments for the Subdivider’s Agreement were still under review by the City Engineer, City Attorney and developer.Brick added that Section 14 (of the origi-nal agreement) regarding Minimum Low Openings needed verification from both parties engineers and that Section 10 Payment of Sanitary Sewer Connection Fees were under review due to the rezoning that had occurred since the approval of the original agreement.After some brief discussion, Dean made a motion to approve the amendments pending agreement of the City Attorney and City Engineer on Section 10 and 14.Motion by Dean, second by Goodweiler to approve Resolution 1940 pending agreement of Section 10 and 14 by the City Attorney and City Engineer. informed Board she is working on FEMA and financial report for independent audit-ing firm. Dauber reminded all depart-ments that independent auditors will be here next Tuesday and Wednesday. Chairperson Agne addressed all depart-ment heads regarding if budgets are not fully appropriated what impacts that will be on their budgets. Wethington stated currently Sheriff budget is 6% over year budget due to yearly expenses that were paid. Hamann stated if her budget is not fully appropriated it will be a huge impact of $20,000 due to allocation money. Engineer Fangmann explained to his four major categories he may need a bud-get amendment to adjust categories for DOT budget. Auditor Dauber reiterated to Board that Secondary Roads is a stand-alone fund that only receives transfers from Rural Services Fund, therefore, he is not considered same as other depart-ments operating from General and Rural Fund. Smith stated if Board fully funds all budgets departments need to conserve any money remaining in their budget. Bell stated in past department do a good job by not spending all allocated money in departments budget. His concern is budgets exceeding allocated amount will compound over in next budget year. Consensus of Board there cannot be any budget amendments unless it is due to an unforeseen expense. Chairperson Agne informed all department heads this conversation will continue in Board Room. Board reconvened into Board Room. Further discussion held regarding appropriation.Moved by Bell seconded by Smith to fully appropriate all departments to 100% with understanding all departments need to stay within their budget and any addi-tional expense, above budgeted amount, needs to be presented to Board prior to spending. Ayes: AllAbsent: GaulBoard requested Auditor Dauber to rely this information to all department heads and other board and commissions via email.Engineer Fangmann met with Board to request approval of hiring Mitchell Chapman at rate of $21.71 per hour.Moved by Smith seconded by Bell to approve hiring of Mitchell Chapman to Secondary Roads Department.Ayes: AllAbsent: GaulAuditor Dauber presented to Board and asked for approval to purchase a drop box for entire courthouse to utilize. Discussion held. Consensus of Board agreed drop box would be an asset for public. Auditor Dauber and Bell will work together on purchase of drop box with Bell taking lead. Auditor Dauber inquired to Board on status of pre-meeting with Compensation Board representatives. Bell mentioned that Mike Galloway had mentioned in past that he would meet with all Compensation Board Representatives. Consensus of Board to have Auditor Dauber contact Galloway on this request. Welch explained that there is a sewer easement and public access between lots 3 and 4 in which the City could provide a pedestrian trail if they so desired to Greenview. Jones confirmed that an escrow check had been received by the City and recommended approval. The Council had no further comments.Motion by Dean, second by Sexton to approve Resolution 1941.
