    A K TO NASLEDSTVU SPORAZUMOV NEKDANJE

    JUGOSLAVIJE Z REPUBLIKO TURIJO, KI NAJOSTANEJO V VELJAVI MED REPUBLIKOSLOVENIJO IN REPUBLIKO TURIJO (BTUNSNJ)

    Na podlagi 3. lena Ustavnega zakona za izvedbo Teme-ljne ustavne listine o samostojnosti in neodvisnosti RepublikeSlovenije v zvezi z dolobami 1. lena Ustavnega zakona zaizvedbo Ustave Republike Slovenije Dravni zbor RepublikeSlovenije odloa, da se notificira nasledstvo Republike Slove-nije glede naslednjih mednarodnih pogodb, veljavnih med nek-danjo Jugoslavijo in Republiko Turijo, ki naj ostanejo v veljavimed Republiko Slovenijo in Republiko Turijo:

    1. Konvencija med Kraljevino Jugoslavijo in Republiko Turijo o vzajemnih odnosih v sodnih, civilnih in trgovinskihzadevah, Ankara, 3. 7. 1934, objavljena v Slubenih novinahKraljevine Jugoslavije, 1936, br. 263-LXV;

    2. Konvencija o trgovini in plovbi med KraljevinoJugoslavijo in Republiko Turijo, Ankara, 28. 10. 1936,objavljena v Slubenih novinah Kraljevine Jugoslavije, 1936,br. 295-LXXIV;

    3. Dodatni protokol k jugoslovansko-turki konvenciji otrgovini in plovbi z dne 28. 10. 1936, Ankara, 6. 5. 1938,objavljen v Slubenih novinah Kraljevine Jugoslavije, 1938,br. 155-LI;

    4. Konvencija o trgovini in plovbi med Vlado Jugoslavije in Vlado Republike Turije, Ankara, 26. 2. 1953, objavljena v Uradnem listu FLRJ-MP, t. 4/55;

    5. Protokol o odkodnini za turko premoenje in premo-enjske interese v Jugoslaviji, Ankara, 5. 1. 1950, objavljen v Uradnem listu FLRJ, t. 23/50;

    Razglaam Zakon o ratifikaciji Sporazuma o dolgu med Slovenijo in Zdruenim kraljestvom t. 1 (1999) (BGBSD1), kiga je sprejel Dravni zbor Republike Slovenije na seji 2. marca 2001.

    O RATIFIKACIJI SPORAZUMA MED SLOVENIJO IN ZDRUENIM KRALJESTVOM T. 1 (1999)(BGBSD1)

    1. lenRatificira se Sporazum o dolgu med Slovenijo in Zdruenim kraljestvom t. 1 (1999), sklenjen z izmenjavo not 18. maja

    2000.

    2. lenSporazum se v anglekem izvirniku in slovenskem prevodu glasi:*

    * Priloga k sporazumu je na vpogled v Sektorju za mednarodnopravne zadeve Ministrstva za zunanje zadeve in v Sektorju za mednarodne finanne odnose

    NOTE OF THE GOVERNMENT OF THE UNITED KINGDOM

    OF GREAT BRITAIN AND NORTHERN IRELAND

    Dear Minister,

    I have the honour to refer to the debt (the Debt) whichis owed under the loan agreement set out in the Annex hereto deriving from bilateral agreements on certain com-mercial debts that were signed in London on 6 December 1984, and in Belgrade on 7 February 1986, 29 July 1987,8 March 1988 and 11 January 1989 between the Govern-ment of the United Kingdom of Great Britain and NorthernIreland and the Federal Executive Council of the Assembly of the Socialist Federal Republic of Yugoslavia (SFRY).

    I have the honour to propose that the Government of theRepublic of Slovenia discharge the Debt on the thirtieth day after entry into force of this Agreement by making a paymentin respect of the same into ECGDs account at the Bank ofEngland: Account No. 22950001; Sort 10.00.00T; Ref:IDD Slovenia. The sum payable will be calculated by refer-ence to the amounts of principal outstanding and interestaccrued to the date of payment as set down in the Annex.

    Save for the Debt it is agreed that there are no debtsowing between the Government of the United Kingdom ofGreat Britain and the Northern Ireland and the Governmentof the Republic of Slovenia under the bilateral consolidationagreements signed as aforesaid by the United Kingdom ofGreat Britain and Northern Ireland and the SFRY.

    NOTA VLADE ZDRUENEGA KRALJESTVA VELIKA BRITANIJA IN SEVERNA IRSKA

    Spotovani minister,

    ast imam sklicevati se na dolg (dolg), ki se dolgujepo kreditnem sporazumu iz tukajnje priloge in izhaja izdvostranskih sporazumov o doloenih komercialnih dolgo- vih, podpisanih v Londonu 6. decembra 1984 in v Beogra-du 7. februarja 1986, 29. julija 1987, 8. marca 1988 in11. januarja 1989 med Vlado Zdruenega kraljestva VelikaBritanija in Severna Irska in Zveznim izvrnim svetom Skup-ine Socialistine federativne republike Jugoslavije(SFRJ).

    ast imam predlagati, da Vlada Republike Slovenijedolg odplaa trideseti dan po zaetku veljavnosti tega spora-zuma, tako da izvri plailo na raunECGD pri Bank of England : raun t. 22950001; tevilka banke 10.00.00T;sklic: IDD Slovenia . Znesek za plailo se bo izraunal gledena zneske neplaane glavnice in obresti, nastale do dnevaplaila, kot je to navedeno v prilogi.

    Dogovorjeno je, da, razen v zvezi z dolgom, med VladoZdruenega kraljestva Velika Britanija in Severna Irska in Vlado Republike Slovenije ni nobenih dolgov po dvostran-skih sporazumih o konsolidaciji, ki sta jih, kot je zgorajomenjeno, podpisala Zdrueno kraljestvo Velika Britanija inSeverna Irska in SFRJ.

    The Government of the United Kingdom of Great Brit-ain and Northern Ireland and the Government of the Repub-lic of Slovenia recognise that the SFRY has been dissolvedand no longer exists, and that the Republic of Slovenia isone of the successor states to the SFRY.

    If the foregoing proposals are acceptable to the Gov-ernment of the Republic of Slovenia, I have the honour topropose that this Note and Your Reply shall constitute an Agreement between our two Governments in this matter which shall be known as The United Kingdom/SloveniaDebt Agreement No.1 (1999). This Agreement shall enter into force when the Government of the Republic of Slovenianotify, through the diplomatic channel, the completion oftheir constitutional internal procedures necessary to giveeffect to it in Slovenia.

    ast imam sklicevati se na dolg (dolg), ki se dolgujepo kreditnem sporazumu iz tukajnje priloge in izhaja izdvostranskih sporazumov o doloenih komercialnih dolgo- vih, podpisanih v Londonu 6. decembra 1984 in v Beogra-du 7. februarja 1986, 29. julija 1987, 8. marca 1988 in11. januarja 1989 med Vlado Zdruenega kraljestva VelikaBritanija in Severna Irska in Zveznim izvrnim svetom Skup-ine Socialistine federativne republike Jugoslavije(SFRJ).

Ta sporazumzane veljati, ko Vlada Republike Slovenije po diplomatskipoti uradno sporoi, da so konani potrebni notranjepravnipostopki za njegov zaetek veljavnosti v Sloveniji.

    ast imam potrditi, da so doloila in pogoji, navedeni v Vai noti in prilogi k njej, sprejemljivi za Vlado RepublikeSlovenije ter da Vaa nota skupaj s prilogo in tem odgovo-rom sestavlja sporazum med najinima vladama o tej zadevi,ki se imenuje Sporazum o dolgu med Zdruenim kraljes-tvom in Slovenijo t. 1 (1999) in zane veljati, ko VladaRepublike Slovenije po diplomatski poti uradno sporoi, daso konani notranjepravni postopki za njegov zaetek veljav-nosti v Sloveniji.

    Vlada Republike Slovenije in Vlada Romunije, v nada-ljevanju pogodbenici, sta se

    z eljo, da v duhu dobrega sodelovanja in na medse-bojni podlagi olajata ponovni sprejem oseb, ki so nezako-nito vstopile in/ali nezakonito bivajo na ozemlju njunih dr-av,

    dogovorili naslednje:

    I. PONOVNI SPREJEM DRAVLJANOV POGODBENIC

    1. len(1) Vsaka pogodbenica mora na zahtevo druge pogod-

    benice brez posebnih formalnosti ponovno sprejeti na ozem-lje svoje drave vsako osebo, ki ne izpolnjuje ali ne izpolnju-

    The Government of the Republic of Slovenia and theGovernment of Romania, hereinafter referred to as the Con-tracting Parties,

    With a desire to facilitate, in the spirit of good co-operation and on the mutual basis, the readmission of per-sons who illegally entered and/or are illegally staying on theterritories of their respective states

    have agreed as follows:

    I. READMISSION OF THE CITIZENS OF THECONTRACTING PARTIES

    Article 1(1) Each Contracting Party shall, upon request of the

    other Contracting Party and without any special formalities,readmit to the territory of its state any person, who ilegally

    je ve pogojev za vstop ali bivanje, ki veljajo na ozemljudrave pogodbenice prosilke, e se ugotovi ali utemeljenodomneva, da ima ta oseba dravljanstvo drave zaproenepogodbenice.

    (2) Dravljanstvo se lahko ugotavlja na podlagi veljav-nega potrdila o dravljanstvu, potnega lista ali osebne izkaz-nice. (3) Dravljanstvo se lahko utemeljeno domneva na pod-lagi dokumentov, navedenih v drugem odstavku, tudi e sopotekli, in na podlagi drugih podatkov in dokumentov (vozni-ko dovoljenje, tudentska izkaznica, vojaka knjiica itd.). V primeru utemeljeno domnevanega dravljanstva se to ugo-tovi v sodelovanju z najblijo diplomatsko misijo ali konzular-nim predstavnitvom drave zaproene pogodbenice.

    (4) Pogodbenica prosilka mora osebo pod istimi pogojiponovno sprejeti, e se z nadaljnjim preverjanjem ugotovi,da oseba nima dravljanstva drave zaproene pogodbeni-ce.

    II. PONOVNI SPREJEM DRAVLJANOV TRETJIH DRAV IN OSEB BREZ DRAVLJANSTVA

    2. len(1) Vsaka pogodbenica mora na zahtevo druge pogod-

    benice brez posebnih formalnosti ponovno sprejeti na ozem-lje svoje drave dravljana tretje drave ali osebo brez drav-ljanstva, ki je nezakonito vstopila in/ali nezakonito biva naozemlju drave pogodbenice prosilke, e se ugotovi, da jetaka oseba vstopila na ozemlje drave pogodbenice prosilkeneposredno z ozemlja drave zaproene pogodbenice.

    (2) Vsaka pogodbenica mora na zahtevo druge pogod-benice brez posebnih formalnosti ponovno sprejeti dravlja-

    na tretje drave ali osebo brez dravljanstva, ki je nezakonito vstopila in/ali nezakonito biva na ozemlju drave pogodbeni-ce prosilke, e ima taka oseba veljaven vizum, razen neizko-rienega tranzitnega vizuma, ali kako drugo veljavno dovo-ljenje za bivanje, kot je doloeno v dravni zakonodaji in ga je izdala zaproena pogodbenica.

    3. lenObveznost ponovnega sprejema, doloena v 2. lenu,

    ne velja za:a) dravljane tretjih drav, ki imajo skupno dravno me-

    jo z dravo pogodbenice prosilke;b) dravljane tretjih drav ali osebe brez dravljanstva,

    ki so po zapustitvi ozemlja drave zaproene pogodbeniceali po vstopu na ozemlje drave pogodbenice prosilke od te

    dobile vizum ali dovoljenje za bivanje;c) dravljane tretjih drav ali osebe brez dravljanstva,

    ki so zadnje tri mesece bivale na ozemlju drave pogodbeni-ce prosilke;

    d) dravljane tretjih drav ali osebe brez dravljanstva,ki jim je pogodbenica prosilka priznala bodisi status begun-ca na podlagi dolob enevske konvencije o statusu begun-cev z dne 28. julija 1951 in dolob Newyorkega protokolao statusu beguncev z dne 31. januarja 1967 ali statusosebe brez dravljanstva na podlagi Newyorke konvencijeo statusu oseb brez dravljanstva z dne 28. septembra1954;

    e) dravljane tretjih drav ali osebe brez dravljanstva,ki so zaprosile za azil in akajo na dokonno odloitev pristojnih oblasti;

    entered and/or is illegally staying on the territory of the stateof the requesting Contracting Party, if it is ascertained or validly presumed, that such person has the citizenship of thestate of the requested Contracting Party.

    (2) The citizenship may be ascertained on the basis ofa valid certificate of citizenship, a passport or an identity card.(3) The citizenship may be validly presumed on thebasis of the documents listed in paragraph (2) even if they have expired and other data and documents (driving license,student card, military ID card etc.). In the case of validly presumed citizenship the latter shall be ascertained in col-laboration with the nearest diplomatic mission or consular post of the state of the requested Contracting Party.

    (4) The requesting Contracting Party shall, under thesame conditions, readmit a person again, if it has been ascer-tained through further verifications that the person has not thecitizenship of the state of the requested Contracting Party.

    II. READMISSION OF CITIZENS OF THIRD STATES AND STATELESS PERSONS

    Article 2(1) Each Contracting Party shall readmit to the territory

    of its state, upon request of the other Contracting Party and without any special formalities, a citizen of a third state or astateless person who illegally entered and/or is illegally staying on the territory of the state of the requesting Con-tracting Party, if it has been ascertained that such personentered the territory of the state of the requesting Contract-ing Party directly from the territory of the state of the re-quested Contracting Party.

    (2) Each Contracting Party shall, upon request of theother Contracting Party and without any special formalities,

    readmit a citizen of a third state or a stateless person whoillegally entered and/or is illegally staying on the territory ofthe state of the requesting Contracting Party, if such personhas a valid visa, except from unused transit visa, or a validresidence permit, as defined by the national legislation andissued by the requested Contracting Party.

    Article 3 The obligation of readmission as stipulated in Article 2,

    shall not apply in the case of:a) citizens of third states, that have a common state

    border with the state of the requesting Contracting Party;b) citizens of third states or stateless persons who

    obtained, after they left the territory of the state of therequested Contracting Party or after they entered the territo-

    ry of the state of the requesting Contracting Party, a visa or aresidence permit from the latter;c) citizens of third states or stateless persons who have

    resided in the territory of the state of the requesting Con-tracting Party for the last three months;

    d) citizens of third states or stateless persons who were recognized by the requesting Contracting Party either the status of refugee on the basis of the provisions of theGeneva Convention relating to the Status of Refugees ofJuly 28, 1951 and the provisions of the New York Protocolrelating to the Status of Refugees of January 31, 1967, or the status of stateless person on the basis of the New York Convention relating to the Status of Stateless Persons ofSeptember 28, 1954;

    e) citizens of third states or stateless persons whoapplied for asylum, pending definitive decisions by compe-tent authorities;

    f) dravljane tretjih drav ali osebe brez dravljanstva, ki jih je zaproena pogodbenica dejansko vrnila v njihovo ma-tino dravo ali v katero koli tretjo dravo.

    4. lenPogodbenica prosilka soglaa s ponovnim sprejemom

    na ozemlje svoje drave tistih dravljanov tretjih drav alioseb brez dravljanstva, za katere bi zaproena pogodbeni-ca po ustreznem preverjanju ugotovila, da v asu odhoda zozemlja drave pogodbenice prosilke ne ustrezajo dolo-bam 2. in 3. lena tega sporazuma.

    III. POSTOPEK PONOVNEGA SPREJEMA

    5. len(1) Zaproena pogodbenica je dolna brez odlaanja

    pisno odgovoriti na pronjo za ponovni sprejem, v vsakemprimeru pa najkasneje v petnajstih dneh. Vsako zavrnitev ponovnega sprejema je treba utemeljiti.

    (2) Zaproena pogodbenica mora na pronjo pogod-benice prosilke najkasneje v petnajstih dneh izdati potnedokumente, potrebne za vrnitev v domovino, osebi, ki bo vrnjena v skladu z dolobami prvega odstavka 1. lena.Zaproena pogodbenica mora dravljane sprejeti nemudo-ma po izdaji teh dokumentov.

    (3) Zaproena pogodbenica mora najpozneje v enemmesecu ponovno sprejeti dravljana tretje drave ali osebobrez dravljanstva, za katero je bil potrjen ponovni sprejem. To obdobje se lahko podalja na utemeljeno zahtevo katerekoli pogodbenice.

    6. lenZaproena pogodbenica mora pogodbenici prosilki iz-dati potrdilo o ponovnem sprejemu, vkljuno z identifikacij-skimi podatki osebe, za katero se zahteva ponovni sprejem.e se ponovni sprejem izvede brez spremstva, mora bitizaproena pogodbenica o tem pisno obveena.

    7. lenPogodbenica prosilka krije stroke prevoza oseb, ki jih

    je treba ponovno sprejeti, do meje zaproene pogodbenice.Pogodbenica prosilka po potrebi krije vse stroke ponovne-ga sprejema oseb.

    8. len(1) Pogodbenica prosilka dovoli osebi, ki jo je trebaponovno sprejeti, da v namembno dravo prepelje vsosvojo zakonito pridobljeno lastnino v skladu z dravno za-konodajo.

    (2) Nobena pogodbenica ni v nobenem primeru dolnakriti strokov prevoza taknega blaga.

    IV. TRANZIT V PRIMERU ZAVRNITVE

    9. len(1) Vsaka pogodbenica na zahtevo druge pogodbenice

    dovoli v primeru zavrnitve tranzit ez ozemlje svoje dravedravljanom tretjih drav ali osebam brez dravljanstva. Za-proena pogodbenica lahko prosi predstavnika pristojnegaorgana pogodbenice prosilke, da zagotovi spremstvo med

    f) citizens of third states or stateless persons, actually returned by the requested Contracting Party to their state oforigin or to any other third state.

    Article 4 The requesting Contracting Party agrees to accept back

    to the territory of its state those citizens of third states or stateless persons for whom it would be ascertained, after adequate verification carried out by the requested Contract-ing Party, that they do not comply with the clauses under Articles 2 and 3 of the present Agreement at the time of their departure from the territory of the state of the requestingContracting Party.

    III. READMISSION PROCEDURE

    Article 5(1) The requested Contracting Party is obliged to an-

    swer the request for readmission in writing without delay,and in any case within a maximum of fifteen days. Any refusal of the readmission shall be founded.

    (2) Upon request by the requesting Contracting Party,the requested Contracting Party shall, within 15 days at thelatest, issue the travel documents required for the repatria-tion of the person to be readmitted, according to the provi-sions of article 1, paragraph (1). The requested ContractingParty shall readmit the citizens of its state immediately after issuing such documents.

    (3) The requested Contracting Party shall, within onemonth at the latest, readmit a citizen of a third state or stateless person whose readmission was confirmed. Thisperiod may be extended upon founded request by the any of the Contracting Party.

    Article 6 The requested Contracting Party shall issue a confir-mation of readmission to the requesting Contracting Party,including the identity data of the person whose readmission was requested, and if the readmission will be carried out without an escort, the requested Contracting Party shouldbe informed in writing.

    Article 7 The requesting Contracting Party shall cover the ex-

    penses of transportation of persons to be readmitted as far as to the border of the state of the requested ContractingParty. The requesting Contracting Party shall, if necessary,bear all the expenses related to the readmission of persons.

    Article 8(1) The requesting Contracting Party shall allow theperson to be returned, to transport to the country of his/her destination, all his/her legally acquired property, accordingto the national legislation.

    (2) Any of the Contracting Party shall have no obligation whatsoever to bear the costs of transporting such goods.

    IV. TRANSIT IN CASE OF RETURN

    Article 9(1) Each Contracting Party shall allow the citizens of

    third states or stateless persons to transit the territory of itsstate in case of return, upon request by the other Contract-ing Party. The requested Contracting Party may ask a repre-sentative of the competent authority of the requesting Con-

    tranzitom ez ozemlje njene drave, e je takno spremstvopotrebno. Tranzit se lahko opravi po cesti, eleznici ali zletalom.

    (2) Pogodbenica prosilka prevzame polno odgovornostza nadaljevanje potovanja take osebe v namembno dravo inbo tako osebo ponovno sprejela, e se ukrep zavrnitve izkaterega koli razloga ne bi mogel izvesti.

    (3) Pogodbenica prosilka zaproeni pogodbenici potr-di, da ima oseba, za katero je bil odobren tranzit, veljavendokument za prevoz v namembno dravo.

    10. lenPogodbenica prosilka mora obvestiti zaproeno po-

    godbenico, e zavrnjena oseba potrebuje spremstvo.Spremstvo zagotovi pogodbenica prosilka, ki tudi krije vsepotrebne stroke tranzita v namembno dravo in vse stro-ke, ki bi nastali pri vraanju.

    11. lenZahtevo za tranzit si neposredno izmenjata pristojnaorgana pogodbenic. Zahteva mora vsebovati vse podatkeo istovetnosti in dravljanstvu osebe, datumu potovanja,asu in kraju prihoda v dravo tranzita ter asu in krajuodhoda iz nje v namembno dravo, vkljuno z vsemi podat-ki o uradnih osebah, e te spremljajo tako osebo. Zapro-ena pogodbenica mora pogodbenici prosilki na zahtevoza tranzit odgovoriti v osemintiridesetih urah od dnevaprejema take zahteve.

    12. len Tranzit se lahko zavrne, e osebi v njeni namembni

    dravi grozi kazenski pregon ali obsodba zaradi njene rase, veroizpovedi, etnine pripadnosti ali pripadnosti doloenidrubeni skupini ali zaradi njenega politinega preprianja.

    V. SPLONE DOLOBE

    13. lenPogodbenici po diplomatski poti doloita:

    dravne organe, odgovorne za obravnavo proenj zaponovni sprejem ali tranzit;

    mednarodne mejne prehode, ki se lahko uporabijoza ponovni sprejem ali za vstop oseb, ki so v tranzitu.

    14. len(1) e je treba za izvajanje tega sporazuma sporoatiosebne podatke, naj taka informacija vsebuje le:

    a) podatke o osebi, ki bo ponovno sprejeta ali prevzeta v tranzitu, in e je to potrebno, e podatke o njenih druin-skih lanih, kot so: priimek, ime, vsako prejnje ime, vzde- vek ali psevdonim, alias, datum in kraj rojstva, spol, sedanjein vsa prejnja dravljanstva;

    b) potni list, potni dokument, prepustnico ali kakrenkoli drug identifikacijski dokument (tevilka, datum izdaje,organ, ki ga je izdal, kraj izdaje, as veljavnosti);

    c) druge podatke, potrebne za identifikacijo osebe, kibo ponovno sprejeta ali prevzeta v tranzitu;

    d) nart potovanja ine) dovoljenja za vstop v dravo, ki jih je izdala ena odpogodbenic ali tretja drava, njihove opise;

    tracting Party to provide escort while transiting the territory of its state, provided such escort is necessary. The transitmay be carried out by road, railway or air transport.

    (2) The requesting Contracting Party shall take full re-sponsibility for the continuation of the travel of such personto the country of final destination and shall readmit suchperson, if the measure of return cannot be carried out for any reason.

    (3) The requesting Contracting Party will confirm to therequested Contracting Party, that the person for whom thetransit was approved has a document for the transportationto the country of destination.

    Article 10 The requesting Contracting Party shall inform the re-

    quested Contracting Party in case the returned person needsan escort. The escort shall be provided by the requestingContracting Party bearing all necessary costs for transit tothe country of final destination as well as any costs that may occur in case of return.

    Article 11 The request for the transit shall be exchanged directly between the competent authorities of the Contracting Par-ties. The request should contain all data pertaining to theidentity and nationality of the person, the date of travel, thetime and place of the arrival to the transit state as well as thetime and place of the departure from it to the state ofdestination and including all data of the officials, if they accompany such a person. The requested Contracting Par-ty shall answer the request for transit submitted by therequesting Contracting Party within the period of forty-eighthours from the day of receipt of such request.

    Article 12 The transit may be rejected if the person is threatened

    to be prosecuted in the country of final destination becauseof his/her race, religion, ethnicity or membership of a cer-tain social group or because of his/her political opinion.

    V. GENERAL CLAUSES

    Article 13 The Contracting Parties shall define through the diplo-

    matic channels: the state authorities responsible for dealing with ap-

    plications for readmission or transit. international border crossings that may be used for

    the readmission or entrance of persons in transit;

    Article 14(1) Insofar as personal data have to be communicatedin order to implement this Agreement, such information may concern only the following:

    a) the particulars of the person to be readmitted or admitted in transit, and when necessary, of the members ofthe persons family, such as: surname, given name, any previous name, nickname or pseudonym, alias, date andplace of birth, sex, current and any previous nationality;

    b) passport, travel document, laissez-passer or other identity document (number, date of issue, issuing authority,place of issue, period of validity);

    c) other details needed to identify the person to bereadmitted or admitted in transit;

    d) itineraries, ande) entry permits issued by one of the Contracting Par-ties or a third state, their descriptions

    f) obvestilo o posebni pomoi starejim ali bolnim ose-bam, e je ta potrebna.

    (2) Nobena pogodbenica ne sme javno objaviti zau-pnih podatkov o osebnih podatkih oseb, ki bodo ponovnosprejete ali prevzete v tranzitu, oziroma jih ne sme poslatitretjim dravam brez predhodne pisne odobritve druge po-godbenice.

    15. lenDolobe tega sporazuma ne posegajo v pravice in ob-

    veznosti, veljavne za pogodbenici, ki izhajajo iz drugih med-narodnih sporazumov, katerih pogodbenici sta.

    16. len(1) Ta sporazum se sklene za nedoloen as in zane

    veljati na trideseti dan po dnevu prejema zadnjega uradnegaobvestila, s katerim se pogodbenici obvestita o izpolnitvi vseh notranjepravnih postopkov, potrebnih za zaetek nje-gove veljavnosti.

    (2) Z dnem zaetka veljavnosti tega sporazuma prene-ha veljati Sporazum med Vlado Republike Slovenije in VladoRomunije o vraanju in ponovnem sprejemu dravljanov obehdrav, katerih vstop ali bivanje na ozemlju druge drave stanezakonita, podpisan v Ljubljani 11. aprila 1995.

    (3) Vsaka pogodbenica lahko zaasno v celoti ali delnopreneha izvajati sporazum, razen 2. lena tega sporazuma,zaradi razlogov dravne varnosti, javnega reda ali zdravjaljudi z uradnim obvestilom drugi pogodbenici. Prenehanjeizvajanja sporazuma zane veljati takoj.

    (4) Vsaka pogodbenica lahko odpove ta sporazum z

    uradnim obvestilom drugi pogodbenici. Odpoved sporazu-ma zane veljati prvi dan drugega meseca po mesecu, v katerem je druga pogodbenica prejela uradno obvestilo.

    Da bi to potrdila, sta predstavnika pogodbenic, ki stabila za to pravilno pooblaena, podpisala ta sporazum.

    Sklenjeno v Bukareti dne 4. oktobra 2000 v dvehizvirnikih v slovenskem, romunskem in anglekem jeziku,pri emer so vsa besedila enako verodostojna. Ob sporuali razlikah v razlagi tega sporazuma prevlada anglekobesedilo.

    f) if necessary, the need for special assistance to elder-ly or sick persons should be notified.

    (2) None of the Contracting Parties shall either makepublic confidential information about personal data of thepersons who are subject to readmission or admission intransit, or transmit it to third countries without prior writtenpermission of the other Contracting Party.

    Article 15(1) The provisions of the present Agreement shall not

    hinder the rights and obligations assumed by the Contract-ing Parties pursuant to any other international treaties to which they are parties.

    Article 16(1). The present Agreement is concluded for an indefi-

    nite period and shall enter into force on the thirtieth day after the day of the receipt of the last notification by which theContracting Parties shall inform each other on the fulfillmentof the internal legal procedures required for its entry intoforce.

    (2) On the day when this Agreement enters into forcethe Agreement between the Government of the Republic ofSlovenia and the Government of Romania regarding thereturn readmission of the citizens of the two countries whose entry or residence inside the territory of the other state are illegal, signed in Ljubljana on April 11th , 1995,shall terminate.

    (3) Each Contracting Party may temporarily suspendthe application of this Agreement, in whole or in part, withthe exception of Article 2, for reasons of state security,public order or public health by notification to the other Contracting Party. The suspension shall enter into forceimmediately.

    (4) Each Contracting Party may terminate this Agree-

    ment by notification to the other Contracting Party. Thetermination shall enter into force on the first day of thesecond month following the month in which the notification was received by the other Contracting Party.

    In confirmation of the above, the representatives ofboth Contracting Parties, duly authorized for this purpose,have signed the present Agreement.

    Signed at Bucharest on the 4th day of October 2000in two original copies each in Slovenian, Romanian andEnglish languages, all texts being equally authentic. In caseof dispute or difference in the interpretation of the present Agreement, the English text shall prevail.

    da okrepita skupna prizadevanja v boju proti terorizmuin zlorabi mamil, psihotropnih snovi in prekurzorjev,

    da uskladita svoje ukrepe proti mednarodnemu organi-ziranemu kriminalu,

    da poveata skupna prizadevanja v boju proti terori-zmu,

    in ob upotevanju dolob ustreznih mednarodnih kon- vencij s tega podroja

    sporazumeli, kot sledi:

    1. len1. Pogodbenici v skladu z dolobami svoje veljavne

    notranje zakonodaje sodelujeta pri prepreevanju nedovo-ljenega prometa z mamili, psihotropnimi snovmi in prekur-zorji, organiziranega kriminala in terorizma, pri odkrivanju inkazenskem pregonu storilcev teh oblik kriminala kot tudi priprepreevanju, odkrivanju in kazenskem pregonu drugihoblik kriminala, ki ogroajo javni red in mir.

    2. Pogodbenici e posebej sodelujeta v primerih, koso kazniva dejanja ali priprave nanje storjena na ozemljudrave ene od pogodbenic, podatki pristojnih organov po-godbenic pa kaejo na monost, da bi se ta kazniva deja-nja pripravljala ali izvajala na ozemlju drave druge pogod-benice.

    2. lenPogodbenici sodelujeta pri odkrivanju in prepree-

    vanju kriminala, e zlasti organiziranega kriminala, in pritem:

    1. druga drugi sporoata vse podatke o osebah, vple-tenih v organiziran kriminal, podatke o povezanosti storil-cev kaznivih dejanj, informacije o organizacijah in skupinahstorilcev kaznivih dejanj; o tipinem obnaanju storilcev kaznivih dejanj in skupin; o dejstvih, posebno o asu, krajuin nainu storitve kaznivih dejanj; o napadenih objektih,kazenskih predpisih, ki so bili kreni, in izvedenih ukrepih e je to potrebno za prepreitev in zatiranje hudih kazni- vih dejanj;

    2. na zaprosilo izvajata doloene operativne policijskeukrepe, ki so v skladu z veljavno notranjo zakonodajo dravezaproene pogodbenice;

    3. v skladu s tem sporazumom in veljavno notranjozakonodajo drav pogodbenic sodelujeta pri preiskavah zusklajenimi policijskimi ukrepi, ki vkljuujejo vzajemno po-

    mo glede osebja, gradiva in organizacije;4. izmenjujeta informacije in strokovne izkunje o novih

    oblikah in metodah, ki jih uporabljajo storilci kaznivih dejanj v mednarodnem kriminalu;

    5. na zaprosilo izmenjujeta pisno gradivo, vzorce ura-dnih dokumentov in predmetov, ki so bili uporabljeni prikaznivih dejanjih ali iz njih izvirajo;

    6. izmenjujeta strokovnjake zaradi skupnega izbolja-nja kakovosti dela v boju proti organiziranemu kriminalu,zagotavljanja nadaljnjega izobraevanja za svoje strokovnja-ke za pridobitev vije stopnje strokovnega znanja, vzajemne-ga spoznavanja sredstev in metod boja proti kriminalu inrezultatov najsodobnejih policijskih tehnik;

    7. po potrebi organizirata delovna sreanja za pripravo

    in izvajanje usklajenih ukrepov.

    Desiring to step up their joint efforts in fighting againstterrorism and drugs psychotropic substances and precur-sors abuse,

    Convinced of the necessity to harmonize their actionsagainst internationally organized crime,

    Aiming to increase their joint efforts in fighting againstterrorism,

    And taking into consideration the respective provisionsof the relevant international Conventions in the field,

    Have agreed as follows:

    Article 11. The Contracting Parties shall cooperate, in accord-

    ance with the provisions of the national legislation in force, inthe prevention of illicit drugs, psychotropic substances andprecursors trafficking, organized crime and terrorism, in thediscovery and prosecution of the perpetrators of such crimes,as well as in preventing, discovering and prosecuting other crimes seriously threatening the public order and security.

    2. The Contracting Parties shall cooperate especially in cases where the crimes or preparations thereof are car-ried out on the territory of the state of one of the ContractingParties and the information held by the competent authori-ties of the Contracting Parties indicates a possibility of pre-paring or committing the same on the territory of the state ofthe other Contracting Party.

    Article 2 The Contracting Parties shall cooperate in discovering

    and suppressing crime, notably, organized crime, by meansof:

    1. Notifying each other of all data on persons involvedin organized crime, data on connections between criminals,information about organizations and groups of criminals;about typical behavior of perpetrators and groups; aboutfacts, with special attention to the time, place and modusoperandi of criminal acts; about objects of criminal attacks;the provisions of the penal law thereby violated and aboutthe measures taken if this is necessary to prevent andcombat particularly dangerous crimes;

    2. Performing certain operational police activities uponrequest and in accordance with the national legislation inforce in the state of the requested Contracting Party;

    3. Cooperating in investigations, in accordance withthe present Agreement and with the national legislation inforce of the states of the Contracting Parties, by coordinat-

    ed police measures, including mutual assistance in person-nel, materials and organization;4. Exchanging information and expertise concerning

    new forms and methods used by criminals in transnationalcrime;

    5. Exchanging, upon request, written materials, sam-ples of official documents and objects used in the perpetra-tion of, or deriving from, crimes.

    6. Exchanging experts, in order to jointly improve thequality of work, in the context of fighting against organizedcrime, to provide for further education of their own expertsin order to achieve a higher degree of professional knowl-edge, to acquire knowledge of each others means andmethods of fighting against crime and of the results of up-to-date police techniques;

    7. Organizing, when necessary, working meetings for the preparation and performance of coordinated measures.

    3. lenZa prepreevanje in zatiranje nedovoljenega gojenja,

    proizvodnje, ekstrakcije, izvoza, uvoza in tranzita mamil, psi-hotropnih snovi in prekurzorjev ter prometa z njimi si pogod-benici v skladu s svojo veljavno notranjo zakonodajo:

    1. vzajemno sporoata informacije o osebah, vpletenih v nezakonito proizvodnjo mamil, psihotropnih snovi in pre-kurzorjev ter promet z njimi, o skrivaliih mamil, o sredstvihtransporta in nainu storitve kaznivih dejanj, o kraju izvora innamembnem kraju, vkljuno z vsemi drugimi posebnostmi oteh kaznivih dejanjih, e je to potrebno za prepreevanje inodkrivanje drugih kaznivih dejanj, ki ogroajo javni red inmir;

    2. izmenjujeta informacije o obiajnih in novih nainihnedovoljenega mednarodnega prometa z mamili, psihotro-pnimi snovmi in prekurzorji in vse druge s tem povezaneinformacije;

    3. izmenjujeta izsledke kriminalistinih in kriminolokihpreiskav na podroju prometa z mamili, psihotropnimi snov-mi in prekurzorji ter njihove zlorabe;

    4. izmenjujeta vzorce novih mamil rastlinskega ali sinte-tinega izvora ter psihotropnih snovi in prekurzorjev;

    5. izmenjujeta strokovne izkunje o nadzoru zakonite-ga prometa z mamili, psihotropnimi snovmi in prekurzorji, dabi onemogoali monosti nezakonitega prometa s temi snov-mi;

    6. usklajujeta svoje policijske ukrepe, ki jih omogoa veljavna notranja zakonodaja pogodbenic za prepreevanjein zatiranje nezakonite proizvodnje mamil, psihotropnih sno- vi in prekurzorjev.

    4. lenZ namenom prepreevanja in zatiranja terorizma si po-

    godbenici v skladu z veljavno notranjo zakonodajo pogod-benic in s tem sporazumom:

    1. izmenjujeta strokovno znanje in informacije o nar-tovanih ali izvrenih teroristinih dejanjih, vpletenih osebah,nainih izvedbe in tehninih sredstvih, uporabljenih za takadejanja;

    2. izmenjujeta strokovno znanje in informacije o terori-stinih skupinah, njihovih lanih, ki nartujejo, izvajajo oziro-ma so izvedli svoja dejanja na ozemlju drave druge pogod-benice na njeno kodo in proti njenim interesom, e jetakna informacija potrebna za ustavitev terorizma ter zaprepreevanje in zatiranje s tem povezanih drugih kaznivih

    dejanj.5. len

    Sodelovanje med pogodbenicama vkljuuje tudi:

    1. izmenjavo informacij o pravnih dolobah glede kaz-nivih dejanj, ki jih opredeljuje sporazum;

    2. izmenjavo informacij o koristih, ki si jih je doloenaoseba pridobila s kaznivim dejanjem;

    3. izmenjavo zakonov, statistike, operativnih informacijin strokovnega znanja v zvezi s tujci, azilanti, begunci inmigracijami;

    4. izmenjavo informacij, pomembnih za eno od pogod-benic v boju proti nezakoniti trgovini z ljudmi in delovno silo,o nezakoniti posesti oroja, streliva, razstreliv ter toksinih in

    Article 3For the purpose of preventing and combating illicit

    cultivation, production, extraction, export, import, transit ofand trafficking in narcotic drugs, psychotropic substancesand precursors, the Contracting Parties shall, subject totheir national legislation in force:

    1. Communicate each other information relating tothe persons involved in illegal production of and traffickingin narcotic drugs, psychotropic substances and precur-sors, to drugs hideouts, to means of transportation andmodus operandi used by these persons, to the place oforigin and destination, as well as to any other relevantdetails related to these crimes, if necessary to prevent anddiscover other crimes seriously endangering the publicorder and security;

    2. Exchange information regarding the usual and new manners used in illicit international drugs, psychotropic sub-stances and precursors trafficking and any other relevantinformation;

    3. Exchange the results of their criminalistic andcriminological investigations on trafficking in and abuseof narcotic drugs, psychotropic substances and precur-sors;

    4. Exchange samples of new drugs, either of natural or synthetic origin and of psychotropic substances and precur-sors;

    5. Exchange their expertise related to the supervisionof the legal trading in narcotic drugs, psychotropic sub-stances and precursors, with a view to denying any possibil-ity of illegal trafficking in the same;

    6. Harmonize their own police measures, as permittedby their national legislation in force, for the purpose ofpreventing and combating the illegal production of narcoticdrugs, psychotropic substances and precursors.

    Article 4In order to prevent and combat terrorism, the Contract-

    ing Parties shall, subject to the national legislation in force oftheir respective states and according to the present Agree-ment:

    1. Exchange their expertise and information related toplanned or committed terrorist actions, persons involved, ways of perpetration and to the technical means used insuch acts;

    2. Exchange their expertise and information relating toterrorist groups, to their members who plan, carry out or have carried out their acts on the territory of the state of theother Contracting Party, to the detriment and against theinterests thereof, if such information are useful for stoppingterrorism and to preventing and combating other related

    criminal offences. Article 5

    Furthermore, the cooperation between the Contract-ing Parties shall also include:

    1. Exchange of information on the legal provisionsdealing with the criminal acts as described by the present Agreement;

    2. Exchange of information concerning the benefitsoriginating from criminal acts and acquired by certain per-sons;

    3. Exchange of legislation, statistics, operational infor-mation and expertise related to aliens, asylum seekers,refugees and migration;

    4. Exchange of any information important to one ofthe Contracting Parties in the fight against illegal traffickingin human beings and in labor force, illegal possession and

    radioaktivnih snovi kot tudi o odkrivanju kriminalnih tihotap-skih mre ter preprodajalcev ukradenih vozil;

    5. izmenjavo informacij v zvezi s ponarejanjem potnihlistin, ponarejanjem in prenarejanjem denarja, potovalnihekov in kreditnih kartic in s tem povezanega trgovanja,pranja denarja in raunalnikega kriminala.

    6. len1. Za izvajanje dolob tega sporazuma pogodbenici

    imenujeta in pravilno pooblastita svoje pristojne organe zaneposredno in operativno sodelovanje na svojih podrojihdela in v obsegu svojih pristojnosti.

    2. Po zaetku veljavnosti tega sporazuma pogodbenicizagotovita, da si pristojni organi medsebojno sporoijo na-slove, tevilke telefonov in telefaksov, ki so potrebni zauinkovito sodelovanje po tem sporazumu.

    3. Za zagotavljanje operativne povezave pristojni orga-ni po zaetku veljavnosti tega sporazuma drug drugega ob- vestijo o kontaktih tokah, ki jih bodo v ta namen doloili.

    4. Za praktino sodelovanje, kot doloata 1. in 2. lentega sporazuma, lahko pristojni organi pogodbenic v okvirusvojih pravnih pristojnosti in v skladu s svojo veljavno notra-njo zakonodajo sklenejo protokole o sodelovanju, v katerihdoloijo konkretna podroja delovanja in dejanske oblikesodelovanja.

    5. Razen e se dogovorijo drugae, se pristojni organisporazumevajo in si izmenjujejo informacije v anglekem jeziku.

    7. len

    Za zagotavljanje varovanja podatkov o osebah (osebnihpodatkov), ki si jih pogodbenici izmenjata v okviru svojegasodelovanja, veljajo v skladu z veljavno notranjo zakonodajopogodbenic naslednji pogoji:

    1. pogodbenica, ki prejme take podatke, jih sme upo-rabiti le za namene in pod pogoji, ki jih doloi pogodbenica,ki jih je izroila;

    2. pogodbenica, ki prejme podatke, na zaprosilo po-godbenice, ki jih je izroila, to obvesti o uporabi takih podat-kov in o rezultatih te uporabe;

    3. osebni podatki se smejo izroati le pristojnim orga-nom ali organizacijam, ki se ukvarjajo z zatiranjem kriminala,z bojem proti terorizmu, mamilom in organiziranemu krimi-nalu. Ti podatki se smejo poslati drugim organom le ob

    predhodnem pisnem soglasju pogodbenice, ki je podatkeizroila;

    4. pogodbenica, ki izroa podatke, mora zagotoviti, daso ti pravilni, da je izroanje podatkov nujno potrebno in daizroeni podatki ustrezajo cilju izroanja. Upotevati je trebatudi veljavno notranjo zakonodajo druge pogodbenice, kiomejuje izroanje osebnih podatkov. e bi se izkazalo, daso bili izroeni podatki neresnini ali da so bili izroenipodatki, ki ne bi smeli biti razkriti, je pogodbenica, ki jepodatke prejela, o tem nemudoma obveena. Pogodbeni-ca, ki je podatke prejela, popravi vse neresnine podatke innemudoma unii vse podatke, izroene pomotoma ali kate-rih izroitev ni bila dovoljena;

    5. upravieni osebi se na njeno zahtevo razloijo vsiobstojei podatki o njej kot tudi njihova nartovana uporaba.

    5. Exchange of information related to counterfeiting oftravel documents, forgery and counterfeiting of money, trav-el cheques and credit cards and the related trafficking,money laundering as well as computer crimes.

    Article 61. For the purpose of implementing the provisions of

    the present Agreement, the Contracting Parties assign their Competent Authorities and duly authorize them to cooper-ate directly, and operatively in their respective fields of work and according to their respective competencies.

    2. Upon entering into force of the present Agreement,the Contracting Parties shall provide for mutual notificationby the Competent Authorities of addresses, telephone andfacsimile numbers, as required for effectively carrying outthe cooperation under the present Agreement;

    3. In order to provide for operative liaison, the Compe-tent Authorities shall notify each other, upon entering intoforce of the present Agreement, the contact points, as as-signed by them for this purpose;

    4. In order to practically implement the cooperation asprovided by in Article 1 and Article 2 of the present Agree-ment, the Competent Authorities of the Contracting Partiesmay, within the limits of their legal competencies, concludecooperation protocols, fully complying with their nationallegislation in force, where they shall define the specificfields of activity and the actual forms of the cooperation.

    5. Unless otherwise agreed, the Competent Authori-ties shall use English language in communications and ex-changes of information.

    Article 7

    In order to provide for the protection of data relating topersons (personal data) exchanged by the Contracting Par-ties within their cooperation, the following terms and condi-tions shall apply, subject to the national legislation in forceof the Contracting Parties:

    1. The Contracting Party receiving such data may usethe data solely for the purpose and under the conditions asdetermined by the Contracting Party delivering them;

    2. Upon request by the delivering Contracting Party,the receiving Contracting Party shall inform the other of theuse made of the data delivered and on the results thusachieved;

    3. Personal data may be delivered only to the Compe-tent Authorities or organizations dealing with crime suppres-sion, fighting against terrorism, drugs related and organized

    crime. Such data may be transferred to any other authoritiesonly with the prior written permission of the ContractingParty delivering the said data;

    4. The Contracting Party delivering the data must makesure that the data are accurate, that the delivery is absolute-ly necessary and that the delivered data are appropriate tothe aim of the delivery. Consideration shall also be taken ofthe national legislation in force of the other ContractingParty, restricting the delivery of personal data. Should it turnout that incorrect data or data which shouldnt have beendisclosed were delivered, the receiving Contracting Party shall immediately be informed on the matter. The receivingContracting Party shall then correct the inaccurate data and,respectively, immediately destroy any data delivered by mis-take or unpermittedly;

    5. Upon request by a rightfully entitled person, any existing data concerning him/her, as well as the planned

    e zakon ne predvideva drugae, taka razlaga ni obvezna. V zvezi z dajanjem informacij o osebnih podatkih prevlada veljavna notranja zakonodaja drave pogodbenice, ki podat-ke izroa;

    6. pogodbenica, ki izroa podatke, ob njihovi izroitvidoloi tudi veljavne notranje roke za izbris podatkov. V temobdobju je treba podatke, ki se nanaajo na doloeno ose-bo in niso ve potrebni, izbrisati. O izbrisu podatkov in orazlogu za to je treba obvestiti pogodbenico, ki je izroilapodatke. Prejeti podatki se ob prenehanju tega sporazumaizbriejo;

    7. pogodbenici se obveeta, da vodita evidenco oizroanju, prejemanju in izbrisu osebnih podatkov;

    8. pogodbenici morata zagotoviti uinkovito varstvo vseh osebnih podatkov in s tem prepreiti dostop nepoobla-enim osebam do takih podatkov in jih tudi ne smeta spre-minjati ali objavljati.

    8. len1. Pogodbenici jamita za zaupnost vseh podatkov, ki

    jih je ena izmed pogodbenic oznaila kot zaupne, e so biliza take doloeni po veljavni notranji zakonodaji drave po-godbenice, ki jih je izroila.

    2. Gradiva, dokumente, podatke in tehnino opremo,izroene po tem sporazumu, je mogoe izroiti tretji dravile ob predhodnem pisnem soglasju pristojnega organa po-godbenice, ki je te podatke izroila.

    9. len1. Za pospeevanje in stalno vrednotenje sodelovanja

    po tem sporazumu pogodbenici ustanovita meani odbor.Pogodbenici se po diplomatski poti obvestita o sestavi me-anega odbora.

    2. Meani odbor se sestaja po potrebi izmenino v Republiki Sloveniji in v Romuniji. Po potrebi lahko vsakapogodbenic predlaga dodatne sestanke meanega odbora.

    10. lenStroke, ki nastanejo pri izvajanju tega sporazuma, vza-

    jemno krijeta pogodbenici. Ob obiskih delegacij mednaro-dne potne stroke (povratne vozovnice) krije pogodbenica,ki poilja delegacijo, stroke bivanja, notranjih potovanj innujne zdravnike oskrbe pa krije pogodbenica, ki sprejme

    delegacijo druge pogodbenice.

    11. len Vsaka pogodbenica lahko v celoti ali delno odkloni

    svoje sodelovanje in podporo ali postavi doloene pogoje,e je to omejeno z njenim veljavnim notranjim pravom alie se s tem ogroajo varnost ali drugi temeljni interesidrave ali e se kri veljavna notranja zakonodaja dravepogodbenice.

    12. lenDolobe tega sporazuma ne vplivajo na pravice in ob-

    veznosti, ki sta jih prevzeli pogodbenici v skladu z mednaro-dnimi pogodbami, katerih pogodbenici sta.

    use thereof, shall be explained to such person. Unlesspermitted by law, such explanation is not mandatory. Withrespect to giving information on personal data, the nationallegislation in force of the state of the Contracting Party delivering the data shall prevail;

    6. The Contracting Party delivering the data shall, upondelivery thereof, indicate its valid national deadlines for theerasure of these data. Within this period, any data concern-ing a certain person shall be erased when their necessity ceases to exist. The Contracting Party delivering the datashall be informed of the erasure thereof and of the reasonfor such erasure. The data received shall be erased uponthe termination of the present Agreement;

    7. Both Contracting Parties oblige themselves to keeprecords of the delivery, receipt and erasure of personaldata.

    8. The Contracting Parties shall provide for effectiveprotection of any personal data to prevent the access ofunauthorized persons to such data and are not allowed toalter them or render those public.

    Article 81. The Contracting Parties guarantee the confidentiali-

    ty of any data classified as such by any of the ContractingParties, if the same are defined as confidential according tothe national legislation in force of the state of the Contract-ing Party delivering them.

    2. The materials, documents, data and technical equip-ment delivered pursuant to the present Agreement, may beforwarded to any third State only with the prior written ap-proval of the Competent Authority of the Contracting Party that originally delivered them.

    Article 91. The Contracting Parties shall set up a Joint Commit-

    tee, with a view to promoting and constantly evaluating thecooperation pursuant to the present Agreement. The Con-tracting Parties shall notify each other through diplomaticchannels on the composition of the Joint Committee.

    2. The Joint Committee shall meet when needed, alter-nately in the Republic of Slovenia and Romania. Either Con-tracting Party may initiate, if necessary, additional meetingsof the Joint Committee.

    Article 10 The expenditure incurred by the implementation of the

    present Agreement shall be born by the Contracting Partieson a mutual basis. In the case of exchanging delegations,the international travel fares (return tickets) are to be cov-ered by the Contracting Party sending the delegation, while

    the subsistence, domestic travel and emergency medicalcare shall be covered by the Contracting Party receiving thedelegation of the other Contracting Party.

    Article 11Either Contracting Party may deny, in the whole or in

    part, its cooperation and its support or may set certainconditions, therefor, if this is restricted by its national law inforce, if this endangers the security or other essential inter-ests of the state or violates the national legislation in force ofthe state of the Contracting Party.

    Article 12 The provisions of the present Agreement do not hinder

    the rights and obligations assumed by the Contracting Par-ties pursuant to any other international treaties to which they are parties.

    Article 131. The present Agreement shall enter into force on the

    thirtieth day after the date of the receipt of the last notifica-tion by which the Contracting Parties shall inform each other on the fulfillment of the internal legal procedures, requiredfor its entry into force.

    2. The present Agreement is concluded for an indefi-nite period of time. Either Contracting Party may denouncethe present Agreement through the diplomatic channels. The Agreement shall cease to have effect three monthsfollowing the day the other Contracting Party received thenotice of denounciation.

    Signed at Bucharest on the 4th of October 2000, intwo original copies, each in Slovenian, Romanian and Eng-lish languages, all texts being equally authentic and valid.In case of any disagreement in interpretation, the Englishtext shall prevail.

    13. len1. Ta sporazum zane veljati na trideseti dan po datu-

    mu prejema zadnjega uradnega obvestila, s katerim se po-godbenici obvestita o izpolnitvi notranjepravnih postopkov,potrebnih za zaetek njegove veljavnosti.

    2. Ta sporazum je sklenjen za nedoloen as. Vsakapogodbenica ga lahko odpove po diplomatski poti. Spora-zum preneha veljati tri mesece po dnevu, ko je druga po-godbenica prejela obvestilo o odpovedi.

    Podpisano v Bukareti dne 4. oktobra 2000 v dvehizvirnikih v slovenskem, romunskem in anglekem jeziku, priemer so vsa besedila enako verodostojna in veljavna. Obnesoglasju v razlagi prevlada angleko besedilo.

    The Government of the Republic of Slovenia and theGovernment of Canada,

    Desiring to conclude a Convention for the avoidance ofdouble taxation and the prevention of fiscal evasion withrespect to taxes on income and on capital,

    Have agreed as follows:

    Article 1PERSONAL SCOPE

    This Convention shall apply to persons who are resi-dents of one or both of the Contracting States.

    2. lenDAVKI, ZA KATERE SE UPORABLJA KONVENCIJA 1. Ta konvencija se uporablja za davke od dohodka in

    premoenja, ki se uvedejo v imenu Slovenije in v imenuKanade ali njunih politinih enot ali lokalnih oblasti, ne gledena nain njihove uvedbe.

    2. Za davke od dohodka in premoenja se tejejo vsidavki, uvedeni na celoten dohodek, celotno premoenje alina sestavine dohodka ali premoenja, vkljuno z davki oddobika iz odtujitve preminin ali nepreminin, ter davki odpoveanja premoenja.

    3. Obstojei davki, za katere se uporablja konvencija,so:

    a) za Republiko Slovenijo:i) davek od dobika pravnih oseb;ii) davek od dohodka posameznikov, vklju-

    no z mezdami in plaami, dohodkom iz kme-tijskih dejavnosti, dohodkom iz poslovanja indohodkom iz nepreminin in preminin

    (v nadaljevanju slovenski davek).b) za Kanado:

    davki, ki jih uvede vlada Kanade po Zakonu odavku od dohodka(v nadaljevanju kanadski davek);

    4. Ta konvencija se uporablja tudi za kakrnekoli ena-ke ali vsebinsko podobne davke, ki se uvedejo po datumupodpisa konvencije dodatno k davkom iz tretjega odstavkaali namesto njih. Pristojna organa drav pogodbenic drugdrugega uradno obvestita o kakrnihkoli pomembnih spre-membah svoje davne zakonodaje.

    3. lenSPLONA OPREDELITEV IZRAZOV

    1. Za namene te konvencije, razen e sobesedilo za-hteva drugae:a) izraz Kanada, uporabljen v zemljepisnem smi-

    slu, pomeni ozemlje Kanade, vkljuno:i) s katerimkoli obmojem zunaj teritorialnega

    morja Kanade, ki je v skladu z mednarodnimpravom in kanadskimi zakoni obmoje, nakaterem lahko Kanada izvaja pravice v zvezi zmorskim dnom in njegovim podzemljem ter njunim naravnim bogastvom;

    ii) z morjem in zranim prostorom nad vsakimobmojem iz pododstavka i) v zvezi s kakr-nokoli dejavnostjo, ki se izvaja v zvezi z iska-njem ali izkorianjem v njem omenjeneganaravnega bogastva;

    b) izraz Slovenija pomeni Republiko Slovenijo,in ko se uporablja v zemljepisnem smislu,ozemlje Republike Slovenije, vkljuno z mor-skim obmojem, morskim dnom in njegovimpodzemljem ob teritorialnem morju RepublikeSlovenije, e Republika Slovenija lahko izvajasvoje suverene pravice in jurisdikcijo v skladu ssvojo notranjo zakonodajo in mednarodnim pra- vom;

    c) izraza drava pogodbenica in druga drava po-godbenica pomenita, kot zahteva sobesedilo,Kanado ali Slovenijo;

    d) izraza podjetje drave pogodbenice in podje-tje druge drave pogodbenice pomenita podje-tje, ki ga upravlja rezident drave pogodbenice,in podjetje, ki ga upravlja rezident druge dravepogodbenice;

    Article 2 TAXES COVERED

    1. This Convention shall apply to taxes on incomeand on capital imposed on behalf of Slovenia and onbehalf of Canada or of its political subdivisions or localauthorities, irrespective of the manner in which they arelevied.

    2. There shall be regarded as taxes on income and oncapital all taxes imposed on total income, on total capital, or on elements of income or of capital, including taxes ongains from the alienation of movable or immovable property,as well as taxes on capital appreciation.

    3. The existing taxes to which the Convention shallapply are:

    (a) in the case of Canada:the taxes imposed by the Government of Canada

    under the Income Tax Act ,(hereinafter referred to as Canadian tax);

    (b) in the case of the Republic of Slovenia:(i) the tax on profits of legal persons;(ii) the tax on income of individuals, including

    wages and salaries, income from agriculturalactivities, income from business and incomefrom immovable and movable property;(hereinafter referred to as Slovenian tax).

    4. The Convention shall also apply to any identical or substantially similar taxes which are imposed after the dateof signature of the Convention in addition to, or in place of,the taxes mentioned in paragraph 3. The competent author-ities of the Contracting States shall notify each other of any important changes which have been made in their respec-tive taxation laws.

    Article 3GENERAL DEFINITIONS

    1. For the purposes of this Convention, unless thecontext otherwise requires:(a) the term Canada used in a geographical sense,

    means the territory of Canada, including:(i) any area beyond the territorial sea of Canada

    which, in accordance with international law and the laws of Canada, is an area within which Canada may exercise rights with re-spect to the seabed and subsoil and their natural resources;

    (ii) the sea and airspace above every area re-ferred to in subparagraph (i) in respect of any activity carried on in connection with the ex-ploration for or the exploitation of the naturalresources referred to therein;

    (b) the term Slovenia means the Republic of Slov-enia and, when used in a geographical sense,the territory of the Republic of Slovenia, includ-ing the sea area, the seabed and subsoil adja-cent to the territorial sea of the Republic ofSlovenia, if the Republic of Slovenia may exer-cise its sovereign rights and jurisdiction in ac-cordance with its domestic legislation and inter-national law;

    (c) the terms a Contracting State and the other Contracting State mean, as the context requires,Canada or Slovenia;

    (d) the terms enterprise of a Contracting State andenterprise of the other Contracting State meansrespectively an enterprise carried on by a residentof a Contracting State and an enterprise carriedon by a resident of the other Contracting State;

    e) izraz oseba vkljuuje posameznika, drubo inkaterokoli drugo telo, ki zdruuje ve oseb, in zaKanado izraz vkljuuje tudi sklad;

    f) izraz druba pomeni katerokoli korporacijo alikaterikoli subjekt, ki se za davne namene obrav-nava kot korporacija;

    g) izraz pristojni organ pomeni:i) za Kanado ministra za dravne prihodke alinjegovega pooblaenega predstavnika;

    ii) za Slovenijo Ministrstvo za finance RepublikeSlovenije ali pooblaenega predstavnika te-ga ministrstva;

    h) izraz dravljan pomeni:i) kateregakoli posameznika, ki ima dravljan-

    stvo drave pogodbenice;ii) katerokoli pravno osebo, osebno drubo in

    zdruenje, katerih status izhaja iz veljavne za-konodaje v dravi pogodbenici;

    i) izraz mednarodni promet pomeni kakrenkoliprevoz z ladjo ali letalom, ki ga opravlja podjetjedrave pogodbenice, razen e ladja ali letaloopravlja prevoz samo med kraji v drugi dravipogodbenici.

    2. Kadarkoli drava pogodbenica uporabi konvencijo,ima katerikoli izraz, ki v njej ni opredeljen, razen e sobe-sedilo zahteva drugae, pomen, ki ga ima takrat po pravute drave za namene davkov, za katere se konvencija upo-rablja.

    4. lenREZIDENT

    1. Za namene te konvencije izraz rezident drave po-godbenice pomeni:

    a) katerokoli osebo, ki je po zakonodaji te drave

    dolna plaevati davke zaradi svojega stalnegaprebivalia, prebivalia, sedea uprave, krajaustanovitve ali kateregakoli drugega podobnegamerila;

    b) tisto dravo ali njeno politino enoto ali lokalnooblast ali katerokoli agencijo ali institucijo takedrave, enote ali oblasti.

    2. Kadar je zaradi dolob prvega odstavka posameznik rezident obeh drav pogodbenic, se status posameznikadoloi na naslednji nain:

    a) posameznik se teje samo za rezidenta drave, v kateri ima na razpolago stalno prebivalie; eima posameznik na razpolago stalno prebivalie v obeh dravah, se posameznik teje samo zarezidenta drave, s katero ima tesneje osebnein ekonomske odnose (sredie ivljenjskih inte-resov);

    b) e ni mogoe opredeliti drave, v kateri ima po-sameznik sredie ivljenjskih interesov, ali enima v nobeni od drav na razpolago stalnegaprebivalia, se posameznik teje samo za rezi-denta drave, v kateri ima obiajno bivalie;

    c) e ima posameznik obiajno bivalie v obehdravah ali v nobeni od njiju, se posameznik tejesamo za rezidenta drave, katere dravljan je;

    d) e je posameznik dravljan obeh drav ali nobe-ne od njiju, pristojna organa drav pogodbenic vpraanje reita s skupnim dogovorom.

    (e) the term person includes an individual, a com-pany and any other body of persons and, in thecase of Canada, the term also includes a trust;

    (f) the term company means any body corporateor any entity which is treated as a body corporatefor tax purposes;

    (g) the term competent authority means:(i) in the case of Canada, the Minister of Nation-al Revenue or the Ministers authorized repre-sentative;

    (ii) in the case of Slovenia, the Ministry of Fi-nance of the Republic of Slovenia or its au-thorized representative;

    (h) the term national means:(i) any individual possessing the nationality of a

    Contracting State;(ii) any legal person, partnership and association

    deriving its status as such from the laws inforce in a Contracting State;

    (i) the term international traffic means any trans-port by a ship or aircraft operated by an enter-prise of a Contracting State, except when theship or aircraft is operated solely between placesin the other Contracting State.

    2. As regards the application of the Convention at any time by a Contracting State, any term not defined thereinshall, unless the context otherwise requires, have the mean-ing which it has at that time under the law of that State for thepurposes of the taxes to which the Convention applies.

    Article 4RESIDENT

    1. For the purposes of this Convention, the term resi-dent of a Contracting State means:

    (a) any person who, under the laws of that State, is

    liable to tax therein by reason of the personsdomicile, residence, place of management, placeof incorporation or any other criterion of a similar nature;

    (b) that State or a political subdivision or local au-thority thereof or any agency or instrumentality ofany such State, subdivision or authority.

    2. Where by reason of the provisions of paragraph 1an individual is a resident of both Contracting States, thenthe individuals status shall be determined as follows:

    (a) the individual shall be deemed to be a residentonly of the State in which the individual has apermanent home available; if the individual has apermanent home available in both States, theindividual shall be deemed to be a resident only of the State with which the individuals personaland economic relations are closer (centre of vitalinterests);

    (b) if the State in which the individual has his centreof vital interests cannot be determined, or if thereis not a permanent home available to the individu-al in either State, the individual shall be deemedto be a resident only of the State in which theindividual has an habitual abode;

    (c) if the individual has an habitual abode in bothStates or in neither of them, the individual shallbe deemed to be a resident only of the State of which the individual is a national;

    (d) if the individual is a national of both States or ofneither of them, the competent authorities of theContracting States shall settle the question by mutual agreement.

    3. Kadar je zaradi dolob prvega odstavka druba rezi-dent obeh drav pogodbenic, se teje, da je samo rezidentdrave, katere dravljan je.

    4. Kadar je zaradi dolob prvega odstavka oseba, ki niposameznik ali druba, rezident obeh drav pogodbenic, sipristojna organa drav pogodbenic s skupnim dogovoromprizadevata reiti vpraanje in doloiti nain uporabe kon- vencije za to osebo.

    5. lenSTALNA POSLOVNA ENOTA

    1. Za namene te konvencije izraz stalna poslovnaenota pomeni stalno mesto poslovanja, prek katerega v celoti ali delno potekajo posli podjetja.

    2. Izraz stalna poslovna enota e posebej vkljuuje:

    a) sede uprave;

    b) podrunico;c) pisarno;d) tovarno;e) delavnico inf) rudnik, naftno ali plinsko nahajalie, kamnolom

    ali katerikoli drug kraj, kjer iejo ali izkoriajonaravno bogastvo.

    3. Izraz stalna poslovna enota zajema tudi:

    a) gradbie ali projekt gradnje, montae ali sestav-ljanja ali s tem povezane dejavnosti nadzora, am-pak samo e tako gradbie, projekt ali dejavno-sti trajajo ve kot dvanajst mesecev,

    b) storitve, vkljuno s svetovalnimi storitvami, ki jih

    zagotavlja podjetje drave pogodbenice prek svo- jih uslubencev ali drugega osebja v drugi dravipogodbenici, vendar samo, kadar take dejavno-sti (za iste ali sorodne projekte) trajajo s prekini-tvami ali brez njih ve kot devet mesecev v kate-remkoli obdobju dvanajstih mesecev.

    4. Ne glede na prejnje dolobe tega lena se teje,da izraz stalna poslovna enota ne vkljuuje:

    a) uporabe prostorov samo za namen skladienja,razstavljanja ali dostave dobrin ali blaga, ki pripa-da podjetju;

    b) vzdrevanja zaloge dobrin ali blaga, ki pripadapodjetju, samo za namen skladienja, razstav-ljanja ali dostave;c) vzdrevanja zaloge dobrin ali blaga, ki pripadapodjetju, samo za namen predelave s strani dru-gega podjetja;

    d) vzdrevanja stalnega mesta poslovanja samo zanamen nakupa dobrin ali blaga za podjetje alizbiranja informacij za podjetje;

    e) vzdrevanja stalnega mesta poslovanja samo zanamen oglaevanja, za zagotavljanje informacij,za znanstvene raziskave ali za podobne dejavno-sti pripravljalne ali pomone narave za podjetje;

    f) vzdrevanja stalnega mesta poslovanja samo zakakrnokoli kombinacijo deja
