ANALYSIS BY THE ALAMEDA COUNTY COUNSEL OF A DUBLIN UNIFIED SCHOOL DISTRICT
SPECIAL PARCEL TAX MEASURE Measure B, a Dublin Unified School District (Dis-trict)specialparceltaxmeasure,seeksvoterapprovaltoauthorizetheDistricttorenewandextendaspecialparceltaxintheamountof$96.00peryearoneachparceloftax-ablerealproperty,beginningJuly1,2014forfiveyears,tofundtheprogramssetforthinthemeasure.TheDistrictsvoters previously authorized a special parcel tax assess-mentatthesamerateonNovember4,2008. Aschooldistricthastheauthoritytolevyspecialtaxesuponapprovalbytwo-thirdsofthevotescastonthespe-cial taxproposal. (SeeCal.Const.Art.XIIIA,4;Art.XIIIC,2;Cal.GovtCode50075-50077,50079,&53722,et seq.) If two-thirds of the qualified electors voting on thismeasurevoteforapproval,thespecialtaxrevenuewillbeusedforthespecificpurposessetforthinthefulltextofthemeasureprintedinthissampleballot.Thosepurposesin-clude,butarenotlimitedto:recruitingandtrainingteach-ers,maintainingclasssizes,andmaintainingschoollibraryservices.Themeasure furtherprovides that theBoardofTrusteeswill use the revenue for those purposes, unlessit determines in any given year that changes in studentpopulation,fiscalconstraints,orotherchangesinstateorfederalfundingmakedoingsoinfeasibleorinadvisable.AcommunityoversightcommitteewillhelpensurethatthespecialtaxmoniesarespentfortheirauthorizedpurposesandreportannuallytotheBoardofTrusteesandthecom-munityontheexpenditureofsuchmonies. ARGUMENT IN FAVOR OF MEASURE BVoteYESonMeasureBtoprotectexcellenteducationinDublinschoolswithoutincreasingtaxes.Measure B continues locally-controlled funding that stays in our Dublin schools. Our students receive a high-quality and well-roundededucationinlocalschools.Theycontinuetoachievehighscoresonstatewideexamsandarepreparedtocompeteforthebestcollegesand21st-centurycareers.In 2008, over 70% of Dublin Unified School Districtvoters approved funding to protect essential academicprogramsandretainteachers.Whilefundingforeducationis improving, state funding for Dublin schools will notbe fully restored for at least another seven years. Withourincreasingenrollment,itismorecriticalthaneverforDublin Unified School District to maintain stable localfunding.Nowthisfundingisset toexpirethisyear,whichmeansourschoolswilllosemillionsofdollarsandbeforcedtocutcriticalscience,readingandtechnologyprograms.Measure B protects the essentials of an excellenteducationwithoutincreasingtaxes.Specifically,MeasureBwill: Maintain academic excellence in math, science,
reading,writingandtechnology Create and expand educational academies in

INTRODUCTION
Without increasing the existing tax rate and tomaintainhigh quality education for all grades by sustainingacademicachievementinmath,science,reading,writing,and utilizing technology; supporting engineering/medicine/biotechnology academies; attracting/retaininghighlyqualifiedteachers;andmaintainingschoollibraries,currentinstructionalmaterials/technology,shalltheDublinUnifiedSchoolDistrictrenewitsexpiring$96parceltaxforfiveyears,withaseniorexemption,independentoversight,nomoneyforadministratorssalariesandallfundsstayinginDublinschools?
PURPOSE
To provide local revenue that cannot be taken by thestateandtomaintainexceptionalpubliceducationinourschools, the Dublin Unified School District proposes torenewandextenditsexpiringqualifiedspecialparceltaxforaperiodoffive(5)years,beginningJuly1,2014,attherateof$96perParcelofTaxableRealPropertywithintheDublinUnifiedSchoolDistrict,withanannualexemptionavailableforseniorsandpersonsonSupplementalSecurityIncome,uponapplication,andtoimplementaccountabilitymeasures in connection with the special parcel tax toprovide oversight and accountability to ensure that thefundsareusedto:
a) Maintainacademicachievement inmath, science,reading, writing and utilizing technology supporteducational academies in science, engineering,medicineandbiotechnology
b) Attractandretainhighlyqualifiedteachers c) Maintainschoollibraryservices d) Maintain current instructional materials and
technologyforstudents e) Provide ongoing teacher training in the latest
instructionalmethods f) Maintainsmallclasssizes g) Protect taxpayers investment in education and
ensureDistrict accountabilitybyproviding for anindependent community oversight committee andfinancialauditsofrevenuesandexpenditures.
The Board of Trustees will not fund any program orreductionotherthanthoselistedabovefromtheproceedsof the special parcel taxes. TheBoard ofTrusteeswillutilizeparcel taxproceeds for thepurposes listedabove,unlesstheBoardofTrusteesdeterminesinanygivenyearthat changes in student population, fiscal constraints, orother changes in state or federal fundingmakedoing soinfeasibleorinadvisable.
PROCEDURES
Subjecttotwo-thirdsapprovalofthevoters,therenewedandextendedparceltaxshallbecomeeffectiveasofJuly1, 2014 and be collected by the Alameda County TaxCollector at the same time as and alongwith, and shallbe subject to the same penalties as general ad valorem taxescollectedbysaidtaxcollector.Thetaxandpenaltyshallbear interestat thesamerateas therate forunpaidad valorempropertytaxesuntilpaid.Anytaxleviedshallbecomealienuponthepropertiesagainstwhichtaxesareassessedandcollectibleashereinprovided.
Withrespecttoallgeneralpropertytaxmatterswithinitsjurisdiction, theAlameda County TaxAssessor or otherappropriate County tax official (County) shall makeall final determinations of tax exemption or relief forany reason, and that decision shall befinal andbinding.Withrespecttomattersspecifictothelevyofthespecialparcel tax, including the Senior Citizen Exemption asallowedbelow,thedecisionsoftheDistrictshallbefinaland binding. The procedures described herein, and anyadditionalproceduresestablishedbytheBoardofTrustees,shall be the exclusive claims procedure for claimantsseekinganexemption,refund,reduction,orre-computationofthespecialparceltax.Whetheranyparticularclaimisto be resolvedby theDistrict or by theCounty shall bedeterminedbytheDistrict,incoordinationwiththeCountyasnecessary.
TheDistrictsBoardofTrusteesmayadoptsuchadditionalor supplemental procedures as it deems necessary orconvenientfortheadministrationofthespecialparceltax.
OPTIONAL EXEMPTIONS AVAILABLE
AnoptionalexemptionfromthespecialparceltaxwillbemadeavailableannuallytoeachindividualintheDistrictwhowillattain65yearsofagepriortoJuly1ofthetaxyear,andwhoownsabeneficialinterestintheparcel,andwhousesthatparcelashisorherprincipalplaceofresidence,andwhoappliestotheDistrictonorbeforeJuly1,2014,orJuly1ofanysucceedingtaxyear.Anyapplicationforsuchexemptionmustberenewedannually.
AnoptionalexemptionfromthespecialparceltaxwillalsobemadeavailableannuallytoeachindividualintheDistrictreceiving Supplemental Security Income, regardless ofage,whoownsabeneficialinterestintheparcel,andwhousesthatparcelashisorherprincipalplaceofresidence,andwhoappliestotheDistrictonorbeforeJuly1,2014,orJuly1ofanysucceedingtaxyear.Anyapplicationforsuchexemptionmustberenewedannually.
Anyparcelsthatarecontiguoustoeachother,usedsolelyfor one (1) owner-occupied single-family residence,andheldunder identical ownership shall, upon approvalof an application from the owners thereof submitted totheDistrict on or before July 1, 2013, or July 1 of anysucceedingyear,betreatedasasingleparcelforpurposes

ofthespecialparceltax.Anyone(1)approvedapplicationfromaqualifiedapplicantwillprovidesuchtreatmentfortheremainingtermofthespecialtax,solongasalloftheparcelscontinuetobeheldunderidenticalownershipandbeowner-occupied.
The District shall annually provide to the County TaxCollectororotherappropriateCountytaxofficialalistofparcelsthattheDistricthasapprovedforaSeniorCitizenExemption,SupplementalSecurityIncomeExemption,orcontiguouspropertydesignation.
ACCOUNTABILITY MEASURES
In accordance with the requirements of CaliforniaGovernment Code sections 50075.1 and 50075.3, thefollowing accountability measures, among others, shallapply to the special parcel taxes levied in accordancewiththisMeasure:(a)thespecificpurposesofthespecialparceltaxshallbethosepurposesidentifiedabove;(b)theproceedsofthespecialparceltaxshallbeappliedonlytothose specific purposes identified above; (c) a separate,specialaccountshallbecreatedintowhichtheproceedsofthespecialparceltaxesmustbedeposited;and(d)anannualwritten report shallbemade to theBoardofTrusteesoftheDistrictshowing(i)theamountoffundscollectedandexpendedfromtheproceedsofthespecialtaxesand(ii)thestatusofanyprojects,programs,orpurposesrequiredorauthorizedtobefundedfromtheproceedsofthespecialtaxes,asidentifiedabove.
Inadditiontotheaccountabilitymeasuresrequiredbystatelaw, an independent Community Oversight CommitteeshallbeappointedbytheBoardofTrusteestoadvisetheBoardontheexpendituresfundedbythemeasureinordertohelpensure that said fundsare spent for thepurposesapproved by the voters. The Community OversightCommitteewillmonitortheexpendituresofthesefundsbytheDistrictandwillreportonanannualbasistotheBoardandcommunityonhowthesefundshavebeenspent.
PROTECTION OF FUNDING
CurrentlawforbidsanydecreaseinstateorfederalfundingtotheDistrictbecauseoftheDistrictsadoptionofaparceltax.However,ifanysuchfundsarereducedbecauseoftheadoptionofthisparceltax,thentheamountofthespecialparceltaxeswillbereducedannuallyasnecessaryinordertorestoresuchstateorfederalfunding.
