RECOMMENDATION

It is respectfully recommended that the City Council and the Successor Agency approve the attached:

(1) City Council Resolution adopting the Plans and Specifications for the Central Park Paseo/Parking Lot 1 O/Colorado Street Lane Addition Improvements Project, Specifications No. 3483, Plan Nos. 1-2972, 3-1554-4-614, 49-172, 50-555, 6449, C6699 and 52-58; and directing the City Clerk to advertise for bids.

(2) Successor Agency Resolution adopting the Plans and Specifications for the Central Park Paseo/Parking Lot 1 O/Colorado Street Lane Addition Improvements Project, Specifications No. 3483, Plan Nos. 1-2972, 3-1554-4-614, 49-172, 50-555, 6449, C6699 and 52-58; and directing the City Clerk to advertise for bids.

BACKGROUND/ANALYSIS

HISTORY

In March 2011 the City Council and Glendale Redevelopment Agency (GRA) approved a lease agreement and entitlements for the Museum of Neon Arts (MONA) project at 216 S. Brand Boulevard, and approved the schematic design for a pedestrian paseo (connecting Brand Boulevard and Central Park) and improvements to the alley and Parking Lot No. 1 O between Wilson Avenue and Colorado Street east of Brand Boulevard.

With the passage of legislation in June 2011 that dissolved redevelopment (Dissolution Act), the paseo and parking lot improvements were delayed while legal challenges to the legislation were resolved and clarity was added to the dissolution process. During this time, the GRA was prohibited from entering into new contracts and prohibited from using tax increment or bond funds for projects that were not contractually obligated before June 29, 2011. Unlike the MONA project, the GRA did not have a contract to proceed with the paseo and parking lot project; only the design was approved and bidding had not been initiated.

In June 2012, Assembly Bill 1484 was approved that made several amendments to the Dissolution Act. In summary, AB 1484 required several due diligence and audit reviews to assess the GSA's unencumbered cash so it could be redirected to other taxing entities. If the required payments were made, the Department of Finance was authorized to issue a Finding of Completion (FOC) permitting the Successor Agency ("GSA") to use bond funds that were issued in early 2010. Glendale's FOC was issued on May 15, 2013. With the issuance of a FOC, the GSA was authorized to contractually obligate a portion of the 201 O bond proceeds for the project.

PROJECT DESCRIPTION

Paseo:

The project features a new paseo that will punch through the 222 South Brand Boulevard property and draw in the Brand Boulevard brick pattern into the southern portion of the paseo. An area on the north will be surfaced with hardwood planks defining a flexible outdoor space. On the southern edge of the planked surface centrally located within the paseo will be a series of three "Pink Trumpet" shade trees. A wood fence matching the planked surface will be located on the southern edge of the paseo starting from the adjacent brick building east to the parking lot. On the east end of the paseo, there will be a grid of palm trees flanking both sides of the alley. These vertical elements will offer a formal gesture, allow for views through the paseo, and signify the transition of the paseo to the parking lot and Central Park.

The paseo schematic design approved in March 2011 had a terraced water feature. The estimated cost of the feature is $418,000 with much of this cost associated with the fountain's "infrastructure" including a large underground vault to house pumps, clarifiers, electrical equipment, and other utility connections. To reduce costs, staff is proposing to eliminate the fountain in favor of a terraced landscape feature (Exhibit B). The location, size, and scale would be consistent with the water feature and will provide both a focal point for the western portion of the Paseo and a physical separation between the southern walkway and the northern wood deck "courtyard". The metal clad wall proposed on the southern edge of the water feature will remain. Concrete planter walls will form the planter, slowly terracing from seat wall height at the lower Paseo to the upper Paseo. Planting in each portion of the planter will be low-maintenance species. The plant layout around the water drops of the Clayton Plumbers neon sign will imply a ripple from the droplets. Lighting will be subtlety integrated in the planter so as to not distract from MONA's neon elements. Staff believes this could save about $262,000 bringing the Project within the available funding as shown in the Fiscal Impact Section of this report.

Parking Lot and Alley:

The current alley and parking lot will be combined into one cohesive two-way circulation system. The roadway will gently ramp up at the paseo crossing, indicating the presence of a pedestrian corridor. Ninety degree parking stalls on the east will provide parking (served by pay kiosks), and parallel parking on the west will preserve access to adjacent business' parking lots and trash bins. Marking the western edge of Central Park will be a "garden walk" offering a park-like experience. Surfaced with decomposed granite, buffered by grass and groundcover, and shade trees, the pathway will provide an access route to the Central Library and Adult Recreation Center.

Colorado Street Lane Addition:

The parking lot improvements were designed in anticipation of a future westbound right-turn lane on Colorado Street at Brand Boulevard. In order to widen Colorado Street, an 11' dedication will be required from the northerly corner property. The property is approximately 140' by 125' which is barely adequate to feasibly accommodate a subterranean parking structure. To acquire an 11' dedication (reducing the north/south dimension to 129') would render the site economically infeasible for a future subterranean structure due to the need for "jump ramps" and loss of parking spaces. To mitigate the dedication's impact, the property owner agreed in concept to the City conveying a 14' strip of land along the alley in exchange for the 11' dedication along Colorado Street. This would be accommodated by vacating the existing 5' alley easement encumbering the corner property (the fee would revert back to the property owner) and transferring 9' of city-owned currently used for the alley.

The westerly 5' of the former alley property would be reserved for a public sidewalk easement. The property owner has requested that air rights above and below the easement be retained and encroachments for future structural columns be allowed in the easement area as part of the land exchange. The alley and parking lot were designed to accommodate the land swap and achieve the objectives of the Project. Vehicular and pedestrian access/mobility would not be impaired by the structural columns. The concept of the land swap was presented to the City Council and GRA in March 2011 without comment.

If biding of the project is authorized, staff will ask Council and GSA to approve an agreement to acquire the 11' dedication area on Colorado in exchange for the 14' wide strip along the alley along with the bid results. The agreement will address the sidewalk easement, air rights, and potential encroachments for structural columns if the property is developed in the future.

SCOPE OF WORK

The Plans and Specifications have been prepared for the Central Park Paseo/Parking Lot 1 Of Colorado Street Lane Addition Improvements Project. The scope of work includes the following:

1. Central Park Paseo/Parking Lot No. 1 O Improvements:

• Install brick and concrete paving pattern walkways, composite wood decking, seating, decorative lighting and neon signs;

• Install 3 "Pink Trumpet" trees within paseo and Tiny Tower Italian Cypress trees within concrete planter;

• Install pedestrian corridor and "palm court"; • Install 4 parking pay stations; • Install landscaping improvements; • Install 46 parking stalls (2 ADA accessible); • Install 4 speed humps; • Remove existing power poles; • Install underground electrical conduits and vaults; • Install new storm drain; and • Relocate sewer main line.

2. Colorado Street Lane Addition:

• Widen street by 9.5 feet on the north side between Alley No. 58 and Brand Blvd. • Surface Grind/Remove existing asphalt concrete pavement and overlay with Asphalt

Rubberized Hot Mix pavement (ARHM) over Asphalt Concrete Pavement (Base Course) over crushed aggregate base;

• Reconstruct concrete curb and gutters, driveway approaches and aprons, alley aprons, sidewalks and curb ramps;

• Relocate water meters, fire hydrant, street lights, street light pull boxes, twin globe decorative poles, electrical conduits, pull boxes, street signs. bus shelters, curb and area drains;

• Relocate catch basins; • Remove existing street trees and plant three new 24-inch box trees; • Relocate two palm trees on Colorado Street; • Replace existing traffic striping and other traffic markings; and modify traffic signals.

AMERICANS WITH DISABILITIES ACT (ADA)

The proposed project includes improvements that will comply with current Federal ADA guidelines.

ENVIRONMENTAL REVIEW

This project is Categorically Exempt under the provisions of the California Environmental Quality Act as a Class 1 Exemption pursuant to the California Code of Regulations, Title 14, Section 15301.

AVAILABILITY OF SPECIFICATIONS

A copy of the Plans and Specifications is available for review in the City Clerk's Office.

PROJECT SCHEDULE

The construction of this project is anticipated to begin in April 2014, and be completed by November 2014.

FISCAL IMPACT

The Engineer's Estimate for this project is beiween $3,380,000 and $3,720,000. Funding for this project has been allocated in the approved Capital Improvement Program in the following accounts and amounts:

• Measure R Funds • Sewer Reconstruction Program, Account No. 525-51510 • 201 O Central Project Area Tax Allocation Bonds

$320,000 $410,000 $3,600,000

The construction cost of the Colorado Street Lane Addition portion of the project will be funded by Measure R funds. On July 30, 2013, the City and the Los Angeles County Metropolitan Transportation Authority executed a funding agreement in the amount of $350,000. The breakdown of the funding is as follows:

• Construction Support, $30,000 • Construction, $320,000

When the Motion to award the construction contract for this project is submitted to City Council , staff will also request for the appropriation of the Measure R funds.

ALTERNATIVES

The alternatives relating to the proposed Resolutions adopting the plans and specifications for the project are as follows:

Alternative 1: Approve the attached Resolutions. Upon approval of the Resolutions, the contract for construction of the project will be publicly bid and the bids will be reviewed. In February 2014, Resolutions to award the construction contract to the lowest and most responsive bidder will be presented for consideration.

Alternative 2: Not approve the attached Resolutions. If the resolutions are not approved the project would not be publicly bid. The Colorado Lane Addition would not occur nor would the improvements to the alley and parking lot. Because of Building Code requirements, a paseo and public right-of-way will need to be constructed along on the southern fa9ade of the MONA building. Staff would have to return with options for the future paseo.

Alternative 3: New Alternative. The City Council may consider any other alternative not proposed by staff.
