We are celebrating the 127th Birth anniversary of the Greatest son of India Babasaheb Dr. B. R.

Ambedkar throughout the Country in such a time when the Constitutional safeguards available to protect the SCs and STs from atrocities, discrimination and deprivations are at stake due to a judgement delivered by Honourable Supreme Court of India on March 20th .The Country witnessed the ever greatest protest of the SC and ST communities through a successful Bharat Bandh on the 2nd of April 2018. The unity and solidarity among the communities created new history. Unfortunately 9(nine) of our Brothers had to sacrifi ce their lives for protecting the cause of the down trodden. They died martyrs death. It is painful that the judgement of the highest Court of the Country stands in the way of Constitutional protections available for safeguarding of the SC/ST Communities from crimes and atrocities against them. When such crimes in the county are at a rising trend, this Judgement of Honourable Supreme Court of India has attributed in taking away the available Constitutional and legislative protection of safeguard to this downtrodden section of the society.Witnessing the mass unrest in the Country, Government of India submitted review petition before the same bench which delivered the said judgement.But the Supreme Court has not reviewed its judgement and stood by it’s order dated 20th March on 3rd May 18 when the case came up for hearing.There is no reservation available in the Judiciary of our Country.Unfortunately the Judgement of the highest Court of the Country is many a times standing against the interest of SC/ST communities .The 2nd July 1997

judgement replacing the vacancy based roster to post based roster has limited the reserved vacancies within the reserved numbers only. The interim order based on petition of Samata Andolan Samiti issued by the Supreme Court that till the main matter and contempt petition is decided, no further promotions of reserved category persons to unreserved posts will be made based on the DOPT OM Dated 10.08.2010 and Railway Board Circular Dated 14.09.2010. (GOI OM. 36012/11/2016-Estt.(Res.) Dated 30th September 2016). The judgement of 20th March is therefore further pouring salt into the suffering of the downtrodden section of the society. The said Samata Andolan Samiti should have moved to Supreme Court of India for removal of inequality in income distribution in the Country. The survey released by International Rights group OXFAM hours before the start of annual congregation of rich and powerful nation across the world at Davos revealed that the super rich 1% of India cornered 73% of the wealth generated in the Country last year. This is the ever highest gap between the rich and the poor. Where is Samata (equality) ? The private sector of the Country now attributes 40% Employment where reservation is not allowed. Such activist if at all for Samata should have spoken for employment of deprived and down trodden section in private sector of the Country. So, this 127th Birth Anniversary of Babasaheb Dr. B.R Ambedkar is very important to all patriots of the Country to reiterate the Ambedkarian thought which is the path of progress and prosperity through equality in the Society.

RESERVATION IN ITS TRUE PROSPECTIVE

MISCONCEPTION ABOUT RESERVATION

The system of reservation is often misunderstood as a way to provide employment to certain people belonging to Scheduled Castes and Scheduled Tribes. Dr B.R Ambedkar had incorporated the system in the Indian Constitution which came into effect on 26 January 1950 with the emergence of India as a Republic. The aim of reservation is to bring equality in society by bringing the downtrodden section of the society listed in the Constitution of India as castes and tribes to the mainstream so that all sections of the people feel empowered to participate in the decision-making process of the Country. This provision was intended to ensure proportionate representation of people as per population pattern of the Country in the Governance of the Country for enabling every section to participate in Nation Building process. With this holy objective in mind in 1950, the Constitution of India introduced the reserved seats in Parliament, the highest Law making body of the Country. Out of 543 seats in Lok Sabha, 84 seats i.e. 15.47 % were reserved for SCs and 47 seats i.e. 8.66 % for STs, with the sole objective of ensuring proportionate representation of Scheduled Castes and Scheduled Tribes in relation to the total population as per provision contained in Article 330 of the Constitution of India to be read with Section 3 Representation of the People Act, 1950. Thus the Constitution of the Country provides appropriate representation of SC/ST in the Supreme Law Making body setting an example for the fulfilment of the same objectives in every sphere of Governance down the line. So reservation is a system for silent social change to ensure equality through equity and proportionate participation which, in turn, takes the Country towards progress, prosperity and growth.

IS RESERVATION REALLY LEADING TO QUALITY FAILURE ?

The most adverse criticism about reservation is that the system is leading to quality failure. The reservation system came into official existence from the Republic Day of 1950 in our Country but even after 68 years of Independence, no study has ever been conducted to evaluate the impact of reservation. No doubt, the system has helped a lot to keep the Schedule Castes and Schedule Tribes population of the County associated with the mainstream for progress of the Country but it has not yet achieved the desired goal of ensuring proportionate representation. Although no Government study was conducted in this respect, a study by World development Journal, which was published in The Hindu on 29 September 2012

has revealed that reservations in public sector jobs have not affected the productivity or efficiency rather it has had a positive impact in some areas. The study was conducted by Shri Ashwini Deshpande, Professor at Delhi School of Economics and Mr. Thomas Weisskopf, Professor of Economics at the University of Michigan on Indian Railways between 1980 and 2002. Indian Railway is the largest employer in the world where the affirmative action or positive discrimination applies. Indian Railways employs approx 1.4 million people in 4 levels i.e. Group A to Group D. Prof Deshpande and Prof Thomas Weisskopf at the end of their study concluded that “Individuals from marginalised groups may be especially highly motivated to perform well when they attain decision-making and managerial positions, because of the fact that they have reached these positions in the face of claims that they are not sufficiently capable, and they may consequently have a strong desire to prove their detractors wrong,”.

Thus relating reservation with quality failure among employee proves to be totally untrue and ill intended. Without knowing the fact some section makes deliberate propaganda to create bias against the system.

THE MALICIOUS PROPAGANDA OF INTRODUCTION OF CREAMY LAYER IN SC/ST RESERVATION NEEDS TO BE ANSWERED

It is often argued against reservation that the rich among the SCs and STs are snatching away the benefits while the deserving and impoverished continue to bite the dust. It is also advocated in favour of such a theory that there should be creamy layers for SC/ST in the similar line of the OBC. One group has even filed an SLP in Honourable Supreme Court of India in this respect. It is, therefore, high time for all patriots of this Country to give a serious thought on this very important matter.

When the system of Reservation was originally introduced, there was a provision of review of its progress

after every 10 years to ascertain whether SCs and STs have reached proportionate representation or not or otherwise level of equity acheived . Unfortunately, even after 68 Years of Independence, the situation remains ever dismal.

Reservation has definitely benefited SC/ST population to get employment at lower levels but unfortunately, due to lack of positive attitude and biased mindset against SC/ST, the effect of reservation in promotions are not given. As a result, those people recruited under reserved category stagnated at the entry level posts in all the departments and organisations. Thus no new vacancies are created for fresh appointment of SCs/STs. The Honourable Supreme Court of India through its judgement dated 2nd July 1997 has introduced post based roster in place of vacancy based roster. This new system is only a replacement of the posts that fell vacant due to retirement, death and resignation etc of people in the same Category within the cadre strength. Only when recruitment is done for augmentation of cadre strength, the opportunity arises as per new points on the roster. Implementation of reservation in promotion in terms of Article 16(4) A of the Constitution of India and as instructed vide GOI,O.M NO. 36012/18/95 Estt(Res)Pt-II dated 13-08-1997 thus could have immensely helped in the creation of new posts for SCs and STs at the entry level and could have paved the way for proportionate representation.

If we take the example of Banking Sector, initial recruitment mainly takes place in Clerical Grade (Group-C) and entry-level Officer (JMGS-I). No reservation is applicable beyond JMGS-I. So representations of SC/ST in the higher echelons remain negligible. The following figures will be an eye opener for all of us.

The RTI replies received from 23 Banks which was submitted to the Ministry of Finance on 30th May 2017 has exposed the prevailing truth. The summary of those replies shows that at CGM level only 5.5% SC and 2.22% ST, GM level 4.03% SC and 1.61% ST, DGM

Level 6.54% SC and 1.78% ST, AGM level 10.02% SC and 2.42 % ST are there in those 23 Banks. Ideally, it should have been 15% for SCs and 7.5% for STs at all levels and had it been so employment opportunities for SC/ST could have not only emerged at lower levels but also could have ensured social justice to SCs and STs by providing them adequate representations at all levels.

The situation in our own SBI is even more deplorable wherein the total percentage of SC Officers is 17.58% and ST Officers is 7.7% but in DGM and above positions, which is the decision-making level in the Bank, the percentage of SC is only 4.69 % and ST mere 1.22%. So the Constitutional safeguard under Article 16 (4)A and the instructions issued by the Government of India vide it’s OM NO36012/18/95 Estt(Res)Pt-II dated 13-08-1997 remain a far cry.

Those who are advocating for the creation of creamy layers for SC/ST should fight against outsourcing of permanent jobs mainly at Group –D level where the largest portion belong to SCs and STs. As per Article 39, 41-43 of the Constitution of India, the State should ensure a minimum living wage for its citizen and a decent standard of living. Without a permanent job how can those are achieved by a citizen? Unfortunately, now a days almost entire works which were earlier done by Group-D employees at Government as well as in Banks have been outsourced through agency system where the agencies supply the workforce and a very meagre amount is paid to the concerned person employed through them. This is nothing but exploitation and depriving the downtrodden of a living wage and a decent standard of living. Therefore outsourcing of Permanent job is Anti-Constitution. The said Group if at all sincere should have moved for stopping the system which is creating frustration among the poor unemployed youth of the Nation and attributing to their derailment from the mainstream of the society.

Much hue and cry has also been raised in social media that due to the system of reservation in higher

educational institutions, admission of General Category people is marginalised. This is also far from the truth. The study made by Ministry of Human Resource Development, Govt of India (published in THE HINDU on 29 September 2012) based on 448 Universities of the Country under which the admissions in higher education institutions are made revealed that Scheduled Caste Category could enrol only 10.20 % against 15% seats reserved for them. Similarly, enrolment of ST students in higher educational institutions as per the same study is extremely low at 4.4% only.

So, the question of creation of creamy layer will further deprive the SC/ ST Community of their legitimate right of getting their proportionate share in the governance of the Country. The SC/ST Communities as a whole are deprived and extremely backward till now.

As per data available upto March 31st 2011 with the Ministry of Labour and Employment, Director General of Employment and Training in India, the number of Employees in Public Sector is 17548000 and Private Sector 11452000. Thus, private sector is attributing huge employment in the Country, but reservation is not implemented in Private Sector. The Government should urgently formulate policy to implement reservation in Private Sector so that the downtrodden section of the society is not deprived of their legitimate right to a decent standard of living.

In the modelled ILO estimate India’s position in employment to population ratio in Female stands at 150 in the World which is below even Pakistan and other neighbouring Countries. It indicates that the Country Government is deviated from the Directive Principle of State Policy which provides the Governance Principle to the State to ensure living wage and decent standard of living to its citizen. The criticizers of the reservation should raise the issue of increase of employment to population ratio, so that more and more employment opportunities are created and the unemployment problem is attended appropriately. This will automatically address the grievances of all.

Das had meeting with Shri Santosh Kumar Gangwar ji Honourable Minister of State, Ministry of Finance, Government of India on 11.08.2017. After discussion they submitted a memorandum to the respected Minister urging various steps to be taken for further improvement of conditions of SC/ ST Employees in SBI. The Minister was surprised to hear that since inception no director from Workmen or Officer belonging to SC/ ST was appointed in the Central Board of the Bank. The Minister was kind enough to give immediate direction vide Memo No. MOS(F)/VIP/2017 Dairy No. 551311 dated 14.08.2017 to consider the matter which was forwarded by Ministry of Finance ( Departmental of Financial Services) to the Chairman of State Bank of India vide OM No. 20/22/2017-Welfare Dated 28-08-2017. The matter is still pending.

ELECTION OF NATIONAL FEDERATION OF SBI SC/ST EMPLOYEES

For upholding the democratic tradition and in terms of the provisions of the Constitution of the National Federation, Election for the 5 (five) positions of National Working Council was held for the Triennial period 2017-2020 on 15th June, 2017 with participation of delegates from all Circle at the Conference Hall of the Administrative Office, Guwahati. Shri R. P. Singh, the General Secretary of Lucknow Circe was unanimously elected as the National President w.e.f. 01/07/2017 consequent upon superannuation of Shri Suresh Kumar on 30/06/2017. Shri Rajat Kumar Das, our General Secretary was re-elected uncontested/unopposed as the Secretary General of the National Federation which has been a great pride for the Circle and recognition of his dynamic and charismatic leadership of unput downable wisdom. All the members of the entire Circle was very jubilant at his re-election. Besides the President and Secretary General, Shri B.R. Solanki, General Secretary of Ahmedabad Circle was elected as the Sr. Vice President, Shri Banshidhar Sethi, General Secretary of Bhubaneswar Circle was re-electedas Addl. Secretary General Shri Bhupen Hazarika, Treasurer of our circle elected as Treasurer General and K L Chavan,General Secretary of Bangalore Circle was co-opted as the Core Committee Member of the National Federation.

To pay a rich tribute for his great contribution, Comrade Tumung was offered a befitting felicitation and a warm send-off on the eve of his superannuation in a Special General Meeting organised by SEWA (NE Circle) on 18th June’ 2017 (Sunday) in the Shilpagram auditorium at the at Panjabari, Guwahti in presence of many eminent personalities. The meeting was inaugurated by none other than the Chief General Manager of our Circle Shri PVSLN Murty in presence of our Circle CDO Shri Kaushik Sinha, DGM (B&O) Shri Jogesh Ch. Sahu, Dr. H.S. Rana, Principal Director of IIPA, Bangalore,

our National President Shri Suresh Kumar, the entire leadership of National Federation, former National President Shri Kanwar Singhji, eminent personality & former Director of SBI Shri Ananta Kalita, former Circle Presidents of the Association Shri S.S. Pegu and B.C. Rabha and others. Coinciding with the felicitation of Comrade Tumung, our National President Comrade Suresh Kumar was also richly felicitated on the eve of his superannuation on 30/06/2017.

The event has been very colourful and memorable with variety of traditional cultural programmes of all the North Eastern states in a jam-packed house of more than 1000 members & their families with rich deliberation from all the dignitaries and eminent personality present in the meeting.

NATIONAL LEVEL WORKSHOP ON RESERVATION POLICY

A two days National Level Workshop on Reservation Policy for all Circles General Secretaries and Presidents including Reservation Cell In-charges of all the Circles was organised by the Corporate Centre at Hotel Lily, Khanapara, Guwahati on 16th and 17th June 2017. The workshop was inaugurated by Shri PVSLN Murty, the Chief General Manager of NE Circle in presence of DGM & CDO Shri Kaushik Sinha, Dr. H.S. Rana, Principal Director of IIPA, Bangalore & a renowned Authority & Resource Person on Reservation Policy, Secretary General Shri Rajat Kr Das & President Shri Suresh Kumar of National Federation and all the General Secretaries & Presidents of all the Circles.The workshop was conducted by Dr. H.S. Rana at the invitation of the Bank.

The Circle level Quarterly Structured Meeting was held at LHO Guwahati with the representatives of

SBI SC/ST Employees Welfare Association, NE Circle on last 14th March. 2018. On behalf of the Circle Management , the meeting was attended by the Chief General Manager of the Circle Shri P V S L N Murty, both the General Managers Shri Om Prakash Mishra and Shri Digmanu Gupta, Circle Development Officer Shri Ashish Kumar Biswas, DGM (B&O) of Guwahati Module Shri Jogesh Chandra Sahu, Assistant General Manager (HR) Shri Dulal Choudhury , the Liaison Officer at Head Office & Assistant General Manager Shri Swapan Mandal and other HR functionaries of the Bank. made by the Welfare Association and more particularly by its membership as a part of Team North East towards development of the Circle despite facing challenging situations having been posted in far flung areas. Both the General Managers Shri Om Prakash Mishra and Shri Digmanu Gupta also acknowledged the positive approach of the Association vis-a-vis the Circle issues and for maintaining all along a cordial relationship with the Bank management which is essential for development of any institution. DGM (Jorhat) Shri Debashish Mitra, AGM (HR) Shri Dulal Choudhury , the Liaison Officer Shri Swapan Mandal and other functionaries for having their maiden meeting with the Association. He also elaborated the noble and positive role played by the Association in nation building by its unstinted efforts to uplift the down trodden of the society through its various initiatives. The agenda and the issues of the meeting were mainly taken up by the General Secretary Shri Rajat Kr. Das through his logical and articulated deliberation. Among the issues, the most important were the preparing the road map for revamping the liaison mechanism for SCs/STs in terms of the recent Corporate Centre instruction

to man the positions of Liaison Officers from among the SC/ST Officers only, which had a logical conclusion due to the constant efforts of the Association. The others issues taken up with fruitful achievement were posting of SC/ST officers at LHO and AOs in proportion to reservation percentage, verification of Caste/Tribe certificates from the issuing authorities & migration validity, conducting of pre-recruitment training in a convenient location for the trainees after due consultation with the Association, and inclusion of few lectures regarding Govt. Policy on reservation for SC/STs and to earmark 25% of the seats for SC/ST employees while drawing up training programs etc.

The National Federation of SBI SC & ST Employees is the apex body of all the 16 (sixteen) Circles of State Bank of India representing the entire country. It is registered at New Delhi, having its Head Quarter at Guwahati. Out of the total 2, 65,587 employees in

SBI, 49,167 belong to SC and 20,656 belong to STcommunities. Thus, SC & ST represents 26.29% of the total employees’ strength in our Bank as on Dec 2017. Our National Federation is the only Organisation in SBI representing this 26.29% of Employees belonging to SC & ST. Thereby we are the largest SC/ST employees organization in the financial sector of the Country. It is a matter of pride that our National Federation is a classless association having members from Sub-staff cadre to the level of Assistant General Manager in SBI. Thus National Federation of SBI SC & ST employee is playing a very significant role in the progress and growth of our Bank along with safeguarding the interest of the SC & ST employees within the ambit of Constitutional provisions, reservation policies of the Government of India and the Bank.

Our Bank, State Bank of India, is number one employee caring organization in the Country. We are proud that under the Chairmanship of Shri Rajnish Kumar and HR head of the Bank DMD & CDO, Shri Prashant Kumar our Bank is taking special care for the development of SC /ST employees in the Bank. The Bank has extended the following facilities to our Federation and all our affiliated Circles which have made us enable to work for safeguarding the interest of SC /ST Employees.

(a) Office accommodation with required furniture fixtures and telephone connection.

(b) Check off facility for realisation of membership subscription and crediting the same to Association account.

(c) Immunity from transfer to three (3) Principal office bearers in each Circle.

(d) Holding quarterly meetings at Corporate Centre of the Bank, each Circle level and each module level in the Country.

(e) Posted Liaison Officer to the rank of General Manager at Corporate Centre, Assistant General Manager at LHO and Chief Manager at all Administrative Offices.

(f) Sanctioning liberalised housing loan to ST employees on the guarantee of spouse or nominee of the Provident Fund to the tune of Rs. 30 lacs where mortgaged of land is not possible.

The situation needs further improvement and we submit hereunder the core grievances for kind consideration by the Committee.

ISSUES RELEVENT TO STATE BANK OF INDIA

1. REPRESENTATIONS OF SC ST IN STATE BANK OF INDIA DO NOT CONFORM IMPLEMENTATION OF RESERVATION IN EMPLOYEMENT.

The following is the total employees strength vis a vis SC /ST Employees in SBI as per HRMS Dashboard as on Dec 2017.

The above representations of SC /ST employees do not confirm the correct position of implementation of reservation in SBI. In Banks, reservation is applicable in Group C and D i,e Clerical and Subordinate cadre and first stage of Officers grade that is JMGS –I. Thereafter

concession is applicable in promotion from JMGS – I to MMGS-II and MMGS – II to MMGS – III. As per Government of India instructions and reservation policy SC /ST employees selected or promoted on own merit without availing reservation or concession are to be treated as General and not SC / ST. The above figures have included those employees selected or promoted on own merit. So the actual position of shortfall or backlog of SC /ST employees remained unknown.

Hence the Bank Authority may kindly be directed to correct the position immediately to ascertain the actual backlog or shortfall to initiate necessary steps for filling up of those posts.

The updated reservation roaster also needs to be updated in Banks website.

2. INADEQUATE REPRESENTATION OF SC & ST OFFICERS IN HIGHER ECHELONS (DGM AND ABOVE POSITIONS) IN SBI

In State Bank of India the major decisions are taken from the level of DGM & above. As per Article 12 of the Constitution of India, State Bank of is a “STATE”.Hence, SBI assumes a very significant role to ensure adequate representation of SC /ST Officers in the higher echelons of the Bank in terms of Article 16 (4 )(A) of Constitution of India. But in SBI the representation of SC is only 4.69 % and ST a mere 1.22 % in DGM and above positions despite having about 27% SC & STEmployees in the Bank.

The Parliamentary Committee may kindly take a note of this situation of total negligible representation of SC / ST Officers at decision taking level in the Bank and advise necessary roadmap to the concerned authorities for corrective steps.

3.REVISION OF ELIGIBILITY CRITERIA IN PROMOTION TO JMGS –I & TRAINEE OFFICER BY GIVING EFFECT OF ONE YEAR RELAXATION IN SERVICE SENIORITY WHICH WAS IN FORCE IN SBI BUT WITHDRAWN

The System of allowing one year relaxation in service seniority in promotion was in force in SBI but withdrawn through an agreement with the Staff Union on 22.07.2003. Although the Government of India clearly instructed to associate SC /ST members with the negotiating team while negotiating fresh agreement with the Unions vide OM No. 5/9/83-SCT (B) dated 06.07.1984 and No 102/13/1/90- SCT (B) dated 14.09.1990 but our bank had not included our Federation Representative in the Committee constituted in the year 1997 with the representatives of Bank, Staff Federation and academician from Tata Institute of Social Sciences Mumbai based on which Committee recommendation the settlement with the Staff Federation was made on 12th April 1999 and thereafter on 22.07.2003. Through these two agreements the available facilities for the SC /ST employees for their career lift has been ceased contrary to the reservation policy in force. This step of the Bank has very adversely affected the interest of SC /ST employees in SBI.

The matter was represented to the Deputy Managing Director (HR) & Corporate Development Officer vide our letter no. NF/CC/F-01/MIS/17-18/37 dated July 05th 2017 for restoration of the facility which has been wrongly withdrawn. The Bank has not yet initiated any corrective steps but went ahead with promotion exercise last year and this year promotion eligibility has been declared without giving effect of this relaxation. The Committee may kindly take the matter into cognizance and issue necessary instructions.

4.BANK SHOULD STOP ALL OUTSOURCING AND ARRANGE FOR PERMANENT RECRUITMENT FOR PROVIDING ADEQUATE

MEANS OF LIVELIHOOD TO THE CITIZENS AS MANDATED IN THE CONSTITUTION OF INDIA UNDER ARTICLE 39,41-43.

State bank of India being State should have created employment opportunities for the citizen of this Country as a part of its Social and Constitutional obligation under the above articles. Unfortunately now almost the entire works which were earlier done by Group D employees have been outsourced through agency system which is nothing but exploitation of the poorer and downtrodden section of the society. The present system is depriving this downtrodden part of the citizens from a living wage and decent standard of living. Therefore outsourcing of permanent job is Anti Constitution. State Bank of India is now the fifth largest employer of the country and the magnitude of such outsourcing is increasing day by day. If this is not stopped through permanent employment this will definitely create frustration to the poor and unemployed youth of the country and they will be derailed from the mainstream of the society.

There are many temporary employees in all Circles who have not been absorbed by the Bank and their large part is belonging to SC /ST communities. The Parliamentary Committee may kindly give necessary direction to form a Committee to examine the matter and stop outsourcing at the earliest and give permanent appointments for the interest of the Nation. The temporary employees should also be offered employement accordingly.

5. BANK CAREER DEVELOPMENT SCHEME (CDS) NEEDS REVISION SINCE IT IGNORED THE JUDGEMENT OF HONOURABLE SUPREME COURT OF INDIA AND GOVERNMENT OF INDIA INSTRUCTIONS.

With a view to bring competition among the equals SBI has started grading of its Officers to “AAA” “AA” and “A” through a system popularly known as CDS. In this system even if hundred officials are getting hundred marks each in their AARF only 30% of them are awarded “AAA” rating. As a result of which instead

of competition the system is developing jealously and frustration at large scale. Unfortunately a larger number of SC / ST Officers are at the receiving end of such sudden down gradation under CDS.

While developing such a system SBI has totally ignored the Judgement of Honourable Supreme Court of India delivered against Civil Appeal No. 7631 dated 12.05.2008 in the case Dev Dutt Vs Union of India which has become the law of the land. In compliance of above referred Judgement the Government of India has issued the appropriate OM vide No.21011/1/2005-Estt (A) (Pt – II) dated 14th May 2009 And OM No. 5(1)/2000-GM dated 28th May 2009 but SBI CDS system has completely ignored the above judgement and the instructions given by Government of India through the above OMs. The Committee may be kind enough to issue appropriate direction for urgent review of this system of disparity prevailing in SBI in the name of CDS.

6. APPOINTMENT OF OFFICER AND WORKMEN DIRECTOR FROM SC / ST IN THE CENTRAL BOARD OF SBI.

In terms of power conferred upon Government of India under Section 19 (ca) and (cb) of SBI Act 1955 we have prayed before the magnanimity of our most Respected Prime Minister cum Chairman of 125th Birth Anniversary Celebration Committee of Bharat Ratna Doctor B.R Ambedkar to appoint Officers and Workmen Director from among SC /ST Officers and employees to safeguard the interest and monitor the progress of SC /ST communities. This issue was represented by us in the last Parliamentary Committee meeting held on 09th

February 2015 at Mumbai. As the continuation of our persuasion we had met MoS for Finance Respected Shri Santosh Kumar Gangwar Ji on 11.08.2017 and submitted a Memorandum to him. The Honourable Minister was kind enough to give necessary direction vide Memo No. MOS(F)/VIP/2017 Dairy No. 551311 dated 14.08.2017 to consider the matter which was forwarded by Ministry of Finance ( Departmental of Financial Services) through the Chairman of State Bank

of India vide OM NO. 20/22/2017-Welfare Dated 28.08.2017, but the matter is still pending.

It is a matter of great regret that since formation of State Bank of India no SC / ST Officer or member of Staff has ever been appointed as Director in the Central Board of SBI. We believe that the Parliamentary Committee will definitely take steps in this respect for resolution of this long pending issue.

7. THE SUFFERINGS OF ST EMPLOYEES WORKING IN SEVEN STATES OF NORTH EAST CIRCLE

North Eastern Circle of State Bank of India comprised of Seven States out of which six are ST States. At the clerical level (Group - C) the average reservation percentage of ST is 35% but when the turn of their promotion to Officers grade is coming this percentage is reduced to only 7.5%. Due to lack of proper training and infrastructural facilities a large number of ST employees are also unable to secure marks upto general standard. So they are deprived of promotion which is inviting large scale frustration among them. In SBI written examination is applicable from JMGS –I to MMGS –III and qualifying marks are also decided in each year for such promotion. But due to the lack of knowledge developing facilities and backwardness in North Eastern part of the Country the SC /ST candidates are unable to secure the qualifying marks. As a result despite having vacancies they are not promoted.

Many a time particularly ST vacancies in Officers Cadre in other Circles of the Country could not be filled up due to the non availability of ST candidates whereas North East creates Surplus who are not promoted due to lack of vacancies in that Circle. The Parliamentary Committee may be kind enough to pursue the matter at appropriate level so that percentage of promotion upto MMGS –III for ST candidates of North East is increased and Officers post are filled up in descending order of merit ignoring qualifying mark for SC /ST. Excess candidates otherwise eligible for promotion from ST may be migrated to other Circles through option obtained from them.

In N.E. Circle most of the ST States are within the 6th schedule so the ST employees are exempted from Income Tax Payment so long as they remain posted within 6th Scheduled Areas. But for exigencies of the Bank those employees need to be posted out of the Scheduled Areas and thus they became subjected to Income Tax Payment. In our Bank on promotion employees are also sent on Inter Module Transfer and in the process those ST employees are subjected to Income Tax payment and their salary thus got reduced which is again a discouraging factor to them to opt out promotion. Thereby Bank’s HR policy is standing in the way of augmenting the Tribal Employees’ strength. We therefore urge upon the Committee to take-up the matter with Finance Ministry to extend the benefit of Income Tax Exemption to all tribal employees based on their domicile and not based on place of posting.

Due to high cost of living in North East, Bank is paying compensation @ Rs 7500/- per month to outside officials who are posted to North East Circle. This facility has been extended to the Officers of North East in the event of Inter-State Transfer but not given in the event of home State posting. The burden of high cost of living is applicable to all employees irrespective of their place of posting or cadre. We therefore urge upon the Committee to be kind enough to take steps for extending the benefits to all employees of North East.

8.IMMUNITY FROM TRANSFER OF PRINCIPAL OFFICE BEARER OF OUR ADMINISTRATIVE OFFICE (MODULE) LEVEL WELFARE ASSOCIATION

Our Bank is kind enough to grant immunity from transfer to three Principal Office Bearers at LHO Centre of the Bank but no exemption has been extended to Principal Office Bearers of our Module level Welfare Association. In SBI the module covers the vast areas covering 4 to 7 regions comprised of 100 to 500 branches in each module. Therefore our Principal Office Bearer of the module that is Deputy General Secretary needs to remain there to safeguard the interest of SC /ST Employees by taking up their cases of discrimination, deprivation,

and victimization with the Module level Officials of the Bank. We therefore pray before the Committee to be kind enough to give necessary direction to the Bank Authorities for granting transfer immunities which is available to other Union/ Associations to our Module Level Deputy General Secretaries.

9.NATIONAL FEDERATION SHOULD BE ASSOCIATED WHILE NEGOTIATING ANY AGREEMENT WITH THE UNIONS

As per the Government of India Office Memorandum No. D.O.No.5/9/83-SCT(B) dated 06.07.1984 and No. 102/13/1/90-SCT(B) dated 14.09.1990and instructions contain 9.5(a)(b) and 9.6 of Compendium on reservation issued by Ministry of Finance vide file no. 19/4/2014-Welfare dated 23.12.2014 while negotiating fresh agreements with the Unions, endeavour should be made to associate a member belonging to SC/ST Communities with the negotiating team constituted by the Bank. Where an SC/ST Officer of adequate seniority is not available, the Liaison Officer for SC/ST appointed by the Bank may be associated with the negotiations. The Bank should be directed to associate the representative of our Federation in such negotiations to safeguard the interest of SC /ST Employees.

10.IMPROVEMENT IN LIAISON MECHANISM

The Bank has improved the liaison mechanism in the month of July 2017 by nominating Liaison Officers for SC / ST from Corporate Centre level to Administrative Office level from among the SC /ST Officers which is a landmark step. To make the liaison mechanism more purposeful instead of nomination of Liaison Officer permanent posting of liaison officer needs to be done so that the concerned liaison officers remained responsible for their jobs relevant to implementation to the reservation. Nominated Liaison Officers cannot look into the matter relevant to reservation due to their existing workload. At Circle level the Liaison Officer should be appointed to the rank of Deputy General Manager for effective functioning of the mechanism.

11.EXTENSION OF RESERVATION FOR PROMOTION FROM MESSENGER CADRE TO CLERICAL CADRE

At present there is no reservation in our Bank for promotion from subordinate cadre to clerical cadre in view of the Government Instructions that reservation is inapplicable when the component of direct recruitment is more than 75%. But in our Bank the number of posts at clerical cadre is earmarked to be filled up by promotion from subordinate cadre and this portion is not filled up through direct recruitment. So reservation should have been extended in such promotion to give the benefit of reservation to the lowest class of employees and thereby ensure social justice could be ensured to them.

12.PROVISION OF 15 DAYS UNION LEAVE IN A CALENDER YEAR FOR MINIMUM 7 OFFICE BEARERS OF THE CIRCLES

With a view to resolve the grievances of SC/ST employees throughout all the Circles our leaders need to visit far-flung Branches. They also require meetings with various level functionaries of the Bank for amelioration of grievances located at various centres. In the absence of union leave, their leave balance many a time got exhausted and they became unable to respond to the causes.

In our Bank the system of union leave is in existence for the union/association leaders. The same kind of leaves to the extent of 20 days are granted to SC/ST employee union leaders in BSNL and other Public Sector undertakings. We have also requested our Bank to extend the same facilities for our Office bearers in the line of facilities granted to Union/ Association Leaders as stated. The Parliamentary Committee may kindly give a necessary direction in this respect.

13.INTRODUCTION OF PERFORMANCE REVIEW SYSTEM OF CREDIT DELIVERY TO SC/ST BORROWERS FROM RBO LEVEL TO CORPORATE LEVEL

With a view to improve the economic conditions of SC/ST population in the Country, SBI needs to put a

monthly Performance Review System in force from RBO level to Corporate level of the Bank and a monthly Progress Report submission to be introduced for credit delivery among SC / ST borrowers to evaluate their financial progress.

ISSSSUUEES REELEVENT TO MINNISTTRRYY OOFFFFIINNNAANNCCE,, DEEPARTMENT OF FINNAANNCCIIAALLLSSEERRVVVICCEES ANND GOVERNMENNT OOF INNDDDIIAA

1. FINANCE MINISTRY HAS NOT YET REPLIED ON THE POINTS RAISED IN OUR LAST MEMORANDUM TO THE PARLIAMENTARY COMMITTEE

We had submitted Memorandum to the Honourable Chairman and Members of the Parliamentary Committee on the Welfare of SC/ ST Dated on 09th

February 2015 in which Point No. 04, 05, 06, 07, 08 and 13 were relevant to actions to be initiated by the Ministry of Finance, Departmental of Financial Services which is the Nodal Authority for implementation of reservation in financial sector. The Memorandum was forwarded by the Committee Officer, Lok Sabha Secretariat vide No. 8(180)/SCTC /2015 dated 20th

May 2015 to the Secretary , Ministry of Finance with the request to take appropriate action to the matter on priority under intimation to the representationist directly. We have submitted three remainders to the

Secretary DFS on 30th May 2017, 21st August 2017 and 23rd November 2017 but no reply has been received till date. The Parliamentary Committee may kindly take a note of the matter.

2. MINISTRY OF FINANCE NEEDS TO WITHDRAW OM NO. 6/2/2009 TO ENSURE ADEQUATE REPRESENTATION OF SC /ST IN ALL GRADES OF OFFICERS IN SBI AS PER SUPREME COURT OBSERVATION.

In compliance of the observation of Honorable Supreme Court of India in its judgment dated 08.01.2016 that there is negligible representation of employees belonging to SC / ST community at all levels the Ministry of Finance collected data from all the banks including State Bank of India upto MMGS –III and upto Deputy General Manager vide OM No 6/2/2009- Welfare dated 18.07.2016. The data so collected that representation of SC /ST from Scale IV to Scale VI was totally inadequate or negligible but the Ministry seems to appears has close the matter vide OM No. 6/2/2009-Welfare dated 21.10.2016 advising the banks that adequate representation is there upto grade Scale III and there may not be any need to change the existing policy.

The above OM is faulty due to:

1. Honorable Supreme Court observed at all levels butthe Ministry decided up to Scale III level only.

2. The Banks should have submitted data excluding those Officers who have been selected or promoted without availing reservation or concession and are treated as general but Banks has submitted the list without excluding those Officers and thereby a rosy picture emerged which led to deprivation of benefits to SC / ST communities.

3. The RTI reply received from 23 banks and submitted to Finance Ministry on 30th May 2017 shows that at CGM level only 5.5% SC and 2.22% ST, GM level 4.03% SC and 1.61% ST and then DGM level 6.54% SC and 1.87% ST, AGM level 10.02% SC and 2.42% STs in all those banks. Thus the point of inadequate representation is as clear as day light.

We had represented the matter to Finance Ministry vide our letter No. NF/FM/F-01/17-18/05 dated 30the May 2017 for modification of the said OM which has lead to severe deprivation of SC / ST Officers. But no action has been initiated by the Ministry. We had given reminders vide No. NF/FM/17-18/06 dated 21st August2017 followed by another reminder vide remainder NF/FM/F-01/17-18/07 dated 23rd November 2017 but Ministry is totally silent in the matter and deprivation is continuing. We therefore urge upon the Parliamentary Committee to be kind enough to pass necessary direction to the Ministry of Finance for withdrawal of the said OM and issue a modified new OM ensuring adequate representation of SC /ST officers at all levels to end the deprivation.

3. THE APEX BODY OF ALL BANKS, INDIAN BANKS’ ASSOCIATION IS TO BE DIRECTED TO ASSOCIATE OUR FEDERATION IN THE ONGOING BIPARTITE NEGOTIATION.

In terms of instruction contains in clause no. 9.5(a)(b) and 9.6 of compendium of reservation vide file No.19/4/2014- Welfare dated 23rd December 2014 and OM No. 1(50/73-SCT(B), DO No. 5/9/83-SCT(B) and OM No.7/9/89-SCT (B), sincewe are the largest organization of SC /ST in Banking sector, the representative of our federation needs to be included in the ongoing Bipartite negotiation with Employees Union initiated by IBA through which not only this salary but also other service condition will be decided. Ministry level annual review meetings with the SC /ST Employees organizations in financial sector have not been convened for last many years. Those meetings proved to be the finest initiatives by Government of India to ameliorate the grievances of SC /ST employees in financial sector in the past. Specific directions

were given through those meetings to the Financial institutions particularly the Banks to resolve many issues and thus immensely helped to safeguard the interest of SC / ST Employees.

Indian Banks’ Association is although working as a forum of all Banks but not convening any meeting with the SC /ST Employees Welfare Association. The Ministry of Finance also has issued instructions to IBA vide letter No. 10/40/2012-Welfare dated 19/03/2013 but despite of the instructions IBA has not acted positively.

We pray before the committee to kindly look into the matter for convening those meetings.

5. TO MAKE NECESSARY ACT FOR EXTENDING OF RESERVATION IN PROMOTION.

The matter of reservation of promotion to ensure adequate reservation of SC /ST in all grades of Officer

can be resolved by way of making the necessary law by

the Parliament. This process was initiated in the form

of 117th Constitutional Amendment Bill which could

not be passed. We are fortunate that your good office

was kind enough to assure in the general meeting of our

Ahmedabad Circle held on 24th March 2017 that the

matter will be taken up at Government level for bringing

necessary act to ensure reservation in promotion.

Two decade and half century has passed, since we got independence from British colonial rule which

means only political independence not economical and social, which bring some negative elements in the society like castism, racism , etc . The deprived classes of the society whose ancestors have equal contribution in the civil disobedient movement, non cooperation movement but basic right of these people have been denied from the begining The supremacy of the upper caste has kept these negative aspect alive in the society.

Bishnu puran mentions that Chandragupta Maurya is a person from low origin that is “ Shudra but he was a

very able ruler and had conquered Magadh Throne with the help of Chanakya (Kautilya ). So this concludes that - a person is known by his work not by his birth . Now we take an example from world’s longest epic. The Mahabharat “Karna” was the eldest son of Kunti but he was nurtured and brought up by a “Sut” (Shudra ) family so he was called as “Sut putra” and was so brave and powerful that he had created great havoc in the entire battle field of Kurukshetra. Like Karna many other characters in Indian history are found who had not only shown their bravery also saved the society from enemy. The root of dalit/sudra are deeply rooted in Indian society from the begining of the society.

Scheduled fifth and sixth of Indian Constitution are for Scheduled & Tribal areas respectively the term Socialist in the Preamble states that a person can’t be discriminated on the basis of Caste, Colour,

WEAKER SECTION IN DEVELOPED INDIA

Creed, Language, Sex and Religion. Universal adult suffrage which is a core element of Democracy State. Fundamental right like Article 15 - Prohibition of discrimination on certain grounds, Article -17 – Abolition of untouchability, Article 29 – Protection of Minority, Moreover Directive Principle of State policy also prohibited suppression of Minorities that means that our Constitution gives right for protection for SC/ST/ Minority and weaker section of the society .

Although there is a provisions for upliftment for weaker section in our law but there are some malpractices which denigrate the people of these section .

Causes of discrimination against weaker section1. Feeling of superiority : There is a practice of

dominating over certain section of people in the society by other who are enjoying wealth fame, power which is prevalent from very ancient time.

2. Lack of Education : Weaker section in remote areas have lack of educational skills due to which they can be mauled by others according to their wish

3. Certain ethinic practices : There are certain norms , cultures & other religious practices by the people of deprived communities which are considered as unethical improper by the general masses that keep them apart from mainstream but it is also important part for our Indian culture .

4. Improper communication : The means of communication of these people are very poor which debars them from intermixing with the mainstream.

5. Lack of unity : Weaker section of the people have lack of unity for which they can not raise their voice against the any oppression.

Measures for improvement of the weaker section1. Register FIR : FIR must be registered against the

acts done to insult, harass of SC/ST/ weaker section. Very minute enquiry of the cases must be made and it should be free from bias / prejudices.

2. Compensation : There should be a provision in terms of compensastion to the victims apart from the punishment to me culprits, so that it can be a lesson for others.

3. Reservation policy : For upliftment of SC/ST, reservation policy in Govt. & public sector organisation should be implemented properly, so that they can get opportunity to improve their economic condition .

4. Conference for SC/ST : In order to improve the socio economic condition of these section Govt. should organise conference /seminar in every states which will change the attitute of the general people.

5. Education : It is said that knowledge is power, some centres like Skill Development, Job training centre etc should be established for SC/ST and weaker section so that they can chose their livelihood properly.

In order to achieve reasonable balance and development in the society it is very important to bring the deprived section of the society up with mainstream because we can’t deny the contribution of SC/ST people for development of modern India. Developed India means development of all classes of people.

National Commission for Scheduled Tribes under the Chairmanship of Shri Nand Kumar Sai convened

review meeting at Corporate Centre on 14th September 2017. The Bank side was represented by our the then Chairman Smt Arundhati Bhattacharyya along with all top executives of the Bank. Our Federation side was represented by the Secretary General Shri Rajat Kumar Das along with National President Shri R.P Singh, Additional Secretary General Shri Bansidhar Sethi ,Senior Vice President Shri D.R Solanki , Chief Liaison Secretary Shri Anil K Gamre, Treasurer General Shri Bhupen Hazarika and Core Committee Member Shri K.L Chavan. Our Federation submitted a memorandum to the Commission highlighting the following points:

1. Constitutional Provision under Article 16 4(A) for implementation of reservation followed by Government of India OM No. 36012/18/95-ESTT (RES)PT-II Dated 13.08.1997 is to be implemented in our Bank with a view to ensure

2. Appointment of Officer and Workmen Director from among SC/ ST in the Central Board of SBI.

3. Involvement of our National Federation representatives in the ongoing bipartite negotiations and in all internal negotiations in SBI.

4. Improvement of Liaison mechanism for SC/ ST in SBI.

5. Introduction of performance review system in credit delivery to SC/ ST borrowers from RBO level to Corporate Level.

6. Sanctioning of Housing Loans to ST Employees of SBI residing in Scheduled Areas in the Country without insisting for 2 (two) Sureties worth for the amount of Loan.

7. ST Employees selected in Group C positions are to be given posting nearer to their native place in compliance to Government of India order.

8. To stop sudden downgrading of Officers and Employees belonging to SC/ ST in Banks CDS system. This is contrary to the judgement of Honourable Supreme Court of India and Government of India instructions.

9. Sufferings of SC/ ST Employees of 7 (Seven) North Eastern States in respect of payment of Income Tax, Transfer/ Posting, Payment of North East Allowance, etc.

The Commission gave patience hearing on all the points raised in the memorandum and asked for many clarifications which were appraised by the Secretary General. After meeting with our Federation Leadership the Commission had meeting with our Bank Chairman where MD, DMD & CDO, CGM (HR) and all other officials of HR, IR, PM departments were present.

As an outcome of the meeting our Bank has liberalised the Housing Loan to ST Employees in Scheduled Areas for construction of house upto Rs. 30,00,000/- on the guarantee of spouse or nominee of the provident fund. This step is a landmark in the history of our Bank which has also ensured the Right of Dwelling to ST Employees which is also an extended part of Right to Live. Our National Federation conveyed its gratitude to the Bank for such a generous step.

On 4th March 2018 Shri Manhar Valjibhai Zala, Chairman, National Commission for Safai

Karamcharis, Government of India convened a joint review meeting with our North East Circle Management, our Circle Association and Circle Staff Association at Hotel Taj Vivanta, Guwahati. At the outset the Honorable Chairman and other members and officials of the Commission were welcomed by the Bank in a North Eastern traditional way by Shri Om Prakash Mishra, General Manager along with Shri A.K Biswas, Circle Development Officer and other officials of the Bank. It was followed by hearty welcome to the Chairman and the entire team by extending felicitation from our Welfare Association side. Our Circle General Secretary Shri Rajat Kumar Das, President Shri Srikant Deka and all other office bearers participated in the welcome ceremony. Shri Pradip Kumar Baishya, General Secretary and Shri Pranab Kumar Thakuria, President SBISA N.E Circle were also present on the occasion.

Our Association demanded to stop all kinds of outsourcing and arrange for permanent recruitment of Safai Karamcharis (General Attendant) for providing adequate means of livelihood to the citizens as mandated in the Constitution of India under Article 39, 41 to 43. Our General Secretary who is also the Secretary General of the National Federation pointed out that State Bank of India is not only a STATE, Under Article 12 of the Constitution of India, but also the 5th Largest Employer in the Country. Outsourcing is Anti Constitution and a mean of exploitation to the poorer section of the people

This system is creating frustration among poor and unemployed youth of the Country, increasing the magnitude of poverty and attributing derailment of unemployed youths from the mainstream of the Society. If outsourcing is replaced by permanent employment, then 40 to 50 thousand unemployed youths from the poverty ridden section of the society can be employed in SBI in a single day. The Commission assured to take up the matter at highest level. In the meeting our Circle Management confirmed for compliance of all the statutory provisions and guidelines.

Accordingly Shri V Bhargav Kumar and Shri A.S.N Murthy were elected as General Secretary and President of Hyderabad Circle for the triennial period from 2017 to 2020.

Educational and Cultural Safeguards

Article 46: The State shall promote, with special care, the educational and economic interests of the weaker sections of the people, and in particular, of the Scheduled Castes, and the Scheduled Tribes, and shall protect them from social injustice and all forms of exploitation.

Article 15(4): Empowers the State to make any special provision for the advancement of any socially and educationally backward classes of citizens or for SCs and STs.

Article 29(1): Right to conserve distinct Languages, Script or Culture – “Any section of the citizens residing in the territory of India or any part there of having a distinct language, script or culture of its own shall have the right to conserve the same”. This Article has special significance for all the Scheduled Tribes, viz.; Santhals have a script of their own known as Olchiki.

Article 350A: Instructions in Mother Tongue—“It shall be the endeavor of every State and of every local authority within the State to Provide adequate facilities for instructions in the mother- tongue at the primary stage of education to children belonging to linguistic minority groups, and the president may issue such directions to any State as he considers necessary or proper for securing the provision of such facilities”.

Social Safeguards and Statutes and Legislations

Article 17 : Untouchability is abolished and its practice in any form is punishable – Protection of Civil Rights Act, 1955 and Rules there under. Prevention of atrocities upon Scheduled Tribes – The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules 1995.

Article 23: Prohibition of traffic in human beings and beggar and other similar forms of forced labour- The Bonded Labour System (Abolition) Act, 1976

Article 24: Forbidding Child Labour – Various Central and State Law have been enacted to prohibit employment of children below the age of 14 years in any factory or mines or engaging in any hazardous employment.

Economic/ Developmental Safeguards

Article 244(1): Provisions of Fifth Schedule to the Constitution apply to the administration & control of the Scheduled Areas and Scheduled Tribes in any State other than the States of Assam, Maghalaya, Mizoram and Tripura and Tribes Advisory Councils set up in these State are to advise the Governors of these State which have the power to make regulations for the peace and good governance of any Scheduled Area

Article 244(2): Provisions of Sixth Schedule apply to the States of Assam, Maghalaya, Mizoram and Tripura. There are Autonomous District Councils and Autonomous Regional Councils in these Tribal Areas which have a long tradition of self- management system.

Article 275(1): Grants in-Aid to States (having Scheduled Tribes) covered under Fifth and Sixth Schedules of the Constitution. Special Area Programme- Special Central Assistance to Tribal Sub- Plan (SCA to TSP)for grants to the States Governments –as an additive to the State Plan, for areas where State Plan provisions are not normally forthcoming to bring about economic development to tribals.

Service safeguards

Article 16(4): Provides for the reservation in appointments or posts in favour of any backward class of citizens which, in the opinion of the State, is not adequately represented in the services under the State’.

Article 16(4A): Provides for reservation in matters of promotion with consequential seniority to any class or classes of posts in the services under the State in favour of the Scheduled Castes & Scheduled Tribes which, in the opinion of the State, are not adequately represented in the service under the State

Article 16(4B): Provides that “Nothing in this article shall prevent the State from considering any unfilled vacancies of a year which are reserved for being filled up in that year as a separate class of vacancies to be filled up in any succeeding year or years and such class of vacancies shall not be considered together with the vacancies of the year in which they are being up for determining the ceiling of fifth percent reservation on total number of vacancies of that year.

Article 335: Provides that “The claims of the members of the Scheduled Castes and the Scheduled Tribes shall be taken into consideration, consistently with the maintenance of efficiency of administration in the making of appointments, and for relaxation in qualifying marks in any examination or lowering the standards of evaluation, for reservation in matter of promotion to any class or classes of services and posts in connection with the affairs of the Union or of a State”.

The Corporate level structured meeting with our National

Federation was held on 30th October 2017 at State Bank Bhawan, Corporate Centre, Mumbai. The Bank side was represented in the meeting by DMD (CDO), CGM (HR), GM (Law), GM & Liaison Officer, DGM (PM), DGM (IR), DGM (Cadre Management) along with DGM & Circle Development Officers of all Circles. Our Federation team was represented by the Secretary General, National President all Circles General Secretaries and Presidents who are the ex officio Deputy General Secretary and Vice President of our Federation. Treasurer General Shri Bhupen Hazarika also participated in the meeting. The meeting discussed on the following agenda:

1. Confirmation of posting of Liaison Officers from among SC/ ST Officers to Corporate Centre and all the Circles in compliance with Corporate Centre Letter No. CDO/PM/DK/15/515 dated 27th July 2017. Liaison mechanism for SC/ ST in the Bank to be reviewed in the similar line of Official Language Cell. Recommendation to be send to GOI by the Bank.

OUR NATIONAL FEDERATION AT CORPORATE CENTRE MUMBAI

2. Granting 10 days special leave for union activities in the similar line of same type of leave granted to the office bearer of trade unions.

To nominate the name of SC/ ST officer and award staff to Government of India for appointment as Director in the Central Board of the Bank by the Government of India as per provision of SBI Act and Memo No. MOS (F)VIP/ 2017 Diary No. 551311 Dated 14th August 2017 of the MoS Ministry of Finance GOI.

4. Inclusion of National Federation representative in the discussion when any new policy is formulated or any change in the existing policy or agreement is made to safeguard the interest of SC/ ST Employees.

7. Timely and meaningful conduct of all quarterly meetings at all levels and reviews the participants’ numbers in view of expansion of the Bank and increase of numbers of SC/ ST Employees.

8. Extension of basket system in direct promotion to PO/TO/Extra-meritorious JMGS-I to MMGS-II in the light of Supreme Court judgement dated 10/03/1995.

9. Posting of SC/ST support officer with the Liaison Officer at A.U. and review of position in view of

abolishing Deputy Manager Positions in HRs in RBOs.

10. Reintroduction of one year lesser seniority in incadre higher appointment and in promotion to TO/PO/JMGS-I

11. Miscellaneous.

The Corporate Management along with all the Circle CDOs gave a patience hearing on all the issues including various miscellaneous issues particularly downgrading of rating in CDS. It was assured in the meeting that the issues will be examined in due course.

As a follow up of the Corporate Level Structured Meeting a Core Committee Meeting at Corporate centre between our Federation and Corporate Management also had taken place on 07th March 2018 to assess and evaluate the progress on the core issues raised in the corporate level meeting.

The Article 17 of the Constitution of India abolished “untouchability”, forbade its practice in any form

and made enforcement of any disability arising out of untouchability as an offence punishable in accordance with the law. In view of the rampant perpetration of atrocities on SCs/STs, TheScheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, (popularlyknown as SC/ST Act) was enacted in 1989 by the then Rajiv Gandhi Government to give effect to the provisions of the Article 17 of the Constitution forpreventing atrocities and discrimination against the members of SCs/STs, to provide for Special Courts for the trial of such offences as well as relief and rehabilitation of the victims of atrocities. The PoA Act extends to the whole of India except Jammu & Kashmir, and the responsibility for its implementation rests with the State Governments. The Chapter II & III of the Act provides for stringent punishments against offences of atrocities on SC/STs,some of which are as under :

CHAPTER II: OFFENCES OF ATROCITIES3. Punishment for offences of atrocities against a member of a SC or a ST

1. Whoever, not being a member of a Scheduled Caste or a Scheduled Tribe –

i) forces to drink or eat any inedible or obnoxious substance,ii) acts with intent to cause injury, insult or annoyance by dumping excreta, waste matter, carcasses or any other obnoxious substance in his premises or neighbourhood; iii) forcibly removes clothes from the person or parades him naked or with painted face or body or commits any similar act which is derogatory to human dignity, iv) wrongfully occupies or cultivates any land owned by, or allotted to, or notified by any

competent authority to be allotted to a member of a SC or a ST or gets the land allotted to him transferred; v) wrongfully dispossesses from his land or premises or interferes with the enjoyment of his rights over any land, premises or water vi). compels or entices do ‘beggar’ or

other similar forms of forced or bonded labour other than any compulsory service for public purposes imposed by Government, vii) forces or intimidates not to vote or to

vote to a particular candidate or to vote in a manner other than that provided by law, viii) institutes false, malicious or vexatious suit or criminal or other legal proceedings against a member of a SC or a ST, ix) gives any false or frivolous information to any public servant and thereby causes such public servant to use his lawful power to the injury or annoyance, x) intentionally insults or intimidates with intent to humiliate in any place within public view, xi) assaults or uses force to any SC or ST woman with intent to dishonour or outrage her modesty, xii) being in a position to dominate the will of any SC or ST woman and uses that position to exploit her sexually to which she would not have otherwise agreed, xiii) corrupts or fouls the water of any spring, reservoir or any other source ordinarily used by members of the SC or a ST so as to render it less fit for the purpose for which it is ordinarily used, xiv) denies any customary right of passage to a place of public resort or obstructs such member so as to prevent him from using or having access to a place of public resort to which other members of public or any section thereof have a right to use or access to, xv) forces or causes to leave his house, village or other place of residence, shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine.

2. Whoever, not being a member of a Scheduled Caste or a Scheduled Tribe –

(i) gives or fabricates false evidence intending thereby to cause, or knowing it to be likely that he will thereby cause, any member of a SC or a ST to be convicted of an offence which is capital by the law for the time being in force shall be punished with imprisonment for life and with fine; and if an innocent member of a SC or a ST be convicted and executed in consequence of such false or fabricated evidence, the person who gives or fabricates such false evidence, shall be punished with death

(ii) gives or fabricates false evidence intending thereby to cause, or knowing it to be likely that he will thereby cause, any member of a SC or a ST to be convicted of an offence which is not capital but punishable with imprisonment for a term of seven years or upwards, and/or (iii)commits mischief by fire or any explosive substance intending to cause or knowing it to be likely that he will thereby cause damage to any property belonging to a member of a SC or a ST shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to seven years and with fine.

(iv) commits mischief by fire or any explosive substance intending to cause or knowing it to be likely that he will thereby cause destruction of any building which is ordinarily used as a place of worship or as a place for human dwelling or as a place for custody of the property by a member of a SC or a ST,and/or, (v)commits any offence under the Indian Penal Code (45 of 1860) punishable with imprisonment for a term of ten years or more against a person or property on the ground that such person is a member of a SC or a ST or such property belongs to such member, shall be punishable with imprisonment for life and with fine

(vii) being a public servant, commits any offence under this section, shall be punishable with imprisonment for a term which shall not be less than one year but which may extend to the punishment provided for that offence etc.

However, despite all the stringent provisions of the

enabling Act and subsequent PoA Amendment Act, 2015, thedata shows that 75% of the cases resulted in acquittal or withdrawal of charges.The PoA Act is considered to be the biggest weapon against discrimination and atrocities against the marginalised communities like SCs, STs and Dalits. But the records show a abysmally low rate of conviction against a very high rate of atrocities on the Dalit communities.

The March 20 Judgement by the Supreme Court has di-luted the provisions of the PoA Act and thereby caused much consternation and triggered widespread criticism and protest across the country among Dalits includ-ing SC/STs and Adivasis due to their apprehension that the top court’s order will lead to more discrimi-nation and crime against backward communities. Sev-eral Dalit organisations called for Bharat Bandh on April 2 against the Supreme Court’s order. Amid angry protests, violence erupted in many places. The Bandh largely affected parts of Bihar, UP, Punjab, Raj-asthan, Jharkhand, Odi-sha, Delhi and Madhya Pradesh. Several peo-ple were injured and a few protesters died in alleged police firing. Consequently,Union Law Minister had to declare about filing of a comprehensive review petition on the judgment by the Su-preme Court on the SC/ST Act arguing that the denial of anticipatory bail was the very ‘back-bone’ of the 1989 law. Union Home Minister Ra-jnath Singh also appealed to all political parties and groups to maintain peace and not to incite violence.

But what was there in the Supreme Court Judgement?

The judgement in Subhash Kashinath Mahajan us The State of Maharashtra was delivered on March 20 by a two-judge bench of the Supreme Court comprising Justices Adarsh Kumar Goel and Uday Umesh Lalit while examining the question whether there can be procedural safeguards so that provisions of PoA Act 1989 are not abused for extraneous reasons and has since caused widespread dismay for having diluted the PoA Act.

The Bench has issued the following directions;1. There is no absolute bar against grant of

anticipatory bail in cases under the Atrocities Act if no prima facie case is made out or where on judicial scrutiny the complaint is found to be prima facie mala fide.

2. In view of acknowledged abuse of law of arrest in cases under the Atrocities Act, arrest of a public servant can only be after approval of the appointing authority and of a non-public servant after approval by the S.S.P. which may be granted in appropriate cases if considered necessary for reasons recorded. Such reasons must be scrutinized by the Magistrate for permitting further detention.

3. To avoid false implication of an innocent, a preliminary enquiry may be conducted by the DSP concerned to find out whether the allegations make out a case under the Atrocities Act and that the allegations are not frivolous or motivated.

4. Any violation of direction (2) and (3) will be actionable by way of disciplinary action as well as contempt.

Implications :The “directions” of the Supreme Court whether intended or not, make it virtually impossible for any complaint to be registered against those who have committed an atrocity against Dalits or SCs or STs. The 1989 Law, in fact, prohibits anticipatory bail, saying an accused on bail may use his liberty to terrorise his victims. But, in the verdict, the sole anxiety seems to be to prevent arrests from taking place under this law and to ensure that even after the anticipatory bail ban has been upheld as valid and constitutional, it is diluted beyond recognition.

Shri P.S. Krishnan, former Secretary to Union Ministry of Welfare, and currently a member of the National Monitoring Committee for Education of Scheduled Castes, Scheduled Tribes and Persons with Disabilities and who authored the 1989 Act as a civil servant in the then Rajiv Gandhi government, and was associated with the enacting of the 2015 Amendment of the Act, has expressed his distress over the Supreme Court’s judgment on March 20 diluting the PoA Act, 1989 and the PoA Amendment Act, 2015.

As reported, Shri Krishnan wrote a detailed letter immediately after the judgement to the Union Minister for Social Justice and Empowerment, T.C. Gehlot, urging the Centre to issue a strong statement disapproving the Supreme Court’s March 20 judgment and to seek expunging of the observations of the judges, which suggest that the Act is perpetuating casteism. He also wanted the Centre to dissociate itself from Additional Solicitor General Maninder Singh’s statements before the Court, as reported in the Times of India, dated March 21 that the issue of making provision for punishment for false complaints was examined by Parliament, but the government took a stand that awarding punishment to members of SCs and STs for false implication would be against the spirit of the Act.

Shri Krishnan pointed out, the 1989 Act and the 2015 amendment are founded on social realities and constitutional mandates, vide Article 46 of the constitution, which enables the state to promote with special care the educational and economic interests of the weaker sections of the society, in particular, the SCs and STs, and to protect them from social injustice and all forms of exploitation. Any effort on the part of SCs/STs to secure their constitutional rights is visited with severe reprisals, including massacres, mass arson, social and economic boycott, and various kinds of humiliation. “A sample of this evidence needs to be placed before the Supreme Court. These facts are so well-known and notorious that the Supreme Court will be required to take judicial note of it”, the letter says.

Justifying the 1989 Act, Krishnan says because of the juxtaposition of the powerful and the powerless in India’s caste system in every village, it is very difficult

to secure proper investigation and quick and successful trial. Delay in investigation and trial result in intimidation of victims, their survivors, and witnesses by various means including social and economic boycott, which are crippling. Because the caste system is rampant and is inherited over the centuries, caste-based mindset, and biases are widely prevalent among all sections, in all the limbs of the state and institutions, and Krishnan cautions the Centre that the condition of prior sanctions, laid down in the Supreme Court’s judgment, will worsen the already existing long delays in prosecution of atrocity cases and the dilution of Section 18 of the Act by conditions such as those directed in the judgment will encourage such police and other officers who suffer from widespread caste bias, and demoralise and scare the already weak and vulnerable SCs and STs.

Lastly, Krishnan urges the Centre to explore the possibility of requesting the court to recommend the

appointment of judges hailing from SC and STs to the high court and the Supreme Court, so that they can constitute benches to hear such cases, with due sensitivity

Witnessing serious unrest in the Country Government of India ultimately filed review petition before the bench of Justice A.A.Goel and U.R.Lalit through Attorney General for an urgent and open Court hearing of the review petition but failed to convince the bench for early hearing or to stay it’s direction considering the massive protest in the Country that claimed nine lives on 2nd April. When the review petition came for hearing before the bench on 3rd May, the Supreme Court stood by it’s judgement dated March 20th.

Now the entire Country’s eyes are on the Government of India to see what steps they are going to take to protect the SC ST communities from atrocities and crimes against them which are at an increasing trend.

DEENDAYAL ANTYODAYA YOIANA - NATIONAL URBAN LIVELIHOODS MISSION

The key focus areas of DAY-NULM are as follows:

i. Organizing urban poor in Self Help Groups (SHGs)

ii. Creating opportunities for skill development for urban poor leading to market based employment

iii. Helping urban poor to set up self-employment ventures by ensuring easy access to credit.

Major components of DAY-NULM for urban poor are:

1. Social Mobilization and Institution Development (SM&ID): Building community institutions for

urban poor households through thrift and credit based SHGs and their federations.

2. Employment through Skills Training and Placement (EST&P): Providing skill development to

of urban poor to enhance their capacity for self-employment or better salaried employment

3, Self-employment Programme (SEP): Providing interest subsidy Loan assistance through Bank

to individuals/groups of urban poor for setting up gainful self-employment microenterprises

suited to their skills, training and local conditions.

4. Support to Urban Street Vendors: Survey of street vendors, preparation of City Street Vending

Plan, vendors market development, credit enablement, skill development and microenterprises

development. It also seeks to. provide social assistance to urban street vendors through conver-

gence with various schemes of Government.

5. Shelter to Urban Homeless (SUH): Provision of permanent all-weather 24 x 7 shelters equipped

with essential services will be constructed.
