Online institutions have digitized collections.
Better access to works in public domain.Copyrights can last over 100 years.Reluctance to use orphan works.Projects to make works more available.
Copyright law inadequate for 21st century. Not everything posted is public domain. Works need not display the proper copyright notice to be protected. Most works on internet have implied licenses. These can be used different ways.
Implied licenses don’t allow commercial use. Express licenses detail rights granted to reader. Creative Commons license gives Express license. Creative Commons allows non-profit use. Anyone can be liable for copyright infringement.
Libraries license millions of dollars of resources.
Millions of Creative Commons licenses available.
Many works NOT protected.
Many works already licensed for use.
Works that lack originality NOT protected.

Works before 1923 now Public Domain.
Works after 1922 protected for 95 years.
After 1978, terms of protection changed.
Seventy years protection after author’s death.
Provide attribution when using others’ works.
Use the four
factor test to
determine if
you’re covered
under fair use.
The TEACH Act became law in 2002. Educators have almost unlimited
freedom in face-to-face. Grants use of works for educational
purposes only. Distance learning educators are more
limited. Audiovisual works can be shown only
as clips.
Check the Copyright Clearance Center (CCC) for permission services.
