EXECUTIVE SUMMARY FOR INVITING TENDER

Subject: Engagement of Courier Service Agency with Pan India presence for

Handling and Shipment of Drugs Samples for National Institute of Biologicals,

Ministry of Health & Family Welfare, Government of India.

Sealed Tenders under “Two Bid System” are invited for Engagement of Courier Service

Agency having Pan India Presence for Handling and Shipment of Drugs Samples for

National Institute of Biologicals, Noida for a Initial period of 1 Year in the prescribed Bid

forms and Formats enclosed with this document.

Validity of Performance Bank Guarantee

60 (Sixty) days beyond the expiry of the contract period. The Agency will have to extend the validity of the same for extended period (If any).

2. The bidders downloading the tender document from the website- http://nib.gov.in or CPP

portal of Govt. of India, should ensure to submit tender fee of Rs.1,000/- inclusive of UP

VAT in form Demand Draft along with their bid in the Cover - I containing Technical Bid.

3. Two Bid System shall be followed and bidders should take due care to submit tenders in

accordance with the requirements in sealed covers. Bid Evaluation Methodology is given at

Annexure –VI of the Tender Document shall be the basis for evaluation of tenders.

TENDER DOCUMENT FOR PROVIDING COURIER SERVICE

1. INTRODUCTION, GENERAL INSTRUCTIONS AND GUIDELINES FOR THE BIDDER:

1.1. INTRODUCTION NATIONAL INSTITUTE OF BIOLOGICALS is an autonomous Institute under the administrative control of Ministry of Health & Family Welfare, Govt. of India and engaged in the evaluation and quality control testing of various Biological products like Vaccines, Blood Products, Blood reagents, Sera, Immuno-diagnostic kits etc. produced and imported in India. NIB has a state of art laboratory building having area of approx. 15,000/Sqm.

1.2. ELIGIBILITY CRITERIA

a) Only authorized agencies in the business of providing courier service with minimum

experience of 10 years in the services are permitted.

b) The Courier agency is required to have branch offices in all Metropolitan cites, urban

area, semi urban area and Districts of India i.e. having “Pan India Presence”. The

courier service is required to provide a list of its Offices with complete address and

contact information.

c) The Agency should have own well equipped arrangement to pick up and ship any

number of Drugs sample Parcels / Documents.

d) The agency must have carried out similar work during the last 7 (seven) years and

successfully completed at least 3 (three) orders of similar works of value of Rs.10.00

Lakh (Rupee Ten Lakh) each or 1 (one) order of similar works of value of Rs.20.00

Lakh (Rupee Twenty Lakh) in Government/Autonomous Organizations or Public Sector

Undertakings or Reputed Companies. A copy of the award letters for satisfactory

performance is required to be furnished.

e) The details of inputs / information required to be submitted by the agency is given in the

Annexure-I.

f) Average annual turnover for last preceding three years from similar work should be

Rs.300 Crore (Rupee Three Hundred Crore) or more.

g) Bidder should have the ISO 9001:2008 Certification.

h) Bidder must be having helpline numbers & details of dedicated customer support for

online real time tracking system to trace the consignment at any point of time.

i) Tenders received without requisite documents, including Demand Draft of EMD &

Tender fees (if tender is downloaded online), shall not be entertained.

j) Bidders declared by Government of India to be Ineligible/Black listed to participate for

unsatisfactory past performance, corrupt, fraudulent or any other unlawful or unethical

business practices shall not be eligible. An Undertaking in this regard on Stamp Paper

should be provided along with the Technical Bid.

k) The bidder should not be involved in any major litigation that may have an impact of

affecting or compromising the delivery of services as required under this tender. An

undertaking in this regard from the Authorised Signatory to be submitted.

1.3. GUIDELINE FOR SUBMISSION OF TENDER /BIDS

a) Each and every page of the tender document should be signed by Authorized

person / signatory in token of acceptance of the tender conditions along with the

other required documents/details. The bid can be sent by owner or owner’s

representative. Representative will have to enclose the Letter of Authority / the

Power of Attorney along with this Bid Document, otherwise the offer may be

considered null and void at any stage as per the decision of Director, NIB.

b) All the corrections/cutting made anywhere in the tender form will have to be

authenticated with full signature. The corrections without authentication may be

liable to be rejected.

c) The Sealed bids are to be submitted in two separate envelopes

i. TECHNICAL BID: Sealed Technical Bid, along with a Demand Draft of

Rs.50,000/- (Rupees Fifty Thousand only) towards EMD, drawn in favour of

‘NATIONAL INSTITUTE OF BIOLOGICALS - DRUG SURVEY’ payable at

NOIDA/DELHI, and other required documents mentioned in Annexure-I, placed

in sealed envelope super-scribed “TECHNICAL BID - Tender for Engagement

of Courier Service Agency”. Tender Document received without EMD and

prescribed Tender Fee (in case the Tender Document is downloaded online)

shall not be accepted.

ii. FINANCIAL BID: Sealed Financial Bid placed in a separate envelope super-

scribed: “FINANCIAL BID - Tender for Engagement of Courier Service

Agency”.

d) The Envelope No. 1 (Technical Bid) & No. 2 (Financial Bid) shall be sealed separately

and placed in the Third Envelope which also shall be sealed and duly super-scribed

indicating the Name of the Tender and date of the opening and this should be sent on

the below mentioned address:

and must reach to NIB either by Registered Post/Speed Post/Courier or submitted by

hand at Administrative Block or dropping in the Tender box placed at NIB Reception

not later than 3:00 PM on 4th February 2015

e) Tenders received after the stipulated date and time shall not be accepted. NIB shall not

be liable for any postal delays what so ever. Conditional tenders shall not be accepted.

f) The bidder(s) shall quote rates inclusive of all statutory levies, taxes, fees, cesses,

duties, rate charges, surcharges, VAT, Octroi, transport, freight, costs & other taxes

and components etc except Service Tax. No component of cost / tax or any other

charges shall be paid by NIB unless the same is included specifically in the quotations

and agreed by NIB. Rates should be quoted both in figures as well as in words. In case

the rates quoted in words & figures are at variance, the rates written in words will be

taken as final.

g) Pre-Bid Meeting:

a. The Bidder(s) or his official representative, are invited to attend a pre-bid

meeting on date, time and venue specified above. The person should carry

authorization letter and valid Photo ID proof.

b. The bidder is requested to submit clarifications/questions by e-mail/courier / fax

so as to reach NIB at least 2 (Two) days before the scheduled pre-bid meeting.

These questions shall be replied during the pre-bid meeting.

c. Corrigendum(s) and Record Notes of pre-bid discussions, if any, shall also be

available on NIB web site.

d. Non-attendance of the pre-bid meeting will not be a cause for disqualification of

a bidder.

h) The Technical Bid shall be opened on 4th February 2015 at 03:30 PM in National

Institute of Biologicals (NIB), Noida. Bidder or their authorized representatives, (not

more than one person) may be present at the time of opening of tender, if they so

desire. No separate communication will be sent in this regard. In the event of due date

being a close day or declared holiday, the due date for opening of the bids will be the

following working day at the appointed date, time and venue.

i) The Price Bids of only technically responsive bidders shall be opened on a later date,

as may be notified by NIB.

j) NIB reserves the right to reject or accept any tender, and or to annul the bidding

process and or reject all the tenders at any time prior to award of contract, without

thereby incurring any liability to the affected bidder or bidders or any obligation to

inform the affected bidder or bidders of the grounds for NIB`s action.

1.4. Validity of the bids

Bids shall remain valid for 90 (Ninety) days after the date of opening of Technical Bids

prescribed by NIB. A bid valid for a shorter period may be rejected as non-responsive.

However, the rates finalized after opening the tenders shall not increase throughout the

contract period.

In exceptional circumstances, NIB may request the Bidder(s) for an extension of the period

of bid validity. The request and the responses thereto shall be made in writing (or by fax)

by the authorised signatory.

1.5. Amendment of Tender

a) At any time prior to the last date for receipt of Bids, NIB, may, for any reason, whether

at its own initiative or in response to a clarification requested by the Bidders, modify the

Tender by issuing an addendum/corrigendum. Any such amendment issued along with

the original Tender document will constitute Revised Tender.

b) The addendum/corrigendum will be uploaded on NIB website. The Bidders are

requested to visit the website frequently to check for any amendments.

c) NIB may at any time during the Tendering process but before opening the technical bid

request the Bidders to submit revised Technical/Commercial Bids and/or

Supplementary Commercial Bids, in case of change in Scope of Work, without thereby

incurring any liability to the affected Bidder or Bidders.

2. SPECIFICATION OF REQUIREMENTS

2.1 Scope Of Work

a) The Agency will collect about 4,000 Drug Samples Parcels (In Boxes of about size 1.5’

x 1’ x 1’ Feet) from NIB representative in field from all 676 Districts & Union Territories

in India (List Enclosed) as directed by NIB and deliver the Drugs Samples Parcels at

NIB. Further the Agency will also provide Service to pick up about 4,000 Drugs

Samples parcels (In Boxes of about size 1.5’ x 1’ x 1’ Feet) from NIB and to deliver

them at about 35 locations all over India as intimated. Beside this there will be about

4,000 Documents will also to be delivered across the Country.

b) The Agency shall receive drugs samples from NIB representative in the field and pack

these Drugs Samples in Parcels ensuring intactness and integrity, so that it remains in

good condition throughout the period of handling and transit as per industry practice.

The Drug samples parcels should be labelled “Not for Commercial Use”.

c) The Agency shall be responsible for safe custody of the Drugs sample parcels till

delivered at the desired destination.

d) The agency should collect Drugs Samples Parcels on all working days and on holidays,

if there are some urgent requirements.

e) The authorized representative of Courier agency will be required to furnish the receipt

at the time of Drugs Samples Parcels collected.

f) The Courier agency will return the undelivered Drugs Samples Parcels within one

week.

g) The courier agency will ensure that all the Drugs Samples Parcels are delivered to the

recipient to whom it is meant for and in no case is delivered to anybody other than

the recipient or authorised by the recipient.

h) The Courier agency will furnish proof of delivery of Drugs Samples Parcels along with

the bill submitted for payment after getting signature of the recipient, his/her name and

telephone number. The Representatives of Courier Service will write the name and

telephone number of the recipients themselves.

i) The estimated quantities mentioned in the financial offer are tentative for evaluation of

tender only, actual quantities may vary.

j) Stipulated delivery time for Drug samples collected from the field and ship to NIB are as

under:

I. Within 48 hrs. from National Capital Region (NCR).

II. Within 48-72 hrs from other parts of the country excluding North East, Andaman &

Nicobar, Lakshadweep.

III. Within 72-96 hrs from North East, Andaman & Nicobar, Lakshadweep.

k) Stipulated delivery time for Drug samples collected from NIB and shipped to Drug

testing laboratories across the country within 48 hrs.

The Successful bidder will be the official partner of NIB for this work. The successful party will

collect / dispatch about 4,000 Drugs Sample Parcels to be Collected & Delivered from 676

Districts and Union Territories in India (List Enclosed) to NIB and from NIB to the Drug Testing

Laboratories about 4,000 parcels to be delivered to approx. 35 locations across the country.

Besides this about 4,000 payment cheques/ Documents may also require to be delivered

across the Country. Therefore the total No. of Parcels/Documents will be about 12,000. This

Quantity can be increased / decreased by 10%.

2.2 Special Conditions of the Contract

1. Agency should be able to provide NIB the access for online Real-Time tracking

facility of the location of the various Drugs Samples Parcels during the process of

shipment.

2. Special care should be taken while collecting and delivering the Drugs Samples

Parcels containing liquid bottles, ampoules and vials.

3. The Agency should maintain the confidentiality of the Drugs Samples Parcels

collected & delivered and should not share any information/data/detail with other

outside agency without any prior permission in writing from NIB. The Agency will

have to give an undertaking in this regard as per the Annexure-VI.

4. The Agency is required to ensure Transit Insurance of Drugs Samples Parcels.

5. The Financial Bids will be evaluated on the basis of the L-1 rates quoted for

respective Zones as described in the Tender Document. Further NIB also reserves

the right to award the work to more than one Agency as per L-1 rates quoted.

6. The rates in the Financial bid are to be quoted on Zonal Basis i.e. Northern Zone,

Southern Zone, Eastern Zone, Western Zone and North – East (India), & Andaman

& Nicobar and Lakshadweep.

7. Northern Zone- Includes Rajasthan, Uttar Pradesh, Uttrakhand, Delhi (UT),

Haryana, Punjab, Himanchal Pradesh, Chandigarh (UT) and Jammu & Kashmir.

8. Southern Zone- Includes Tami Nadu, Puducherry (UT), Kerala, Andra Pradesh,

Telangana and Karnataka.

9. Eastern Zone- Includes West Bengal, Sikkim, Bihar, Jharkhand and Odisha

10. Western Zone- Includes Maharashtra, Dadra & Nagar Haweli (UT), Goa, Gujrat,

Daman & Diu (UT), Madhya Pradesh and Chhattisgarh.

11. North – East (India), & Andaman & Nicobar and Lakshadweep- Includes

Arunchal Pradesh, Assam, Meghalaya, Tripura, Mizoram, Nagaland, Manipur,

Andaman & Nicobar and Lakshadweep.

3. GENERAL CONDITIONS OF TENDER:

3.1 Period of Contract

a) The contract will be initially valid for a period of 1 (one) year from the date of award of

work.

b) The contract period, if required, may be extended for another 1 (one) year on the same

terms & conditions as mutually agreed in writing on the basis of the satisfactory

performance / services of the agency.

3.2 Termination of The Contract

a) NIB may terminate the contract without assigning any cause by giving 15 (Fifteen)

days’ notice in writing. However, the notice period may be extended by mutual

agreement till alternate arrangements are made. Further, any pending or unresolved

service, function, task, performance, unpaid fees and any other remedies shall continue

by both the parties during the period of termination notice and the same must be

satisfied before this agreement is terminated.

b) The Agency shall have no claim to any payment or compensation whatsoever on

account of any profit or advantage, which would have been derived from the execution

of the work in full, but which he did not derive in consequences the full amount of the

work not having been carried out, neither shall he have any claim on compensation /

damage for the loss suffered by him by reason of termination of agreement by NIB.

c) NIB without prejudice to any other remedy, reserves the right to terminate the Tender /

Contract in whole or in part and also to blacklist the Agency for a suitable period

without giving any notice in case he fails to honour his bid or contract without sufficient

grounds or found guilty for breach of conditions of the tender or contract, negligence,

carelessness, inefficiency, fraud, mischief and misappropriation or any other type of

misconduct by agency or by its staff or agent. NIB’s decision in such a situation shall be

final and shall be accepted by the service provider without any objection or resistance.

In such case of termination, NIB will have the right to put in place any other agency for

carrying out the remaining enrolment work. Any extra expenditure shall be recovered

from the agency.

d) If the successful bidder withdraws or the services provided by the successful bidder are

not found satisfactory during the probationary period of two months from the date of

taking over charge/work, NIB reserves the right to terminate the contract without giving

any notice and initiate appropriate necessary action in this matter for making alternate

arrangements.

3.3 EARNEST MONEY DEPOSIT (EMD)

a) The Earnest Money Deposit (EMD) of Rs. 50,000/- (Rupees: Fifty Thousand only) in

the form of Demand Draft drawn in favour of “National Institute of Biologicals – Drug

Survey” payable at Noida/Delhi and is to be submitted along with the Technical Bid.

b) Tenders received without the prescribed EMD shall not be entertained.

c) The EMD of the unsuccessful bidders will be refunded without any interest or bank

charges. The EMD of the Successful bidder will be refunded after submission of the

Security Deposit/ Performance Bank Guarantee by the Agency.

3.4 IMPOUND OF EMD

EMD of the successful bidder shall be liable to be forfeited if the successful bidder does

not fulfil any of the following conditions:

I. If the Bidder withdraws their offer during the period of tender validity.

II. If after submission of quotation the Bidder fails to honour the contract or refuses to

comply with any or all terms and conditions of the tender.

III. An agreement is not signed in the prescribed form within 15 (Fifteen) days of the

receipt of the Letter of Award of the Contract.

IV. The Successful bidder does not commence/provide Courier services within

15 (Fifteen) days of the award of contract by NIB.

3.5 SECURITY DEPOSIT

The Security Deposit / Performance Bank Guarantee of 10% (Ten Percent) of total

contract value in the form of Demand Draft in favour of ‘National Institute of Biologicals’

payable at Noida/Delhi or bank guarantee from any Nationalized Bank as per the format

given in Annexure-V is to be submitted by the Agency immediately within 15 (Fifteen)

days of the execution of the agreement to cover any loss or damage caused to or suffered

by NIB due to acts of commission and omission by the Agency or any failure on the part of

Agency in fulfilment of terms and conditions of the contract and conditions contained in the

agreement. The bank guarantee should be valid up to 60 (Sixty) days beyond the expiry of

contract period. The Performance Bank Guarantee should also be suitably extended for

the extended contract period (If any).

3.6 PAYMENT TERMS

I. The Agency will submit State/UT wise Pre-receipt bills in duplicate as per the

Financial Bid. The proof of Delivery (PODs) will be preserved and maintained by

courier agency and should be submitted along with the Bills. The Payment will be

made through Cheque /NEFT/ RTGS within 45 (Forty Five) days after scrutinizing

and verifying the same.

II. The Payment will be released after deduction of applicable taxes, if any.

III. In case of untimely or non-delivery of Drugs Samples Parcels etc. or damage to the

drug sample Parcels; NIB reserves the right to deduct the amount from the billing of

the Courier Service.

3.7 LIQUIDATED DAMAGES

I. The timely and accurate delivery of the drug samples parcels

/letters/articles/packets/ documents etc. with utmost promptness is the essence of

this tender. Extensions of the time limit of the delivery of the Drugs Samples

Parcels/packets/articles/ documents beyond the agreed delivery time schedule will

not be given except in exceptional circumstances. In case of delay in delivery

beyond the agreed delivery time schedule, penalty at the rate of 10% (Ten Percent)

of the total courier charges for that consignment, subject to maximum 50% (Fifty

Percent) of total courier charges for that consignment. Quantum of liquidated

damages assessed and levied by NIB shall be final and not challengeable by the

Agency.

II. The Agency shall exercise due care and caution while transporting the

consignments to avoid any damage or loss at any stage. The Agency shall be

responsible for the safety of the consignment in their custody. NIB shall be at liberty

to recover all the damages or any payable amount from the Agency’s bills, if the

Agency fails in taking care of the consignment in its custody.

III. All the material shall be deemed to be in the possession of the Agency and in its

care, custody, risk and responsibility from the moment they have been handed over

to and accepted in writing by the Agency or his representative at the pickup point

and till such time they are delivered to the addressees under proper

acknowledgement. The Agency shall be responsible for any mishap, accident en-

route, the consequences thereof including legal compensations, if any, and payable

during the execution of the contract. NIB shall not be in any way responsible for any

accident or damages incurred or claims arising there from during the period of the

contract.

IV. Subject to clause for Force Majeure, if the bidder, fails to provide the service as

agreed, NIB at its discretion may without prejudice to any other right or remedy

available to NIB in the tender and the Contract, forfeit the entire performance bank

guarantee submitted by the agency, apart from blacklisting of the agency for further

participation in any of the tenders of NIB.

3.8 INDEMNITY

The Courier agency hereby covenants and agrees to indemnify and shall at all times keep

indemnified NIB against any losses or damages that NIB may sustain as a result of the

failure or neglect of the Agency to faithfully carry out its obligations under this agreement or

negligence, carelessness, inefficiency, fraud, mischief and misappropriation or any other

type of misconduct of the Agency or its employees, agents, representatives and further to

pay for all losses, damages, costs, charges and expenses which NIB may reasonably incur

or suffer, and to indemnify and keep indemnified NIB in all respects.

3.9 FORCE MAJEURE

If any time, during the continuance of this contract, the performance in whole or in part by

either party under obligation as per this contract is prevented or delayed by reasons of any

war or hostility, act of the public enemy, civil commotion, sabotage, fire, flood, explosion,

epidemic, quarantine restrictions, strike, lockout or acts of God (herein after referred to

"eventuality"), provided notice of happening of any such eventuality is given by either party

to the other within 21 (Twenty) days of the date of occurrence thereof, neither party shall

be reason of such an "eventuality" be entitled to terminate this contract nor shall either

party have any claim for damages against the other in respect of such non-performance or

delay in performance and deliveries under the contract. The contract shall be resumed as

soon as practicable after such "eventuality" has come to an end or cease to exist. In case

of any dispute, the decision of The Director, NIB shall be final and conclusive, provided

further that if the performance in whole or part of any obligation under this contract is

prevented or delayed by reason of any such eventuality for a period exceeding 60 (Sixty)

days, either party may at its option, terminate the contract. Provided also that if the

contract is terminated under this clause NIB shall be at liberty to take over from the

Agency at a price to be fixed by NIB, which shall be final, all unused, undamaged and

acceptable materials, bought out components and other stores in the course of operation

which may be in the possession of the agency at the time of such termination, or such

portion thereof as NIB may deem fit, except such material as the agency may with the

concurrence of NIB select to retain.

3.10 ARBITRATION

I. In the event of any dispute difference, claims and demands arising between NIB and

the agency in any matter arising in relation or connection or pursuant or touching to

the meaning, operation, effect or interpretation of this tender / agreement directly or

indirectly, the matter shall be referred to the Director, NIB who may himself act as

sole arbitrator or may name as sole arbitrator an officer of NIB notwithstanding the

fact that such officer has been directly or indirectly associated with this contract. The

decision / award of the Arbitrator shall be final and binding on the parties. Cost of

Arbitration will be shared equally by the parties. The Jurisdiction for the arbitration

shall in Delhi/Noida.

II. The Arbitration proceeding shall be governed by the Arbitration and Conciliation Act

of 1996 or any statutory modifications or re-enactment thereof and rules made there

under and for the time being in force shall apply to the arbitration proceedings under

this contract.

III. The proceedings of arbitration shall be in English/Hindi language.

3.11 JURISDICTION

In respect of any dispute arising between NIB and the agency in any matter covered

under this tender / contract or arising directly or indirectly there from or connected or

concerned with the said contract, the courts at Noida/Delhi shall only have the

jurisdiction.

3. NIB shall be at liberty without reference to the bank and without affecting the full liability

liabilities hereunder or to vary the contract or the work to be done thereunder vis-à-vis the

Agency or to grant time or indulgence to the Agency or to reduce or to increase or otherwise

vary the prices of the total contract value or to release or to forbear from enforcement of all or

any of the security and/ or any other security (ies) now or hereafter held by NIB and no such

dealing (s) reduction (s) increase (s) or other indulgence (s) or arrangements with the Agency

or release or forbearance whatsoever shall absolve the Bank of the fail liability to NIB

hereunder or prejudice the rights of NIB against the bank.

4. This guarantee shall not be determined or affected by the liquidation or winding up,

dissolution, or change of constitution or insolvency of the Agency but shall in all respect and for

all purposes be binding and operative until payment of all money payable to NIB in terms

thereof.

5. The bank hereby waives all rights at any time inconsistent with the terms of this

guarantee and the obligations of the bank in terms hereof shall not be anywise affected or

suspended by reason of any dispute or dispute having been raised by the Agency stopping or

preventing or purporting to stop or prevent any payment by the bank to NIB in terms hereof.

6. The amount stated in any notice of demand addressed by NIB to the bank as liable to be

paid to NIB by the Agency or as suffered or incurred by NIB on account of any losses or

damages of cost, costs, charges and / or expenses shall be conclusive evidence of the amount

so liable to be paid to NIB of suffered or incurred by NIB as the case may be and shall be

payable by the bank to NIB in terms hereof.

7. This guarantee shall be a continuing guarantee and shall remain valid and irrevocable

for all claims of NIB and liabilities of the Agency arising up to and until midnight

8. This guarantee shall be addition to any other guarantee or security whatsoever that NIB

may now or at any time anywise may have in relation to the Agency’s obligations/ or liabilities

under and/ or in connection with the said contract, and NIB shall have full authority to have

may have or obtain and no forbearance on the part of NIB in enforcing or requiring

notwithstanding that any security which NIB may have obtained or obtain from the Agency

or unrealized.

10. We the said Bank undertake not to revoke this guarantee during its currency except with

the consent of NIB in writing and agree that any change in the constitution of the said Agency

or the said Bank shall not discharge our liability hereunder.

In the course of discharging of functions as an expert member / special

invitee/ personnel involved in this survey and participating in the meetings of expert

committees constituted for “Survey of Extent of Problems of Spurious and Not of

Standard Quality (NSQ) Drugs in the Country”, you will gain access to certain

information which is privy to NIB / CDSCO / Ministry of Health & Family Welfare, Govt.

of India, as well as that of third parties (such as the State Drug controllers, Public

Health authorities, manufacturers, Chemists, exporters who are involved in regulation

/ manufacturing / distribution / dispensing of drugs). You undertake to treat such

information as confidential and proprietary to NIB / CDSCO / Ministry of Health &

Family Welfare, Govt. of India, the aforesaid parties collaborating with NIB or the

aforesaid third parties as the case may be. In this connection you agree:

i) Not to use the information for any other purpose than discharging your

function as an expert member / special invitees / personnel involved in the

above mentioned survey and all its related activities.

ii) Not to disclose or provide the information to any person who is not bound by

similar obligations of confidentiality and non-use as contained herein.

iii) Not to disclose any information to print / electronic media or on social

networking sites.

iv) You have no vested commercial interest / any other conflict of interest in

obtaining access to any part of the information which will be generated in

this survey.

v) In this connection you undertake to promptly advise NIB of any change in

the above circumstances (sr. no. i to iv), including if any issue arises during

the course of your activities as expert member / special invitee / personnel

involved in these committees.

Any violation of this undertaking shall invite action as per rules and member /

special invitee / personnel’s name involved in the survey shall be deleted

from the committees constituted for conduct of this survey by the Chairman.
