Planning Applications - LargeThis data set comprises of applications for planning permission submitted to local authorities. Developments not requiring planning permission areexcluded. This data is collated, classified and geo-coded by Landmark.

Planning Applications are collected from planning registers throughout Great Britain, using local authority weekly planning lists. There is aprocessing delay of approximately six weeks between applications being lodged with the local authority and the information being available in thisdata set.

Planning permission is required, in most cases for the construction of new structures, or a fundamental change of premises. For England andWales they are granted in accordance with the Town & Country Planning Act 1990 as amended by the Planning and Compensation Act 1991.

For Scotland planning applications are granted under The Town and Country Planning Act 1997.

The data includes large, small and minor applications which are split on the basis of estimated project value. Small applications have a value of lessthan £100,000. Minor applications cover very small works, for example conservatories, car ports and signs.

Decisions are tracked for large applications but information may not be available for older applications dated before October 2006.

In addition to formal planning applications this data set also includes records of potential projects gathered from trade publications, tender requestsand the like. Such records usually have very little detail and may or may not require planning permission should the project proceed.

Areas Benefiting from Flood Defences

Flood Zones are defined by the Government's Planning Policy Statement 25 on ''Development and Flood Risk'' for England (PPS25) datedDecember 2006, which replaces Planning Policy Guidance 25: Development and Flood Risk (PPG25), published in July 2001.The Flood Zones are defined in table D.1 of PPS25 and illustrate the probability of flooding across England for planning consultation. The Zoneshave been identified using the best available data held by the Environment Agency ignoring the presence of flood defences. This data set is Flood Zone 2 (Medium Probability), which comprises areas of land assessed as having between a 1 in 100 and 1 in 1000 annualprobability of river flooding (1% - 0.1%) or between a 1 in 200 and 1 in 1000 annual probability of sea flooding (0.5% - 0.1%) in any year.This definition of Flood Zone 2 applies only in England. Equivalent data is also provided for Wales, although in Wales the data does not have thesame relationship to Planning Policy and is not referred to as Flood Zones.

Flood Zone 3b comprises land where water has to flow or be stored in times of flood. Strategic Flood Risk Assessments (SFRAs) should identifythis Flood Zone (land which would flood with an annual probability of 1 in 20 (5%) or greater in any year or is designed to flood in an extreme(0.1%) flood, or at another probability to be agreed between the LPA and the Environment Agency, including water conveyance routes).These definitions of Flood Zone 3a and 3b apply only in England. Equivalent data is also provided for Wales, although in Wales the data does nothave the same relationship to Planning Policy and is not referred to as Flood Zones.

This data set shows those areas benefiting from demarcated flood defences whereby in a 1% fluvial or 0.5% tidal flood event, areas that wouldotherwise flood are protected, provided that the defences do not breach.

Flood Defences

The Environment Agency's holding of Flood Storage Areas. A flood storage area may be referred to as a balancing reservoir, storage basin orbalancing pond. Its purpose is to attenuate an incoming flood peak to a flow level that can be accepted by the downstream channel. It may alsodelay the timing of a flood peak so that its volume is discharged over a longer time interval.

This is the Environment Agency's holding of Linear Flood Defences. This data set contains all flood defences constructed during the last five yearswith a standard of protection equal to or better than 1% for rivers and 0.5% from the sea. Some additional defences, which may be older or mayhave been designed to provide a lower standard of protection, are also shown where the information is currently available. This layer compriseslinear flood defences, for example flood embankments and walls.

Flood Hazard 75 Year Return Period

Flood Hazard 100 Year Return Period

This dataset describes the surface water and major river flood hazard for 75 year return period for England, Scotland & Wales. A return period isthe statistical probability of the flood happening in any given year. i.e. a 75 year return period is a 1 in 75 chance.

The Risk Management Solutions (RMS) data model does not take into account Coastal/Storm Surge Flooding, Dam Failure Flooding, SewerOverflow Flooding or risk of flooding from the sea. The source data is created using 0.0005 decimal degree grid cells projected using WGS84(Lat/Long). Landmark has translated the data into British National Grid - as a result of the translation, the data does not appear as a regular grid.Due to this re-projection cell sizes will vary across the country.

Two types of major river flood hazard classification are used: defended and undefended. The 'defended' data assumes any flood defences presentwithstand the flood heights for which they were designed. The 'undefended' data assumes that no flood defences are present, representing thepossible outcome if any defences which are present are breached entirely.The defended dataset makes certain assumptions about flood defences around Great Britain. RMS state these assumptions take into account EAdefences, the government defence assumptions from DEFRA, other literature, and discussions with the EA especially around river flood defencesin London and the impact of tidal defences along the river including the Thames barrier.This data has flood depth information, grouped into four bands: 0-200mm, 201-500mm; 501-2,000mm; 2,000mm and over.Surface water flood hazard is defined in this context as flooding from minor rivers, water flowing across the ground or raised groundwater levels.The surface water hazard does not make any account for any flood defences which may be present.

This data set identifies areas prone to the two main types of flooding - inland (fluvial floodplains) and coastal/estuarine, based upon the observationof the types of geological deposit present. The first release of the data set (April 2007) covers England & Wales, but will be extended to Scotlandat a later date. The data set is a digital map based on the BGS Digital Geological Map of Great Britain at the 1:50,000 scale. It was produced by characterisingSuperficial (Drift) Deposits on this map in terms of their likely vulnerability to flooding, either from coastal or inland water flow. These SuperficialDeposits are considered 'recent' in geological terms, most having been formed in the later parts of the Quaternary geological period (i.e. within thelast few tens of thousands of years). Observations made during recent major inland and coastal flooding events have demonstrated that theerosion and deposition of these recent geological sediments have produced subtle topographical variations, resulting in landforms such as fluvialand coastal floodplains. The mapping of these landforms, in conjunction with the fluvial and/or coastal deposits that underlie them, has in turndetermined the extent of previous coastal and inland flooding. The data set does not take into account any man-made influences such as flood protection schemes, nor does it take into account the possibility offlooding onto low-lying ground that is not occupied by the 'indicator' deposits described above.

This data set is the first national hazard or susceptibility data set of groundwater flooding. The first release of the data set (April 2007) coversEngland & Wales, but will be extended to Scotland at a later date. Groundwater flooding is increasingly recognised as a hazard and can be defined as the emergence of groundwater at the ground surface, or therising of groundwater into man-made ground under conditions where the normal range of groundwater levels is exceeded. Based on geological andhydrogeological information, digital data has been used to identify areas where geological conditions could enable groundwater flooding to occurand where groundwater may come close to the ground surface. The data set defines areas with one of five levels of groundwater susceptibility,ranging from high susceptibility to negligible or no susceptibility. Areas with no data represent areas with no susceptibility to groundwater flooding.The resolution of the modelled output is 50m by 50m cells. The data set is a hazard data set, not a risk data set, meaning that it does not provide any information about the likelihood of a groundwaterflooding event occurring.

OS Land Form PROFILE Spot Heights

Ordnance Survey's Land-Form PROFILE contour data is a data set representing the physical shape of the real world within Great Britain.Contained within this data set are height contours, and high and low water marks. Contour data has been captured from Ordnance Survey's1:10,000 scale mapping, with high and low water marks from Ordnance Survey 1:1,250, 1:2,500 or 1:10,000 scale digital data. The OrdnanceSurvey 1:10,000 scale mapping was re-contoured as part of a programme, completed in 1987, using photogrammetric techniques. Some smallareas, which were not visible on the photography, were surveyed by ground methods. The height contours are at 5 m intervals, except in mountainor moorland areas where the interval is 10 m. Indexed contours are present at 25 m intervals, 50 m in mountain or moorland areas. Height values are given to a resolution of 1 cm but will have an accuracy dependent on the survey method used to fix the height. In areas with a 5 mvertical interval the accuracy of the contours has been found to be of the order of ±1.0 m root mean square error (RMSE). For areas with a 10 mvertical interval the accuracy is of the order of ±1.8 m RMSE. Land-Form PROFILE is supplied in tiles, each tile covering an area of 5 km by 5 km, with 10,577 tiles in the series.

Land-Form PROFILE Air Heights define the height above sea level at a single point. Air Heights are recorded to the nearest 1.0 m and typically follow Hill tops, valley junctions, low-lying areas and river crossings. Selected AirHeights are captured from Ordnance Survey's 1:10,000 scale mapping and this is supplemented by Spot Heights, and high and low water marksfrom Ordnance Survey 1:1,250, 1:2,500 and 1:10,000 scale digital mapping data.

Land-Form PROFILE Spot Heights define the height above sea level at a single point and were fixed by ground survey methods, mainly spiritlevelling, at the time the national bench mark network was established and are normally positioned along the centre of roads (recorded to thenearest 0.1 m). Some additional Spot Heights were surveyed using height traversing techniques to supplement Air Heights in areas of sparsecontrol. Selected Spot heights are captured from Ordnance Survey's 1:10,000 scale mapping and this is supplemented by Air Heights, and high and lowwater marks from Ordnance Survey's 1:1,250, 1:2,500 and 1:10,000 scale digital mapping data. In confined circumstances (for example ancientearthworks) where the topography is depicted by slope symbols instead of contours, a single central Spot height is captured. On extended features,spot heights are captured at intervals of 750 m.

OS Contour Data

OS Land Form PANORAMA ContoursThe OS PANORAMA product is a dataset representing the physical shape of the real world, and contains contour data within Great Britain.Contained within this PANORAMA contour dataset are 726,882 height contours, 50,452 lakes, 9785 coastlines, 216,074 formlines (asupplementary contour not corresponding to the normal contour vertical interval and estimated from surrounding contours), 1088 breaklines (a lineindicating an abrupt change in gradient), 1057 ridgelines, and 14,940 spot heights.

The PANORAMA data has been captured in 812 20km by 20km tiles, and the contours were created from height elements depicted in theLandranger® 1:50 000 scale map series (compared to 1:10,000 scale mapping for the OS PROFILE product). PANORAMA contour features areat 10 m elevation intervals (compared to 5m elevation intervals in the OS PROFILE product), whilst in areas of steep slope (mountain andmoorland) some contours will be omitted therefore contours may occur at greater elevation intervals e.g. 25meters. Where coincident with man-made features, contours may be broken, whilst contours are not shown in active quarries, gravel pits, spoil heaps or open cast mines.

The height/elevation data within this product are normally related to mean sea level at Newlyn. The accuracy of digital contours is typically betterthan 3 m (root mean square error (RMSE)). These refer to the differences between the contour height recorded on the map and the measuredheight (above mean sea level) at the points on the ground represented by that contour.

Land-Form PANORAMA is a frozen dataset and is not updated.

County Council and Greater London Authority Boundaries

This is a boundary data set containing polygon features which define local authority areas. Local authorities are classified as District councils,London Borough councils, Metropolitan District councils and Unitary authorities. These boundaries were sourced from the OS Boundary Linedistrict borough unitary data set. In order to give this data set full GB coverage, the Isle of Scilly boundary has been added from the OS BoundaryLine county data set. Although the Isles of Scilly has been classified as a county council by OS Boundary Line, it is in reality a Unitary authority. Thesource mapping scale for all features within this data set is 1:10,000.

This is a boundary data set containing polygon features which define England's County Council areas and the Greater London Authority boundary.The boundaries have been sourced from the OS Boundary Line county data set, although Landmark have removed the Isles of Scilly boundary andadded this to the Boundaries - Local Authoritiesdata set, as it is better classified as a Unitary local authority, rather than a county council.

A county council is the elected administrative body governing an area known as a county, and exists in a two-tier system where local governmentfunctions are divided between county councils and district councils, county councils being responsible for more strategic services in a region.However, the data set does not have full coverage in England, because in some areas of England a one-tier governmental system of unitaryauthorities or metropolitan districts exists. Typically unitary authorities cover large towns or cities, which are large enough to be independent ofcounty or regional administration. Metropolitan districts are to a large extent the same as unitary authorities after the abolition of metropolitancounty councils, although some functions were taken over by joint bodies such as Passenger Transport Authorities, and joint fire, police and wastedisposal authorities.

The absence of county level administration within Unitary authority and Metropolitan district areas mean that these areas are not represented in thisdata set.

The Greater London Authority (GLA) administers the 1579 km² of Greater London, covering the 32 London boroughs and the City of London, whichare also administered at the local authority level. The GLA was created to improve the coordination between the London borough authorities, andhas responsibility for areas such as transport, policing, fire and rescue, development and strategic planning.

There is a one-to-one relationship between feature key and boundary (e.g. Devon County Council). There is a one-to-many relationship betweenfeature key and feature geometry key as individual boundaries have been chopped to increase the efficiency of spatial queries.

The source mapping scale for all features within this data set is 1:10,000.

the owner of the Property at the date of the Report,any person who purchases the whole of the Property Site, any person who provides funding secured on the whole of the PropertySite,any person for whom You act in a professional or commercial capacity,any person who acts for You in a professional or commercial capacity; andprospective buyers of the Property Site as part of an Information Pack butfor the avoidance of doubt, Landmark shall have no liability to suchprospective buyer unless the prospective buyer subsequently purchasesthe Property Site, and the prospective (or actual) buyer shall not be entitledto make the Service available to any other third party.Accordingly Landmark shall have the same duties and obligations to thosepersons in respect of the Services as it has to You.

effect or attempt to effect any modification, merger or change to theService, nor permit any other person to do so; orcopy, use, market, re-sell, distribute, merge, alter, add to or carry on anyredistribution, reproduction, translation, publication, reduction to anyelectronic medium or machine readable form or commercially exploit or inany other way deal with or utilise or (except as expressly permitted byapplicable law) reverse engineer, decompile or disassemble the Services,Content or Website; orremove, alter or in any way change any trademark or proprietary markingin any element of the Services and You shall acknowledge the ownershipof the Content, where such Content is incorporated or used into Your owndocuments, reports, systems or services whether or not these are suppliedto any third party.create any product which is derived directly or indirectly from the datacontained in the Services

The mapping contained in any Services is protected by Crown Copyright andmust not be used for any purpose outside the context of the Services or asspecifically provided by these Terms.You are permitted to make five copies of any Report, but are not authorised tore-sell the Report, any part thereof or any copy thereof unless you are anAuthorised Reseller. Further copies may not be made in whole or in part withoutthe prior written permission of Landmark who shall be entitled to make a chargefor each additional copy.

VAT at the prevailing rate shall be payable in addition to the Landmark Fees. Youshall pay any other applicable indirect taxes related to Your use of the Services.An individual or a monthly invoice showing all Orders created by You will begenerated subject to these Terms. You will pay the Landmark Fees at the ratesset out in Landmark's or its Authorised Reseller's invoice. The Landmark Feesare payable in full within 30 days without deduction, counterclaim or set off. Youacknowledge that time is of the essence with respect to the payment of suchinvoices. Landmark reserve the right to amend the Landmark Fees from time totime and the Services will be charged at the Landmark Fee applicable at the dateon which the Service is ordered. We may charge interest on late payment at a rate equal to 3% per annum abovethe base lending rate of National Westminster Bank plc.Landmark or its Authorised Reseller shall not be obliged to invoice any partyother than You for the provision of Services, but where Landmark or itsAuthorised Reseller does so invoice any third party at Your request, and suchinvoice is not accepted or remains unpaid, Landmark or its Authorised Resellershall have the option at any time to cancel such invoice and invoice You directfor such Services. Where Your order comprises a number of Services orseverable elements within any one or more Services, any failure by Landmark orits Authorised Reseller to provide an element or elements of the Services shallnot prejudice Landmark's or its Authorised Reseller's ability to require payment inrespect of the Services delivered to You.

Landmark may suspend or terminate Your rights under these Terms without anyliability to You with immediate effect if at any time:-

You fail to make any payment due in accordance with clause 4;You repeatedly breach or commit or cause to be committed any materialbreach of these Terms; orYou commit a breach and You fail to remedy the breach within 7 days ofreceipt of a written notice to do so; additionally, without prejudice to theforegoing, Landmark may remedy the breach and recover the costs thereoffrom You.

If Your rights are terminated under this clause and You have made an advancepayment We will refund You a reasonable proportion of the balance asdetermined by Us in relation to the value of Services previously purchased.Landmark reserves the right to refuse to supply any or all Services to You withoutnotice or reason.

We provide warranties and accept liability only to the extent stated in this clause6 and clause 7.Nothing in these Terms excludes either party's liability for death or personal injurycaused by that party's negligence or wilful default, and the remainder of thisclause 6 is subject to this provision and Your statutory rights. As most of the information contained in the Services is provided to Landmark byothers, Landmark cannot control its accuracy or completeness, nor is it within thescope of Landmark's Services to check the information on the ground.Accordingly, Landmark will only be liable to You for any loss or damage causedby its negligence or willful default and subject to clause 6.o below neitherLandmark nor any person providing information contained in any Services shallin any circumstances be liable for any inaccuracies, faults or omissions in theServices, nor shall Landmark have any liability if the Services are used otherwisethan in accordance with these Terms. Save as precluded by law, Landmark shall not be liable for any indirect orconsequential loss, damage or expenses (including loss of profits, loss ofcontracts, business or goodwill) howsoever arising out of any problem, event,action or default by Landmark.In any event, and notwithstanding anything contained in these Terms,Landmark's liability in contract, tort (including negligence or breach of statutoryduty) or otherwise howsoever arising by reason or in connection with thisContract (except in relation to death or personal injury) shall be limited to anaggregate amount not exceeding £1 million if the complaint is in relation to aReport on residential property and an aggregate amount not exceeding £10million in respect of any other Report or Service purchased from Landmark.Landmark will not be liable for any defect, failure or omission relating to Servicesthat is not notified to Landmark within six months of the date of the issuebecoming apparent and in any event, within twelve years of the date of theService.You acknowledge that:-

Subject to clause 6.o below You shall have no claim or recourse againstany Third Party Content supplier nor any of our other Suppliers. You willnot in any way hold us responsible for any selection or retention of, or theacts of omissions of Third Party Content suppliers or other Suppliers(including those with whom We have contracted to operate various aspectsor parts of the Service) in connection with the Services (for the avoidanceof doubt Landmark is not a Third Party Content supplier). Landmark doesnot promise that the supply of the Services will be uninterrupted or errorfree or provide any particular facilities or functions, or that the Content willalways be complete, accurate, precise, free from defects of any other kind,computer viruses, software locks or other similar code although Landmarkwill use reasonable efforts to correct any inaccuracies within a reasonableperiod of them becoming known to us;Landmark's only obligation is to exercise reasonable skill and care inproviding environmental property risk information to persons acting in aprofessional or commercial capacity who are skilled in the use of propertyand environmental information and You hereby acknowledge that You aresuch a person;no physical inspection of the Property Site reported on is carried out aspart of any Services offered by Landmark and Landmark do not warrantthat all land uses or features whether past or current will be identified in theServices. The Services do not include any information relating to theactual state or condition of any Property Site nor should they be used ortaken to indicate or exclude actual fitness or unfitness of a Property Site

"Authorised Reseller" means an agent or reseller of Landmark whom Landmark has duly appointed to resell its Reports and Services."Content" means any data, computing and information services and software, and other content and documentation or support materials and updates included in and/or supplied by or through the Websites, in Reports or Services or in any other way by Landmark and shall include Landmark developed and Third Party Content."First Purchaser" means the first person, or legal entity to purchase the Property Site following provision of a Report."First Purchaser's Lender" means the funding provider for the First Purchaser"Information Pack" means a pack compiled by or on behalf of the owner or prospective buyer of the Property Site, designed to aid the marketing or purchase of theProperty Site and containing information provided by or on behalf of the owner or prospective buyer of the Property Site."Intellectual Property Rights" means copyright, patent, design right (registered or unregistered), service or trade mark (registered or unregistered), database right or otherdata right, moral right or know how or any other intellectual property right."Order" means the request for Services from Landmark by You."Property Site" means a land site on which Landmark provides a Service.References to "We", "Us" and "Our" are references to Landmark Information Group Limited ("Landmark"), whose registered office is 7 Abbey Court, Eagle Way, Exeter, EX2 7HY. Where You are not ordering the Services directly from Landmark, but from an Authorised Reseller, references to "Landmark" or "We", "Us" and "Our" shall be construed so as to mean either Landmark and/or the Authorised Reseller as the contextshall indicate.References to "You/Your/Yourself" refer to the contracting party who accesses the Website or places an Order with Landmark."Report" includes any information that Landmark supplies to You including all reports, services, datasets, software or information contained in them."Services" means the provision of any service by Landmark pursuant to these Terms, including without limitation, any Report. for any particular purpose nor should it be relied upon for determiningsaleability or value or used as a substitute for any physical investigation orinspection. Landmark recommends that You inspect and take other advicein relation to the Property Site and not rely exclusively on the Services. Subject to clause 6.o below, Landmark shall not be responsible for error orcorruption in the Services resulting from inaccuracy or omission in primaryor secondary information and data, inaccurate processing of informationand data by third parties, computer malfunction or corruption of data whilstin the course of conversion, geo-coding, processing by computer orelectronic means, or in the course of transmission by telephone or othercommunication link, or printing.Landmark will not be held liable in any way if a Report on residentialproperty is used for commercial property or more than the one residentialproperty for which it was ordered.the Services have not been prepared to meet Your or anyone else'sindividual requirements; that You assume the entire risk as to the suitabilityof the Services and waive any claim of detrimental reliance upon thesame; and You confirm You are solely responsible for the selection oromission of any specific part of the Content;Landmark offer no warranty for the performance of any linked internetservice not operated by Landmark;You will on using the Services make a reasonable inspection of any resultsto satisfy Yourself that there are no defects or failures. In the event thatthere is a material defect You will notify us in writing of such defect withinseven days of its discovery;Any support or assistance provided to You in connection with these Termsis at Your risk;

All liability for any insurance products purchased by You rests solely with theinsurer. Landmark does not endorse any particular product or insurer and noinformation contained within the Services should be deemed to imply otherwise.You acknowledge that if You Order any such insurance Landmark will deem suchas Your consent to forward a copy of the Report to the insurers. Where suchpolicy is purchased, all liability remains with the insurers and You are entirelyresponsible for ensuring that the insurance policy offered is suitable for Yourneeds and should seek independent advice. Landmark does not guarantee thatan insurance policy will be available on a Property Site. All decisions with regardto the offer of insurance policies for any premises will be made solely at thediscretion of the insurers and Landmark accepts no liability in this regard. Theprovision of a Report does not constitute any indication by Landmark thatinsurance will be available on the property. Professional opinions contained in Reports are provided to Landmark by thirdparties, and such third parties are solely liable for the opinion provided. For theavoidance of doubt, those parties providing assessments or professional opinionson Landmark products include RPS Plc & Wilbourn Associates Limited, and anyissues with regard to the provision of such opinion should be taken up with therelevant third party.If Landmark provides You with any additional service obtained from a third party,including but not limited to any interpretation or conclusion, risk assessment orenvironmental report or search carried out in relation to a Report on YourProperty Site, subject to clause 6.o below Landmark will not be liable in any wayfor any information contained therein or any issues arising out of the provision ofthose additional services to You. Landmark will be deemed to have acted as anagent in these circumstances and the supply of these additional services will begoverned by the terms and conditions of those Third Parties. In any event no person may rely on a Service more than 12 months after itsoriginal date.If You wish to vary any limitation of liability as set out in these Terms, You mustrequest such variation prior to ordering the Service. Landmark shall use itsreasonable endeavours to agree such variation but shall not be obliged to do so. Time shall not be of the essence with respect to the provision of the Services.Ordnance Survey have undertaken a positional accuracy improvementprogramme which may result in discrepancies between the positioning of featuresused in datasets in the Services and the updated Ordnance Survey mapping.Subject to clause 6.o below, Landmark and its Suppliers exclude all and anyliability incurred as a result of the implementation of such positional accuracyimprovement programme.Where Landmark provides its own risk assessment in connection with anyReport, Landmark shall carry out such assessment with all reasonable skill andcare but shall have no liability for any such risk assessment conclusion which isprovided for information only, save where Landmark conducted the samenegligently, in which case the provisions of clause 6 shall apply. Notwithstandingthe provision of any such risk assessment conclusion you should carefullyexamine the remainder of the Report and should not take or refrain from takingany action based solely on the basis of the risk assessment. For the avoidance ofdoubt, the provisions of this clause 6n apply solely to risk assessmentsconducted by Landmark, and the provision of any other risk assessment by athird party shall be governed by such third party's terms in accordance with theprovisions of clause 6i above.Landmark obtains much of the information contained in its Report from thirdparties. Landmark will not accept any liability to You for any negligent or incorrectentry, or error or corruption in the Third Party Content supplied to Landmark, butLandmark's Suppliers may be liable for such negligent or incorrect entries, orerrors or corruptions, subject to the terms and conditions on which they supplythe Third Party Content to Landmark.

Save where expressly provided, this clause 7 shall apply solely to EnvirosearchResidential Reports (regardless of the result of such Report). Nothing in thisclause 7 shall operate to override or vary the provisions of clause 6.Landmark are prepared to offer, at their sole discretion, and without anyadmission or inference of liability a contribution towards the costs of anyremediation works required under a Notice (as defined below) on the terms of thisclause 7 ("the Contribution")In the event that a Remediation Notice is served on the First Purchaser or FirstPurchaser's Lender of a Property Site under Part II(A) of the EnvironmentalProtection Act 1990 ("the Notice") Landmark will contribute to the cost of suchworks as either the First Purchaser or First Purchaser's Lender (but not both) arerequired to carry out under the Notice subject to the provisions of this clause 7and on the following terms:

the Contribution shall only apply to contamination or a pollution incidentpresent or having occurred prior to the date of the Report;the Contribution shall only apply where the Property Site is a singleresidential dwelling house or a single residential flat within a block of flats.For the avoidance of doubt, this obligation does not apply to anycommercial property, nor to any Property Site being developed orredeveloped whether for residential purposes or otherwise;the Contribution is strictly limited to the cost of works at the Property Siteand at no other site.the Contribution will not be paid in respect of any of the following:Radioactive contamination of whatsoever nature, directly or indirectlycaused by or contributed to or arising from ionising radiations orcontamination by radioactivity from any nuclear fuel or from any nuclearwaste from the combustion of nuclear fuel or the radioactive toxicexplosive or other hazardous properties of any explosive nuclear assemblyor nuclear component thereof.Asbestos arising out of or related in any way to asbestos or asbestos-containing materials on or in structures or services serving the structures.Naturally occurring materials arising from the presence or requiredremoval of naturally occurring materials except in circumstances wheresuch materials are present in concentrations which are in excess of theirnatural concentration.Intentional non-compliance arising from the intentional disregard of orknowing wilful or deliberate non-compliance by any owner or occupier of

the Property Site with any statute, regulation, administrative complaint,notice of violation, or notice letter of any Regulatory Authority.Any condition which is known or ought reasonably to have been known tothe First Purchaser or the First Purchaser's Lender prior to the purchase ofthe Report.Any condition which is caused by acts of War or an Act of Terrorism.Any property belonging to or in the custody or control of the FirstPurchaser which does not form a fixed part of the Property Site or thestructure. Any fines liquidated damages punitive or exemplary damages.Any bodily injury including without limitation, death, illness or disease,mental injury, anguish or nervous shock.Any financial loss in respect of any loss of any rental, profit, revenue,savings or business or any consequential indirect or economic lossdamage or expense including the cost of rent of temporary premises orbusiness interruption.Any losses incurred following a material change in use of, alteration ordevelopment of the Property Site.

The maximum sum that shall be contributed by Landmark in respect of anyContribution shall be limited to £60,000. In the event that more than one Reportis purchased on the Property Site the Contribution will only be payable under thefirst Report purchased by or on behalf of any First Purchaser or First Purchaser'sLender and no Contribution will be made in respect of subsequent Reportspurchased by or on behalf of such First Purchaser, First Purchaser's Lender orany person connected to them.Landmark shall only pay a Contribution where the Notice is served within 36months of the date of the Report.Any rights to a Contribution under this Clause 7 are not assignable in the event ofa sale of the Property Site and Landmark will not make any Contribution after thedate of completion of such sale.In the event the First Purchaser or First Purchaser's Lender wishes to claim anyContribution, it shall notify Landmark in writing within 3 months of the date of theNotice. The First Purchaser or First Purchaser's Lender (as applicable) shallcomply with all reasonable requirements of Landmark with regard to thecommission and conduct of the remediation works to be carried out under theNotice, and in the event the First Purchaser or First Purchaser's Lender (asapplicable) does not do so, including without limitation, obtaining Landmark'sprior written consent to any estimates for such works or complying with any otherreasonable request by Landmark, Landmark shall not be required to pay anyContribution. Notwithstanding the payment of the Contribution by Landmark theFirst Purchaser or First Purchaser's Lender as applicable shall take allreasonable steps to mitigate any costs incurred in connection with the conduct ofworks required under the terms of any Notice.In the event that the First Purchaser or First Purchaser's Lender receives anycommunication from a statutory authority to the effect that there is an intent toserve a notice received under PartII(A) of the Environmental Protection Act 1990they will advise Landmark within a maximum period of two months from receiptof such communication. This clause 7h and the service of any notice under itshall not affect the provisions of clauses 7 e and g, and any suchcommunications, even if advised to Landmark will not operate as notice underclause 7e. Landmark reserve the right at any time prior to a claim for Contribution beingmade in accordance with clause 7 g) above, to withdraw the offer of payment ofContributions without further notice.

You acknowledge that Landmark shall not be liable for any delay, interruption orfailure in the provision of the Services which are caused or contributed to by anycircumstance which is outside our reasonable control including but not limited to,lack of power, telecommunications failure or overload, computer malfunction,inaccurate processing of data, or delays in receiving, loading or checking data,corruption of data whilst in the course of conversion, geo-coding, processing bycomputer in the course of electronic communication, or printing.

If any provision of these Terms are found by either a court or other competentauthority to be void, invalid, illegal or unenforceable, that provision shall bedeemed to be deleted from these Terms and never to have formed part of theseTerms and the remaining provisions shall continue in full force and effect.

These terms shall be governed by and construed in accordance with English lawand each party agrees irrevocably submit to the exclusive jurisdiction of theEnglish courts If any dispute arises out of or in connection with this agreement (a"Dispute") the parties undertake that, prior to the commencement of Courtproceedings, they will seek to have the Dispute resolved amicably by use of analternative dispute resolution procedure acceptable to both parties with theassistance of the Centre for Dispute Resolution (CEDR) if required, by writtennotice initiating that procedure. If the Dispute has not been resolved to thesatisfaction of either party within 60 days of initiation of the procedure or if eitherparty fails or refuses to participate in or withdraws from participating in theprocedure then either party may refer the Dispute to the Court.

Landmark may assign its rights and obligations under these Terms without priornotice or any limitation.Landmark may authorise or allow our contractors and other third parties toprovide to Landmark and/or to You services necessary or related to the Servicesand to perform Landmark's obligations and exercise Landmark's rights underthese Terms, which may include collecting payment on Landmark's behalf.No waiver on Landmark's part to exercise, and no delay in exercising, any right,power or provision hereunder shall operate as a waiver thereof, nor shall anysingle or partial exercise of any right, power or provision hereunder preclude theexercise of that or any other right, power or provision.Unless otherwise stated in these Terms, all notices from You to Landmark mustbe in writing and sent to the Landmark registered office (or in the case of anAuthorised Reseller, to its registered office address) and subject to paragraph ebelow all notices from Landmark to You will be displayed on our Websites fromtime to time.Any complaints in relation to the Services should, in the first instance, be inwriting addressed to the Customer Service Support Manager at the Landmarkregistered office. Landmark or its agents will respond to any such complaints inwriting as soon as practicably possible.A person who is not a party to any contract made pursuant to these Terms shallhave no right under the Contract (Right of Third Parties) Act 1999 to enforce anyterms of such contract and Landmark shall not be liable to any such third party inrespect of any Services supplied.Landmark's Privacy Policy as displayed on the Website governs the use made ofany information You supply to Landmark.
