1. INTRODUCTION

1.1. The Project

1. The Government of Viet Nam has requested assistance from the Asian Development Bank (ADB) to finance the construction of Mong Duong 1 Thermal Power Plant (MD1) (under Loan No.2350 and 2610) which is a coal-fired thermal power electricity generation project with a capacity of 1,000 MW located in Quang Ninh province (Northern part of Vietnam). MD1 comprises of two 500 MW generating units and associated supporting infrastructure whereas Mong Duong 2 power plant is built on the same plot of land under a BOT scheme comprises of two 600 MW generating units.

1.2. Report Purpose

2. MD1 project has been classified as category A in accordance with ADB’s Environmental Assessment Guidelines (2003). To ensure that negative environmental health and safety impacts are minimized and addressed effectively throughout the project implementation and operational phase, MD1’s Environmental Management Plan (EMP), detailing mitigation measures and a monitoring program during various project phases, was developed as an integral part of the Environmental Impact Assessment (EIA) of the Project which was completed and approved by ADB in 2006.

3. This monitoring report is highlighting the environmental monitoring tasks and quality observations performed based on required contents as mentioned in the MD1’s environmental monitoring plan included in the EIA1. The report covers the period from October 2015 to December 2016 and provides a summary of current problems, conclusions and recommendations on how to best mitigate impacts on affected parties and environment.

1.3. Project Implementation Progress

4. The construction of MD1 was completed on 10 October 2015 (unit 1 PAC – Provisional Acceptance Certificate) and 3 December 2015 (unit 2 PAC), and they have been in commercial operation since then up to now.

2. Compliance with applicable government laws, regulations and

requirements

2.1. Applicable Environmental Law and Regulation

• The Environmental Protection Law of the Socialist Republic of Vietnam 55/2014/QH13; • Decree No.19/2015/NĐ-CP of Viet Nam Government, detailing and guiding the

implementation of some articles in the Environmental Protection Law; • Decree 18/2015/NĐ-CPCP of Viet Nam Government, on environmental protection

planning, strategic environmental assessment, environmental impact assessment and environmental protection plans • Circular No. 21/2012/TT-BTNMT from Ministry of natural resources and environment

2.2. Status of compliance with government environmental requirements

5. Given to Environmental Laws and Decrees published by Vietnam Government, MoNRE issued its letter requesting TPMB1 to implement in compliance with the License No. 2881/GP-BTNMT dated on 9 November 2015; the License No.12/GP-TNMT dated on 14 Jan 2016 and the License No. 32/GP-TCMT dated on 22 March 2016. TPMB1 already signed monitoring contract with Environmental Monitoring Center of Quang Ninh Province for conducting monitoring activities as required in the afore-mentioned licenses.

6. Requirements specified in the License No. 2881/GP-BTNMT: the license for discharge into water resources issued by MoNRE on 9 November 2015 as follows:

Monitoring of Waste water Automatic monitoring:

- Automatic continuous monitoring of cooling waste-water at the discharging location to cooling water discharge canal of the Plant, with some parameters such as pH, temperature, extra Chlorine and waste water flow.

- Automatic continuous monitoring of cooling waste-water and domestic water at the after-treatment waste water outlet from waste water treatment plant of the Plant prior to discharging to waste water discharge canal of the Plant, with some parameters such as pH, COD and waste water flow.

Periodic monitoring of waste water flow and quality every 02 months at the discharging location to discharge canal of Mong Duong Power Complex and at the location in the discharge canal of Mong Duong Power Complex prior to discharging to Luong Gac river, with parameters as specified in the Table 1 of this License (including 25 major parameters in the Code QCVN 40:2011/BTNMT).

Monitoring of received water source: - Monitoring location: 01 location at the Luong Gac coastal area, around 200m distance

from discharge point of Mong Duong Power Complex discharge canal to Luong Gac. - Parameters: as specified in the National Code for coastal sea-water quality QCVN

10:2008/BTNMT. - Monitoring frequency: every three (03) months.

7. Requirements in the License No. 12/GP-TNMT: the permit for water resource

exploration and use issued by Quang Ninh Department of Natural Resources and

Environment (Quang Ninh DoNRE) on 14 January 2016 as follows:

Monitoring and supervision of water quality: Monitoring locations: at 02 locations: 01 location nearby water intake of the Pump

Station and 01 location at the upstream of Thac Thay River, 100m distance prior to leading to the Reservoir.

Monitoring parameters: as mentioned in the Code QCVN 08:2008/BTNMT- National Technical Code on surface water quality (A2 column), assure minimum 06 parameters: pH, TSS, BOD5, Amoni, Clorua, Nitrit, Nitrat, As, Sb, Fe, Mn, Hg, mineral lubricants, E. coli, coliform.

Monitoring frequency: every six (06) months.

Monitoring and supervision of water source supplied for potable use: Monitoring locations: 02 locations: 01 location at the clean water tank inside after-

treatment water treatment plant area of Mong Duong 1 TPP and 01 location at clean water tank inside after-treatment water treatment plant area of Mong Duong 2 TPP (after-treatment water supplied for domestic use).

Monitoring parameters: as specified in the Code QCVN 02:2009/BYT - National Technical Code on potable water quality, including: color, taste, turbidity, extra chlorine, pH, Amoni, sum iron contents, Pecmanganat, hardness (CaCO3), clorua, Florua, Asen, sum Coliform, E. coli or fecal coliform.

Monitoring frequency: minimum every three (03) months.

Monitoring of waste water: Production waste water:

- Monitoring frequency: every 03 months. - Monitoring location: 02 locations (at discharge outlet to Mong Duong canal and at the

cooling water discharge point to Luong Gac). - Parameters: pH, DO, TSS, COD, BOD5, sum N, sum P, Sulfur, N-NH4+, lubricants,

Fe, Mn, Zn, Cd, Cu, Pb, Cr(III), Cr(VI), Ni, As, Hg, F-, S2-, extra chlorine, Coliform. - Standard code: QCVN 40:2011/BTNMT

Automatic monitoring of cooling waste water: - Monitoring frequency: continuous. - Location: at cooling water collector pipe. - Supervision parameters: flow, pH, temperature, Chlorine. - Standard Code: QCVN 40:2011/BTNMT.

Automatic monitoring of waste water: - Monitoring frequency: continuous. - Location: at waste water discharge piping to the discharge canal. - Supervision parameters: flow, pH, temperature, Chlorine. - Standard Code: QCVN 40:2011/BTNMT.

Monitoring of surface water: - Monitoring frequency: every 03 months. - Monitoring locations: water supplied to the Plant from Thac Thay River. - Monitoring parameters: pH, DO, BOD5, COD, SS, Amoni, sum N, sum P, sum mineral

lubricants, As, Cd, Pb, Hg, Cu, Zn, Fe and Coliform. - Standard Code: QCVN 08:2008/BTNMT.

Monitoring of sea-water: - Monitoring frequency: every 03 months. - Monitoring locations: 03 locations (cooling water intake, 100m distance from Luong

Gac coastal, after the discharge point from discharge canal). - Monitoring parameters: temperature, pH, TSS, DO, BOD5, COD, N-NH4+, Cl-, P-

PO43, surface active agent, lubricants, As, Cd, Pb, Hg, Cl, Coliform. - Standard Code: QCVN 10:2008/BTNMT.

Monitoring of atmosphere: - Monitoring frequency: every 03 months. - Monitoring locations: 03 locations (inside Plant boundary). - Monitoring parameters: temperature, noise level, humidity, dust, CO, SO2, NO2. - Standard Code: QCVN 05:2013/BTNMT; QCVN 26:2010/BTNMT.

3. THE MONITORING RESULTS DURING OPERATION

9. During operation phase, TPMB1 has been closely coordinating with the Consultant

(ENVIRONMENTAL MONITORING & ANALYSIS CENTER (EMAC), QUANG NINH PROVINCE and ENVIRONMENTAL MONITORING CENTER of Viet Nam environment administration) to conduct environmental monitoring activities for MD1 in compliance with the Permits/Licenses which were granted by Authorized Agencies. Scope of work of the Consultant is monitoring and evaluation of environment value according to Permit No.2881/GPBTNMT dated 9 November 2015; 12/GP-TNMT dated 14 January 2016; and 32/GXN-TCMT dated 22 March 2016 (See para. 5). After getting monitoring results, TPMB1 will summarize, give evaluation and submit reports to ADB. Progress:

- ENVIRONMENTAL MONITORING & ANALYSIS CENTER (EMAC), QUANG NINH PROVINCE carried out monitoring work from 1 January 2016 to 30 April 2016 in compliance with the contract No.19/2016/HĐ-NĐMD-TTQT.

- ENVIRONMENTAL MONITORING CENTER of Viet Nam environment administration carried out monitoring work from 1 January 2016 to 30 April 2016 in compliance with the contract No.40/2016/HĐ-NĐMD-TTQTMT.

10. The consultant’s reports were sent to MoNRE and Quang Ninh DoNRE.

11. From October 2015 up to December 2016, TPMB1 implemented following environmental monitoring activities: in 2017, TPMB1 continues to sign one supplementary contract with Environmental Monitoring Center of Quang Ninh Province for monitoring activities as per the contract No. 054/2017/TV.

3.1. Environmental effects monitoring

3.1.1. Ambient surface water quality

12. According to the environmental monitoring plan in the EIA, ambient surface water quality needs to be monitored annually at several locations, however, in 2016, samples were

taken at only one location (MD-NM1, see Table 1) but for four times in every quarter. MD-

NM1 is located upstream of MD1’s waste water discharge point, and its water quality does not indicate MD1’s impact on surface water. Monitoring in line with the environmental monitoring plan will be conducted from 2017.

The 1st instalment: 10 March 2016.

The 2nd instalment: 18 June 2016.

The 3rd instalment: 16 October 2016.

The 4th instalment: 16 December 2016.

13. The results of monitoring conducted on 10 March 2016; all parameters of ambient surface water quality monitoring are under permitted code QCVN 08-MT:2015/BTNMT for national technical regulation on surface water quality.

14. The monitoring samples taken on 18 June 2016; the results showed that several indicators exceeded the permission standard. However, the monitoring location is on the Thac Thay river and before receiving waste water discharged from MD1. The reasons for this exceedance could be explained that it is rainy season, much organic matter (from bodies of death plants and animal) come from upstream and being decomposed which cause high concentration of relevant parameters in the surface water.

15. The monitoring samples taken on 6 October 2016; all parameters of surface water quality monitoring are under permitted code QCVN 08-MT:2015/BTNMT, except for lubricants which exceeded the permitted standard at that time only, lubricants monitoring result of December 2016 is still under permitted limit.

16. The monitoring samples taken on 16 December 2016; all parameters of surface water quality monitoring are under permitted code QCVN 08-MT:2015/BTNMT except for coliform. Due to heavy rain and flood, there are animals and vegetables wastes, so coliform parameter exceeded the permitted limit.

3.1.2. Wind direction and speed

17. Mong Duong Ward is located nearby Cua Ong Ward of Quang Ninh Province, so the climate in Mong Duong is similar to the climate in Cua Ong Ward. Therefore, to get information about wind direction and speed in Mong Duong, it is possible to refer to the monitoring data of Cua ng station via the website: http://thoitiet.mirbig.net/vi/ N/ 0/1584594 C a ng.

3.1.3. Ambient air quality and Noise level

18. Time of monitoring:

The 1st: 10 March 2016.

The 2nd: 20 June 2016.

The 3rd: 26 October 2016.

The 4th: 16 December 2016.

19. Monitoring of ambient air quality and noise level was conducted at 03 positions inside the Plant: MD1-KK1; MD1-KK2; MD1-KK3.

20. The monitoring result is in Table 4.

21. On 10 March 2016, all parameters of ambient air quality monitoring are under permit regulated in national standard QCVN 05:2013/BTNMT.

22. On 20 June 2016, 26 October 2016 and 16 December 2016, all parameters of ambient air quality monitoring are under permit regulated in national standard code QCVN 05:2013/BTNMT except for TSP. However, as the monitored results showed that dust emission from MD1’s 02 Factory chimneys is controlled well within the standard. Therefore, the reasons which caused the TSP level was over standard may come from:

+ The construction activities (from September 2015 to April 2017) of the improvement of National Highway No. 18, which is located about 200 to 500 m from the sampling points and passes by MD1;

+ The coal mining activities at Khe Cham coal mine areas located about 5km from MD1, which discharges a large amount of solid waste mainly rocks to form 200 m height rocky mountain every year as disposal areas. In the dry condition, the dust generated from the mountains covers entire Mong Duong Ward.

3.1.4. Other Parameters

23. Some other parameters such as (i) current velocity; (ii) ambient groundwater quality in existing wells; (iii) heavy metals of ambient groundwater quality; (iv) fisher and aquaculture activity at the project area; and (v) mangrove status; are included in the environmental monitoring plan, but their monitoring was not conducted in 2016. TPMB1 will start monitoring these items in 2017 and report the result to ADB thorough the next monitoring report (covering the period from January to December 2017).

3.2. Project performance monitoring

3.2.1. Emissions Stack Air Quality

24. MD1 installed online monitoring system at 4 stack emission locations (Table 5) for monitoring parameters such as TSP; SO2; NO2…; the system has been transferring the data to Quang Ninh DoNRE for their monitoring. However, the hardware system for Stack 2A and 2B (Unit 1) broke down in 2016 and was replaced in October 2017. The data of the period from the beginning of the operation (October 2015) until October 2017 was lost and cannot be restored.

25. The summary of the online monitoring result is in Table 6 for Stack 2A and Table 7 for Stack 2B.

26. During the monitoring period between October 2015 and December 2016, the emission’s quality (S 2 and TSP) exceeded Vietnamese Standard (permitted code QCVN 22:2009/BTNMT for National Technical Regulation on Emission of Thermal Power industry) for several times. All these cases happened when the boilers started up their operation. The exceedance of the standard was predictable therefore TPMB1 sent a report to Quang Ninh Provincial People’s Committee, Cam Pha District People’s Committee, Mong Duong Commune People’s Committee, and Quang Ninh DoNRE, Quang Ning Department of Public Security in advance of the ignition at each time. This happened for three times for Unit 1 (on 30 September, 16 October, and 22 October all in 2016) and five times for Unit 2 (on 13 October 2016, 27 October 2016, 29 October 2016, 30 November 2018 and 28 December 2016). To avoid the exceedance of emission’s standard and to reduce damage on emission gas treatment system, TPMB1 is planning to change the starting-up fuel from fuel oil (FO) to diesel oil (DO) by October 2018.

3.2.2. Treated Wastewater quality

28. MD1 installed online monitoring system at wastewater discharge location for monitoring parameters such as pH; temperature; extra Chlorine and waste water flow; this system has been transferring data to Quang Ninh DoNRE for their monitoring.

29. The summary of the online monitoring result is in Table 9, although MD1 faced with technical issues which could not extract data of temperature and residual Chlorine from the system.

30. If the system detects pH out of the Vietnamese standard (between 5.5 and 9), the outlet of the wastewater treatment plant will be automatically closed and chemical will be added to the plant to adjust the pH level to ensure the compliance of the environmental standard. The outlet will be reopened only after the pH level is adjusted. This case happened 6 times during the monitoring period. If the chlorine level goes beyond the Vietnamese standard (1.8 mg/l), the system gives an alarm so that the staff can take an action to ensure the compliance of the Vietnamese standard (dilute the wastewater with seawater before discharging). This case has not happened so far.

Other parameters such as COD, BOD, turbidity are monitored every day to assure that the quality of discharged wastewater is under permitted limit as per the code QCVN 40:2011/BTNMT of MoNRE for national technical regulation on industrial wastewater. The summary of the daily monitoring result is in Table 10. Between October 2015 and December 2016, COD, BOD are under the permitted code QCVN 40:2011/BTNMT. There is no applicable standard of Turbidity.

33. At the monitoring time on 26 Feb 2016, all parameters of industrial waste water monitoring are under permitted code QCVN 40:2011/BTNMT. Quality of industrial waste water can be acceptable for discharging.

monitoring are under permitted code QCVN 40:2011/BTNMT. Monitoring result at waste water: Only observed at NT3,4 but not monitored at NT1,2 because it is not required in the license No. 2881 / GP-BTNMT.

35. At the monitoring time (18 June 2016), all parameters of industrial waste water monitoring are under permitted code QCVN 40:2011/BTNMT except for coliform parameter at NT1. The Coliform rate of the treated wastewater (at NT3) is in the permissible limits. The reasons leading to the higher Coliform rate at the NT1 may be because the outlet of the cooling water canal (NT1) is the mixing position of the sewage source of the Mong Duong 1 Thermal Power Plant and the upstream waters. Therefore, it is assumed that the coliform at NT1 exceeded the standard not because of wastewater from Mong Duong 1 plant, but because of upstream water. At the NT4 (middle of waste channel) and NT2 (end of discharge channel), the Coliform rate reduces to the allowed limits as QCVN 40: 2011 / BTNMT because the discharge channel also receives more cooling water from Mong Duong 2 Thermal Power Plant.

36. At the monitoring time (6 October 2016), all parameters of industrial waste water monitoring are under permitted code QCVN 40:2011/BTNMT

3.2.3. Discharged Cooling Water’s Quality (chlorine levels and temperature)

38. At the cooling water discharge points, MD1 has installed the extra chlorine and temperature meter. At present, all points are online connected and can transfer data to Quang Ninh DoNRE for their monitoring, inspection and supervision.

39. Between October 2015 and December 2016, the range of the chlorine level is between 0.5 and 1.9 mg/l, and always controlled less than 2.0 mg/l (QCVN 40:2011/BTNMT).

40. The temperature of the end of discharge channel was measured only for 3 times in 2016. According to the 2016 data of the Center for Environmental Monitoring, the temperature of the cooling water at two locations (inlet of the cooling water/sea water, end of discharge channel) is as follows:

+ On 18/06/2016: Temperature of the inlet of the cooling water: 31,9oC Temperature of the end of discharge channel: 34,5oC Difference: 2,6oC

+ On 6/10/2016: Temperature of the inlet of the cooling water: 32,6oC Temperature of the end of discharge channel: 32,9oC Difference: 0,3oC

+ On 16/12/2016: Temperature of the inlet of the cooling water: 22,6oC Temperature of the end of discharge channel: 25,1oC Difference: 2,5oC

41. Based on these data, at least on those three days when the temperature of surface water was measured, the difference of the input cooling water temperature and the output discharge water temperature is not more than 3oC in difference, which matches with EIA requirements.

3.2.4. Condition of storm water outfall

42. Via inspection and supervision through storm and typhoon, plan of MD1 has not been flooded, so no damage occurred for equipment system and human during the monitoring period.

3.2.5. Condition of oil separators

43. During operation stage, at the locations which are easy for oil spilling, MD1 has designed and installed spillway. After that re-collected oil will be pumped up to oil-mixing wastewater treatment system. There have been no oil spilling cases during the monitoring period.

3.2.6. Quantity and type of aquatic biota captured at intake screen

44. During operation stage up to now; at the cooling water intake screen, only small quantity (about a few kilograms per week) of aquatic biotas such as: shrimp and squid have been captured; after that, these aquatic biotas were gathered and transported to specified areas.

3.2.7. Ash volumes deposited and reused

45. Up to the end of 2016, total accumulative discharged ash volume is 1.063.020 tons. Reused ash volume is 174.072 tons (sold to Enterprises who have demand for re-using ash volume), occupied 16% of the discharged ash volume.

3.2.8. Breaches of security at ash disposal areas

46. To prevent environmental pollution caused by ash pond leachate, MD1 has one deposit water re-circulation system returning from ash pond for discharging ash.

47. The water will be treated with neutralized chemicals prior to returning. Therefore, this system’s water will be operated in the closed circulation manner, and not discharged to the outside.

48. MD1 always arrange security 24/24 hours, and closely coordinate with local police so as to control and assure safety and security around the Plant. Therefore, from MD1 entered commercial operation, there are no safety and security violation at the ash disposal area.

3.2.9. Dumping of waste outside project site or in rivers and Luong Gac

49. During operation stage of MD1, there are no waste dumped outside of the project site such as Luong Gac river. MD1 always arrange classified waste bins at all operational locations of the plant, concurrently require operators to collect and classify waste to the specified waste bins. Collected waste has been transported for treatment by Thuan Thanh Environmental Joint Stock Company (an environmental company that TPMB1 hired) which obtained Business License for Hazardous Waste Management No. 1234.036.VX (05th times) on 28 September 2015 by MONRE. Hazardous waste discharged during the operation stage Includes: waste cloth contaminated by oil, waste oil, grease, asbestos from insulation material, light bulb etc. For normal solid waste: TPMB1 has signed the contract No. 30 / HDKT-NDMD-MTTĐ for transportation and handling of solid waste from 1 April 2016 to 1 April 2018 with Tuan Dat Environmental One Member Limited Company which obtained license for solid waste management from the Department of Planning and Investment of Quang Ninh Province with the first registered No. 5701445969 on 6 December 2010.

3.2.10. General site condition and cleanliness

50. Mong Duong Thermal Power Company always highly concentrates on general site condition and cleanliness so as to assure clean and green landscape.

3.2.11. Covering of trucks

52. At present, Mong Duong Thermal Power Company sells ash to outside companies; to protect surrounding environment, Mong Duong Thermal Power Company always supervise and require the buyer to comply with environmental protection rules; and overload transportation is not allowed to avoid dust polluting outside environment.

53. Via observation and supervision, there is no dust generated outside, so it means that environment inside and outside is clean.

3.2.12. Environmental approvals at source of limestone, fuel oil, chlorine and coal

54. The following licenses were approved at source of limestone, fuel oil, chlorine and coal.

- The License No. 312/GP-UBND of Quang Ninh PC dated 13 February 2014 and Decision No. 786/QD-UNND dated 29 March 2013 on agreement for exploitation of stone to be used as construction material in Dong Vai village, Thong Nhat commune, Hoanh Bo district, Quang Ninh province.

- Decision No. 3443/QD-UBND dated 26 October 2012 of Quang Ninh PC on approval environmental impact assessment for Project of building coal transport system from Khe Cham coal selection company to Mong Duong thermal power plant in Mong Duong ward, Cam Pha city, Quang Ninh province of Cam Pha Vinacomin;

- Confirmation letter No. 04/XN-STC dated 17 July 2015 to confirm the measures to prevent and respond to chemical incidents of AKA Vietnam Joint Stock Company.

- Decision No. 1249/QD-UBND date 27 April 2009 on approval of oil spill incident response at B12 Oil Port.

55. The following is the list of other licenses approved for MD1.

- The License No. 2881/GP-BTNMT; The license for discharge into water resources issued by The Ministry of Natural Resources and Environment on 09 November 2015.

- The License No. 12/GP-TNMT; The permit for water resource exploration and use issued by Quang Ninh DoNRE of on 14 January 2016

3.2.13. Registration papers and compliance certificates of construction vehicles with Government approved environmental emissions standards

56. Time beings, construction stage of the Plant has been finished. Therefore, construction vehicles are not used.

3.2.14. Dust and noise emissions in the vicinity of the coal transfer system

57. Coal transferring system of MD1 is closely covered, dust collectors are arranged at each coal transferring points. Therefore, beyond 500m dust and noise level are not impacted.

4. Mong Duong Thermal Power Company always pays attention to stabilization, rehabilitation and landscaping of all land surfaces affected by the project. Mong Duong Thermal Power Company already planted grass and green trees covering all empty lands of the Plant; green trees, grass and small trees around the Plant are usually looked after by the Company’s workers.

4. Key Environmental Issues

4.1. Key Issues Identified

6. TPMB1 has always complied with environmental requirements specified by Vietnam

Government. During operational period, there are no incidences or accidents occurred.

Environmental issues are complied with applicable laws and standards of Vietnam

Government.

7. TPMB1 has been conducting environmental monitoring and supervision, however,

monitoring of some parameters such as (i) current velocity; (ii) ambient groundwater quality

in existing wells; (iii) heavy metals of ambient groundwater quality; (iv) fisher and

aquaculture activity at the project area; and (v) mangrove status; was not conducted in 2016.

In 2016, TPMB1 did not monitor these parameters due to the confirmation No.32 / GXN-

TCMT issued by the General Department of Environment - MoNRE on 22 March 2016,

which stated "The program of environmental monitoring under this certification replaces the

environmental impact assessment report.", therefore TPMB1 thought that the monitoring of

other parameters required by the licenses (see para 5)) were no longer required. However,

TPMB1 understood in April 2017 that, as ADB's requirement, all parameters in the

environmental monitoring plan in the EIA need to be monitored, and TPMB1 will start the

monitoring in line with the monitoring plan and add the result of monitoring for ADB in the

next environmental monitoring report (which covers the period after 2017).

8. During the monitoring period between October 2015 and December 2016, the

emission’s quality (S 2 and TSP) exceeded ietnamese Standard for several times. All

these cases happened when the boilers started up their operation. The exceedance of the

standard was predictable therefore TPMB1 sent a report to Quang Ninh Provincial People’s

Committee, Cam Pha District People’s Committee, Mong Duong Commune People’s

Committee, and Quang Ninh DoNRE, Quang Ning Department of Public Security in advance

of the ignition at each time. To avoid the exceedance of emission’s standard and to reduce

damage on emission gas treatment system, TPMB1 is planning to change the starting-up

fuel from fuel oil (FO) to diesel oil (DO) by October 2018. (para 26)

9. Ambient air quality (TSP) exceeded the Vietnamese standard, but TPMB1 considers

this is due to external factors (National Highway No.18 improvement activity and coal mining

activities at Khe Cham coal mine areas located about 5km from MD1) because dust

emission from MD1’s 02 Factory chimneys is controlled well within ietnamese emission

standard. (para. 22)

5. Complaints

1. From PAC (Provisional Acceptance Certificate) to date, there is no any complaint from resident who live around the plant about environment of the plant, TPMB1 arrange monthly for resident to go into MD1 to visit and introduce environment treatment system. After each visit, representative of the residents always highly evaluates environment protection of the plant.

Appendix 1: Environmental Team Organization Chart

Technical Department has 19 staff with the main responsibilities for (i) overall management of proper and safe operation of the systems (including environment system), all equipment and machines; (ii) monitoring of operation indicators of all system including the environmental parameters of online system; (iii) and preparation of environmental monitoring report(s) during operation phase for submission to ADB.

Safety Department has 5 staff. The main tasks are to; (i) supervise the compliance of environmental and safety issues of MD1 operation; (ii) conduct periodic environmental monitoring as required by Viet Nam regulations and relevant licenses; (iii) share the monitoring results with Technical Department for the reporting to ADB; (iv) prepare annual environmental monitoring report for Quang Ninh DoNRE (both during construction and operation phase); and; (v) provide safety training to MD1 staff.

Appendix 2: Organization Chart for External Environmental Monitoring

Ministry of Natural Resources and Environment (MoNRE) approved EIA before MD1 construction started and issued operation licenses

4 before MD1 came into operation. During the

operation phase, MoNRE is supposed to conduct site inspection annually. During the monitoring period, MoNRE conducted site visit (with deputy minister) for one time.

Quang Ninh Department of Natural Resource and Environment (Quang Ninh DoNRE) is authorized by MoNRE to supervise and monitor the compliance of environmental requirement of MD1. Quan Ninh DoNRE (i) monitors the data of online environmental monitoring system; and (ii) conducts site inspection annually to check the operation of treatment facilities and take environmental samples to verify the results from online system.

Cam Pha Division of Natural Resource and Environment, in coordination with Quang Ninh DoNRE, conducts site inspection of MD1 to check operation of treatment facilities at least once a year.
