The Affordable Care Act (ACA) has caused staffing firms to look at their benefits and existing processes from a different reference point. SSAP allows a staffing firm to have an “Audit Log” for ACA, which specifically creates their processes and integration of systems appropriate for ACA. Employees also now have ACA responsibilities. Importance of Fixed Indemnity PlansAccording to the Department of Labor (DOL): “Fixed indemnity coverage under a group health plan meeting the conditions outlined in the Departments’ regulations is an excepted benefit under PHS Act section 2791(c)(3)(B), ERISA section 733(c)(3)(B), and Code section 9832(c)(3)(B). As such, it is exempt from the health coverage requirements of title XXVII of the PHS Act, part 7 of ERISA, and chapter 100 of the Code.”

Payroll Deduction and COBRAEssential StaffCARE is a payroll-deducted benefit plan that uses a series of weekly payroll reports to administer. Using these reports, we are able to outsource most of the administration for you. This process takes the work off of your HR and Payroll departments. To ensure privacy, the files are transmitted through a secure HIPAA compliant process that only your company has access to.

• File #1: You send us a basic payroll report showing all employees who worked that specific pay period.• File #2: We send you a list of employee premium deductions to load into your payroll system, based on

the enrollments, changes, and terminations that occurred that week.

If an employee misses six (6) consecutive weeks of premiums, their coverage will automatically terminate and a COBRA package will be mailed to their home address. PAI handles the COBRA administration for all enrolled employees. The premium rates for COBRA coverage will be approximately 2% higher than the original premium.

In And Out Of Benefits StatusAn employee who is off assignment and is no longer receiving a paycheck, can miss a premium payment without having their benefits enrollment canceled. If an employee comes back to work between one (1) and six (6) weeks, payroll deductions will automatically resume and be applied on a going-forward basis (no back premiums need to be paid unless there has been a claim). If, while off assignment, an employee files a claim then all missed premiums (up to 6 weeks) will need to be paid before the claim can be processed.

Our Wellness/Preventive Plan (MEC W/P) Overview ESC Minimum Essential Coverage (MEC) - ERISA-Qualified, Employer Sponsored

• The self-funded ESC MEC plan will eliminate the $2,000 (A) tax on all full-time temporaries, but leaves the possibility of the $3,000 (B) tax being assessed for each full-time temporary associate that applies for and receives a Federal subsidy.

• The self-funded ESC MEC plan satisfies the individual mandate for employees if enrolled in MEC.• ESC MEC is completely voluntary and there is no employer contribution required. Our MEC W/P plan

ESC MEC Wellness/Preventive BenefitsEssential StaffCARE’s Minimum Essential Coverage (MEC) Wellness/Preventive plan is a qualified ACA-compliant, ERISA-qualified, employer-sponsored plan. ESC Audit Log (Branch Manager)Variable Hour / Full Time Employee ClassificationDuring the on-boarding process, this tool provides a standardized process to classify a new hire as a Variable Hour or Full Time Employee. ACA requires this classification to take place at the point of hire, understanding the employee classification may change in the future. The ESC Audit Log enables a branch manager to record this classification through a weighted and standardized questionnaire. This initial classification is required by ACA. Staffing companies may use this classification to determine benefit eligibility, however most companies will offer ACA compliant plans to all new hires in the event the employee’s variable hour/full time status changes in the future.
