LUZERNE COUNTY DISTRICT ATTORNEY’S OFFICE

ASSISTANT DISTRICT ATTORNEY JOB DESCRIPTION

Position: Full-Time Assistant District Attorney

Department: Luzerne County District Attorney’s Office

Employment Status: Regular, Full-Time, Union, Non-Exempt

Salary: $43,000 (non-negotiable)

Summary:An Assistant District Attorney (ADA) is responsible for rep-resenting the Commonwealth’s position and interest when individuals are charged with committing a criminal act. In-volvement in the cases assigned to the ADA begins with the initial stages of the investigation and continues through all stages of the investigation and prosecution, up to and includ-ing the sentencing and any post-sentence motions.

Minimum Qualifications:Minimum requirements include being in good standing and admitted to practice before the Bar of the Commonwealth of Pennsylvania. The applicant must also be willing to un-dergo PA and FBI Criminal History Background Checks and PA Child Abuse History Clearance.

Essential Functions:

1. The Assistant District Attorney may be responsible for specific types of crime prosecution such as domestic disputes, child abuse, narcotics, sexual assaults, major crimes, elder abuse and DUI.

2. The Assistant District Attorney must formulate trial strat- egy, determine sentence to be sought, conduct plea negotiations and research applicable case law.

3. The Assistant District Attorney is responsible for ascer- taining the facts of the case, work closely with law enforce- ment, secure expert testimony and prepare witnesses for trial.

4. The Assistant District Attorney will act as a resource for law enforcement, other Assistant District Attorneys, Detectives and lawyers, and attend community outreach programs when asked by the District Attorney.

5. The Assistant District Attorney must advise police on matters of filing complaints when asked, attend write-ups and/or preliminary hearings, and secure additional infor- mation from law enforcement personnel when required.

6. The Assistant District Attorney must communicate infor- mation on case status to all involved parties such as de- fense attorneys, law enforcement and victims.

7. The Assistant District Attorney must be proficient at legal research, provide necessary training in his/her desig- nated specialty, and be able to communicate effectively and work closely with all support staff and detectives within the office.

8. Additional responsibilities are at the discretion of the District Attorney.

The Luzerne County Pro Bono Program is a newly initiated program run by the Wilkes-Barre Law and Library Association’s Pro Bono Committee. Luzerne County Pro Bono’s services are only for people with little or no income. If you know of a person who needs free legal assistance in Luzerne County, he/she can apply for Luzerne County’s Pro Bono services by e-mailing: [email protected]. You can also follow us and message us on Facebook. Because Luzerne County Pro Bono is recently established, our focus is primarily on landlord/tenant cases. Those with other legal issues will be encouraged to contact Other Organizations whose contact information will be included in a pamphlet that will be made available in the Law Library and in other offices in the Courthouse and Annexes, at Magisterial District Justice Offices, and at various community organizations throughout Luzerne County. As part of its mission, the Pro Bono Program will operate a low bono program. The program recently received a one-time grant from the Luzerne County Bar Association Charitable Foundation, Inc. as startup seed money to become operational. More will be published on the Pro Bono Program as it continues to grow and develop. July 31

ORDER

AND NOW, this 22 day of July, 2020, pursuant to the Judicial Emergency previously declared by this Court as ap-proved by the Supreme Court of Pennsylvania and the au-thority of the Court pursuant to Pa.R.J.A. 1952(B) to address the emergency circumstances due to the number of sheriff ’s deputies subject to quarantine, and to protect the health and welfare of the public, litigants and employees to the extent possible, IT IS HEREBY ORDERED and DECREED as follows:

1. Pending further Order of Court, only civil and criminal proceedings which directly impact the health, safety, secu-rity, welfare or incarceration of an individual shall be held as would normally be scheduled. All other proceedings shall be postposed [sic] to a later date.

2. In particular the following matters shall be postponed and rescheduled:

3. The following matters shall be held as normally pro-cessed:

• Protection from Abuse hearings• Bail postings• Preliminary arraignments• Lift warrant hearings• Civil injunction proceedings• Mental health proceedings• Guardianships• Gagnon I Hearings for incarcerated Defendants (video conference)• Specialty Court proceedings

4. Family Court shall continue to operate to the extent possible to address all emergency matters. In the interim all hearings or conferences before a Hearing Officer shall be conducted by telephone conference and/or postponed to a later date. All pending matters before a Judge shall be re-viewed on an individual basis to determine the need to post-pone and reschedule or address by alternate measurers [sic] such as telephone conference.

5. The Domestic Relations Office shall conduct all proceed-ings for intake, conference and before the Hearing Officer telephonically. All normal contact with clients and/or the public shall also be telephonically.

6. Luzerne County Adult Probation and Parole Department shall conduct all proceedings for intake, conference and be-fore the Hearing Officer telephonically. All normal contact with clients and/or the public shall also be telephonically.

7. All jury trials are hereby postponed pending further Order of Court. Jurors shall not appear as previously di-rected.

8. All dependency and/or delinquency proceedings that require immediate judicial review or adjudication shall be promptly heard by the assigned Judge. All other matters will be reviewed by the assigned Judge on an individual case basis. Cases that do not require immediate substantive actions

such as case review, shall either be rescheduled or held tele-phonically within the discretion of the presiding Judge.

9. All Internships are cancelled.10. Judges shall review their individual calendars and

whenever possible conduct necessary proceedings and/or conferences telephonically. Each Judge shall take the ap-propriate steps in scheduling to their individual calendar to comply with the provisions of this Order.

11. Nothing herein shall be construed to impact the right to speedy trials or other constitutional rights or procedures. On the contrary, all constitutional requirements shall be fol-lowed in all matters.

12. The District Court Administrator and the Office of Court Administration shall take all administrative steps to effectuate this Order.

IT IS FURTHER DIRECTED that this Order shall be posted in a public location in all Court facilities, shall be made available on the County and Court website and shall be pro-vided to the Wilkes-Barre Law & Library Association for publication in the Luzerne County Legal Register.

This Order shall be effective beginning at 4:30 p.m. on July 22, 2020 and shall expire on at [sic] 8:30 a.m. on August 3, 2020 unless extended by further Order.
