TERMS & CONDITIONSPRICES All prices are valid to 31st December, 2018 and are subject to change without notice. All prices are in PNG Kina and are inclusive of tax.

PRICES DO NOT INCLUDED• Any personal or additional expenses such as facsimile use, telephone calls,

internet use or any items not indicated as included in the Function Agreement.

• Additional costs such as printing for menus, name tags/cards, programs, invitations or tickets etc., Special Function Licence fees, decorations or hiring of additional equipment in order to hold your event.

• Royal Papua Yacht Club (RPYC) reserves the right to recover from you:• Any property or accommodation damages caused by you or your guests; or

Any other fees, charges or levies the RPYC may incur because of your actions or omissions.

BOOKINGS AND PAYMENTS

BOOKINGSAll details of the event must be confirmed by the Organiser(s) prior to the event. The Function Agreement and Terms and Conditions must be signed off by the Organiser. Final numbers of attendees must be confirmed 24 hours prior or full numbers will be charged.

PAYMENTSA deposit of 50% of the full cost amount for your event is required in order for you to secure your booking. The full balance of payment must then be made prior to the commencement of your event. Failure to pay the stipulated deposit or the full balance in the times mentioned in these Terms and Conditions, will mean your event will be cancelled. Any additional costs must be settled at the conclusion of the event. If agreed prior by Management, provision can be made to settle additional costs within 48 hours of the event. Extra costs incurred during the event must be approved by Management and signed off by the Organiser prior to those costs being incurred. Method of payment must be approved prior to the event by RPYC Management.

CANCELLATIONS If you cancel your booking 48 hours or more prior to your event no financial penalty will be incurred. If your booking is cancelled within 48 hours of your event or you do not show up on the date of the booked event, the deposit paid will not be refunded.



TERMS & CONDITIONSLIABILITY To the full extent permitted by law, the RPYC; • Whilst acting in good faith, does not accept any responsibility for default

causing loss or injury to person or property whether by negligence or otherwise on the part of any company, firm or their employees or any individual providing any facilities for any person taking part in the event; and

• Is not liable for any loss, damage, cost or expense suffered by any person or additional expenses caused or occasioned by delays due to adverse weather, unsuitable conditions, illness, injuries, strikes, civil disturbances or whatsoever in nature interfering with, altering or adding to the cost of the service requested or booked.

• Responsibility for third parties or conduct of others • Neither the RPYC nor its’ agents or co-operating organisations will be

responsible for any cancellations, delays, diversions or substitution of equipment or any act of omission whatsoever by air carriers, hotels, transportation companies, or any other persons providing any of the services necessitated by the same. Nor shall they be liable for any loss or damage to property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, or negligence of any person not its’ direct employee or under its’ exclusive control.

• The RPYC is not responsible for any criminal conduct by third parties.

GOVERNING LAW

All matters concerning this booking will be subject to the laws of the National Capital District (NCD), Papua New Guinea and legal action arising under this contract shall be litigated in the appropriate Court having jurisdiction at the NCD which Court both parties acknowledge to have exclusive jurisdiction in relation of any legal action brought under these Terms and Conditions. The RPYC will comply by the conditions of its’ Liquor Licence and any special fees incurred for the extension of trading hours will be passed on to the event Organiser.

ERRORS AND OMISSIONS Every effort is made to ensure accuracy at the time of going to press, however, the RPYC cannot be held responsible for printing or typographical errors (including electronic publications), or errors arising from unforeseen circumstances.Entire agreement This document and the Functions Agreement represents the entire agreement between the participant and the RPYC.I agree with the abovementioned Functions Terms & Conditions.Name:_______________________________ Signed:____________________________________ Date:________________________________

EVENT ORGANISATIONWe can assist with booking entertainment for your event. We have a number of bands and other music professionals who perform regularly at the RPYC and can be arranged to perform at your function. Please contact our Function Sales Team for more information and assistance.We also work closely with a number of professional Event Management organisations which offer services such as decorating, sound, lighting, set building, staging, rigging, design and logistics. They can assist with events like product launches, conferences, award shows, presentations and live concerts.
