A short recess was taken after whichMr. Hartwell addressed the jury for thedefense. The learned counsel said thejury must put on one side all prejudicesand favor. It was a grand thing thisnew departure taken. It was a positionfor this country that did not exist before.A special committee had been appointedto investigate the condition of affairs inthe Custom House with regard to thewithdrawal of bonded liquors. Theyhad found a wrong state of affairs, infact they discovered a great scandal.

He went on to refer to the mode ofwithdrawal and to the exemption of cer-tain foreign representatives from thepayment of duties. The large array ofwithdrawal orders under the exemptionrule which he had been permitted toshow indicated fully the way businesswas done. In earlier years the amountswere much smaHer than of late, but themethod was the same, that is to allowdealers to go down to the Custom Housewith the orders endorsed. He supposedthat no person in the Custom House be-

lieved that in such cases these liquorswere actually consumed by these gentle-men or their families. Tewkesbury hadtestified that he had learned nothingnew in the course of this trial. Counseldid not believe that the customs officialshad ever been deceived. It did not ap-pear that any different instruction werenow given to them.
