Reading of the Minutes

Minutes of the August 23, 2018 Fayetteville Board of Education Meeting

Work Session The meeting convened at 4:06 PM in the Adams Leadership Center with President Justin Eichmann presiding.

The roll was called and board members Justin Eichmann, Nika Waitsman, Tim Hudson, Susan Heil, Bob Maranto and Megan Hurley were present. Traci Farrah was absent

Dr. John L Colbert, Superintendent, explained that the purpose of the meeting was to present the Final Budget of Expenditures for FY17-18.

Glenda Sullins, Director of Finance and Business Services, explained the fund balances and information on where our funds are invested. Glenda also explained the ending fund balance based on the difference between revenue and expenditures. The building, federal, activity and child nutrition funds were also explained.

Glenda Sullins recommended a transfer into the building fund and asked the board to approve at the regular board meeting in August.

Adjournment The meeting was adjourned at 4:46 PM.

Board Meeting The meeting convened at 5:00 PM in the Adams Leadership Center with President Justin Eichmann presiding. The Pledge of Allegiance was led by students from McNair Middle School.

Roll Call The roll was called and board members Justin Eichmann, Traci Farrah, Nika Waitsman, Tim Hudson, Bob Maranto, Megan Hurley and Keaton Smith were present.

Recognitions Greg Mones, Human Resource Director, was honored for winning the HR Administrator of the Year Award.

The FHS Dawg Crew was honored for being on the Superintendent’s Honor Roll.

Board Member Liaison Reports Justin Eichmann, Board President, reminded the board that they Hall of Honor Banquet will be held on October 11.

Justin noted that the Fayetteville Public Education Foundation’s fall grant cycle would close on August 24.

Justin shared that Cambre with the Fayetteville Public Education Foundation would be invited to a board meeting in the next couple of months to give an update on the Foundation.

Superintendent’s Report Dr. John L Colbert, Superintendent, reported on the first day of school and shared a video that included highlights from the day.

Consent Agenda The Board voted 7-0 to approve the consent agenda. Nika Waitsman made the motion, which was seconded by Tim Hudson. By approving the consent agenda, the Board approved the minutes of the July 26, 2018 board meeting, student transfers, certified and classified staff changes, the monthly financial report and a student expulsion.

New Business (Discussion) Christine Wilken, Classified PPC President, presented Policy 4243 - Classified Leave Policy. Christine explained that the policy changes reflect the changes that were approved for Policy 4150 - Certified Leave Policy in June. The Board will be asked to approve Policy 4243 at the September board meeting.

Dr. Larry Ben, Associate Superintendent for Administrative Services, presented information about the New/Revised District Policies for Homeless Students (5.40), Student Handbook (5.42) and Service Animals on School Grounds (5.43). The board further discussed Policy 5.43 and agreed that they would like to see a revision to include ‘parent must include documentation from a physician’. The Board will be asked to approve the New/Revised District Policies at the September board meeting.

Old Business (Action) The Board voted 7-0 to approve Final Budget of Expenditures for FY17-18. Justin Eichmann noted that the final budget was presented at the work session prior to the regular board meeting. Tim Hudson made the motion, which was seconded by Nika Waitsman. The Board voted 7-0 to approve the New/Revised District Policies for National School Lunch Act Funding Expenditures (3.13), Parent, Family, and Community Engagement – District (6.11), Parent, Family, and Community Engagement – School (6.12), Smart Core Curriculum & Graduation Requirements for the Classes of 2019 & 2020 (5.41), Smart Core Curriculum & Graduation Requirements (5.41), Smart Core Curriculum & Graduation Requirements for the Classes of 2021 & Thereafter (5.41.1) and Unexcused Absences (5.7). Tim Hudson made the motion, which was seconded by Traci Farrah. The board further discussed the graduation requirements of 24 credits vs 22 credits. The district currently requires 24 credits in order to graduate but the state requires 22 credits. Dr. Mark Oesterle, Executive Director of Secondary Education, explained the discussions that are currently taking place regarding the requirements. Minutes of the September 4, 2018 Fayetteville Board of Education Work Session

Work Session The meeting convened at 12:30 PM in the Adams Leadership Center with President Justin Eichmann presiding. The roll was called and board members Justin Eichmann, Nika Waitsman, Tim Hudson, Susan Heil, Bob Maranto and Megan Hurley were present. Traci Farrah was absent Dr. John L Colbert, Superintendent, explained the purpose of the meeting and introduced Bob Templeton with Templeton Demographics. Bob Templeton presented information about demographic and enrollment projections. Dr. Megan Slocum, Associate Superintendent for Support Services, presented information about the warehouse and transportation facilities. Steve Janski, Director of Athletics, presented information about the facilities used for student activities. Dr. Slocum presented information about relocating Administration and Fayetteville Virtual Academy. Dr. Slocum presented information about the Lewis Property and the possibility of entering into a land acquisition partnership with the City of Fayetteville. Dr. Colbert presented information on pending projects, an overview of potential projects and other district considerations.

Glenda Sullins, Director of Finance and Business Services, introduced Kevin Faught with Stephens. Kevin presented 5 types of financing options. The board further discussed the financing options and determined that they would like to further explore option 2. The board discussed the relocation of FVA and agreed that they would like to see some data regarding enrollment and the number of students that visit the facility and how often. The board discussed the land acquisition partnership with the City of Fayetteville and agreed that they would like to further explore this option. The board discussed options for the warehouse and transportation facilities and agreed that they would like to see the cost of the recommendations. Other topics that the board discussed and would like to see additional information:

1. Building and land configuration at the Administration Building and Boardroom 2. Efficiency Study 3. Renovation cost of a historical building 4. Benefits of having FVA students near the High School 5. Bus Transportation Comparison 6. Data from the Athletic Committee that Steve Janski is overseeing

Methodology Report ESEA Sec. 1118

TO: Board of Education FROM: Glenda Sullins, Director of Finance and Business Services I recommend approval of the Methodology Report ESEA Sec. 1118. Fayetteville School District defines equity from State and Local funds for each school by the following:

1. Classroom FTEs are based upon meeting state standards for classroom student counts. A yearly review is completed to determine the number of FTEs based on student enrollment at each school. Fayetteville Public School Board supports hiring the best candidate in a classroom, not looking at salary schedule placements of applicants. The equity is by FTE determination, not cost.

2. Support Staff positions are based on standard criteria created by the District. Each year, these positions are

reviewed to determine any changes needed. FPS calculates an equitable allocation of FTEs support for areas of Library, Office, lunch room and other building operation support.

3. All schools, regardless of school size are provided with one Principal FTE. Currently, FPS provides one

Assistant Principal FTE at each school. Each year this Assistant Principal FTE is reviewed to determine if the current FTE is still appropriate. Each school is provided with at least one Counselor FTE…some schools may have more than one Counselor FTE based on school enrollment. FPS provides at least one Library Media Specialist FTE.

4. School level budgets are calculated by the previous year’s 4th quarter ADM and each school is given an

instructional budget based on a grade band formula.

5. Maintenance and operating budget is determined by square footage and building age. Maintenance budgets

are managed at District level by the Maintenance Director. Each year projects are determined by the following needs: safety, student growth and building age/upgrades. These projects are reviewed and approved by the school board. The district has developed rotations cycles for HVAC, roofs, flooring, and parking lots.

Supplement, Not Supplant Under the Every Student Succeeds Act:

Demonstration of Compliance

The purpose of this form is to collect the required information necessary for Arkansas Department of Education (ADE) to verify that each local education agency (LEA) is in compliance with the demonstration requirements regarding Supplement, Not Supplant (SNS) under the Elementary and Secondary Education Act (ESEA), as reauthorized by the Every Student Succeeds Act of 2015 (ESSA). To ensure all LEAs in Arkansas meet these requirements, each LEA must submit the following:

(a) An assurance stating the LEA is in compliance with the provisions of section 1118(b) of the Elementary and Secondary Education Act (ESEA), as reauthorized by the Every Student Succeeds Act of 2015 (ESSA);

(b) An indication of the type of methodology the LEA has adopted and is implementing in regard to the allocation of State and local (non-Federal) funds to all schools; and,

(c) A narrative description of the methodology or a reference to the LEA's Financial Transparency document in which the methodology is described.

Note: The LEA is required to provide the demonstration requirements to ADE one time for the duration of the Title I, Part A program under the ESSA, unless the LEA adopts or implements a revised methodology for allocating State and local (non-Federal) resources. Upon adoption or implementation of a revised methodology, it is incumbent upon the LEA to provide an updated demonstration of compliance form to the Public School Accountability Division, Federal Programs Unit within the Arkansas Department of Education.

Instructions

Every LEA must submit a Supplement, Not Supplant Demonstration of Compliance before the grant recipient will be granted substantial approval for 2018-2019 expenditure of funds. The LEA must submit assurance, with choice of Methodology (if applicable), along with narrative, no later than October 15, 2018. This date has been extended from the original September timeline in order to give districts reasonable time to get school board president's signature.

A copy of this form must be duly executed by the President of the School Board or Board of Directors and uploaded into the 2018-2019 form upload folder in lndistar. Upon submitting the required materials, ADE will verify the information provided to ensure the LEA is in compliance with the ESSA requirements.

Pre-K Nutrition Grant

I recommend approval of the Pre-K Nutrition Grant.

Each year, for the past 10 years, the Pre-K Director has applied for and received the Child and Adult Food Care Program Grant (CACFP Grant). The purpose of this grant is to get pro-rated reimbursement for breakfast, lunch and snack served to the Pre-K students based on eligibility for free and reduced rates. The reimbursement is from the United States Department of Agriculture Food and Nutrition Service. The reimbursement is turned over to the Fayetteville Public Schools Nutrition Department, as they hold the Food Service Contract and provide the meals for the Pre-K students. The reimbursement is typically around $121,000 per school year. This covers 85% of the total amount Pre-K owes the Nutrition Department. There is no other source of funding for the 85%.

The Arkansas Department of Human Services requires that the School Board approves that we apply to receive the funds provided by the grant.

GENERAL ASSURANCES 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. Each such program will be administered in accordance with all applicable statutes, regulations,program plans, and applications.

B. The LEA will comply with all applicable supplement not supplant and maintenance of effortrequirements under Section 9521 – IV.B.1:

1. The control of funds provided under each program and title to property acquired withprogram funds will be in a public agency, a non‐profit private agency, institution, organization,or Indian tribe, if the law authorizing the program provides for assistance to those entitiesand;

2. The public agency, non‐profit private agency, institution or organization, or Indian tribe willadminister the funds and property to the extent required by the authorizing law.

C. The LEA will adopt and use proper methods of administering each such program, including:1. The enforcement of any obligations imposed by law on agencies, institutions, organizations,

and other recipients responsible for carrying out each program and;2. The correction of deficiencies in program operations that are identified through audits,

monitoring, or evaluation.D. The LEA will cooperate in carrying out any evaluation of each such program conducted by, or for, the

State Educational Agency, (SEA), the Secretary, or Federal officials.E. The LEA will use such fiscal control and fund accounting procedures as will ensure proper

disbursement of, and accounting for, Federal funds paid to the LEA under each such program.F. The LEA will:

1. Submit such reports to the SEA (which shall make the reports available to the Governor) andthe Secretary as the SEA and Secretary may require to enable the SEA and Secretary toperform their duties under each such program; and

G. The LEA has consulted with teachers, school administrators, parents, and others in the developmentof the local consolidated application/LEA Plan.

H. Before the application was submitted, the LEA afforded a reasonable opportunity for public commenton the application and considered such comment.

TITLE I, PART A –  Improving Basic Programs Operated by LEAs 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. Ensure that migratory children and formerly migratory children who are eligible to receive servicesunder this part are selected to receive such services on the same basis as other children who areselected to receive services under this part;

B. Provide services to eligible children attending private elementary schools and secondary schools inaccordance with section 1117, and timely and meaningful consultation with private school officialsregarding such services;

C. Participate, if selected, in the National Assessment of Educational Progress in reading andmathematics in grades 4 and 8 carried out under section 303(b)(3) of the National Assessment ofEducational Progress Authorization Act (20 U.S.C. 9622(b)(3));

D. Coordinate and integrate services provided under this part with other educational services at the localeducational agency or individual school level, such as services for English learners, children withdisabilities, migratory children, American Indian, Alaska Native, and Native Hawaiian children, andhomeless children and youths, in order to increase program effectiveness, eliminate duplication, andreduce fragmentation of the instructional program;

E. Collaborate with the State or local child welfare agency to:1. Designate a point of contact if the corresponding child welfare agency notifies the local

educational agency, in writing, that the agency has designated an employee to serve as a point ofcontact for the local educational agency; and

2. By not later than one year after the date of enactment of the Every Student Succeeds Act,develop and implement clear written procedures governing how transportation to maintainchildren in foster care in their school of origin when in their best interest will be provided,arrange, and funded for the duration of the time in foster care, which procedures shall—

a. Ensure that children in foster care needing transportation to the school of origin willpromptly receive transportation in a cost‐effective manner and in accordance withsection 475(4)(A) of the Social Security Act (42 U.S.C. 675(4)(A)); and

b. Ensure that, if there are additional costs incurred in providing transportation to maintainchildren in foster care in their schools of origin, the local educational agency will providetransportation to the school of origin if—

i. The local child welfare agency agrees to reimburse the local educational agencyfor the cost of such transportation;

ii. The local educational agency agrees to pay for the cost of such transportation; oriii. The local educational agency and the local child welfare agency agree to share the

cost of such transportation; and3. Ensure that all teachers and paraprofessionals working in a program supported with funds under

this part meet applicable state certification and licensure requirements, including anyrequirements for certification obtained through alternative routes to certification; and

4. In the case of a local educational agency that chooses to use funds under this part to provide earlychildhood education services to low‐income children below the age of compulsory schoolattendance, ensure that such services comply with the performance standards established undersection 641A(a) of the Head Start Act (42 U.S.C. 9836a(a)).

TITLE I, PART D – Children of Youth who are Neglected, Delinquent or At‐Risk (Applicable to those LEAs that have projects funded under this part) 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. The local educational agency developed and will implement the local flexibility demonstrationagreement in consultation with teachers, principals, other school leaders (including charter schoolleaders in a local educational agency that has charter schools), administrators of federal programsimpacted by the agreement, parents, community leaders, and other relevant stakeholders;

B. The local educational agency will use fiscal control and sound accounting procedures S. 1177—107that ensure proper disbursement of, and accounting for, eligible federal funds consolidated and usedunder such system;

C. The local educational agency will continue to meet the requirements of sections 1117, 1118, and8501; and

D. The local educational agency will meet the requirements of all applicable federal civil rights laws incarrying out the agreement and in consolidating and using funds under the agreement.

TITLE II, PART A –  Preparing, Training and Recruiting High Quality Teachers and Principals 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. The local educational agency will comply with section 8501 (regarding participation by private schoolchildren and teachers);

B. The local educational agency will coordinate professional development activities authorized underthis part with professional development activities provided through other federal, state, and localprograms; and

C. The local educational agency will prioritize funds to schools served by the agency that areimplementing comprehensive support and improvement activities and targeted support andimprovement activities under section 1111(d) and have the highest percentage of children countedunder section 1124(c).

TITLE III, PART A –  Language Acquisition and Language Enhancement (Applicable to those LEAs that have projects funded under this part) 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. Each local educational agency that is included in the eligible entity is complying with section 1112(e)prior to, and throughout, each school year as of the date of application;

B. The eligible entity is not in violation of any state law, including state constitutional law, regarding theeducation of English learners, consistent with sections 3125 and 3126;

C. The eligible entity consulted with teachers, researchers, school administrators, parents and familymembers, community members, public or private entities, and institutions of higher education, indeveloping and implementing such plan; and

D. The eligible entity will, if applicable, coordinate activities and share relevant data under the plan withlocal Head Start and Early Head Start agencies, including migrant and seasonal Head Start agencies,and other early childhood education providers.

TITLE IV, PART A –  STUDENT SUPPORT AND ACADEMIC ENRICHMENT 

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. The LEA or consortium will prioritize the distribution of funds to schools served by the localeducational agency, or consortium of such agencies, that:1. Are among the schools with the greatest needs, as determined by such local educational

agency, or consortium;2. Have the highest percentages or numbers of children counted under section 1124(c);3. Are identified for comprehensive support and improvement under section 1111(c)(4)(D)(i);4. Are implementing targeted support and improvement plans as described in section 111(d)(2); or5. Are identified as a persistently dangerous public elementary school or secondary school under

section8532.

B. The LEA or consortium will comply with section 8501 (regarding equitable participation by privateschool children and teachers);

C. The LEA or consortium will use not less than 20 percent of funds received under this subpart tosupport one or more of the activities authorized under section 4107;

D. The LEA or consortium will use not less than 20 percent of funds received under this subpart tosupport one or more activities authorized under section 4108;

E. The LEA or consortium will use a portion of funds received under this subpart to support one or moreactivities authorized under section 4109(a), including an assurance that the local educational agency,or consortium of local educational agencies, will comply with section 4109(b); and

F. The LEA or consortium will annually report to the State for inclusion in the report described in section4104(a) (2) how funds are being used under this subpart to meet the requirements of subparagraphs(C) through (E).

G. SPECIAL RULE.—Any local educational agency receiving an allocation under section 4105(a)(1) in anamount less than $30,000 shall be required to provide only one of the assurances described insubparagraphs (C), (D), and (E) of subsection (e)(2).

McKinney‐Vento Homeless Education Program  (42 U.S.C. 11431 et seq.)

I, the undersigned Superintendent for the above named LEA, hereby, assure the Arkansas Department of Education that: 

A. The local educational agency will adopt policies and practices to ensure that homeless children andyouths are not stigmatized or segregated on the basis of their status as homeless.

B. The local educational agency will designate an appropriate staff person, who may also be acoordinator for other Federal programs, as a local educational agency liaison for homeless childrenand youths, to carry out the duties described in McKinney‐Vento.

C. The local educational agency will adopt policies and practices to ensure that transportation isprovided, at the request of the parent or guardian (or in the case of an unaccompanied youth, theliaison), to and from the school of origin, as determined in accordance with the following, asapplicable:

1. If the homeless child or youth continues to live in the area served by the local educationalagency in which the school of origin is located, the child's or youth's transportation to andfrom the school of origin shall be provided or arranged by the local educational agency inwhich the school of origin is located.

2. If the homeless child's or youth's living arrangements in the area served by the localeducational agency of origin terminate and the child or youth, though continuing his orher education in the school of origin, begins living in an area served by another localeducational agency, the local educational agency of origin and the local educationalagency in which the homeless child or youth is living shall agree upon a method toapportion the responsibility and costs for providing the child with transportation to andfrom the school of origin. If the local educational agencies are unable to agree upon suchmethod, the responsibility and costs for transportation shall be shared equally.

Act 1120 Resolution

TO: Board of Education FROM: Dr. Larry Ben, Associate Superintendent for Administrative Services Pursuant to Arkansas Code Annotated §6-13-635, local school boards are required to review and approve any employee increase in pay of 5% or more from one fiscal year to the next. Following are the procedures that the state has outlined for review of those pay changes.

1. Beginning September 15, 2014 and continuing each September 15th thereafter, school are required to run a cognos report and identify on a spreadsheet those employees that have an increase in pay of 5% or more.

2. This spreadsheet should be presented along with a resolution to the School Board no later than the October Board meeting of each year with the initial year being October 2014.

3. The first report will reflect a change in pay from FY13 to FY14 (2012-13 school year to 2013-14 school year).

In compliance with this law you will find the following in your packet: • A copy of the state statute • A draft of the proposed resolution • Two spreadsheets reflecting those employees with a 5% or more change in pay from the

2016-17 school year to the 2017-18 school year. The first spreadsheet is a list of certified staff and the second spreadsheet is a list of classified staff. These spreadsheets are sorted by reason for the increase.

These two reports (certified and classified staff) list only the name and the reason that the listed employee received a 5% or more pay increase from 2016-17 to 2017-18. State statute 6-13-635 only requires that the reason for the pay increase be listed on the reports. It does not require any additional information be released. However, additional information can be generated at the board’s request.

A.C.A. § 6-13-635 (2014)

6-13-635. School board review and approval of salary increases.

(a) As used in this section, "salary increase" means an increase in the salary paid to a school district employee for performing substantially the same job functions as the employee performed before receiving the salary increase.

(b) (1) (A) A school district board of directors shall review and approve by a written resolution an increase in salary of five percent (5%) or more for a school district employee.

(B) The resolution shall include the reasons for the salary increase, which may include without limitation:

(i) A bonus that is not added to the employee's salary; (ii) An incentive bonus provided:

(a) For National Board for Professional Teaching Standards certification under § 6-17-413; (b) To a certified speech-language pathologist under § 6-17-413; (c) For teacher recruitment or retention in high-priority school districts under § 6-17-811; (d) To a master principal under § 6-17-1603; or (e) Under another specific provision of law; or

(iii) An increase in salary received as a result of the school district employee moving into a new position with substantially different job functions.

(2) (A) The school district shall provide a certified copy of the written resolution required under this subsection to the auditor who conducts the annual financial audit of the school district.

(B) Within thirty (30) days following the date of an audit report in which an auditor notes noncompliance under this section, the school district shall provide a copy of the audit report to the Department of Education.

(C) Annually by October 1, the department shall:

(i) Compile a list of the reports of noncompliance received under this section; and (ii) Provide the list to the House Committee on Education and the Senate Committee on Education.

RESOLUTION OF FAYETTEVILLE SCHOOL DISTRICT #1 BOARD OF DIRECTORS

WHEREAS, the Fayetteville School District #1 Board of Directors (Board) met in a regular, open, and properly-called meeting on October 25, 2018, in the Adams Leadership Center; WHEREAS, ____ members were present, a quorum was declared by the chair; WHEREAS, the Board has, pursuant to Act 1120 of 2013 codified as Ark. Code Ann. § 6-13-635, determined that the employees listed and described in Attachments A & B, are eligible and have been approved to receive an increase in salary of 5% and above from FY17 to FY18. 3.12 – ENGLISH LANGUAGE LEARNERS

The District shall utilize the special needs funding it receives for identified English Language Learners (ELL) on services, activities and materials listed in the ADE Rules Governing the Distribution of Student Special Needs Funding for School Year beginning 2004-2005 and Additional Teacher Pay and the Determination of Allowable Expenditure of These Funds.

The expenditures of ELL supplemental funding shall be evaluated at least annually to determine their overall effectiveness. The evaluation shall specifically address how the use of ELL funds is in alignment with the District’s school district support plan in addressing identified achievement gaps and student performance deficiencies.

5.67.1– EXTRACURRICULAR ACTIVITY ELIGIBILITY FOR HOME SCHOOLED STUDENTS Home-schooled student means a student legally enrolled in an Arkansas home school and who meets or

has met the criteria for being a home-schooled student, as established by A.C.A. § 6-15-503.

Interscholastic activity means an activity between schools subject to regulations of the Arkansas

Activities Association that is outside the regular curriculum of the school district, such as an athletic

activity, fine arts program, or a special interest group or club.

Home-schooled students whose parents or guardians are legal residents of the school district will be

permitted to pursue participation in an interscholastic activity in the student's resident school zone as

permitted by this policy.

Home-schooled students whose parent or legal guardian are not residents of the school district will be

permitted to pursue participation in an interscholastic activity in the District if the superintendent of the

student’s resident district and the superintendent of the District both agree in writing to allow the

student to participate in interscholastic activities at the District.

Although not guaranteed participation in an interscholastic activity, home-school students who meet

the provisions of this policy, AAA Rules, and applicable Arkansas statutes shall have an equal

opportunity to try out and participate in interscholastic activities without discrimination. The District

shall provide a reasonable alternative to any prerequisite for eligibility to participate in an interscholastic

activity that the home-schooled student is unable to meet because of his or her enrollment in a home

school.

To be eligible to try out and participate in interscholastic activities, the student or the parent of a

student shall mail or hand deliver the student's request to participate to the student's school's principal

before the signup, tryout or participation deadline established for traditional students. Additionally, the

student shall demonstrate academic eligibility by obtaining a minimum test score of the 30th percentile

or better in the previous 12 months on the Stanford Achievement Test Series, Tenth Edition; another

nationally recognized norm-referenced test; or a minimum score on a test approved by the State Board

of Education.

A student who meets the requirements for eligibility to participate in an interscholastic activity is

required to register for no more than one course in the District's school where the student is intending

to participate in an interscholastic activity.

The student shall regularly attend the class in which the student is registered beginning no later than the

eleventh (11th) day of the semester in which the student's interscholastic activity participation is desired.

The student must attend the practices for the interscholastic activity to the same extent as is required of

traditional students.

A student and the parent or legal guardian of the student shall sign and return an acknowledgement of

receipt and review of an information sheet regarding signs and symptoms of sudden cardiac arrest

before the student may participate in an athletic activity and before each school year the student

participates in an athletic activity.

A home-schooled student who has met the try out criteria; and who has been selected to participate in

the interscholastic activity shall meet the following criteria that also apply to traditional students

enrolled in the school:

standards of behavior and codes of conduct;

attend the practices for the interscholastic activity to the same extent as is required of traditional students;

required drug testing;

permission slips, waivers, physical exams; and

participation or activity fees.

A home-schooled student who is not a resident of the District may begin participating in interscholastic

activities:

a. Immediately upon being approved for participation for all interscholastic activities other than athletic activities; and

b. One (1) calendar year after being approved to participate in interscholastic activities that are athletic activities unless the approval is prior to July 1 of the school year the student would have been enrolled in seventh (7th) grade if the student were enrolled in public school.

A home-schooled student who is not a resident of the District and is prohibited under this policy from

participating in an interscholastic activity that is an athletic activity for one (1) calendar year may

immediately participate in rehearsals, tryouts, practices, auditions, classes, or other endeavors

associated with the interscholastic activity.

Students who participate in extracurricular or athletic activities under this policy will be transported to

and from the interscholastic activities on the same basis as other students are transported.

A student who withdraws from an Arkansas Activities Association member school to be home-schooled

shall not participate in an interscholastic activity in the resident school district for a minimum of three

hundred sixty-five days after the student withdraws from the member school.

6.13 – PARENT, FAMILY, AND COMMUNITY INVOLVEMENT ENGAGEMENT FOR

ENGLISH LANGUAGE LEARNERS

The English Language Learners (ELL) Parent Involvement Family, and Community Engagement Policy includes the

objective listed in the District and Title I Parent involvement , Family, and Community Engagement policies (6.11

and 6.12) and has the following objectives, which supplement but do not supplant the district policies and

Arkansas Act 603:

1. All parents and families of English Language Learners will be given equal opportunity and

encouragement to participate in the education of their children by providing, to the extent possible

practicable, information in a language they can understand.

2. All parents and families of English Language Learners have a right to withdraw a child from some or all

ESL instructional services. However, a student will continue to be identified as an English Language

Learner and will continue participating in annual ELPA21 testing until the student meets the exit criteria

outlined in Arkansas Commissioner’s Memo LS-18-083.

3. The Fayetteville School District will conduct an annual evaluation and needs assessment of the ESL

programs in the district in order to identify opportunities for greater participation of parents and families

of ELL’s.

4. Translation and interpretation services will be provided for both written and verbal communication, to

the extent possible practicable.

5. Parents will be notified within two (2) weeks no later than thirty (30) calendar days after the beginning

of the school year or within two (2) weeks for students who enroll after the start of the school year of

their child’s placement in an ESL program.

6. Parents will may be invited to attend and assume an active role in the Language Placement Advisory

Committee meetings for their children.

7. Parents have the right to request that their ELL child be immediately removed from an ESL program

upon their written request.

8. 7. Parents will be informed of the following ESL program components:

The reasons for ELL identification and placement in an ESL program,

The child’s level of English proficiency, how the level was assessed, and the status of the child’s

academic achievement,

The method of instruction to be used in the ESL program,

How the program will meet the education strengths and needs of the student,

How the program will help the student learn English and meet challenging state academic

standards,

The program exit criteria, including the expected rate of transition and graduation,

How the program will meet the needs of students with disabilities.

REIMBURSEMENT RESOLUTION

WHEREAS, Fayetteville School District No. 1 of Washington County, Arkansas (the "District”) proposes acquiring, renovating and repairing school facilities (the "Project"); and

WHEREAS, the District proposes to obtain funds to accomplish the

Project from the issuance of its Construction Bonds to be issued in an amount not to exceed $10,000,000 (the "Bonds"); and

WHEREAS, the purpose of this Resolution is for the District to

declare its "official intent" to reimburse itself for the Expenditure ( defined below) from the proceeds of the Bonds, within the meaning of the applicable Treasury Regulations promulgated by the United States Treasury Department (the "Regulations").

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the District:

Section 1. That the District hereby expresses its intent under the

Regulations to advance its own funds to pay up to $6,000,000 of the costs of the Project and to reimburse itself from Bond proceeds for all expenditures for such costs paid by the District prior to the issuance of the Bonds (the "Expenditure"). Debt service on the Bonds will be paid from surplus revenues (being revenues in excess of the amount necessary to insure the payment when due of principal of, interest on, and the trustee's and paying agent's fees in connection with the bonds for which voted) derived from debt service taxes heretofore or hereafter voted for payment of other bond issues of the District, subject to the prior pledge of such surplus revenues.

Section 2. That proceeds of the Bonds will be applied to reimburse the District within eighteen (18) months after the later of (a) the date of the Expenditure or (b) the date on which the Project is placed in service and, in any event, within three (3) years after the date of the making of the Expenditure.

Section 3. That the District is aware of no reason which would cause it to expect that the Expenditure would be reimbursed from any source other than the proceeds of the Bonds.

Section 4. That the District is aware of no reason which would cause it to believe that the Expenditure will not be reimbursed from proceeds of the Bonds.

Section 5. That the Board is aware of nothing in the budget or financial circumstances of the District which is inconsistent with the intent

Section 6. That the Expenditure will be a "capital expenditure" within the meaning of applicable Treasury Regulations or will constitute a portion of the costs of issuance of the Bonds.

Section 7. That this Resolution is adopted to document compliance with applicable Treasury Regulations, including Treas. Reg. Sec. 1.150-2.

Section 8. That a copy of this Resolution shall be filed in the main administrative office of the District. It shall be continuously available for public inspection during regular business hours on every business day until the date of issuance of the Bonds.

Section 9. That all Resolution in conflict herewith are repealed to the extent of such conflict.

Section 10. That this Resolution shall be in full force and effect from and after its adoption.

4243 – CLASSIFIED LEAVE POLICY The Fayetteville Board of Education recognizes the need for employees to be protected from loss of salary during temporary absences from work caused by personal illness or disability, illness, or bereavement in the immediate family, and other reasons of an emergency or personal nature.

The Board of Education also agrees to protect the security of the employee who requests leave of absence for an extended period by guaranteeing the individual to return to a classified position in their field, provided conditions outlined in the procedures governing this policy are met.

DEFINITIONS School employee shall include any employee of this school district who works not less than twenty (20) hours per week, and who is not compelled by law to secure a teaching license from the State Board of Education as a condition precedent to employment.

I. SICK LEAVE Sick Leave Definitions:

1. “Sick Leave” is absence from work due to illness, whether by the employee or a member of

the employee’s immediate family, or due to a death in the family.

2. “Immediate Family” shall include the teacher’s spouse, children, parents, grandparents,

grandchildren, siblings and other relatives living in the same household. means the father,

mother, sister, brother, husband, wife, child, grandmother, grandfather, grandchild, in-laws, or

any individual acting as parent or guardian of an employee. For purposes of this definition,

husband or wife includes domestic partners.

3. “Current Sick Leave” means those days of sick leave for the current contract year, which leave

is granted at rate of one (1) day of sick leave per contracted month or major part thereof.

4. “Accumulated Sick Leave” is the total of unused sick leave, up to maximum of one hundred

twenty (120) days accrued for previous contracts but not used. Accumulated sick leave also

includes the sick leave transferred from an employee’s previous public school employment.

Sick Leave Procedures:

Sick leave may be used in half or whole day increments. Pay of sick leave shall be at the employee’s

daily rate of pay. Absences for illness in excess of the employee’s accumulated and current sick leave

shall result in a deduction from the employee’s pay at the daily rate.

At the discretion of the District and, if FMLA is applicable, subject to the certification / recertification

provisions contained in FMLA, the District may require a written statement from the employee’s

physician documenting the employee’s illness. Failure to provide such documentation of illness may

result in sick leave not being paid, or in discipline up to and including termination.

Should an employee be absent frequently during a school year, and said absences are not subject to

FMLA leave, and if such a pattern of absences continues, or is reasonably expected to continue, the

Superintendent may temporarily reassign the employee.

If the employee’s absences are not subject to the FMLA, or are in excess of what is protected under

the FMLA, excessive absenteeism, to the extent that the employee is not carrying out his/her

assigned duties, may result in termination.

Sick Leave and Family Medical Leave Act (FMLA) Leave:

When an employee takes sick leave, the District shall determine if the employee is eligible for FMLA

leave and if the leave qualifies for FMLA leave. The District may request additional information from

the employee to help make the applicability determination. (See policy 4151) To the extent the

employee has accumulated sick leave, any sick leave taken that qualifies for FMLA leave shall be

paid leave and charged against the employee’s accrued leave including once the employee exhausts

his/her accumulated sick leave, vacation or personal leave.

Any employee who is absent as a result of an injury caused by either an assault or other violent

criminal act committed against the school employee in the course of his or her employment shall be

granted leave in accordance with Arkansas law.

Sick Leave and Outside Employment:

Sick leave related absence from work inherently means the employee is also incapable of working at

any source of outside employment. If an employee who works a non-district job while taking district

sick leave for personal or family illness or accident, Workers Comp, or FMLA shall be subject to

discipline up to and including termination.

Maximum Sick Leave Accumulation:

Employees may accumulate a maximum of 120 days sick leave. In June of each year employees shall

be paid for all sick leave accumulated over 120 days at the rate of one-half (1/2) of the employee’s

daily rate of pay, not to exceed the beginning substitute rate.

Sick Leave Paid at Retirement:

Upon retirement, employees who qualify for benefits with the Arkansas Teacher Retirement

System will be reimbursed for unused sick leave up to 120 days at the rate of one-half (1/2) of the

employee’s daily rate of pay, not to exceed the beginning substitute rate. Employees shall have

served in the district 3 years to be eligible for this benefit.

Military Leave:

Military leave will be granted as provided for in Arkansas law.

II. SICK LEAVE BANK

A. Participation:

Participation in the Sick Leave Bank (SLB) is available to all classified employees who are

eligible for sick leave and is on a voluntary basis.

An employee becomes a member of the SLB by contributing one (1) sick day to the bank. New

staff members and others not contributing previously will be given an opportunity to join. By

September 15, every classified employee will receive notification of their participation in the

SLB in the Leave section of their monthly pay stub. This notification should indicate if they

have already donated a day and are an active member of the SLB. Newly employed staff

members will receive the SLB contribution form with new hire paperwork. The SLB

contribution form will be available online.

Such declaration and contribution shall be made on a SLB Election Form distributed and

collected by the District’s Human Resources Office. The SLB Form is due in the Human

Resources Office no later than September 15 or within fifteen (15) days of beginning

employment.

After a SLB member withdraws days from the bank, they must contribute one (1) day of their

sick leave allowance at the beginning of the next school year to reestablish membership in the

SLB.

If, during the course of a school year, the SLB balance of contributed days is reduced to fifty

(50), the District’s Human Resources Office will notify classified staff of this occurrence and will

request the immediate completion of another SLB Form. An employee’s failure to contribute

another one day of accumulated sick leave will terminate that employee’s participation in the

SLB until the next opportunity to contribute arises.

B. Governance:

The Classified SLB shall be kept separate in the number of days recorded and accounted for,

but shall be governed by the Sick Leave Bank Committee.

The Sick Leave Committee A seven-member committee shall oversee the administration of the

SLB. The committee shall be comprised of the Superintendent (or designee), the FEA

President (or designee), three teachers elected by a majority of certified staff in an election

directed and certified by the PPC, and two classified employees elected in an election directed

and certified by the classified PPC. The committee shall decide on requests based on the

committee’s rules of operation. Requests for leave from the Sick Leave Bank should be routed

to the Human Resources Office.The following will occur by September 15 (Ideally after PPC

elections):

1. FEA will nominate one member to serve on the SLB committee for a two year term

2. Certified PPC will hold an election for three teachers to serve on the SLB committee

for a two year term

3. Classified PPC will hold an election for two employees to serve on the SLB committee

for a two year term

The committee shall decide on requests based on the committee’s rules of operation.

Requests for leave from the SLB should be routed to the Human Resources Office.

The SLB committee will begin meeting in October and meet once a month or as needed.

C. Rules of Operation:

1. Only those employees who have made contributions to the SLB may make requests

for grants from the bank.

2. SLB days will be granted only in cases of serious physical, mental, or emotional illness

of the employee or serious illness or death in the immediate family, and with the

written approval of the SLB committee. “Immediate family” shall include the

employee’s spouse, children, parents, and any other relatives living in the same

household. an individual with any of the following relationships to the employee:

the father, mother, sister, brother, husband, wife, child, grandmother, grandfather,

grandchild, in-laws, or any individual acting as parent or guardian of an employee.

For purposes of this definition, husband or wife includes domestic partners.

3. The SLB days may be used only upon exhaustion of a member’s accumulated sick

leave, personal leave, non-contract leave (if applicable), and vacation (if applicable).

Days used from the SLB are grants and do not require repayments. However, the

employee they must contribute one (1) day of their sick leave allowance at the

beginning of the next school year to reestablish membership in the sick leave bank.

4. Therefore, the committee expects employees to use discretion in making requests

for days from the SLB. Before approving a request for SLB days, the SLB committee

will review sick leave records and require appropriate documentation. (Including

doctor’s note verifying disability and/or expected duration.)

5. Requests for SLB days should will be made on a SLB request form and submitted to

the Chairperson of the committee through the Human Resource Office. Forms may

be obtained by contacting the Human Resource Office. A link will be posted on the

district website that takes employees directly to this form. Once submitted, this form

will go directly to Human Resources.

6. SLB days will not be granted if an applicant is receiving income from an income

protection insurance policy or similar coverage (for example, short-term disability,

Arkansas Teacher Retirement Disability, etc.).

7. Sick leave grants made from the SLB shall be for no more than fifteen (15) days for an

individual applicant per year. Employee’s Employees in need of more than fifteen

(15) days may apply for an additional fifteen (15) days, which if approved, will result

in the deduction from the employee’s salary an amount equal to twenty-two percent

(22%) of the employees current daily pay rate (not to Exceed $60 per day) for each

additional day taken. Any unused SLB days granted may not carry forward to any

subsequent year and shall be returned to the SLB.

8. Unused days contributed to the SLB will accumulate and carry forward (in total – not

by the individual).

9. When applicable, days granted from the SLB will run concurrent with FMLA.

III. PERSONAL LEAVE

A classified employee may apply use personal leave when the reason for the requested leave does not

fall within any of the other leave categories. Unless an emergency exists, days should be requested

five three (3) days in advance to the supervisor so that an appropriate substitute can be scheduled.

Personal leave will be requested in the same manner as sick leave through the online substitute

management system. Staff members are not required to disclose the reason for their personal leave,

but they are encouraged to enter the leave as soon as possible. The supervisor may have to deny days

if adequate coverage is not available. In addition to sick leave, two paid days of personal leave shall be

granted each academic year. If personal days are not used they will rollover to the next year as sick

leave days. If the use of an additional personal day leave is required, one (1) up to two (2) sick leave

days can be used for personal leave. The use of this additional personal leave day(s) will result in the

reduction of either one (1) or two (2) sick leave day(s) from the employee’s current sick leave balance.

Personal leave is not allowed during the first and last week of school, or during the day before or after

a school holiday, unless specifically approved by the Superintendent (or designee).

IV. PROFESSIONAL LEAVE

Categories of Professional Leave:

A. There will be two categories of Professional Leave:

1. Professional Development / Business Leave

2. Civic Leave

B. Professional Development / Business Leave may be granted on approval of the supervisor and

the Superintendent (or his designee). Request for Professional Development / Business Leave

must be made and approved in advance. Approval may be granted for the following reasons:

1. Education/Work-related meetings and conferences

2. School visitations

3. Field trips and other activities where students are being chaperoned/supervised

4. Participation in Professional Organizations

5. Approved Professional Development

C. Civic Leave may be granted for the following:

1. Jury Duty

2. Other civic responsibilities and activities

3. Political activity affecting education

D. Approval/Disapproval of Professional Leave

In all categories above, the Superintendent (or designee) will have three options related to

disposition of the leave request:

1. Disapprove the request.

2. Approve the request, and agree that the school will accept responsibility for some or

all of the expenses related to the leave.

3. Approve the request, and charge the employee with accepting the responsibility for

any expenses related to the leave.

In deciding which option to exercise, the Superintendent or (designee) will consider the

benefit likely to accrue to the Fayetteville Schools; the availability of budgeted funds; whether

the request for leave was initiated by the employee, the school, or some other agency. Travel

procedures outlined in Policy No. 4133 will be followed at all times.

V. EXTENDED LEAVE

Extended leave is a leave of absence without pay and benefits, but with the privilege of returning to

the same or as nearly comparable assignment as possible and may be granted upon approval by the

Board of Education under the following conditions:

A. An extended leave may be granted for not less than six (6) months or more than one (1) year

unless otherwise specified in this policy or the Communicable Disease Policy No. 4170.

Extended leave less than six (6) months but a minimum of three (3) months may be approved

if recommended by the Superintendent. Six month leaves must begin at the beginning of a

school term (either July 1 or January 1).

B. The employee on extended leave must notify the Superintendent not less than thirty (30) days

prior to the end of his approved leave term of his intention to resume work.

C. Failure to notify the Superintendent of intention to resume work as indicated, or failure to

report for duty at the expiration of an extended leave shall be considered a resignation.

D. Application for extended leave, except in emergencies such as ill health, must be filed with the

employee’s supervisor and the Superintendent in writing at least one month before leave shall

take effect. Written response to each application is required. In determining whether to

approve or deny an application, the administrators and the Board of Education will consider

the employee’s request, the potential effect on the students involved, and the employee’s

length of service in the District, and other appropriate factors.

E. All benefits to which an employee was entitled at the time his extended leave commenced will

be restored to him upon his return. Unless otherwise specified, a returning employee will be

placed on the salary schedule at the level achieved prior to his leave.

F. All employees are eligible to apply for extended leave in the following categories:

1. Physical, mental, or emotional illness of the employee which extends beyond

accumulated sick leave.

2. Military induction or enlistment for active military service in time of war or other

national emergency in accordance with the provisions of the Act of Congress requiring

universal military service for meeting such emergency. Leave will be granted to any

classified employee who is a member of a Guard or Reserve Unit ordered to active

duty by a proper authority in accordance with current law.

3. Illness or injury of a member of the employee’s immediate family or any other family

catastrophe requiring the employee to be absent from work.

4. Advanced study in the teacher’s employee’s major field.

5. Child bearing. An employee may apply for such leave to be effective beginning at any

time between the commencement of pregnancy and the semester following the birth

of the child. (Note – Sick leave may be used for child bearing, but should not exceed

six eight (8) weeks unless a medical complication exists.)

6. Child rearing. An employee may apply for such leave to be effective at any time during

which the teacher employee has a child living at home. (An employee adopting a child

may apply for such leave to be effective prior to receiving custody, if necessary to

fulfill the requirements for adoption.)

7. Becoming a candidate for, or serving in, a public office, unless there is a specific legal

prohibition.

8. Enlistment in the Peace Corps or other such federal program. Such enlistment shall

not exceed three years. If verifiable and relevant experience is gained, the employee

will be awarded appropriate experience on the salary schedule, even if the allowable

out-of-district credit limitation has been reached.

9. Absence from the area due to the temporary transfer or sabbatical assignment of a

spouse.

10. Consideration of career change. Such leave will be approved for one full year and will

generally not be approved unless the employee has a minimum of ten years

experience in the District.

VII. LIMITATIONS AND CONDITIONS

If an administrator has reason to believe that the requirements for any type of leave as described in

Sections I-V of this policy have not been correctly applied, verification may be required of the

employee. The administrator will notify the employee in writing of why verification is required.

5.40 – HOMELESS STUDENTS

The Fayetteville School District will afford the same services and educational opportunities to homeless

children as are afforded to non-homeless children. The Superintendent or his/her designee shall appoint

an appropriate staff person to be the local educational agency (LEA) liaison for homeless children and

youth whose responsibilities shall include, but are not limited to: coordinating with the state educational

liaison for homeless children and youth to ensure that homeless children are not stigmatized or

segregated on the basis of their status as homeless and such other duties as are prescribed by law and

this policy.

Receive appropriate time and training in order to carry out the duties required by law and this

policy;

Coordinate and collaborate with the State Coordinator, community, and school personnel

responsible for education and related services to homeless children and youths;

Ensure that school personnel receive Professional Development and other support regarding

their duties and responsibilities for homeless youths;

Ensure that unaccompanied homeless youths:

o Are enrolled in school;

o Have opportunities to meet the same challenging State academic standards as other

children and youths; and

o Are informed of their status as independent students under the Higher Education Act of

1965 and that they may obtain assistance from the LEA liaison to receive verification of

such status for purposes of the Free Application for Federal Student Aid;

Ensure that public notice of the educational rights of the homeless children and youths is

disseminated in locations frequented by parents or guardians of such youth, and unaccompanied

homeless youths, including schools, shelters, public libraries, and soup kitchens, in a manner and

form that is easily understandable.

To the extent possible, the LEA liaison and the building principal shall work together to ensure no

homeless child or youth is harmed due to conflicts with District policies solely because of the homeless

child or youth’s living situation; this is especially true for District policies governing fees, fines, and

absences.

Notwithstanding Policy 5.1, homeless students living in the district are entitled to enroll in the district’s

school that non-homeless students who live in the same attendance area are eligible to attend. If there

is a question concerning the enrollment of a homeless child due to a conflict with Policy 5.1 or 5.2, the

child shall be immediately admitted to the school in which enrollment is sought pending resolution of

the dispute, including all appeals. It is the responsibility of the District’s local educational liaison for

homeless children and youth to carry out the dispute resolution process.

For the purposes of this policy “school of origin” means:

The school that a child or youth attended when permanently housed or the school in which the

child or youth was last enrolled, and

The designated receiving school at the next grade level for all feeder schools when the child

completes the final grade provided by the school of origin.

The District shall do one of the following according to what is in the best interests of a homeless child:

Continue the child’s or youth’s education in the school of origin for the duration of

homelessness:

o In any case in which a family becomes homeless between academic years or during an

academic year; and

o For the remainder of the academic year, if the child or youth becomes permanently

housed during an academic year; or

Enroll the child or youth in any public school that non-homeless students who live in the

attendance area in which the child or youth is actually living are eligible to attend.

In determining the best interest of the child or youth, the District shall:

Presume that keeping the child or youth in the school of origin is in the child’s or youth’s best

interest, except when doing so is contrary to the request of the child’s or youth’s parent or

guardian, or (in the case of an unaccompanied youth) the youth;

Consider student-centered factors related to the child’s or youth’s best interest, including

factors related to the impact of mobility on achievement, education, health, and safety of

homeless children and youth, giving priority to the request of the child’s or youth’s parent or

guardian or (in the case of an unaccompanied youth) the youth.

If the District determines that it is not in the child’s or youth’s best interest to attend the school of origin

or the school requested by the parent or guardian, or (in the case of an unaccompanied youth) the

youth, the District shall provide the child’s or youth’s parent or guardian or the unaccompanied youth

with a written explanation of the reasons for its determination, in a manner and form understandable to

such parent, guardian, or unaccompanied youth, including information regarding the right to appeal.

For an unaccompanied youth, the District shall ensure that the LEA liaison assists in placement or

enrollment decisions, gives priority to the views of such unaccompanied youth, and provides notice to

such youth of the right to appeal.

The homeless child or youth must be immediately enrolled in the selected school regardless of whether

application or enrollment deadlines were missed during the period of homelessness.

The District shall be responsible for providing transportation for a homeless child, at the request of the

parent or guardian (or in the case of an unaccompanied youth, the LEA Liaison), to and from the child’s

school of origin.

For the purposes of this policy, students shall be considered homeless if they lack a fixed, regular, and

adequate nighttime residence and:

1. Are:

Sharing the housing of other persons due to loss of housing, economic hardship, or a

similar reason;

Living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative

adequate accommodations;

Living in emergency or transitional shelters

Abandoned in hospitals, or are awaiting foster care placement

2. Have a primary nighttime residence that is a public or private place not designed for or

ordinarily used as a regular sleeping accommodation for human beings:

3. Are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train

stations, or similar settings; and

4. Are migratory children who are living in circumstances described in clauses (a) through (c).

In accordance with Federal law, information on a homeless child or youth’s living situation is part of the

student’s education record and shall not be considered, or added, to the list of directory information in

Policy 5.13.

To the extent feasible, the District shall do one of the following according to what is in the best interests

of a homeless child. (For the purposes of this policy “school of origin” means the school the child

attended when permanently housed or the school in which the child was last enrolled.)

1. Continue educating the child who became homeless between academic years or during an

academic year in their school of origin for the duration of their homelessness;

2. Continue educating the child in his/her school of origin who become permanently housed

during an academic year for the remainder of the academic year; or

3. Enroll the homeless child in the school appropriate for the attendance zone where the child lives.

If the District elects to enroll a homeless child in a school other that their school of origin and such action

is against the wishes of the child’s parent or guardian, the District shall provide the parent or guardian

with a written explanation of their reason for so doing which shall include a statement of the

parent/guardian’s right to appeal.

In any instance where the child is unaccompanied by a parent or guardian, the District’s local

educational liaison for homeless children and youth shall assist the child in determining his/her place of

enrollment. The Liaison shall provide the child with a notice of his/her right to appeal the enrollment

decision.

Each Homeless child or youth shall be provided services comparable to services offered to other students

in the school who are not homeless. These services include:

students with disabilities, and educational programs for student with limited proficiency in

English;

c) Programs in vocational education;

d) Programs for gifted and talented student; and

e) School meals program.

5.42 – STUDENT HANDBOOK

The Fayetteville Public Schools shall prepare and maintain a Student Handbook which shall be approved

by the Board of Education on an annual basis. The Student Handbook shall be updated as needed to

reflect changes in law, the policies of the Board, and Arkansas Department of Education Rules Governing

Standards for Accreditation. The Student Handbook shall contain a summary of the Parental

Involvement Parent, Family, and Community Engagement Plan adopted by the Fayetteville Public

Schools pursuant to Arkansas law.

Changes to the Student Handbook shall be provided to students and parents, either in the Student

Handbook, or, if changes are made after the Student Handbook is printed, as an addendum to the

Student Handbook.

5.43 – SERVICE ANIMALS ON SCHOOL GROUNDS

Students with “disabilities” as defined by the Americans with Disabilities Act shall be permitted to use

service dogs and trained miniature horses (hereinafter referred to as service animals) on school grounds,

provided the individuals and their animals meet the requirements and responsibilities identified in this

policy.

When a student with a disability seeks to bring a service animal on school grounds, school district

personnel shall require the parent or legal guardian to submit medical documentation from a licensed

physician the student’s parent or legal guardian that the animal is necessary because of the student’s

disability, and a written explanation of the work or task the animal has been trained to perform. School

personnel are not entitled to ask for documentation that the animal has been properly trained, but the

parent or legal guardian of the student bringing the animal on school grounds will be held accountable

for the animal’s behavior.

Any service animal brought on school grounds by a student with a disability must have been trained to

do work or perform a task for the student. The work or tasks performed by the service animal must be

directly related to the student’s disability. Examples of work or tasks include, but are not limited to,

assisting students who are blind or have low vision with navigation and other tasks, alerting students

who are deaf or hard of hearing to the presence of people or sounds, providing non-violent protection,

pulling a wheelchair, assisting a student during a seizure, alerting students to the presence of allergens,

retrieving items such as medicine, providing physical support and assistance with balance and stability

to students with mobility disabilities, and helping students with psychiatric and neurological disabilities

by preventing or interrupting impulsive or destructive behaviors.

Neither the crime deterrent effects of an animal’s presence nor the provision of emotional support,

comfort, or companionship shall constitute work or tasks performed for a student with a disability under

this policy. No animal shall be permitted on school grounds for the sole purpose of providing emotional

support, comfort, companionship, crime deterrence or similar support for a student.

A service animal shall be under the control of its student handler. A service animal shall have a harness,

leash, or other tether, unless either the handler is unable because of a disability to use a harness, leash,

or other tether, or the use of a harness, leash, or other tether would interfere with the service animal’s

safe, effective performance of work or tasks, in which case the service animal must be otherwise under

the handler’s control by means of voice control, signals, or other effective means.

A service animal shall be properly groomed to prevent shedding and dander, and shall be kept clean of

fleas and ticks.

School personnel may ask an individual with a disability to remove a service animal from the premises if:

1. The service animal is out of control and the animal’s handler does not take effective action to

control it;

2. The service animal is not housebroken; or

3. Making reasonable accommodations for the service animal’s presence would fundamentally

alter the nature of the service, program, or activity.

If the school district excludes a service animal due to any of the reasons listed above, the district shall

give the student with a disability the opportunity to participate in the service, program, or activity

without having the service animal on the premises.

School personnel are not responsible for the care or supervision of a service animal brought on school

grounds by a student with a disability. Students with service animals are expected to care for and

supervise their animals. In the case of a young child or a student with a disability who is unable to care

for or supervise the service animal, the student’s parent or legal guardian is responsible for providing

care and supervision of the service animal at the parent or guardian’s expense. Any adult responsible

for providing care and supervision of the service animal on school grounds shall be subject to the same

background checks required of all employees of Fayetteville Public Schools.
