FMM organised a seminar onEmployment of Foreign Workers andExpatriates in the Manufacturing Sectoron April 6, 2017. The seminar wasofficiated by Dato’ Abdul Halim binAbdul Rahman, Deputy DirectorGeneral, Immigration Department(Administration) and attended by160 Human Resource professionalsworking in the manufacturing sector.Seminar speakers were from the

The ePPAx, managed by the LabourDepartment, caters for recruitment fromall source countries except Bangladesh.The ePPAx covers all manual processingunder Labour Department i.e. up toquota approval. Processing at MOHAis still manual. Employers with LabourDepartment approval via the ePPAxhave to proceed to MOHA for interviewsat the One-Stop Centre (OSC). Afterreceiving approval, companies can applyfor calling visa and medical examinationat source country through the ForeignWorkers Computerised ManagementSystem. The Jobs Clearing System issubsumed under the ePPAx. Processingcovers verification of information whichtakes a month, including LabourDepartment visits to the employerand hostel premises.

The SPPA is for Bangladeshis onlyand is a Government-to-Governmentarrangement managed by a vendorappointed by MOHA. Companieschoose their candidates once theagent is appointed in Bangladeshand the agent is randomly autoassigned by the system.

The Rehiring Programme, which startedon February 15, 2016 would end onDecember 31, 2017. The programme is tolegalise illegals (Pendatang Asing TanpaIzin, PATI) working with employers. PATIsregistered with Immigration Departmentare issued with E-Card and are eligibleto be re-hired, subject to terms andconditions which include whether theyhad entered through proper channels,worked with an employer, without acriminal record, not a UNHCR cardholder,passed medical examination and insectors that are allowed.

The Employers‘ Undertaking (EU, formerlyknown as Employers MandatoryCommitment), has been enforced sinceJanuary 1, 2017 except the clause thatrequires the levy burden to be borne byemployers, which comes into effect onJanuary 1, 2018. The EU must be signedat the Labour Department in Putrajaya14 days after notification of approval bythe Labour Department (for ePPAx); andat the OSC, MOHA for SPPA approvalsduring the employer’s interview session.

Expatriate application is managedby Talent Corporation Malaysia Berhadusing the MYXpats system. TheImmigration Expatriate ServicesDivision processes the final approval.There are three categories ofemployment pass:

• Category I – minimum salaryRM5,000; minimum work periodof two years with dependents;

• Category II – minimum salaryRM5,000; maximum work period lessthan two years with dependents;

• Category III – salary betweenRM2,500 – RM4,999; maximumwork period 12 months, renewaltwo times.

The maximum validity period for aProfessional Visit Pass is 12 months.If services are required for a longerperiod, the employer has to applyfor an Employment Pass. There isan appeal process for rejectedapplications which are processedoffline. The employer is requiredto provide additional justificationfor the application. The decisionon the appeal lies with the Director-General of Immigration Department.Employers could make a final appealto MOHA.

On May 3, 2017, HE Maria CastilloFernandez, Ambassador of the EuropeanUnion Delegation to Malaysia called onTan Sri Dr Lim Wee Chai, FMM President.

HE Ambassador took up her new position inMalaysia on September 2, 2016 after havingserved for four years as Head of Division forIndia, Nepal, Bhutan and Bangladesh at theEuropean External Action Service of theEuropean Union.

The issues discussed included the soon-to-be resumed negotiations for the EuropeanUnion-Malaysia Free Trade Agreement (FTA).The FTA negotiation was launched in 2010but reached an impasse in 2012. Tan SriDr Lim reiterated FMM’s support for theEuropean Union-Malaysia FTA.

Amongst the Asia-Oceania countries, the EUhas signed FTA with South Korea, Singaporeand Vietnam. Currently negotiations arebeing held with Australia, New Zealand,Indonesia and Philippines and an FTA withJapan would soon be finalised.

FMM with the support of MalaysiaDigital Economy Corporation Sdn Bhd(MDEC) organised the FMM ICTConference 2017 with the theme“Moving Towards Industry 4.0:Exploring the World of ConnectedEnterprises” on May 25, 2017.

Dr Helena Eian, FMM Council Member,in her welcome remarks urgedparticipants particularly SMI membercompanies to adopt new technologiesin their manufacturing processes sothat their businesses could remainrelevant and sustainable. She reiteratedthat they need to take steps now,rather than later. Moving towardsIndustry 4.0 is a journey that requireslots of resources from human capitalto capital investments. To embark on

this journey towards Industry 4.0,manufacturers are required to preparefor major fine-tuning of their operationsor even prepare to fail, re-learn fromtheir failures and continue fine-tuning.The manufacturing industry should takemeasures to innovate in order to stayrelevant and competitive in the market.

Dr Helena also highlighted that theFMM-MIER Business Conditions Surveyin 2H2016 revealed that awareness ofIndustry 4.0 among manufacturerswas low. Only 12% of the respondentsare very aware of Industry 4.0; 41%are somewhat aware, 28% need moreinformation (via seminars, literature, etc.)and 19% are not aware at all. The surveyfindings also showed that 20% ofthe respondents’ operations were

automated at above 50% while 77%were automated between 1% – 50%and 3% were not automated at all.

Jeyasigan Nair, Director of Technology& Frontier Business Division, MIDAhighlighted the Government incentivesfor Smart Manufacturing including:

• Domestic Investment StrategyFund which provides matchinggrants for expenditures incurredfor upgrading the company’stechnological capabilities to be morecompetitive internationally, moveup the value chain and enable thecompany to be active participantsin the global ecosystem.

• Automation Capital Allowanceto encourage swift adoption ofautomation among manufacturingcompanies in undertaking innovativeand productive activities. As ofJanuary 20, 2017, a total of36 applications had been approved.

• Soft Loan Scheme for Automation &Modernisation which was launchedin February 2017.

MITI and MIDA will take the lead inspearheading Industry 4.0 initiativesin Malaysia as follows:

• A National Strategic Plan forIndustry 4.0/Smart Manufacturingwill be prepared before end-2017.

• Undertake an industrial studyfocus on ‘Industry 3+2 Sectors’ i.e.Electrical & Electronics, Machinery& Equipment, Chemicals, MedicalDevices and Aerospace sectors.

• To collaborate with industry topromote the exchange of technicalknow-how and marketing.

• Outreach programmes to connectall stakeholders to accelerateindustrial growth through theadoption of smart technology.

• Spearhead the adoption of SmartManufacturing and Industry 4.0 inMalaysia in sync with the 2050National Transformation (TN50).

FMM Trade and Investment Mission to Jakarta,Indonesia was held from April 4 to 6, 2017 and ledby Ir Ter Leong Leng, FMM Council Member. A totalof 20 representatives from 15 member companiesparticipated in the trade mission.

At a briefing session for participants, MATRADEIndonesia and Angeline Suparto Law Corporationpresented papers on Doing Business in Indonesiaand the Legal Aspects of Doing Business in Indonesiarespectively. MATRADE Indonesia also arranged one-to-one business matching sessions for participants.

Over 30 business matching meetings were arrangedand potential sales of more than RM8.75 million areexpected for sales from first aid kits, condoms and thesupply of stamping parts for the automotive industry.

The Innovation Incubation Centreaspires to accelerate the growth oftechnopreneurs in the renewableenergy, ICT, biotech and engineeringindustries by nurturing enterprisesfrom ideation to commercialisationvia provision of interventionprogrammes in critical areas.

It is difficultto truly appreciate the impact of Lean thinking until you have seen and experienced Japan hands-on.

On April 19, 2017, the FMM Branding and IntellectualProperty Committee visited Wipro ManufacturingServices Sdn Bhd, located at Subang Jaya,Selangor Darul Ehsan. A total of 23 representativesfrom member companies participated in the visitled by Michelle Hah, Chairman of Branding andIntellectual Property Committee.

WIPRO UNZA, part of Wipro Consumer Care &Lighting Group, is amongst Southeast Asia’sleading manufacturer and marketer of personalcare products, supplying Asian focused brands tomillions of Asian consumers. The group’s SubangJaya complex is currently its largest productionfacility occupying a land area of about 36,610 m2.Participants had the opportunity to view theproduction processes of the personal care productsand the automated line of delivering the finishedgoods to the warehouse.

On April 11, 2017, 16 participantsfrom member companies visitedthe Malaysian Global Innovation &Creativity Centre (MaGIC), Cyberjaya.The visit was led by Ir Ter Leong Leng,FMM Council Member and Chairmanof FMM Entrepreneurship Committee.

MaGIC is a one-stop centre forentrepreneurs, providing all thefacilities an entrepreneur would

need. Among the services theyprovide include funding frombanks or venture capitalists toproviding incubators for developingstart ups to improve their productsand services.

The visit was organised for membersto gain a better understanding ofthe MaGIC Accelerator Programme(recently renamed to Global

Accelerator Programme (GAP).GAP is designed to build and growan ASEAN community of start-upsby providing opportunities to fosterrelationships and achieve a regionaloutlook, access to regional route-market partners and investors andexchange knowledge with peers.

A total of 229 participants attended theFMM Industrial Waste ManagementConference 2017 held on May 16,2017. The conference was customisedto provide updates on environmentalregulations and strategies forcompanies to reduce and recycletheir industrial waste.

Dato’ Dr Ahmad Kamarulnajuib binChe Ibrahim, Director General ofDepartment of Environment (DOE)presented guidelines on environmentalself-regulation and mainstreamingtools for industry. Noor BaizzuraAzizan, Principal Assistant Directorof Environment Institute of Malaysia(EiMAS) shared information onhow to become an environmentalcompetent person as well asadditional qualifications that certifiedcompetent person could attain fromEiMAS. Environmental competentpersons who attended the Conferencewere awarded six ContinuousProfessional Development (CPD) hours.

Participants were also enlightenedon practical strategies to reduce andrecycle solid waste, industrial effluentsand air emissions by speakers fromGovernment agencies, establishedmanufacturers as well as serviceproviders. The speakers were fromDOE Selangor, National Solid WasteManagement Department, MalaysianBioeconomy Development CorporationSdn Bhd, Acme Chemicals (Malaysia)Sdn Bhd, SOLS 24/7 Malaysia, Excel AirEngineering Sdn Bhd and PerundingHMS Integrasi.

The average global robot density inthe manufacturing industry in 2015is about 69 industrial robots installedper 10,000 employees. The mostautomated markets are the Republicof Korea, Singapore, Japan andGermany. The Republic of Korea hasby far the highest robot density in themanufacturing industry at 531 industrialrobots per 10,000 employees in 2015.

The biggest benefit of automation isthat it saves labour. Besides reducingenergy and materials usage, it alsoimproves quality, accuracy and precisionof outputs. However, concerns of highinitial investment, employees’ upskilltraining and potential retrenchmentmay hinder implementation ofautomation in factories.

FMM Factory Automation Conference2017 with the theme “Financing forExpansion and Practical ModernisationProcess” was organised on April 20,2017 to address these concerns.A total of 131 participants obtainedinformation on financing optionsas well as practical approaches toenhance automation in their factoriesand warehouses.

Members of the FMM SMI Committeevisited Antah Schindler Training Centre,Balakong on May 12, 2017. A total of42 representatives from 26 membercompanies participated in the visit.Ir AK Woo, Vice-Chairman of SMICommittee led the visit.

Schindler is one of the world’s leadingproviders of elevators, escalators andmoving walkways. Participants learnthow Schindler Malaysia designs itstechnical and vocational training(TVET) system to acquire new talents.Schindler’s TVET system combineswork-based training at a host companywith instruction at a vocationalclassroom. The training centre isequipped with lift training shafts,escalators, lift simulators with oversightbeing provided by experienced andinternational certified master trainers.It has also been certified by theDepartment of Occupational Safetyand Health to train Lift CompetentPerson Grade 3.

A total of 215 representatives from117 member companies visited theGerman-Malaysian Institute (GMI) atKajang, Selangor on April 22, 2017.The FMM delegation was led byDato’ Dr Ir Andy Seo, FMM Vice-President and Chairman of FMMSMI Committee.

GMI is a joint venture between theMalaysian and German Governments.It offers advanced broad-basedengineering education and trainingwith industrial consultancy and services.

The key highlight of the visit was thecampus tour to GMI’s laboratories/workshops facilities such as iFactory

Innovation Centre, IndustrialCommunication Lab, ProgrammableLogic Controller Lab, Facilities & BuildingAutomation Lab, Autronics & HybridSystems Lab, Sheet Metal Workshop,CNC Precision Machining Centre andRobotics Lab. Participants were alsobriefed on how they can organise theirproduction in a lean and efficient way.

Effects of the CollectiveAgreement after aTakeover or Merger

Q1We took over a company that was placedunder receivership. There was a changein the company name after the takeover.The company had signed a collectiveagreement (CA) with one of the nationalunion and the CA had not expired at thetime of the takeover.

Since we are not a signatory to theCA, the management felt that it is notobligated to comply with the terms andconditions stipulated in the CA. Theunion has threatened to launch a picketand wants to file a non-compliancecase with the Industrial Court underSection 56(1) of the Industrial RelationsAct 1967 if we refuse to comply withthe terms in the CA. Kindly advice.

AThe said question falls within the purviewof Section 17(1) of the Industrial RelationsAct, 1967 which reads:

A collective agreement which hasbeen taken cognizance of by the Courtshall be deemed to be an award andshall be binding on-(a) “the parties to the agreement including

in any case where a party is a tradeunion of employers, all members of thetrade union to whom the agreementrelates and their successors, assigneesor transferees;’’

Thus, by taking over the company,your company falls within the pretext assuccessors, assignees or transferees andtherefore your company is bound bythe terms and conditions as stipulatedin the CA.

The case law that illustrates this, isthe Kesatuan Kebangsaan WartawanMalaysia & Anor vs Syarikat PemandanganSinar Sdn. Bhd & Anor 3(CLJ) 2001.

Your company is only bound bythe current unexpired CA. Oncethe current CA expires, the Unioncannot submit a new proposal forthe renewal of the CA because yourcompany has not given recognitionto the union.

Constructive Dismissal

Q2One of our junior executive wasdemoted to a lower grade after adomestic inquiry for refusing to complywith lawful instructions. Not satisfiedwith the decision, he notified thecompany that he is walking outof the company deeming himselfconstructively dismissed and willpursue the matter with the relevantauthority. Kindly advise what isconstructive dismissal and will hesucceed in his claim.

AConstructive dismissal (CD) wouldmean where an employee himselfterminates the contract with orwithout notice by reasons of theemployer’s conduct. CD takes placewhen an employee terminates thecontract by walking out because ofrepudiatory conduct of the employer.

Some of the circumstances that canattribute to CD are:• Reduction of wages, allowances

and commission.• Withdrawal of some of the

contractual benefits stated inthe contract of service such asfree meals, water, electricity,housing and car.

• Demotion to a lower grade.• Transfer to a different location not

provided for in the contract.• Changes in job function.

The basic principles involved in CD issummarised in Bryn Perrins, “IndustrialRelations and Employment Law”where it states:

In order for an employee to be ableto claim CD, four conditions mustbe fulfilled:• There must be breach of contract

by the employer. This may be eitheractual or an anticipatory breach;

• The breach must be sufficientlyimportant to justify the employeeresigning or else it must be last ina series of incidents which justifieshis leaving. Possibly a genuine,albeit erroneous interpretation ofthe contract by the employer willnot be capable of constituting arepudiation in law;

• He must leave in response to thebreach and not for some otherunconnected reason; and

• He must not delay too long interminating the contract in responseto the employer’s breach, otherwisehe may be deemed to have waivedthe breach and agreed to varythe contract.

If these conditions are not met,the employee will be held to haveresigned and there will be nodismissal. The onus of proving thatthere was CD lies with the claimant.

This is what CD is about. Now revertingback to your case, the junior executiveleft deeming CD is solely for the reasonthat he was demoted. The demotionwas meted out after he was foundguilty of refusing to comply withlawful instructions, which is a seriousmisconduct. Based on the aforesaidcircumstances, he will not be ableto prove CD as the Company wasjustified to demote him after provinghis guilt at the domestic inquiry.
