The public informal work session of the Board of Chosen Freeholders of the County of Morris was called to order by Director Mastrangelo at 4:05 p.m. on July 23, 2014 at the Long Hill Township Municipal Building, 915 Valley Road, Gillette, New Jersey.

Deputy Clerk of the Board Susan Allard read the open public meeting announcement as to the scheduling resolution and the publication of notice as required by law.

The Board of Chosen Freeholders went into executive session at 4:08 p.m. and resumed open session at 5:30 p.m. with the following in attendance:

At 4:05 p.m. the meeting began in open session with the following in attendance:

Freeholders Mastrangelo, Cesaro, DeFillippo, Krickus and Lyon.

Also present were: Dan O’Mullan, County Counsel; John Bonanni, Administrator; Cathy Burd, Assistant Administrator; and Randy Bush, Assistant County Counsel.

At 4:08 p.m. Mr. O’Mullan read the following resolution:

WHEREAS, pursuant to the Open Public Meetings Act, the Board of Chosen Freeholders of the County of Morris in the State of New Jersey may exclude the public to discuss matters as are provided under the Act (N.J.S.A. 10:4-12(b)).

NOW, THEREFORE, BE IT RESOLVED that this Board hereby excludes the public in order to discuss fifteen (15) such matters:

1. As it pertains to contract matters to discuss negotiations of managed Medicaid contracts pursuant to N.J.S.A. 10:4-12(b)(7);

2. As it pertains to appointment, to discuss one appointment to serve as the Treasurer pursuant to N.J.S.A. 10:4-12(b)(8);

3. As it pertains to appointment, to discuss one appointment to serve as the Chief Financial Officer pursuant to N.J.S.A. 10:4-12(b)(8);

4. As it pertains to appointment, to discuss one appointment to the Morris County Improvement Authority pursuant to N.J.S.A. 10:4-12(b)(8);

14. As it pertains to labor negotiations, to discuss a status update on the PBA 298 award pursuant to N.J.S.A. 10:4-12(b)(4); and

15. As it pertains to personnel, to discuss a personnel requisition for the Office of the Sheriff pursuant to N.J.S.A. 10:4-12(b)(8).

The Board reserves the right, as the Board exchanges ideas related to the above matters and attempts to develop appropriate plans of action as may be suggested by individual Freeholders or staff members, to broaden discussion and to attempt to arrive at nonbinding consensus provided such broadening of discussion continues within the limits set forth in N.J.S.A. 10:4-12(b)(1) through (9). Matters discussed in Executive Session will be made public at the earliest point in time that the need for confidentiality for each such matter shall no longer be necessary.

BE IT FURTHER RESOLVED that this Resolution shall take effect immediately and be in full force from and after its passage.

At 5:30 p.m. the meeting returned to open session.

ADMINISTRATOR’S REPORTMr. Bonanni reported that last evening on behalf of the County he attended the State DOH hearings as relates to the Prime Healthcare purchase of St. Clare’s. He provided testimony as well as others in support of the purchase, which included members of the Mental Health Advisory Board.

As it relates to the traffic concerns that have been expressed to the Board by a number of residents in the Central Avenue area of Morris Plains – he did contact the State to discuss the conceptual design of another access road that would come off of Hanover Avenue into the complex. He did receive a callback from the State and they are reviewing this with their Division of Property Management to make sure that there are no restrictions in the bond issue to clean up the site. Assuming there are no restrictions and the DOHS has no problem with this, the County can go forward to incorporate this into our 2015 budget.

Regarding the Route 24 flyover concept – he did have a conference call with the DOT. He asked if they would consider amending their plan to provide a direct access from Park Avenue back out to Route 24 East. They will get back to us.

The Park Commission is hosting a National Night Out event on August 5 at Mennen Arena from 5 – 9 p.m.

The Insurance Fund Commission’s next meeting is on August 4 at 5 p.m.

There is a Picatinny Work Group meeting this Monday. Congressman Frelinghuysen will discuss the value that Picatinny brings to the area.

COUNTY COUNSEL’S REPORTMr. O’Mullan’s department has reviewed fifty-four resolutions for tonight’s meeting. There will be appointments discussed in closed session that will result in six more resolutions to make it sixty resolutions. There are four ordinances scheduled for this evening, one for introduction (Amendment to a previously issued bond ordinance for

$1,800,000 to rehabilitate the Ann Street Parking Deck). It was noted that originally the bond ordinance had been adopted in 2013 to demolish and re-build the Ann Street Parking Deck. Since then the County has researched into rehabilitating the deck which is a savings to the County. The three ordinances for second reading/adoption are purchase of an all terrain vehicle; a heavy duty cab truck; and new carpeting for the County Clerk’s Office.

FREEHOLDER CESAROHe reported on work being done by the Mosquito Control Division. Due to the recent rainfall that gave us 3.1 inches of rain, there was flooding in some areas of Morris County. In response they partnered with Essex County to provide air spray control over the flooded areas. Seven hundred ninety flooded acres were treated.

Morris County has not seen West Nile virus activity so far, but there are reports of it throughout New Jersey. The County will continue to be vigilant regarding surveillance.

FREEHOLDER LYONHe distributed a schedule of upcoming Human Services events which include the Senior Nutrition Program summer picnics at six sites in August.

They have been meeting on a regular basis on the 2015 budget items.

FREEHOLDER DEFILLIPPOShe, along with Morris County staff members and representatives from Lincoln Park, Passaic County, NJDOT, NJDEP, and NJTPA met in Lincoln Park on July 17 to review and resolve the concerns that the town had regarding the Two Bridges Road Project.  One of the concerns is that the addition of the new bridge would worsen flooding conditions in the area.  Through cooperation amongst the group, modifications were designed into the project that alleviate most of Lincoln Park’s concerns.

Another concern was about removing the old bridge. That was also addressed by suggesting it be pursued as a separate project.

Freeholder Mastrangelo added that Morris County made a good suggestion to bring all the parties to the table. That was the town’s

frustration. By doing so, he feels the process has been accelerated.

FREEHOLDER KRICKUSBudget – Debt – Ann Street Parking Deck He noted that the advantage is to renovate and not have to tear it down and re-build. After further investigation it was determined that the parking deck could be rehabilitated in place of demolition and rebuild.  This realization will save the county $1.5 million of capital funds.  The freeholders took a risk when they added additional resurfacing to the capital program, but due to the savings realized by the Ann Street Garage project borrowing will be what was anticipated prior to the increase in resurfacing projects and the County of Morris may continue to pay down debt as planned.

We will have the MCIA update next month.

He attended a CCM health career graduation a week ago that is federally funded and helps people to advance their careers.

Freeholder Mastrangelo noted our staff has been very creative and came up with the paving plan and minimized the debt structure.

DEPARTMENT HEADS’ REPORTMs. Burd reported that all requests for the 2015 capital budget are due at the Administrator’s Office next Friday. The requests will be reviewed at the next Facilities Review Committee meeting.

Mr. DiGiralomo reported that they are continuing to use the OEM mass casualty bus to help at municipal incidents. Recently they have taken the vehicle to Roxbury and Randolph fires for use by the volunteer fire departments and first aid squads to treat the responders.

Ms. Leary asked for direction regarding the Draft Preservation Trust Fund General Election Referenda on three issues that if adopted by the Board would need to be voted upon by the citizens of Morris County by referendum.  The three modifications would give more options for how the funds could be used.  The deadline is August 15 to file the referenda.  The next freeholder meeting is the last meeting where action may be taken to get the referenda on the ballot for November.  Freeholder DeFillippo said she has some questions that she needs to ask Ms. Leary.  Discussion will be continued at next meeting.

Freeholder Mastrangelo asked Mr. Tugman about providing laptops and a portable printer to be used when the Board is on the road for any changes that need to be made on the agendas by the Clerk and the Deputy Clerk.  Mr. Tugman will meet with Clerk Ketchum to define the specific requirements and determine the best technical solution.

Mr. Tugman reported that the transition to the new VoIP telephone system is 75% completed.

Ms. Santucci reported that the office of Risk Management continues to work to complete the County’s Insurance applications for our 2015 renewal.  These applications will be submitted in August. 

In addition, the Evaluation Committee for the Insurance Broker Services proposals will submit their recommendation to the Freeholder Board by mid-August and a contract should be awarded at the last Freeholder meeting in August.

Mr. Kovalcik thanked the Board for their vote of confidence in appointing him.  It is planned that in August and September the Treasurer’s Office will begin to work on, in conjunction with Risk Management, the 2015 Insurance Fund budget, the 2015 Improvement Authority budget and working with Administration on the 2015 Capital Budget Requests.

Mr. Pinto reported that they received word from the State of New Jersey that the County was awarded $250,000 for an additional generator at Morris View. We are most at risk in this hot weather. The next step is to prepare a grant resolution. Installation is next year and we will research this with the State to see what the grant timeframe is.

RESOLUTIONSThe Freeholder Board reviewed and discussed the resolutions. Regarding the Pipeline resolution, Freeholder DeFillippo would like to include wording about Morris County citizens’ safety for all modes of transport of crude oil within the county.

Freeholder Mastrangelo would like to amend the Board’s resolution on the meeting schedule to allow the Board to re-convene to open session of the work session as soon as closed session has adjourned. Freeholder DeFillippo felt that would not be good for the public because they would not know when to arrive for the open portion of the

work session. It was decided to keep the meeting setup that is currently in place.

On motion by Freeholder DeFillippo and seconded by Freeholder Lyon, the meeting adjourned at 6:05 p.m.
