1 INTRODUCTION

This Decision Document (DD) presents an Explanation of Significant Differences (BSD) in the remedies selected for Site Other Site (OT) 022/Operable Unit (OU) -26, OT024/OU-28, and OT026/OU-29 located at the Former Homestead Air Force Base (AFB), Homestead, Florida,

The Record of Decision (ROD) for these sites was issued in October 1998 (Montgomery Watson, 1998). The final remedies included:

• OT022/OU-26: Remove and landfill soil contamination and intrinsic remediation of groundwater contamination.

• OT024/OU-28: Remove and landfill soil contamination • OT026/OU-29: Remove and landfill soil contamination

This ESD is issued in accordance with §117(c)(42 United States Code (USC) § 9617(c)) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C. §9601 et seq., as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA), and the National Oil and Hazardous Substances Pollution Contingency Plan (NCP), 40 Code of Federal Regulations (CFR) §300.435(c)(2)(i). This BSD has been prepared to provide the public with an explanation of the nature of the change which has been made to the selected remedy set forth in the RODs for the aforementioned OUs; to summarize the information that led to the making of this change; and to affirm that the revised remedy complies with the statutory requirements of CERCLA Section 121,42 U.S.C. § 9621.

2 STATEMENT OF PURPOSE

Following the ROD finalization, issues concaning Land use Controls/Institutional Controls (LUC/ICs) have been identified at OT022/OU-26, OT024/OU-28, and OT026/OU-29. LUC/ICs are "non^engineered instruments, such as administrative and legal controls, that help rriiriimize the potential for human exposure to contamination and/or protect the integrity of the remedy" httD://www.epa. gov/suoerfund/policv/ic/index -htm. Parcel llE, which includes these sites, was transferred fixjm the Air Force to Miami Dade Coimty in 2006 (Attachment 1). LUC/ICs were implemented at these sites as environment use restrictive covenants, but were not iricltided as a , part of the selected remedy in the ROD. Restrictive covenants are provisions in a deed that limit the use of the property and prohibit certain uses. The purpose of this ESD is to formally document the inclusion of LUC/ICs as part of the remedy for each OU. The LUC/ICs remedid action (RA) objectives for OT022/OU-26, OT024/OU-28, and OT026/OU-29 include:

> Prevent residential use, including use of the property as hospitals for human care, public or private school for persons under 18 years of age, or daycare centers for children.

> Prevent exposure to the subsurface soils contaminated with arsenic and Polynuclear Aromatic Hydrocarbons (PAHs) above the higher of residential altemative-SoU Clean­up Target Level (SCTL) or aboVe background concentration, by preventing digging, excavating or conducting any other activity that would disturb the surface cover without coordinating such efforts and obtaining approval fix)m the FDEP, USEPA, and the Air Force, or their successors.

> Prevent exposure to the groundwater contaminated with arsenic above Maximum Contaminant Levels (MCLs), by preventing the drilling of wells on the property, or the consuming, causing exposxire to, or otherwise using the groundwater for any purpose whatever, without coordinating such efforts and obtaining approval from the FDEP, USEPA, and the Air Force or their successors, and

> Maintain the integrity of any current or future remedial or monitoring system, including monitoring wells and the soil covers.

3 SITE fflSTORY AND PREVIOUS INVESTIGATIONS

3.1 OT022/OU-26

3.1.1 Site History

Site OT022/OU-26 occupies approximately 1.5 acres located in the east-central portion of the Former Homestead AFB at the eastern comer of the intersection of Bikini Boulevard and Bougainville Boulevard. OT022/OU-26 includes the Aircraft Fabrication Facility (Building 745) and a sheltered concrete slab (Building 746) to the southeast (Figure 1).

Building 745 was used for the maintenance of aircraft skin and hydraulics and lead-acid battery storage. Building 745 was partially repaired after Hurricane Andrew, but is not currently occupied. The Waste Analysis Plan listed PD-680 and hydraulic fluid as typical wastes generated at the facility. Three transformers were stored at the eastem comer of the building. In 1993, the transformers were removed and evidence of leakage was not reported (OHM, 2000). Building 745 was equipped with a floor drain S3^tem that discharged via an undergroimd indiistrial waste line to a former ditch located east of the building. A small sump, located at the east^ comer of Building 745, also discharged to die ditch via a separate underground waste line. In 2002, the floor drain system was deactivated and plugged, and the discharge piping was removed (IT, 2002).

Building 746 was used to store gas cylinders, flammable materials, solvents, driveway sealer, and storage cabinets containing paints. Two flammable material storage lockers, located southwest of Buildihg 746, were removed. In addition, two underground storage tanks (UST) for fuel storage were located northeast of Building 746, which were removed in 1994 (Montgomery Watson, 1998).

3.1.2 Previous Investigations

Confirmation sampling was performed in 1994. Confirmation groundwater samples indicated the presence of significant levels of cis-l,2-dichloroethene (DCE), 1,2-DCE, tetrachloroethene (PCE), trichloroethylene (TCE), and vinyl chloride (VC) above the Florida Department of Environmental Protection (FDEP) Groundwater Clean-up Target Levels (GCTLs). GCTLs correspond to Florida Administrative Code (FAG), Drinking Water Standards. In surface soil samples, PAHs, pesticides, and polychlorinated biphenyls (PCS) were detected. Several PAHs were detected at concentrations above FDEP industrial SCTLs (Woodward-Clyde, 1995).

In 1996, the Air Force completed an Interim Remedial Action (IRA) (by volxmtary soil removal) at OT022/OU-26. The contaminants of concern were arsenic and PAHs. The arsenic and PAH impacted soil was removed and disposed of at a Resource Conservation and Recovery Act (RCRA) permitted Subtitle D landfill. Clean, imported, crushed limestone material was u^ to complete backfilling operations. Howev», these soil removal activities failed to remove all contaminated soil as some of the contaminants listed above were observed above die ^licable industrial SCTLs (OHM, 2000; Shaw, 201 la).

Surface soil samples collected fi'om the 1997 Remedial Investigation (RI) soil borings showed low concentrations of benzene, toluene, dhylbenzene, and xylenes (BTEX) compounds below FDEP residential SCTLs. Total PAHs, individual semivolatile organic conqiounds (SVOC), and individual pesticides were also detected in the soil samples. Several PAHs concentrations were above FDEP industrial SCTLs (Woodward-Clyde, 1997). A total of 14 metals were detected above backgroimd concentrations in the Rl surface soil samples. Mercury and lead were detected above FDEP industrial SCTLs in an isolated area south of Building 745, near the former lead-acid battery storage room. Groundwater screening throughout the Site during confirmation sampling and the Rl confirmed that significant concentrations of chlorinated aliphatic hydrocarbons (CAHs) were present in site groundwater, particularly west of Building 745 above FDEP GCTLS and/or federal MCLs (Woodward-Clyde, 1997).

The groundwater and soil sampling locations fi'om the 1994 confirmation sarnpling, 1996 IRA, and 1997 Rl events are also illustrated in Figure 1.

3.2 OT024/OU-28

3.2.1 Site History

Site OT024/OU-28 occupies approximately four (4) acres in the southwestern portion of the Base (Figure 2). Building 750 was used for jet engine tear-down, rebuilding, inspection and repair beginning in approximately 1950. Used jet fuels were drummed and taken to the fire training pit for use in fire training exercises. An oil water separator (OWS) and sump were located in the southwest portion of the site. Aircraft soap used at the facility was discharged to the OWS located southeast of the building outside of the building footprint. Five USTs associated with electroplating operations at the facility were located at the northwest comer of the Building 750. Waste oils were collected in a mobile 500-gallon aboveground storage tank (AST) for recycling. The OWS, USTs, and AST were removed in 1994. Soil removal activities were completed in 1999, but arsraiic and PAH impacted soils remained above FDEP industrial SCTLs (Shaw, 201 lb). Building 744, an AST, and Building 743, an emergency electrical generation building, are located at the south side of the site.

3.2.2 Previous Investigations

Removal of the OWS and its associated sump was conducted between Decemba- 1993 and February 1994. At this time, the floor drains in the building and on the concrete pad were grouted. A two-phase subsurface investigation was completed at the sump/s^arator area in March-May 1994 and November 1994. Sampling indicated the presence of toluene, total recoverable petroleum hydrocarbons (TRPH), and brazene. Groundwater san^les indicated the presence of PCE, TCE, naphthalene, 1-methylnaphthalene, 2-methylnaphthalMie, arsenic, chromium, and lead. Removal of the USTs was conducted in March 1994. There was no visible evidence of leakage from the USTs to the surroimding site media. Soil samples taken &om the excavation iiuiicated no exceedances of established cleanup standards. Four monitoring wells were subsequently installed. Groimdwato' samples indicated no exceedances of the associated MCLs.

An RI was conducted at OU-28 in 1997. Surface soil samples collected during the RI indicated relatively low concentrations of BTEX compoimds. PAHs and SVOCs were also detected. Pesticides were also detected in the surface soil. Arsenic concentrations were detected above FDEP residential SCTLs in surface soil surrounding Building 744 (Woodw^-Clyde, 1997).

In the southern, eastern, and northern portions of OU-28, PAHs, pesticides, and metals (lead and arsenic) were reported as concentrations that exceed the FDEP industrial SCTLs. PAH exceedances were reported primarily in surface soil samples near the eastern and northem portions of Building 750. hi addition, baizo(a)pyrene and benzo(a) anthracene concentrations were detected above the FDEP residential SCTLs ih surface soil samples south of Building 750 near the AST (Building 744). Lead and arsenic were detected above FDEP residential SCTLs in surface soil surrounding the AST (Building 744). Maximum concentrations detected were 1,230 mg/kg and 6.8 mg/kg, respectively. A possible eiqilanation for the high lead concaitrations is lead-based paint flaking ^m the AST. Lead also exceeded the FDEP indtiistrial SCTLs in one surface soil sample near the eastem bomw of Building 750. One pesticide, heptachlor qioxide, was reported at a concentration marginally exceeding the FDEP industrial SCTLs in a surface soil sample collected east of Building 750.

Groundwater sampling from monitoring wells installed for the OWS investigation indicated that low concentrations levels of PCE and TCE were present above the FDEP GCTLs. Further investigation during the RI via Geoprobe® indicated that these concentrations were localized and most were at or below FDEP GCTLs and/or federal MCLs. Groundwater samples collected from 2 wells and were analyzed for volatile hydrocarbons, PAHs, and total lead. No FDEP GCTL exceedances were detected.

3.3 OT026/OU-29

3.3.1 Site History

Site OT026/OU-29 was used as an Avionics Ground Equipment shop. Tactical Electronic Warfare System Shop, and housed various associated testing shops (Figure 3). Building 760 was located at the northeast intersection of Bikini and St Nazaire Boulevards. The building was

demolished after being heavily damaged by Hurricane Andrew. The site currently consists of a mixture of asphalt or concrete paved ar^ and a grassy area covering the former building footprint. A concrete QWS was located at the southeast comer of former Building 760. Influent to the OWS was reported to have originated inside of former Building 760. The effluent discharged to the north into the sanitary sewer that runs along Bikini Boulevard. A 2,000-gallon steel UST, used to store diesel fuel, was also located adjacent to the southwest side of the buildiug. The 2,000-gallon UST was removed in 1994 (Montgomery Watson, 1998). Soil removal activities were completed in 1999, but PAH impacted soils remained above FDEP industrial SCTLs (Shaw, 2011).

3.3.2 Previous Investigations

The OWS was removed in 1994, and the influent and effluent pipmg were sealed at the excavation botmdaries. Subsurface samples of target compounds were reported as either nondetect or below FDEP industrial SCTLs. Groundwater sampling indicated concentrations of TCE, PCE, and VC above FDEP GCTLs. In 1994, the UST was excavated and removed. Subsurface investigation of the UST area showed detections of TRPH and lead.

TRPH was reported at concentrations below the acceptable FDEP cleanup soil criteria. Results of the subsequent grormdwater investigation indicated the presence of chlorobenzene, benzene, 1 ,4-dichlorob«izene, and n^hthalenes. Concentrations of benzene and chlorobenzene exceeded die FDEP groundwater regulations criteria and/or the federal MCL. Resampling in 1996 indicated that these contaminants no longer exceeded the stated criteria.

A RI was completed at the site in 1997. Surface soils near the southern, eastern, and northern portions of former Buildirig 760 contained concentrations of PAHs and one pesticide (heptachlor epoxide) that exceeded the FDEP industrial SCTLs. Additionally, a marginal exceedance of benzo(a)pyrene was reported in the sur&ce soil sample north of former Building 760. The locations of the surface soils with PAH concentrations that exceeded FDEP industrial SCTLs are consistent with areas that would have received runoff fiom the site. Subsurface samples collected from borings near the former OWS excavation indicated that relatively low concentrations of BTEX, PAHs, and pesticides are present Thirteoi metals were reported above background concentrations in the subsurface samples. However, detected analytes were reported below the FDEP industrial SCTLs.

The groundwater screening indicated that significant concentrations of BTEX and chlorinated VOCs were present in the area of the former OWS. Groundwater samples from existing monitoring wells near the center of the former OWS excavation area contained concentrations of TCE, 1,2-DCE, and VC which exceeded the FDEP groundwater regulations criteria and/or federal MCLs.

The groimdwater and soil sampling locations from the previous investigations are also illustrated in Figure 3.

4 SELECTED REMEDY

The ROD for OT022/OU-26, OT024/OU-28, and OT026/OU-29 was issued in October 1998. The Remedies were selected to address the principal risks identified during the R1 and ERA. at the sites. The selected remedies allowed for the Former Hoinestead AI^ to meet its overall objective of protecting human health and the environment through the process of identifying, investigating, cleaning up, and closing contaminated sites.

The selected remedy addressing soil risks at all three sites was to "remove and landfill" the contamination. This remedy included:

> Excavation and removal of contaminated soils above industrial STCLs, > Backfilling excavated areas with uncontaminated fill, and > Transporting contaminated soils to a solid waste landfill for disposal.

The selected remedy addressing groundwater risks at OT022/OU-26 was "intrinsic remediation". This remedy included:

> Evaluation of biodegradation/reduction of contaminants over time, > Long-term groundwater monitorir^ for chemicals of concern, > Restriction of groundwater use at the site, and > Ix)ng-term management and health and safety ovo^ight for construction projects in the

area.

4.1 REMEDY IMPLEMENTATION

4.1.1 OT022/OU-26

In June and July 1999, the soil remedy for the OU-26 ROD was implemented involving the removal of contaminated soil exceeding industrial SCTLs. Approximately 250 tons of contaminated soil/limestone (130 tons more than specified in the ROD) were removed and transported off site for disposal. Figures 4 arid 5 illustrate the excavations and metals concentrations in the soil at the site. Figure 6 illustrates the excavations and PAHs concentrations in the soil at the site.

In accordance with the approved ROD, Long Term Monitoring (LTM) was initiated at the site in Novanber 1999. Groundwater samples were collected quarterly fium November 1999 through

April 2004 (Year 5, Quarter 3), and biennially in 2006, 2008, and 2010. The groundwater samples were analyzed for VOCs and the following natural attenuation parameters: nitrite-nitrate nitrogen, sulfate, total organic carbon, m^faane, ethane, and ethane. The results of the sampling indicated exceedances of TCE, DCE, and VC FDEP GCTLs. Of the natural attenuation parameters sampled, methane, nitrate-nitrogen, sulfate, and total organic carbon were detected. All excq)t one inonitoring well with historical TCE detectiorw showed TCE concentrations below FDEP GCTLs during the February 2010 sampling event (Shaw, April 2011). The sample at MW03 (Figure 1) contained a TCE concentration of 11.8 pg/L. The FDEP GCTL for TCE is

4.1.2 OT024/OU-28

In May and September 1999, the Air Force completed a RA at OT024/OU-28 involving the r^oval of Arsenic and PAH contaminated soil exceeding industrial SCTLs. Approximately 1,450 tons of contaminated soil/limestone (50 tons less than specified in the ROD) were removed and transported off site for disposal. However, these soil removal activities &iled to remove all contaminated soil as some of &e contaminants listed above were observed above the applicable FDEP residential SCTLs (Shaw, 2011). Figure 8 illustrates the excavations and metals concentrations in the soil at the site. Figure 9 illustrates the excavations and PAHs concentrations in the soil at the site.

4.1.3 OT026/OU-29

In May and SeptembCT 1999, the Air Force completed a RA at OT026/OU-29 involving the removal of metals and PAH contaminated soil exceeding industrial SCTLs. Approximately 1,350 tons of contaminated soil/limestone (400 tons more than specified in the ROD) were removed and transported off site for disposal. However, these soil removal activities failed to remove all contaminated soil as some of the contaminants listed above were observed above the applicable FDEP residential SCTLs (Shaw, 2011). Figure 10 illustrates the excavations and metals concentrations in the soil at the site. Figure 11 illustrates the excavations and metals concentrations in the soil at the site.

5 DESCRIPTION OF SIGNIFICANT DIFFERENCES AND BASIS FOR THE ESD

Land xise Controls/Tnstitutional Cnntmls

The 1998 , ROD did not select LUC/ICs for groundwater or soils as part of the RA necessary for protection of human health and the envinnunent Because sites OT022/OU-26, OT024/OU-28, OT026/OU^29 were not remediated to a level protective of unrestricted use/unlimited exposure, this ESD is intended to address the residual risk remaining after the completion of the active con^onents of the RA, which left surface soil unsuitable for residential use, subsurface soil in certain areas unsuitable for industrial use, and contaminated with arsenic and PAHs, and contamination in the groundwater by arsoiic, benzene, and TCE above the FDEP groimdwater regulations and/or federal MCLs imtil the cleanup objectives are met. While certain restrictions on use that run with the land were included in the deed when the property was transferred to Miami-Dade County, this ESD will select LUC/ICs as part of the RA to ensure that the remedy is protective of human health and the environment.

a. LUC/IC Objectives: The objectives of the LUC/ICs in this ESD are, generally, to prevent the unacceptable exposures to residual contamination at the site in the surface soil, subsurface soil and groundwater. Specifically, the LUC/ICs objectives are to:

i. Prevent residential use, including use of the property for hospitals for human care, public or private school for persons under 18 years of age, or daycare centers for children. ii. Prevent exposure to the subsurface soils, by preventing digging, excavating or conducting any other activity that would disturb the surface cover without coordinating such efforts and obtaining approval fiom the FDEP, USEPA, and the Air Force, or their successors. iii. Prevent exposure to the groundwater, by prohibiting the consuming, causing expos;ire to, or otherwise using the groundwater for any purpose whatever, without coordinating such efforts and obtaining approval fiom the FDEP, USEPA, and the Air Force or their successors. iv. Prevent actions that disturb, move, damage, mar, tamper with, interfere with, obstruct, or impede any wells and treatment facilities and systems, and related piping used in the environmental remediation and restoration on the property.

b. Additions to the Selected Ranedy: The ROD for OT022/OU-26, OT024/OU-28, and OT026/OU-29 is hereby revised by ad(fing LUC/ICs as a component of the remedy. The LUC/ICs will include the restrictive covaiants in the deed that transferred Parcel IIE ^m the Air Force to Miami-Dade County and that affected the above objective.

c. LUC/ICs will be maintained until the concentration of hazardous substances in the soil and groundwater are sat such levels to allow for unlimited use and unrestricted exposure. The Air Force is responsible for implementing, maintaining, reporting on, and enforcing the land use controls. Although the Air Force has transferred the property to Miami-Dade Coimty, and may arrange with Miami-Dade County to perform certain procedural responsibilities to Miami-Dade County, the Air Force shall retain ultimate responsibility for remedy integrity.

d Any activity that is inconsistent with Ae LUC/IC objectives or use restrictions, or any other action that may interfere with the effectiveness of the LUC/ICs will be addressed by the Air Force as soon as practicable, but in no case will the process be initiated later than 10 ^ys after the Air Force becomes aware of the breach. The Air Force will notify EPA and FDEP as soon as practicable but no longer than 10 days aftw discovery of any activity that is inconsistent with the IC objectives or use restrictions, or any other action that may interfere with the effectiveness of the LUC/ICs. The Air Force will notify EPA and FDEP regarding how the Air Force has addressed or will address the breach within 10 days of sending EPA and FDEP the notification of the breach.

e. Prior to seeking approval for the EPA and FDEP, the owner or future recipient of the property must notify and obtain approval from the Air Force of any proposals for a land use change at a site inconsistent with the use restrictions and assumptions described in this ROD. The Air Force shaU not approve a modification or termination of LUC/ICs, implementation actions specified in this ESD, or modification of land use without approval by EPA and FDEP. The Air Force shall seek prior concurrence before any anticipated action that may disrupt the effectiveness of the LUC/ICs or any action that may alter or negate the need for LUCs.

£ Monitoring of the environmental use restrictions and controls will be conducted annually by the Air Force. The monitoring results will be included in a separate report or as a s^tion of another environmental report, if appropriate, and provided to the EPA and FDEP. The annual monitoring reports will be used in pr^aration of the Five Year Review to evaluate the effectiveness of the remedy.

6 SUPPORT AGENCY INVOLVEMENT

hi accordance with the NCP §300.435(c)(2), the Air Force consulted with the USEPA and FDEP prior to the issuance of this ESD. "The Air Force also provided USEPA and FDEP with the opportunity to comment on the ESD.

7 STATUTORY DETERMINATIONS

The Air Force and USEPA, with concurraice from the FDEP, has determined tiiat the addition of LUC/ICs to the remedy for OT022/OU-26, OT024/OU-28, and OT026/OU-29 is necessary for these sites, is protective of human health and the environment, complies with Federal and State requirements that are applicable or relevant and appropriate to the RA, is cost-effective, and utilize permanent solutions, and alternative treatment technologies to the maximum extent practicable. While the remedy does not meet the CERCLA preference for treatment (active) as a principal elemoit of the remedy, intrinsic reduction in the volume and toxicity of groundwater contamination has and will continue to occur and tiie Air Force by rranoving soil contamination and disposing of it reduced the volume of soil contamination. Further treatment is not necessary for protectiveness for the current and reasonably anticipated land use due to LUC/ICs which restrict use and exposure.

1. PARTIES

THIS INDENTURE is made and entered into this day of 2006, by and between the UNITED STATES OF AMERICA, acting by and%rough the Secretary of the Air Force, under and pui suant to the powers and authority contained in tlie Defense Base Closure and Realignment Act of 1990, as amended (10 U.S.C. § 2687 note), and delegations and regulations promulgated thereunder (the "drantor"), and MIAMI-DADE COUNTY, a political subdivision of the State of Florida, whose mailing address is 111 N.W. l"Su-eet, Suite 2460, Miami, Florida 33128 (the "Grantee"). (When used in this Indenture, unless the context specifies othenvise. "Grantor" shall include the assigns of the Grantor, and "Grantee" shall include the successors and assigns of the Grantee.)

II. CONSIDERATION AND CONVEYANCE

WITNESSETH, THAT the Grantor, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has remised, released, and deeded, and by these presents does remise, release, and quitclaims unto the Grantee, all the right, title, interest, claim, and demand which the Grantor has in and to the following described lot, piece, or parcel of land, situate, lying, and being in the City of Homestead, Miami-Dade County, and State of Florida (hereafter the "Property"). A description of the Property is set forth on Exhibit A to this Indenture and identified as Parcel 11-E.

III. APPURTENANCES AND HABENDUM

A. TO HAVE AND TO HOLD the same together with:

I. All Grantor owned buildings, facilities, roadways, rail lines, and otlier infrastructure, including storm drainage systems, sewer systems, and water utility distribution systems located thereon, and any other improvements on the property except for wells and treatment facilities and systems and related piping used in environmental remediation and restoration, which

are considered personal property of the Grantor and are not being conveyed to the Grantee under this Indenture;

2. All hereditaments and tenements therein and revisions, remainders, issues, profits, privileges and other rights of the Grantor belonging or related thereto;

3. All rights to mineral, including but not limited to gas, oil, water, top soil, muck, peat, humus, sand and common clay belonging to the Grantor.

IV. EXCEPTIONS

None.

V. RESERVATIONS

A. RESERVING UNTO THE GRANTOR, a right of access to any and all portions of the herein described land for purposes of environmental investigation, response or other corrective actioru This reservation includes the right of access to and use of, to the extent permitted by law, available utilities at reasonable cost to the Grantor. These rights shall be exercisable in any case in which a response action or corrective action to be performed by the Grantor is found to be necessary after the date of conveyance of the herein described land, or such access is necessary for the Grantor to carry out a response action or corrective action on adjoining property. Pursuant to this reservation, the United States, (including but not Ihnited to. Region 4, United States Environmental Protection Agency (EPA), and the State of Florida Department of Environmental Protection (FDEP) and their respective officers, agents, employees, contractors and subcontractors shall have the right (upon reasonable notice to Grantee or the then owner and any authorized occupant of the aforedescribed property) to enter upon the herein described land and conduct investigations and surveys, to include drillings, testpitting, borings, data and/or record compilation and oftier activities related to environmental investigation, and to carry out response or corrective actions as required or necessary under applicable authorities, including but not limited to monitoring wells, pumping wells, and treatment faciUties. In exercising such rights, the Grantor shall use its best efforts to coordinate such activities with the lawftil occupant(s) of the land on which the activities are to be conducted, so that such activities, to the extent technically and economically practicable, do not int^ere with such occupant's beneficial use and enjoyment of the land.

B. Any moriitoring wells, pumping wells or treatment facilities required in conjunction with additional remetUal or corrective action found to be necessary after die date of conveyance shall be designed and installed so as to be as inconspicuous as practicable. Grantor shall notify Grantee in writing, in reasonable detail and in reasonable scale, of the nature of such future facilities and of the location of any such future facilities, and, at Grantee's request, shall record such notice. Grantor shall continue to own existing monitoring wells and other future facilities described above, which are personal property. Grantor shall be responsible for operation, maintaiance, repair, replacement and rerhoval of wells and other facilities. When existing monitoring wells or future facilities are

no longer required in connection with a remedial or corrective action. Grantor shall close or abandon them in accordance with applicable law and regulation within a reasonable period. Grantee may request information concerning Grantor's continuing need for any particular facilities and may request Grantor's closure or abandonment of facilities at any time it appears such facilities are no longer required. If Grantor does not close or abandon facilities no longer required by Grantor in time to meet Grantee's schedule for use of the Property, Grantee may itself close them in accordance with applicable laws and relations, at Grantee's expense. If necessary. Grantee may seek concurrence of EPA and the FDEP as set forth in Section VII.B. below, to close or abandon such facilities, if Grantor has not done so. Once closed or abandoned in accordance with applicable law or regulation, die Grantor shall have no interest in such facilities. Grantor and Grantee shall record one or more notices or amendments of prior notices showing which facilities are closed or abandoned from time to time. If Grantor fails to do so. Grantee may itself record such notice or amendment

VI. CONDITION

A. The Grantee agrees to accept conveyance of the PropCTty subject to all covenants, conditions, restrictions, easements, rights-of-way, reservations, rights, agreements, and encumbrances, whether or not of record.

B. The Grantee acknowledges that it has inspected, is aware of, and accepts the condition and state of repair of the Property, and that the Property is conveyed, "as is," "where is," without any representation, promise, agreement, or warranty on the part of the Grantor regarding such condition and state of repair, or regarding the making of any alterations, improvements, repairs, or additions. The Grantee further acknowledges that the Grantor shall not be liable for any latent or patent defects in the PropMty, except to the extent required by applicable law, and as set forth in Section VII.B. and Vin.p.

C. Grantee hereby understands and agrees that all costs associated with removing any restrictions of any kind whatsoever contained in this Indenture, whether necessitated by an environmental or other law or regulation, shall be the sole responsibility of Grantee, without any cost whatsoever to the United States.

VII. COVENANTS

A. Ashestns-Cnntaining Materials ("ACM"!. The Grantee is wamed that the Property may contain current and former improvements, such as buildings, facilities, equipment, and pipelines, above and below the groxmd, that may contain ACM. The Grantee covenants and agrees that in its use and occupancy of the Property, it will conqrly with all applicable Federal, State, and local laws relating to asbestos. The Grantee is cautioned to use due care during property development activities that may uncover pipelines or other buried ACM. The Grantee covenants and agrees that it will notify the Grantor promptly of any pot^tially friable ACM that constitutes a release under the federal Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. §§ 9601 et seq.). The Grantor's responsibility under this deed for friable ACM is limited to friable ACM in demolition debris associated with Air Force activities

and usage arising prior to the date of this Indenture and is limited to the actions, if any, to be takra in accordance with the covenant contained in Section V1I.B. herein. The Grantee is warned diat the Grantor will not be responsible fiar removing or responding to ACM in or on utility pipelines. The Grantee acknowledges that the Grantor assumes no liability for property damages or damages for personal iajury, illness, disability, or death to the Grantee, or to any odier person, including members of the general public, arising from or incident to the purchase, transportation, removal, handling, use, dsposition, or other activity causing or leading to contact of any kind whatsoever with asbestos on the PropCTty arising after the date of this Indenture, whether the Grantee has properly warned, or failed to properly warn, the persons injured.

B. NOTICES AND COVENANTS RELATED TO SECTION 120(h)(3) OF THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION AND LIABILITY ACT (CERCLA), AS AMENDED, (42 U.S.C. §9620(h)(3)).

1. Pursuant to Section 120(h)(3)(A)(i) of CERCLA, die following is notice of hazardous substances on the Propaty, and a description of remedial action concerning the Property.

a. The Grantor has made a complete search of its files and records. Exhibit B contains a table with the name of hazardous substances stored for one year or more, or known to have been released or disposed of, on the Property; the quantity in kilograms and poimds of die hazardous substance stored for one year or more, or known to have been released, or disposed of on the Property; and the date(s) on which such storage, release, or disposal took place.

b. A description ofthe remedial action(s) taken by the Grantor on the Property regarding hazardous substances is contained in Exhibit C.

c. Pursuant to Section 120(h)(3)(A)(ii) of CERCLA, the United States covenants and warrants:

(1) that all remedial action necessary to protect human health and the environment with respect to hazardous substances remaining on the Property has been taken before the date of this Indenture; and (2) any additional remedial action foimd to be necessary after the date of this Indenture for contamination on die Property existing prior to the date of this Indenture will be conducted by the United States.

Pursuant to and in accordance with CERCLA 120(h)(3)(B), this warranty will not apply in any case in which any grantee of the Property, or any part thereof, is a potentially responsible party with respect to the Property. For the purposes of this warranty, the phrase "reme^al action necessary" does not include any performance by the United States, or payment to the Grantee fixim the United States, for additional remedial actim diat is required to facilitate Grantee's use of the Property hereby conveyed.

d. The United States has reserved a no-cost right of access to the Property in the Reservation Section of this Indenture in order to perform any remedial or corrective action as required by CERCLA 120(h)(3)(A)(ii).

NOTICE

BREACH OF ANY ENVIRONMENTAL USE RESTRICTIVE COVENANT IN SECTION Vm.D.2. BELOW, MAY AFFECT THE FOREGOING

WARRANTY

2. Environmental Use Restrictive Covenants

a. The following environmental use restrictive covenant(s) in this section is (are) being created to protect human health and the environment with regard to residual contamination remaining on the Property and is (are) a conq)onent of the remedial action referred to in section B. 1. above:

(1) The subsurface soils within the Property are contaminated with arsenic and PAHs. In order to prevent exposure to these contaminants and protect the public and site persoimel from exposure to these contaminants, the Grantee is proMbited from digging, excavating, or conducting any other activity tiiat would disturb the siuTace cover without coordinating such efforts and obtaining approval from the FDEP, EPA and the Air Force, or their successors in function.

(2) The groundwater widiin the Property is contaminated with arsenic, benzene and TCE. In order to prevent exposure to these contaminants and protect the public and site personnel from exposure to these contaminants, the Grantee is prohibited from consiiming, caxising exposure to, or otherwise iising the underlying groundwater for any purpose whatsoever, without coordinating stich efforts and obtaining approval from the FDEP, EPA and the Air Force, or then-successors in function.

(3) The Grantee shall not use the Property for residential purposes, hospitals for human care, public or private schools for persons under 18 years of age, or day care centers for childrea For the purposes of this prohibition residential purposes shall mean market housing with permanent utility coimections designed for non-temporary accomodation of individuals or families.

(4) The Grantee covenants not to disturb, move, damage, mar, tamper with, interfere with, obstruct, or impede any wells and treatment facilities and systems, and related piping used in die environmental remediation and restoration on the Property.

b. It is the intent of the Grantor and the Grantee that the Grantor will retain the right to enforce any restrictive cov«iant in this section through the chain of title, in addition to any State law that requires the State to enforce any restrictive coveriant in this section. The Grantee covenants to insert all of this section in any deed to the Property that it delivers.

C. PreservatioTi rnvenant. The threatened eastern indigo snake has the potential to inhabit the Property. The Grantee shall conduct surveys to determine the presence of the eastern indigo snake, prior to undertaking any construction on the Property, the United States shall be deemed a beneficiary to this preservation covenant without regard to whether it remains the owner of any land or interest tiierein in the locality Of the propMty hereby conveyed and shall have the sole right to enforce this preservation covenant in any coiut of competent jurisdiction. This preservation covenaiit, and its restrictions, conditions, and limitations shall be binding on the Grantee and its successors, and assigns in perpetuity. The Department of Interior, Fish and Wildlife Service may, for good cause, and with the concurrence of the General Services Adnoinistration, modify or cancel any or all of the foregoing restrictions upon written application of the Grantee, its successors or assigns.

D. Restriction on roTtimftr^ial Airport Use.

1. The Property shall not be developed either for use as a commercial airport or to support a commercial airport. The foregoing condition shall not apply to aviation-related tenants on the Property, as long as such tenants are not used to support a commercial airport at the former Homestead AFB. For the purposes of this covenant, the term "commercial airport" shall mean a public airport receiving scheduled passenger service having 2,500 or more enplaned passengers per year.

2. The foregoing condition is for the sole benefit of the UNITED STATES OF AMERICA and shall be binding and enforceable against the Grantee in perpetuity. The Grantor reservra the right to enter and inspect the Property for conqiliance with the foregoing conditions.

3. In the event of a breach of the foregoing condition, whether caused by the legal inability of the Grantee, its successors and assigns, at the option of the Grantor, all title, right of possession and all other rights transferred by this instrument to the Grantee, of the Property, or any portion thereof that is found to be in breach of this Covenant, shall, at the option of the Grantor, revert to the Grantor in its then existing condition sixty (60) days following the date upon which demand to this effect is made in writing by the Grantor, unless within said sixty (60) days such default or violation shall have been cured and all such condition^shall have been met, observed, or complied with, or if within sixty (60) days the Grantee shall have commenced the actions necessary to bring the Grantee into compliance with all such conditions of this paragraph VILD. in accordance with a compliance schedule approved by the Grantor said reversion shall not occur and title, ri^t of possession, and all other rights transferred hereby, except such, if ariy, as shall have previously terminated or reverted, shall remain vested in the Grantee, its transferees, successors and assigns. This option of reversion shall be a continuing one, and may be exercised by the United States any time the Grantor determines the aforesaid conditions are not met, observed or complied with by the Grantee or any subsequent transferee, successor of assign.

E. Hazards to Air Navigation. Prior to commencing any construction on, or alteration of, the Property, the Grantee covenants to comply with 14 C.F.R. Part 77 entitled "Objects Affecting Navigable Air Space," or under the authority of the Federal Aviation Act of 1958, as amended. Pursuant to this reservation, the Grantor shall have the right to regulate or prohibit the release into the air of any substance which would impair the visibility or otherwise interfere with the operations of aircraft, such as, but not liniited to, steam, dust, and smoke; the Grantor shall have the right to regulate or prohibit light emissions, either direct or indirect (reflective), which might interfere with pilot vision; and the Grantor shall have the right to prohibit electrical emissions which would interfere with aircraft and Air Force communications systems or aircraft navigational equipment

F. Non-Discrimination. The Grantee covenants hot to discriminate upon the basis of race, color, religion, national origin, sex, age, or handicap in the use, occupancy, sale, or lease of the Property, or in its employment practices conducted thereon. This covenant shall not apply, however, to the lease or rental of a room or rooms within a family dwelling unit, nor shall it apply with respect to religion if the Property is on premises used primarily for religious purposes, llie United States of America shall be deemed a beneficiary of this covenant witihout regard to whether it remains the owner of any land or interest dierein in the locality of the Property.

Vm. MISCELLANEOUS

A. Each covenant of this Indenture shall be deemed to touch and concern the land and shall run with the land.

B. The Grantee may request fi'om the United States a modification or release of one or more of the covenant(s) in whole or in part in this Indenture, subject to the notification and concurrence or approval of the Grantor. In the event the request of the Grantee for modification or release is approved by the United States, the United States agrees to modify or release the covenant (the "Covenant Release") giving rise to such restriction in whole or in part. The Grantee understands and agrees that all costs associated with the Covenant Release shall be the sole responsibility of the Grantee, without any cost whatsoever to the United States. The United States shall delivier to the Grantee in recordable form the Covenant Release. The execution of the Covenant Release by the United States shall modify or release the restrictive covenant With respect to the Property in the Covenant Release.

C. The acceptance of this Indenture shall constitute conclusive evidence of the agreement of the Grantee to be boimd by the foregoing conditions, restrictions, and limitations, and to perform the obligations referred to hereitL

D. The Air Force recognizes and acknowledges its obligations under Section 330 of the National Defense Authorization Act, 1993, Pub. L. No. 102-484, as amended, which provides for indemnification of certain transferees of closing defense property.

1. Notice of FFA. The Ghnntee acknowledges that the Grantor is subject to the terms and conditions of a FFA, which requires the Grantor to conduct activities including, but not limited to, investigations, explorations, surveys, remedial actions, response actions, and corrective actions. The easement reserved in Section V. of this de^ is intended to allow Grantor to fulfill its obligations under the FFA.

2. FFA Inclusion. The Grantee and all subsequent transferees shall include the provisions of this Section VIII.E. in all subsequent lease, transfer, or conveyance documents related to the Property or any portion thereof that are entraod into prior to the determination by the United States that all remedial action is conplete at with respect to the Property.

PB^ REPORT OF BOUNDARY SURVEYING AND MAPPING ACTIVITIES AT THE HOMESTEAD AIR RESERVE STATION SITE, BEING A PORTION OF UNPLATTED SECTION 1, TOWNSHIP 57 SOUTH, RANGE 39 EAST

IN UNINCORPORATED MIAMI-DADE COUNTY, FLORIDA

Introduction:

Pursuant to its contract with Shaw Environmental 8s Infrastructure, Inc. (hereinafter, "Shaw* or the "client.") of Knoxville Tennessee, PBS8sJ has executed several bovuidaty surv^ at the above captioned location for design/evaluation purposes by Shaw.

This site is located in Section 1, Township 57 South, Range 39 East in unincorporated Miami-Dade Coimty, Florida in a semi-rural area south of Miami. The site was originally part of Homestead Air Force Base, which was closed and abandoned by the United States Department of Defense in 1992 after the majority of the Base was destroyed by windstorm Hurricane Andrew. Since that time, portions of the facility have been rebuilt as Homestead Air Reserve Station, and is currently occupied by elements of the Florida Air National Guard, U.S. Air Force Reserve and the U.S. Department of Homeland Security. Other portions of the former Base are under varying forms of control or use by the Miami-Dade County Aviation Department, Parks and Recreation Department and the Public Works Department.

In accordance with the contract, PBS8kJ conducted boundary surveys of six (6) sites, using locations provided by the client. These six (6) sites are identiiied as Sites OU14, OU20/21, OU26, OWS795, and OU22, 28, 29 85 30, each of which are more fully described on the "Boundary Survey* Maps ^uld Surveyor's Reports accompanied by this Report, (q.v.)

TTiBi-mTnentatlon and Surveying Methods:

All methodology used during the course of the survey for each site was in strict accordance with generally accepted survey standards for South Florida, PBS8feJ corporate protocols, and niost importantly, the "Minimum Technical Standards for Land Surveying in the State of Florida,' as published under Rule 51G17-6 of the Florida Administrative Code. Authority for these Standards are promulgated under Chapter 177 of the Florida Statutes, which governs the practice of surveying and mapping in the State of Florida.

In each case, the individual sites were tied into the Florida State Plane Coordinate System for the East Zone of Florida (No. 901) as based on the North American Datum of 1983/1993 adjustment. All coordinate pairs (Northings and Eastings) as indicated on the Survey Maps are derived from this system. Also,

traverses were employed to create mathematically closed figures that in this case, exceed the requirements set forth in the Florida Administrative Code.

Survey monuments were established at the comers of each parcel as required. These moniiments consist of 5/8" steel rebars with yellow caps stamped 'T.B24.'' In the case were boundaiy comers fell on hardscape surfaces, the established monuments consisted of nails and brass discs stamped "PBS&J LB24." Both forms of monumentation meet the requirements set forth in said

To perform the above functions, Ashtech Z-Surveyors GPS receivers and accessories incorporated with Pad^ Crest 9600 pack-bit radio modems vdiere used. This, combined with Wild T-1600 Total Stations were employed to achieve the highest possible degree of accuracy for the surveys.

Field notes, etc.

Copies of field notes and other data associated with the surveys are attached hereto and made a part hereof. The client is advised that this information is being presented as work-related products at the request of the client, and as such, are not intended to supersede the certified survey maps and reports for the sites.

Control Point Locations/Survey Monnments. etc.

All survey work associated with this project was controlled by a horizontal/vertical control station established by the Miami-Dade Water 8s Sewer Department's Survey Office as part of that agency's Covmty-wide GPS/GIS Project completed in 1996. In this case. Master Control Station WALDIN was used due to its proximity to the surveyed sites. A reproduction of the Control Sheet for this monument is attached hereto and made a part hereof. All surveyed boundaiy points were tied into the Master Control Station and are noted as such on the Survey Maps and Reports.
