You are required to prove your case If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part. Dear Commission,

As a follow up to my Notice of Appeal sent on November 21, 2014, I submit this document to provide the details of my appeal based on my best recollection of the events I was fined $149 67 by the Pasco County Super visor of Elections for missing the filing deadline on J 0/31/J 4 for the reporting period 10/18/14-10/30/14. I was seeking re­election to Lexington Oaks COD Seat 4. The amount of expenditmes that were not filed by the deadline was $598..67 ..

Fout yeats ago, in 2010, I experienced little or no issues with filing financial reports, mostly thanks to the guidance of Iiffannie Alligood, the Directot of Election Administration for the Pasco County Supervisot of Elections .. However, in the 2014 election cycle, I did have a few problems filing my financial reports and had to place several phone calls to I iffannie and he1 staff to assist me in either filing or amending reports .. In fact, I amended one report four times leading up to the peliod in question The mistakes I made were enors of my own doing, but the infrequency and unfamiliatity of using the 1epo1ting system contributed to the majority of the errors Outing the week of the deadline in question, I contacted Tiffannie for assistance regarding one of those e11ors The context of that call tanged from both current and foture issues 1elated to my filings. In the midst of that conversation, I specifically heard her to say that the next report did not have to be filed until after the election. Tiffannie is a very competent public servant and she knows he1 job very well so I left that conversation thinking that I did not have to file until after the election and would revisit the report right after the election. Logicallx, it made sense to me at the time because I didn't recall having to file a repo!t with such a short turnaround time (24 hours lJp .the previous cycle. I tlrink this must have changed from the 2010 election because I didn't recall having such a shott turnaround time

What obviously happened dming the conversation with Tiffannie is that we got om wires crossed .. Iiffannie had apparently moved on to discussing the next deadline when I thought we were still discussing the cmrent one. I was actually online making amended co11ections during that conversation and I recall struggling to keep up with maldng the physical conection and conducting the revolving conversation.

During the week of October 30th, I had already loaded all of my financial information into the web repmting tool fo1 the period in question, but did not send it based on the

aforementioned conversation. I also remember thinking that I might expend a few dollars up to or on Election Day, so I logically held off fl om app1oving the G7 Report

On Friday, October 3 lst, I came home from work and immediately went into Halloween mode to give out candy to neighborhood children. I had been campaigning doo1 to door the entire week so by the time I was done with Halloween night, I was absolutely exhausted I went inside and fell asleep instantly. Normally, I check my email pretty regularly during campaign season, but based on the conversation in question, I thought I was ok up until the election, so I felt comfortable not checking it right away. When I woke up the next morning, I opened up my email and saw two similar messages dated 10/30/14 and 10/31/14 from Iiffannie, the former that read:

I was mm tified and confused I immediately emailed Tiffannie in a panic and then filed the G7 1epo1t within the hour She graciously called me back within a couple of hou1s We discussed the pri01 conve1sation we had that had led up to this incident She conveyed to me that I must have misunderstood her and I conceded that She continued by telling me to go ahead and file, which I had already done prior to her calL She also advised me of the fining process

In summarizing this ordeal, there was ce1tainly confusion brought on by miscommunication, but conttibuting to the confusion was the apparent change in iepo1ting from the p1evious election cycle (2010}. The 24 hom tmnarollild for the filing of the period from 10/18/14 to 10130/14 was unanticipated change and a contributing facto1 in this series of events I ce1tainly had absolutely no intent to deceive or hide my financial transactions from anyone I did not seek to gain advantage in any way. I filed the G? report immediately after learning of the delinquency, approximately 8 hours afte1 the deadline .. In running for this position, I only sought to se1ve my local community, not deceive them. I also maintain a 45+ hour wo1k week fo1 my primaiy job which makes it more difficult to manage and keep up with eve1y change that occms.

I have attached the referenced emails and repo1ts for youi consideration I also want to clarify that, despite the misfiring of communication that occuned here, I have the utmost faith in and respect for Ms. Alligood and I am in no way casting any shred of doubt over her abilities to pe1form her duties .. We are lucky to have her in Pasco County.

After· Genernl Election After the General Election, a 90-day final report is due February 2, 2015. This termination report code will be listed as TR-G

Candidates who withdrnw from their race will need to contact the Supervisor of' Elections' office who will establish a termination report code (TR-W) for each candidate.

Note: Termination reports deemed late are also assessed fines.. The ru:nount of the fine is $50 per day late, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report
