How is land identifiGd?

Land is commonly identified by a street address, but sometimes thisatone does not provide an accurate identification of the relevant parcelof land relating to an application. Make sure you also provide theformal land description - the lot and plan number or the crown. sectionand parish/township details (as app:icable) for the subject site. Thisinformation is shown on the title

What is an encumbrance?Title Information

An 'encumbrance ' is a formal obligation on the land. with the mostcommon type being a 'mortgage '. Other common examples ofencumbrances include:

Restrictive Covenants: A 'restrictive covenant ' is a written agreementbetween owners of land restricting !he use or development of the landfor the benefit of others. (eg. a limit of one dwelling Of limits on typesof building materials to be used).

A Planning schemes use specific definitions for di#erent types of useand development. Contact the Council planning office at an early stageIrt preparing your application to ensure that you use the appropriateterminology and provide the required details.

Section 173 Agnements: A 'section 't73 agreement ' is a contractbetween an owner of the land and the Council which sets outlimitations on the use or development of the land

How do planning schemes affect proposals?

A planning scheme sets out policies and requirements for the use,deve:opment and protection of land. There is a planning schemefor every municipality in Victoria. Development of land includes theconstruction of a buildings carrying out works. subdividing land orbuildingsand displaying signs.

Easements: An 'easement ' gives fights to other parties to use theland or provide fof services Of access on. under or above the surfaceoftheland.

Building Envelopes: A 'building envelope ' defines the developmentboundariesforthefand

Proposals must comply with the planning scheme provisions inaccordance with Clause 61 .05 of the planning scheme. Provisions mayrelate to the State Planning Policy Framework. {he Local Planning PolicyFramework, zones. overlays, particular and general provisions. You canaccess the planning scheme by either contacting Council's planningdepartment Of by visiting the Planning Schemes Online section of the

What documents should t check to find encumbrances?

Encumbrances are identified on the title (register search statement)under the header 'encumbrances, caveats and notices'. The actualdetails of an encumbrance are.usually provided in a separate document(instrument) associated with the title. Sometimes encumbrances arealso marked on the title diagram or plan, such as easements or buildingenvelopesA. You can obtain a planning certificate to establish planning scheme

details about your property. A planning certificate identifies the zonesand overlays that apply to the land. but it does not identify a]] ofthe provisions of the planning scheme that may be relevant to yourapplication. Planning certificates for land in metropolitan areas and mostrural af03s can be obtained by visitingyour local Council to obtain a planning certificate in Central Goldfields.Corangamite. Macedon Ranges and Greater Geelong. You can also usethe free Planning Property Report to obtain the same information.

What about caveats and notices?

A 'caveat ' is a record of a claim from a party to an interest in !he land.Caveats are not normally relevant to planning applications as theytypically relate to a purchaser, mortgagee or charged claim, but cansometimes include claims to a covenant ot easement on the land. Thesetypes of caveats may a#ect your proposal.

See Example 2.Other less common types of obligations may also be specified on titlein the form of 'notices'. These may have an effect on your proposal,such as a notice !hat the building on the !and is listed on the HeritageRegister.

Estimated cost of developmentIn most instances an application fee will be required. This fee must bepaid when you lodge the application. The fee is set down by governmentregulations.

What happens if the proposal contravenes an encumbrance ontitle?

To help Council calculate the application fee, you must prosride anaccurate cost estimate of the proposed development. This cost doesnot include the costs of development that you could undertake without apermit Of that are separate from the permit process. Development costsshould be calculated at a normal industry fate for the type of constructionyou propose.

Encumbrances may affect or limit your proposal or prevent it fromproceeding. Section 61 (4) of the P/annan and Envfronmen1'.4ct 7987 forexample, prevents a Council from granting a pemiit if it would result in abreach of a registered restrictive covenant. If the proposal contravenesany encumbrance, contact the Council for advice on how to proceed.

Council may ask you to justify your cost estimates. Costs are requiredsolely to allow Council to calculate the permit application fee. Fees afeexempt from GST.

You may be able io modiO your proposal to respond to the issue. Ifnot, separate procedures exist to change or remove the various typesof encumbrances from the title. The procedures are generally quiteinvolved and if the encumbrance relates to more than the subjectproperty, the process will include notice to !he a#ected party.

The declaration should be signed by !he person who takes responsibilityfor the accuracy of all the information that is provided. Ihi$ declaration isa signed statement that the information included with the application tstrue and correct at the time of lodgement.

As well as describing the land, a full copy of the title will include adiagram or plan of the land and will identify any encumbrances. caveatsand notices.

The declaration can be signed by the applicant or owner, tf the owner isnot the applicant, the owner must either sign the application form or mustbe notified of the application which is acknowledged in the declaration.

What i$ a 'full ' copy of the title?The title information accompanying your application must include a'register search statement ' and the title diagram. which together make upthe title.

In additior}. any relevant associated title documents, known as'instruments', must also be provided to make up a full copy of the title.

Check the title to see if any of the types of encumbrances, such asa restridive covenant. section 1 73 agreement, easement Of buildingenvelope, afe listed. If so, you must submit a copy of the document(instrument) describing that encumbrance. Mortgages do not need to beprovided with planning applications.

Why is 'current' title infomtation nquired?

It is important that you attach a current copy of the title for eachindividual parcel of land filming the subject site. 'Current ' titleinformation accurately provides all relevant and up-to-date intonation.

You should provide sufficient supporting material with the applicationto describe the proposal in enough detail for the Council to make adecision. It is important that copies of alt plans and infomlation submittedwith the application afe legible.

Some Councils require that title infomiation must have been searchedwithin a specified time frame. Contact the Council for advice on theirrequirements.

There may be specific application requirements set out in the planningscheme fof the use or development you propose. The application shoulddemonstrate how these have been addressed or met.

Existing Assets

8. Prior to the use commencing any existing trees, footpaths, vehicular crossings and/or

driveways, signage and/or linemarking conflicting with, not required or deemed obsolete

shall be relocated and/or removed and the kerb & channel, roadway, paths and nature

strip shall be reinstated to the satisfaction of the Responsible Authority.

Erosion and Sediment Control

9. Construction of the car park and ancillary works must be undertaken in accordance with the EPA document Construction Techniques for Sediment Pollution Control, Environment Protection Authority May 1991.

Landscaping 10. The site must be landscaped to the satisfaction of Council.

Amenity 11. The development and use of the land must not cause and adverse amenity impact to any

other person, to the satisfaction of the responsible authority, due to:

c. Noise,

d. Dust,

e. Odour, or

f. Any other cause.

Permit expiry 12. This permit will expire if one of the following circumstances applies:

g. The buildings and works have not commenced within two years of the date of this

permit,

h. On the 31st December 2021

These times may be extended in an application is made to the responsible authority in accordance with the provisions of s.69 of the Planning and Environment Act 1987.

IMPORTANT INFORMATION ABOUT THIS PERMIT

WHAT HAS BEEN DECIDED?

The Responsible Authority has issued a permit.

(Note: This is not a permit granted under Division 5 or 6 of Part 4 of the Planning and Environment Act 1987.)

CAN THE RESPONSIBLE AUTHORITY AMEND THIS PERMIT?

The Responsible Authority may amend this permit under Division 1A of Part 4 of the Planning and Environment Act

1987.

WHEN DOES A PERMIT BEGIN?

A permit operates:

* from the date specified in the permit; or

* if no date is specified, from—

(i) the date of the decision of the Victorian Civil and Administrative Tribunal, if the permit was issued at the

direction of the Tribunal; or

(ii) the date on which it was issued, in any other case.

WHEN DOES A PERMIT EXPIRE?

1. A permit for the development of land expires if—

* the development or any stage of it does not start within the time specified in the permit; or

* the development requires the certification of a plan of subdivision or consolidation under the Subdivision Act 1988

and the plan is not certified within two years of the issue of the permit, unless the permit contains a different

provision; or

* the development or any stage is not completed within the time specified in the permit, or, if no time is specified,

within two years after the issue of the permit or in the case of a subdivision or consolidation within 5 years of the

certification of the plan of subdivision or consolidation under the Subdivision Act 1988.

2. A permit for the use of land expires if—

* the use does not start within the time specified in the permit, or if no time is specified, within two years after the

issue of the permit; or

* the use is discontinued for a period of two years.

3. A permit for the development and use of land expires if—

* the development or any stage of it does not start within the time specified in the permit; or

* the development or any stage of it is not completed within the time specified in the permit, or, if no time is

specified, within two years after the issue of the permit; or

* the use does not start within the time specified in the permit, or, if no time is specified, within two years after the

completion of the development; or

* the use is discontinued for a period of two years.

4. If a permit for the use of land or the development and use of land or relating to any of the circumstances mentioned in

section 6A(2) of the Planning and Environment Act 1987, or to any combination of use, development or any of those

circumstances requires the certification of a plan under the Subdivision Act 1988, unless the permit contains a

different provision—

* the use or development of any stage is to be taken to have started when the plan is certified; and

* the permit expires if the plan is not certified within two years of the issue of the permit.

5. The expiry of a permit does not affect the validity of anything done under that permit before the expiry.

WHAT ABOUT APPEALS?

* The person who applied for the permit may apply for a review of any condition in the permit unless it was granted

at the direction of the Victorian Civil and Administrative Tribunal, in which case no right of review exists.

* An application for review must be lodged within 60 days after the permit was issued, unless a notice of decision to

grant a permit has been issued previously, in which case the application for review must be lodged within 60 days

after the giving of that notice.

* An application for review is lodged with the Victorian Civil and Administrative Tribunal.

* An application for review must be made on an Application for Review form which can be obtained from the

Victorian Civil and Administrative Tribunal, and be accompanied by the applicable fee.

* An application for review must state the grounds upon which it is based.

* An application for review must also be served on the Responsible Authority.

* Details about applications for review and the fees payable can be obtained from the Victorian Civil and

Administrative Tribunal.
