The EB-5 Regional Center Program allows eligible aliens the opportunity to become lawful permanent U.S. residents by investing $500,000 into a qualified EB-5 project in a USCIS designated Regional Center and create at least 10 permanent American jobs per individual investment.

Most Regional Centers are located within a “Targeted Employment Area” which is an area that, at the time of investment, is a rural area or an area experiencing unemployment of at least 150 percent of the national average rate.

As such, the EB-5 Regional Center Program is one of the most flexible immigration programs in the world, allowing foreigners to gain permanent United States residency for themselves, their spouse, and any unmarried children under the age of 21, through their EB-5 investment.

Previous Approvals: Previous EB-5 Projects within the Palm Beach Regional Center have received close to 80 approvals on the I-526 petitions. A total of 5 EB-5 projects have already been sponsored by the Palm Beach Regional Center. Attractive Minimal Participation Levels The Palm Beach Regional Center allows foreign investors to invest in prearranged programs at two levels of investment - $500,000 in more than forty county-wide locations that have unemployment at 150% or more of the national average. Palm Beach Regional Center

Palm Beach Regional Center is approved by USCIS to operate in the Florida counties of Miami/Dade, Broward, Palm Beach, Martin, Port St. Lucie, Indian River, Hendry, Okeechobee and Charlotte. EB-5 Project Structure Florida Restaurant Franchise

Group EB-5 Projects are

administered through the Palm

Beach Regional Center – a

USCIS approved and federally

designated Regional Center. The

projects are located in cities like

Miami, Fort Lauderdale and

West Palm Beach, which are

some of the most wealthy and

important economic areas of the

United States. All of the

development sites have been

certified and designated as

being located in a “TEA” zone,

therefore qualifying for the

$500,000 investment

requirement.

FRFG projects are typically

structured in the form of a loan,

for a period of 5 years. The loan

will be used for the acquisition,

construction and operation of

the restaurants. In some cases,

the investment is backed by real

estate and typically has the first

lien on all assets of the business.

During the course of the loan,

the investors receive a fixed

interest rate payment, which is

accrued annually. The

distribution of typically 2% is

paid every 6 months.

Once the conditions on the

green card have been removed

and the loan has reached its

maturity, the developers would

then refer to the available

sources to repay the loan to the

investors. For example,

operational profits accrued

during the years of operation

may be used. Other options

include the refinancing of the

loan or ultimately the sale of the

restaurant and the sale of the

proceeds used to repay the loan.

become a nationally recognized

restaurant and is poised to become one

of the largest barbecue restaurant

franchises in the country. VooDoo BBQ

currently has 54 operating and licensed

locations and development sites in

Louisiana, Texas, Mississippi, North

Carolina, South Carolina and Florida

with additional plans in place to expand

into Georgia, Alabama and Washington,

D.C.

VooDoo is known for world-class and

mouth-watering barbecue, which begins

Previous EB-5 Success:

In 2012, Florida Restaurant Franchise

Group fully funded the first phase of the

VooDoo BBQ & Grill expansion in

Florida. A total of 10 EB-5 investors

participated in the project and have

received 100% approvals on their I-526

petitions. The first phase has already

opened 2 VooDoo BBQ locations in

Kendall and Pembroke Pines, with two

more stores set to open before the end of

2013 in Fort Lauderdale and Hollywood.

Combined, the restaurants will create a

total of 175 full time jobs, which is 75%

more than needed to meet the EB-5

Program jobs requirement.

Unlike many other EB-5 projects in the

country, the development of our

restaurants is not dependent on EB-5

funds in order to begin operations. FRFG

will proceed with the development with

or without the EB-5 investors.

How long does the EB-5 application process take?

The life cycle of an EB-5 based petition is divided into two parts – the approval of the I-

526, and the actual adjustment of status or consular processing. The initial part, which is

the processing of the I-526, can take from 3 months to 12 months. The approval of the I-

526 is a crucial part of the petition, as USCIS evaluates, at this time, whether the EB-5

investment follows the guidelines imposed by law.

What is “lawful source of funds”?

In order for the EB-5 investor to become a US legal resident or green card holder, the EB-

5 investor must be able to show to USCIS that the capital invested in the job-creating

entity was obtained through lawful means. Income tax returns, evidence of acquisition

and sales of property (in the US and abroad), and evidence of gift of funds are among

some of the documents your immigration attorney will likely request in order to establish

that the capital invested was earned through lawful means.

What happens if the investor’s green card is denied?

Since investors are fearful that they will lose their money if their green card application

(I-526) is denied, we have established a 100% refund policy of all investment funds and

applicable fees. To further assure approval, we have employed the services of some of the

most experienced EB-5 attorneys in the country to review each investor’s petition before

it is submitted to USCIS to help assure a streamlined approval process and reduce the

chances for a denial. Please reference all offering documents for complete explanation of

refund policy.

What is your experience with developing and running a franchise?

Florida Restaurant Franchise Group has a combined 30 years of success in running

various national franchise operations. Most recently, Joe Sloboda and his team developed

and operated the fast food concept of Five Guys Burgers and Fries in the greater Miami

area. Five Guys has been one of the fastest growing restaurant chains in the United States

and has approximately 900 stores. The location ran by Mr. Flechner in Miami Beach, was

in the top 5 highest-grossing stores in the country.
