September 11-12, 2013 The Georgia Composite Medical Board (GCMB) held its regular meeting on September 11-12, 2013, at 2 Peachtree Street, NW, Atlanta Georgia 30303, to consider Medical Board matters. Board members in attendance on Thursday September 11, 2013, were:

Scarlett Shell, Assistant Attorney General Stephanie Mason, Assistant Attorney General Dr. Weil called the meeting to order at 8:00 a.m. AGENDA Dr. Retterbush made a motion, seconded by Dr. White, to approve the agenda of the, September 11-12, 2013 meeting. The motion carried unanimously. MINUTES Dr. Retterbush made a motion, seconded by Dr. Chandler to approve the August 8-9, 2013 minutes. The Board extends their congratulations to Harold Oglesby on being named St.

Josephs’s/Candler’s, 21th James R. Lientz Humanitarian.


September 11-12, 2013 Phyllis White gave an update on the Pain Clinic applications. Board reviewed calendar for 2014 and approved the following tentative dates for the board

meetings subject to modifications. January 9-10 July 10 February 6 August 7-8 March 6-7 September 11 April 3-4 - Savannah October 9-10 May 1-2 November 6-7 June 5-6 December 4-5

EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following information for the Board’s review: Dr. White motioned to go into Closed Session. Dr. Antalis seconded the motion and it carried unanimously.

1. Letter from Representative B.J. Pak regarding the process for complaints. Dr. Retterbush agreed to meet with Representative Pak to discuss the issues.

2. Yolanda McGee sent an email regarding pain management rules. Board referred Ms. McGee to the Laws and Rules.

3. Dr. Nash sent an email regarding no physicians in the Emergency Room only physician extenders without direct supervision. Board to refer Hospital Facility.

4. Report from a physician that his identity has been stolen. Board reported to the Secretary of State and Georgia Drugs and Narcotics Administration.

5. Dr. Hood sent a letter regarding electronic medical records and questions relating to HER. Referred to Board’s website to review the Board Laws and Rules.

6. Regarding a letter from HHS, FDA concerning Hyperbaric Oxygen Treatment Centers. Board approved to put in next newsletter and email to the people who have requested to be on the proposed Rule and Newsletter update email list.

7. Janet Wray gave an update on pending cases and attorney time for the AG’s Office. For information only.

8. Reviewed a GBI list of “Deaths Related to Prescription Drug Overdose Increase in 2012.” Board requested staff to contact the counties not listed on the list for a count.

9. An Article entitled “Professional Licensing Report.” For information only. 10. An Article “Why Physicians Should Steer Clear of Treating Family Members.” Ask

Author if we can publish in newsletter. For information only. 11. Article entitled “Thousands of doctors practicing despite Misconduct.” For information

only. 12. Jim McNatt, MD emailed with information concerning a rule from Florida defining

surgery. The Board referred to the Rules Committee. 13. Felecia C. Lane, DNP, FNP-C, MS, BSN, RN, emailed concerning whether or not she can

address herself as Dr. Lane, Doctor of Nursing Practice. Tabled for further information.


September 11-12, 2013 Dr. White motioned to go into Closed Session to conduct Dr. Retterbush seconded, the motion and it carried unanimously. Dr. Weil declared Open Session. Appearance before the Board Parvaiz Syed, MD requested an appearance before the board. He was accompanied by his attorney Fran Cullen. Dr. Syed and Ms. Cullen presented oral arguments. The Board members asked questions. Dr. Gross motioned to go into closed session. Dr. Deloach seconded the motion and it carried unanimously. Dr. Weil declared Open Session. Dr. Gross motioned to table application for further information. Dr. Sightler seconded the motion and it carried unanimously. Dr. White motioned to go into Executive Session to conduct Committee meetings and Investigative Interviews. Dr. Retterbush seconded, the motion and it carried unanimously. committee. 2. Approved changing the instructions for Form C to include the delegating physician must

supervise the APRN performing a medical procedure a minimum of 10 times as part of the training documentation.

3. Tabled request for the additional procedures – joint aspiration and joint injection – to be added to agreement between Torrence Drakeford, APRN and Steven Niergarth, DO and request that documentation regarding the specific joint(s) be submitted.

4. Recommends the additional procedures – central venous lines (with/without ultrasound), arterial lines (with/without ultrasound), and Vascath (with ultrasound) – be added to the agreement between Carole Lovering, APRN and Ryan Carrick, MD.

5. Approved the Committee recommendation that delegating physicians who submit incomplete NP registration packets be notified that they are allowed a 30-day period to complete the submission of all documentation. If the items are not submitted within the 30 days, the protocol agreement will be null and void and a new registration packet with all items including a new fee must be submitted.

ORTHOTICS AND PROSTHETICS ADVISORY COMMITTEE Dr. Weil presented the report of the Orthotics and Prosthetics Advisory Committee as a motion. Dr. Antalis seconded the motion and it carried unanimously. The Board took the following actions:

1. Kinsey, Christopher -Deny waiver; requesting course in physics then send approval to ABC to allow Mr. Kinsey to take examination for licensure. 2. The Board discussed Attorney General’s advice on whether a person that fits custom spinal Orthotics be licensed and concluded that this practice does not require licensure. 3. Andrea Clair, Fraud Analyst, with National Supplier Clearinghouse, inquired on whether

supplier who only provides custom fabricated diabetic footwear to patients are required to have Orthotic licensure and concluded this practice does not require licensure.

PAIN CLINIC ADVISORY COMMITTEE Dr. Chandler presented the report of the Pain Clinic Advisory Committee as a motion. Dr. Gross seconded the motion and it carried unanimously. The Board took the following actions: Approved the following Applicants for Pain Clinic Licensure:
