PROMOTION OF EQUALITY AND PREVENTION OF UNFAIR DISCRIMINATION ACT, 2000

REDUCE THE AREA OF JURISDICTION OF EXISTING EQUALITY

EQUALITY COURTS AS PUBLISHED IN GOVERNMENT NOTICE NO. 1378 OF 13 JUNE 2003; DESIGNATION OF MAGISTRATES’ COURTS AS EQUALITY COURTS; DEFINE THE AREA OF JURISDICTION OF EACH EQUALITY COURT; AND APPOINTMENT OF PLACES WITHIN TIHE AREA OF JURISDICTION OF EACH EQUALITY COURT FOR TIHE HOLDING OF EQUALITY COURT SITTINGS.

COURTS; RE-DEFINE THE AREA OF JURISDICTION OF EXISTING

I, Penuell Mpapa Maduna, Minister for Justice and Constitutional Development,

under section 16(1) of the Promotion of Equality and Prevention of Unfair

Discrimination Act, 2000 (Act No. 4 of 2000), and after consultation with the headl of

the administrative region as defined in section 1 of the Magistrates’ Courts Act, 1944

(Act No. 32 of 1944), hereby -

reduce the area of jurisdiction of the existing Equality Court mentioned under

the applicable item in column A of the Schedule to this notice by excising .the

districts, sub-districts or other areas of jurisdiction mentioned in that item in

column D of this notice from the area of jurisdiction as mentioned under colwmn

C of the previous notice;

define the area of jurisdiction of the existing Equality Court mentioned under

the applicable item in column A of the Schedule to this notice and the Schedule

of the previous notice, to consist of the districts, sub-districts or oth.er areas of

jurisdiction created in terms of section 2 of the Magistrates’ Courts Act, 1944

(Act No. 32 of 1944), as mentioned in that item in column E of this notice for

the administrative region mentioned in that item in column C of this notice and

in Column B of the Schedule of the previous notice;

(c) designate under the applicable item in column B of the Schedule to this notice

the Magistrates’ Courts mentioned under the item in column B of this notice as

equality courts for the administrative region mentioned in that item in column C;

(d) define the area of jurisdiction of each equality court mentioned under the

applicable item in column B of the Schedule to this notice, to consist of the

districth, sub-districth or other areas of jurisdiction created in terms of section 2

of the Magistrates’ Courts Act, 1944 (Act No. 32 of 1944), as mentio:ned in that

item under column F;

(e) appoint the places as mentioned in column G of the Schedule to t f i s notice

within the area of jurisdiction of each equality court mentioned under that item

in column A and B of this notice for the holding of equality court sittings; and

( f ) amend the Schedule to Government Notice No. 878 of 13 June 2003 to reflect

the amendments and insertions reflected in paragraphs (a), (b), (c), (d), and (e)

above, accordingly.
