from the date of taking over the charge and

shall be governed by standard terms of

to time.

Directorate of Agriculture in place of Shri Satyawan

Agriculture Officer, Quepem in place of Shri Girish

ATMA-South.

The Memorandum of Association of the Goa State Animal Welfare Board prescribed by Animal Welfare

Board of India as per Annexure-I shall be:

Memorandum of Association

1. Name of the Board : The Board shall be the “Goa State Animal Welfare Board” (GSAWB).

2. Office of the Board : The office of the Board shall be situated at Directorate of Animal Husbandry

& Veterinary Services (Head Office).

3. Location : Near Parking Plaza, Patto, Panaji.

4. Address : Pashusamvardhan Bhavan, Patto, Panaji-Goa.

5. Essential Character:- The Board shall be a corporate body composed of its members with rights,

powers, privileges and responsibilities provided for from time to time by the law of the country.

The Board, shall be a Body Corporate having perpetual succession and a common seal with power,

subject to the provisions to acquire, hold and dispose of property and may by its name sue and be

sued.

6. The Objectives:- The purpose of the Board shall be to prevent the infliction of unnecessary pain or

suffering on animals and promote animal welfare.

7. The Functions of the Board:- The objectives of the Board shall be:

7.1 To promote Animal welfare in general and advise the State Government in all matters concerning

animal welfare. However, the Government may or may not accept the advise so rendered.

7.2 To advise the State Government on the making of rules under Act with a view to preventing

unnecessary pain or suffering to animals generally, and more particularly when they are being

transported from one place to another or when they are used as performing animal of when they

are kept in captivity or confinement;

7.3 To advise the Government or any local authority or other person on improvements in the design of

vehicles so as to lessen the burden on draught animals;

7.4 To take all such steps as the Board may think fit for amelioration of animals by encouraging or

providing for, the construction of sheds, water troughs and the like and by providing for veterinary

assistance to animals;

7.5 To advise the Government or any local authority or other person in the design of Slaughter houses

or in the maintenance of slaughter houses or in connection with slaughter of animals so that

unnecessary pain or suffering, whether physical or mental, is eliminated in the pre-slaughter stages

as far as possible, and animals are killed, wherever necessary, in as humane a manner as possible;

7.6 To take all such steps as the Board may think fit to ensure that unwanted animals are destroyed

by local authorities, whenever it is necessary to do so, whether instantaneously or after being

rendered insensible to pain or suffering;

7.7 To co-operate with, and co-ordinate the work of, associations or bodies established for the purpose

of preventing unnecessary pain or suffering to animals or for the protection of animals and birds;

7.8 To give financial and other assistance to animal welfare organizations functioning in any local area

or to encourage the formation of animal welfare organizations in any local area which shall work

under the general supervision and guidance of the Board;

7.9 To encourage by the grant of financial assistance or otherwise, the formation or establishment of

pinjrapoles, rescue homes, animals shelters, sanctuaries and the like, where animals and birds may

find a shelter when they have become old and useless or when they need protection;

7.10 To advise the State Government on matters relating to the medical care and attention, which may

be provided in animal hospital and to give financial and other assistance to animal hospitals

whenever the Board thinks it necessary to do so;

7.11 To impart education in relation in collaboration with Animal Welfare Board of India to the humane

treatment of animals and to encourage the formation of public opinion against the infliction of

unnecessary pain or suffering to animals and for the promotion of animal welfare by means of

lectures, books, posters, cinematographic exhibitions and the like;

7.12 The Board will advise the State Government on any matter connected with animal welfare or the

prevention of infliction of unnecessary pain or suffering on Animals in Animal Farms established

for commercial breeding, research or experimentation in Medical/Veterinary Research Institutions

in the State.

7.13 To advise the State Government for strict implementation of the Prevention of Cruelty to Animals

Act, 1960 in letter and spirit in the State and rules framed thereunder;

7.14 To encourage the formation of animal welfare organizations in any local areas of the State and to

issue guidelines to all N.G.Os working in the State in connection with animal welfare activities and

supervise their work;

7.15 Shall recognize and affiliate Animal Welfare Societies/Bodies/Organizations established in the State

for the purpose of preventing unnecessary pain or suffering to animals or for the protection of

animals and birds and to co-operate with and coordinate the work and activities of all such N.G.Os.

7.16 Shall recommend or grant financial or other assistance to N.G.Os engaged in animal welfare

activities, which shall work under the general supervision and guidance of the Board;

7.17 The Board shall formulate appropriate regulations for the administration of its affairs subject to

approval of the State Government for carrying out its functions;

7.18 The Board shall call for any information from the State Government, Local Bodies, State Department

and other Statutory Bodies pertaining to its work and also visit any place in the State for the

purpose of discharge of its functions;

7.19 The Board under Human Education Program, shall publish a quarterly magazine “Animal Welfare”.

The responsibility of bringing out the periodical should be that of standing committee on Human

Education.

8. Property and Assets:

The income of the Board, howsoever derived, shall be applied towards promotion of the objectives

of the Board in the MOU.

9. The Government’s power:

The State Government may appoint one or more persons to review the work and progress of the

Board.

10. Dissolution:

If on winding up or dissolution of the Board, there shall remain after the satisfaction of all its debts

and liabilities, any assets and property, whatsoever, the same shall not be paid to or dealt with in

such manner as the State Government may determine.

11. Certification:

A certified to be a true copy of the rules i.e. Article of Association of the Board by three members

of the Governing Body of the board is filed along with the Memorandum of Association.

12. General Body:

We, the several persons, whose names and addresses are given below having associated themselves

for the purpose described in this Memorandum of Association, and set our several and respective

hands here on to form ourselves into Board under the Society Registration Act, 1860.

Article of Association of

Goa State Animal Welfare Board

1. Short title, extent and commencement

1.1 Name of the Board:

The Board may be called the “Goa State Animal Welfare Board”.

1.2 These rules may be called the Goa State Animal Welfare Board (GSAWB) Rules, 2017.

1.3 It extends to the whole of Goa State.

2. Headquarters of the Board:

The headquarters of the Goa State Animal Welfare Board shall be situated at Directorate of Animal

Husbandry & Veterinary Services, Pashusamvardhan Bhavan, Patto, Panaji-Goa.

3. Definitions:

In these Rules, unless the context otherwise requires, words or expressions contained but notdefined

in these rules shall bear the same meaning as in the Prevention of Cruelty to Animals Act, 1960 or

any modification thereof in force on the date published in the Official Gazette of Uttaranchal.

3.1 “Act” means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960);

3.2 “Chairman” shall mean the Chairman of the Goa State Animal Welfare Board;

3.3 “Member” shall mean the Members of the Goa State Animal Welfare Board;

3.4 “Executive Committee” shall mean the Executive Committee for the time being constituted under

the Rules of the Board;

3.5 “Member Secretary” shall mean the Member Secretary of the Board;

4. Constitution of the State Board:

Nomination as required shall be made by Government of Goa. The Board shall consist of the

5. Cancellation of registration of the Board:

(A) The term of office of a Member appointed, nominated or elected under clause 4 shall come to an

end as soon as he ceases to be a Member of the body, which elected him or in respect of which

he was nominated;

(B) Remaining period is the term of office of a Member appointed, nominated or elected to fill a casual

vacancy shall continue for the remainder of the term of office of the Member in whose place he

is appointed, nominated or elected;

(C) The State Government may at its discretion remove the member from the Board without assigning

any reason.

(D) A member of the Board shall cease to be a member if he dies or resigns his membership or becomes

of unsound mind or insolvent or is convicted of a criminal offence involving moral turpitude or

involves himself/herself in any matter of litigation against the Government.

6.1 The members of the Board shall receive such allowance, if any, as the Board may, subject to the

prior approval of the State Government.

6.2 No act done or proceeding taken by the State Board shall be questioned on the ground merely of

the existence of any vacancy in, or defect in the constitution of the Board and in particular, and

without prejudice to the generality of the foregoing, during the period intervening between the

expiry of the term for which the Board has been constituted under clause 4 and 5, the ex-officio

members of the Board shall discharge all the powers and function of the Board.

6.3 Vice-Chairperson – The State Government may nominate one of the members of the Board to be

its Vice-Chairperson. The Vice-Chairperson shall exercise such powers and perform such functions

as the Chairperson may, with the prior approval of the State Government, delegate to him/her from

time to time.

7. Administration of the Board:

7.1 The Board shall meet at least twice in a year in any place as may be decided by the Chairperson.

7.2 The Chairperson of the Board will preside over the meetings of the General Body. In the absence

of the Chairperson, the Vice-Chairperson will preside over the meeting.

7.3 The quorum for Board meeting will be 1/3rd of the total sitting members.

7.4 The meeting will be held 15 days prior notice. Chairperson can call an emergency meeting at any

time.

7.5 Minutes of the Board’s meeting will be recorded by the Member Secretary Minutes will be circulated

to all members and concerned organizations. Minutes approved by the Board will be forwarded to

the State Government by Member Secretary of the Board.

7.6 The Member Secretary of the Board will prepare the budget in advance in the month of October

of each financial year.

7.7 Non-Official members of the Board will be entitled to travelling daily allowances as per standing

rules of the State Government.

7.8 Any recommendations made by the Board will be given effect only after approval of the State

Government.

8. The Executive Committee:

8.1 The Executive Committee, to whom by the rules of Board, the management of its affairs is entrusted,

will consist of the following as member, namely:

8.2 The Executive Committee will be called maximum four times in a tenure of one year at a place as

decided by the chairman or when it is required.

8.3 The term of office of an ex-officio Member of Executive Committee shall continue so long as he holds

the office by virtue of which he is such a Member.

8.4 In the absence of Chairperson, Vice-Chairperson may preside over the meeting of the Executive

Committee.

8.5 The Executive Committee shall constitute any number of standing committees on specific matters,

as and when required. On each such committee apart from 2-3 members of the Board an expert/

/specialist may be invited for expert opinion on the subject.

8.6 The quorum for Executive Committee meeting will be 1/3rd of the total sitting members.

8.7 The meeting of the Executive Committee will be held 7 days prior notice.

8.8 The Executive Committee of the Board shall be entitled to exercise all such powers and to do all

such acts and duties as the Board is authorized to exercise.

8.9 The Executive Committee may recommend to Government regarding making, amendment or repeal

any bye-laws related to administration and management of the Board. The recommendation of

Executive Committee shall be required to be approved by the State Board. The Government may

or may not accept the recommendations so rendered.

8.10 To provide and arrange for training of all categories of personnel engaged in the field of animal

welfare.

8.11 Powers of Executive Committee:

A. To create any post, provided that no post is created without prior approval of the Government; as

the case may be.

B. To appoint at its discretion, remove, retire or suspend such officers, clerks and employees in special

services, as it may from time to time think fit and to determine their powers and duties and fix their

emoluments provided that if the officers and other employees are regular Government Employees

of the Animal Husbandry Department or on the deputation, the service shall be regulated in

accordance with the provisions of service Rules Disciplinary and Appeal Rules prevalent in the

State.

C. To institute, conduct, defend compound and abandon any legal proceeding by or against the board

or its officers or otherwise concerning the affairs of board and also to compound and allow time

for payment or satisfaction of any claims or demands by or against the Board.

D. The powers vest with Member Secretary to release and other discharges for money payable to the

board and for the claims and demands of the Board.

E. Subject to the overall control and policies of the Government, to develop and frame specific

policies, lay down and enforce timely action schedule programme and methods for the

implementation of the policies and to direct their administration and speedy execution in the most

economic way.

F. To prescribe policy and lay down procedure/guidelines for the operation of the Board.

G. To ensure the due observance of code of discipline at all levels by the employees of the Board.

H. Approve Annual Budget estimate and to establish sound accounting, costing and financial in

keeping with the general directives of the Government and any other directives that may be issued

from time to time and to review and consider inspection notes, balance-sheet, etc. subject to the

provision of these article.

8.12 Duties of Executive Committees:

The committee shall cause minutes of the proceeding to be recorded in books provided for duties

and powers of Executive Committee.

(i) Of all appointments of officers made at the meeting showing also the remuneration to be paid

respectively to them.

(ii) Of all names of the member present at each meeting of the committee and of any committee

of the members.

(iii) Of the names of the members, if any, dissention form or not concurring in any resolution passed

at a meeting.

8.13 Quorum for Transaction of Business of the Executive Committee:-

A. Questions arising at any meeting of committees shall be determined by a majority of votes of the

members present and in case of an equality of votes the Chairperson shall have a second or casting

vote.

9. Funds, Accounts and Audit of the Board:

9.1 The funds of the Board shall consist of grants made to it from time to time by the Government and

of contributions, subscriptions, bequest, gifts and the like made to it by any local authority or by

any other person.

9.2 Recurring and non recurring grants made by the State Government for the furtherance of the

objectives of the Board.

9.3 Income from other sources.

9.4 Such other amount as General Body/Executive Committee may decide to divert from the regular

fund to special fund subject to approval of the State Government.

9.5 The books of account shall be kept at the registered office of the board or at such a place as the

Executive Committee shall think fit and shall be open to inspection by the members of the

Executive Committee during office hours.

9.6 The Member Secretary will be responsible for the maintenance of the accounts.

9.7 The Executive Committee shall appoint an auditor to examine the Board’s account and record from

time to time and certified balance will be produced in general body meeting.

9.8 The auditors of the board have the right to attend the meeting and shall be entitled to receive the

notice of the general body meeting.

9.9 Copies of the annual accounts of the fund duly audited and certified by the Member Secretary of

the board submitted to the Government of Goa of every year in the 1st Quarter of the next financial

year.

10. Powers of Member Secretary:

10.1 All Financial and Administrative powers will resume with the Member Secretary.

10.2 The Member Secretary will be supervised by and responsible to the General Body and the Executive

Committee.

10.3 The Member Secretary will have liaison with the State Government, relevant departments of the

State Government, Animal Welfare Board of India and relevant Ministries/Departments of the

Central Government.

10.4 The Member Secretary will have overall responsibility for planning and executing the work of

Secretariat, for supervising the work of various committees, directing and overseeing implementation

of various tasks through Animal Husbandry Department officers.

10.5 The Member Secretary shall also perform such functions as may be delegated to him/her by the

Board, Chairman and/or Executive Committee from time to time.

11. Standing Committee:

11.1 The Standing Committee for suggesting amendments of Transport of Animal, Registration of cattle

premises, Training in Animal Welfare, ABC Program, SPCA Registration, NGO affiliation and

Experimentation on animals may be constituted.

11.2 Recommendations made by the Executive/Standing Committee will be forwarded to the Member

Secretary of the Board, who will place the same on the agenda for the next meeting of the board.

12. Duties of Member Secretary:

12.1 The Board shall keep proper books of accounts of all sums of money received and source thereof,

all sums of money expended by the Board and the purpose for which such sums are expended.

12.2 The records of Board’s Assets and Liabilities.

12.3 The other records will include Agenda Register, Membership Register, Proceeding Register, Cash

Book, Records of Accounts, Disbursements and Dead Stock Register.

13. Modification of Objective:

13.1 The Board may alter and extend the purpose as per decision of the Executive Committee/General

Body Meeting.

14. Modification of Articles/Regulation:

14.1 The Rules may be altered or cancelled by the resolution passed by a majority of two third of the

members present at a General Body meeting of the Board convened for the purpose. Rule can be

modified, amended or repealed suo moto on the recommendation of the Government.

14.2 The Modified Regulations will be deemed to have enforced in accordance with the provisions of

the Board.

15. Change of Membership:

15.1 The membership of General Body may be added, altered by a resolution of the General Body and

thereafter an approval of the State Government.

15.2 The members of Executive Committee may be added, altered by a resolution of the Executive

Committee, thereafter an approval of the General Body and State Government.

16. Dissolution of the Board:

16.1 The Board may resolve by a three fourth majority of the votes given at the meeting convened for

that purpose, to dissolve the society provided that due notice of such resolutions have been given

to the Members of the Board in accordance with the procedure laid down in that behalf by the

Societies Registration Act, 1860 and provided that the prior approval of the Government of Goa for

such dissolution had been taken.

17. Miscellaneous:

17.1 Notwithstanding anything contained in these Articles, all submissions and references to be made

to the Government under any of these Articles shall be made through the Department of Animal

Husbandry and Veterinary Services, Government of Goa.

This Notification supersedes all the previous notification issued in this context in the past and

comes into force with immediate effect.

Shri Ramkrishna S. Samant, Dy. Director of

Education, as Chairman of the Goa Board of

Secondary and Higher Secondary Education with

immediate effect subject to the following terms

and conditions:-

1. That the said officer shall serve in the said

Board as its Chairman for a period of four

years from date on which he assumes the

charge of the office or till he completes the

age of 60 years whichever is earlier.

2. That the said officer will submit himself to

the order of the Government and authorities

under whom he may from time to time be

placed by the Government and will at all

times obey the rules prescribed for the time

being for regulation of the public service to

which he may belong and will from time to

time proceed to any part of India to which

he may be required to proceed.

3. That the said officer will employ himself

efficiently and diligently and to the best of

his ability as the Chairman of the Board and

that he will devote his whole time to the

duties of the service and will not engage

directly or indirectly in any trade, business

or occupation on his own account. He will

not except in case of accident or sickness

certified by the competent medical authority

absent himself from duties without having

first obtained permission from the

Government or the authorized officer.

4. That the Government may terminate his

agreement at any time by giving three

calendar months notice in writing if the said

Officer is found guilty of any breach of any

of the terms and conditions herein specified.

5. That the said Officer may terminate this

agreement by giving to the Government

ninety days advance notice in writing and

on expiration of such notice this agreement

shall stand terminated. In the absence of

such notice to the Government the said

Officer shall refund to the Government an

amount equivalent to the pay of three months

in lieu of the said notice.

6. That the Government shall pay to the saidOfficer so long as he shall remain inoffice and actually perform his duties, in“Level 13” of the Pay Matrix of 7th PayCommission (corresponding scale PB-4;Rs. 37,400-67,000 + Grade Pay Rs. 8,700 inthe 6th Pay Commission scale), and his salaryshall be fixed as per the rules in aforesaidscale with right for increment as and whenthey fall due. He shall also be paid dearnessallowance, house rent allowance and otherallowances admissible to a Governmentservant in the service of Goa State asadmissible under the Rules. He shall beentitled to travelling allowance anddearness allowance as admissible to aGrade I Officer of the Government wheneverthe said Officer has to perform tours foreffective discharge of duties attached to thepost of Chairman of the Board.

7. The said officer shall be entitled to, subjectto exigencies of public service, leave andleave salary as are admissible to an Officerof the Government and further that he shallbe allowed encashment of leave as per Rules.

8. The said Officer shall be eligible for medical

attendance and treatment as are admissible

to a Grade-I Officer of the Government.

9. The said Officer shall so long as he continues

to be the Chairman of the Board, subscribe

to the General Provident Fund and shall be

subjected to the rules of such fund.

10. The said Officer shall in the matters in

respect of which no specified provision has

been made in this agreement, be governed

by the rules and regulations which are

applicable to a Government servant of equal

status.

11. The said Officer shall be entitled to benefits

of L.T.C. the Children Education Allowance,

Medical Reimbursement, Tuition Fees, etc.

as are enjoyed by the Government servant

of equal status.

12. The period during which the said Officer

serves as Chairman of the Board shall be

counted as qualifying service for the benefits

under the pension and scheme and also to

such other benefits which are applicable to

the said Officer immediately before the date

of his assuming office of Chairman of the

Board and the Government undertaking to

make contribution for leave salary and

pension which may be payable under the

said scheme for the period for which the

said Officer continues to function as

Chairman of the said Board.

13. The Government has no objection if said

officer retains his lien on the post held by

him immediately prior to his appointment

as Chairman of the Board, during the period

for which this agreement shall be in force.

14. In the event of any question, dispute or

difference arising under or out of or in

connection with the conditions herein

contained or touching or concerning the

meaning or operation or and as to the rights,

liabilities of the parties hereto, the same

shall be referred to the sole arbitration of

the person nominated by the Governor of

Goa. There will be no objection to any

appointment that the arbitrator so appointed

is a Government servant and that in course

of his duties as such Government servant

had expressed his view in all or any of the

matter or disputes and differences. The

award of the arbitrator so appointed shall

be final and binding on the parties to those

presents. Subject as aforesaid, the provisions

of Indian Arbitration Act, 1940 for the time

being in force shall apply to the arbitration

proceedings under the Clause.

Shri Ramkrishna S. Samant is requested to

sign an agreement to this effect.

Disputes Act, 1947 (Central Act 14 of 1947) the

Government of Goa, by Order dated 23-06-2016,

bearing No. 28/24/2016-LAB/433, referred the

following dispute for adjudication to this Labour

Court II, Panaji-Goa.

“(1) Whether the action of M/s. Kadamba

Transport Corporation Ltd., Porvorim in

non-extending benefits of 3rd up-gradation

under Modified Assured Carrier Progression

Scheme to Shri Anant Y. Lotlikar, Traffic

Controller, on completion of 30 years of

service, is legal and justified?

(2) If not, what relief, the Workman is entitled

to?”

2. On receipt of the reference, a case wasregistered under No. LC-II/IT/13/16 and registeredA/D notice was issued to the parties. In pursuanceto the said notice, the parties put in theirappearance. The Workman/Party-I (for short“Workman”), filed his Statement of Claim on15-12-2016 at Exb. 5. The facts of the case in briefas pleaded by the Workman are that he wasappointed as ‘Conductor’ w.e.f. 16-07-1982 by theEmployer/Party–II (for short “Employer”). He statedthat he was confirmed in service w.e.f. 01-05-1983.He stated that his pay was fixed in sixth pay scaleas 3050-75-3950-80-4590, by order dated 01-04-1999.He stated that in terms of the circular dated21-11-2000 and on recommendation of departmentalpromotional committee, he was granted TimeBound Promotional Scale (TBPS) in the pay scale ofRs. 4000-100-6000 w.e.f. 01-11-2000 and wasdesignated as ‘Conductor’ (TBPS). He stated thathis basic pay in TBPS was fixed at Rs. 4300/- byorder dated 28-01-2003. He stated that inaccordance with Assured Career ProgressionScheme (ACP), the financial up-gradation wasavailable in the next higher pay scales, wheneveran employee completed 12 years as first financialup-gradation and 24 years as second financial

up-gradation. He stated that consequent upon

adoption of revision by the Government of Goa and

extended to the employees of the Employer, his

pay scale was revised in the pay band to Rs. 5200-

-20200+2400 grade pay. He stated that his pay

scale was fixed at Rs. 8930 + grade pay of Rs. 2400/-.

He stated that he was given various revision and

up-gradation in the pay scale under the TBPS. He

stated that his release of second financial

up-gradation was differed on account of pendency

of departmental proceedings, which is ultra-virus

of the Modified Accelerated Progression Scheme.

He stated that his annual increment was released

w.e.f. 01-07-2013, by order dated 26-07-2013 and

his pay scale was Rs. 11,569/- plus grade pay of

Rs. 2400/-. He stated that his pay as on 01-07-2013

was Rs. 11,980/- and grade pay of Rs. 2400/-.

He stated that by order dated 30-07-2014, the

Employer was pleased to release increment and he

was designated as ‘Traffic Controller’ MACP III and

his pay band was fixed at Rs. 12,420/- plus grade

pay of Rs. 2800/- w.e.f. 01-07-2014. He stated that

he was entitled for 3rd financial up-gradation in

the pay band of Rs. 9300-34800+4800 as grade pay

under the MACPS. He stated that the Employer, in

contravention and gross abuse of process of law,

the proceedings were re-opened and erroneously

penalty was imposed, when in fact his grade pay

was inconsonance with the MACPS ought to have

been Rs. 4200/-. He stated that he was granted

revision in the pay scale vide order dated

28-01-2013 w.e.f. 01-11-2000, despite the pendency

of the charge-sheet dated 10-01-1996. He stated

that he was granted revision in the pay scale of

TBPS, despite pendency of the proceedings andtherefore the second revision cannot be differed.He submitted that the differing of the second up-gradation is ultra-virus to the MACP scheme. Hestated that on recommendation of departmentalpromotional committee, he was granted revision inthe pay scale under the TBPS, vide order dated28-01-2003 w.e.f. 01-11-2000 and his increment wasfixed at Rs. 4500/- as on 01-11-2002. He submittedthat he was deprived of the financial up-gradationas required under the scheme. He stated that asthere was anomaly in his pay fixation, he raised adispute before the ALC, which ended in failure. Hestated that during the pendency of the proceedingsbefore the ALC, the Employer was pleased to revisehis scale, however, the anomaly was not rectifiedand therefore there was disparity in pay fixationunder MACP scheme.

3. The Workman challenged the non-extending

benefits of third financial up-gradation under

MACP Scheme, thereby depriving him the monetary

benefits by contending to be illegal. He submittedthat he was confirmed in service w.e.f. 01-05-1983and therefore on completion of 30 years of service

in the same cadre without any promotion, he wasentitled for 3rd up-gradation on 01-05-2013. Hesubmitted that he was granted up-gradation fromtime to time despite of the pendency of the charge-sheet and therefore, he ought not to have beendeprived the third financial up-gradation on theground of pendency of the departmentalproceedings. He submitted that the action of theEmployer is smacks of malafideness and is anex-facie instance of unfair labour practice. Hesubmitted that he has been denied the 3rdup-gradation despite of his eligibility only tovictimize him. He submitted that he has beengrossly discriminated against the whims andcaprices of unmoving bureaucracy. He submittedthat the denial of 3rd up-gradation under the MACPscheme has resulted in anomaly in pay fixationand therefore, the pay fixation is unfair and notinconsistence with MACP scheme. The Workmantherefore prayed for passing an award holding thathe is entitled for 3rd up-gradation on completionof 30 years of service in the same cadre and furtherdirected the Employer to pay the arrears as accruedin accordance with the pay revision. The Workmanfurther prayed for grant of monetary benefits ongrant of 3rd financial up-gradation from the date ofeligibility and other consequential benefitsattached to the same.

4. Thereafter, the Employer filed an applicationfor direction to produce documents listed in thelist of documents of the Workman, which wasallowed by order of this court dated 03-10-2017after hearing both the parties and the Workmanwas directed to furnish the xerox copies of all thedocuments relied by him in his list of documentsat the cost of the Employer within 10 days from thepassing of the said order and the matter wasfixed for filing written statement to 25-10-2017.On 25-10-2017, Ld. Adv. Shri A. Kundaikar,appearing for the Workman as well as Ld. Adv.Shri P. Agarwal, appearing for the Employerremained present and orally submitted that thematter is likely to be settled amicably between theparties and sought time to settle the matter.Accordingly, on 24-11-2017, Ld. Adv. Shri A.Kundaikar, appearing for the Workman as well asLd. Adv. Shri P. Agarwal, appearing for theEmployer remained present and filed a jointapplication at Exb. 13 for passing an award in terms

of settlement.

I have carefully perused the terms of settlement

filed by both the parties. The said terms of

settlement are beneficial to both the parties. It

also helps in keeping peaceful harmonious

industrial relations between the parties. Hence I

consented to the same.

In view of above, I proceed to pass the following

order.

ORDER

That in view of the amicable settlement betweenparties hereto, the dispute as to “Whether theaction of M/s. Kadamba Transport Corporation Ltd.,Porvorim in non-extending benefits of 3rdup-gradation under Modified Assured CarrierProgression Scheme to Shri Anant Y. Lotlikar, TrafficController, on completion of 30 years of service, islegal and justified”, does not survive.

JUDGEMENT

1. This judgment and order shall determine

the claim application of the Applicant dated

18-04-2017 for computation of the amount filed

U/S 33-C (2) of the I.D. Act, 1947.

2. By the present claim application, the

Applicant claimed a total amount of Rs. 2,45,218/-

(Rupees Two lakhs forty five thousand two hundred

eighteen only) towards unpaid salaries, unpaid

conveyance and other expenses, annual benefit,

gratuity, bonus and technicians wages.

3. Upon receiving the aforesaid claim application

of the Applicant, a due notice was issued and

served upon the Opponent. The Opponent has

however, failed to appear before this court on

scheduled date of hearings. The Opponent was

therefore marked an ex-parte by giving ample

opportunities and an ex-parte proceedings was

conducted.

4. Based on the pleadings filed by the Applicant,

this court framed the following issues on

18-09-2017 at Exb. 4.

1. Whether the Applicant proves that he is

entitled to receive from the Opponent a sum

of Rs. 2,45,218/- (Rupees Two lakhs forty five

thousand two hundred eighteen only)

towards his salaries, gratuity, bonus?

2. What Order?

5. My answers to the aforesaid issues are as

under.

(a) Issue No. 1 : Partly in the affirmative

and partly in the negative.

(b) Issue No. 2 : As per final order.

REASONS

6. By the present claim application the Applicant

claimed a total amount of Rs. 2,45,218/- (Rupees Two

lakhs forty five thousand two hundred eighteen

only) towards his unpaid salaries, local conveyance

and other expenses, annual benefits claim for last

year, gratuity, bonus and technicians wages. To

prove his case, the Applicant has examined himself

and produced on record certain documentary

evidence in support of his oral evidence.

(a) Unpaid Salaries:

The oral evidence of the Applicant on record

indicates that the Applicant has not been paid his

salaries for the month of February, 2015 to 30th

July, 2015 for six months. The evidence on record

indicates that the monthly salary of the Applicant

was Rs. 17,253/- (Rupees Seventeen thousand two

hundred and fifty three only). Thus, the total

salaries for six months @ Rs. 17,253/- comes to

Rs. 1,03,518/- (Rupees One lakh three thousand five

hundred eighteen only).

(b) Local Conveyance:

The Applicant claimed an amount of Rs. 55,000/-

(Rupees Fifty five thousand only) towards local

conveyance. The oral evidence on record indicates

that the Applicant has not been paid the local

conveyance allowance for 10 months for the period

from October, 2014 to 31st July, 2015. The evidence

on record indicates that the Applicant was paid

the local conveyance allowance @ of Rs. 5,350/- p.m.

Thus, the total local conveyance allowance the

Applicant is entitled for 10 months @ Rs. 5,350/- p.m.

comes to Rs. 53,500/-(Rupees Fifty three thousand

five hundred only).

(c) Gratuity:

The Applicant claimed an amount of Rs. 19,500/-

(Rupees Nineteen thousand five hundred only)

towards his gratuity. In terms of Clause 9 of the

appointment letter at Exb. 6 issued to him, the

Applicant is entitled to for the gratuity under the

Gratuity Rules and Regulations. In terms of Clause 4

of the Payment of Gratuity Act, 1972, the gratuity

shall be payable to an employee on termination of

his employment after he has rendered continuous

service for not less than five years.

The evidence on record indicates that the

Applicant was in uninterrupted employment of the

Employer for the period from 02-04-2009 till

31-07-2015 i.e. for six years and three months. The

basic pay of the Applicant at the relevant time

was Rs. 4000/-. Thus after calculation the gratuity

of the Applicant comes to Rs.13,846/- (Rupees

Thirteen thousand eight hundred forty six only).

(d) Bonus:

The Applicant claimed an amount of Rs. 2000/-

(Rupees Two thousand only) towards bonus for the

year 2014-15. The Applicant is entitled for bonus

under the Payment of Bonus Act, 1965 in terms of

Clause 8 of his appointment order at Exb. 6. The

oral evidence on record indicates that the

Applicant has not been paid the bonus for the year

2014-15. In terms of Clause 10 of the Payment of

Bonus Act, 1965, the Applicant is entitled to a

minimum bonus @ Rs. 8.33% of the salaries or wage

earned by the employee during the accounting

year or Rs. 100/- whichever is higher. Thus, after

calculation the bonus comes to Rs. 333/- (Rupees

Three hundred thirty three only).

(e) Technicians Wages and Annual Benefit Claim for

last year:

The Applicant claimed a sum of Rs. 55,200/-

(Rupees Fifty five thousand two hundred only)

towards technicians wages for the period from

April, 2015 to September, 2015 @ Rs. 9,200/- p.m.

The Applicant also claimed a sum of Rs. 10,000/-

(Rupees Ten thousand only) towards the annual

benefit claim for the year 2014-15. The Applicant

has however, failed to prove the entitlement of the

said benefits of Technicians wages as well as

Annual Benefit Claim for the last year. In the

circumstances, the Applicant is not entitled to any

amount towards the benefits of Technicians

wages as well as Annual Benefit Claim for the last

year.

Thus, the Opponent are liable to pay to the

Applicant a total sum of Rs. 1,71,197/- (Rupees One

lakh seventy one thousand one hundred and ninety

seven only) towards his salaries, local conveyance

and other expenses, annual benefit claims for last

year, gratuity, bonus, technician’s wages. The

Applicant is entitled to the aforesaid amount of

Rs. 1,71,197/- (Rupees One lakh seventy one

thousand one hundred ninety seven only).

In view of above, I pass the following order:

ORDER

1. It is held that the claim application of the

Applicant dated 18-04-2017 is hereby partly

allowed. Consequently, the Opponent

M/s. Cata Appliances is hereby directed to

pay to the Applicant Shri Robin Fernandes,

a sum of Rs. 1,71,197/- (Rupees One lakh

seventy one thousand one hundred and

ninety seven only) within a period of two

months from the passing of the present order,

failing which it shall bear a simple interest

@ 9% p.a.

2. No order as to cost.

Whereas, the Petitioner is concerned with ShreeRudreshwar Devasthan, Harvalem, Sankhalim,Bicholim Goa, being one of the Mahajans of Devasthan.

And whereas, the Hon’ble High Court ofBombay, at Goa, vide order dated 20-12-2017 hasdisposed of the Writ Petition No. 391 of 2017directing the State Government to appoint DeputyCollector, Bicholim to look after the financial andadministrative aspects of Shree RudreshwarDevasthan, Harvalem, Sankhalim, Bicholim Goa.

Now therefore, in pursuance of the direction ofthe Honble High Court of Bombay at Goa, in saidWrit Petition No. 391of 2017, the Deputy Collector,Bicholim, is hereby appointed to look after thefinancial and administrative aspects of ShreeRudreshwar Devasthan Harvalem, Sankhalim,Bicholim Goa.

For the said purpose, the Deputy Collector willhave all necessary powers to supervise and call forrecords and such other ancillary powers to exercisethe complete financial and administrative controlover the Devasthan.

The Deputy Collector however will not be thepart of the purely religious function to be carriedout in the Devasthan through priests. However,whenever such religious functions have financialconnotations, he will supervise the same for thepurpose of carrying out the financial andadministrative control of the Devasthan.

As regards the administrative function which also

involve the purely religious activities it will be

open to him to consult with the ad hoc Managing

Committee.

The Deputy Collector will evolve a suitable fair

and transparent methodology and will keep the

necessary records. This arrangement will continue

till the regularly elected body is in place.

In the meanwhile, ad hoc Managing Committee

which is operating as on today will operate, subject

to the above.

tax under the said Act.

This Notification shall come into force from the

date of its publication in the Official Gazette.
