Nairobi Regional Commissioner James Kianda said, the government

is coming up with a way forward that will get the disease to the level where schools can be reopened, people travel to their rural areas as well as open air traffic.

Addressing a security meeting at Kasarani Sports Complex, Kianda said the government is concerned over the behaviour of some resi-dents who have continued to flout

the Covid-19 regulations despite the County being ranked highest with the number of infected per-sons.

In the meeting attended by the Nairobi County Commissioner Flora Mworoa and the Nairobi Regional Police Commander Au-gustine Nthumbi, the Regional Commissioner singled out Ma-

thare, Starehe, Huruma , Korogo-cho and Kariobangi estates as some of the areas where members of the public were ignorant of the curfew law.

“There is a lot of interaction of people from 7.30pm to 9.00 pm yet the curfew starts at 8.00pm. Starting Friday, we want to see empty estates as people have to be

inside their houses and no vehicle should be on the road during cur-few hours,” he directed the law enforcement officers.

The Government has set aside a provisional budget of Sh2.282

billion to provide relief as-sistance to people affected by drought across the country.

According to Govern-ment Spokesperson Col. (Rtd) Cyrus Oguna, cur-rently over 1.4 million Kenyans are at risk of hun-ger and starvation, and potentially face acute food insecurity.

“Government is com-mitted to ensure that no Kenyan dies due to lack of food. The National Govern-ment, in collaboration with the affected counties have initiated interventions which include close moni-toring of areas that may be threatened for immediate response,” explained Col. Oguna.

Speaking in Nairobi dur-ing a media briefing, Col. Oguna said County gov-ernments, in collaboration with the National Govern-ment have rolled out a plan

to assist the affected areas which include distribution of water to households in the counties of Turkana, Mandera, Garissa and Wajir.

“The intervention meas-ures also include provision of relief food in Turkana county by the County Government, cash trans-fer under the Hunger Safety Net Program which is currently in Phase 3. Here, every household re-ceives Sh.2,700 every two months, and targets over 101,800 households in the Counties of Turkana, Man-dera and Marsabit. The Government spends about Sh2 billion on the program every year,” said Oguna.

US service men based in main land Lamu County have part-nered with local youth work-ing under the Kazi Mtaani Programme in Hindi location and constructed a school to provide access to education for children within the remote Magogoni area.

Speaking to KNA in Lamu, County Housing Director Mr Omara Monyoncho stated that the Magogoni Primary school was built through a partner-ship between the “Camp Simba” American soldiers who provided iron sheets, timber, sand and cement and Kazi Mtaani youths who provided labour and also committed to expand the school that will serve Magogoni village.

Monyoncho further said that the State Department of Hous-

ing trained the youths on how to build the classrooms using interlocking stabilized soil blocks (ISSB).

Magogoni village neigh-bours the Kenya Navy base and the American “Camp Simba” base. “Thanks to the Kazi Mtaani Initiative, chil-dren within Magogoni will no longer be forced to trek long

distances up to Hindi Primary to access school with the new school being put in place,” Monyoncho stated.

He said the institution is one of legacy projects in the county aimed at improving education access to children even within the most remote areas.

Lamu County Commissioner Irungu Macharia hailed the in-

itiative by both the American soldiers and the Kazi Mtaani Youths who undertook to build the school. Hindi Ward MCA Ms Anab Mohammed on her part stated that she will ensure that the school is included in the Lamu county school feed-ing programme, being in a far flung area.

Anti-tobacco lobby urges state not to allow sale of banned

Over 270 farmers’ groups across Embu County will benefit from

Sh100.2 million National Ag-ricultural and Rural Inclusive Growth Project (NARIGP) to increase food production and spur productivity.

While disbursing the funds at Talent Academy, Governor Martin Wambora urged the

farmers to utilize the funds prudently by investing the money on the intended pro-jects.

Wambora said through pru-dent use of the NARIGP funds, the farmers will motivate the county government to look for more funding.

The governor further assured the farmers that the county government will continue sup-porting them through com-

plementing the funding done by other players such as World Bank.

He revealed that the county government will contribute Sh 48 Million for Rupingazi Weru irrigation project which is being funded by World Bank to the tune of Sh100 million.

Jamleck Muturi, County Executive Member, Agricul-ture said the 279 groups set to benefit with the Sh 100.2 mil-

lion are engaged in mango and green gram farming as well as poultry and dairy cattle keep-ing.

The CEC said that NARIGP is aimed at helping farmers in-crease food production as well as enhancing profitability in agriculture.

In order to enhance pro-ductivity and value addition, Muturi said the county gov-ernment has released 14 mo-

torbikes that will be used by agricultural extension offic-ers in 14 wards in Manyatta, Mbeere North and Mbeere South.

He further noted that for easy reach to all the farmers, the ministry of agriculture through NARIGP has trained

over 100 farmers as trainers to others farmers.

Canon Elizabeth Kivai, nominated MCA who is the chairperson, County Assem-bly Committee on Agriculture said plans are underway to pass supplementary budget in order to fund the Rupingazi Weru Ir-rigation project.

Canon Kivai further noted that the committee has visited the NARIGP farmers and noted prudent use of the funds and many farmers are reaping much from the project adding that the county assem-bly of Embu will work closely with the executive to ensure the farmers are supported.

Please tell us what the East African Community is all about-When was it established and what its objectives are.

The East African Community (EAC) is an inter-governmental organiza-tion bringing together six Partner States. The Treaty for the establish-ment of the East African Community (EAC) was signed on 30th Novem-ber 1999 and later came into effect in July 2000 upon its ratification by the founding Partner States of Kenya, Tanzania and Uganda. Burundi and Rwanda joined the Community in 2007 while South Sudan joined in 2016.

The main objective of the EAC is to develop policies and programmes aimed at widening and developing co-operation among the Partner States in Political, Economic, Social and Cultural fields, Defence and Se-curity among other areas for their mutual benefits. The integration pro-cess of EAC is guided by the Treaty and 5-years Development Strategies. The integration was envisaged to be achieved through the establishment of a customs union which was to be an entry stage, then a common mar-ket, monetary union and ultimately a political federation. The integra-tion process is further spearheaded through 17 areas of cooperation within which numerous milestones and drivers are incorporated.

As a regional bloc bringing together several countries, what does the EAC governance structure look like?

The EAC Treaty specifies the man-agement structure of the integration process. The Treaty provides for the establishment of organs, institutions and entities that would coordinate and facilitate negotiations between the Partner States as well as man-agement of the agreements reached in the process.

Specifically, the Treaty provides for the creation of a Ministry in charge of EAC in every Partner State in all Part-ner States. The Ministry is charged with coordinating all agencies and departments at the national level with roles in the integration process.

As a Ministry coordinating the EAC affairs in Kenya, what are your specific mandates?

As I mentioned earlier, the estab-lishment of the Ministries responsi-ble for EAC integration is anchored in the Treaty. In this regard the Ministry of East African Community and Re-gional Development was created to spearhead Kenya’s participation in the regional integration process.

The Ministry’s mandate include: Policy on EAC; Implementation of the EAC Treaty; Coordination of im-plementation of EAC Regional Pro-jects and Programmes; promoting and fast tracking of EAC integration and coordination of Government’s participation in EAC affairs.

Kenya was recently elected chair of the EAC. What does this mean for the country and the Ministry?

Kenya assumed the chairmanship of EAC during the 21st Summit of the Heads State that took place on 27th February 2021. The chairmanship in EAC is not only an honour but also a heavy responsibility on Kenya, which as a country we definitely value. As the Chair of all EAC meetings for the next one year, Kenya is expected to objectively steer negotiations across all sectors with the aim of achieving the envisaged deeper and wider in-tegration.

Indeed, during the term of Kenya’s chairmanship of EAC, His Excellency the President is clear on the priority areas that will be focused on. These priority areas are captured in the EAC 6th Development Strategy for the pe-riod 2021 to 2025.

This definitely is a difficult time for a regional body whose activities revolve around negotiations. How is the Com-munity managing its affairs in the face of the coronavirus pandemic and the re-sultant restrictions?

Since the emergence of the COVID-19 pandemic in the EAC in March 2020, most physical meetings have been suspended. This has, to some extent impacted negatively on various programmes and projects. However, this is not unique to EAC, since it has affected the normal way of doing business across the world.

As a way of ensuring that the busi-ness of the Community progresses under this environment most of the meetings are now conducted virtu-ally through means such as Video Conference (VC) to which all Partner States are connected. Where such virtual meetings are not possible due to various reasons, the EAC rules provide for some level of flexibility in the conduct of the integration busi-ness including delegation of specific powers to the Chairperson of the Council of Ministers in consultations with the Partner States.

What are your plans as the new chair of the Council of Ministers, to maintain the integration momentum?

As I mentioned earlier, the EAC

Council of Ministers is the policy organ of the EAC. All decisions with policy, financial and administrative implications must pass through the Council of Ministers. This therefore requires the Council to be active and in-charge of the integration process in order to facilitate the Community to move forward.

As the Chair of the Council, I will therefore invest a lot of energy and time in facilitating an environment where the members of the Council can come together in the negotia-tions table and provide the necessary policy directions across all sectors. This is in recognition of the fact that decisions in EAC are made through consensus with all members on board. As we focus on implementa-tion of the identified priorities.

In terms of trade, how healthy is in-tra-EAC trade?

Over the last two decades, intra-EAC trade has emerged as an impor-tant aspect of the integration process. It is on this understanding that the Treaty for the establishment of EAC specified a Customs Union as the di-rect entry into the integration in the EAC.

In this regard, intra-EAC trade has been recording significant achievements especially after the establishment of the Customs Union. For example, the total in-tra-EAC trade recorded a growth from USD5.83billion in 2014 to USD5.99billion in 2019. Over the same period the intra-EAC trade ac-counted for 11% of the total global Partner States trade. This intra-EAC trade is of significant importance considering the nature of the prod-ucts traded.

Talking of trade, how is Kenya doing in terms of trade statistics with other EAC partner states?

EAC is a major destination for Ken-

ya’s exports and progressively a major source of imports since the com-mencement of the customs union. With a combined population of 177 million people and GDP of USD193 billion, EAC is a major market for Kenya’s products, creates opportuni-ties for cross-border investment, and is a platform for creation of a unified voice in the international arena. In 2019, for example, Kenya’s exports to EAC amounted to Ksh140 billion accounting for 24% of the total Ken-ya’s exports in that year. This was an increase from Sh53 billion in 2006. Kenya also imports various prod-ucts from the Partner States record-ing Sh68 billion imports from EAC in 2019 with a huge increase from Sh6 billion in 2006. The trade balance also grew significantly from Sh47bil-lion in 2006 to Sh73 billion in favour of Kenya.

Like siblings in any family, EAC Part-ner States must each be fighting, albeit silently, for adequate space within the community. Has there been any point of deviations between these states and, if any, how have these been dealt with?

The Treaty envisages an integration process that creates an environment for mutual benefits, sharing benefits equitably and promoting people-centred mutual development of ties between Partner States in political, economic, social, cultural and tra-ditional aspects. Fundamentally the Treaty provides for a Community founded on mutual trust, peaceful co-existence and peaceful settle-ment of disputes.

The beauty in the Community is that the Treaty has provided a road-map for resolving such differences that may occur guided by the above principles.

What can you cite, in summary, as the key achievements so far registered by the EAC?

Twenty years down the line, the EAC is growing steadily and fast. Briefly, some of the achievements under these efforts include, but are not limited to, a running list of eco-nomic and socio-political areas that I can share with you.

First and foremost, the EAC was hinged on four key pillars, two of which have already been operation-alized, and whose implementation are ongoing. They include the Cus-toms Union, which came into in 2005 and which has not only attracted di-rect foreign investments to the re-gion, but has eased regional trade through faster movement of goods.

The signing of the Common Mar-ket protocol in 2010 has had a mas-sive impact on regional trade and interactions. The Common Market provides for freedoms of movement of persons, labour, goods, services and capital; and the right of estab-lishing business and residence. It is through the Common Market that professionals from across the region are now able to move across the bor-ders and take up employment. Simi-larly, the Common Market has led to the establishment of One Stop Border Posts that help in faster movement of goods and persons across the bor-ders.

On the third pillar, the Monetary Union, the protocol was signed and ratified by Partner States and its im-plementation is expected to peak with the establishment of a single currency in East Africa. The Com-munity is currently working on the establishment of the institutions re-quired to operationalize the Mone-tary Union. Regarding the fourth and final pillar of the Political Federation, the Community is currently work-ing on a constitution for the Political Confederation.

Any challenges being faced by this regional bloc, and how are they being surmounted?

A: Some of the challenges faced on the way include the following:

(a) Regular emergence of Non-Tariff Barriers (NTBs) arising from administrative and legislative meas-ures and which frustrate cross-bor-der trade and movement of people. In an effort to address the challenges, the Community has put in place vari-ous measures including an NTB law and monitoring framework.

(b) Quorum issues which re-quire participation of all Partner States. When one Partner State is not available or adequately represented, the meeting is cancelled delaying the decision making.

(c) Financial challenges. The budget of the Community is fi-nanced from Partners States through equal contributions as well as from development partners. Over the last couple of years, Partner States have faced challenges in honouring their financial obligations on time.

Kenya was recently elected chair of the East African Com-munity (EAC) during the regional bloc’s Summit held virtually owing to Covid-19 restrictions. Kenya Ports Authority (KPA) has completed the construction of the

Sh500 million modern tug jetty at the marine dockyard pro-viding Mombasa Port a critical lifeline into the future.

The new jetty which is part of the modernisation and ex-pansion programme is set for commissioning next month and is expected to last for 80 years. The modern facility seen as a crucial component of port operations will replace the old jetty which was demolished in 2020 after serving as a docking point for vessels for 70 years.

The demolished jetty lost its load bearing capacity, was un-safe and was it was in a state of disrepair by the year 2010.

According to KPA Head of Marine Engineering Stephen Toya, the new jetty is 50 me-

tres long by 20.64 metres wide while its access trestle is 14.8m metres by 11.14 metres.

“The old jetty no longer sup-ported the emerging loads placed on it and did not meet modern design standards and specifications,” said Eng.Toya.

Toya said maximum availa-bility of floating crafts is crucial to ship turnaround boosting efficiency and cutting costs, and added that the Author-ity’s floating marine crafts like the Tugboats and Pilot Cut-ters require periodic checks. He said floating marine crafts are necessary to port business since Mombasa is classified a compulsory pilotage port that further requires towing by har-bour tugs and mooring boats in securing ships to quay.

“At any given time, we can secure two boats alongside new tug jetty for repair and return them to business,” added the KPA official.

THE PROCUREMENT OF CONSULTANCY SERVICES TO UPDATE THE FEASIBILITY STUDY OF THE KENGEN ENERGY PARK AT OLKARIA, NAIVASHA – KENYA

1. Background Information

The Government of Kenya launched the Industrial Transformation Programme in July 2015 that provided a framework for the country’s indus-trialization process. A key component of this programme is the setting up of industrial zones and parks. KenGen plans to develop an industrial park (to be called KenGen Energy Park) at the Olkaria geothermal hub in Nai-vasha and requires the services of a consultant to conduct and update the feasibility study. KenGen intends to leverage on its Geothermal resources available at Olkaria.

A feasibility study for establishment of the KenGen Energy Park was conducted and concluded in October 2016. Since then, there have been economic changes. The Laws and regulations governing industrial parks have also changed. It is therefore necessary to update the industrial park feasibility study to include the new ideas and take into account the regula-tory changes that have taken place.

It is envisaged that KenGen will use the Specially Permitted Procurement Procedures (SPPP) to attract investors at the energy park. As part of this assignment, the consultant is required to develop procedures and tem-plates for operationalizing the SPPP, as well as a comprehensive evaluation criteria and specifications that will be used to enlist suitable industrial park developers and operators.

The proposed feasibility study should evaluate various business models for the development of the Industrial Park. KenGen is now inviting consultants with experience in carrying out feasibility studies for industrial parks to sub-mit Expression of Interest (EOI) for consideration to update the Feasibility Study for the proposed KenGen Energy Park in Olkaria, Naivasha.

2. Objective To enable KenGen update the existing energy park feasibility study and create a bankable blueprint for its development considering the existing market, applicable laws and regulations governing the development.

3. Scope of the Consultancy Services The services expected for the proposed update of the feasibility study of the KenGen Energy Park shall include, but not limited to the following:

a) Review of the existing feasibility study.b) Carry out detailed Market Demand Analysis to identify suitable

products/services or industries/sectors that would be suitable for investing at the KenGen Energy Park.

c) Develop an updated feasibility study by incorporating the new ideas and government laws and regulations, including the Special Economic Zones Laws and Regulations.

d) Evaluate and recommend on industrial park development models suitable for KenGen and the Land Use Policy.

e) Develop a schematic Master Plan of the proposed Energy Park area

f) Develop a Financial Model for the energy park.g) Carry out Economic Impact Assessment.h) Recommend infrastructure requirements and cost estimates. i) Review and recommend the selling prices and tariff structures

for geothermal resources to be offered by KenGen including steam, brine, condensate, electricity, raw water and services charge.

j) Review and advise the lease price for the land.k) Develop the term sheet for the energy park.l) Carry out the cost and benefit analysis for the KenGen Energy

Park. m) Advise on the viability of the various industrial park model to

KenGen and the potential investors.n) Advice on the procurement models/approaches for attracting

investors which are suitable for KenGen Energy Park.o) Develop the Project implementation roadmap, institutional

framework and financing models.p) Develop marketing and business plans showing financial and

economic analysis.q) Prepare a detailed feasibility study report covering the scope

of the study as a minimum that meets the requirements as set out in the Special Economic Zones Laws and Regulations.

r) Develop procedures and templates for procurement of inves-tors using the Specially Permitted Procurement Procedures.

s) Develop a summary report suitable for market sounding.t) Conduct and prepare a Strategic Environmental Impact Assessment Sustainability (SEIA) study report.u) Assist KenGen to acquire National Environmental Manage-

ment Authority licence for the SEIA.

4. Summary of deliverablesThis study shall be compiled into the following separate reports:

a) A detailed feasibility study report covering the scope of the study

b) Procedures and templates for procurement of investors using the Specially Permitted Procurement Procedures.

c) Strategic Environmental Impact Assessment (SEIA) study report.

5. Mandatory requirements

a) Certificate of incorporation or equivalent (and any certificate of change of name), certified by an authorized representative of the bidder or (as the case may be) the consortium member.

b) Financial Statements for the last 3 years including Tax registra-tion and Tax compliance certificates or equivalent documents applicable in the bidder’s Country of origin. (For consortium arrangements, each member must meet the requirements).

c) List of consultancy services on similar studies, including a brief description of the study (scale and scope) and the status of the study.

d) A list of studies that the proposed team members including the team leader have experience relevant to this study indicat-ing the scope, responsibilities and duration of engagement for each team member.

e) Where the applicant is a consortium, a list of the proposed mem-bers of the consortium and the proposed Leader of the consortium and the roles of each member.

6. Eligibility and Documentation Requirements

The expression of interest must be accompanied by the consultant’s qualifi-cations, professional capabilities and details of past experience related to the requested consultancy services. This consultancy requires the services of com-petent firms knowledgeable in carrying out feasibility studies of industrial parks and preparing SEIA/ESIA study reports.

a. The eligible firms shall have: i) At least 10 years’ experience in industrial park development consultancy. ii) Demonstrate successful performance in carrying out at least three (3)

similar scope of work studies in the past 15 years. The consultant shall provide at least three references for consultancies carried on industrial park development.

iii) It is anticipated that Consultants responding to this EOI will be an indi-vidual firm or association. In case of an association, the members shall submit a declaration confirming their association (joint venture or

consortium) with indication of the Lead Partner of such an association. iv) Foreign consultant firms shall incorporate local consultants in their teams

in accordance with the statutory local content requirement. v) Demonstrate a strong & stable financial status by positive cash flows, net

worth and profitability for the immediate last 3 years.

b. Firms should submit Company Profile consisting of the following:i) Scope of services offered by the firm.ii) Name of firms that bid jointly (if applicable) should submit consortium

agreements between parties involved, duly certified by a law firmiii) Contact details of the firm; physical address, phone number and email

addresses.iv) Organization structure of the firm.v) Contact person with designation and contact details (physical address,

phone number and email addresses).vi) List of key staff relevant to the assignment and their profile (must be

composed of relevant staff with a mix of appropriate expertise). Pro-fessionals who are proposed must be registered as consultants with re-spective registration bodies and with experience in at least three similar projects.

Narok County has so far vaccinated 4,552 peo-ple against the Covid-

19 since the beginning of the vaccination exercise early last month.

Speaking to KNA , the County Public Health Officer Mr. Edward Oludaru Tankoi said, 848 of those who have received the first jab of vac-cination are health workers, 460 security personnel, 463 teachers and 1,752 others be-long to the other groups which the government had ear-marked for vaccination such as those above 58 years of age and those living with various health conditions which make them susceptible to Covid-19 complications. Tankoi said the county has so far received a total of 6,000 doses of the Coronavirus vaccine out of which more than 4,800 have already been used, but they are expecting more supplies from the main depot in Kitengela in Kajiado. The county is tar-geting to vaccinate close to 2,000 workers in the health sector including support staff and other priority groups such as teachers and secu-rity personnel. “So far, there is an increase in demand for the vaccine from the targeted groups, especially those over 58 years of age,” he said.

The County Public Health

officer said they have now opened another vaccination centre at Kilgoris Sub-County Hospital in Trans Mara West to serve the larger Trans Mara area and supplement the vac-cination centre at Narok Refer-ral Hospital.

The National Government received 1.02million doses of Coronavirus vaccine from Ox-ford AstraZeneca Company manufactured in India and a further 100,000 doses which came later for this first phase of vaccination against Covid-19 pandemic which is targeting frontline workers who are at the highest risk such as health workers, teachers and security personnel.

The government hopes to vaccinate about 30 percent of its population against the Coronavirus pandemic by mid this year.

Tankoi reiterated his ear-lier stance to residents and all stakeholders including health workers not to let down their guard in protecting themselves from the Covid-19 and advised wananchi to continue observ-ing the Ministry of Health guidelines on Covid-19.

“We should continue ob-serving all these ministry of health guidelines until such a time that the entire country is vaccinated or develop herd immunity,” he said.

1. The Government of the Republic of Kenya has received financing from the International Development Association (IDA) towards the cost of the Horn of Africa Gateway Development Project. The Kenya National Highways Authority, an imple-menting agency of the Government of Kenya, intends to use part of the proceeds of the credit to engage qualified and experienced firms to undertake Consulting Services.

2. The consulting services (“the Services”) include but are not limited to:

Conducting of Feasibility Studies, Environmental and Social Impact Study, Preliminary and Detailed Engineer-ing Design and Preparation of Bidding Documents for the Madogo Junction (A3/B89) - Garissa - Modika – Daadab - Liboi – Harhar (A3) Road Corridor approximate (211 Km).

The estimated number of person-months of key professional personnel for this assignment is 189 and the Project dura-tion will be 18 Months.

The Detailed Terms of Reference (TOR) for the assignment can be found at the following website: www.kenha.co.ke 3. The Kenya National Highways Authority, a State Corporation under the Ministry of Transport, Infrastructure, Housing,

Urban Development and Public Works established under the Kenya Roads Act, 2007, now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:

a. Firm’s competence and experience in terms of successfully delivering similar assignments in Design Review, Detailed Engineering Design and construction supervision of bridges and highways in similar countries and preferably in Sub-Saharan Africa (SSA). Specific experience of successful completion of minimum three (3) similar nature and complexity assignments within the last ten years is required. The nature and similarity of the assignments includes Design Review, Conducting of Feasibility Studies, preparation of Social and Environmental Safeguard Instruments, Detailed Engineering Design, Preparation of Bidding Documents, Supervising Environ-mental and Social Impact Management Plans to International Standards in addition to the technical engineering and contractual management role.

b. Applicant firm’s institutional, Technical and Managerial capabilities, as demonstrated through the firm’s financial and technical strength and established quality management systems and reputability;

c. Suitability and relevance of area of core business of applicant firm to the envisaged assignment and number of active years in similar business;

d. Experience in similar conditions (in low middle-income countries and in Sub-Saharan Africa) would be an added advantage; Key Experts will not be evaluated at the shortlisting stage.

4. The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s Procurement Regulations for IPF Borrower’s, Fourth Edition, November 2020, (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.

5. Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the as-sociation is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected

The formulation of the Inter-county Physical and Land Use Development Plan will be overseen by the Inter-County Joint Physical and Land Use Planning Committee consisting of the respective County Executive Committee Members responsible for physical and land use planning matters, two other relevant County Executive Committee Members, copted representatives from the relevant National Government Ministries, Departments and Agencies (including the Konza Technopolis Development Authority) and the Director-General of Physical and Land Use Planning who shall be the ex-officio member ad coordinator of the planning activities.

The formulation of the Inter-county Physical and Land Use Development Plan will largely entail the review of the Approved Development Plan No. 03 (Konza Techno City Buffer Zoning Plan Ref. No. 2564/2013/01) and will adopt a highly participatory and consultative process.

Now therefore, in view of the foregoing and in order to safeguard the integrity of the physical and land use planning practices in the subject areas, it has been decided and hereby declared that all developments be suspended for a period of ninety days with effect from the date of this Notice. For avoidance of doubt and to ensure clarity, this suspension will apply to:

1. All proposals for subdivision and amalgamation of land, change of user as well as extension of user that are yet to be registered under the Land Registration Act, 2012.

2. All building plans and proposal civil works that are yet to be commenced.

Further, all development proposals that have been processed and approved as required under the provisions of section 58 of the Physical and Land Use Planning Act, 2019 stand suspended until completion of the formulation of the Inter-county Physical and Land Use Development Plan upon which such approvals will be reviewed as appropriate.

Governor Anne Waiguru said that in a partnership of the County Government and the National Agricultural and Rural Inclusive Growth Pro-ject (NARIGP) Project, 62 dairy farmers groups have been sup-ported with Sh. 31 million for improvement of dairy cattle breeds through artificial in-semination and on-farm feed formation and silage making.

Ms Waiguru said improv-

ing the county’s cattle breeds, which will be done in col-laboration with Kenya Ani-mal Genetic Resources Center (KAGRC), will enhance milk production and ensure that dairy cattle have a stronger immune system. “The ulti-mate goal of this program is to ensure that farmers increase their milk production and get more value from it so that they can uplift their living stand-

ards,” said the governor. She noted that the county was aiming at increasing milk pro-duction from the current daily

average of 4 litres per farmer to about 13 litres which she said would be made possible through the improvement of

the existing cattle breeds. The governor added that another Sh. 27.5 million will go into the installation of semi-automated yoghurt production units for Rung’eto and Kirima Dairy Farmers Cooperative Societies, installation of a 150KV power backup generator and its hous-ing for Podago Dairy Farm-ers Cooperative Society and procurement of a 10,000 litres milk hauler for Rung’eto Dairy Farmers Cooperative Society. Kirima Dairy Cooperative So-ciety Manager, Beth Kariuki, has said that the support will go a long way in enhancing the productivity of the society.

Pursuant to provisions of the Excise Duty Act, 2015 and the VAT Act 2013, Kenya Revenue Authority wishes to remind all manufacturers, importers, distributors, wholesalers and retailers of excisable goods and members of the public, to take note of the following:

1. It is an offence to manufacture, offer for sale or be in possession of excisable goods not affixed with excise stamps or affixed with counterfeit stamps. Members of the public and all persons who deal in excisable goods are encouraged to use the SOMA LABEL APP available on Apple Store and Play Store to check the authenticity of excise stamps.

2. It is an offence to distribute, offer for sale or be in possession of any excisable goods manufactured or imported by unlicensed persons. The updated list of licensed manufacturers and importers of excisable goods is available on the KRA website: www.kra.go.ke

3. Manufacturers of packaging materials are reminded that it is an offence to produce counterfeit packaging materials or to manufacture packaging materials for packaging excisable goods without the authority of the licensed manufacturer of the excisable goods.

4. All VAT registered suppliers are reminded of their obligation to issue tax invoices upon sale or delivery of taxable goods and services. Distributors, wholesalers, retailers and members of the public are urged to demand for proper tax invoices upon purchase of goods and services.

KRA would like to remind all persons that non-compliance with the law will lead to imposition of sanctions and penalties as provided by the tax laws which may include; prosecution of offenders, closure of premises, seizure of excisable goods and their destruction at the cost of the offender.

Nakuru County govern-ment has purchased two

modern firefighting engines worth Sh150 million as it seeks to strengthen its disaster re-sponse preparedness.

Governor Lee Kinyanjui said his administration was keen on having a functional fire de-partment to serve and protect the fast-growing investments in the region.

Speaking to KNA at his of-fice, Mr Kinyanjui revealed that the county has set aside a further Sh165 million to re-vamp the fire department.

“When we came into of-fice, the fire department relied on only one fire engine and a water bowser truck which was in a poor state. We are putting efforts to strengthen the de-partment, as well as establish-ing a regional disaster response system for Rift Valley region counties,” he explained.

The new engines are fitted with a 13m ladder as well as cutting machines that are used to cut metals especially when rescuing passengers trapped in vehicles after accidents.

“Our aim is to have each of the eleven sub-counties

equipped with a fire engine. This is just the beginning of the implementation of the initia-tive,” said the Governor.

Mr Kinyanjui observed the new engines will initially be stationed in Nakuru town, but would serve all the eleven sub-counties.

He stated that he would rally the County Assembly to con-sider purchase of a third en-gine in the next financial year budgetary allocations.

“This is a major step in our disaster preparedness plan, given that there is enough water supply in Nakuru town,” said Kinyanjui, adding, “We are now firmly on the route to a functional fire department

to protect investments in our county,” observed Mr Kin-yanjui.

According to the County Chief Officer for Disaster Man-agement and Humanitarian Assistance, Anne Njenga 30 firefighters have undergone a two-week training session at the Kenya Pipeline Company’s (KPC) Morendat Institute of Oil and Gas in Naivasha on disaster response, fire fighting and rescue techniques .

Ms Njenga stated that the County is partnering with state agencies and humanitar-ian organisations to train com-munities on safe fire and flood handling techniques to avert disasters.

With the enactment of the Scrap Metal act No. 1 of 2015 and the establishment of the scrap metal council the act became fully operationalised as stipulated in section 6 subsections (1) of the act. Under section 9 subsection (1) of the scrap metal act, a person shall not deal in scrap metal unless that person has a license issued by the council and is a member of the Scrap Metal Dealers, Smelters or a Manufactures Association.

A person who deals in scrap metal without a license commits an offence whose penalty is as in section 9 sub section (2).

Government to partner with private sector to revamp aquaculture farming

BY BY JANE NAITORE (KNA) The Government will part-

ner with the private sector to provide a ready market for aquaculture products by op-erationalizing fish plants es-tablished under the 2009/2013 Economic Stimulus Program in four Counties in the country.

To Achieve this, the Depart-ment of Fisheries, Aquacul-ture and Blue Economy has kick started the re-stocking the Opapo fish Plant in Opapo ward, Rongo Sub County in Mi-gori County with 30,000 Nile Tilapia fingerlings.

Making the announce-ment the Principal Secretary Dr.Francis Owino said the sec-tor also go out of its way to sup-plement lake fish which is

under massive exploitation due to the increasing demand of the commodity in the country.

According to Dr. Owino, the fish plants which have in-creased in 15 counties will not only provide ready market and offer feeds at affordable cost, but will also stop the women from being exploited by their male counterparts who demand for sex in exchange for the commodity, commonly known as ‘sex for fish vice’.

The vice has been cited as one of the major bottlenecks in the

fight against HIV/Aids preva-lence in the counties which have been rated among the highest in the country.

Opapo plant which is being revamped in partnership of the RIO Fish Company and the County government of Migori has already started receiving fish from farmers and doing value addition before it is resold to traders.

RIO fish Company Direc-tor Nixon Shikuku says the company is a social enterprise that specializes in solving the challenges of fish farmers by offering market, value addi-tion to the commodity, capac-ity building to farmers and fish feeds at affordable prices.

Shikuku says the company which also has fish cages in Lake Victoria has a capacity of producing more than 168 met-ric tons of the commodity an-nually, although it has so far managed 60 tons worth sh.18 m.

“Once we are able to produce full capacity, the plant will contribute to more than 1% of the country’s production which currently stands at 30,000 metric tons, but is supposed to be 100,000 tons,” he says.

The plant has been in opera-tion for the last six months and is locate 8km from Rongo town

towards Migori, along the Kisii- Migori- Isebania highway.

It is currently offering deep fried, smoked, and grilled fish to traders who sell the commodity in the neighbor-ing Kisii, Nyamira and Hom-abay Counties for domestic and institutional consump-tion.

A restaurant is also based at the plant premises to offer traders and travelers a fish eating experience of differ-ent fish dishes including fish pizza and samosas among other local dishes.

The Plant, Shikuku says, has helped empower women and youth through job creation, and aquaculture farming activities besides improving nutrition and therefore health of the popu-lation who are avoiding bad eating habits.

The restaurant’s Proprie-tor Bob Okello says reiterates Shikuku’s sentiments that the plant has been however affected by the impact of Covid19 pandemic including fish supply now that fisher-man are not able to get the best catch which occurs at night when the curfew in place.

State agencies are up in arms against graft in Kenya, through collabo-

rations meant to stir citizens’ adherence to integrity as well as unlock government rev-enue.

In the anti-graft campaign, the agencies are applying a 360-degree strategy, sealing corruption loopholes and im-plementing systems that dis-courage corruption.

The Ethics and Anti- Cor-ruption Commission (EACC), Kenya Revenue Author-ity (KRA), Assets Recovery Agency (ARA), Office of The Director of Public Prosecu-tions (ODPP), Directorate of Criminal Investigations (DCI), Financial Reporting Center (FRC) among other agencies through the Multi-Agency Taskforce Team on Corruption (MAT) have been agile in ac-tualizing President Kenyatta’s initiative of fighting corrup-tion in the country.

High value arrests and raids have been made through col-laborations promoted by the multi-Agency framework, in the graft war, executive shifts conducted and beyond that, strategic initiatives and tech-nologies used to curb graft and streamlining revenue system, a move that is currently pay-ing off.

Recent progress is dem-onstrated by KRA’s efforts in surpassing monthly collection targets, for the fourth time in

a row. In the month of March, KRA collected Sh.6 billion, the highest revenue performance rate since the beginning of the Financial Year. This was de-spite a challenging economic environment brought about by Covid-19.

Compared to the Febru-ary collection which stood at Sh.127.7 billion, with a per-formance rate of 105.1 per cent the March collection grew by 11.2 per cent, with a surplus collection of Sh 6.6 billion.

The Authority, like other agencies, has been keen on implementing a number of revenue enhancement meas-ures, cognizant of the prevail-ing effects of Covid-19 on the business environment. The measures, which promote compliance and discourage tax evasion, are now paying off. Top above all goals for KRA, has been sustained im-

plementation of compliance efforts, revenue enhancement initiatives and improved ser-vice delivery to taxpayers.

There has been a relentless focus on pending bills, non-compliant suppliers/with-holding agents/importers, and dispute resolution mecha-

nisms to meet the revenue tar-gets. Since prosecution is one of KRA’s enforcement meas-ures, KRA continues to charge perpetrators in Court when all efforts fail. Last year alone, 122 cases were taken to Court on various tax offences for con-travening The Tax Procedures Act and The East African Com-munity Customs Management Act (EACCMA). The cases had a tax implication of Sh. 12.9 Billion. Out of these cases, 29 have since been completed. KRA attributes this progress to the government good-will that comes from MAT collabo-rations. The ODPP through the framework has ensured a high prosecution rate, with the ju-diciary ensuring that there is closure of all such cases taken to Court.

The Ethics and Anti-Cor-ruption Commission, the anchor agency in the fight against graft has enhanced its resolve to pursue high value corruption cases. The Agency has taken high pro-file cases to court, including former officials of the defunct Rural Electrification Author-ity (REA) over procurement irregularities in the tender for solar electrification of public primary schools worth over Sh.100 million, former sen-ior officers at the Lake Basin Development Authority who have been charged for engag-ing in a project without prior planning and conspiracy to defraud.

During crises, communica-tion plays a key role in terms of engaging the public in order to inform them on the effects of a particular crisis and steps taken to manage and control that cri-sis.

The importance of effective communication is amplified further when public participa-tion is needed to tackle the crisis at hand.

After the report of the first COVID-19 case on 12th March, 2020, the Government em-barked on daily media briefs that have been quite instrumental in raising awareness among Ken-yans on the pandemic.

There is no doubt that major-ity of Kenyans have basic aware-ness on the disease. Despite this general awareness, Kenyans still

engage in risky behaviours that expose them to the hazards of the disease.

A section of Kenyans still hold Ministry of Health (MOH) guide-lines towards combatting the spread of COVID-19 as govern-ment-enforced directives and only adhere to them to escape the possible legal implications of violation.

For example, most Kenyans use facemasks to avoid being nabbed by the police rather than to protect themselves from the COVID-19. Addition-ally, observing social distance has proven to be an uphill task for most Kenyans, as evidenced by sheer disregard for govern-ment’s directive on social gath-erings. This implies lack of risk awareness.

The MOH has rolled out a

comprehensive Risk Commu-nication and Community En-gagement Plan that has been cascaded to the counties for im-plementation. It is expected that the counties adopt this Plan and adapt it to address the unique risk awareness needs of their re-spective communities.

The term “community” as Renata Schiavo explains in her book; Health communication: from theory to practice indicates “ a variety of social, ethnic, cultural, or geographical asso-ciations, for example, a school, workplace, city, neighbourhood, organized patient or professional group, or association of peer leaders,” to name but a few.

If the counties take up the challenge and implement the plan to the latter, it will influ-ence the risk perception of

the communities at large. The plan should rely on messaging tailored to Behaviour Change Communication model that maximises on stakeholder en-gagement and community par-ticipation to the grassroots level.

In addition to the local mass media channels like community radios and vernacular radio sta-tions, local National Government Administration Officers (NGAOs) and opinion leaders at the com-munity level must be involved in sensitising members of the com-munity on COVID-19 risks.

The community should en-courage each other on COVID-19 prevention and care. This can be best achieved through applica-tion of conventional and non-conventional communication channels to improve COVID-19 risk perception among Kenyans.

Page 22: Government sets aside Sh.2.28b to support drought stricken

The Germany government has extended a financial grant of Sh 830million towards the empowerment of Kenyan youth under a new project dubbed Vi-jana Vuka Na Afya (VIVA) to be launched soon.

The multi million grant to be channeled through the German Development Bank (KfW) is a product of a technical coopera-tion agreement between Kenya and Germany.

PS State Department of Youth Affairs Mr Charles Sunkuli and KfW Senior Program Officer Benjamin Graedler signed the agreement and agreed on the implementation road map of the project in Nairobi.

The new initiative will benefit youths aged between 15 to 24 years in Kisumu, Mombasa and Nairobi informal settlements for a peripd of 3 years.

Speaking during the cer-emony, Mr. Sunkuli the gov-

ernment envisages that over 100,000 will benefit from the Vijana Vuka NA Afya Pro-gramme through services that will be delivered through an IT platform as a voucher service that will enable young peo-ple access heath, vocation and technical training.

The PS said a further 60,000 youth will benefit from entre-preneurship training under the same programme.

Mr Sunkuli explained that

the first component will in-volve information provision to raise awareness on sexual and reproductive health through education materials, entrepre-neurship and life skills training courses.

He added that the compo-nent will also have sporting activities, and support to youth clubs, youth empowerment centres, training of service pro-viders on healthy behavior and youth friendly services.

An interim Sugarcane Pricing Committee con-stituted by the Ministry

of Agriculture, Livestock, Fish-eries and Cooperatives has ap-proved an increase in the price of cane from the current Sh.3, 700 per tonne to Sh4, 040 per tonne effective April 1, 2021 in line with the Industry Cane Pricing Formula.

Consequently, Cabinet Sec-retary (CS) Peter Munya di-rected millers to adhere to the new prices while making pay-ments to the farmers adding that any farmer being paid less should report the miller to the Ministry.

“Any cases of non-compli-ance will attract a fine of not less than Shs500, 000 or one year imprisonment in line with Section 37 of the Crops Act, 2013,” said Munya.

Speaking at Kilimo House while giving an update of the sugar sector, Munya said that sugarcane prices to farmers had stagnated at Sh3,700 per tonne since the last review by a similar committee in 2018.

Munya highlighted that there has been a lot of concern from the farmers on the inability of the millers to harvest their cane on time and this has in turn led to delays in cane harvesting and in some instances sugarcane of up to 48 months still remained unharvested in the fields.

“My Ministry through the Agriculture and Food Author-

ity (AFA) held consultative meetings with millers from the affected areas with a view to coming up with agreeable solutions and there was an ur-gent request by the millers for the government to roll out the implementation of the Crops (Sugar) (General) Regulations, 2020 whose impact would be coordination of the sugar sec-tor and create linkages between

millers and growers,” said Munya.

The CS further said that they have put in place a sensitization cum registration exercise of growers through print and elec-tronic media in a bid to reach out to the ‘independent grow-ers’ whose cane is not captured in the mill harvesting program.

Munya said that millers were encouraged to enhance their

capacities where possible with special request for the govern-ment to fund the rehabilita-tion of state owned mills which would otherwise lead to ab-sorption of the excess sugar-cane.

“We have also witnessed enhanced capacities by some private millers through setting up of new sugar mills, for ex-ample, West Kenya Sugar Com-pany – Naitiri Unit in Bungoma County, is 80% complete and targets commissioning in Au-gust 2021. This would greatly enhance absorption of cane in the area and neighboring catchment,” said Munya.

He added that there are other applications for setting up of new sugar mills in Siaya, Kilifi, Kisii, Uasin Gishu and Tana River Counties.

Munya said that the sugar industry has steadily expanded over the years with the area under cane having increased from 126,826 hectares in 2002 to 202,616 hectares at the end of 2020 signifying an increase of 60%.

Munya, however noted that increase in population has had an upward push in sugar con-sumption outpacing domestic production.

“The country has not reached self-sufficiency in sugar pro-duction. For this reason, the country will this year be filling the deficit by importing sugar, especially from the Common Market for Eastern and South-ern Africa (COMESA) region.

Sugarcane growers enjoy better pay as new pricing rule comes into force

The county government of Kirinyaga has disbursed Sh 3,081,000 to assist needy students pay school fees. Out of the kitty, Sh1,615,000 went to secondary school students, Sh990,500 to university students and Sh 475,500 to students in ter-tiary institutions. While distributing the bursary cheques to selected students among the beneficiaries, Governor Anne Waiguru said the funds will benefit 179 sec-ondary school students, 50 university students and 22 college students. Beneficiaries in second-ary schools were awarded between Sh. 5,000 and Sh. 10,000, while university and college students got between Sh. 15,000 and Sh. 30,000 depending on the need of the student. Waiguru said that the bursary fund is aimed at enabling stu-dents from poor backgrounds to remain in learning institu-tions after enrollment. She noted that the disburse-ment was in addition to the Sh110 million bursaries given to about 40,000 students earlier in the year. “My government remains committed to supporting the education of our children, the improvement of academic performance in our county

and ultimately, the lives of our youth,” she said The governor also appealed to all the county residents to strictly adhere to the laid down Covid-19 prevention measures, such as wearing masks properly whenever in public, washing hands regu-larly and observing physical distance. She said Kirinyaga county has registered a total of 530 Covid-19 cases since the outbreak of the pandemic, with 436 and 24 patients successfully recovering from home-based care and isola-tion centers respectively. “Currently, 4 patients are un-dergoing treatment in isola-tion centers while another 27 are recovering under home-based care. The county has lost 9 people to the disease, two of them dying during the current wave,” the Governor said. Waiguru also noted that the county had on Wednesday received an additional 6,000 doses of Covid-19 vaccine making a total of 11,000 doses that the county has re-ceived so far. County gives Sh3m worth of bursaries to needy students

A number of farmers in Mi-gori County are now engaged in serious cage farming to tap the huge fish resource in Lake Victoria. With the current dwindling fish stocks in the expansive fresh water lake, individual farmers and large scale traders in the area are now engaging in growing fish in cages and registering good earnings.Statistics from the local fish-eries offices indicate that a total of 55 cages have been established on the Lake side of Migori region alone to date and are fetching good earn-ings to the owners, mainly individual farmers and well-organised firms.For instance, during the 2019/2020 financial year, cage fish farmers from the re-gion earned a combined sum of over Sh2.5 billion within that period from over 5,000 metric tons of fish sales.County fisheries lead techni-cal officer Mr. Stanley Mu-loma said, although some of the cage farmers within the four wards of Nyatike
